I hope this email finds you well. I'm writing to you concerning my dealings with Sun West Mortgage Company. Our entire closing process and the events leading up to it were grossly mishandled and perhaps illegal. With information at times seeming to be deliberately misleading throughout the process. We started our process with S.W.M.C. XX/XX/XXXX, with it ending in no deal XX/XX/XXXX. The number one issue, they dont date their rate lock, so you are flying blind as to the terms that you are agreeing to. Even all their documentation will reflect the same rate right up until the end. To complicate matters further as, we were asked to improve our property as we were getting a cash out refinance, which cost us $ XXXX in repairs and {$900.00} in appraisals.Given the length of the process, we had a changed financial situation, that had they known their own policies would have shown we were no longer eligible but were still dragged along through the process for months. Please see the following information and pasted communication for a details. XX/XX/XXXX, after shopping for a rate settled on 2 competing financial institutions-SWMC and XXXX XXXX XXXX. In trying to appeal to us that SWMCs mortgage was a superior product and company A, their mortgage consultant, asked me to ask XXXX XXXX XXXX the following via email on XXXX Do you know if they quoted you on a 30-day rate lock or 45-day rate lock? I ask because appraisals ( like we discussed ) are taking a little longer. Therefore, I wouldn't want them to charge extension fees since it'll most likely go over 30 days. I would just confirm : ). This was also mentioned in a email from A dated XX/XX/XXXX We don't have any lender fees unless you choose a rate with a discount point. We have no origination fee, no application, rate lock, credit pull, etc. fees. We also service your loan, so things stay in house. The only other fees would be the appraisal, title work, and establishing your new escrow account. Later I found that SWMC also charge extension fees, whilst the implication from As emails imply that is what separates SWMC from competitors. I secured and locked on XXXX 2.875 % over 30yrs, with a $ XXXX cash out for renovating our home. Our home was appraised, I then received the following email from XXXX XXXX Unfortunately, since those are major renovations, the appraiser can't properly place a value on the property since the renovations can at any time be stopped. They aren't allowed to take the cash-out refinance into the equation when assessing value. If it were smaller projects, like a coat of paint or changing something minor out, the appraisers can sometimes use discretion. However, since major elements to a " functioning '' home are missing/still being worked on in regards to the appraisal standards, there will have to be a follow up check in from XXXXhe appraiser once they are completed. There are two options : 1 ) We can continue the lock & once repairs listed by the appraiser are complete, we can close. There will be lock extension fees associated. 2 ) Or we can cancel the lock for now, while you finish repairs listed, and then we re-lock & process the refinance. I elected to hold the lock and secured a contractor. Then A left the company and our file was passed onto XXXX. This was my email XX/XX/XXXX to XXXX- Hi XXXX, I saw that you've taken over our cash out refinance. Welcome! Given we have a few things we have to fix until the appraiser can make a final calculation. I was wondering how much the extension fees are if there are any? I believe our lock in date expired the XXXX. We are getting the cash out refi to finish our renovations, so that means we are in the midst of renovating. I'm hoping to get the work the appraiser recommended completed within 2/3 weeks. Will the extension be pending upon the return of the appraiser and do we know how long that could be? If you need to jump on a call this week to be caught up, I'm free. Feel free to review the email from XXXX below also. We signed more documents but still hadnt heard from XXXX, so I sent him this email dated XX/XX/XXXX Hi Everyone, I was just sent this updated disclosure requiring another fee. Could someone tell me what it's for a what the parameters are of the fee in terms of what it includes ie. how long it extends our rate etc? Many Thanks, XXXX On the XX/XX/XXXX for some strange reason XXXX replied to my question to my husbands email the following XXXX : Your lock is due to expire on XX/XX/XXXX. Can you please give me a status on the following repairs? Completion of the master bathroom, installation of the crawl space skirting and interior paint as needed. Based on the time you are expecting it would take for repairs to be completed, we would need to decide whether we should let the lock expire or extend it. Extension cost is {$70.00} per day. Please let me know. My reply the same day- We were just sent this updated disclosure requiring another fee of some {$1200.00}. Could someone tell me what the fee is for? I saw that XXXX mentioned to J that the extension would cost approximately $ XXXX day. We are waiting to lock in our contractors so we have a better idea of how long it could take to reschedule the appraiser. Could someone tell me how the rates have changed since the lock, and also if we have to go through the whole credit check thing again and what else is involved if we start the process later in the month all over again? Between XX/XX/XXXX and XX/XX/XXXX I went back and forth with XXXX assistant who informed me XXXX would have to explain what the fee was for, so I wait and then email him again. In the meantime my husband was made redundant on the XX/XX/XXXX. But I dont hear from XXXX for 10 days, so on XX/XX/XXXX I reach out- Hi XXXX, I was wondering if we could jump on a call today? We should have our work completed by the end of the month at the latest. Given that the rates are going up we would like to continue with the lock, but I would like to discuss with you what the {$1200.00} fee was for, we haven't signed that yet. No response, I contact his assistant XXXX, that Im concerned about the lack of communication so another assistant-XXXX reaches out to me via phone and then sends this email the same day stating- As discussed I will have your lock extended to the end of the month ( Friday, XX/XX/XXXX ) for closing. There will be an extension cost but we will waive the relock costs. The revised XXXX will be sent to you once this update is processed. Then XXXX asks me about my husbands work status, I email stating the XX/XX/XXXX Apologies for not informing you guys of our most recent situation, I wasnt totally aware I had to inform you immediately as XXXX got a payout for a few weeks and weve had a lot going on trying to get the house completed for the evaluation. So XXXX was paid out from ( company name ) until the end of XXXX I believe, and he is on his XXXX interview for his a new role. I will keep you all apprised of the situation. If you have any suggestions as to how this can be navigated, Im all ears. On XX/XX/XXXX XXXX gets back to me via email- Thank you for the updates. Please be aware that the lock on your loan will expire on XX/XX/XXXX. Once we get closer to that time period, we will need to decide on what you want to do with the lock. All of that will depend upon where we stand with the repairs and the new job. When there is a change in job, the underwriter usually requires 1 month of paystub and the new job offer letter. Before the lock expiration, we will need to make one of the following decisions : 1. Extend at a cost of {$70.00} per day, or 2. Relock at a future date, depending upon where the rates are at the time. I reply via email XX/XX/XXXX Thanksfor the update. Just so I know, if XXXX 's offer is delayed, is it possible to get someone to go guarantor to secure the loan? XXXX via email XX/XX/XXXX 'You could add someone as a cosigner. Do you have someone in mind who could help with the qualification? We will need to take an application, run credit, and request and verify the income/ assets for that individual. I suggest my father in law. Then XXXX via email XX/XX/XXXX Thank you for your time over the phone. As soon as I hear back from XXXX ( XXXX ), I will take his information and request him to provide necessary documents to get the loan moving forward. I email XXXX XX/XX/XXXX I understand that you're approaching your underwriter 's to see about approving my Father-In-Law as our guarantor. The improvements to the house that the appraiser XXXX recommended will be completed and ready for inspection by this weeks end. Also, could you please keep us apprised of any additional fees and the total associated with the extension? Please advise of anything we can do on our end to expedite this process. No response, so I email him again XX/XX/XXXX I just wanted to double check that you have all the information from XXXX before he goes on his trip, tomorrow? Just in case the underwriter agrees to a guarantor. If you could call me today that would be great, I have a meeting at XXXX XXXX until XXXX, but other than that I'm free. On XXXX reach out to XXXX assistants to ask if he has seen my email and that Im concerned as its time sensitive. They offer to review the file and come back with items my father in law needs to provide in order to proceed. Between XX/XX/XXXX and XX/XX/XXXX Im trying to understand if my father in law would be a guarantor or a co-signer so we know if he would have to be on the title or not. I then send assistant XXXX the following email on XXXX I hope you're well! I was wondering if you could give me some advice? Since XXXX has taken over our account the communication has been terrible. Do you know if we can request someone else take over the handling of ourmortgage? I receive a phone call from assistant XXXX apologizing for the neglect of my account and that I dont need to worry about the rate, and that they can play around with the extension fees given how long the file is taking to be completed. I had questions about the details surrounding my father in law being a co-signer and not a guarantor and not an occupant. It took until the XX/XX/XXXX to have any of these questions answered, meanwhile Im concerned that we are paying each day an extension fee. The disclosures we are given do not detail any of the lock details and the rate of 2.875 % is all over our closing disclosures. In the meantime theyre going over my father in law-XXXX 's financials to ensure he is credit worthy. They then ask if my husband has a job yet, which he doesnt, but that was the whole reason to put my father in law on the loan in the first place. XX/XX/XXXX they tell me they received the appraisal back. The appraiser doesnt inspect pier and beam, I have to organize another inspection, this time for the foundation. The same day we are required to pay a further {$200.00} to ensure the appraisal is up to date. XX/XX/XXXX my husband provides them with an employment offer letter. XX/XX/XXXX I send the foundation inspection letter, stating our foundation is sound. XX/XX/XXXX I ask if XXXX is still required to be on the loan, given my husband has secured work? On XX/XX/XXXX I ask again. XX/XX/XXXX I receive a reply that my father in law is required to remain on the loan given we have charged all our renovations to our credit cards, his credit needs to counter our new credit rating. XX/XX/XXXX I resend XXXX offer letter. The offer letter is sent with specific requests answered for and resent over. XXXX senior recruiter in the HR department emails XXXX an email on XX/XX/XXXX XXXX is honestly awful! Im so sorry youre dealing with this. I actually responded to two separate emails from them yesterday, and in both shared the information you mentioned below. ' Hoping to speed up the process I email the team on XX/XX/XXXX I've uploaded both XXXX 's XXXX statement and his first weeks paystub, I'm looking to get an employmentverification letter instead of an offer letter as XXXX has already accepted the job and is now actively employed. Let me know if there is anything else need to get this finalized, if it goes into XXXX it will be 6-mths, which feels like a really long time for a loan. Please, if there's anything I can actively be doing, let me know. On XX/XX/XXXX XXXX from XXXX emails me- Hello XXXX : Can you please give me a call so we can lock your rate and prepare the paperwork for closing? XXXX calls me at work and for the first time notifies me that we do not have a locked in rate. I tell him this is news to me given all the paper work always indicated the original rate offer. All contracts and disclosures have stated the same rate over and over again. We sent the document to an experienced mortgage broker who informed us the documents were illegal, given they do not record the expiry date of the lock. When I speak to XXXX again, he informs me he can try and offer me something else, but along the same lines. He sends me documents to sign that change the terms to 15 years instead of the promised 30. He says he will try something else. On XX/XX/XXXX I receive an email from the team I just received confirmation from our underwriting team that your loan is now ready to schedule closing. On XX/XX/XXXX I reply to the whole team via email Hi Everyone, I don't want the current deal that XXXX tried to renegotiate-no cash out refi, 15 yr home loan and an outrageous rate an 8 % HELOC. I've looked up past correspondence, XXXX is incorrect that my rate expired in XX/XX/XXXX. I would NEVER have continued with a loan without a lock. Please see the correspondencebelow and attached. Here I've asked questions regarding the rate and was aligned with the understanding expressed by Sun West, all following documentation that was given me right up until recently reflected this understanding of a 30yr cash out refi on 2.75 %. This is the deal I want without any cost to me, as that was what was originally agreed to. I have gone to an enormous effort to comply with every step and have gone into debt to renovate our home and to qualify for this loan. ' The same day they replied-They will review correspondence. XX/XX/XXXX I receive an email from the team asking if I can provide the land survey I have already provided. XX/XX/XXXX XXXX email team Hi everyone, The most recent document STILL has us down for 15 years, as I've expressed, I want the30 year. I don't want to pay close to $ XXXX After receiving more docs I email them again : Can you guys send me the proposed loan before I sign anything to do with Sun West ? I just got a Cash out refinance caution. I receive more revised docs XX/XX/XXXX and reply Hey Everyone, An extra XXXX in fees isn't going to work for us. The fact that you guys are still coming back to me after all this time ( yesterday! ) for a land survey shows the lack of attention paid to our account, going over the same information over and over again. Yes, I had to add XXXX to the account in XXXX but that took at the longest 30 days, aside from talking the underwriting team into accepting his docs and financial position. I've done this all before and have always been efficient in providing information. I understand XXXX XXXXs employment became a factor but with XXXX as a co-signer I'm still unsure why it took so long. And when XXXX did have a job offer, the fact that the underwriting team dragged their feet in accepting XXXX XXXXs employment is not my problem, to that end, even his HR person said she had never had such trouble convincing a financial institution of someone's employment! I then send another email with the XXXX offer attached. Attached is the loan that was offered to us in XXXX which we all signed. On XX/XX/XXXX I email XXXX SWMC manager, XXXX, and send her the following email- Hi XXXX, I hope this emailfinds you well. I'm writing to you concerning my dealings with XXXX in processing our cash-out refinance. The entire file has been grossly mishandled and the deal disclosed, misrepresented. As such I have been advised that I should file a complaint with the Consumer Financial Protection Bureau and have supporting documentation to verify my complaint. Please find the attached correspondence. We had a highly experienced mortgage broker go over our " non-cooling '' off disclosure that was sent to us XXXX XXXX ( which we all signed ), he said that it is highly suspect that there is no notification on the document of whether or not the rate is locked. XXXX then called me on the XXXX XXXX XXXX the 3rdtime in 6 months to explain our rate expired in XX/XX/XXXX, when I have email correspondence fromSWMCthat confirms that the rate was extended until the end of XX/XX/XXXX. During a conversation with XXXX 's assistant, he could see that my file was being ignored and that there would be some leeway on an extension. Then I received the XXXX XXXXdocs, which were the original deal and signed them. On the conversation on XXXX XXXX has tried to offer me a 15yr loan and an 8 % HELOC or the original loan that will cost me {$26000.00}. Most recently I have been offered a loan with the original rates for a cost of {$8000.00}. I want the deal that was sent to me on XX/XX/XXXX. Please let me know whereSWMCstands on the matter, then I shall know how to proceed. I leave for XXXX this week and would like it wrapped up. Obviously, if your loan doesn't close you don't pay these fees but let me see if anything can be done to reduce the cost. XX/XX/XXXX I receive a call for the first time from an underwriter at SWMC called XXXX, I ask him to email me what he has just stated over the phone. Per our conversation, Texas does not allow for a non occupant co borroweron a cash out loan. I am sending this email at your request. After this correspondence we sell our car, as XXXX is given a company car and it will lower our debt/income ratio XX/XX/XXXX I am sent a new offer in form of a document to sign I reply to the document the same day Hi XXXX We will be refusing the latest offer fromSWMC, $ XXXX for closing is egregious! Especially given we were notified for the first time yesterday, that my father in law can't even be on the loan. Which was part of the hold up on my end in the first place. So we spent all this time going back and forth over a topic that wasn't even a viability. This has been one of the worst financial experiences of my life and feels as though the negligence is intentional so as to mislead a consumer and keep the financial options forSWMCfluid. I know it is taking some time but pleasebelieveI am still workingon it. CFPB To whom it may concern : My name is XXXX XXXX XXXX and I want to launch a complaint against my mortgage company SunWest Mortgage Company, INC NMLS ID XXXX. In XX/XX/XXXX my employer filed for bankruptcy and I was laid off, at the time I was able to secure employment with a company that worked per contracts, however, the company was based out of XXXX and there were times that we will go with no work for 2 or 3 months and whatever monies we had was getting depleted. In XX/XX/XXXX I was let go from that company as well and was unable to secure employment in my field with a comparable salary in my vicinity. My husband and I had started our own business in XX/XX/XXXX so I decided that we will try to get the business going as I kept looking for a new work opportunity. On XX/XX/XXXX we started to fall behind in the mortgage and so on XX/XX/XXXX we made the XX/XX/XXXX payment and we had requested a Loss mitigation package as we wanted to get caught up with the payments. The loss mitigation package was sent to us on XX/XX/XXXX, we sent the package back but on XX/XX/XXXX they send us the denial letter stating we were denied due to incomplete documents, even though it was just a month from when we received the package. We requested the documents again, I got the letter dated XX/XX/XXXX with the documents I had requested to be able to apply one more time, but by then I was told I could not make a payment anymore because our property was sent to Foreclosure on XX/XX/XXXX. We have been told that once you send the loss mitigation package to be reviewed they cant accept any payments until the review is process. We sent those documents back and received confirmation they got them on XX/XX/XXXX, on XX/XX/XXXX I called and was advised all docs were received and the file was with the Underwriter and no docs were needed at the time. On XX/XX/XXXX additional documents were requested, sent those back as well, and our request was denied. Unfortunately, I cant find the denial letter for that application, but we went ahead and applied again on XX/XX/XXXX and on XX/XX/XXXX we got an additional document needed letter dated XX/XX/XXXX, but it only allowed me 15 days to submit the documents, which contrasts with the previous ones of 30 days. Unfortunately, I didnt realize this and sent the documents past the time frame, so then again, I was denied for incomplete application as per the letter dated XX/XX/XXXX. Please keep in mind that every time I was sending a complete package according to the income, expenses requirements stated on the XXXX like paystubs and P & L. On XX/XX/XXXX I sent yet again another package, received letter confirmation dated XX/XX/XXXX, again they asked for more docs on letter dated XX/XX/XXXX, I sent them, I called XX/XX/XXXX and they stated they received them and file with Underwriter as of XX/XX/XXXX. I received a denial letter on dated XX/XX/XXXX that states between many things, that because we are now over 12 months past due we dont qualify for pretty much anything that is not an FHA HAMP and we didnt qualify for that because my payment was greater than 40 % of my income. I then sent an appeal to the denial on XX/XX/XXXX since my husband had gotten a Part time job in XX/XX/XXXX that had increased our Income and so I was using him as a Non-BW contributor. They sent me another letter for even more documents date XX/XX/XXXX, Mind you I had just sent the proof of his income with the appeal Paystubs and new P & L for our business but now they also wanted information about repairs needed in the house since Hurricane Irma had done some damage back in XX/XX/XXXX. ( Please keep in mind that on the previous denial dated XX/XX/XXXX they didnt mention anything about the damage being an issue on the modification review ). I sent all required documents on XX/XX/XXXX and in letter dated XX/XX/XXXX they denied us again, this time because The repairs have not started yet and hence repairs would drain our monthly resources However, we had sent documentation showing that the claim was submitted to the insurance company and we are pending the payment to start the repairs. That Brings me back to the last application I sent and it was received on XX/XX/XXXX. I sent a new application because I have now secured a full time job, so I my income has changed. But then again they are asking for a list of documents in excess of the documents needed and requested, and I honestly believe that they are trying to make this process to cumbersome that no matter what I try I wont be able to save my home. For Example, This application was submitted on XX/XX/XXXX. Why am I being asked to submit my XX/XX/XXXX and XX/XX/XXXX XXXX forms when they already have my XXXX form filled with which they can obtain my transcripts if thats what they needed? And on top of that to ask for also my tax returns again? Why are they asking for clarification of deposit for the business account? Dont they know is a business and so there will never be a deposit equal to the other since the invoices are never the same? Is this really necessary? Please, if there is anything you can do to get this process done and reviewed once and for all. All I have been trying to do since I was only 2 months past due is resolve this issue and keep my house. The longer this takes the more I owe and now I cant even try to get caught up at all!!! If you go to their website and request a loss mitigation package it only gives you the XXXX and not all the other documents that need to be filled out. You have to dig in to find out that you also need a XXXX and Expense sheet, and so may other things. I also have an issue with them requesting that we send proof of our GAS expense because they believe that Im not putting enough expenses on my disclosure. I am applying for the loan modification with my XXXX income and my Self employment income, both of these combined are now sufficient to pay my mortgage and as I am the only one on the loan I only sent the expenses based on what I pay. Remember that I live with my husband and he pays for some of the expenses on my household. I dont pay for everything there is to pay so how can I prove this? I believe they are being unreasonable on the amount of documents they are asking for continuously. I have paystubs and P & L, I have sent both and bank stmts sustaining my income, taxes can be obtained with the transcripts from IRS even though i have sent the actual tax returns as well. They are making this very difficult and because of this back and forth of additional unnecessary documents too much time has passed and we are unable to get caught up unless a modification is approved as we now owe over twenty thousand dollars including attorney fees. To my understanding as long as the documents are sent for review within a certain time frame of being originated Ie : Bank statements ( 30 days from UW review ) There should not be such thing as Refreshing of expiring documents. Is this correct? Because that is what they are requesting now amongst other things. They have also sent contradictory letters in regard to our denial on the last application. One letter says it was because of the house damage, and the other letter sent after says it was denied due to incomplete documents. This company seems to be incompetent and not borrower friendly. I tried to make a payment back in XX/XX/XXXX but I was not allowed because I called 1 day too late. Also an agent has told my husband as well that once they get the loss mitigation package no payments can be made. And ever since the nightmare has not stopped. I have attached : * Copy of denial letter dated XX/XX/XXXX ( income denial ) * Copy of the Appeal additional documents requested. I would like to file a complaint against LowRates.com by Sun West Mortgage Company Inc., NMLS ID XXXX. Due to their lack of disclosures and timeliness I lost out on thousands of dollars. I have chronicled my emails and phones calls with the two individuals below : XXXX XXXX, Mortgage Consultant | NMLS ID XXXX XXXX XXXX, Sales Manager | NMLS ID XXXX My complaint revolves around a mid-day rate change which I was not made aware of as a possibility during the application. I did an application over the phone with XXXX XXXX and was quoted a rate and was asked if I wanted to lock in the rate. I asked if I could see it in writing and was told the Loan Estimate would be sent within 10 minutes and that I would get a call once sent and we can lock in then. Almost 3 hours later I received a call stating rates changed and I was out of luck. I then spoke with his manager XXXX XXXX who repeated there was nothing that he could do for me, that XXXX XXXX 's delay in getting back with me was due to them trying to get me exception pricing. I stated that while I appreciate that, I should have been informed of the issue as it was happening so that I could decide to take another offer I was given. Instead they called me back so late that I could no longer reach the loan officer at the other mortgage lender and missed out on locking in on their rate. When I asked for his name and NMLS ID he asked me why I wanted to know after providing it and when I told him I planned to file a complaint he became irate, trying to guilt trip me into not submitting a complaint, saying I was threatening his livelihood and that I was coming after his two little girls, and attacking him and his wife. I have never had someone try to guilt trip me so hard, it was super unprofessional and just plain wrong. I specifically want the following answered/addressed : 1 ) Are certain disclosures required at application, if so, which? And is the company alleging they provided them all to me? I feel like the fact rates can change mid-day should be a required disclosure at application ( if not, that is feedback ). I was aware they could change daily but not mid-day. 2 ) I feel as if there may have been a bait and switch done. XXXX XXXX told me he could beat a competitor 's rate and verbally told me he beat it, it was only after I requested the official Loan Estimate that there was an issue. 3 ) Their rate of 2.375 % for 30 year with only {$2700.00} in points almost seems too good to be true after talking to other lenders for XX/XX/2021. Is there any chance that XXXX XXXX messed up on the application and misquoted me and then tried to cover it up claiming a mid-day rate change occurred? 4 ) If a mid-day rate change did occur, at what time did the rates change? And when did XXXX find out? Timing is key here and the fact I should have had my Loan Estimate within 10 minutes of phone application yet didn't receive a call for 3 hours has me questioning the timing. 5 ) Is it appropriate to have a manager bring up his family to guilt trip me into not submitting a complaint? I feel like that in of itself is an issue. 6 ) The manager refused to let me speak to anyone else. Do consumers have the right to escalate further with the mortgage lender? I emailed two random directors I found on their website but neither replied. Below are the phone timestamps with a summary of the call. Attached is all email correspondence : Incoming Phone Call, XX/XX/2021 XXXX XXXX CT ( 48m 7s duration ) : XXXX XXXX called to complete the refinance application over the phone. Towards end of call he confirmed 2.375 % rate, with {$2700.00} in points and XXXX {$1200.00} in title fees. He asked if I would like to lock the rate and I asked if I could see the loan estimate. He said yes, that I would receive it in 10 minutes and that he would call me as I received it so we could review it together and lock in the rate. Incoming Phone Call, XX/XX/2021 XXXX XXXX CT ( 4m 28s duration ) : XXXX XXXX called to inform me that rates changed mid-day and he was unable to get an exception to honor the pricing I received over the phone. I expressed my frustration since I was literally quoted a much lower rate and was told within 10 minutes I would have paperwork to lock in the rate. He advised I should call back the other company and lock in their rate ( I had forwarded XXXX a Loan Estimate from a competitor earlier in the morning that he replied back stating he could beat ). I advised him that the loan officer just left for the day and that I wished he hadn't waited so long to tell me the bad news ( now after XXXX XXXX CT ). He said that was unfortunate but that we could check the rates tomorrow morning and he would reach back out shortly after XXXX XXXX CT. Incoming Phone Call, XX/XX/2021 XXXX XXXX CT ( 9m 43s ) : XXXX XXXX called since I requested to speak with the manager via email with XXXX XXXX on XX/XX/2021. He informed me that due to market volatility there was a mid-day rate change on XX/XX/2021. I explained that XXXX set expectation to call me back within 10 minutes as I should receive a loan estimate by then so I could lock the rate in. Instead XXXX didn't email me until XXXX XXXX CT stating " Did not forget about you and just waiting for them to send the loan estimate over to me. ". I explained that I waited until XXXX XXXX CT before replying to XXXX asking " Any update? Am I able to lock the rate prior? I want to lock in before the day is over. '' XXXX ultimately said XXXX took so long to inform me due to trying to get exception pricing for me. I mentioned that while I appreciate that, XXXX should have informed me of what was going on while it was happening so that I had time to lock in the rate with the other company. Instead he waited until the end of the day when I couldnt lock in the rate with the other company. XXXX questioned why I couldnt have locked in and kept repeating there was nothing he could do for me, that they did nothing wrong. I asked for his name again and his NMLS ID. After he provided it he asked why I requested that information. I informed him that I planned to file a complaint with the CFPB, Texas Department of Savings and Mortgage Lending, and Sun West Mortgage Company. He immediately became defensive and said I was threatening his livelihood and that I was coming after his two little girls, and attacking him and his wife. I have never had someone try to guilt trip me this hard, it was super unprofessional and just plain wrong. I stated it wasnt my intention to make it personal, just that I felt like something was done wrong and at bare minimum that my experience should be heard by those areas. I added that if he did nothing wrong, that he should have nothing to worry about regarding his family. He was still defensive and a bit hostile, but stated he would try going the exception route and to give him 24 hours before submitting my complaints. We are lodging a complaint against Sun West Mortgage Company, XXXX ID : XXXX regarding an ongoing debacle that has persisted since XX/XX/XXXX, including but not limited to lack of clarity on : 1 ) .Repayment options available at the end forbearance plans, 2 ). Communication issues related to forbearance, 3 ) .Delays from the servicer with regard to loan modification, and 4 ). Erroneous credit reporting during forbearance and modification period, etc. Due to the Covid-19 pandemic, our VA home loan was under CARES Act forbearance from XX/XX/XXXX through XX/XX/XXXX. On or around XX/XX/XXXX, Sun West Mortgage was contacted regarding our options for getting the mortgage on track once forbearance ended and possibly desiring to end it early ( XX/XX/XXXX ) so that the mortgage payments could resume and we could refinance. Sun West indicated in multiple conversations that refinancing was not an option we would have with them. Several conversations took place during this two month period that went undocumented. On XX/XX/XXXX, Sun West Mortgage intentionally reported the mortgage 30 days late for XX/XX/XXXX while it was under CARES Act forbearance, presumably to prevent us from the option of refinancing with another company. We contacted them immediately on XX/XX/XXXX when notified by another lender of the report. This matter had to be escalated several times to no avail until finally reaching an XXXX XXXX ( Servicing Team Lead ) on XX/XX/XXXX who sent an email instead of the requested explanation on company letterhead. The written letter was not received until XX/XX/XXXX. By this point the damage the reporting had on the borrower 's credit score was significant and halted the refinance process with two lenders. During this period a partial claim modification with Sun West Mortgage was discussed and sent out by Notary on or around XX/XX/XXXX. The partial claim agreement for modification was structured wrong and both we and the Notary contacted Sun West Mortgage that day to advise. We also contacted the VA concierge to have them contact the mortgage company on the proper structuring of the Partial Claim Modification. Naturally, the forbearance was ending on XX/XX/XXXX so we resumed making online payments on XX/XX/XXXX. On XX/XX/XXXX, we received a letter from Sun West Mortgage indicating " we would like to work with you on a Loss Mitigation Home retention ... A Workout Package or request for additional information has already been mailed to you ''. Three days later on XX/XX/XXXX, we received two certified letters address to us individually of " Notice of Default and Intent To Foreclose ''. We contacted Sun West believing this was an error and were told we needed to speak with a specific agent in Loss Mitigation, XXXX XXXX. We left several voicemails between XX/XX/XXXX and XX/XX/XXXX and never received a return call from this agent. On XX/XX/XXXX, when we attempted to make our next online payment we received a message that our account was essentially blocked for online payments and we needed to call the number to make payments. When we called, we we expressly told that we Sun West would no longer accept monthly payments for the loan and the full amount from the forbearance period would need to be paid by XX/XX/XXXX for regular monthly payments to resume. We called the VA concierge on XX/XX/XXXX who emailed Sun West immediately requesting " borrower be provided with clarity and detailed loss mitigation status ''. On XX/XX/XXXX. XXXX, Sun West reported the loan 120-days delinquent to the credit bureaus for XXXX, XXXX, XXXX, XX/XX/XXXX during the forbearance period. This impacted the credit score again, dropping it significantly. We had to contact Sun West again to have this erroneous reporting corrected. We finally received the corrected Partial Claim Modification documents on XX/XX/XXXX, more than two months later. The documents were signed, notarized, and returned around XX/XX/XXXX. We received a phone call from Sun West approximately XX/XX/XXXX that a correction was needed on a witness signature for the documents and they would send that page only back via XXXX. We received it and made the correction and mailed back around the XX/XX/XXXX. On XX/XX/XXXX, we were once again unable to continue making payments as the CARES ACT forbearance allows and when attempted with a phone agent, the Sun West agent again indicated that he was being blocked from making payments also. We spoke with multiple individuals from both customer service and the loss mitigation assistance department and none were able to advise us on why we are unable to continue our monthly payments like we began on XX/XX/XXXX. On today, XX/XX/XXXX, we called Sun West again to follow up the status of the Partial Claim Modification and were told " Sun West is restructuring the documents and resending them soon '' by XXXX ( XXXX. Assistance Loss Mitigation Team ). When ask XXXX when will Sun West remove the block for us to resume monthly payments as the CARES ACT allows, she stated you can always make payments. When we clarified for her the issues we have had and lack clarity of the payments being blocked, she indicated that back in XXXX when the modification was denied, the letter of intent to foreclose was sent and the full amount required to be paid that created our inability to make online payments. However, she could not explain as to why we had been told repeatedly we could not make phone payments directly with Sun West representatives for the past two months and proceeded to schedule multiple payments for the account. We have full and complete documentation of everything discussed here. Understanding that Sun West had the ability and options, and our full cooperation to resolve the issues of this complaint for more than 6 months now, we are hoping for some type of accountability that corrects Sun west actions and mishandling of consumer accounts. Specifically of creating unnecessary delays that negatively impacts and affects the consumer 's credit, finances, and financial abilities to handle their responsibilities.

The complaint is about my current Mortgage company but I have to begin my story as to how I got to this extreme financial and health abuse! However it's bad enough that since XX/XX/XXXX IHSS XXXX, extreme corrupt XXXX and XXXX subjected us to myriad of Torts and still ongoing, subjected us illegally to severe financial hardships due to several Governmental Torts of turning off entitlements for my severely XXXX son ; his caregiver, a severely XXXX senior ; due to when moving from a rental because we purchased a home, when we have ten days of notice, when I was on my last truck load, misclassifications ; assumptions ; spying ; intimidation ; denials ; misconduct and even criminal acts that led me to total financial disaster! Afterwards, my financial situation has collapsed ; since, when I had a credit score of XXXX. Since, all the liberal banks like XXXX XXXX ; XXXX ; XXXX, and XXXX XXXX shut me down and cancelled my cards. I had 11 accounts with XXXX, but XXXX is still harassing me after 16 years of loyalty and perfect payment record! Therefore, in the beginning of XXXX of governmental payments were withheld, XXXX was not even getting paid, due to 3 misclassifications of my DAC ( XXXX Adult since XXXX ) son! At the time when I was just moving into my purchased home. I then refinanced my FHA loan 6 months later, with the indicated mortgagor, Sun West! However, they volunteer to offer me a {$5500.00} loan as a lien at 3.5 % interest. But with the excuse of my credit when it was he same when the refinanced my FHA Loan, they increased the second loan to 7.75 % interest, without notice! And I have low vision ; thus, it hurts to focus my eyes to read due to my optic nerve damage over a decade ago due to an auto accident ; thus, I mostly use my large duo monitors and my Text To Speech Readers to read! However, I was elated that a new finance company was willing to refinance me at a lower rate! I submitted everything the pending mortgage company asked me for ; however, they were asking for the legal document for the small lien. This is the major problem I am complaining about. I requested the legal document from Sun West and asked them why they are claiming 7.75 % interest when it started at 3.5 % but never informed me it was going to more than double my interest! They did email me the document ; however, their subjected me to extreme security paranoia. In other words, to open the document it requires a password, they sent me on a separate email! I opened the document and saved it on my computer. So I thought ; however, even though I can see the document, I can not printed, fax it forward it or view it again. Since, I get an error message and the prospective mortgagor indicated that the document was blank. I was into disputes with them this morning, when I was feeling well. Since, we still get XXXX symptoms we contracted last XXXX! In addition, I have cerebral hypoxia, XXXX fatigue, broken sympathetic nervous system ; thus, this autonomic nervous system does not function during negative stress and get very ill, like this morning. The first representative kept repeated that there was nothing she could do due to security paranoia. In other words, they are disgruntled because I am trying to refinance and have been approved. After the first call, I was very upset. Then XXXX, so called a supervisor called me back and said she was willing to fax the document to me! I connected my fax ; however, for about ten times a fax with the number from XXXX, XXXX was trying to fax the document to my CELL PHONE NUMBER, instead of my fax. I try to contact them but they were not available. I did filed a complaint to HUD and to their superiors regarding this incident. I am so afraid not to be able to refinance because of Sun West refuses to provide the legal and registered document they had failed to provide to me! The new mortgagor is going to refinance me at 2.75 %! They do have many similar complaints online. In other words, they irrational policies are more important than their customers and have a funny way of showing how the refuse to let me refinance and want to keep me. Of course, they are abusing me financially! Please help me, before the new mortgagor loses interest! Please help me! I did not ruin my credit score but the local government so called adult support services!

I was contacted by XXXX XXXX ( NMLS XXXX ) with XXXX XXXX on XX/XX/2021 inquiring if I was interested in refinancing for a rate reduction, I said yes, and we immediately began the process. An appraisal in the amount of {$450.00} was needed that I paid for in XXXX, that was not disclosed upfront. I also informed XXXX at that time that I had supplemental property tax that were due, and he assured me they would be included with the refinance and not to worry about paying them. I asked him what was needed and forwarded everything expeditiously. He advised me we would close in XXXX, therefore I did not need to make the XXXX mortgage payment, instead my husband and I needed to pay off debt to lower are debt to income ratio. Only to inform me the last week in XXXX that we would not close and the XXXX mortgage payment needed to be paid. He again assured me we would close in XXXX and XXXX mortgage did not need to be paid, only to be told at the end of XXXX that we could not close because I needed to be in my loan for one full year, therefore we would need to hold off until beginning of XXXX. I paid the XXXX mortgage, again late. He informed me on XX/XX/XXXX that I would be signing closing documents in a few days. Unbeknownst to me, XXXX switched companies and moved to Sun West mortgage and initiated a new application XX/XX/XXXX, therefore he knew the signing date he provided me was not true. Again, advised me that I did not need to pay XXXX mortgage, only to tell me to pay it specifically on XX/XX/XXXX, and XXXX again we will close. XX/XX/XXXX, I no longer felt confident with working with XXXX, therefore I reached out to the Division Branch Manager, XXXX XXXX ( NMLS XXXX ) by email inquiring on the status of the loan. To date, XXXX never responded, instead forwarded my inquiry to XXXX who called me back. XXXX asked me to only speak with him, as XXXX and nobody else really knew anything about my file, even though XXXX was listed as the loan officer. I advised XXXX in XXXX that it was imperative that we close, as all the back and forth along with other personal issues had finally cause a significant strain in my finances, and I would not be able to make the XXXX payment. Again, XXXX assured me, things would be okay, and even if I did not make the XXXX payment, he had it all under control. He explained he would be able to extend the lock in date to a date in XXXX where my current mortgage company would not report the 30-day notice to the creditors, which they absolutely did! Finally, XX/XX/XXXX, he informed me that I must make the XXXX payment then Ill be able to sign my escrow documents. I made the payment for XXXX, and signed my escrow documents XX/XX/XXXX with a funding date scheduled for XX/XX/XXXX, which did not happen. XX/XX/XXXX I reached out to XXXX inquiring about the funding date and informing him XX/XX/XXXX was within the upcoming week, which another mortgage payment would be due and if it didnt fund, I would be behind another 30 days for XXXX, which will reflect on my credit as did XXXX. His response, were funding this week to avoid that. XX/XX/XXXX, XXXX again informed me, we should be all set for closing today or tomorrow. XX/XX/XXXX, I reached out again inquiring, and XXXX informed me we were just waiting for update/verify the current payoff. Shortly after, I received a phone call from XXXX stating a verification of mortgage was needed to close. Also, due to the 30 day late payment from XXXX, and I had not made the XXXX mortgage payment, they will likely be unable to complete the refinance. At that point, I asked XXXX to withdraw the application and forget it. He had screwed the entire refinance up by misinforming and misguiding me. I walked away with {$390.00} worth of monthly late fees ( {$65.00} per month XXXX XXXX ). XXXX and XXXX mortgage due ( {$4600.00} ), a 30 day late credit reporting, and {$2900.00} defaulted supplemental property taxes, because of XXXX. To date I have yet to receive a formal notice from Sun West declining my application. I emailed XXXX XXXX and XXXX XXXX to express how disappointed I was with all of this. XXXX, again, never responded. XXXX, responds my sincerest apologies which isnt enough!!!

XXXX ( signed refinance documents with notary ) The loan amount with the business : {$720000.00} Sun West Mortgage Company ( Loan officer : XXXX XXXX XXXX : XXXX ) promised us if we refinance with them, we did not need to make mortgage payments for XXXX & XXXX, our first payment with them will be XXXX, we will lower our APR 3.375 % to 3.25 %, we will get rid of PMI thus lowering our mortgage monthly by roughly {$300.00}, and since its a refi our closing costs will be really low. They also promised to put our escrow balance from the previous loan with them into a new escrow account so the money will be used for the XX/XX/2021 property taxes ( as it was set aside the whole year for the taxes owed ). Sun West Mortgage Company made multiple errors during the refi process and failed to inform us ( homeowners ) of their mistakes. The first mistakes were not caught until after the refinance at the funding process to fund the loan. They blamed the owners for not having enough funding and using the stopped XXXX mortgage payment as the solution to why we were short funded. The issue escalated multiple times to managers and the loan officer was not helpful. It went all the way up to XXXX XXXX ( XXXX ) and she was provided text message proof with our loan officer of the promised no mortgage payments for XXXX. She informed us there was a communication error with down the route from loan officer to originating/servicing/funding departments. They offered to cover the shortage due to their mistake and there was a payment of {$1300.00} on XX/XX/XXXX showing, just 4 days after we resolved the issue with XXXX XXXX Email confirmation and text messages documented. The other mistakes were not held responsible and caught until after they sold our newly refinanced loan to XXXX XXXX. They used our escrow balance to lower the loan principal balance after multiple times our loan officer kept reassuring us it will be put into a new account. They also took away the property prepaid costs in our closing costs section so it looked like they were able to lower the closing costs by half. After we inquired, they merely told us their higher ups were able to do some magic and lower our costs. The business only tried to resolve the issues when it got escalated to XXXX XXXX during the time of funding the loan. After the loan was sold to XXXX XXXX, in a little of less than 2 months of closing for the refi with Sun West, the escrow analysis letter was sent to us XXXX XXXX, showing we had a shortage due to the property taxes and insufficient funds. During this whole, we were not aware of any issues they had and were always surprised through a letter. We tried to contact Sunwest with this issue but it was very hard to get a hold of someone. Wherever they would explain it had to do with originating dept or servicing dept, they informed us they would investigate and call us back. After a week or two, we just get a letter in the mail of their explanation, usually indicating they made a mistake but it was still our fault because they covered their grounds. In this most recent issue, they informed us of their inadvertent clerical error for changing the property taxes at closing to {$0.00}. But their backup resolution to cover themselves, informing us they provided {$1300.00} + {$1300.00} to principal balance to reduce the loan balance and providing {$2000.00} cash to close. We already questioned why there was cash to close when we didnt want any cash at closing. The amounts above of {$1300.00} were entered XX/XX/XXXX for them resolving their short loan funding problem. In this letter, they explained it as if they already gave us the money ahead of time so all that should cover the property taxes. We have made so many calls, attempts to get the issues resolved and even contacted our loan officer after her mishap. All have not tried to resolve our issue. The only thing they provided time and time again was a XXXX gift card with every printed letter explaining themselves.

Background. This is the second CFPB complaint I 've found it necessary to file arising from a HECM I have with Sun West Mortgage Company ( " SWMC '' ). CFPB Case Number XXXX is incorporated herein by reference. SWMC falsely claims that it has not received proper documentation of the completed repairs as a pretext for illegally retaining the unused balance of my repair set-aside funds for its own enrichment. SWMC is illegally withholding the unused balance of repair set-aside funds ( well in excess of {$2000.00} ), which it should have reimbursed to me and/or credited to my line of credit four months ago, by using a stratagem claiming that SWMC has not received proper documentation of the repairs. All repair work in connection with this loan has been fully paid for by me, and inspected and certified by an FHA inspector as required by HUD. Further, I have ( a ) documented to SWMC that I furnished all materials and paid my construction provider ( who is a licensed contractor as required and approved by SWMC ) in full, out of my own pocket, for installation, as previously agreed with SWMC ; and ( b ) provided SWMC with a " Paid In Full '' invoice signed by my construction provider and me, as previously agreed with SWMC. In XXXX 2016 I provided SWMC with a written request for reimbursement in the amount of {$1400.00} for my final out of pocket expense for labor, at which point SWMC unlawfully refused to reimburse me as agreed. Instead SWMC demanded that I and/or my construction provider ( SWMC ca n't decide whether it 's one or both ) execute an inappropriate proprietary deposition document by falsely terming it a mechanic 's lien ( it is NOT a valid California mechanic 's lien ). Moreover, SWMC apparently dunned my construction provider with phone calls trying to find out if I really paid him. SWMC fraudulently skimmed inspection fees from my repair set-aside. SWMC fraudulently skimmed an unauthorized {$100.00} from my repair set-aside funds claiming they used it to pay for an inspection fee that I had already paid ( in fact, over-paid ) in escrow. Skimming inspection fees is a familiar tactic of predatory lenders ( XXXX ). SWMC is trying to force this loan into foreclosure. As I stated in my XXXX 2016 complaint, I believe SWMC is a lying, thieving, predatory lender using every trick in the book to have an excuse to declare this loan in default and foreclose ( my property is currently worth substantially more than the loan balance ). Likewise, it has recently become apparent that HUD is enabling SWMC 's stratagem to declare this loan in default and foreclose. On XXXX XXXX, 2016 I filed a HUD complaint against SWMC for defaulting on its repair set-aside payments to me ( XXXX reference number XXXX ). For three months various representatives at HUD, FHA, and XXXX XXXX XXXX stonewalled and spun out a string of XXXX XXXX excuses for not acting on my complaint in a timely manner, until they apparently finally ran out of excuses and announced that if SWMC wants me ( or my construction provider ) to sign a document, whether applicable or not, I ( or my construction provider ) am required to sign it. On XXXX XXXX, 2016, by letter I appealed to HUD Secretary XXXX XXXX ( copy attached ) but never received any reply or acknowledgment whatsoever. In light of HUD 's well-known unsavory mortgage sale giveaways to XXXX XXXX speculators, it is my view that HUD has proved beyond a doubt that it is more interested in lining up with its exploitative business partners, lenders and mortgagees like SWMC than with its exploited HECM borrowers. Based on my first-hand experience with the representatives at SWMC, HUD, FHA and XXXX XXXX XXXX, it 's my view that this is based on an insidious, discriminatory, stereotypical perception regarding HECM borrowers being easy prey.

My initial concerns included real online reviews by actual customers. The online reviews by customers raised initial concern for me when I informed my mortgage was temporarily transferred to Sun West Mortgage Company. The reviews posted by actual customers do not mean the company is a bad company but they do suggest there is room for improvement. I noticed attempted use of advanced psychology to give the appearance of versus real, relevant customer service by including links to fake/ company created XXXX infomercials most likely by paid actors whose point of view and opinion will be slighted in biased favor of Sun West Mortgage Company . It is my opinion that someone dropped the ball by not processing an electronic payment I did for XX/XX/XXXX. I did an electronic payment I received an email confirmation and I also printed out/ did a print screen and pasted the info into MS paint to ensure I had a copy of the info. Sun West is claiming that there was incorrect routing or account number which I find hard to believe as I copied and pasted the account and routing from my online checking account to my online Sun West account when placing online payment to them and receiving payment confirmation. I was very hesitant to be transferred to a call center XXXX and discussing my financial information, unfortunately this normal for some companies versus keeping jobs in USA. The call center was not much help, they did not discuss what the issue was or why I was being contacted, only that I was being recorded for some unknown reason ( for XXXX, a radio show, who knows ). All the call center really did was transfer me to company rep voicemail. I was provided the toll free number of Sun West Rep with an extension number to speak to however I could never reach them. When calling the number the automated system indicated you needed to dial an extension or press XXXX for the operator. When you pres XXXX for operator the voice system takes you back to original recording, realistically you only have the option to dial extension which goes to VM every time. I attempted to make a online payment on via their website XX/XX/XXXX which Sun West Mortgage intentionally blocked and prevented on their website. It is my opinion that Sun West wanted to increase revenue from late fees by blocking my ability to pay online thus increasing likeyhood that I may need to pay past XX/XX/XXXX if needing to go to XXXX XXXX. I made a very reasonable attempt to pay on time, actually multiple times that Sun West Mortgage intentionally obstructed and prevented. I also noticed that Sun West Mortgage prevented me from printing the section of the webpage that showed the detailed information preventing me for paying online, I still did a print-screen and pasted in M.S. paint and saved the webpage as alternate ways to show the truth of what they did. SunWest called my parents asking them for payment in regards to my house payment something that should not have been done, is rude, and I did not appreciate. Due to the inability of Sun West Mortgage to send me detailed email or letter to home fax as requested point blank I requested they speak with my legal counsel which they refused to do. Due to enclosed factors in my complaint I am writing for federal investigation and resolution. I am no fool, it 's a home and the bank has many legal options as do I to resolve concern such as writing ( agency name ). As soon as I can go online in their system and pay them I will do so, whether or not Sun West Mortgage ( aka SunWest ) does what they are suppose to and should do to accept and process payments from customers has yet to be seen. We closed on our home on XX/XX/XXXX with Sun West Mortgage Company ( " Sun West '' ) as our mortgage provider. We decided to escrow our county land tax, FHA insurance, home owner 's insurance, etc. We made our monthly mortgage payments. In XX/XX/XXXX or XX/XX/XXXX ( letter dated XX/XX/XXXX ) we received an " Annual Escrow Account Disclosure Statement '' letter, including projections for the coming year. On this letter, it stated that there was a surplus of {$610.00} in our escrow account and that the surplus would be returned to us. On or about XX/XX/XXXX, Sun West issued us a check for an escrow surplus of {$610.00}. Once we received the check, we deposited it into our local banking account. We continued to make our mortgage payments monthly. On or about XX/XX/XXXX, we received a notice from the XXXX XXXX Trustees Office concerning our land taxes. The notice stated that our land taxes had not been paid for the XX/XX/XXXX or XX/XX/XXXX calendar years. The notice also stated that it was believed that Sun West was actually paying our neighbors taxes. We immediately notified Sun West of this issue. Our taxes were paid in full on or about XX/XX/XXXX. In XX/XX/XXXX or XX/XX/XXXX ( letter dated XX/XX/XXXX ), we received another Annual Escrow Account Disclosure Statement, including projections for the upcoming year. We were shocked to see that we now had a deficit in our escrow account of {$860.00}. We immediately called Sun West to discuss this as well as other issues that we were confused about. After many discussions with Sun West, we received a packet in the mail regarding all of our concerns, and Sun Wests formal responses to them. While two concerns were properly addressed, we felt that the initial concern our large deficit in our escrow account was not. On page 1 of the packet, Sun West admits that It was found that due to an inadvertent administrative error on the part of Sun Wests tax payment processing vendor XXXX, the parcel information for the subject property was incorrectly reported for your loan. As a result of this error, the property taxes were paid for a different property ( our neighbors property ) for the years XX/XX/XXXX and XX/XX/XXXX. Sun West sincerely apologizes for any inconvenience caused to you due to this situation. On pages 3-4 of the same packet, Sun Wests response can be found in regards to Concern 1 Why did Sun West send a refund check if Sun West did not want you to cash it. Their response is as follows The refund of {$610.00} did not belong to you as it was calculated on the basis of tax payments made for the property belonging to ( our neighbors ). ( pg 4 ) However, as explained earlier, Sun West was notified of the discrepancy in the parcel information for the subject property on or about XX/XX/XXXX. This meant that the analysis completed on XX/XX/XXXX was completed with the incorrect parcel information for the subject property and thus was null and void. It is our position that the deficit in our escrow account has been directly caused by the mismanagement of our mortgage and escrow accounts by Sun West and their tax payment processing vendor XXXX. Due to their administrative error, Sun West and XXXX are directly responsible for the taxes being paid incorrectly, the initial escrow account surplus and resulting check for {$610.00}, and now this deficit caused by the surplus check and the tax differential between our property and our neighbors. The administrative error has had a direct impact on why our escrow account has such a large deficit at this time. We do not feel as though we are responsible for Sun West and XXXX errors which resulted in this situation described within this complaint. Please see attached documents for reference.

BELOW IS AN EXCERPT FROM THE LETTER SENT TO MY MORTGAGE LENDER, WHICH THEY HAVE REFUSED TO RESPOND TO IN OVER 90 DAYS. THEY ACKNOWLEDGED RECEIPT OF THIS LETTER BUT REFUSE TO ADDRESS MY CONCERNS. Dear Sir or Madam : I am writing to you for the 2nd Time to dispute the validity of accounting and servicing of my mortgage, your accounting practices are such that all payments are credited to fees and/or penalties which are given application priority over principal and interest crediting which subsequently leads to your compounding additional late fees when the security note expressly states that late fees is applied to currently due principal and interest only. Moreover, there is no continuity of contact, your email communications contain the perfunctory tag " single point of contact '' for the sake of appearing to comply with the law, ( XXXX XXXX, XXXX XXXX, XXXX XXXX ) contact with XXXX different individuals does not equate single point of contact. However, upon calling that person is not available, whomever answers the call greets you with he/she is not available but I can or I 'll transfer to someone else in that department who can help, questions regarding accounting are not answered the information is not available. For example, my escrow account was being over charged, property taxes were calculated incorrectly, I was promised a return call that never occurred. This second request is to inform you of my need for additional information regarding various charges, credits, debits, transactions, reversals, actions, payments, analyses, and records related to the servicing of my loan from its origination to date. To date, the documents and information you have sent me, and the conversations with your service representatives, have not answered my questions. My 1st written request was on XXXX XXXX, 2016, your company acknowledged receipt of this request via email on XXXX/XXXX/2016. However as of today you have failed to provide me with any form of resolution of the errors, provide information requested validating these errors as being correct, provide investigation of my concerns and you have failed to explain in writing why you have refused to address my request. It has been over 90 days and you have essentially ignored my written request and have continued to erroneously service this mortgage, which violates RESPA. I currently have a home loan with Sun West Mortgage Company Inc. that I am refinancing with the same company. I started the process around the beginning of XXXX. Everything started off smoothly, recently however, the process has been severely delayed by Sun West and it 's service providers. I have a number of questions, all of which I have addressed to Sun West, and none of which have received any sort of satisfying response ( if any at all ). I have a number of concerns regarding the process ; 1 ) My original loan processor mysteriously changed after my appraisal and I was given absolutely no understanding of why - or prior notice that it would happen. 2 ) My appraisal took forever to order and complete - and after it was finally done in XXXX, I was advised it had passed with an evaluation of XXXX 3 ) I was contacted the next week and advised my appraisal did NOT pass and that I needed to put 40 hours worth of paint work into my garage. I had to complete that work in two days! Despite asking multiple times - no explanation was provided for why I was told it passed and why I had to wait days longer to find out it did n't. 4 ) I was told by my original and newly assigned processor not to pay my XXXX or XXXX mortgage as these would be rolled into my new loan, however, the same company has ( as of today ) contacted me 3 times to threaten my credit if I do not immediately post a payment. Each time I call my processor they assure me everything is fine, my credit wont be affected and they will get the collection dept to stop calling - but they are still threatening me and I fell an extreme amount of pressure to sign my loan docs asap so as to avoid the credit hits for payments that Sun West advised me to skip and then further delayed due to their own mistakes. This seems to be a deliberately deceptive practice meant to financially obligate me into signing - even if I am uncomfortable. B/c otherwise my credit is irreparably damaged and I wo n't be able to get a loan anywhere. 5 ) Once the garage was fixed and the correction was approved ( 5 days later ) I was set to close for Saturday, XXXX. I was informed it was critical to sign by that day b/c it would only leave me with 1 day at the end of the month to fund my loan and avoid credit implications!! However, upon arrival the loan docs had multiple errors and incorrectly listed my brothers name as owning my home and being married to my wife. Despite being positively terrified that my credit was going to be affected - could not sign something that said my brother and wife were married and owned my house - that is absurd!!! 6 ) The error was correct the following Monday of this week XXXX and all closing docs were to be signed @ XXXX. I took off work early so I could be there to sign and end this mess, however Sun West again made a mistake which caused me to miss work for no reason! Finally at 7pm someone arrived to oversee the signing and it was completed. 7 ) I am now sitting in Limbo with no guarantee that my loan will fund in time to prevent any adverse credit action that was due to a series of delays and errors that were in no way related to things within my control. I want someone from Sun West to call me and explain all of this! I want a guarantee that my credit will not be affected in the slightest due to this mess and I want it in writing that they will assume all responsibility required to fix my credit - should their incompetence adversely affect it! I also do n't believe ANYONE should ever have to pay for a service that threatens it own customers and forces them into signing loans at risk of loosing all credit worthiness - but XXXX knows that 'll never happen!

Background We closed on our house on XX/XX/2020. Within a month the pandemic hit and I was laid off from my job as a direct result of COVID-19-related hardship for the company. Since even the supplemented unemployment insurance payments were nowhere near my regular salary ( on which we qualified for the house ) we were in danger of instantly losing our home. We were able to be placed on COVID-19 emergency forbearance through our current lender ( XXXX ). This was extended once as I struggled to find a job in the poor economy. In XXXX I was able to obtain work, but at a significantly reduced salary than I was making before the pandemic. Still, we were able to come out of the forbearance and modify the mortgage to roll in the missed payments. We entered the trial period of the modification with our first payment on XX/XX/2020, with subsequent trial payments in XXXX and XXXX. Regular mortgage payments on the modification began in XXXX and we have paid every month since until XXXX XXXX 3 months of trial, 4 months of regular payments ). Current Issue We have been working with XXXX on an IRRRL refinance through SunWest Mortgage Company since early XXXX. We were turned onto them by the copious mailers that they sent offering lower rates and the ability to skip two payments. This was appealing to us since, like many, we are still struggling to catch up from the difficulties we faced during the worst economic impacts of the pandemic and their continuing impacts now. XXXX prequalified us for a lowered interest rate and advised us specifically that we would not need to pay XXXX or XXXX payments. Because we were so far along in the process ( we had signed initial disclosures, some additional VA-specific disclosures, a Loan Estimate, and a Change of Circumstances form ) and were just waiting on the final formalities as we understood, we did not pay the XXXX payment to our current lender. On XX/XX/XXXX, we were informed that a VA underwriting requirement precludes us from qualifying because we have not made 6 payments on the modification. Upon reviewing the VA Circular that outlines this guidance, we found that it was rescinded XX/XX/XXXX of this year and have been unable to locate guidance that replaces this. We have, in fact, made 7 payments post-modification ( three were in the trial period ). We are being instructed to make three additional payments ( XXXX, XXXX, and XXXX ) and to then resume this process with XXXX. As a result of practices that are specifically called out as problematic by the VA and which we unfortunately discovered warnings about post hoc, ( XXXX XXXX XXXX ) we are now in a position of ( 1 ) being within days of being 30 days late on our XXXX payment, ( 2 ) having our XXXX payment simultaneously due, ( 3 ) being unable to handle two simultaneous payments due to the fact that we spent our XXXX payment on necessities that we had been forgoing due to our newly reduced financial capacity, ( 4 ) getting into a situation where out already stretched credit falls into a rolling 90-day late cycle indefinitely, ( 5 ) owing monthly late fees, being subject to constant debt collection activities, falling into poor standing with our current lender, and ( 6 ) possibly losing our home because of an accumulation of the above difficulties on top of our current hardship and any future hardship caused by impending COVID-19 variants. My husband served his country and he deserves better than to live in fear that our family will lose our home and be unable to afford another one due to the current difficulties in the housing market. I am a XXXX in Arizona ( XXXX ) I was doing a deal with a buyer of mine that just canceled after XXXX days. We reached full acceptance of this contract on XXXX XXXX, 2015. This deal was a XXXX on an acre, just outside of XXXX AZ. The property is on septic and has a well agreement, and a road agreement. The buyer is very well qualified and just wanted a low payment with enough land to build a big workshop, so this property fit perfectly. We were done with all our inspections and sent everything to underwriting the beginning of XXXX. The good and hardworking folks at XXXX did the best they could and worked so hard on this file it amazed me. The Underwriter, Sunwest ( who was the investor that would buy the loan ) asked for corrections and for the whole packet to be re-submitted at least XXXX times and spent 3 months reviewing the file. We have XXXX of emails in which Sunwest keeps asking for things ( many times things we had already submitted numerous times ) over and over again, each time saying that they just needed this XXXX last thing and they could approve the loan. Finally after a month and a half they start looking at the well agreement, which on the surface looked fine. They requested more documentation and more and water tests and all other kinds of paperwork over and over again. The listing agent, escrow company and myself spent hours searching for all the paperwork, that was mostly online and public knowledge. All this time, XXXX & XXXX at XXXX were continually calling asking that they please just give us a Yes or a No on the file. The Seller had moved out and had to stay in a motel for a month. The Buyer had paid for a repair to properly affix the XXXX in XXXX as we were told by Sunwest then that it would close in a couple days after that was taken care of. The seller paid for a septic cert, as we were told by Sunwest underwriting that should be done before the appraisal to speed things along. The buyer also obviously paid for a home inspection, engineering report and appraisal, in addition to the repair. Plus, the buyer has to pay more rent as his lease expired, so he had to go month to month in XXXX which costs extra. Then after they finally came to the conclusion after XXXX months in underwriting that the property did not meet HUD guidelines due to the fact that we could not find corporation papers for the well group they verbally said they could not do the deal. It then took them a week to send XXXX the denial letter in writing. It is my assertion that if Sunwest had done their job correctly and had competent underwriters working for them they could have come to the same conclusion in XXXX! We have all wasted so much time and money on this file, it is ridiculous. Towards the end of XXXX it seemed to me like they were just prolonging the deal, by not answering their phones or answering XXXX and XXXX of emails asking for updates. By prolonging the pain they were just begging the buyer and seller to cancel the deal so they would not have to, because they must have realized that they had already wasted so much of everyone 's time and money that if they now denied the loan XXXX of the parties might find a way to sue them, however if the buyer or seller canceled before a denial, a lawsuit would be harder to prove. I am most likely going to have some of the best Real estate lawyers in Arizona look at the case and file for damages and whatever else they can think of, as this was absolutely ridiculous and absolutely unnecessary to wast so much of everyones time. As, I tried to tell Sunwest a XXXX times, this is not just a file, this is people 's lives that you have absolutely damaged.

In XX/XX/2023, I had emergency XXXX and was places on XXXX through my employer. In addition, fighting a child custody case which caused me to have to pay attorney and medical fees to ensure to the stability and overall wellbeing of my son. My employer determined they weren't not going to continue my employment as XXXX is a right to hire state and because I was a contractor salary employee. This caused my husband to have to end welding school early to obtain employment to continue income. He is also in the military and has been activated on several occasion in the past 6 months which has cause financial hardship. Upon my recovery and release from my physician, I began new job. We were behind on payment but got XXXX and XXXX paid and caught up quickly. I kept in communication with the mortgage company. I asked about my options, the representative discouraged it and explained that it was a lengthy process and they would work with me and to keep them posted on my financial situation. Then I check my credit report were they had reported missing payment and I had to pay two months of last charges. I contacted the company to submit my complaint and how I was unaware that they would report it after I was under the understanding that they were working with me as I seemed to believe it was a temporary financial hardship and we would be able to get on tract quickly. I explained that if I was aware of the impact on my credit. I could had made arrangements or submitted documentations to justify why my payments where late. The company was very rude and unhelpful. Offering no solutions. Once again, the agent mentioned completely the form but told me that they take more than 30 days to get approved and it would still negatively impact my credit. I do not have internet access or printer access to complete the forms and the forms do not have the ability to be completely online. They also starting calling me multiple time a day to remind me of my next payment due date and harassing me about enrolling in auto bill pay while I was working to make the money which I expressed how I did not appreciate these harassing phone calls and how the agents made them sound urgent and I would call them back and it would be about that. The agent told me because I had missed a payment I was flagged and added to this call list. I expressed my disatification with this because it was wasting time and harassing me while I was trying to work to ensure that I did not miss another payment and how I was frustrated that they impacted my credit where I could have qualified for a hardship. My family us simply just trying to get adjusted to new jobs and our family situation. I have had 2 previous mortgages in my life through other companies and never have I experience this time of customer service. They simply don't care want your money, offered no solutions, and have made the entire situation worse. Now we are in a situation where we are going to be late on this next payment due to additional legal fees and illness. I have emailed the company and reached out to many XXXX resources to find a solution on my own. I am just simply disatified with this company and do not want to call them to fight with them where they offer no options, solutions and them it will just lead to more harassing phone calls. I would not recommend this mortgage company to anyone and once I can get my credit recovered and income stable. I will be looking for a new mortgage company to take over this VA Home Loan.

On approximately XX/XX/2021 I submit an application to refinance my home to SunWest Mortgage Company. Initially I spoke with someone named XXXX XXXX who was very helpful and answered all my questions. After receiving my application and running credit, XXXX assured me they would be able to proceed with an FHA refinance. I informed MrXXXX XXXX I was wanting to go conventional rather than FHA. He told me they could rerun my credit once it goes through underwriting and then perhaps switch it to conventional. I had recently paid off some medical debt that was affecting my credit score and needed a little more time for that to update and reflect a better score. Even if I was not able to go conventional, SunWest had already sent a conditional pre-approval on XX/XX/XXXX, for a 3.75 % interest rate which was significantly lower than the existing rate. On XX/XX/XXXX, I was not able to reach Mr. XXXX via email or phone. I sent an email to XXXX XXXX the loan coordinator and also called her. She informed me XXXX XXXX was no longer with the company and she would be assisting me until they could find a replacement for XXXX. She emailed me XX/XX/XXXX telling me again the loan had been conditionally approved and the next step was to obtain an appraisal. XXXX sent the link for the vendor who would perform the appraisal so I could pay {$530.00} and schedule. I paid the fee and sent in any other documents requested at that time. Several days went by and I tried to reach XXXX for an update several times without response. Finally on XX/XX/XXXX, she responded to an email requesting more employer information and to say everything was going smoothly. On XX/XX/XXXX, XXXX sent an email saying they are still looking for an appraiser and trying to verify employment. I also received an email from someone named XXXX XXXX who told me he was taking over the loan and would be in touch soon. After speaking with XXXX, I learned the appraisal had never been ordered and the loan was in disarray. He promised me he was going to work to get everything resolved and would stay on the case until it was taken care of. He ordered the appraisal and I set the appointment for that to take place XX/XX/XXXX. I spoke with MrXXXX XXXX several times over the next couple days working through the application and documents I had already submit. He asked me to resubmit everything. On XX/XX/XXXX, I sent XXXX an email asking if he needed anything else and to express my concern ; I received an out of office reply. On XX/XX/XXXX, I spoke with XXXX and he apologized. He said he was sending more disclosures for me to sign and we should be able to finish things up quickly. On XX/XX/XXXX, I received an email from XXXX asking for more documentation and telling me they needed payoff information from HUD regarding a lien in the amount of approx. {$6300.00}. This was the first mention of this and I was not aware I had a lien. After a lot of back and forth, I was told on approx. XX/XX/XXXX that SunWest would not be able to fund the loan. The reasons given were the HUD lien and the expiration of the application and other things set forth by SunWest. During this period of time, I had also submit applications with other lenders as I was assured it would not affect my credit. Because of SunWest, I have not been able to secure lending to refinance my home which has left me in a very bad situation financially.

Dear Sir or Madam, For the last 9 months I have contacted my mortgage company, SunWest on 6 separate occasions requesting them to correct, incorrect reporting on all 3 of my bureau reports. I subscribe to a service that allows me to monitor all 3 of my reports and shared this information on all occasions with SunWest. 1. As of XXXX, XX/XX/XXXX I spoke with XXXX from SunWest to discuss the problem on my account # XXXX, which reports a 90-day delinquency in XXXX of XXXX from XXXX, a 90 day delinquency in XXXX of XXXX from XXXX, but no reporting from XXXX. I also uploaded a letter to their site outlining the call. 2. XX/XX/XXXX, XXXX-uploaded a letter on their website requesting that they correct the reporting. I saved a copy. 3. On XX/XX/XXXX @ XXXX I sent Sunwest an email to their customerservice@swmc.com site, requesting corrections and attached copies of my credit reports and my spouses who is a co-borrower. On XX/XX/XXXX I received a template email that it had been received. 4. On XX/XX/XXXX, XXXX. I emailed them again requesting a response and correction with no response. Template email received 5. In early XXXX, I uploaded a 3rd letter with copies of my credit reports to support my dispute of incorrect reporting. 6. I received a letter dated XX/XX/XXXX form SunWest stating that they had tried to contact all 4 credit bureaus but could not confirm whether any delinquencies were reported by the credit bureaus as our reports were masked due to the Chapter XXXX bankruptcy. I sent them copies from all XXXX bureaus. 7. XXXX XXXX I contacted SunWest and spoke to my representative XXXX to follow up and she had no answers for me. 8. On XXXX XXXX. I sent yet another email to their customer service email address with copies of my credit report with no response to date. CREDIT DISPUTES 1. In XXXX I sent a letter of dispute via certified mail to each credit bureau. I received responses from 2. a. XXXX XX/XX/XXXX ( report XXXX ) reported Open/Never late for my SunWest mortgage b. XXXX XX/XX/XXXX ( XXXX ) Late 90 days delinquent, verified by lender c. XXXX-No response but my credit report states Late 90 days 2. On XX/XX/XXXX I sent a second round of disputes to each and have not received a response to date. 3. My spouse ( XXXX XXXX XXXX XXXX ) and co-borrowers credit is reporting current for all XXXX bureaus. Here is where it gets somewhat convoluted. My spouse ( co-borrower ) and I filed a Chapter XXXX bankruptcy in XXXX of XXXX due to my XXXX XXXX medical bills and entered into loan modification with Sunwest. Our original loan with them was account # XXXX. After the loan modification we were issued a new loan # XXXX. Both bureaus have the loan numbers mismatched. Respectfully, I have tried phone calls, emails, uploading and certified letters with only 1 response from Sunwest, which I believe to be fraudulent as we are all abele to access the credit bureaus with a 60 day delayed response. My spouse and I have been working very hard to increase our credit scores so that we may refinance and seek another lender. I believe Sunwest is aware of this and is purposely stalling and being non-responsive. Lastly, we have contacted all 3 credit bureaus and they have not made any changes per the lenders confirmation. These days, so many seniors are subjected to fraud, abuse and illegal activity, especially in XXXX XXXX XXXX. I've been subjected to illegality, spying, financial abuse, false accusations, discriminations, falsely blamed and deprivation of many financial opportunities. At this time my credit score was XXXX but then it tumbled to less than half. 1. Moving to XXXX, California has been a catastrophic financial disaster, beginning with XXXX turning off my son 's benefits when I was in the middle of moving, they showed up unannounced to my previous place. Especially because I was moving into the Citi of XXXX from a XXXX Rental. I have 10 days to report a change of address, but my mailing address had not changed. As his caregiver, all benefits stopped. It took them 1 month to schedule a reevaluation that lasted 15 minutes, but they lied in the appeal that it lasted 40 minutes. The local XXXX office XXXX XXXX " I was going to shoot them on the head, '' by sending an officer to my home 8 days later. XXXX XXXX came with an office to spy and had my entire house searched and demanded phone numbers and searched for my son a mile down the street and demanded him to get into her car. I have Power of Attorney. Financial institutions did the following. 2. XXXX and XXXX XXXX followed suite . After 17 years of being a loyal customer with 11 accounts XXXX shut me down. XXXX XXXX has reduced my 3 cards down up to XX/XX/XXXX of my limits illegally. 3. I hired two consolidation companies, but they failed me and fired them. 4. Last XXXX a so-called mortgage servicer, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX # XXXX, XXXX XXXX California stole 5 house mortgage payments. They are an entity that don't exist, but XXXX XXXX XXXX claims Agent & Chief of XXXX XXXX XXXX and XXXX XXXX at XXXX XXXX XXXX, # XXXX XXXX XXXX, XXXX XXXX, CA # XXXX registered the entities as XXXX in XXXX. I was urged to pay via XXXX or XXXX and lives at XXXX XXXX Vermont XXXX # XXXX. Here some of their names! XXXX ; XXXX XXXX XXXX ( and asked me for a Sun West Mortgage Statement ) ; XXXX XXXX XXXX ; XXXX XXXX XXXX ) ; XXXX ; XXXX XXXX ; XXXX XXXX XXXX ; XXXX XXXX ; XXXX ; XXXX. The bank says I can't get my money back. 5. Sun West Morgage Company kept harassing me and subjecting me to financial abuse and fraud on a {$5500.00} 2nd lien and sent me to the credit bureaus every month. They sent me about 500 pages of notices, but the illegal company told me just to forward them to them to the fraudulent company. 6. Without notice XXXX XXXX bought out my loan from Sun West and received notices on the day before it happened, last month. 7. Now XXXX XXXX got in the action because on my illegal scores and cancelled Care Credit when I had paid it off and always paid everyone on time and even in advance. I've 3 pandemic infections and have survived but because of my illegal bad scores I keep getting blamed what has been circumstances beyond my control or doing. I'm mailing I'm writing to ask for advice or referrals. A law firm XXXX XXXX has purchased my debts that credit card companies refused to communicate with me and just hired XXXX XXXX XXXX to work with my score. This is an ongoing dispute with my current Sun West Mortgage Company leading to a dangerous denial of my prospective mortgage company. XXXX XXXX has been patient for a long, long time ; but time is running out with the rate they qualified me for! XXXX sent me a short form to fill out for only a signature and date to proceed with my refinancing. I contacted Sun West and they are being uncooperative, fraudulent, and discriminatory with 2 severely XXXX seniors! First their form for the 2nd lien was submitted to me as an image but not as text. I repeatedly and tried to convert it to text. I spent an entire week trying it! My computer and printer do not recognize images to print or copy as text. I had to wait for them to mail me a hard copy of the document, after repeated emails and phone calls. But because they are so incompetent, they ended mailing me two copies. I then contacted them about the short form required to only sign and date in order to proceed with the refinancing to include my second loan of {$5000.00}! They denied to signing it and said that I must pay if before I refinance with the new mortgage company! And the last two months my payment increased to about an additional {$60.00}! The more reason I need to refinance at a lower rate and get refunds after the new refinancing. Last month I had to borrow just to meet my payments because I also have a dispute going with IHSS for my son. I'm in re-appeal with them for 2 years. XXXX was a very corrupt city until our current elected mayor and is doing great and greatly improving the city! But no matter what I do to comply with SWM, now SWM keeps stopping me with pettily stuff and made-up requirements! I will copy the email from my current pending lender telling me that SWM demands that my {$5000.00} loan must be paid off BEFORE THE REFINANCING. However, I spoke to the supervisor, XXXX says that the second loan of {$5000.00} can be including with the refinancing. I called the CFPB because I could not login ; however, CFPB said I could file a new complaint. SWM seems to come up with repeated new excuses for not letting me refinance! They have become rogue and totally abusive and discriminatory. They sure have a funny way of showing they want to keep me! I have not once missed my payments within allotted payment period time ; however, they just charged me with late charges for the {$5000.00} loan as being late. I did not even know that I did not have an allotted period to pay it like the main loan. I tried to contact them this morning and it took 4 phone calls. I called to the number they included on an email with an extension of XXXX. However, if I would ask for the spelling of their name or repeat the name they would hang up. I finally went online and found another number for customer service. I also asked XXXX for the email for their CEO, XXXX and she said it is XXXX. I am explaining SOME of their incompetence details to demonstrate how incompetent, discriminatory, abusive, uncooperative and Bad Faith intent they display! Please help me! On XX/XX/XXXX I sold my property located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX and the bank used by the purchaser who acquired the property was SunWest Mortgage located in XXXXXXXX XXXX. The final disclosure was given the day before at XXXX XXXX by the real estate agency ( XXXX XXXX ), telling me the amount I had to bring was of {$9200.00} payee XXXX XXXX, I inquired because the amount was less than the initial one of {$11000.00}, a difference of {$1700.00} and the real estate representative XXXX XXXX mentioned it was a credit on my behalf. This was given to me a day before the closing, I was traveling to XXXX since I live in XXXX I didn't had enough time to validate this information, since it was with time constriction, I needed to go to the bank to purchase the cashier 's check in order to be on time during the closing with the money requested per their emails. The closing occurred around XXXX XXXX on XX/XX/XXXX as appointed, I gave keys and left the bank with the deed and all my closing documents. Around XXXX XXXX I received a call from the XXXX XXXX that there has been an error during the closing and that I owed them {$3700.00}, I asked from what and she mentioned about an escrow balance they were supposed to return to the house buyer but somehow it was credited to me. In XXXX we had to sign an addendum from the bank because SunWest couldn't validate those funds from the buyer therefore XXXX XXXX had to return the funds the day of the closing, which is strange then that if Sunwest could not validate those funds, how they still ended using them during the closing. I sold my house for {$120000.00} and between taxes, lawyers, fees and more I paid {$18000.00} in closing costs, an amount already excessive for such short selling house. I know some of the costs were related to taxes but still excessive, however I really didn't had any representation or to whom really ask since I was in XXXX and to then after the closing say I still owe {$3700.00} and to pay it directly to the real estate agency seems unfair because that transaction will not get recorded in the sale. Further more, there was another issue with the house deed, the initial sale price was $ XXXX and then was adjusted to {$120000.00} due to some repairs the house needed and the buyer agreed to do, but somehow the house deed was with the initial price of $ XXXX and now the law office XXXX XXXX had to send a Power of Attorney for me to sign in order to have a legal representative to create a new deed so they can register the property with the right sale price, his lawyer XXXX XXXX suggested it was a favor that they usually charge XXXX, I did mentioned it was not my error, since all that should have been validated with the bank prior closing by them, still I am already doing my diligence to assist with this issue. All these situations are creating a lot of stress and is overwhelming since I do not live in XXXX anymore and is difficult for me to handle them from across here. I feel the bank and other agencies didn't handle this with precaution causing all these errors and now I feel I am the guilty one having to deal with their issues.

In XXXX of XXXX, Sun West Mortgage Company issued me an FHA loan for the purchase of my primary residence. I have reasons to believe Sun West Mortgage Company failed to meet " HUD Quality Control Requirements '' when underwriting my loan. Deficient and poor underwriting practices lead to enormous losses to the Federal Government, and also to individuals ( a. individuals to whom loans are issued, b. millions of taxpayers ). I have reasons to believe that Sun Wests underwriting of my loan was deficient, having " excessive qualifying ratios '' and " insufficient compensating factors ''. HUD 's handbook requires that lenders gather significant compensating factors to approve loans that exceed HUD-FHA 's limits. One compensating factor, for instance, would be for S Sun West to require a borrower to come up with a larger down-payment. Sun West, however, failed to gather any significant compensating factors to approve my loan. 1. My debt to income ratio was too high, exceeding HUD 's benchmarks. 2. Sun Wests underwriters qualified my commissions as " acceptable '' and " verifiable '' income, even though I had been at that job for less than a year. I had also just recently moved to New Jersey. 3. Sun West hired their own appraiser as required by FHA, which appraised the value of the home at exactly what the seller was asking for ( at {$270000.00} ). I later found out that the seller had purchased the home for only ( {$110000.00} ) just seven months prior to the appraisal. The seller did poor and minor work at the house ( obviously not spending more than {$10000.00} ). The nearby homes had been sold for a much lower price, thus, leading me to believe that the appraiser was in collusion with the loan officer to get a high appraisal, to get that loan approved quickly, through a " lethal predatory lending '' that has now put me on route to foreclosure. It has caused me substantial financial loss. 5. The loan officer had contacted me through a lead that was given to him by my realtor. Sadly enough, my realtor lacked integrity and honesty. At this particular sale, my realtor was violating several New Jersey Real Estate laws ( he and the seller, who were in collusion, were later fined by the State of New Jersey for these violations ). After reviewing all communications with my loan officer and my realtor, it appears to me that the loan officer did not act in good faith at the issuance of this loan. It appears to me that he served the best interest of the seller and of the realtor ( who at this sale, failed to disclose that he was a dual agent ). As a matter of fact, the seller was a broker ; she and the realtor had an employer-employee relationship. 5. After contacting Sun West about being a possible victim of fraud and " predatory lending '', Sun West failed to provide me with an adequate response, and my loan was quickly transferred over to XXXX ( which is the mortgage bank that now shows on my credit report ).

I started my refinance process with Lowrates.com back in XXXX of 2020. My loan Officer is XXXX XXXX My loan processor is XXXX XXXX Their Sales manager is XXXX XXXX Its now been 6months and they still have not given me a day to close on my loan. This is despite the fact that I have received a loan approval. Throughout the refi process I have responded and given them EVERY piece of documentation WITHIN MINUTES of them requesting it. I've even gone as far as doing " their '' job by getting my own mortgage payoff quote directly from my lender. Because in their own words, " I CAN GET IT MUCH FASTER THEN THEM ''. BTW, they have now asked me to get a payoff quote 4 SEPARATE TIMES, because the payoff " good thru date '' they ask me to ask for expires. They even asked for my tax returns ( for a second time ) after having my loan supposedly in process for 3 months. It's my understanding that tax returns, credit scores and debt ratios are verified at the VERY BEGINNING so that the company and CLIENT don't waste time and/or money. These are all examples of poor customer services, inadequate training, leadership and lack of processes. When I ask them for a status or why its taking so long, their response is " its due to covid '' or they forgot something or they didn't realize I needed an appraisal done ( after they had the loan application for 5 mos that is when they realized that mistake ) but the response I get MOST OFTEN FOR THE LAST 2 1/2 mos is " SILENCE ''. My emails, phone calls and text msgs to every person I mentioned above are just ignored. No sorry, no explanation they just simply go unanswered. When I do hear back from them it's to ask me for another " CURRENT '' bank statement, another " CURRENT '' paystub, another " CURRENT '' letter from my XXXX that I'm still in business, another verification of employment or needing another credit inquiring response letter from me. Once again this is lack of procedures and gross mismanagement. I can't believe that this isn't costing the company money because of the rate lock extension fees XXXX which they are trying to make me pay XXXX. I did contact the sales manager XXXX XXXX back in early XXXX to voice my grievances and lack of communication. Unfortunately, after leaving a message on my phone that stated that he was unaware of any problems on my loan but that he would look into it and get back with me I have yet to get another call or message. The only reason I'm sticking with this company though is for the simple fact that now with interest rates rising I would be locking in a higher rate. Believe me I would much rather take my business elsewhere if it would not cost me so much with a higher interest rate. So I'm asking for help in getting my loan closed and at the same time report this company and its employees for their complete lack of care, understanding, compassion and horrible customer service.

We refinanced our home with XXXX, who sold our mortgage to SunWest Mortgage. We set up our mortgage on automatic payment, so there have been no late fees. An escrow account was set up as part of the refinance. We were supposed to have two months " buffer, '' and during the refinance, {$480.00} was placed in the escrow account, with {$300.00} escrow payment due each month to cover Homeowner 's Insurance, FHA Insurance, and County Taxes. We just completed our first year, and our property taxes went up by {$100.00} for the year. As of today, we had over {$700.00} in our account, which is more than the 2-month buffer. SWMC raised our mortgage from {$1300.00} to {$1400.00} and they claimed they want our " starting balance for the new year '' to be {$1100.00}, which is about 4-5 times the original 2-month buffer. SWMC claims it is for the upcoming year 's anticipated " shortage '' based on their " analysis. '' Our escrow only covers 3 items to analyze as previously stated : Property taxes, FHA Insurance, and Homeowner 's Insurance. The FHA Insurance is not going up. The Homeowner 's Insurance has no claims ( and has never had a claim in 10 years ), so its rates are n't going up. That leaves an anticipated increase in property taxes. From the time we refinanced until this year, there was a {$50.00} shortage in our taxes, which they just took out this month. Currently, we were told we have a $ XXXX balance, and our taxes are due in XXXX. SWMC wants to pay the taxes early ( in XXXX ), claiming that when they do so, we will be in the negative because they will also pay FHA at the end of the month. They raised our Escrow to {$310.00} ( from {$300.00} ) to cover the difference in taxes. Then they added another $ XXXX/mo on top of the adjusted escrow payment each month. The new escrow payment is high enough that it will cover ALL payments ( taxes, property insurance, and FHA insurance ), and by this time next year, the buffer will still be there. Basically, SWMC wants to add another {$500.00} slush fund at our expense, yet they have absolutely no mathematical or legal justification to take this extra {$500.00}. The Math : FHA Insurance {$150.00} X 12 months = {$1800.00}. Property/Hazard Insurance ( 12 months ) {$650.00}. Property Taxes ( 12 Months ) {$1300.00} TOTAL YEARLY REQUIRED ESCROW $ XXXX Monthly escrow amount needed to cover {$3800.00} charges : $ XXXX/month Current Principal and Interest payment : {$1000.00} + {$320.00} ( adjusted for tax increase ) TOTAL NEW PAYMENT : {$130000.00} SWMC NEW Payment : {$1400.00} If the $ XXXX/month payment shown above covers ALL escrow expenditures IN FULL, and borrowers still have the 2 month required buffer, how can they legally raise our payment an ADDITIONAL $ XXXX/mo. ( $ XXXX/yr ) above the newly adjusted, higher escrow amount?

This involves a mortgage loan that I applied to Sun West Mortgage Company for and received an initial loan estimate for on XX/XX/2021. I decided to pursue the mortgage through Sun West and did end up going through with the purchase and financing with Sun West. My issue is that, as we approached the closing date, I received a closing disclosure ( dated XX/XX/2021 ) that reflected quite a big difference in costs than the initial loan estimate. After looking into it further, it seems that pretty much all of the title costs, including lenders title insurance, were omitted from the initial loan estimate. This resulted in over {$1900.00} in title fees that werent anticipated. The initial estimate for monthly mortgage insurance premium also doubled. The total loan costs increased by 107 %. There was some creative arranging of the closing disclosure to make it look like nearly the same cash to close number, but that didnt take into account the {$3400.00} cash deposit I had already placed in escrow. I confronted the lender on these discrepancies and let them know that I had looked at the regulations and was aware that there were not supposed to be these kinds of increases in-between disclosures. I made a fairly big stink about it, which resulted in an updated closing disclosure ( claiming that the wrong version was sent the first time - I also didnt think those disclosures were supposed to be updated like that once they were sent ). This disclosure included another {$2400.00} in lender credits which looked like an attempt to compensate for the additional fees as compared to the original loan estimate, and miraculously got me back to my initial cash at closing amount. The doubled monthly mortgage insurance premium was not corrected, however. When you compare the final loan terms to the initial estimate, the interest rate was the same 3.25 %, but the monthly payment went from {$1600.00} to {$1900.00} ( a $ XXXX difference note that the monthly escrow payment was excluded from the initial monthly payment estimate but included in the final one ), and the APR increased from 3.486 % to 3.701 % ( an increase of 0.215 % ). When I was initially shopping for a mortgage I thought a 3.486 % APR was slightly high, but still within the range of comparables and my realtor recommended this particular lender, so I went with them. If they had shown me a 3.7 % APR I never would have pursued this mortgage ( there were some lenders advertising as low as the 3.25 % range at that time ). I ended up going through with the loan from Sun West, since it was either that or scuttle my plans to buy the house, at that point. I think their lending practices were unethical, though, and feel like I am forced to pay more than I originally agreed to.

Greetings, I have a VA loan on our home & property. We have refinanced twice before. As a result of Covid 19 & other issues, the rates went down again. We wanted to reinance for a lower rate. Nearing the end of the process, the mortgage company advised us that there was a title issue. I told them that this was a VA loan from the beginning. The first title company was with XXXX XXXX, now this the mortgage company, Sun West is using XXXX XXXX XXXX company.The mortgage company that XXXX XXXX XXXX had found issues with the title & would not complete the refinance, I contacted a manager with XXXX XXXX XXXX & he advised, after checking into it that there was no issue that he could find. I then contacted the XXXX XXXX tax office & they advised that the property was confirmed to be in our name and found no issues. I contacted Sun West Mortgage Co. again & told them what I learned. Sun West did not have a good reply & noted my complaint & said that they would investigate. this is what they replied to me : Here are a list of the issues title has brought up to us : XXXX XXXX XXXX is deceased. XXXX XXXX XXXX 's Will has been admitted to probate under Case or Docket Number XXXX in the Probate Court XXXX of XXXX XXXX, Texas. Company requires : a ) A copy of the Will and either : i ) Muniment of Title and/or any other orders affecting title to the subject property. b ) Satisfactory evidence, in accordance with Procedural Rule P-11 ( b ) ( 9 ), that state inheritance and federal estate taxes are paid, or will be paid. Upon review, Company reserves the right to make additional requirements and/or exceptions. We have been informed that this transaction involves an existing Manufactured Housing Unit to be conveyed with the real property. As a result, the following requirements apply : 1. Seller must obtain, in their own name, a Statement of Ownership and Location having designated the subject Manufactured Housing Unit as real property prior to closing the transaction. 2. The real property status must be perfected by filing a certified copy of the Statement of Ownership and Location in the real property records in Nueces County. We started a loan application on XX/XX/XXXX with Sun West Mortgage Company , Inc. NMLS XXXX. The loan officer did not tell us that the company could not make a loan on a property with more than 2 units. Upon learning this we changed the application to our home at XXXX XXXX XXXX, XXXX, WY and sought a partner to complete the purchase. On XX/XX/XXXX the loan office made the first loan estimate with the wrong address. ( XXXX XXXX XXXX, the purchase property. ) On XX/XX/XXXX the loan estimate was corrected to XXXX XXXX XXXX. On XXXX Sun West put an unlicensed " loan coordinator, '' XXXX XXXX between me and the loan officer, XXXX XXXX, NMLS XXXX. All documentation of our finances were submitted by the XXXX of XXXX. On XX/XX/XXXX Sun West issued a Closing disclosure with a funding date of XX/XX/XXXX but with their closing agent instead of the one we had selected knowing ours would cost less as a local XXXX XXXX XXXX office. On XX/XX/XXXX I notified XXXX XXXX that XXXX XXXX kept asking for uploads of our financial documentation that had already been uploaded. XXXX replied, " Yes, XXXX XXXX is your Loan Coordinator. Have a great day! '' ( I believe XXXX XXXX quit because of this addition of XXXX in the mix ) By this time we had extended our closing 3 times and the seller made a hard closing date of XX/XX/XXXX. Sun West made an error on the Closing CD to XXXX XXXX XXXX and it had to be returned to Sun West for correction. Subsequently, Sun West notified the XXXX XXXX XXXX closing agent that the loan could not be funded until XX/XX/XXXX. From the first funding date of XX/XX/XXXX and XX/XX/XXXX there was plenty of time if I had been working with an NMLS loan officer to get this loan to the closing agent with a funding prior to XX/XX/XXXX. This stall had the nefarious affect of indicating that a borrower must accept the Sun West closing agent if they want a timely closing on a loan. All borrowers should be informed that Sun West will not say the can not do the loan but will delay to get the word out to Realtors to advise their clients to accept the Sun West closing agent and their nearly double closing costs.

On XX/XX/XXXX my repairs contractor signed a " lien waiver and release '' form, supplied by my Sun West Mortgage, as a condition for them to release my insurance funds, allocated for my pool repair, which falls under the " other structures '' coverage of my insurance policy. The Lien Waiver and Release form states, " The total of all charges for, and in connection with, all such services, labor and/or materials performed or furnished by Contractor will be paid in full to Contractor upon receipt of completed lien waiver ... '' My mortgage company did not abide by their own contract to release funds, in full, per the contract. I did not complain about it then, but feel I must bring this, likely, UDAAP violation to the CFPB 's attention because on XX/XX/XXXX, I requested the release of additional funds to my repairs contractor and was told an inspection was required prior to the release of funds. An inspector came out on XX/XX/XXXX and performed the inspection. I followed up and was told the inspection had not yet come in. Eventually, when I followed up on XX/XX/XXXX, I was told that the inspector, sent by Sun West, did not do a sufficient enough job with the photos for funds to be released and Sun West requested that I, personally, provide additional photos as the aforementioned inspector didn't provide proper documentation for my funds to be released to my contractor. I supplied the requested photo on XX/XX/XXXX. When I followed up on XX/XX/XXXX, I was told that a supervisor had to review the request to release funds to the contractor and it would take an additional 3-5 business days for the review to take place. When I mentioned that my contractor signed a lien waiver and release form stating the contractor would be paid in full upon the receipt of the lien waiver and it didn't happen, I was told it didn't matter what the Lien Waiver and Release form stated and that Sun West Mortgage had a right to verbally impose additional requirements before releasing any funds. I ask that the CFPB investigate this as it seems to violate the CFPB 's Unfair, Deceptive, or Abusive Acts or Practices policy due to Sun West Mortgage not abiding by their own Lien Waiver and Release contract.

SunWest Loan # XXXX First off my husband is a veteran and we filed for a VA refinance loan. We were told by XXXX XXXX of SW that we would get a 3.75 % loan. All paperwork was going through and each time we saw 4 % on the docs we called XXXX. He said it was just during the process and it would change in the end, after all credit cards were paid. Well it never changed and when we were signing docs we saw that it was a 4 % loan! We were livid! But we had to go through with the loan because we had to pay a personal loan off within 2 weeks. After contacting SW about this issue, all we were told was SW never promised us a 3.75 %. We went back and forth with some robot who kept stating the same thing over and over. This was more upsetting because we informed them that we were trusting what XXXX was telling us and now find out we should not have!! The difference in the loan rates makes our monthly payment hard to handle, we are struggling to get by. Back in XX/XX/2018 we got a letter that our Escrow Account was short by {$290.00} and that we could pay it to get that fixed. So we paid it, wrote on the check that it was for the Escrow Account, but I just found out SW applied it to our mortgage therefore the following month they only billed us {$3300.00}. We paid this and now we just received a letter that we sent in a short payment! We paid the statement amount! Then they say this could adversely affect our credit! This is all their error but they are making it seem like it is our fault. We called today and spoke with a XXXX, an account specialist and we asked him for an apology letter stating they were wrong. But he did try to blame us telling us we should have written in the memo section of the check that it was for the Escrow account, and we told him, we did!! SW never wants to apologize for their errors. And the main error of promising us a 3.75 % rate and getting us a 4 % is unimagineable!! We clearly remember that XXXX said if we paid off some credit cards we would get this rate and we did, but we still did not get the rate!!! We feel SW should stand by their promise to get us this 3.75 %!

I pay regularly my monthly mortgage payment by check. In XX/XX/XXXX I applied for automatic ACH payment ( ln # XXXX ). The confirmation was not forthcoming in XXXX thru XX/XX/XXXX. To avoid late penalty for XX/XX/XXXX, I sent a check to pay XX/XX/XXXX with a written note/warning " please do not double pay my XX/XX/XXXX payment, I applied for automatic " ACH '' payment " and confirmation of effectivity is not forthcoming. The lender received my XXXX check, ignored the warning not to double pay my XX/XX/XXXX mortgage, cashed the check. The lender accessed my bank money without my permission and maliciously for their advantage. The lender maliciously knew that my XX/XX/XXXX loan payment was already paid from a confirmation in their system, nevertheless cashed the check, applied such money to next month ( XX/XX/XXXX ) payment. I did not authoriz e Sunwest Mortagge to cash that check. Lender staff ignored that warning and cashed. Unfortunately the check did not go thru but nevertheless lender and its staff accessed customer bank account in excess of my authority. For this reason, it is clear enough Sunwest Mortgage violated the trust I put on them so far as accessing my bank money without my permission. That is abuse of authority to collect mortgage payment ( as they already received my mortgage XX/XX/XXXX payment ) more than what they are entitled to. Imagine, Sunwest Mortgage collect and access maliciously any customer bank money as much as they can at any moments time and customers do not know of such activity until the customer receives a bank statement. For this reason, my bank charged me {$29.00} for that returned check for which I was asking Sunwest Mortgage to return/refund that money. I sent Sunwest Mortgage a bank statement that showed my bank charged {$29.00} but refused to refund. I am filing this complaint so the public will be warned of this unscropolous activity of Sunwest Mortgage. I would like the lender borrowers to be aware of this lender activity. I also want the government monitoring agency to be aware of this kind of activity by this lender and to stop it now.

I received a letter dated XX/XX/21 regarding a 30-day foreclosure notice stating my loan modification was denied because there are liens on my property that were not satisfied in time. That time frame was XX/XX/21. This statement is inaccurate as I emailed a satisfaction letter from XXXX XXXX in XX/XX/XXXX 2021 along with my loan modification application. I spoke to a representative several times and each time I was told that I still did not have a free and clear title. When I called XXXX XXXX, they informed me there were no liens on my property. I then proceeded to call the recorders offices in which they also told me there were no liens on my property. It is now XXXX and Sun West Mortgage is telling me liens are still showing up on my property. I went on to the Clark County Recorders office website and pulled up the records that show the liens were released in XXXX and XXXX of 2021. Today when I called Sun West and spoke to someone, I was appalled to find out there has not been a new title search since XXXX of 2021!!!!! This is unacceptable!!! The negligence from Sun West that has not even bothered to do a new title search is incomprehensible! The fact that I have waited for MONTHS because Sun West can not get their act together and pull a new title report is criminal as they are now threatening to foreclose on my house on something that was taken care of back in XXXX!! This could have all been resolved in XXXX had Sun West done a little due diligence and looked this up themselves, but instead worked from an old title search. I have emailed screen shots from the Clark County Recorders to Sun West showing all the liens have been cleared. The recorders office told me they could not provide me with copies of the stamped lien releases, but I was able to see the release on their website. Sun West Mortgage is threatening with a 30 day foreclosure notice after their egregious oversight by stating I did not have a free and clear title when there is proof that is has been free and clear since XXXX of 2021.

I have recently been awarded as a 100 % XXXX veteran and applied for property tax reduction as such.. The County ( XXXX XXXX, CA ) has issued a refund on property tax retroactively from the date I was awarded. In doing so the County sent out a form to the mortgage company ( Sun West Mortgage ) that paid the taxes on my behalf in an escrow account. The form lets the mortgage company determine if the refunded monies go to the home owner ( Me ) or paid directly to the Mortgage Company. My loan with Sun West Mortgage was closed Mid XXXX as I had refinanced to another company. With the beforementioned information Sun West without regard that my loan was no longer serviced by them elected to have the monies sent to them. The monies were sent to a third party company that Sun West uses to pay property taxes for there accounts and has been in there possession since XX/XX/XXXX. I have had daily phone conversations with the company and am just getting the run around as to where my refunded property tax money is! It was not identified that the money was sent to the third party until XX/XX/XXXX. Since than I have spoken to supervisor XXXX and XXXX. My last conversation with XXXX on XX/XX/XXXX was not even noted to the account according to XXXX whom I spoke to on XX/XX/XXXX @ XXXX. I had called at XXXX on XX/XX/XXXX and left a message for XXXX XXXX said he would call me back Monday morning and has yet to do so to this point. Since Sun West no longer has an active account with me they should have not of elected to receive my refunded money from the XXXX XXXX XXXX XXXX and I would have received my refund by now, like I did with the other refunds for the prior years from a different mortgage company. I feel as a XXXX veteran this company is taking advantage of the situation to control someone else 's finances, not sure if they do this kind of thing all the time to there customers but they are sure using my money for something since they don't seem to want me to have it!

I have a mortgage with Sun West Mortgage Company, Inc, ( SWMC ). I am seeking the assistance of the Consumer Financial Protection Bureau ( CFPB ) to have SWMC return unauthorized transactions of {$1000.00} to my escrow account. I sent a request to SWMC on XX/XX/XXXX and have not received a response. Upon acquiring my property, SWMC sought an XXXX insurance policy on my behalf in order to close my loan. At closing, every document reviewed by me either contained my signature or initials. My closing disclosure document reflected the premium for my XXXX insurance policy, which I funded during closing. However, after my mortgage closed, SWMC obtained and paid for additional insurance without my knowledge or approval. As a result, SWMC caused me to have an escrow shortage and my mortgage payments went from {$720.00} to {$820.00}. The first payment at the increased mortgage amount was effective XX/XX/XXXX. I have informed SWMC that this higher payment will not be sustainable for me but SWMC have not helped. Since XX/XX/XXXX, when I discovered the unauthorized transactions, which took place in XX/XX/XXXX, I have been seeking answers from both SWMC and the insurance broker, XXXX & XXXX as to what occurred. I got nowhere with the insurance broker and though I received an automatic message from SWMC that my concerns were escalated for a complete review, I also got nowhere and took measures to mitigate the escrow impact on my mortgage by seeking a loan modification from SWMC. My request and appeal for a loan modification so that my mortgage does not end in default were denied. My XX/XX/XXXX request to refund my escrow account of the unauthorized charges have gone answered ; this request was sent to the CEO, MrXXXX XXXX XXXX ; customer service ; management ; and the insurance departments. On XX/XX/XXXX, I followed up in an email to Mr. XXXX and to date, I have yet to receive a response. I thank the CFPB for looking into this very important matter.

Our check payment was purposely held up by Sun West Mortgage Company to be able to prematurely report us as 30 day delinquent and prevent us from refinancing with another mortgage company. Our mortgage is due every XX/XX/XXXX of the month. This XX/XX/XXXX we mailed our check on the XX/XX/XXXX to Sun West 's XXXX Ca Office. Mail should not take more than 5 days for our payment to get to them as we also live in California. On XX/XX/XXXX, a 30 day mortgage delinquency report was filed to the three credit bureaus which led to the credit score of my husband to drop by more than 100 points. Please note that XX/XX/XXXX is only the 29th day from our due date. We were trying to refinance with another company since Sun West sat on our refinance with cash out application which we started XX/XX/XXXX. Sun West knew that we were trying to move, thus the malicious report. Initially, SunWest 's customer service confirmed to us via phone that they received our XX/XX/XXXX check payment on XX/XX/XXXX which means that we made it on the 30th day and we should not have been reported. The malicious report they did halted any chance for us to refinance either with them or any company for the next 12 months. . Based on FCRA Compliance, delinquencies are calculated based on the due date. The credit reporting options for reporting late payments does not include one for being 1-29 days late. This doesnt exist and any lender that attempts to report someone as being late before they are full 30 days past the due date is providing knowingly an incorrect information to a credit reporting agency. We begged them over the phone several times XX/XX/XXXX, emailed for reconsideration and wrote a formal letter requesting clemency on the delinquency report ( upon their advice ) only to find out that we have already been reported. All our pleadings were unheeded despite the fact that we are existing clients for almost three years now and have never been late in our payments.

We have our current home V.A .mortgage through Sun West Mortgage Company . Back on XX/XX/2020 we requested a cash out refinance with SWMC. Our loan officer assured us this process would be seamless as we are existing customers. No credit check for existing customers ( wrong ) minimal cost ( wrong ) Quick process ( wrong ). After dozens of phone calls, emails, document chasing and 5 + months they ( SWMC ) tell us of a problem with a credit repair program we are using. Back in XXXX my wife was temporarily laid off ( due to covid ) so we called this company and asked to defer XXXX 's payment. They understood the circumstance and the payment for XXXX was not made. SWMC claims that the underwriters do not accept the missed payment and on XX/XX/2020 declined the loan. Now I understand the V.A. may have some ridiculous policy that requires no missed payments but we really believe SWMC should have brought this to light back in XXXX. Nothing at all was discussed regarding the missed payment until XX/XX/XXXX. On at least 3 occasions the loan officer told us that we would be closing before the next month, even to the point of signing a final agreement. My wife and I constantly called and emailed the loan officer and usually calls took weeks to return. We feel that we were treaty poorly and unprofessionally though out this entire process. If there was truly a problem with one missed payment they should have told us months ago. We've had to cancel home improvement plans as well as plans to sell our home when the market was in our favor. We could have been spending the last 4 months with another lender if we knew the outcome of this agreement. We most certainly were misled and feel this behavior is unacceptable by any lender. 5 months for a refusal is ridiculous. Thank you for your time on this matter. P.S. In the month of XXXX 2021, I began the process of refinancing one of my properties. I wanted to facilitate the process and continue using Sun West Mortgage Company Inc. ( XXXX XXXX ) The first person I spoke with was XXXX. He told me that it was going to be an easy process. My rate was locked at 2.8 %. I provided the required documents, then XXXX began to handle the loan. After several weeks my brother and I began signing several automated documents on XXXX '. We were also made to pay {$500.00} dollars for an appraisal. For several weeks we were avoided and my phone calls or emails were not answered. I tried calling different numbers from Sun West and it seems that every single person I Spoke with was a " manager '' but they could not resolve any issues. I also submitted documents to the underwriter XXXX XXXX just to be told that they would NOT be accepted. so why ask for them in the first place? They had problems checking my brothers income for technical reasons on there behalf. I also paid off all my debt even my student loans and on that day my loan was canceled. I filled a complaint with the XXXX After Sun West received the complaint another agent from the bank called me trying to help expedite the loan and asking for more documents which I sent. One week later they called me back saying that because the loan was cancelled and without my consent my new rete would be 5.5 %! why do we now qualify? It has been about 8 months without resolution. I have not contacted an attorney in regards to this matter but I want to start that process. I encourage attorneys to reach out to me in this matter for input. All this has taken a toll on my mind and health not just on me but for the rest of my family. We seek compensation for damages on many levels. I want Justice done ASAP.

I am currently XXXX to the XXXX XXXX, I fell behind on mortgage payments, Internet services are not always available. I 've reached out to the bank several times to see what options were available to me to no avail. My credit score is dropping dramaticly. I finally was able to make a call and speak with someone. I asked what my options are and she told me that I would have to fill out, scan, fax all this paperwork to her to see ; otherwise there is nothing they can do for me. I explained my situation and how these resources are not readily available to me. She then told me that I should 've planned for this better. I did not / was not even going to entertain that ignorance. I asked if they could temporarily suspend reporting any further deliquencies to the credit bureaus until I return XXXX XX/XX/XXXX/XX/XX/XXXX. She responded " no ''. I asked her if I paid the past due amount right now in full on the phone could they waive the late fees & corporate fees as well as delete the derogatory and late payments from my credit report. She responded with " we do n't do that ''. Up until my XXXX I was in good standing with my mortgage payment, never have been late. I have been working hard to reestablish my credit from my divorce a few years ago ; I involuntarily XXXX to serve my country, leaving my kids behind for less money and to try and deal with this. I am willing to work with the bank but they are not willing to work with me. I know I am protected to a certain extent under the SCRA and they ca n't start foreclosure proceedings for a certain amount amount of time. All this has just added unnecessary stress ; stress that I have absolutley no control over. I am seeking help from CFPB to see if there is anything they can do for me.

Applied in XX/XX/XXXX with XXXX for rate/term. All info originally told to me as far as rate and fees was a bold faced lie. I was told NO FEES at all and 2.9 rate. When LE sent there was several thougsand in fees above and beyond title fees. No calls no responses to inquiries until end of XX/XX/XXXX. Final CD never sent for review even after repeated request. When CD was day of supposed closing and it was incorrect. NO final CD sent, closing was no call no show. No final CD has been given to me in advance, at least not one that resembled what was told to me, and no advance notice on closing. When speaking to lender on XX/XX/XXXX and title agent, based on their recommendation we rescheduled closing for XX/XX/XXXX XX/XX/XXXX roles around and spoke to lender and closer and was awaiting closing. No call no show again from lender, however closer had the courtesy to reach out and say lender cancelled last minute. When I get processor and LO involved, the rate expired. They sat on this for a week, scheduled closing and intentionally let rate expire to further delay this debacle. Literally sat on the file for a week and waited until 10 minutes before closing to tell me this. The practices of this lender have resulted in numerous TRID violations, not to mention the appearance of multiple unfair, deceptive, and abusive practices including false advertising, saying no fees then charging fees and not following TRID rule. There are numerous UDAAP and TRID violations. I would have to imagine this treatment is not reserved for only me, but others are experiencing it too. In addition to the above, no one could give me a correct LE or CD based on what I was told I advance and once they actually did they cancelled closing.

My Issue with the Company Sun West as a whole is the constant lack of professional work ethics and inability to deliver on practical and basic services. I am trying to purchase a real estate property which Sun West is the " lender ''. The issue is after countless phone calls and documents the company can not provided me with an adequate reason as to what is holding up the whole transaction to be able to close on the property. Furthermore, after a minimal two extensions granted by the seller and even then I have yet to fully understand why I am unable to close on the property. The seller might even walk away soon due to the lack of transparency from Sun West the " Lender '' and lack of being able to accomplish a set closing date for the property. I have called corporate multiple times already throughout the process to only be shuffled from one unaware superior of my " loan officer '' to another. The people I voice my issues with have stated that they will handle the situation and call me back to inform me of the resolution. Unfortunately not one of those superiors has yet to contact me back to todays date. I also have my real estate attorney and realtor as a witness to all the shenanigans. I am a first time home buyer and the process has been a total nightmare ; in which I do not feel like a valued customer nor, do I feel like this is fair treatment of anyone. I am in utter shock that a company of this magnitude is not under a fine microscope of the " CFPB ''. I spoke with my attorney and realtor before submitting this complaint and they both assured me that my current experience is not in any way, shape, or form a representation of how the home buying process really works.

My name is XXXX XXXX and I was a mortgage lender for Sun West Mortgage. I recently have decided to leave that company for being predigest most of my clients. Recently I have had plenty of clients submit a loan application through Sun West. I have been originating for over 3 years at several companies. At this point I have never had so many issues to be able to provide a pre-approval for my clients. I have attached a loan application on 1 of my clients along with all the conditions and the XXXX findings giving us an approval. They refuse to provide a pre-approval letter to my clients. I have had situations where I have had to request 24 months of paychecks from my clients. My clients have provided that, and they will still not provide a pre-approval letter. This is ongoing w/Sun West . I am currently no longer with them. I have another file currently with them, XXXX XXXX has sent in all the conditions as well and they had not sent the file into the VA for review. They have discriminated against all my clients, even the Veterans I serve. Sun West has help back a lot of preapprovals from my clients after running their credit and submitting all the needed documents and they refuse to pre-approval any of my clients. They have violated so may laws in the mortgage industry. They discriminate and should not be servicing loans. They only provide preapproval letters to those they THINK is worthy. Regarding wither the client is truly approved or not. They set up files so that files for clients do not get qualified. XXXX is a VA file and they sent it to the VA with a 50.5 % DTI knowing it will not work. They refuse to let the client know why and how to help them qualify.

By the end of XXXX, I began the process to obtain the money and pay off the reverse loan. In XX/XX/XXXX, the XXXX XXXX XXXX and XXXX XXXX declined the loan due to problems with the property. In other words, I was approved for the loan but the property does not qualify for any product. The Bank tells me that no financial institution is going to grant me the money due to the situation of the property. I contact HUD indicating the situation, I send them the bank document and I even make an offer to pay off the loan to which they tell me that they do not accept any offer other than paying 95 % appraisal of the property. I contact other banks to present the situation and try to get the money, but all the banks, including XXXX XXXX XXXX XXXX XXXX, who originated the reverse loan, told me the same thing, that the property does not qualify for any loan. At the moment, I am in a Mediation program with XXXX XXXX in the Court but they do not want to accept an offer, they just want full payment that I can not get due to the situation described or that they hand over the property, which is not an alternative for me since I have tried everything and it is the only property I have. It is my only home and I have not refused to pay at any time and I followed all the steps that they have indicated to me. I just want you to help me with this situation because they granted a reverse loan with a property that has a " Hazzard '' because the property has had that situation since XXXX and if in XXXX it qualified for a reverse because now they can not grant me the loan to pay it off. Please I need your intervention in this matter.

Was emailed by my current mortgage lender about a HELOC back in XX/XX/2022. I contacted the company SunWest Mortgage to inquire about this program and they assigned me a loan originator, they collected some information and explained that I would receive documents to sign. I did complete that and then waited for further instruction. I was not contacted again until I initiated the status update. They indicated they could not pull credit because of a lock on my account. I explained the lock had been removed and they were ok to proceed. Another week or so went by and never heard a word. I followed up again and he explained I still had a lock on my file. That again was not true. They finally pulled credit and the process continued. I then received disclosures however upon review everything was filled out for a property I have not owned in XXXX years. I received an invoice to pay for an appraisal for that same property which was not my current owned property that I was applying for the HELOC on. I was assured that all would be fixed and disclosures etc would be resent. I never received anything. Continued to not hear any updates at all. I sent several emails and phone calls and never received any responses until I started inquiring to speak to managers. I was finally contacted back and said they were getting it all fixed. Still have not heard anything back. This is going on a XXXX month process now and the whole situation has been messed up from the beginning. I would like this to be resolved as soon as possible or my credit report repaired and the inquiries they caused removed.

I contacted XXXX XXXX mortgage loan cordinator of XXXX XXXX who represented rhe lender Sun West Mortgage Inc. After prequalifying and going through the process up to the appraiser, is where things became very fuzzy with continued descrepancies from XXXX XXXX and appraiser. Appraiser claimed he couldn't find comps, when he did get them, he had issue with the business/residential ratio, fixed that, then estimator had issues with contractor 's bid saying it was too low. Had to trump it up to XXXX dollars more. Then the appraiser results finally came after refusal to complete the appraisal, some curiously long delays, dissapearances, and after reluctantly agreeing to complete the report. Finally his appraiser 's report came in 100, 000 plus dollars above the property value. Just about what they had me raise the contractor 's bid to. Then still trying to find a way to work it out, I called the lender 's agent XXXX XXXX, who delayed returning my call for days prior. And finally XXXX XXXX admits to me that his boss flat out didnt like the property and wasn't going to back it. Then weeks later I recieved a letter saying the loan was denied because I lacked collateral. Something that was never asked for in the transaction and never was in any document. The reason they said I didnt get the loan was simply not true. This out and out misinformation confirms what I already had come to believe. That I have been redlined by the mortgage company.

complaint against : Sun West Coast Mortgage XXXX XXXX XXXX XXXX XXXX XXXX & XXXX XXXX Ca XXXX Upon moving into the home we have noticed or had issues that was not listed in inspection and appraisal documents. These issues have cost my family over XXXX dollars. We purchased the home and was never told about the fire hazard with a sliding door not being able to open. We also have a gas fire place that the previous home owner told me he dont know if it works or not. We had to cut down trees, we had a second floor leak and all of these problems where within a week or two of us moving in. I hav documentation of these issues along with invoices. I spoke with the company on numerous ocassions and they have not tried to help me. I told them that FHA wouldnt have approved of that home with the hazards it had coming in. I also explained to them my family would had made contengencies based on the issues the home presented. But these issues was not listed in the inspection. To me it seem like he left off the things that didnt work to finish to process. XX/XX/20 & XX/XX/20 I called Sun West Mortgage company and spoke to a representative and then to a supervisor regarding the CARES Act forbearance. I am up to date with all of my payments at this time but will have difficulty making payments for XXXX and the next few months as my husband is not working. I asked for the forbearance to start on XX/XX/20 for 180 days. According to both the representative and the supervisor the forbearance starts on XXXX. I called FHA on XX/XX/20 ( reference # XXXX ) and spoke with an FHA employee who also reviewed the info with me and stated I had a clear understanding of the information and I was correct that the forbearance does not need to be retroactive or pushed back if I had made the payments. The Sun West mortgage representatives kept telling me that no matter if I made my payments in XXXX XXXX XXXX, I still have to have the forbearance start on XX/XX/20. This does not make sense to me as I have already made those payments and its the future payments that I am concerned about. How is this helpful as a consumer to have a forbearance start on a date when I was ok financially to make my mortgage payments. I have not heard back from FHA regarding this case other than the initial email I received from the rep when I called on XX/XX/20. Please contact me as this is a not how the CARES Act is supposed to work.

sun west mortgage company is the holder of my first mortgage on my property. i went into forbearance due to layoff from covid shutdown. as i am coming out of forbearance they did present me with some options, one was a loan modification but they did not provide the documentation requested by my second mortgage holder for a subordination ( XXXXXXXX XXXX XXXX ). XXXX XXXX XXXX denied the request for subordination due to delinquency, but i was delinquent due to forbearance under the cares act and the second reason was that sun west did not provide the proper documentation. when the subordination was denied sun west immediately moved into the foreclosure process asking for {XXXX} due by XX/XX/2022. this is a federally backed loan by XXXX XXXX and it is my understanding that federal backed loans will not be asked for payment in full i have made payments in full to both companies since my forbearance ended and am ready willing and able to continue making payments on my home but the current situation is i will be forced to have my home foreclosed on or sell if i do not take out another loan to cover the mortgage balance. something seems off here and i can not understand why both companies would rather see a foreclosure rather then just work something out and have me continue to make my payments. i think i need some help.

I had previously submitted a complaint under " CFPB Case Number : XXXX ''. In response to my complaint, SunWest Mortgage Company stated " Th e appraiser has mentioned in the appraisal report that the subject property was recently renovated ( in the year 2013 ). The subject property had new roof, new vinyl siding, new kitchen, new bathrooms, new laminate flooring throughout, new furnace and new hot water heater. This indicated that the subject property was in like new condition. ". The truth, however, is that : the roof was not new, the vinyl siding was not new, the furnace was not new, and the hot water heater was not new. I would like to hear from the Bank, as the Bank seeks a response from the Appraisal company they had hired. Based on what assurance did they affirm that : the roof, the vinyl siding, the furnace, and the hot water heater were new? This information led the Bank 's underwriters to believe that the property had been recently renovated. This is no laughing matter, but it almost can serve as a joke when we talk about the furnace and hot water heater. These a very, very old. Why did the appraiser say they were new? Did the seller provide the appraiser with receipts of newly purchased and installed furnace and water heater, or the appraiser simply assumed they were new?

SUNWEST MORTGAGE. Roof damages and my insurance carrier ( XXXX ) approved a full roof replacement. I had to inform mortgage Company Sunwest about this because the repair check was a 2 party check to me and mortgage company. After filling out all the paperwork, Sunwest informs me that they will keep up to {$150.00} of the contractors money so they can pay their own inspector to come make sure work is completed. I spoke to my loan officer and my insurance carrier and neither has ever heard of this practice. I look at all my loan docs when I signed with Sunwest, and no paperwork shows that if I have an insurance claim that Sunwest will basically take a deductible out for an inspection. Now, I am going to have to owe the contractor up to {$150.00} plus my deductible. Sunwest, stated they do this for the Safety of my family. They will not budge on this. I tried to even explain to them that we purchased a Permit through the county and they actually have an inspector come out and I could just forward them over the county info when completed. Sunwest said no and will still be withholding money from the repair check for their own inspector. I feel this is a shady practice and when looking for a mortgage carrier, would have never signed with them if I knew that I would be charged a fee if I have an insurance claim.

Due to some complications we received from a previous lender, I decided to move forward with XXXX XXXX from Sunwest Mortgage as our new lender as he assured me that we would close on time and there would be no issues. On the day before closing at around XXXX, he decided to call me and tell me there was an issue and that I had to bring another $ XXXX to closing to get it fixed. As you can imagine, this threw me completely off guard because two days prior to closing everything was fine and Sunwest confirmed we were good to go. Due to this nonsense and the company 's evil practices, we had no choice but to ask the builder to delay closing to figure something out. The builder in turn, was not going to delay closing and were planning to charge {$250.00} per day for the extra time. This of course led to us having to cancel our contract because we did not have the extra funds, nor were we given any help in attempting to fix it. Sunwest Mortgage company has now cost me my deposit ( {$5000.00} ) and {$600.00} due to the appraisal I had to order because they were unable to switch it from the other company. I am now without a new house to move into and having to explain to my XXXX XXXX XXXX son that we must find an alternate location to live due to the incompetence of Sunwest mortgage.

I have a XXXX mortgage from Sun West Mortgage Company. After the repairs were completed, Sun West Mortgage Company sent me my monthly statement XX/XX/XXXX for my upcoming XXXX 2016 mortgage payment. The statement showed the unused funds were applied to my bill and I still will have a remaining credit for about half a month worth of mortgage. The statement clearly indicated under please pay amount that it was a negative ( credit ) amount. Because of that monthly statement, I rearrange my finances to cover things I normally did not have room in my budget. On XXXX XXXX, 2016 Sun West Mortgage sent me an email saying I did not make mortgage payment before the end of the grace period ( XXXX XXXX ). I contacted Sun West and they stated it does not matter what they sent to me and pay my bill. They refuse to admit fault. They bombarded me with a lot of phone calls and had someone visit my home twice to instruct me to pay. Sun West stated that the credit is correct, but they applied it to principle. This may or may not be standard practice, but the monthly statement did not reflect that. I find Sun West practices to be misleading, inappropriate, harassing, and intimidating. I have had my mortgage with Sun West for almost 3 years. It has been a bumpy 3 years but i always make sure they get theirs. I contracted a life threatening case of the XXXX XXXX virus in early XX/XX/2022, and as such fell behind on my payments to a lot of creditors since i could not leave the hospital/house for weeks, including my mortgage. I made sure i paid my mortgage first and they were taken care of, and have been since. I literally could not work because of my illness, and i was caught up until that point, and they still hit me with late fees and dinged my credit for being late. Well i got them paid, and have been fine since then, however, my credit has not been. That late payment on my credit is keeping me from doing a lot of things i need to do in my life and its just not a fair or good way of looking at on their part. I reached out to them, they sent me back a basic letter telling me " better luck next time '', not in those words, but the gist of it. I know i had some transgressions the year before that, but i am not asking for a handout there, all i am asking is for some mercy in XXXX of 2022 and a removal of that late payment in particular. I was hurt by something out of my control and i am asking for the smallest amount of mercy.

I was offered an informal forbarnace on my loan due to the the impacts of Hurrican Irma on our area in Florida. I have submitted documentation and loss mitigation request packages numerous times to try to get on a repayment plan to bring the loan current or request a modification, or simply an extension of the forbearance until XX/XX/XXXX when I will receive my delayed bonus in order to bring the loan current. I have received little to no response and communication from SunWest and promises for call backs and assistance that have gone unfulfilled. At this point, the forbearance is up XX/XX/XXXX, and I have been trying all week to get answers on what I can do to ensure my credit is not impacted and how we can work to bring the account current. When you call the loss mitigation and customer service departments, you sit on hold for 5 min and then are automatically dumped into a voicemail box. I am out of options and am simply trying to ensure that I can work to bring my loan current as soon as possible. I have diligently been trying to work with them for the last 60 days and it seems they are ignoring my requests so that the forbearance will run out and they can asses late fees and impact my credit report as of XX/XX/XXXX.

I refinanced my home with Sun West Mortgage in I believe, XXXX or XX/XX/2022. I also cancelled my home owners insurance with XXXX XXXX XXXX on XX/XX/2022. In XXXX and I signed with XXXX XXXX. I received a letter from Sun West stating they received two claims for homeowners insurance payments. I called Sun West and verified my cancellation with XXXX XXXX but Sun West had double paid to XXXX XXXX and XXXX. Then In XXXX I again received a letter from Sun West Mortgage stating they double paid again. I called Sun West and cleared it up again. I filed a complaint with The XXXX XXXX. Of XXXX : Consumer Complaint for XXXX XXXX. I also filed a complaint with CFPB against XXXX XXXX XXXX ; Complaint ID XXXX. Since that time Sun West has not been sending me my payment coupons. They have been calling me and in their verbal disclosure they are threating foreclosure on my house with this statement " We are a debt collection agency and whatever you say can be used for that purpose ''. I have made every payment and in fact have made extra payments to my principal. They have not resolved my issues and in fact continue to threaten foreclosure. I had an unforeseen problem with my mortgage payment for XX/XX/2019. I set up the mortgage payment on the Sunwest mortgage company website for XX/XX/2019. Even tho this would have been 30 days late I was willing to pay late fees. I planned on paying the XX/XX/2019 payment on time. XX/XX/2019, received a phone call from a representative from Sunwest mortgage, in ref to XXXX payment. The rep explained no payment was pending or received. I explained I set up the payment for XX/XX/2019, at that point, I signed into the Sunwest site online. to check the status. No payment was pending, I told the REP I would pay the mortgage now. The REP advised me they block the payment part of there website and I wouldn't be able to pay it online. I told the REP this doesn't make sense to block me from making a payment and this is my complainant. Why would any business make it difficult to make late payments, I could O made my payment over the phone, but I rather make a payment online, I decided to mail the payment in and making it longer for the payment to clear. In the meantime, Sunwest will continue to make collection calls, as a result of blocking the online payment site.

SunWest, a.k.a. XXXX, has made repetitive, unnecessary demands that I confirm my request for paper documents over the past twenty-seven days thus unduly delaying the processing of my loan and the loan closing. Beginning on XX/XX/2020, I made written requests for paper copies of loan documents. The loan officer confirmed on XX/XX/2020 that he would mail paper documents to me and confirmed the address to which they would be mailed. On XX/XX/XXXX, XX/XX/XXXX, and XX/XX/2020, I repeated my clear written requests to the loan officer 's supervisor. On XX/XX/XXXX, the loan officer 's supervisor emailed me requesting another confirmation that I wanted to be provided with paper documents, stating that he was " very familiar with all the laws and rules from the CFPB and other authorities that regulate our industry. '' The repeated requirements for confirmation of my request for paper documents is beleaguering and dilatory and is unduly delaying the loan closing. I recently refinanced my house with the same lender. The closing date was set at the end of XXXX and I had already sent in my payment for the month of XXXX. As there was to be two months of " skipped '' payments ( notice enclosed ), this would have been XXXX and XXXX with payments beginning XX/XX/XXXX. I called the broker, XXXX, who stated that Sun West Mortgage would catch the error and return the check. When the check was not returned in several weeks ' time, I began inquiries. They acknowledged receipt of the XXXX check, but after that, there is obfuscation only. One individual claimed that the payment was included in the return of the escrow account, which is false ( copy of the escrow balance and the check enclosed ). Enclosed is a copy of the letter which I sent to the CEO ( no name was given in the online information ). I have also enclosed a copy of the " stub '' from the statement for which the XXXX payment was made. On XX/XX/2020, I was contacted by Account Executive from XXXX XXXX that works together with XXXX to refinance my mortgage. They promised to beat the rate we were offered by another entity and said that we are looking at 30-45 day escrow. We signed the agreement at 2.5 % without closing cost. Person from XXXX XXXX led us to believe that were on track and almost ready to close and advised not to pay our mortgage payment for XXXX. Luckily, I did not take his advice and made a payment before penalties kicked in and our credit scores was affected. On XX/XX/XXXX, they assured me that we are still moving forward and almost ready to close. On XX/XX/XXXX, they told me that management has reviewed the file and identified some pricing errors so now I have to pay 2.75 % instead of 2.5 % with no points. At that point, I simply agreed to it and instructed them to carry on with new rate. It's now XX/XX/XXXX, deal is nowhere near closing state unless I'm willing to take 2.75 % with closing cost being around XXXX. Those guys using bait and switch techniques to acquire new customer base, absolutely unacceptable at these day and age.

My husband and I were trying to get a modification on our house and that back in XXXX XXXX is when filed for this with our HUD certified mortgage modification counselor. We in default on XXXX XXXX because we still could n't pay in full and the modification was denied. So filed appeal because they had said that the VA said that we are in the negative balance of {$80.00} and that is what Sun West h ad told my HUD counselor. I turned in the appeal so this papers were in and with all the proper documents and adding income with extra dependent that I have legal guardianship of her. We had a weekly request in on what is going on with the refinance and every week Sun West claim was all good and still in the process. XXXX. Requested a number of additional things from such as my bank statements when the federal loan requirements say not to ask for thisXXXX. XXXX XXXX has claimed after the fact that something was mailed to me with the closing cost back XX/XX/XXXX. This did not happen. Nobody has seen what she is claiming. I asked for my signature on it somewhere which does n't exist. Only my signature on a loan application with the XXXX area blank is what they can find. XXXX. CEO refusal to follow up.

I was recently in a forebearance program with my mortgage servicer ( SunWest Mortgage Co. ) I am fully caught up with all payments and attempting to re-enroll in their in-house auto payment program. Their loan portal shows me a message saying that I need to contact their customer service team to re-enroll in auto payments since I was enrolled in their forebearance program. This wouldn't be a problem but I can not get any customer service support. When I call I wait on hold for an hour then I am directed to an automated prompt telling me to leave a voicemail and they'll call me back. The call back never comes. I have also attempted to resolve this over their website 's online chat customer service and their own agents then tell me that i'll get a call back within 24 hours ... that never comes either. I find it odd and disconcerting because for a large company that has so many regional offices nationwide and who was until recently, so easy to contact and speak to an agent, is now impossible to communicate with. This seems highly suspicious to me in the way smoke makes me suspicious of fire.

My mortgage company is incredibly clueless. They did n't pay my Homeowner 's Insurance policy last year and it was cancelled accordingly. I contacted them ahead of time to advise I received notice and then still managed to be late even though I advised when it needed to be paid by. This year I contacted them 2 weeks before it cancelled. My insurance company said they called and asked about renewal on the XXXX and my insurance company stated they would have provided the renewal amount. My mortgage company said they never got the renewal amount (? ) and then advised me they sent a check for the prior years renewal amount on XX/XX/2016. I contact my Insurer ( XXXX ) again on XX/XX/XXXX, they advised of the above call on the XXXX and stated there was no contact or check received from the company since then. This has been grossly mishandled and I have had to figure it out both years and been stuck in a state worrying about my insurance policy cancelled, premium rising because of their mistake, or being stuck with Lender Placed Insurance because they ca n't handle an escrow account properly.

I was just informed that I am Disqualified for an IRRRL refinance loan due to a COVID-19, Mortgage company Approved, ONE Month Forbearance ( Where I did pay the interest ) in XXXX. So ... Basically, I am not afforded the opportunity of a lower interest rate due to a World-Wide Pandemic that I worked through??? I took a 30 % pay-cut for XXXX and XXXX. I asked Sun-West Mortgage company for a 3 month forbearance. I paid {$900.00} on interest in XXXX. In XXXX, I paid {$3000.00} and was caught back up because my salary was restored since I was considered essential and worked through the mayhem. This is the most ridiculous set of rules. WHY in the world would this be acceptable? Please change these rules for IRRRL qualifications. An approved forbearance due to this pandemic, especially one that was only used for one month, should in no way, disqualify an individual that has been, is doing and will continue doing the right thing. To Whom It May Concern I am getting jerked around by Sun West Mortage Company. What happened is when I first set up my automatic payment I wanted to make a {$1000.00} dollar payment each month. It would cover the payment and anything else was to go to principal. Sun West Mortgage Company decided to raise my monthly payment from {$890.00} to {$930.00} That was no problem since I was paying a XXXX dollars per month or so I thought. Turns out they added the {$100.00} the {$930.00} equaled {$1000.00}. It was {$39.00} more than I requested to be taken out. Subsequently, I did not have the extra {$39.00} but I did have over {$1000.00} dollars in the account. They said I had insufficient funds so they docked me {$15.00}. I know it does not sound like much but they threatened me with a bad credit score if I did not pay up immediately. I made a payment through XXXX XXXX on XX/XX/XXXX. I was told that all I had to do is call in and give them the mtcn number so they can process it on that day then I would n't receive a 30 day late. So I called in the number on XX/XX/XXXX after I made the payment and gave the rep the mtcn number. I made the payment on time, but when SunWest Mortgage went to withdraw the fund was insufficient. i wasn't aware my wife failed to put the money back in the checking account after using some of it. I immediately, called SunWest to explain what had happened, tell them the fund is there in my account and I'm ready to pay the penalty because of that. I told SunWest this is a very difficult moment where they should at least, see the human toll besides their own bottom line which is making money at all costs.They didn't want to listen, explained to me the way to resolve the payment is to go buy a money order for the amount of {$2100.00}. SunWest charged me {$15.00} for insufficient fund and {$110.00} penalty. My final bill was the mortgage payment plus fees, penalty and {$15.00} for the cashier check I bought. Oh, i forgot to mention next day postage fees. This is the way SunWest treated part of its clienteles that is voiceless and unable to come out of that merciless purge.

At the beginning of XX/XX/2018, the mortgage on my home at XXXX XXXX XXXX, XXXX, VA XXXX, which until that time was held by Sun West, was transferred to XXXX XXXX XXXX. I bought my townhouse on XX/XX/2020 during the pandemic with the help of a down payment assistant program of {$11.00}, XXXX, forgivable after 36 months of consistent payment. My mortgage was with Sun West mortgage company ( SWMC ). While attempting to refinance and shopping around, I was told that I have a third XXXX for {$31000.00} on my mortgage ( deed of trust ) with a guy named XXXX XXXX XXXX XXXX as the trustee and Beneficiary, MERS acting solely as a nominee for Sun West Mortgage Company inc. Sun West Mortgage Corporation 's licensed broker XXXX XXXX, Tel XXXX XXXX told me on XX/XX/2021 that he would lock in a refinance loan on my home at the rate of 1.75 % 30 yr fixed and would send me a loan estimate for loan # XXXX, and had me sign all the necessary documents, and relying on this estimate, I cancelled other pending offers at the same rate. Then this broker sends out a notary to sign papers where he has added {$10000.00} fees additional to the loan estimate that I relied on to my detriment. I refused to sign the papers, and he stated to me that he would correct the problem, and send out the notary again. As damages, I am demanding the {$10000.00} damages for detrimental reliance ; or alternatively, that the loan estimate be honored, this is a VA XXXX loan which the fees added make it not approvable by the VA for its 36 month recovery test.

I refinanced my mortgage using contour mortgage. My current mortgage company sunwest mortgage gave contour a payoff on XXXX XXXX. I signed the closing papers on XXXX XXXX, 2016. I have my monthly payments directly come out of my checking account every XXXX of the month. I was advised by sunwest to cancel my XXXX payment threw my bank due to the signing which I did. XXXX also calculated per dime payments into the final payoff which would bring the payments current from the date of requested payoff until XXXX XXXX when the payoff check was received. I received a letter from sun West stating my loan has been paid in full dated XXXX XXXX. I am now receiving phone calls from sunwest stating I need to make a XXXX payment. Both myself and contour mortgage have documents paying the loan in full and do not believe I owe a XXXX payment because of that.

I called Sunwest Mortgage to see if I could pay my XXXX payment on XXXX XXXX. I 've never made a late payment in 2 years since I purchased the house. I wanted to make a payment arrangement to make sure my payment was made for XXXX ( since I 'm going through a divorce I have to pay rent, mortgage and child support now ). They were not at all compassionate about my situation. They said if they did n't get the principal by today, I would have a negative mark on my credit report, they would send an intent to foreclose, and I would have to make 2 XXXX payments. I think this is totally unfair. Again I have not missed a payment in 2 years. I 'm going through a financial hardship with my divorce. The " intent to foreclose '' is not true, the house is on the market and I do n't intend to miss any payments until it is sold.

They do not have a loss mitigation office in Puerto Rico, where I lived and always sent the documents late, through XXXX. As an example of this problem, I am submitting evidence of two letters. The first one is a letter of Informal Forebearance Agreement dated XX/XX/XXXXsent to me by XXXX on XX/XX/XXXX., as a consecuence of recieveing it late I was not able to act on it in a timely manner. I received a phone call and a late payment statement from Sun West Mortgage Company, Inc ( SWMC ) on or about XXXX/XXXX/2016. After looking at my XXXX XXXX online payment detail I called SWMC mortgage and explained my bank showed they mailed the payment on XXXX/XXXX/2016 and the payment processed XXXX/XXXX/2016. I was told they did not process the payment until XXXX/XXXX/2016, which created the late fee after XXXX/XXXX/2016. I explained they had internal issues processing my payment late and that was not my fault. They said they could wave half of late fee ( {$42.00} ). I currently have a mortgage account with Sun West Mortgage ... A couple of years ago I was out of the country and had some problems with transferring funds and speaking with Sun West Mortgage to make my payment. My payments are due by the XXXX of the month and for whatever reason I paid this account either on the XXXX or the XXXX of the same month. I absolutely do not believe I was 30 days late on this payment, but Sun West continues to report this payment as 30 days late. I have been disputing this late payment with the credit bureaus but have not been able to get them to remove it. I have become extremely behind on my mortgage due to loss of employment. I was finally able to regain employment ( although still making a considerable amount less than what the mortgage was originally based upon ) and have applied for a loan modification which they have denied and are pushing to foreclosure. They stated that I did not have enough income but would not provide me with any actual numbers supporting the denial. I received a promotion at one of the 2 jobs that I hold which boosted the income. I sent in the documentation to support that new income yet they have not reviewed to see if that will allow for a modification. On XX/XX/2022, an interest rate was locked with Sun West Mortgage company for a borrower. On XX/XX/XXXX, without prior notice, Sun West unlocked the client 's rate and required that we re-lock the rate. The client had already signed the rate lock agreement. After asking that Sun West re-lock the interest rate based on the signed agreement, we were informed that they refused to re-lock the original rate. They insisted that I re-lock the rate even though they refused to give any prior warning. Sun West has very unprofessional business practices when the borrower or mortgage broker has done nothing wrong. This is an unethical business practice and should be illegal. I requested a broker price option because the value of homes where I live has risen significantly and I believe I have enough equity to stop paying PMI. A sunwest mortgage company representative told me XXXX was an option and took my payment information by phone to move forward with the process. I waited over a month for a reply and received a voicemail telling me that I'm not eligible because I requested a forbearance while I was furloughed from work during the Covid shut down in 2020, almost a year ago. In XXXX of this year, I refinanced my home. My existing Bank at the time was XXXX and they took my money in escrow and paid my taxes as the transfer was taking place between banks. The new mortgage owner ( SunWest Mortgage Company, In. - NMLS ID XXXX ) also paid my taxes with the settlement money that was established for paying the taxes. Sunwest mortgage is reporting erroneous late notations on my credit file and they must be removed. I did a short sell on my house and sold it almost immediately and the new owners moved in very shortly after. However, Sunwest mortgage is showing 2 lates for XX/XX/20 and XX/XX/20. I was not late on this account, my title company was supposed to wire the money over. This was not my fault, whether or not payment was received on time was not up to me but my title company. I can only assume there was some kind of error on your end or my title companies end but this is not my fault. My house had already been sold and people were residing in that home for those months. Sunwest Mortgage has maliciously reported my mortgage account incorrectly. This act was premeditated and vindictive. Because I am enrolled with all XXXX major credit bureaus, I have the date ( proof ) archived. When I disputed the data, Sunwest refused to correct even after I disputed numerous times with them directly and the XXXX reporting credit bureaus. I got the VA involved and the issue first issue was mitigated the next day. XXXX is directly responsible for the fraudulent reporting of a federally insured VA mortgage which is a felony. I 've extended the financial contingency / contract agreement several times due to slow response and to avoid losing the opportunity to purchase the home. I applied for the Homeowner Assistance Fund ( HAF ) program with the Department of Economics and was approved. I notified my mortgage company Sun West Mortgage that I had been approved for mortgage assistance and had been approved. I sent the approval letter. Company has failed to pay property insurance due to lack of funds. Account is escrowed and I have been making all payments on time. Concerned that property taxes are also not getting paid and that I could lose the property. Insurance payment is over a month late, was due XX/XX/22. Talked to mortgage company XX/XX/22 and they told me payment would be sent the following day. My insurance contacted me XX/XX/22 saying they had not recieved payment. XXXX denied my application to submit to underwriting stating I did not meet FHA guidelines because I did not have a home I own and will be renting out via a lease appraised and that should could not accept the lease I had. Sunwest Mortgage is reporting a late on my credit file that needs to be removed. I was refinancing my home and working with the title company and sunwest and my lender on this. Everyone advised me to not make a payment because it would mess with my refinance and that the title company would issue the final check that would pay off my loan so I did as I was told.
