I was participating in an auction by NY XXXX on the site XXXX XXXX on XX/XX/2021 ( evening EST ). One lot ( a XXXX watch ) came up for auction. The red Bid tab was displaying an amount of XXXX USD. I clicked on it ( XXXX ), nothing happened as if the site was frozen or my bid was held at bay, and then suddenly the bidding jumped to XXXX on the side window, and then the side window showed XXXX and said I had won it for XXXX. I did not ever bid on XXXX, an XXXX bid never appeared on the auctioneers site for me to click on. Normally, on the screen, the lot shows up with a picture and below that picture, a red tab with the amount for bidding shows up. When we click on that amount on the platform/site, the site says bid has been sent. The site continues to provide feedback such as " winning '' or " bid again '', etc. All internet auction sites provide feedbacks on your bidding, and you know your bid has gone through, without which the auction will be improper. In my case, these events and feedbacks did not occur. There were no feedbacks about my bid. I immediately contacted both NY XXXX and the XXXX XXXX by phone and emails explaining what had happened. Several emails followed between NY XXXX, XXXX XXXX, and me, and no one explained to me how a XXXX bid could translate into an XXXX bid without my doing anything or the lack of feedback on my original XXXX bid. It appears that there were instances where this exact same thing had happened to other bidders on this platform as well. Mine was not an isolated case. In addition to NY XXXX and XXXX XXXX, I had communicated to others as well about this incident. There are additional issues we have found with this auction as well. I did offer NY XXXX to buy the lot for my original bid of XXXX, but they refused. There appears to be other issues related to this bidding as well. I really tried hard to explain what had happened, but these two entities have pursued a wrongful claim causing much stress. The next thing I received was a letter from Summit AR collection agency and their agents started to call me what appears to be very shortly after sending the letter, violating the 30-days-time frame for my reply. The agent I happened to speak with was coercing me to pay the amount despite my explanation as to what had happened. The agent warned me that my credit score will be ruined if I did not pay ignoring my description of the incident and the fact that I do not owe any money to NY XXXX or this agency. He then wanted me to call him when I send my letter etc. I found these excessive, unwarranted and harmful. This has caused much mental stress at a particularly difficult time for me and my family. I have sent a cease and desist letter to the collection agency. Finally, in response to my complaint to XXXX on XXXX XXXX and NY XXXX, XXXX XXXX has now admitted there was net work issues related to this bidding and they will be discussing with NY XXXX to sort this out. I have attached it with this complaint. I am worried that Summit AR will report to credit agencies before XXXX XXXX sorts this out in a timely manner. I had even pointed out that there was a breach of accounts at XXXX XXXX.

Summit Account Resolution, Amount : {$320.00} I have already sent a debt validation request to the collection agencies as per my rights under the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692g, and I have yet to receive satisfactory proof that these debts are indeed mine. I request that you investigate these matters promptly and remove or correct the disputed information from my credit report if the creditors can not verify or validate the debt. The FCRA requires you to complete this investigation within 30 days of receipt of this letter ( 15 U.S.C. 1681i ). Please note that accurate reporting is crucial for fair credit practices, and it is my right as a consumer to insist upon this. A fitness club had a clause in their contract saying if you cancel within three business days you are not obligated to pay anything. If you go past these three days then cancel you pay {$300.00} dollars or so. On the third day ( within the acceptable window ) I called in to the fitness club and asked what would be the appropriate steps to cancel the contract. They stated I have to come in to cancel, but since I called I can come in anytime that week that is convenient and not pay the fine. Upon arriving a few days later at the club I was given a business card and told to email the individual stating my wish to cancel. After doing so, the individual on the email stated I was pass the three day window to cancel and I owed {$300.00}. I responded with an email describing the situation - how a representative from the company gave me a verbal agreement that it was ok to come in later the week. I received another generic email, which did not dispute or even acknowledge anything I said about the verbal agreement, and stated I still owe {$300.00}. I sent another email asking to discuss this further over the phone because I feel I was apparently lied to and I do not believe that is an acceptable business practice to entrap someone like that. After no response back by email I called multiple times and left messages or a person at the club stated someone would get back to me. I never got any response back from the club. A few months later, I found a letter in the mail from a debt collection agency saying I owe them {$300.00}. Should I have done something different? Do I owe that {$300.00} to the health club? It appears like that was an entrapment technique. and the company refused to negotiate with me in good faith or even reach back out to me.

I rented a vehicle from XXXX XXXX XXXX company in 2017 and returned the car and paid the fees agreed upon. Upon approval, I let the company know of a crack in the windshield that was caused by a stone hitting the windshield while driving on the highway. I explained that the State of Florida fixes cracked windshields free of charge " In the state of Florida, windshield cracks and chips are repaired free of charge. According to Florida statute 627.7288, if you have comprehensive coverage on your vehicle your insurance company will pick up the tab for any repair or replacement that you may need. The law states that your deductible will be waived. '' After discussing they took my insurance information in case of the claim being escalated and said if any needed further action was needed they would be in contact. I signed the paperwork and never heard back from them. I received a call from a " Debt Collection Agency '' from a New Jersey number stating that they were calling to claim the debts owed and when I explained that was handled they began to over speak me and not let me explain. I finally told them I would be in contact with XXXX to figure out the issue. The next morning around XXXX XXXX I received another collections call form a Mississippi number from a gentlemen that would not let me say a work and asked what is it I think will happen? Just give him my debit or credit card number. When I asked for his company name he said XXXX XXXX and hung up. I attempted to call XXXX but states they are busy or not open. I am trying to find out exactly what was done on the companies part for the last two 3 years that they took my insurance information and never filed a claimed and expect me to pay for a service in FL that is free.

On XX/XX/2022, I received notifications from XXXX and XXXX that a collection account in the amount of {$2400.00} was reported by XXXX. After a quick XXXX search, I learned this company is a collection agency attempting to collect a debt. SUMMITACTRES ( " Summit A-R '' ) unscrupulously " parked '' this debt on my credit profile in an effort to collect a debt that I do not owe. What is " parking '' the debt? It is when a company, Summit A-R in this case, reports a debt to the credit bureaus to force a consumer to contact them with the hopes of collecting a debt they purchased from another company. These actions are malicious ( and quite possibly illegal ) and have severely harmed my credit. As a consumer, I am protected by the Fair Debt Collection Practices Act. Summit A-R 's placement of this collection account on my credit report is the epitome of an abusive, deceptive, and unfair debt collection tactic. Furthermore, XXXX ' actions have unfairly tarnished my credit as they attempt to exploit my good credit standing. This is exactly what the Fair Debt Collection Practices Act intended to stop. Summit A-R has a debt from XXXX. XXXX was unable to provide me with validation for the debt. I went to them with a sick puppy and they gave me estimates. They never gave me a final bill and told me I would need to give them another {$400.00}. I disputed it with my Credit Card and XXXX XXXX credited it back to my account. They are trying to collect a debt without sending it to me in writing.

I rented a car from XXXX XXXX XXXX in XX/XX/XXXX. I returned the car on XX/XX/XXXX and went over it with the agent at the airport and everything was fine and he gave me my receipt- there was no damage to the car. About a week later I received an email from XXXX asking me to file a damage report because there was damage to the car. I filled out the report stating that there was absolutely no damage to the car upon returning it. A few months later I received a bill for over {$800.00} for repairs. I emailed and called XXXX with no resolution. I asked for time stamped photos as well as where the car was from the time I dropped it off until they claimed there was damage and they refused to provide the information. They did send me a photo of a scratch on the car and then a bill for XXXX hours of labor and glass repair!!! Today I received a notice that they turned me in to collections for not paying their bill. The collections agency keeps calling me demanding payment. I explained that I was not paying because I did not damage the car. After searching the internet, I found that there is a class action lawsuit against XXXX for fraudulent damage claims as well as hundreds and hundreds of complaints from other consumers that have had the same type of fraud and sent to collections. I have attempted multiple times to contact XXXX XX/XX/XXXX claim department and I can not get a human. It is obvious that this is a common fraud scam by this company and now it has impacted my credit report.

XXXXXXXX XXXX XXXX XXXX XXXX provided services from XX/XX/2021 to XX/XX/2021, for which most of the bills were paid by my insurance. However they accumulated minimal unpaid amounts for my account. Once we found out, we paid the total accumulated balance of {$330.00} in XX/XX/2021. However they reported my account and me to the collection agency at some point in time and we had no knowledge about this, until recently when we applied for home mortgage. The collection agency had hit my credit score and brought my credit score from XXXX to below XXXX. Due to this we are now getting higher interest rate on the mortgage. After we found out this, we called the XXXX XXXX multiple times and provided the payment confirmation and requested that they give us a letter saying it a mistake or reserve this credit rating impacts. The manager spoke with us just once and agreed to take action and resolve this issue. But since then it been more then 1 week and the manager has been ignoring our calls. We requested to speak to the manager to just get an update on this situation. But the receptionist named XXXX never got manager on the phone. She keeps on saying she will pass on this message to the manager. Due to there mishap, they reported our fully paid account to collection agency and the collection agency damaged our credit score which will affect us financially now. The clinic is purposely ignore our attempts to get this fix with the collection agency and the credit rating agency.

Im really worried that SUMMIT ACCOUNT RESOLUTION is reporting inaccurate information on my credit report. I have repeatedly told these companies, the account have fraudulent activity and Im a victim of identity theft and accounts and charges arent mine 15 U.S. Code $ 1681c-2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 16816 - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( XXXX XXXX In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. On XX/XX/XXXX, I noticed a medical debt that I did not recognize added to my credit report. I immediately found the company, Summit AR, and contacted them to get additional information about this debt. They emailed back and verified the debt. On XX/XX/XXXX, I answered a phone call which happened to be from Summit AR, the collection agency. I said I'd happily pay the debt, but I had never received notice of the debt and thought it was inequitable that it was added to my credit report before I received a bill. I said that I would like for the account to be removed from my credit report. They refused. As mentioned, I never received a bill from them, though they claimed to send a single bill in XX/XX/2020. When I mentioned that I never received the bill, they told me to contact the postal service. I escalated to a number of supervisors, all of whom said I ignored bills and ignored my mail, and they would refuse to address the credit report.

This company has consistently been contacting my friends cell phones. Disgusting my deck, and today my friend reached out, asking me who are you owing money to because some lady just called me and discussed your entire finances. After speaking to the lady had manager advisor, why are you contacting people that have nothing to do with my debt. She on a recorded line, admitted that I am not XXXX and whoever the other person Is that shes talking to is not me she discussed my dip with third-party people over and over again I have advise them to reach out and ask for FTC regulations . Not only did she discuss my debt with an associate, but also kept threatening to obtain the new living address of me. On XX/XX/2020 I sent Summit AR a letter, which is attached. In the letter on page 4 I clearly state that I am represented by an attorney who's contact information I provided. The letter was sent to them via Fax and Certified Mail. Summit AR must've not read my entire letter because they responded to me directly instead of my attorney. This is a violation of the FDCPA 1692 c ( B ) With anyone except consumer, consumers attorney, or credit bureau concerning the debt and 1692 c ( a ) ( 2 ) After it knows the consumer to be represented by an attorney unless attorney consents or is unresponsive. I am requesting that summit AR cease an desist their disregard for the law right away and contact my attorney right away to resolve this matter. No lawsuits have been filed YET.

On XX/XX/2021, Summit Account Resolution added a derogatory mark on my credit report per XXXX and XXXX. Upon further research, the account was transferred/ sold and I am no longer responsible for the account. A certified Debt Validation letter was delivered on XX/XX/2021 and in response, I received a bill. On XX/XX/2021 a second certified Debt Validation letter was sent. Debtors Creditor did not verify this debt. Also, there was NO written form of communications, contract or signature for this accused debt at all. A bill without a signature does not validate the debt and anybody can send a bill and say its mines. According to the FCRA, Summit Account Resolution, has violated my rights as a consumer and Im requesting legal action to remove this account immediately.

I rented a car from XXXX, it had reported damage on the rear bumper according to my rental receipt, I noted damaged when I walked into the hotel parking lot the next day. I asked for a photo of previous damage, and all correspondence associated with in, instead they sent me to a collection agency ( Summit ). I communicated with Summit over the phone and asked them to only communicate with me in writing. I asked them in writing for a copy of the photo of the vehicles reported damage prior to me renting the car so I could sent it to my insurance, which would have covered the damage. Instead I continued to get rude phone calls telling me to State your Name. I offered to settle the debt in writing, but instead they reported me as a charge off.

I had an unpleasant experience with a debt collector who used and deceptive practices that violate the FDCPA. They added an account to my credit report without my agreement or wet signature on any legal contract. The collector also failed to follow the proper 5 step validation process, which is required by law. This situation violates my rights and I am entitled to {$1000.00} for each violation under the FDCPA. I am requesting that the debt collection company remove this account from all three credit reporting agencies and compensate me for the violations. If they fail to do so, I will have no choice but to take legal action. The account they're reporting is also reporting inaccurately which is another violation in itsself.

I hired a fencing company in XXXX XXXX to install a new fence. They damaged my landscaping and did not install the fence per our specifications. They were paid 65 % of the estimate but refused to correct the issues for the remaining balance. Another contractor was hired and paid to fix the fence and the landscaping. The fencing company has now sent the balance to a collection agency who has reported this on my credit without any proof that the money is owed. Collection agency was advised of this in XXXX XXXX and again in XXXX XXXX - no further legal action has been taken by the collection agency or the company.

I recently discovered that Summit Account Resolution is reporting a debt that I do not owe to all three credit bureaus. After discovering this discrepancy I reached out via certified mail to Summit Account Resolutions providing proof of full payment made to the original creditor and also requested removal of the negative account being reported. Summit replied by mail still requesting that I remit payment for a debt that I do not owe ( refusal to remove negative account ). This is a violation of the FCRA and if this matter is not resolved immediately I will be filing a claim for damages.

They sent me a email saying I owed them money due to embezzlement from a previous company I worked for. This is not only slander but unfounded when I asked for proof they sent me like a screenshot of a transaction on XX/XX/2020 saying it would be their final attempt. I asked for more proof and they said thats all they had to provide me and put it on my credit as well. Obviously this is heinous and wrong as I did not embezzle anything and they did not want to provide proof or work with me. I want it off my credit and I want them to apologize in writing for putting me through this ordeal.

I have sent many letters to Summit Account Resolution to ask for verification of the debt, and Summit sent a letter stating that the account was verified, with no proof of me owing them. They did send a itemized letter with an address that I never lived at. I also reached XXXX about this and they only letters I recieved from them was stating the account was verified, but also had no proof of verification. I sent XXXX and Summit many letters over a course of a year to send me proof of verification, not once have I ever gotten proper verification.

I went to the doctor XXXX/XXXX/15. I had a {$72.00} co-pay I owed for a dermotology visit. I intermediately paid it when I received the bill ; paid XXXX/XXXX/15. The doctor 's office took and cleared the payment. Then they say they ca n't find the payment. I called to clear it up. They said to fax in proof of payment. I did that. According to the FDCPA a debt buyer is considered a debt collector and must have proper licensing to operate business in the state of Illinois. I preface this to say the company Support Collectors , Inc, has been illegally reporting an alleged debt on my credit profile without an Illinois Collection Agency License.
