This complaint is about Success Mortgage Partners ( SMP ) from XXXX MI that helped me refinance my current mortgage and XXXX XXXX ( the buyer of said mortgage ) whom is not fixing the issue in a timely manner. I started the refinance process in XXXX of this year and everything went relatively smoothly until it came to the actual closing date. When I reviewed the final documentation on XX/XX/XXXX, I realized on the final Closing Disclosure Document that the Escrow amount was greatly overstated. I immediately emailed XXXX XXXX ( XXXX ) of the issue who then asked me to check directly with the lender. I then proceeded to inform XXXX XXXX ( XXXX ) and XXXX XXXX ( XXXX ) of SMP that they had gross overstated my local taxes due and that it needed corrected before final closing. I was assured that same day by XXXX that they would be looking into the figures and have it corrected before closing. On XX/XX/XXXX I received the updated CD and this time the escrow was grossly understated. Once again, I contacted XXXX to let her know, but she did nothing to get it corrected. The day of closing I brought up the issue to the traveling notary and she suggested it wasnt an issue. That all I had to do was have an updated CD signed by SMP and everything would be fine. My wife and I had little faith in that statement, but figured we would give her the benefit of the doubt. On XX/XX/XXXX I received an email from SMP stating the mortgage loan is being transferred to XXXX XXXX and my first payment was due on XX/XX/XXXX for an amount of {$1900.00}. I figured that wasnt a big deal because SMP must have used the much lower escrow figure and I could add extra each month to make up for it until I could get someone at XXXX XXXX to correct it. However, a week or two later I received my first bill from XXXX XXXX and it had the original grossly overstate escrow amount with a monthly bill of {$2500.00} due on XX/XX/XXXX. I contacted XXXX from SMP on XX/XX/XXXX and informed her of the major issue. Her two emailed responses follow : I apologize for the way you feel. I did everything that was in my powers in order to help you. I even got the managers of the closing department involved so that it could be sorted out correctly for you. If I can be of any assistance in helping you fix this please feel free to reach out. I truly am sorry and I apologize again but please remember it is the title company and the closing department that are crunching the numbers at the end and I did provide them all with all the information that you sent me. I also would be happy to discuss this further if you would like. I just hung up with my manager ( she is copied on the email ) and she is also going to see if she can pull some strings with wells fargo to help you fix this situation. Again as I have said I am sorry for the inconvenience and please fee free to reach out to me if you need anything else. XXXX XXXX ( XXXX ) is XXXX manager at SMP. She responded that she was in contact with my case manager at XXXX XXXX to get this issue corrected on XX/XX/XXXX. I contacted XXXX XXXX to resolve this issue on XX/XX/XXXX or XXXX. Mr. XXXX XXXX ( XXXX ) XXXX Ext XXXX took the call and reassured me everything would be resolved in a timely manner and he would give me updates at least once every two weeks on any progress. I had another person by the name of XXXX XXXX ( XXXX ) XXXX Ext XXXX also of XXXX XXXX leave me a message. I called both XXXX and XXXX to leave messages and have yet to hear back from either of them, and it is now XX/XX/XXXX, and I have yet to pay my mortgage payment. The folks at SMP knew they had dropped the ball and pushed my mortgage through with incorrect escrow figures and did so to get paid. XXXX XXXX took over as servicing agents on the mortgage to try and expand their client base and have done nothing to help resolve this situation. I am now stuck paying an additional {$500.00} more a month on my mortgage payment when I should be paying {$100.00} less a month compared to my old mortgage. Why would I want to refinance and pay more over the same 15 year term. I am extremely disappointed in the way both of these companies are handling my business and hope that you can get them to resolve this important matter in a timely manner.

On XX/XX/2019 we started a loan process with XXXX XXXX. He stated we were shooting for closing on XXXX XXXX. The first thing he had me do that went wrong was he had us payoff one credit card of three. I paid that card off of $XXXX, about a week later he calls me the day before the first closing date of XXXX XXXX because he had me pay off the wrong credit card. So we sat on the phone with the credit bureau going over what needed to be done for about an hour. They said well when you did the probability on the credit you had them paying off this card but in turn had them pay off that card. So I had to go to the atm pull money off the paid off card and pay off the other card. So this pushed our closing date back for another few weeks. After about the 3rd time we signed an extension and my landlord kept hounding us on moving, I talked with XXXX and he said, " let me call and talk to the seller about an early move in." This was on XXXX XXXX, he then calls me back and says, " you can move your things into the garage." I told him, that all our things will not fit into the garage. So I said, can you call him back and ask him since it is only for the weekend because we were supposed to close on the XXXX of XXXX if he cared if we just occupied the home. He said, "you know what it is only for the weekend I don't think it's a problem but I will talk to him. Which he obviously never did. Otherwise when the roof started pouring water over the weekend I texted the realtor pictures of all the water sitting in the floor and dripping down the walls.I then learned that no one but XXXX knew we were occupying the home. She said, "I have to tell the seller otherwise I can get in trouble. So she did and he said thats fine but he wanted $XXXX a day for rent, so we agreed to that due to the fact and only the fact that we were closing in a few days. Well now here we are XXXX XXXX and owing $XXXX. He then had me go to the bank to get statements which is 30 mins from my work and an hour and a half from my home. I sat there for 45 mins going over numbers with him and the clerk. He told me he needed an email address from the clerk so he could email them a document to sign. So then he tells me well I need you to transfer this amount of money and then take this amount out of your account to make it this number. I did so. A few days later the bank calls me and said they never recieved an email to sign. I called XXXX to check and he told me "Ya well we don't need that, I found a loop hole so we don't have to use that." XXXX has had me send numerous documents many of times and sometimes didn't need them. There has been so many days where XXXX and I have tried to reach XXXX to find out what was going on, if we were closing, any new news and most the time we never got anything back until push came to shove. He never told me at the beginning that they needed my tax transcripts when I got my husbands two weeks ago at the end of the loan. I had to drive to XXXX to get them. He has told me on numerous ocassions not to bring any money to the table at closing because he doesn't think the seller is that worried about it. He has had me sit on the phone with people like the irs, credit bureau, and the underwriter so many times for absolutely no reason. He and his father share the same name and to verify that my husband didn't have ownership of his fathers property XXXX had my husband write a letter stating that and sign it. Then on XXXX XXXX we were asked by XXXX and XXXX for a copy of his fathers drivers license to prove they were two different people. Now we were due to close this friday on the XXXX and because XXXX failed to get the file in in time we can not close until Monday now, which incurs more money owed to the seller. Not to mention that XXXX has been transferred from this firm at success in XXXX and transferred to the Georgia branch because he has messed up three others files. So in turn success mortgage put another lender in charge of our file but also left XXXX on the file to continue to mess it up. This mortgage companies name is success mortgage

From XXXX to XX/XX/XXXX, my wife and I worked with the XXXX XXXX XXXX to close on a house, which I currently resided in. From XXXX to XX/XX/XXXX, my wife and I worked closely with our XXXX XXXX XXXX agent, who worked at the XXXX XXXX XXXX. During this time, I sent multiple paystubs, applications, and documents ( to include my VA XXXX Letter ) to our XXXX XXXX XXXX agent. Unfortunately, we found out through our XXXX XXXX XXXX agent that she was fired sometime between XX/XX/XXXX and XX/XX/XXXX. Because of this, the owner of the XXXX XXXX XXXX ( NMLS # XXXX ) took over to assist us in closing on our future home throughout the month of XXXX, XXXX. Since the owner of the XXXX XXXX XXXX took over, we had to resubmit ALL of our documents to the owner of the XXXX XXXX XXXX via email and seemed like he was confused on the appraisal of the house. In order to ensure that the house appraisal was correct, my wife had to recruit the assistance of our realtor to provide the accurate home appraisal. I had multiple conversations with the owner of the XXXX XXXX XXXX to clarify my VA Rating being XXXX %, not XXXX %. The closing of our home was postponed and rescheduled two different times. Finally, my wife and I closed on our home on XX/XX/XXXX. In XXXX of XXXX, I received a letter from my current mortgage company, XXXX XXXX ( XXXX. XXXX XXXX, XXXX, TX XXXX ), that I have an Escrow Shortage of approximately {$7700.00}. Sadly, XXXX XXXX only provided me 1 week notice that my mortgage payment increased from {$1300.00} to {$2000.00}. After multiple attempts, XXXX XXXX was only able to provide a 3 year payment plan that decreased the {$2000.00} payment to now a payment of {$1900.00}. I also called the XXXX Tax Appraisal Office to figure out what happened. After discussing my issues with my agent, she explained that apparently when my house was being closed on, the original lender ( XXXX XXXX XXXX ) was using the wrong appraisal information. The agent also mentioned that my VA XXXX was wrongly inputted as XXXX %. I explained to her that I was rated at XXXX %. In the county of XXXX, veterans rated at XXXX % have no property taxes. Veterans who are rated between XXXX %, get a discount on property taxes. Because of this discrepancy, I now have an escrow tax shortage of {$6000.00} and an insurance shortage of {$1700.00}. All of this could of been paid off if my original lender ( XXXX XXXX XXXX ) used the correct home appraisal information and used the correct VA XXXX Rating. Throughout this process, my family and I have incurred late fees and extra mortgage costs due to the XXXX XXXX XXXX mistakes.

On XX/XX/2020 I started the pre approval process on a Mortgage loan with a company called Success Mortgage Partners Inc. based in XXXX, Florida. They came recommended by the Realty agent I've been working with. On XX/XX/2020 I was pre-approved for a Mortgage loan up to {$270000.00} and so I then proceeded to find a property that suited the needs of me and my family. Me and my wife are currently XXXX our XXXX child XXXX in XXXX and we have XXXX XXXX year old boy as well. Naturally, we needed more space and thus had the need to acquire a property ( We currently rent ). We eventually found the right house for us under our budget at {$240000.00} and put in an offer which was countered and we accepted. After that, I continued the loan process with " Success Mortgage Partners '' providing documents, Signing the contract at a specific interest rate Paying the Escrow deposit to the title company, Having the house inspected etc. Everything seemed to be going well. When we got to the final stage of said process which is Underwriting, there were certain conditions that needed to be met which meant submitting additional documents which we were glad to provide. On XX/XX/XXXX, we were notified by phone call and email that all conditions were met and we were clear to close on the property. Me and my couldn't have been more excited being first time home owners and all. Our closing date had been scheduled ultimately for XX/XX/XXXX but we were trying for an early closing taking into consideration all that has been going on in the world so we were notified on the XXXX that we would be closing on Tuesday XX/XX/2020. Today XX/XX/XXXX, I received a phone call early morning from our lender at Success Mortgage that we were not going to be able to close and that the company had decided to pull the loan with no clear reason other than that the market had changed over the weekend and they were not able to sustain the loan. I find this completely unethical, unprofessional and unjust from their part. Even if I as a buyer were the one to pull out of the deal, there would've been repercussions and penalties I'm sure so I'm hoping there are some as well in place for them in order to protect people like me as a consumer. I am left in a complete state of uncertainty with my XXXX year old, and XXXX wife and possibly no place to live in a few weeks since i gave my landlord my final noticed the day I got my closing notice. Is there anything that can be done regarding this injustice?

Success Mortgage Partners has been deceptive and dishonest throughout the entire lending process. We started working with them in XXXX of XXXX and was supposed to close on the home XX/XX/XXXX. The Loan Officer ( XXXX XXXX XXXX out of Michigan ) asked if we could extend the closing until XX/XX/XXXX to allow more time to gather what was needed. They have repeatedly lied about the file being in underwriting, being approved and being sent to XXXX. I've had to repeatedly send them the same documents over ahd over because they keep losing what was sent. We learned on XX/XX/XXXX by the Account Executive that the loan officer working on the file is not experienced with XXXX which has only further delayed the process. They fail to answer calls or emails. I am at risk of losing {$500.00} earnest money if the file does not close by XX/XX/XXXX which was the agreement to extend the loan based on what we were promised by Success Mortgage. I will also lose the {$500.00} I paid for the appraisal to this lender as well as {$220.00} spent for the home inspection and {$35.00} spent on a termite inspection. I do not have credit issues and can not understand what is going on with this company and their inability to close a loan in 30 days. It is very disheartening to experience dishonesty when working with lenders/mortgage companies. This company should be investigated.

We were in the process of selling our home and purchasing a new home. We were set to close on XX/XX/XXXX. The mortgage broker, Success Mortgage Partners , Inc., already gave us final loan approval. The property appraised over purchase price. We had the home " tied-down '' to code to qualify for the conventional loan. The tie-down cost us {$2900.00}, plus the engineer report at {$350.00}. The mortgage broker called us today to inform us that because we were purchasing a manufactured home, the " investors '' were no longer going to honor the loan. They completely backed out of our agreement and we are now left to find another lender with closing scheduled on XX/XX/XXXX. We have to move out of our current home by XX/XX/XXXX. Because of the mortgage broker 's decision to breach the agreement between us and them, we now do not have a lender and if we do not get another loan, we will not have a home as of XX/XX/XXXX. After speaking to the mortgage broker 's legal department, we were informed that they would not release to us the name or entity that was the " investor. '' They refused to supply us with the contract between them ( broker ) and the " investor. '' They also did not tell us under what legal authority their decision was grounded upon.

Success Mortgage Partners Inc. - Predatory Lender. I started my VA Loan in XX/XX/XXXX with Success Mortgage Partners. Loan was sold to XXXX Mortgage Co, and I applied for a forbearance with XXXX and was approved in XX/XX/XXXX due to some health issues etc. Mortgage was repurchased by Success Mortgage Partners in XXXX. Success Mortgage Partners refused to honor the forbearance and demanded immediate payment. They have called numerous times demanding payment, or they would foreclose. During this whole time, I have only received 2 mortgage statements ( XX/XX/XXXX and XX/XX/XXXX ). I thought it was federal law that a mortgage company had to provide statements and notices monthly. The one statement in XX/XX/XXXX showed NO Overdue amount. Then they called me at the beginning of XX/XX/XXXX threatening foreclosure again. I never receive any notices, it's always a phone call. They also never verify my identity when I call them. All you need is the loan number, and they divulge personal information without hesitation. They have also refused to pay my Homeowners insurance which was sent to them in XX/XX/XXXX and due to expire XX/XX/XXXX. Please Help. XXXX XXXX American Veteran

My wife is shopping for home loan pre-approval and provided information to XXXX XXXX NMLS ID # XXXX ( XXXX ) XXXX XXXX and provided my S.S. Number which she copied incorrectly. XXXX took it upon herself to pull my credit via other means as she did t have to correct XXXX number. We had been shopping for a lender and chose three separate companies to get a quote from. We had a " local lender '', XXXX XXXX, who quoted us. We decided to not go with her as our loan originator and chose another company as she couldn't match the rates provided by the others. XXXX proceeded to contact the seller and told them we weren't using her as a loan officer, which she had not right to do. She attempted to jeopardize our pending home purchase out of spite. The actions taken were unprofessional and likely illegal.
