XXXX I purchased solar panels and a new roof from the salesman ( XXXX XXXX of XXXX XXXX XXXX ; it was financed through Sunlight Financial. The roof was completed and solar panels installed by XX/XX/XXXX. However the payments are processed by XXXX XXXX XXXX XXXX. When I purchased the roof and solar panels XXXX explained that I could apply for a federal residential tax credit using a form XXXX. The federal tax credit or residential energy credit, would be XXXX and if I voluntarily gave that money to Sunlight Financial my monthly payments of XXXX would remain the same after the XXXX payment. However if I kept the XXXX my payment would increase to XXXX after the XXXX paymentthe following is the wording in the contract ( full contract attached ). This section of the contract is my issue : Monthly Payment : {$150.00} for the first XXXX payments, increasing to approximately {$210.00} if the 26 % voluntary payment of {$11000.00} is not paid by the XXXX payment. There are no prepayment penalties. However, when filing my taxes, form XXXX took into account all my improvements ; the new doors, roof, and solar panels. My residential energy credit was only XXXX not the XXXX strictly for the solar panels. When I first contacted Sunlight regarding my concerns with this payment of XXXX in XXXX of XXXX I was told to contact XXXX XXXX XXXX XXXX. The credit union stated that it didnt matter that I didn't receive the XXXX from the energy credit I will still have an increase in my payment if I don't pay them the XXXX by the XXXX payment. I told the XXXX XXXX XXXX XXXX representative that this XXXX seems more like a balloon payment although it is not being referred to as one. All In told me to contact Sunlight because they have nothing to do with the contract terms. I contacted Sunlight again ; per their website it directed customers to text them which I did twice in XX/XX/XXXX but did not receive a call back. I posted the following XXXX review of the company on XX/XX/XXXX : " I contacted sunlight via text 3 times ( for some reason they don't take direct calls ) and received a generic message that someone would contact me... .a week later still no response! I am a new customer and have questions regarding my contract but clearly customer service is not a priority ; I would never recommend this company to anyone! '' On XX/XX/XXXX I received the following email from Sunlight : " Thank you for providing your feedback and letting us know about this issue, XXXX. We set a high standard for ourselves and are truly sorry to hear that standard was not met in your interaction with us. Please get in touch with us on ( XXXX ) XXXX and we'd be happy to help you out. Regards, Sunlight Financial '' I called on XX/XX/XXXX, but was put on hold for an extended period of time and finally hung up. I sent them the following email instead on XX/XX/XXXX : I am writing this letter to express my serious concerns and dissatisfaction with the terms and conditions of the XXXX XXXX purchase agreement ( hereinafter, the " Agreement '' ) that I entered into with Sunlight Financial on XX/XX/XXXX. As per the Agreement, I agreed to make payments for the first 17 months in the amount of {$150.00}, with the payment increasing to {$210.00} from the XXXX month onwards, unless a " voluntary payment '' of {$11000.00} was paid by the expiration of the XXXX payment. Upon careful examination of the Agreement, I have identified two primary issues that require immediate attention and resolution : 1. Breach of Guarantee : During the negotiation of the Agreement, it was explicitly represented to me that the " voluntary payment '' of {$11000.00} would be based on the amount of residential energy credit I was entitled to receive from the IRS. XXXX from XXXX XXXX ( I can't locate his last name but his email is XXXX ) was the sales representative who told me about the credit and assured me the credit was assured to be no less than {$11000.00}, forming the basis of my decision to proceed with the solar panel installation. However, to my disappointment, the total amount of residential credit I received from the IRS for the installed solar panels only amounted to {$7800.00}, significantly less than the guaranteed amount. This significant discrepancy has put me in a financially compromising position, as the " voluntary payment '' was contingent on receiving a specific amount of tax credit. I firmly believe that Sunlight Financial has failed to honor the guarantee, resulting in a breach of contract. 2. Potential Illegality of Balloon Payment : I have become aware that the " voluntary payment '' clause in the Agreement may constitute a balloon payment arrangement. This type of payment structure is governed by specific regulations under California statutory and case law. However, the contractual terms do not expressly refer to this as a balloon payment or provide the necessary disclosures as required by law. This raises concerns about the legality and transparency of the payment arrangement. I have been advised to seek legal counsel to verify the legality of this clause, and it is essential for Sunlight Financial to provide clarification and justification for the inclusion of such a payment provision in the Agreement. In light of the above issues, I request that Sunlight Financial take the following actions to address and resolve the dispute : 1. Conduct an immediate investigation into the misrepresentation of the " voluntary payment '' guarantee and provide a detailed explanation for the discrepancy between the assured amount and the actual residential energy credit received. 2. Provide a written response confirming that the " voluntary payment '' clause in the Agreement complies with all relevant laws and regulations pertaining to balloon payments in California. Include references to applicable stat utory and case law supporting the legality of the clause. 3. Offer a fair and equitable resolution to this matter, considering the financial strain caused by the misrepresentation and potential illegality of the " voluntary payment '' clause. I expect a prompt response within a reasonable timeframe from the date of receipt of this letter. Failure to address these issues satisfactorily may result in further legal action to protect my rights as a consumer under the laws of California. Our team will review your information and be in touch shortly. Sunlight Financial Support sunlightfinancial.com XXXX I received XXXX calls from XXXX ( no last name given ) of Sunlight ; she left a voicemail on XXXX regarding my complaint email. She stated she spoke to XXXX and XXXX of XXXX Renewables and they provided additional insight into my complaint. She said to call her at XXXX. I called 4 times but it went to voicemail ; each time I left a message asking her to call me back. I did receive a text from XXXX in XX/XX/XXXX stating that he heard from Sunlight regarding my complaint. He wanted to know what he could do but I let him know this was a contract issue that only Sunlight could address. I told him I was having trouble reaching XXXX and if he would call her and ask her to contact me that would be helpful. On XX/XX/XXXX I received another voicemail from XXXX stating she was sorry it had taken her so many months to reach out to me but she had issues with her system and just received access to my voicemails. She stated that she was sorry but she spoke to XXXX at XXXX XXXX prior to calling me and he advised her he spoke with me and quote unquote, everything was resolved. She stated if I should call support back at XXXX with any questions regarding the loan terms and that her team would be happy to assist me. I called Sunlight on XX/XX/XXXX to speak with her and the representative XXXX XXXX ) could not transfer my call to XXXX but accessed my complaint using the case number XXXX. However he couldnt answer my questions regarding the contract. I asked for XXXX last name but he was unwilling to provide it. He offered to send her an internal message but I asked him to have her email me ; I did not want anymore voicemail messages. Then I advised him I would be making a complaint through your agency.

The California State Licensing Board has taken the most serious action available against Sunlight Financials XXXX and referred them to the Office of the Attorney General for legal action in connection with this loan. The recommended violations include, but are not limited to abandonment without legal excuse. I believe they used fraud, unconcionability, unfair surprise, and extreme unfairness to induce the contracts. Ive sent many letters to Sunlight Financial. The most recent letters, including the CSLB results, were sent XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX to XXXX XXXX ( XXXX XXXX XXXX ), XXXX XXXX ( Compliance Counsel ), and Sunlight Financial Escalations Team reiterating contract breaches, abandonment and the unfair sales tactics that took place to induce the Loan Agreement. I requested cancelation of the loan, a full unconditional lien waiver, and removal of all references regarding the account from the credit reporting agencies. I also sent an official claim notice to the physical mailing address, as noted in the Loan Agreement to Sunlight Financial XXXX XXXX XXXX XXXX and the same letter was emailed on XX/XX/XXXX. I have been reporting to Sunlight Financial and XXXX since my first discovery of contract breaches on XX/XX/XXXX, but they have routinely disregarded these concerns to date, and instead of providing assistance Sunlight threatened and commenced action against me. Solar installation and financing contracts were signed on XX/XX/XXXX and XX/XX/XXXX. The installation deadline date was XX/XX/XXXX. Upon conclusion of XXXX, Sunlights XXXX made only one visit to my property, which was delivery of some panels to my roof. The job was abandoned and over 75 % is incomplete. Despite my many requests for advisement and installation, they never made any attempts or contacts whatsoever to discuss or arrange job completion. In addition to abandonment, Sunlights contractor resurfaced on XX/XX/XXXX but only to trick me into Signing an agreement that would release them from their contract but hold me to contract terms of {$36000.00} and 20 years of payments. This incomprehensible scheme provided a hush payment of {$3500.00}. I didnt sign the document and they reverted to their routine disappearing act. Sunlight Financial and their contractor, who are introduced as partners on the cover page of their contract, used a high pressure sales rep to secure installation and financing agreements. Despite the Loan Agreements Holder Rule disclosure, Sunlight is illegally holding me ( the customer ) liable for their and their partners negligence and fraud. Sunlight Financial is charging me for services and products that will never be realized due to illegal business practices, which include, but are not limited to abandonment. On XX/XX/XXXX I received a written response from Sunlight Financial Associate General Counsel, XXXX XXXX. Instead of providing assistance, XXXX XXXX validated the abandonment and other concerns I had raised, by exploiting an open-ended line, in the Note, that reads, The System does not need to be connected to a power grid or operating to be considered Installed for purposes of this Note. XXXX XXXX misappropriated contract terms to trick me into believing it means, The System NEVER needs to be connected to a power grid or operating to be considered installed In the same letter XXXX XXXX confirmed and acknowledged that the system was not installed or even substantially installed by volunteering the following statement, installation required a main panel upgrade and relocation of the main service panel all of which was never done. XXXX XXXX letter contradicts his own statement by also claiming that my allegations are entirely unfounded. XXXX XXXX XXXX further exhibited unconscionable actions by deceptively stating that the Loan Agreement is by and between me and XXXX XXXXXXXX XXXX and therefore Sunlight Financial doesnt have the authority to cancel any of my obligations under the loan agreement. The definitions section of the Loan agreement makes clear that, for purposes of the Note, XXXX XXXX XXXX and Sunlight Financial are one and the same by stating, We, us and our mean XXXX XXXX Bank, located at XXXX XXXX XXXX, XXXX, XXXX XXXXXXXX ( Lender ), and any subsequent holder of this Note. The Lien, the Note definitions section, the Loan Agreement cover page, and the XXXX certificate all prove that Sunlight is the Note-holder and has authority to cancel the agreement. I believe Sunlight and their partner used fraud, unconcionability, unfair surprise, and extreme unfairness to induce the contract, and derelict their contractual duties. THE HOLDER RULE applies to this contract and as such, Sunlight Financial must abide : The Holder Rule is a federal regulation intended to help consumers when a defective or fraudulent product or service is purchased with credit extended directly by the seller or arranged by the seller. If the seller ( 1 ) provided your financing directly or ( 2 ) has a partnership with the provider of your financing, you may be able to stop paying on the loan and possibly obtain a refund of any payments you made on the loan if a product or service is defective or not provided. All supporting documents referenced in this complaint were emailed directly to Sunlight Financial.

This began in XX/XX/2022 and is currently ongoing as I had contact with Sunlight on Monday, XX/XX/XXXX. Sunlight Financial has ignored my attempts to receive the original application I submitted to verify a loan for work performed in XXXX. I filled out XXXX application with strict instruction to XXXX salesmen at XXXX construction we both had to be on the loan. Borrower/Coborrower positions, my wife and I. Whichever was first didn't matter because it needed to help both our credit files. We received a denial that evening, my wife received an email the next day as being approved. The salesman informed us everything was approved he got us the loan so we can get the windows. Quote " I got it to go through, you guys are qualified, don't do anything. A few days later we received XXXX denial emails, got told to ignore those everything was in place. Before leaving we were informed most installs happen within XXXX weeks or less. We were of the opinion at this time we were both on the loan. We both received information in separate files to be signed individually. Thought it strange, I asked and was told that is just the way it was. Continue to fill out the info in XXXX. We both filled our information out. As the first XXXX week deadline approached, we reached out and didn't receive an answer multiple times, after it passed we were ignored more. The original contract with XXXX expired the end of XXXX, they extended this without our knowledge or consent. The local secretary told us, " There were problems at the company manufacturing the windows. ". At this time I cancelled through the email link on the main website because we did not approve of the extension. Another salesman contacted me and told to contact corporate, upon calling corporate I was routed to another salesman. When questioned about the ownership of the company and what the secretary said, he paused, signed and repeated the ownership sales line. I was also informed to call corporate again at the same number. A number that routed me to another local salesman In XXXX, received a call from an installer, informed him the contract was cancelled there is no contract/agreement in place, but I would still like them to be installed. He showed up the next day and started the installation. At this time, almost XXXX and XXXX months had passed, not just XXXX weeks. Installer was confused because he claimed installs happen within XXXX to XXXX weeks. When I returned home I was surprised to see a name on the windows that wasn't XXXX construction, as the biggest selling point was the claim they owned the manufacturer. I started searching the Ohio Secretary of state website, different representatives for the XXXX companies along with different addresses for those representatives.. I reached out to both and didn't get a response back verifying ownership. Upon completion, he handed a paper for a signature, claimed it was for him to be paid. Along with an approval from Sunlight Financial. I went to the website and tried logging in, and to my surprise, my information was rejected. When the local corporate manager (? ) was questioned he assured me the ownership was as stated, and the loan was setup the way it was for us to qualify, although it was in fact not what we had requested. To this day I have not received verification of ownership. I recently questioned the local salesman, and he referred me to the warranty paper. Claimed its on there. Sunlight informed me in XXXX call, they did not originate the loan they are only the servicer. When I asked who it was they refused to answer, and just said they could not be reached at this time. They also refused to pass along the contact information. The Sunlight rep has also told me that I was removed because I did not qualify. I was confused at how I was denied, with a $ XXXX a year job, I have since received a 30 % raise, but my stay-at-home-mom wife qualified with no income in XX/XX/XXXX years. They used her credit and my income against our wishes, without showing us another option, XXXX we would have denied because the payment would have been entirely too high. I have requested the XXXX applications filled out in XXXX or XXXX to verify the validity because something has not felt right for a while. My requests have fallen on deaf ears XXXX times. I have requested a fraud investigation be opened at Sunlight and also have been ignored. Sunlight refers me to XXXX for questions and XXXX refers me Sunlight, doesn't make sense. I have requested a call from XXXX XXXX, not a local individual and have yet to be called. The XXXX salesman this last week informed me that he told me about the loan when he returned the next day to measure the windows. I was at work and he was gone before I got home. When I told him this he then insisted he told my wife. She says he came to measure windows and left.

Good day to you, My name is XXXX XXXX. I am reaching out to you, regarding a time-sensitive matter, referencing XXXX XXXX XXXX XXXX XXXX Sunlight Financial, who was originally the entity presiding over my loan to XXXX XXXX XXXX XXXX This entity in question, XXXX XXXX, its supervisor, XXXX XXXX along with another salesman named, XXXX used deceptive practices on myself and my neighbors to selling each of us solar panels. Also, Supervisor XXXX XXXX and his salesman, XXXX both told me when I asked them if they had solar panels on their home? Supervisor, XXXX XXXX stated he had solar panels on his roof top for 4 years and his net meter bill with XXXX XXXXXXXX will never exceed {$14.00}, further stating on 4 different intervals, ( Im a creature by habit with repeating myself to others ) his net meter bill with XXXX XXXX has never exceeded {$14.00} and that it will never be due to where we live, XXXX XXXX, NV. The other salesman, XXXX stated to me he has had solar panels for three years and his net meter bill never exceeded {$14.00}. Also, myself and neighbor down XXXX XXXX from me, ( XXXX XXXX XXXX, contact info. is in the complaint I sent ) told the both of us, ( along with hearing the same thing from other XXXX salespeople told us all we would receive the credit in full for {$8700.00} when filing our taxes. I learned after the fact this was not true. Another lie told. My CPA was the one who informed how this solar credit works, and that he had heard the same story from his clients. I have done my due diligence in reaching out to officials in congress, seeking justice due to injustice done. In return I was given local resource information to further assist me and others. I pursued each resource given in seeking legal representation, ( Consumer law atty. ) citing XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, and the XXXX XXXXXXXX XXXX referral services. To no avail not XXXX of these entities was able to assist XXXX further. Nevada XXXX XXXX XXXX, XXXX XXXX XXXX, and XXXX XXXX XXXX all told me to reach out to Attorney General, XXXX XXXX 's office for further assistance. On XX/XX/XXXX, XXXX XXXX XXXX, the entity now presiding over my loan debited my checking account ( 8 ) times, totaling {$1300.00}. These charges were made fraudulently because they were never authorized. ( I filed a claim with my bank and received all monies debited from XXXX. ) I have attached my statements as proof to their fraudulent act. For the record, I never once set up any type of ACH with XXXX XXXX XXXX, neither could they produce such a document with my signature on it, giving them permission to do so. I always would call into XXXX monthly to make a payment, via debit card. Entering a contract with XXXX XXXX XXXX XXXX, they were to install XXXX solar panels, the panels I was financing. I guess I ran off at the mouth too much disclosing I live alone. Nine months and four installation visits later, due to many foul-ups with XXXX XXXX XXXX XXXX XXXX XXXX installed another manufacturing solar panels on atop my roof, ( REC. ) How I found out I do not have XXXX XXXX panels was when going on top of my roof top for cleaning. Also, I have reached out to XXXX XXXX XXXX XXXX, and to no avail, they refused to further assist me by not assuming any accountability for their wrongdoing. XXXX XXXX XXXX also never installed the pigeon guards around the solar panels on my roof nor my neighbors. This has affected my once credit in the XXXX to now XXXX. This contract entered into with XXXX XXXX was XX/XX/XXXX. It took the company one year and one month to complete due to the company not having their business in order. Another sign of trouble to come. Myself, along with my neighbors continue to be failed by our system set in place to protect its residence from predatory deceptive practices used in scamming consumers. This ordeal causes me on a continuum to experience heightened XXXX symptoms, anxious, irritability, and anger. The frequency to experiencing all symptoms mentioned is daily with intensity. I have reached out to XXXX XXXX and Sunlight Financial. To no avail, nothing. They will not assume accountability. I reached out to a number of agencies here in XXXX XXXX, NV for timely assistance, ( nothing ) also filing a complaint with XXXX XXXX XXXX XXXX. To no avail, nothing. I filed a formal complaint with Attorney General XXXX XXXX 's office. To no avail, nothing. I filed a complaint with the NV Contractors Board. My case is still under investigation with them. As you can see I have been taken around the world with this. The epitome of atrocity. Dear Sir / Madam, This is a formal complaint against XXXX XXXX XXXX XXXX XXXX and its business and financial affiliates and our intent to terminate our solar agreement ( see attached ). This may or may not be the proper way to dispute this, but at this point I will try anything to get my voice heard. The email chain below is just a short version of actual events as I know your time is valuable. To present day we are still paying ( on loan to Sunlight Financial ) for a solar product that is defective and when it was operable it was not performing to the caliber we were cross-sold. ( Love that a company can just drop a partner when things go bad ) - XX/XX/XXXX called XXXX XXXX to see what was needed to get solar panels fixed, and they scheduled me a service appointment for XX/XX/XXXX. - XX/XX/XXXX emailed XXXX XXXX about any type of payment suspension / reimbursement program until my solar panels are restored They emailed me back indicating there was no reimbursement for this type of issue - assuming its because its not there product defect ( lol ). - XX/XX/XXXX email received from XXXX XXXX directing me to go through XXXX directly regarding the firmware / snap pv link issue and to reschedule my service call with them - XX/XX/XXXX sent email to XXXX asking about warranty on these defective parts ( they confirmed XXXX yrs ). - XX/XX/XXXX sent an email to XXXX asking for a new service appointment where in turn they gave me 4 preferred retailers to call and schedule a new appointment. We currently have messages out to several local XXXX XXXX XXXX that XXXX recommended and are waiting for responses. How can a financial institution partner with such a poor-rated, poor customer-service and poor performance products? First off I hope I made the correct choice to file this complaint because no where did I find Home Improvement Loans. So got the loan through Sunlight Financial but the loan was actually approved by XXXX XXXX XXXX. My fist instalment was due on XX/XX/2023. On XX/XX/2023 I remembered that because the XXXX of XXXX had fallen on a Sunday I had forgotten to submit the first payment. So I login to my online account with Sunlight Financial and proceed to submit my payment. On XX/XX/XXXX of the current year, I login to my bank account to see what had been charged so far ( because I have other payments that come in ). To my surprise, I see 2 charges for sunlight financial one in the amount of what the payment should be which is in the amount of {$230.00} and the one I made and authorized in the amount of {$230.00}. I called them that same day XX/XX/2023 at XXXX XXXX to ask why had they charged my bank account twice? That I had only authorized the payment of {$230.00} made on XX/XX/2023. She checked and verified that the auto pay was not activated. So according to the young lady I spoke to, she verified that the autopay had not been activated, so there was no reason for the financial institution in charging my account without my consent. She did say she'd enter notes to escalate the situation and that she would call me with a response. She even verified my phone number. I asked for either a refund of the double charge or credit for the payment due on XX/XX/2023. I also asked for my payment due date to be moved to the XXXX of each month. I want to point out the call was being recorded! That was taken care of on XX/XX/2023. But as far as for the issue with the double charge they did not mention a thing. I even logged in to see if their was at least a credit to make a payment till XX/XX/2023, but nothing has been updated. Then I proceeded to sending them a message via their portal which I took a screen shot of, before submitting to keep as proof. But till this day of XX/XX/2023 I have not received a response from them, not a call or an email or a letter in the mail addressing the issue. I have removed my bank account from the portal since XX/XX/2023 so they can no longer take any payments that I do not authorize. But I would really like for someone to reach out to them and ask why did they take money that was not authorized? In the attached files you will find the message sent to sunlight Financial disputing the double charge. Then email with the charge that was authorized by me. And a screen shot of the charges from my bank. Final note, I was never notified about the first charge otherwise I would have never made that payment on XX/XX/2023.

I purchased a Solar Panel / Battery Back up System ( System ) from XXXX XXXX XXXX which was financed through Sunlight Financial. Sunlight Financial sold the financing to XXXX. The System did not work and it was determined by 9 State Attorney Generals that the marketing, selling, and installation of the System was fraudulently done by XXXX XXXX XXXX. The 9 AGs sent a letter to XXXX XXXX XXXX and Sunlight Financial that they should not collect any money til this was resolved and the systems either fixed, removed or the money refunded. In the meantime, XXXX XXXX XXXX went bankrupt. I stopped payment on the system based on the system not working and the letter from the Attorney XXXX and XXXX XXXX XXXX not completing their work to make the system functional. XXXX placed a lien on my home. I went to court and the court agreed that the XXXX is not part of the house but is XXXX XXXX ; therefore the XXXX on the house should be essentially null and void ; however, XXXX won't remove the lien. XXXX then trespassed onto my property and had a lock installed on the System which rendered System useless ; no electricity was generated from the Solar Panels and the XXXX Back up did not store the energy for use if the power went out. This also cut all power to XXXX circuits which were identified as " critical circuits '' including the XXXX XXXX and the Refrigerator. Thus the XXXX XXXX and my refrigerator stopped working immediately. As a direct result of this action by XXXX, my basement ended up with over XXXX ' of water and over {$110000.00} in damage to my home. All the while XXXX claims that I still owe them {$50000.00} for the XXXX that doesn't work. I engaged an attorney and have asked XXXX to come get the XXXX. They refuse and won't address the critical issues such as the damage their actions directly caused. I am giving them one last opportunity to resolve this before filing a lawsuit against them to collect the money from the damages they caused. I am planning on getting the XXXX XXXX involved in this litigation, too, if XXXX doesn't come to their senses. I've contacted the original XXXX XXXX, Sunlight Financial, and they ignore my concerns. Several calls have given the standard answer of " we're looking into it and have received your complaint. '' But nothing ever moves forward. On XX/XX/2022 ; my wife and I entered into a contract based on a sales meeting at our home to purchase a solar powered system through XXXX XXXX ( since then has been renamed XXXX XXXX ). The sales agent presented information and quoted figures that we feel are highly deceptive and patently misrepresent the ability of the system as it functions today. The total cost of the system is {$74000.00} which comes down to roughly $ XXXX. We were made to believe that our system would generate 73 % of our current energy usage, and that by improving the efficiency of our home through changes such as LED bulbs, improving insulation, etc. ; our energy consumption would further decrease. At the time, our average energy bill was approximately $ XXXX. The sales agent referenced the cost of the system being offset by the amount of savings generated through solar energy. In actuality, we are not seeing any significant change in energy utilization. Our monthly statements for energy consumption have not changed, nor has our monthly bill. We are not only paying the same monthly energy bill as prior to the system being installed, but we are also paying the cost of the system which has essentially doubled our monthly payment for energy. Because of the gross misrepresentation, we have become incredibly upset. We have tried reaching out to the sales agent but have received no response. We also have reached out to XXXX XXXX, but they state that they will not do any form of system performance review until at least 5 months have passed. Because of this, we feel that XXXX XXXX has breached the contract agreement and we should not be held liable for payments on this system and therefore can not expect Sunlight Financial or XXXX XXXX XXXX to continue to request payment for this faulty system as we want it removed from our property. To be clear, this is not necessarily an issue with the loan or repayment. We believe we were fraudulently sold a system that can not perform to the specifications that we were made to believe. This has caused a doubling of our expense without any benefit. After telling us we qualified and rushing us through the contract process he left. I'm a former XXXX XXXX customer, now that they are closed and filing for bankruptcy. I contacted Sunlight Financial because they facilitated our solar loan through XXXX XXXX for XXXX XXXX. I described my issues, such as install problems, property damaged and stolen property, items not installed that were in my contract and my system install not what was purchased in my contract, rebate check never received, XXXX XXXX for a reimbursement that i never received and the list goes on. Sunlight is giving me the run around as well as XXXX XXXX, they do not want to take responsibility for their part in this scam and even go as far to tell me that the items i listed weren't in my contract. I have documented everything, emails, text, calls and complaints. I have been fighting back and forth for XXXX even before XXXX went belly up. I have literally had to babysit the entire project from beginning to end just to get it operational, argue along the way about my list of complaints only to get nowhere. I met spoke with a sales person from XXXX on XXXX XX/XX/2021 to obtain a quote for Solar panel installation. At no point was it discussed that I required a loan as I intend to purchase outright. When the sales person asked to confirm my social security number I questioned him on why that was needed. I advised I did not want any loans or any enquiries made on my file. Sunlight Financial XXXX are taken out under false pretenses with high pressure predatory sales. Sunlight financial charges a 29 % dealers fee/ origination fee and will raise price of monthly payments after 19 months unless we pay a hefty payment out of pocket. We were told by XXXX XXXX that we would receive a rebate check from them to cover this but never received it. Sunlight financial also assured us that XXXX would send this rebate check so we wouldn't have to worry about our payment going up however pink energy soon closed its doors. The price we were pitched does not show the breakdown of what the money is going towards so we had no idea a good majority of the loan was for the dealers fee. Essentially what they are doing is taking advantage of the 26 % federal income tax credit in order to capitalize off of the tax savings that homeowners get to claim. We were originally told that the loan would only be {$40000.00} then when we got the paperwork back the loan amount was {$82000.00}. When we told them that it was way more than we could afford and told them we did not want to move forward we were threatened with a bill of {$5000.00} that needed to be paid in full for their " time processing the loan ''. When we told them that we are unable to pay {$5000.00} they said our only option was to move forward with the loan. After doing more research we found that this same tactic was used with a large majority of their customers and many were forced to take on a large loan that they could not afford. We decided to get solar panels on our home, a rep from XXXX XXXX XXXX XXXX XXXX XXXX came out and gave us an estimate and offered financing. We chose to do the financing option only to find out afterward that Sunlight Financial was not the creditor, it is XXXX XXXX Bank located at XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and we are only able to get access to them from Sunlight. This institution has participated in fraudulent and predatory lending actions on multiple occasions and in multiple states. We are now on the hook for over {$39000.00} at a minimum for a solar system that hasnt even been connected to the grid. Lets not mention that this institution knew there was bad business practices by XXXX XXXX XXXX XXXX XXXXXXXX XXXX for months and months yet continued to initiate pushy loans to unsuspecting consumers. Now we have contacted both entities to try to remedy this situation, we got nowhere with XXXX XXXX who filed bankruptcy and closed all operations yesterday, we have gotten nowhere with Sunlight Financial either as they claim they are investigating the situation yet we fail to have any correspondence from them. We now have thousands of dollars of useless equipment on our roof, nobody to service said equipment, breaches in contract, and damage to our home from this equipment. This is a multistate issue and needs to be addressed immediately. The financial burden that these people have cost my family is ridiculous and continues to grow. On XX/XX/2021 I signed a contract to have solar panels installed on the home I own. They partially installed the system on XX/XX/2021 and it is still not operating. It does not work. I have signed the dotted line so I have obligated myself for 20 years to pay for something they have failed to deliver on. The other concern I have is the federal tax credit you can get for going solar. They expect me to pay the tax credit amount on the loan by the XXXX month note. I was approved for a loan for central AC installation. The amount financed was {$7500.00} at 12.99 % APR with automatic payment withdrawal from my checking account. I received a TILA disclosure from them on XX/XX/ showing the loan term of 12.99 % and payment of {$110.00} per month and a finance charge of {$6000.00} with the first payment due XXXX On XXXX I received a " welcome letter '' from them stating that my APR was 12.99 % and my payment would be {$110.00} per month with a finance charge of {$6200.00}. I have a solar panel loan with the lender Sunlight Financial aquired by XXXX XXXX for a solar panels on my home. I was mislead by the salesmen and Sunlight Financial to believe I would qualify for the 30 % tax credit for solar energy when I file my taxes. I was told I would qualify for this tax credit and could use it as a voluntary payment towards my loan but it would need to be made by the XXXX loan payment. My issue is sunlight financial released the funds to XXXX XXXX before the project was completely installed. This is causing me to make payments on solar panels that are not functioning. This is also making it impossible for me to claim on my taxes before the XXXX monthly payment because I do not have the permission to operate which is necessary to claim as a tax credit. It states in my contract that payments will begin after Installation, and my panels were not completely installed until XX/XX/2023. In XXXX of XXXX I received a notice from the loan company that services my XXXX XXXX advising me my payment was missing. Note : the servicing company changed their address and ALL our account numbers. My payment is set on AUTOPAY through my bank so I updated the address and account number and called ( on XX/XX/XXXX ) and spoke with XXXX who advised me not to worry ; the payment would get to them eventually. She advised she would note the account and no late fees would apply. After applying for a bridging loan with Sunlight Financial for Eerie Home roofing, making a debit payment for it, and unfreezing my credit for XXXX and XXXX with which we secured a LOC, attempts were made to take funds from my XXXX XXXX checking and two savings accounts. I spotted it and contacted the bank which froze all original accounts and denied the attempts. I opened new checking and XXXX savings accounts. with XXXX. For the XXXX months that I have had the panels they have not worked. I have recording from my electric company, XXXX XXXX, that they have not received any power from our panels. Good afternoon, I took out a loan from XXXX XXXX to finance my solar panels and solar battery. They used Sunlight Financial who uses XXXX XXXX XXXX to originate the loan and then transferred the loan over to XXXX XXXX XXXX. The issue is that I am being charged unearned fees in interest for an APR of 3.49 % when the loan agreement I signed the APR is 2.99 % with ACH withdrawals as a discount. I have contacted SunlightFinancialXXXX every month for the past 3-4 months to let them know the payment amount they listed to pull from my account and are currently pulling from my account is overstated at {$160.00} when I am only supposed to be paying {$150.00}. They have updated the APR on the later statements but are still charging me a higher monthly payment on unearned fees. I have reached out several times and this has still not been resolved. What I would like as a resolution would be my next ACH payment on XX/XX/2022 to be drafted correctly for the correct payment amount & this remark to remain on their record so that they dont display this negligence again with either myself or other consumers.

I am filing a complaint against Sunlight Financial. Solar Panels were installed on our house by XXXX XXXX and Sunlight Financial is the broker. I initially reached out Sunlight Financial and XXXX XXXX over a year ago as panels were placed on our house but work was not completed per contract. Panels were not operational for about 6 months even though were being charged and they failed several city/ township inspections due to poor workmanship. I signed up for a solar home loan and the company that financed it with Sunlight Financial. The company that monitored the solar was power home solar also known as XXXX XXXX. XXXX XXXX has now went out of business and filed bankruptcy and therefore left all of its customers without workmanship on the solar system supplied by XXXX. Sunlight Financial is still trying to collect on this loan when the loan contract has been broken. Yes, The warranty with XXXX on the solar system is still valid but theres no one to service the solar system and currently my system does not work and has not worked since XXXX of 2022. Almost a year ago I began the process to have solar panels installed. XXXX XXXX was contracted to do the work. They quickly went out of business after simply putting the panels on my roof - nothing more. The wires are still dangling down the side of my house. Sunlight Financial authorized payment to XXXX despite the system not actually being installed. This began my monthly loan payments with XXXX XXXX XXXX XXXX. I have tried contacting Sunlight Financial but they rarely reply - only on their terms and requesting info they want and never to address the issues. I have a solar loan with Sunlight Financial, I have the original contract and before I signed, I was told that my loan was transferable in case I sell my property located in SC. I asked the question before signing anything because we are a XXXX family and we moved frequently. ON XX/XX/2020 i had a conversation with Sunlight Financial Services. They claimed since i already had existing credit with them that i would be approved. So while extending and adding to my solar system on my home currently they asked to run my credit due to a name correction and nationality correction. I was sold a solar system for my home under fraudulent sales tactics and false production. I notified the lender since the company had gone bankrupt and told them I was using my rights under the FTC Holder rule to withhold payment and requested them refund me my payment i have made. they refunded me 1 payment. I hired an attorney to handle this case and also included my state attorney general. My attorney sent the lender a letter back in XXXX of this year and we never heard a response back from the lender. Sunlight complaint In XXXX XXXX, I signed an agreement for sunlight financial to finance my solar panel installation which was being completed by XXXX XXXX for approximately $ XXXX XXXX XXXX did the initial installation ( panels etc ) in XX/XX/2022 but never completed all other required steps including state inspections. Regardless, Sunlight Financial proceeded to disburse funds to pink energy without first confirming with the person on the hook for repaying the loan to confirm the project was substantially complete. We purchased solar panels in XX/XX/2019. The solar panels are defective and have never worked. The solar company ( XXXX XXXX XXXX ) went out of business. According to the holder rule, due to the system being defective, we should not be obligated to pay the loan further. We are more than willing to have sunlight financial come and collect their solar panel property, but we have done more than our due diligence to get the panels fixed and it is to no avail. The salesman said it is the interest on the loan added to the project cost. Later i find out that this is a hidden dealer fee charged to the project so Sunlight Financial does not have to disclose in the APR calculations. It also appeared the company added finance charges that were not disclosed at the time of signing. We contracted a solar panel company, XXXX XXXX XXXX to install solar panels and finances that project through sunlight financial. Sunlight financial disbursed all the money to the contractor without verifying that the project was installed, and it was not. Sunlight financial refuses to give me any alternative options to resolve the is problem. Our first payment is due in XXXX and we dont have the complete product we paid for.
