I have put in two separate loan applications on two separate properties with XXXX XXXX at Sunstreet Mortgage. On both occassions we have informed XXXX that I had a prior VA loan and VA foreclosure. My real estate agent informed him as well as she referred us to him. XXXX has also contacted the VA to discuss the foreclosure as he originally told us the VA requires a 6 % downpayment for prior VA loan that resulted in foreclosure. I say this to say that XXXX knew I had a prior VA loan and still quoted us what I know now is the 1st use and not the 2nd use VA funding fee on both loan estimates. This made his loan estimate look better than other loan estimates I received. XXXX then sent us a revised loan disclosure statement and when we inquired why the VA funding fee had went from {$7500.00} to {$11000.00} he cited a change in circumstance stating he thought I was a first use and that he had just received the Certificate of Eligibility from the VA stating otherwise. When we reminded him of the several different occassions that support him having known about the prior VA, he stated that we lied on the prior applications and that I verbally told him I did not have a prior VA loan. In addition, he received the Certificate of Eligibility on XX/XX/XXXX. He did not make the Revised Loan Disclosure Statement and Estimate available to me until XX/XX/XXXX. He is required to make it available within 3 business days of having known of the change in circumstance which would mean he should have made it available by XX/XX/XXXX. He is in violation of the tolerance levels under the TRID rules as they relate to the VA funding fee and disclosures.
