I have been unemployed since XX/XX/2023 and was barely making my payments with my unemployment, but I made it work because on time payments have always been a point of pride for me when it comes to my credit. Unfortunately, my unemployment ran out in XX/XX/2023 leaving me with XXXX income to make payments. I spoke to XXXX people at Tally and let them know what my situation is. The people I spoke to on the phone were very kind and understanding and they are NOT the issue here. Fast forward to XX/XX/2023 and I've finally found a job. I have ( and still do ) every intention of paying my creditors back and getting back on track. I made a payment for XX/XX/XXXX which Tally was happy to take, no questions asked. However, yesterday I received an email saying I could not make any payments unless it was via autopay. I was saying, here take my money! And their response was essentially, umm no thanks jump through hoops first. There's an inherent risk that any borrower will default. I understand that, and that's why I spoke to two Tally employees about my situation, letting them know WHY and where I am at in the process to getting back on track ( aka, I'm not enjoying being unemployed and I'm actively working on finding a job! ) I tried to offer some understanding to Tally on how I'm mitigating the risk to the company AND to my personal credit score. Now I'm not sure any notes were placed on my account because the way I'm being treated is condescending, unfair, and abusive. On the flip side, Tally wants to get paid, right? Tally believes that inconveniencing customers, who already made one payment to get current, by forcing them to use autopay when the customer is clearly uncomfortable with it ... and Tally thinks this is the best course of action to get paid? Again, I'm saying here let me make another payment, take my money, and Tally said NO. That's crazy to me! I don't like autopay, I have never used it and I don't intend to use it going forward. It's not my thing. Before I lost my job I made 100 % of my payments to Tally and all of my other creditors on time. Without autopay. I don't like it, I'm not comfortable using it, and I should not be forced to do so. What happens if Tally tries to pull funds before I get paid ( maybe every employee at Tally is well off, but I live paycheck to paycheck ) and I incur a fee at my bank? Is Tally going to reimburse me for that fee because they've forced me to use a service against my will? If the money isn't there, Tally doesn't get paid and I've incurred a fee. NO ONE WINS in this scenario. Tally is trying to cover their butts because they're a business and the bottom line is not the customers but the money. But again, forcing someone into autopay does not guarantee you'll get a payment and frankly it's just forcing a loyal customer to hate your business and use my first amendment rights to shout it from the rooftop how I feel. There's a risk of default sure, but I think companies also forget about reputation risk. It's a thing. Because I was not given an option, I did set up autopay for one payment that is to come out on the XXXX. However, I don't intend to keep it indefinitely and I've already notified the company in writing that I revoke authorization after this one payment on the XXXX, as is my right. In anticipation of this being a fight with Tally, I am going to reach out to my bank after the XXXX to notify them that Tally can not initiate any further automatic withdrawals. In the meantime, I am prepared to make regular one time payments as I had been doing before I lost my job and unemployment. According to UDAAP regulations, an act or practice is unfair when, among other things : 1 ) It causes or is likely to cause substantial injury to consumers ( this is where the fee that could be incurred for me being forced to sign up for autopay. " Substantial '' would come into play if Tally requires this of everyone in this situation, unless they're just applying it to me in which case I have a lawsuit on my hands! ) 2 ) the injury is not reasonably avoided by consumers ( if I'm being forced into this, how can I avoid it? ) 3 ) The injury is not outweighed by countervailing benefits to consumers or competition. ( please explain to me where the benefits are? ) An act is abusive if it takes unreasonable advantage of, among other things : The inability of the consumer to protect its interest in selecting or using a consumer financial product or service. I want to pay Tally, but I am being forced to use a financial service that I am firmly against using. I have always prided myself in having a decent credit score and I've had a perfect payment record up until two months ago. I'm pretty sure me paying Tally means more to me than Tally does because every financial institution has money set aside for losses. I'm happy to work with Tally and make my payments, I just need to not be emailed and talked to in a condescending manner, nor forced into anything. I may just be an account number to you, but I am a person. Regarding the account number. It's impossible to find on the app and website. It's not on the statements either. Maybe look into that as well.

XXXX XXXX and TALLY TECHNOLOGIES, INC have taken adverse action against me, with forethought and malice, by furnishing inaccurate and knowingly false late payments to my consumer report without my lawful authority and XXXX has done nothing to rectify the situation even though I've provided ample opportunity to do so, making them WILLFULLY NONCOMPLIANT. This adverse action as defined under 12 CFR 1002.2 ( c ) ( 1 ) ( i ), which has the same definition as 15 U.S. Code 1691 ( d ) ( 6 ), has negatively affected my ability to extend credit and operate in commerce. Congress makes it clear that causing a restraint of trade or conspiring to cause a restraint of trade, pursuant to 15 U.S. Code 1, is declared to be illegal and carries both civil and criminal penalties. My right to privacy and my right to know where and how to direct the disclosure of my nonpublic information in accordance with 15 U.S. Code 6801 ( a ) of the Gramm-Leach Bliley Financial Protection Act, has been flagrantly violated. There is NO LAW that states that they are required to report derogatory items to a consumer credit report or file and 15 USC 1681s-2 ( 7 ) ( E ) very plainly and clearly states that. These companies do this anyways to coerce and extort you by threatening your financial reputation and causing undue strife and XXXX XXXX preventing me from obtaining credit that is my right and regulated under Federal law! I am aware that not excluding transactions between, I, the consumer, and the creditor is a violation of 15 U.S. Code 1681a ( 2 ) ( A ) ( i ). If you notice in the attached files ( exhibit A ), TALLY TECHNOLOGIES, INC chose not to furnish ANY positive payment history, further proving they are acting maliciously to coerce repayments on alleged debts. XXXX was not exercising its grave responsibility with respect to impartiality when furnishing this false and misleading information to my consumer report. Reasonable procedures were not taken to ensure the accuracy of the information given by XXXX XXXX or TALLY TECHNOLOGIES, INC before furnishing it, and requested documentary evidence was not provided to prove that they had even performed a substantial investigation. This very clearly shows that XXXX has shown bias towards me because I never gave my lawful authority to any consumer reporting agency or financial institution, let alone XXXX, XXXX XXXX, or TALLY TECHNOLOGIES, INC to furnish any late payments to my consumer report. It is my undoubted belief that due to TALLY TECHNOLOGIES, INC and XXXX XXXX 's business relationship with XXXX, this consumer reporting agency literally parrots any information given to them as a means of conspiring together to coerce consumers to pay extra fees for debts that they allegedly owe. They have come up with an elaborate scheme to con consumers out of their hard-earned money through fraudulent practices and not only is this actual extortion this appears to be racketeering. I intend to file a criminal suit against ALL PARTIES involved in what transpired under the RICO act which is punishable by law, up to 20 years. I'm a litigious consumer and have no problem exercising my rights to the fullest extent.

Roughly 2 years ago, I signed up with a company called Tally to chip away at some credit debt I'd racked up in college. The first round was successful and I paid everything off in full. I thought I was done with Tally as everything has been paid off ... ... About a year and a half later, I had some more credit card debt I was getting ready to enroll in a similar company ( they were offering a better service for CC debt repayment than Tally ). Before I could enroll my CC debt with my chosen company, Tally AUTO-DRAFTED 100 % of my personal CC debt from my bank account into an account with them! ( Without my active permission of course. ) Since then, I've been actively trying to get Tally to REVERSE the enrollment so I can handle my CC debt on my own terms ... I've contacted my bank, I've contacted Tally 10 's of times, even my chosen debt relief company to see if they can intervene somehowall to no avail. The worst part is, over the past 6 months of actively trying to get this resolved, Tally has been reporting negatively on my credit!!! I have more than 9 late payments and 4 negative marks on my credit due to Tally NOT AGREEING TO REVERSE THEIR AUTO ENROLLMENT AND REFUSING TO ADDRESS MY SUPPORT REQUESTS!!! It's been incredibly frustrating and of course the damage to my personal credit score has been detrimental ... Hoping to come to a resolution here ...

Three months ago I decided to have a unified platform to monitor my credit cards. I came across Tally on their website www.meettally.com. I downloaded the app and created a profile. The company suggested me a line of credit. I completed the application and did not use the account at any time. Few weeks later, I began receiving multiple email and text messages claiming payment. I ignore them because I never used a credit card without full knowledge. They persisted and when I called, I was informed that Tally had paid my credit cards XXXX XXXX XXXX XXXX ) on my behalf. I asked when and why. I was told that that's how they work. I replied that I never asked for such service therefore will not be responsible for any such debt. I proceeded to call XXXX XXXX XXXX and was informed that my credit card was overpaid. That was shocking to me. I asked XXXX to send the money back to the company that paid it. The bank declined so I requested that they close my account if I am not protected from predatory landing. Tally company is now harassing me with phone calls and text messages. The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.

Tally obtained my credit information through false advertising and I unknowingly entered into a predatory lending loan. I signed up for a congruent balance transfer line of credit, not a loan. Also initially Tally was not reporting on my credit when I joined. I was under the impression my balance with Tally was XXXX XX/XX/XXXX and I was blindsided with a near {$5000.00} balance. In 2020 Tally began to report on my credit due to a California ordinance. I am requesting Tally to remove its reporting from my credit file as I never authorized the reporting to my credit file. I was not forwarned nor received an email or letter about the change. XX/XX/2020 ; I informed Tally, my company is purchasing an {$8.00} XXXX dollar commercial building for my company headquarters in which Stellar credit is required. A Tally balance is reporting on my credit as of XX/XX/2020 I need it removed immediately.

I hope all is well I know I qualify for the loan with Tally I checked all the guidelines several times on line. My credit score is good its XXXX and I have not ever been late on anything on my credit my whole life and Im XXXX. Im not for sure what is going on but I would really like 3 or 4 of my credit cards paid off so I would have XXXXne payment instead of several. I have unfrozen my XXXX account several times and I even wrote them a certified letter to unfreeze and they keep saying its unfrozen so Im not for sure what the issues really is. This really needs to be look in to because I know I qualify so Im not for sure why when I have tried several times to get the loan I havent received it. I can assure you that I qualify for Tally. I signed up for an account with Tally after watching an ad on TV that said they can help with credit card repayment. I go through the process and every step of the way they say its a completely automatic program that reduces interest while paying down my credit cards with an easy to follow plan. Once I agree to their account credit line to start the process, and their additional annual fee of {$300.00}, I find out that my credit cards are not actually supported by their program at all and encounter multiple issues trying to get them linked. After contacting Tallys support team, they try to push off the blame onto their credit card processor and offer no further support on how I can get the platform to work as it was sold to me. Now I have a new credit line on my credit report that I wont be able to use without significant hassle that was sold to me under false pretenses.

I opened up a line of credit with Tally Technologies and the debt has been canceled. XXXX is the only agency still reporting this debt to my credit report. XXXX. According to 15 U.S. Code 1681 - Congressional findings and statement of purpose ( a ) Accuracy and fairness of credit reporting : The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. XXXX is the only agency reporting this account. XXXX. I received a copy B of a 1099C showing that the debt has been canceled. This is inaccurate reporting and should be removed.

I included this line of credit in a XXXX XXXX bankruptcy in the state of Virginia. I filed in XXXX of XXXX and received my discharge in XXXX of XXXX. This account was verified included and Tally would not update my credit report in a timely manner. I emailed Tally approximately 9 times before I received a timely response to update their information on my XXXX report. Tally finally updated my report to reflect the account as discharged through the bankruptcy and still to this day sends me constant payment due date reminders and past due amounts for this account via mobile push notifications. I can not close the mobile account with a balance due. This is against FCRA requirements as this is considered contacting me in attempts to collect a debt thats been effectively discharged through a XXXX XXXX bankruptcy.

On XX/XX/2020, I paid off my loan in full with Tally Technologies. They said that my credit report would be updated within two weeks with the account being paid off. On XX/XX/2020, the " paid off '' account status still did not appear on my credit report, and the account showed an incorrect and old balance from over a year ago ( much higher and therefore affecting my credit score ) on the credit report. I emailed asking for corrected information. On XX/XX/2020, Tally Technologies reported my account as " Charged-Off. '' This is extremely incorrect and fraudulent. Not only has Tally acted in fraud and bad-faith, they have been usurious in their interest charges before the account was paid off. They should be investigated for their credit reporting practices, which are NOT in compliance with the FCRA.

I had registered for tally line of credit and added a unsupported card on my account to get the tally limit but I never expected tally to make an payment to my card due to it being unsupported plus the payments being made were set as " you pay '' tally made the payment without my authorization but I'm trying to get the cardholders company to return the payment to my tally account but it is taking longer than usual and tally is reporting the account as late payments on my credit report... it is not my responsibility to correct their mistake but I have tried to get them to get the money back because I never authorized it but they refused to help me again and again.

XXXX XXXX is the name of the company. It is an app that is designed to help people get out of credit card debt. They have marked a late payment on my XXXX credit report two times. The first time I asked them to take it off after making a payment to them of over {$1000.00}. I had some financial difficulties and after paying the large amount asked them to remove it. The second time, was on XX/XX/2022. I had paid what was due on XX/XX/2022. This was NOT a late payment. I asked them to remove it and they said they would not. Both late payments need to be taken off my credit report.

My identity was stolen. Someone made purchases and obtain accounts in my name! The issue was reported to the federal government ( FTC ) as well as the credit bureaus and each company. The companies honored the removal requests after reviewing the appropriate documents, however, those same companies sold the accounts to debt collectors or other debt buying companies, and now the accounts are reporting again under new companies. Its devastating to say the least!

A month ago I got my first house. and during the credit review process, it appears that I owe a line of credit debt to a company called Tally technology. which I do not know has requested a line of credit with them! In according with the Fair Credit Reporting Act this creditor has violated my rights under 15 USC 1681 section 602 states I have the right to privacy ( 15 USC 1681 section 604 section 2. It also states a consumer reporting agency can not furnish an account without my written instructions under 15 USCS 1666b a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose

A creditor is reporting on my credit report late payments every month from XX/XX/2021 to now XX/XX/2021. In XX/XX/2021 that reported an on time payment. I pay my bills on time every month and need these negative accusations removed from my credit report.
