Terrible issue with SUMMIT FINANCIAL CORP. After hurricane Irma I was told that I would get XX/XX/XXXX and XX/XX/XXXX payments deferred to the back-end of my payments so I paid XXXX for the months of XX/XX/XXXX and XX/XX/XXXX but wasn't told that I had to pay an extra {$21.00} for the payments to be deferred after I made the payment which led to my car being put up for repossession in XX/XX/XXXX. I got past the tow truck guy called Summit explained what happened and singed a contract with them to take the repossession off paid {$1300.00} for that. I was left displaced due to the hurricane & have not been working since ..explained this to a collector ( XXXX ) and asked why was my payments for XX/XX/XXXX and XX/XX/XXXX were {$650.00} she said it was from all kind off different late fees ... then I stated I couldn't afford those fees and if I paid that I would be up 2 car payments she then that if I just pay an extra {$1.00} over the payment I would be ok and stated that I would double the payments for XX/XX/XXXX and XX/XX/XXXX and that I just was offered a position. I was unable to keep that promise due to me starting new and had to wait til XX/XX/XXXX to get paid. On XX/XX/XXXX I tried logging into the website to pay and was locked out ... tried contacting customer service but was put on hold for a good while. That night my car was repossessed around XXXX and being that I work graveyard shift I was unable to go to work @ XXXX. Called them @ XXXX XXXX and was told they had no knowledge yet of the tow company having the car and the company opened at XXXX someone would give me a call back ... that call didn't come until XXXX ... and was told by a repossession manager then that they were not going to take the {$1000.00} they stated I owed for the past due late fees and car payments ( which I only owe {$310.00} a month and was willing to pay the amount stated ) and he felt I was going to continually be late along with the payments and that the car is still over {$14000.00} on which I suppose to owe ( which it was only {$13000.00} when I purchased it and have had it almost 2yrs ) so they were defaulting on the account. I'm truly confused to how have the total cost not changed in 2yrs along with how could he personally make that type of descision. I asked for all transactions to be sent to me also so I can see for myself exactly how the payments were over {$14000.00} but I have yet to receive that email. Im currently at rusk of losing the job I just recently received due to this situation.

On or about XXXX XXXX, XXXX I contacted XXXX XXXX at Summit Financial to verbally advise that I was voluntarily surrendering the XXXX XXXX XXXX. XXXX XXXX stated that it was the holidays and that no one was available to pick the vehicle up. I advised XXXX XXXX I was able to take the vehicle back to XXXX XXXX, he told me that I was not able to do so. XXXX XXXX advised that a representative would contact me at the phone number provided to schedule a time to pick up the vehicle. I received no contact from said person, XXXX XXXX received a call on XXXX/XXXX/XXXX from a woman calling from XXXX stating that they were issuing an enforceable warrant for my arrest but did not say for what reason or why. I called on XXXX/XXXX/XXXX at XXXX XXXX and spoke with an individual named XXXX XXXX XXXX whom stated that she was from the enforceable warrant reporting/processing office. XXXX XXXX advised she saw in the notes that someone spoke with me stating I was voluntarily surrendering the vehicle but that they were headed to court this afternoon to place a warrant for my arrest for not surrendering the vehicle. I advised her that I had not received a call from anyone stating they were ready to get the vehicle and that I had no problem with them getting the vehicle. She advised that I leave the key in the vehicle and the car unlocked so someone was able to come get the vehicle as long as it was not in a gated community. I advised her that I was not comfortable with that, that I wanted to be there and receive something in writing stating that they have secured the vehicle. She stated that Summitt Financial is a large company and that I would receive something in the mail 10 days later stating that I could pay off the debt to retrieve the vehicle or advise me of the debt which was owed. I advised her that I was currently out of town but the vehicle was at the residence which was listed on contract. She stated that they had to obtain the key, I advised them to tow the vehicle. She threatened to have me arrested and a warrant issued. I advised her that what she was doing was against debt collection practices and that she had no right to tell anyone that a warrant was going to be issued nor should I be penalized nor threatened with a warrant because Summitt Financial failed to contact me to schedule a pick up time. I have the emails and I am able to obtain records of my phone log to prove that I have initiated contact with the company to secure the vehicle almost 30 days ago.

I took out a loan with summit financial for a vehicle about 1 year ago. I never get a bill from them and have occasionally been less than 30 days late with my payment. I have always paid less than 30 days late. In XXXX I continued to run a little bit behind so I took an option for a XXXX time deferrment for a fee to get back on track as I was getting closer to 30 days late. I made my XXXX payment on time and when I was going to make my payment in XXXX on the XXXX two weeks late, I instead received a knock on my door to serve me a notice of which I thought it was repossession. Upon calling and speaking to a XXXX XXXX who was highly abusive to me, I asked to speak to a supervisor and was passed to a XXXX XXXX who then proceeded to be even more abusive saying I was a collection manager and should be ashamed that my bill was 17 days late. In the past I have made several complaints about a collection agent XXXX XXXX who has made repeated calls to my job despite requests not to call me at work. In fact she made no less than XXXX calls in a 1 hour period to my job back in XXXX. I was assured she would not be rep back in XXXX and I thought all was well. However, she emailed me and apparently dispatched a door knocker, who I mistakenly took for a repo agent. XXXX, XXXX XXXX, and XXXX XXXX have little to no regard for the Fair Debt Collection act and have been at best abusive. I have spoken to excellent professionals at this company before but these XXXX individuals are out of control and I would like it to stop. I have been assured by XXXX XXXX who is the VP of collections that my issues will be addressed. He was reasonable and stated his company 's position about the collection activity which while I disagree with using door knockers now understand is an action they chose to take. What I do n't understand and based on the fact that I have made several verbal complaints about these collection practices in the past is that the abuses continued as long as they have. I am hopeful XXXX XXXX is addressing this but I felt the level of abuse to protect other consumers needed to be reported. I have had some pleasant interactions with this company including XXXX XXXX himself, they do have professional competent bill collectors working for them but these few individuals are so far out of control I could not keep silent.

In XX/XX/XXXX I became ill and went into the hospital and was going to be off of work for an extended period of time. I knew I would not be able to make my car payments so I volutarily surrendered my vehicle to XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, FL XXXX, ( XXXX ) XXXX. They were not happy but they accepted the vehicle, auctioned it off for far less that it was worth ( it was a XXXX XXXX XXXX ). They sold it for XXXX and applied that to my XXXX loan and left me with a XXXX balance on my credit report. when they realized I would not be working they wrote off the loan completely. Some time passed and I returned to work a couple of years later. In XX/XX/XXXX they had listed on my credit report that the amount I owed them was {$9900.00}, thirty days later in XX/XX/XXXX it increased to {$13000.00}. I have not had possesion of the vehicle since XX/XX/XXXX, how can they continually charge me for the vehicle? Also they list on my credit report that I " failed to make my payment '' each month for the past two years. How can they do that when they have written off the loan? As of XX/XX/XXXX I now owe them {$14000.00}! It's all on my credit report and it goes up every month. They have charge me over 50 % of the original figure of {$9900.00} in a matter of 12 months! I feel they are being vindictive because I defaulted on my loan and I would like this information purged from all of my credit reports and and additional reporting agencies like XXXX and thier affiliates. This is outragous and can't believe that this is even legal. I have been requesting validation of debt for a collection from on my XXXX and XXXX credit profiles since earlier this year of XXXX from Summit Financial account # XXXX. On either time of my validation requests has Summit Financial provided me with a signed contact. Approximately 2 months ago I fike A complaint via the CFPB reference never receiving the proper documentation reference said accounts public auction being held which wouldve allowed me the opportunity to recover said vehicle and the credit bureau XXXX advised they would provide proof via mail within 10 days, which they did not. What they did send me ( documents dated XX/XX/XXXX ) was an updated version of my credit report which indicated that they had modified the comments to a Chrage off with a fixed rate. They never provided with the documents I requested. Now moving forward I requested an early exclusion via XXXX in XX/XX/XXXX for said account and Summit Financial has now moved my date of delinquency from XX/XX/XXXX to XX/XX/XXXX. Because Summit Financial not XXXX XXXX XXXX has provided me with the legal documents of a signed contract As per the FCRA during my validation requests I am requesting that this account be removed from my XXXX and XXXX credit profiles. Id also like to add that prior to qualifying for the early exclusion via XXXX and XXXX I was successfully able to remove Summit Finacial from my XXXX credit profile via an early exclusion request as XX/XX/XXXX. It appears that Summit Financial is intentionally attempting to further harm my credit profile and my credit score by refusing to provide me with the documents the FCRA states that Im legally entitled to once validation is requested.

I opened an auto loan in XXXX XXXX with Summit Financial. They just set up a website for the company about 4 months ago. I logged on to pay my account last month. The billed stated that my payment was {$430.00} + {$110.00} miscellaneous fee= {$540.00}. I paid that amount. This month I check my online account only to see that This month 's payment included another {$110.00} miscellaneous fee. I called Summit to find out what this miscellaneous fee is and she explained that the {$110.00} was not being charged each month. It was for XXXX NSF fees that were applied to my account in XXXX. They are continuously charging interest on this {$110.00} even though I made a payment which was more than enough to cover it. Instead of applying my overpayment to eht {$110.00}, they have the funds " set aside '' for me until I have enough extra month to make a full payment. They said that I have to " request '' the money be applied to the miscellaneous fee. Also, this company just recently started sending out statements within the last 9 months. Before then, I had no way of knowing what is charged and what is due. I believe this company is unfairly collecting interest by keeping consumers in the dark in regards to this " miscellaneous '' fee collection and interest accrual. I have requested a copy of my entire transaction history, but I am sure that this " extra '' money they have sitting aside for me has been there for a while. And instead of applying it to my principal balance, they have been unfairly gaining interest on it while charging me additional interest at the same time.

Some years ago my information was used to obtain a used car from XXXX XXXX XXXX in XXXX, FL that has since closed. After getting paperwork in the mail " thanking me for my purchase '' I immediately went down to the lot where the manager gave me the number to the financial provider for the car and would not give me the information on the person that actually got the car. After contact the loan provider we got things situated and my information was " deleted '' off of the car and everything had went back to normal. In XXXX I pulled my report and noticed that Summit Financial has started reporting for the balance of {$8000.00} for the XXXX XXXX that I did n't own or posses. I immediately contacted them and the loan officer that i had spoke with prior to see what the deal was and why it was still connected to me. I was told since my name was originally on the paper work even after having my name removed ; that It still had to be reported to my credit. Even though I found that hard to believe. They had me to believe that even though i had no ties with this loan ; it had to sit on my credit for 7 years according to Summit Financial. I am preparing to be a homeowner and had a meeting with my banks home loan manager and pulled my credit all for me to find out that Summit Financial never even after 7 years deleted this off of my credit. They actually reported for an extra year. NOW, adding fees and renewing this debt that I do not owe them! This getting out of hand with the lies and the run around that i 'm getting at this point.

Collector contacted me to voluntarily surrender a vehicle that original lender " charged off ''. She would not identify the company she worked for but threatened to file an " order of execution '' to have police pick up the vehicle. When asked to send paper work to me to submit to my attorney she screamed at me and said there was no paper work. Just tell her where to pick up the car. She also left several voicemails on my cell phone threating the same. I saved the last voicemail. The person also called my employer and spoke to my supervisor informing him of the debt and the police coming to my office to pick up the car. My supervisor sent me an email detailing the phone conversation. I had my attorney call her and she told him the same thing. He searched court databases for XXXX Counties and found no documents filed against me. He told the person not to contact me at work nor my employer again, and to notify me in writing of any legal proceedings including documentation and not to call me any more or come to my home without proper identification and paperwork. The person would not identify where she worked to the attorney either and was very abrasive as she was with me. The attorney told me to contact the FTC as the person was calling from a cell phone, would not identify who she worked for or a work address, nor provide any written documentation of legal actions, which was a clear indication of a scam and that she violated laws.

My Auto loan is with Summit Financial Corporation in XXXX Florida. My loan papers given to me from the dealership at the time of purchase state that my " payment due date is the XXXX of each month, and considered late if paid ten days or more after the above stated due date and buyer will incur an additional {$50.00} late fee. '' Summit Financial has not given me any New paperwork to sign for any new due date or additional fees, but began telling me ( after my first year and a half ) that i am past due. They are saying i am due on the XXXX of each month and want me to pay micelllaneous charges but ca n't tell me what the itemized charges are. They do not send me a statement, but only a letter telling me i am past due, micellaneous charges of {$300.00} dollars, no new balance ( balance never changes even after they get payments ). They argue that I have the wrong understanding about the contract and they they do not recognize what the dealership gave me. Only what is on thier computer screen. I have noticed that there are others on a blog site that are having the same problems as I. Surely they can not change my finance terms without me signing a new contract. Please advise.

I have been disputing this debt on my credit report because Summit FinanciaXXXX and XXXX XXXX XXXX XXXX, and XXXX XXXX, which I have submitted court documents and pictures, have reported the incorrect information to the Credit Bureaus. Under the FCRA, it states that if any of the consumer 's information in not 100 % accurate, then by law the credit bureaus are under obligation to investigate it and remove that item ( s ) from that consumer credit file. I have disputed this for over 3 years, with no success. I have submitted documentation to the credit bureaus from the creditors stating my position and they still will not remove these items from my credit file. On XX/XX/XXXX, I sent in documentation, then again on XX/XX/XXXX. I have just recently sent more documentation in around XX/XX/XXXX. The only results I am getting is the items are being updated on my credit file. I have received correspondence from the creditors saying that they have no identifiable information in their system on me. I have even called the creditors and was not able to speak anyone and I also left messages, but received no return calls.

Loan was taken out 3 years ago in a used car for acct number ending in XXXX! At start of loan told it was 7 percent interest rate and have only recently when loan is almost paid off been told that all my extra payment went to interest rate which was not what I agreed to! I have requested over and over and been denied copy of signed Car document showing interest rate or my signature acknowledgment! This means that as I got years thought that this loan was being paid off early due now! In XXXX XXXX, XXXX of Summit Financial Corporation called my place of employment because my payment was about XXXX week late. I asked her not to contact me at my place of employment because I am not allowed debt or credit collection calls at my place of employment. On XXXX XXXX, XXXX, XXXX called my place of employment because they had not received my payment that was due on the XXXX and left a message in my work 's voicemail. I returned her call on XXXX XXXX and spoke with her. I told her that payment was mailed on XXXX XXXX, and I asked her not to call my place of employment because I am not allowed debt or credit collection calls at my place of employment. XXXX became irate with me. I mailed a letter, via certified mail, to the company stating that I have asked them numerous times not to call my place of employment and that I would like them to stop calling because I am not allowed debt or credit collection calls to my place of employment. I have XXXX issues with Summit but was only able to select XXXX issue below. I purchased a vehicle from Summit Financial XX/XX/XXXX. I 've never paid a payment beyond 30 days late until XX/XX/XXXX as I had became unemployed. I missed that payment and it has been affecting my credit ever since, I requested to have this payment deferred but they were unable to work with me in addition I 've sent letters to Summit requesting a resolution but they are continuing to report the late payment to the credit bureaus. In addition, I was recently informed that my loan was a interest bearing loan with 18 % interest rate and I was not informed of this during the sale or my many times talking to the agents at Summit Financial. I became curious as to why is my balance is still over XXXX when I purchased the car in XX/XX/XXXX for XXXX and my payment is $ XXXX/month. The value of the car in currently XXXX. I 'm unable to trade or refinance this car in as I 'm upside down, I want to find a resolution to get rid of this car as well.

I previously had an auto loan through Summit financial opened in XXXX . In XX/XX/XXXX of XXXX I was in an automobile accident, the other driver was at fault, she was cited for running the red light and speeding. Her insurance company paid over {$8000.00} off on the car because it was a total loss. I had purchased GAP insurance with the vehicle and the cost of that product was built into my loan agreement, original dealership was XXXX XXXX Signature of XXXX , GA. After her insurance company paid, that left me with a lingering balance of about {$1300.00}, which the gap insurance I paid for was supposed to cover. The account was then to be paid in full and closed. Instead, they opted NOT to apply my gap insurance, an NOT to reimburse me for paying for a feature they would not allow me to use. The account is still open, and accumulating more fees since XXXX . The current amount they have me owing now is {$2100.00}. This has been adversely affecting my credit with all three agencies.

I am making monthly payments of {$490.00} on a XXXX XXXX XXXX to Summit Finance. In XX/XX/2016, the original loan amount was XXXX. I tried to re-finance through this lender but was denied. Then I tried to re-finance through my bank but was also declined. I found out that for over two years I have been paying only XXXX towards the principle. The car is only worth XXXX and the pay-off amount is XXXX. The dealership told me they were charging me 24 % INTEREST. THIS IS CRIMINAL! IHAVE BEEN UNDER EXTREME FINANCIAL HARDSHIP for the past two years and at a rate such as this I may not live that long to ever pay it off! I also did some nvestigating of 'Summit Financial Corp. and they recently declaRED BANKRUPTCY. This company is still reporting inaccurate information to 2 of the 3 major credit bureau 's. XXXX has deleted them from my credit report after reviewing my complaint and dispute. I have sent in several requests to have this information verified bearing my signature, dates, and accuracy of the alleged amount. They have not supplied me a single copy or response to my request since XX/XX/2018, when the 1st request was made. I am now seeking legal action. I have sent my requests out via certified mail and have all of my documents ready to go for proof of service. Summit Financial Corp, is doing bad business. They are not updating accounts correctly and they are not reporting cars that have been resold for their profit. I contacted this agency on XX/XX/2021 by the name of Summit Financial. They redirected me to another company on XXXX XXXX 2021 called XXXX XXXX, which states they are a lawyer and agent for the Federal government. This Company called Summit Financial is no longer operable. They closed down their business and are not in service. They are not allowed to operate and they have no way of contacting anyone. They had a recording stating they were going to arrest me if i did not pay the amount they are seeking. Neither company refused to give me details of either information including account information and amounts owed. They were very threatening in their tone and language. Summit Financial is reporting negative history on my credit report illegally without any information to provide. I financed a car in 2011 a brand new XXXX and it was under warranty the car then had a factory issue and was returned to XXXX. The finance company Summit Financial was to be refunded for the remaining loan amount once the car was sold at the auction. Now 6 years later the finance company is reporting negatively to my credit file on Friday XX/XX/XXXX the balance was XXXX when I spoke with them and tried to come to an agreement or resolution the where very rude and seemed to care less even though they are not reporting correctly. As soon as we hung up the phone they turned around and changed the balance to XXXX and reported to transunion that I owed this crazy amount that is not true or legal. I called them back and asked them to correct it but they said they do not care and they are illegally reporting inaccurate information

On my credit file dated XXXX XXXX, 2017 I received an update to my XXXX credit report from Summit financial. The report was updated to show the account is now reported as closed, balance is now XXXX, amount past due is now XXXX. as well as the account history codes are now 1. The problem now is that I called XXXX and XXXX to inform them of the update, and they said they were not going to investigate this account again, I faxed them a copy of my updated account with XXXX. The representatives informed me that they reached out to summit financial in order to get corrected updated information, and summit financial REFUSED to update the account with those credit bureaus. I am including my updated credit report as proof of my documentation

I have previously contracted Summit Financial and requested the information re the debt they placed on my credit report for approximately 3-4K dollars. I had a loan with XXXX and the car was brand new and was a lemon I gave them the vechicle to sell in the auction and the debit was to be free and clear. After speaking with Summit and trying to discuss the account and request documentation of the validity of the debt they refused to provide me with information and I have been requesting it for the past year. I have called and they refuse to take my calls. They turned around and changed the balance owed from 3-4K to XXXX and now its rising day after day. This is inaccurate information and not a liable debt, Please remove it.

Summit Financial Corporation is stating that I owe XXXX different amounts on all my credit reports. I voluntarily surrendered my vehicle abo ut two m onths ago. The vehicle was sold about a month ago and my credit reports are not indicating the right amount owed. They immediately reported to my credit report that I surrendered the vehicle but has not decreased the amount owed on any of my credit reports. I was advised verbally that the amount owed after the vehicle was sold was a little over {$8000.00}. My XXXX Credit Report is showing I still owe {$12000.00}, my XXXX Report is showing I owe {$13000.00} and my XXXX Report also has an incorrect amount owed.

Summit Financial is continuously reporting I owe $ XXXX in debt for a car I never had in my possession at all. In XX/XX/2016 and XX/XX/2016, a representative for Summit Financial contacted my job and informed my subordinate XXXX XXXX XXXX that they were looking for me and that I was past due on my car note with the company. The company continued to call my place of employment disclosing information to my assistant, who was not listed as a reference on my account nor did I provide them with the contact information, nor did I authorize them to contact me at that job. The information was then relayed to my supervisor and negatively impacted my employment with the company.

Summit Financial never helped us recover this account at all. The customer service representatives we're very rude and always lied. I contacted the company through email multiply times to resolve my issues and even when the car was totaled what steps did I need to take next and still no answer. On my credit report they have it as a charge off and that is untrue. Summit Financial needs to fix my records or delete the record and its entirety.
