To Whom It Concerns, In XXXX of XXXX, I received a letter from XXXX XXXX XXXX, PA, located XXXX XXXX. XXXX, FL XXXX attempting to collect a private student loan debt. The last payment on that debt happened on XX/XX/XXXX. It's been in default, which I'm not proud of, and I've never been sued on it prior, nor have I made any payment or payment arrangements since the last payment in XXXX. I made this very clear to the law firm, XXXX XXXX XXXX, PA, who is representing Student Loan Solutions LLC. They claim the statute has not expired and then proceeded to file a complaint on XX/XX/XXXX, in XXXX XXXX XXXX XXXX XXXX. I have since been served, on XX/XX/XXXX. In the lawsuit, they provided, as the first exhibit, the original promissory note I signed back in XXXX ; however, the lawsuit is for much less than the ending balance of what was due when payments stopped. In the lawsuit, which is obviously time barred, they didn't provide a payment history ( which I actually have ), they didn't provide any proof that the plaintiff owns the debt, and they made false statements. They are clearly filing illegal lawsuits and taking advantage of people, and they will, no doubt, win default judgments from the many folks who don't know the law and/or ignore the lawsuits. Furthermore, I believe they are in collusion, with the many defense attorneys, who keep on soliciting me for their services against the lawsuit. The defense attorneys I spoke to, through consultation, have advised me to settle, rather than fight and/or motion for dismissal, on a debt that is clearly time barred and weak, even if it wasn't time barred. These people are breaking the law and this needs to be corrected before too many people suffer unjustly. Sincerely, XXXX XXXX

I had a private education loan from XXXX XXXX XXXX, I took the loan out in XXXX. I was able to keep up with the loan for several years but with a job loss I got behind. The debt ended up getting charged off and fell off my credit report around XXXX. In XXXX I relocated for work from XXXX XXXX to XXXX Florida in XXXX. XXXX I was sued by XXXX and XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX, representing Student Loan Solutions LLC. They stated, XXXX XXXX XXXX assigned their interest in agreement to Student Loan Solutions in XXXX. They had one attempt to collect the debt XX/XX/XXXX they sent a collection notice to my address in XXXX, XXXX months after I moved. The collection notice is from XXXX And XXXX... Which I will add is owned by XXXX of the board members at student loan solutions. Here is my case information https : //hover.hillsclerk.com/html/case/caseSummary.html, if you go to doc XXXX there is an in depth break down of information I was able to put together. Such as proof it was a private loan. A screen shot of Student Loan Solutions own website advising they are not affiliated with any banks that they are an independent company that specializes in the development and administration of documents to assist debtors with the necessary paperwork needed to complete federal student loan consolidation and or forgiveness process. Their company profile is a passive debt buyer. I also was able to find out that all the collection agencies which all have names that read as if attorneys, are all owned by different board members of student loan solutions. The attorney is filing a suit a month every month against people, since XXXX. I have attached a copy of my filing to the court.

Student loan solutions LLC bought a portfolio of time barred debt from XXXX XXXX XXXXXXXX in XXXX. Most all of the loans they bought were from XXXX and XXXX. They are now suing the borrows in court over debt from 10+ yrs ago trying to get default judgements. In all the states they are suing on time barred debts. I had a loan with XXXX XXXX XXXX in XXXX. It was charged off in XXXX and my last payment was in XXXX. I receive a letter from XXXX XXXX XXXX XXXX XXXX out of XXXX KS in XX/XX/XXXX saying I owed {$6000.00}. I sent them a letter saying I contested it and wanted more information. They sent me a notorized letter from Student loan solutions stating the amount due, the date of the charge off ( XXXX ) and my last payment ( XXXX ). It also included the bill of sale from XXXX XXXX XXXX with no identifying information that they bought my loan but was dated XXXX. There was a affidavit from student loan solutions saying the terms of my loan and that XXXX XXXX XXXXXXXX often sells these loans. Again no identifying information. Copies of the original note. I received a court summons on XX/XX/XXXX that Student loan Solutions was suing me for the amount owed and I had 14 days to reply to the summons and a court date of XX/XX/XXXX. I hired an attorney as its a violation of the FDCPA yet they are being allowed to do it all over the country. Its against the Fair Debt Collection Practices Act for a debt collector to sue me for a time-barred debt and a violation of my consumer rights.
