My second lien home loan was transferred to SW Linear Investment Group , LLC from XXXX XXXX XXXX on XX/XX/XXXX. I requested a pay off from SW Linear Investment Group , LLC and was provided 3 different amounts within a few days of each other. I felt each time the amount provided was inaccurate and I expressed my concern to SW Linear Investment Group , LLC ; Account Number : XXXX XXXX XXXX Property Address : XXXX XXXX XXXX XXXX, TX XXXX When expressing my concern I requested a payment history for the life of my loan. XXXX XXXX who is a representative for SW Linear Investment Group , LLC stated in XX/XX/XXXX that my loan was behind 8 payments when my loan was transferred to them. Again, I requested to see this information in writing vs. being communicated this information. After receiving conflicting information from SW Linear Investment Group , LLC I expressed that the amount they stated I owed did not appear to be accurate. Then I was advised by XXXX XXXX that my loan was behind 8 payments when my loan was transferred over. However this is not accurate, I was not behind any payments. I actually reached out to XXXX XXXX, XXXX, and provided proof that my loan was current when my loan was transferred to SW Linear Investment Group , LLC. I forwarded this communication that proved I was not behind any payments to XXXX XXXX, however XXXX XXXX refused to respond to my communication. I continued to express that my starting balance from where SW Linear Investment Group , LLC began to service my loan was wrong, and should have been lower than what was being reported. I further expressed I was not behind when my loan was transferred. I additionally expressed that the payoff provided to me was inaccurate. Each request in writing via company email, fax, mail went unanswered. My communication has been with the following SW Linear Investment Group , LLC : XXXX XXXX Her email signature reads : XXXX XXXX XXXX Linear Investment, LLC Linear Mortgage , LLC XXXX XXXX XXXX XXXX, FL XXXX XXXX XXXX XXXX XXXX XXXX, that XXXX XXXX XXXX XXXX did not provide my full file when they transferred the loan to SW Linear Investment Group , LLC ; and recorded she states, they have requested my file since XXXX from XXXX XXXX XXXX XXXX and have yet to receive my file. So therefore they do not know if they amount of loan remaining that was transferred over to them is accurate or not. I expressed since they purchased my loan and my loan was transferred over to them, they were responsible for gathering this information. Once again, I demanded this information from SW Linear Investment Group , LLC since they are my new loan servicer. I also communicated per my records my loan should be released in full, and I demanded release with no response. I have not received any communication from SW Linear Investment Group LLC since XXXX. I have not received monthly statements, calls or anything. My calls go unanswered, my letters to them go unanswered. Finally today I was able to get through, to XXXX XXXX at 2:30 p.m. XX/XX/XXXX after initiating calling them today, I was told that they are still waiting for XXXX XXXX, XXXX to provided them information since XXXX ; and no one followed up on the information. I then asked XXXX XXXX, to whom was SW Linear Investment Group LLC licensed with to service my second loan. I expressed I wanted to file a complaint. XXXX XXXX then put me on hold for a very long time. Upon her return to the call, she communicated she did not know who the company was licensed with. She said she would have to find out, and she hung the phone up on me. She has worked for SW Linear Investment Group , LLC since at minimum XXXX, so I am not clear on how she wouldn't know who the company she works for is licensed through, and furthermore not know the process for me to take on filing a formal complaint. Unfortunately, the answer that has lingered on since XXXX remains unanswered, and SW Linear Investment Group LLC continues to refuse to let me know who they are licensed with to service my loan. I feel helpless, and hopeless that I am unable to resolve this alone and feel that I will be forced to pay money that I do not have to hire an attorney to resolve this matter.

I started to receive frequent letters from Linear Mortgage aka XXXX XXXX, that I owe them money for a vehicle and that they were collecting on the debt. I never signed a contract with them to do business with them. They claimed they purchased the debt from the original creditor. The amount was more than the alleged original amount and they are charging interest as well. They started sending me letters every month, stating that they would take action against me if I did not pay them or surrender the vehicle. I sent them a cease and desist and a debt validation letter via USPS Certified Mail with Return Receipt to the address listed on the letter. They purposely refused to pick up the letter and sent it back to me. I never signed a contract with this company, they are debt buyers and allege that they purchased the debt from the original creditors. A few days after I was notified by the postal service that the letter would be returned, a representative called me on the phone. She was very rude and I told her that I sent a cease and desist letter and validation letter and told them that they were not authorized to collect inTexas until they got the proper registration and bond, she stated very harshly that they had not received anything, even though I had proof that it had been sent to the address they gave me. She did not care, she started to argue with me and I had to hang up the phone due to the distress. They ignored the fact that they were violating the Texas Finance Code by continually collecting without registering with the state and obtaining a surety bond. They continued to intimidate me and harassment by proxy by sending someone with a tow truck to my home at XXXXXXXX XXXX in the evening to seize my vehicle.I asked him to leave since this issue was actively being disputed and I had a cease and desist until this was resolved. That visit not only scared me by showing up at my house but upset me and my kids. Then the intimidation and embarrassment continued by the tow truck sitting outside my house for another 20 minutes after I asked him to leave. They failed to send me any proper documentation or send me a letter stating that they were actively seeking the vehicle and would send someone to my home. They are intentionally operating outside of the FDCPA, FCRA and Texas State Law by only inquiring into my credit report. They are not reporting this alleged legitimate debt on my credit report and are trying to intimidate me without the legal debt collection practices. These people will not provide me with the proper or requested proof that they are in fact who they say they are or that I owe them anything at all. They have ignored any attempt to resolve this properly. They intentionally evade the laws of Texas and act in a manner that I have perceived as intimidating and harassing. I sent another cease and desist and validation letter via XXXX. I requested a final resolution with this company before I exercise my legal rights and sue this company for monetary and statutory damages. The first letter was sent via certified letter and they ignored my letter, my cease and desist, and my validation letter and continued collecting. I sent a final letter on XX/XX/2021.

I am writing this letter to explain my unfortunate set of circumstances that caused me to become delinquent. I have done everything possible to make ends meet but fell short due to income. My hardship began in XXXX. The main reason I felt short was due to medical complications that have put me in a disabled position and I am now waiting to see if I will receive social security disability where I suffer from ( XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) I had a major XXXX on my hand that exhausted all paid time off. This resulted in no income but being committed to my obligations I withdrew from my retirement savings to stay on top of payments. I was in an adjustable rate loan that increased my payments from {$260.00} to {$640.00}, which was a huge jump for me with no income causing me to get further behind. I was receiving additional income of child support that stopped which helped make the partial payments I was making to XXXX. I applied for a modification using my husbands income. During this process I received a letter stating it was charged off as a bad debt because I was making partial payments. My situation has improved based on my husbands income increasing and we feel that with your help in keeping our home that you will consider giving us a modification with a fixed rate. Historically, XXXX charged off the balance due to me making partial payments in XXXX. My loan was a interest only loan. In XXXX, XXXXXXXX XXXX sent me a letter to foreclose on my home after 4 years of no one having my loan and being charged off by XXXX. My balance was $ XXXX. XXXX XXXX XXXX also show differently of when it was recorded in XXXX. XXXX XXXX, with XXXXXXXX XXXX retroactively added interest from XXXX to present, late fees, legal fees to my XXXX mortgage which put it in a first lien position to be able to foreclose my home in the amount of $ XXXX. XXXX added on $ XXXX of fees and interest. According to your CFPB, once the loan is charged off you can not go back and charge interest when the loan gets sold I have submitted a loss mitigation packet based on his loan amount that exceed my first mortgage. I was denied due to income. XXXX is now forcing me to pay off the loan with him in 45 days. He stated that he would remove all fees and added interest bringing the loan back to $ XXXX. If he is able to do this why wont he do the modification based on $ XXXX? He stated in the attached email documents attached of his plan. XXXX has conducted very unprofessional behavior as he taunts XXXX XXXX XXXXXXXX XXXX. ( see emails attached of his rude and abrupt behavior and makes it very difficult to work with ) threats, disturbing vexatious acts, and condescending remarks. He has now sent to his attorneys to start the process of foreclosure if I do not come up with the agreed amount of $ XXXX in 45 days or he will go back to the original amount of $ XXXX so that he can foreclose on my home. Again, this is where the fees put my XXXX mortgage in 1st lien position. We have requested explanation to no avail of a response of how he added interest from XXXX to XXXX.

I was directed to you through the Attorney Generals Office-XXXX XXXX My ex husband, after our divorce and the home was given to me went and borrowed money on the property in order to pay what he owed me to avoid a contempt of court issue. My name is not on the loan but my property is because the finance company did not do the research needed before writing him a check. He has since passed away and now the loan company wants me to pay the bill that I was not ever aware of. I directed them to file against probate but they never did. His mother XXXX XXXX was the beneficiary of his life insurance, checking and savings and they have never sent her any thing about this. How can someone use my property without my knowledge and I have to pay the bill. They are threatening to foreclose on my property now and after I paid off the first mortgage as I was instructed by the court. Linear XXXX should be responsible for this since they never had insurance on the loan, never had my signature that he could borrow my property to take out a loan nor did they do the research they should have done to start with? They have told me that they wrote the checks directly to XXXX XXXX XXXX not only once but twice, One time for {$9000.00} and another loan ( The loan application was used to payoff a previous note for {$12000.00}. with XXXX, a XXXX XXXX account for {$9000.00} and misc bills and direct to XXXX. Linear Mortgage , LLC got home equity loan papers from XXXX XXXX XXXX from 2002. these paper should not exist they should have been destroyed by the XXXX XXXX XXXX XXXX in 2002. Because we never signed them we turned down what they were offering us because it was not what we wanted. we told XXXX XXXX XXXX to stop coming too our home because we wanted nothing to do with them. XXXX Mortgage sent us papers saying that we owed them this XXXX for a home equity loan and said that they had a lean on our property and if we did not pay that they would take our home. so Started to pay them XXXX dollar a month and my husband said that something about this was not right we never took out a home equity loan. so we looked in our files and we found the papers from XXXX home equity like I said we never sign them or received any money from them. Linear Mortgage sent me the same paper with our signature on them that was a photo copy. alone with paper file with the court of deeds. I called to ask them were did they get these papers and at first she she she got them from a company call XXXX I told her I never heard of them before then she sent me the copy from XXXX XXXX XXXX. I even called XXXX and they said they never keep paper from that far back I tole Linear Mortgage we wanted our money back she said that she could not help me and she hung up on me and said tell my Lawyer. I called the police they sad i would have to file a fraud report on line so that it can be investigated.

XX/XX/XXXX, I received from XXXX XXXX XXXX Notice of Intent to Foreclose for a lender and amount ( XXXX ) I was unaware of. When disputed, they informed me of the original debt was with XXXX XXXX. While, I was familiar with XXXX, the debt was charged off in XXXX. For seven years, there was no communication from XXXX or Linear Mortgage , LLC, indicating it had been turned over to a new servicer. Throughout the dispute, Linear Mortgage , LLC back dated interest, and late fees from XXXX until the XXXX to support their Intent to Foreclose notice. All of which was discovered during the process of negotiation with me hiring an attorney. Linear Mortgage , LLC agreed to forgo additional fees and only to pay $ XXXX However, they submitted updated Notice of Intent to Foreclose for $ XXXXnaming themselves as 1st Position. The information regarding Loss/Mediation wasn't forwarded to me until XXXX of XXXX It was later discovered that Linear Mortgage , LLC was not licensed to act as a debt collector in XXXX XXXX or anywhere on the consumer licensing information site. Since they are unlicensed and my former attorney informed them they were to cease with collecting, that have now signed my Deed of Trust over to XXXX XXXX XXXX. Unfortunately, my attorney has withdrawn from the case and I am left without any resolve.

I purchased the car with a XXXX down payment, I was not aware that it was balloon payments. I have already paid in about XXXX dollars into a car that is only worth about XXXX dollars because my interest rate is 22.03 % I am honestly drowning because of ridiculous monthly payment of XXXX and am nowhere close to being down paying this car off.
