On XX/XX/2020, the process server hired by collection agency Stokes & Wolf, PC went to my previous home address where they encountered my former landlord. The process server stated he worked for the feds and handed my former landlord a stack of papers regarding a collection account in my name. My landlord told the process server I no longer reside at that location. The process server laughed and walked away leaving the papers with my former landlord. I have not lived at said location in over a year which can be proven by my current drivers license and vehicle registration information. I recently disputed this charge on my credit. I never signed a lease nor moved into unit in question. I believe this is an attempt to bully me into paying a debt not legally mine. Stokes & Wolf, PC has violated 15 U.S. Code 1692c. As such, I will pursuing further legal action. 15 U.S. Code 1692c Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

In XXXX I was served for collection on a repossession. The debt was charged-off and sold to XXXX, XXXX. I went to court, and worked out a payment arrangement with the creditor 's attorney ( Stokes & Wolf , P.C . ), so a judgement wasn't granted or entered in the court. I was paying on the payment plan for several months until I defaulted in XX/XX/XXXX. The creditor 's attorney sent me a letter, appearing as if it was responding to a judgement. The letter is on the county court format, and states " Notice to Judgement Debtor Pursuant To Section 24-33.5-704.3, C.R.S. '' The form is dated XX/XX/XXXX, but it states " This form is applicable until XX/XX/XXXX, unless extended by the Administrator to a date not later than XXXX, XXXX, XXXX '' I feel like the creditor is trying to intimidate me, or scare me into thinking that a judgment has been issued, but I contacted the county court and they have no record of the case number. Additionally, I did a statewide public record search, and checked my credit reports, and there aren't any judgements in my name.

I had an arrangement with XXXX I lost my job and then they did not contact me nor did they try to work with me. I than I had contacted them nurmous times to try to make an arrangement they would put me on hold and they would not work with me. They sent me to collection agency which I found out in XX/XX/31 that an office was going to my mailing address and my former employer. I had not had any type of correspondence from either of the companies now I have added interest and legal fees that I don't feel I should have pay if I had no correspondence from them. I feel like this is unfair and they are using gray areas of the laws to charge the anomus fees to the consumer.

On XX/XX/XXXX Stokes & Wolf PC sent me a letter to settle the Collection for {$2300.00}, which is the Original Amount. I had until XX/XX/XXXX to pay the Account in Full. The Account was paid in Full XX/XX/XXXX. I Received the Letter stating Paid in full. ***NOW***XXXX XXXX who had the Account, will not change the Balance to XXXX and Paid I Full. When I asked they said to Call Stokes and Wolf said I have the Letter and they should change the Balance to XXXX. Called XXXX XXXX XXXX and they said FLAT OUT NO.

Stokes & Wolf , P.C . mailed a collection notice to friend who resides at a different address dated XX/XX/2022. This is not consistent with the practice of not contacting parties who were not listed on the collection notice in an effort to collect a debt.
