I submitted XXXX open complaint about sterling so for my education I sent sterling my XXXX XXXX and I sent it to XXXX the client that assigned sterling to do the background check.
XXXX had my bacholer degree for full XXXX months once i spoke with XXXX from sterling he yells and said if he adds my XXXX XXXX to the background check the others wont get the jobs and its not fair so its about the other who wont get my job and i dont matter XXXX my background with a lie to reach such goal.
yet he added the reason i got rejected also becuase of criminal background too and once i told him look at the criminal background check it says clear there is no criminal, and i had him to look it was i had to double him on that.
so yes check this guy from sterling i dont wish him to loose his job the way i did for the others too.its like he need to not sacrify me for the others nor himself yes its tiny fix that he doesnt mind to it as he said, instead have XXXX knows how to reject consultants without lying on their background check.
so summary on : if you look at the attached pre adversterling document .it started my background check XXXX while the job offer and documents submitted on XX/XX/XXXX its like do they try to hide a month by not paying attention to the difference between XX/XX/XXXX and XX/XX/XXXX.
So sterling did my background check in days and if you look at each request it didnt take XXXX days to come back with clear results.
but the hiring XXXX of XXXX that requested the background check who already got my XXXX XXXX for XXXX months, told me she wont clear my background check, where she went and checked education reasons, as i understood she does that as habit and im not the only person she did this to them she wants to find something in order not to clear the background check so she choose the education.
this Hiring XXXX have friends cover her all the time while none telling her what are the rules and procedures for her learn them so she repeat lie on the background checks where us as individuals had to complain and spend months on these complaints where if this Hiring mangers learned them she save our time and her friends time.

so the second problem sterling asked and emailed XXXX to add request to add my XXXX XXXX to the background check while XXXX have my XXXX XXXX. and sterling also got copy of my XXXX XXXX and they refuse to add it to my background check the guy who i spoke to from sterling yelled it mean he knows i have XXXX XXXX already highly he is the XXXX who removed it.
sterling refuse to add my background check my bachelor while they have it and they dont to pick and choose what they want .please have sterling add my XXXX XXXX to my education, sterling tuff lady knows that the people who took my position all with bachelor degrees, they all just have XXXX XXXX becuase sterling did their background check, but yet they saw that and they fine with that and their employee yells if he update and add my XXXX XXXX all these XXXX employee wont get my job, its XXXX biased and hate and lies in the background check yet he yells.

sterling works on XXXX on strong relation ship, check the owner of sterling website its very close to XXXX name it was ican. ( rhyming ) so yes intentionally sterling dropped my education, the guy from sterling asked me to add my employers from my past employment history, where i replied add my XXXX XXXX, but he is the same one who yells if i add your XXXX XXXX the others would loose and wont get my job offer ( meaning the ones who XXXX choose will loose my position because they were my replacement he feels angry to degree he yelled ) its like he lied on my background check and yet he yells.
so please sterling cant just pick and choose what they want to cite for my education i already submitted my bachelor couple of times before the background started and yet i have emails before the background started to add my XXXX XXXX and i got confirmed on such request from XXXX from XXXX in his replied email.
so yes my education cost me XXXX years as XXXX XXXX XXXX long hours and long nights and XXXX XXXX and XXXX masters and yet they want me not to say word master and yet they dont want to add world XXXX and yet they dont want to pay my rent and yet i dont want that job but i want my background report to reflect that my education is not the reason behind XXXX reject to give me the offer.
the way it was so easy for sterling to do my background check in XXXX days.
where sterling background check will pop out in same speed with i got rejected for lack of education.
and yet I want XXXX and sterling not to say criminal record too becuase my record is clear and for them not cite XXXX XXXX becuase once i got interviewed the interviewer knew XXXX not XXXX..
its like i had XXXX security clearance that why it was easy to get my background check in XXXX days becuase it was already in the computer system.
so again they have my XXXX XXXX and the guy i spoke to who i belive is the XXXX who did my background check same guy who yelled if he add my XXXX XXXX others wont get chance in my job offer need to add my XXXX XXXX.

There is information that on my consumer report that is a result of identity theft. I did not provide written permission of instructions for the identified transactions to be reported on my consumer report. back ground check complaint against sterling so they created PRE-ADVERSE ACTION NOTIFICATION which states i dont have education and being denied employment because i dont have education where i have emailed from XXXX confirming that they submitted my XXXX XXXX to the background check they included my XXXX XXXX to the background check, which XXXX sat on my XXXX XXXX for more than two months where sterling got my XXXX XXXX before they produced the background check because i spoke with the guy who did my background check who said adding my XXXX XXXX to this background check takes him a minute but if he adds my XXXX XXXX, the person who took my job offer and replaced me will loose his chance in my job offer.its like this guy screamed as its ok to lie on my background check for this person to be able to replace me and yank the job offer.

I would like to file a official complaint against Sterling ( A company that conducts background checks ).
In regards to my background check that was conducted by their organisation. I wrote a letter along with my official dispute / complaint case number. I provided evidence along with my request ; that the alerts found on my record stating the offense description of ( XXXX XXXX XXXX ). Be removed from my background check conducted by Sterling. The prosecutor in my case declined to prosecute me ; because there was no credible evidence against me and the judge ruled in my favor. Rendering a judgement of XXXX XXXX.
I took the initiative to pay for myself, and obtain from my local police department of XXXX, Georgia on XX/XX/2020. The evidence that clearly shows that I have a clean criminal record with no charges ever brought up against me.
The issue that was disturbing to me about this company and their employees ; and made me compelled to take this complaint to another level is ... the way they handled my dispute. Every representative of this company that I spoke with clearly did not want to listen to me or take my complaint seriously.
They all told me that it was pointless for me to file a complaint without proof of a expungement from my local courthouse of XXXX County Georgia. Without even giving me the opportunity to present my evidence they had already made up in their mind that they were not going to grant me ; any type of service or removal off of my record. Without even seeing my evidence. Which was very unprofessional to me. The laws that are governed by this country of the United States ; everybody is due their day in court or the opportunity to present their case.
I was contacted by a representative of their company on XX/XX/2020. I can tell by her demeanor that she really just called me just ... to say she followed up and did her job and tell me the company was not going to listen to my side of the story and be fair about the situation. The only reason she gave me two or three minutes to plead my case is to say that she was courteous. I explained to her that I had evidence to submit in my case and I will be faxing that evidence over to her the same day that she called.
She again disregarded everything that I told her and stated she will send me an email, with her contact information. I could forward my expungement paperwork from the XXXX County courthouse. When ever they decide that it is safe for them to open back up. We all know this world and country are in a pandemic and there is no guarantee of an exact date of the government courthouses opening up.
She stated herself to me on that phone call ... that she called and saw for herself that the courthouse was closed until father notice.

On XX/XX/XXXX, I agreed to have a background check with Sterling Talent Solution. This was a requirement as I just got hired with XXXX XXXX. At XXXX, I received an email confirming that my background check was complete. Under DOJ XXXX XXXX XXXX, my result was XXXX XXXX. According to the New York XXXX XXXX XXXX XXXX XXXX XXXX, a Level XXXX XXXX XXXX is someone who is an offender that is at low risk of repeating the offense.
After I found this out, I immediately called the company asking to dispute the claim. I have never been accused, convicted, or gone to court for anything of this matter. They said there was nothing that I could do because the report was done. After that call, I made numerous calls to see if this report had any actual truth.
After speaking with the Department of Justice XXXX XXXX XXXX, they told me that I am not and never have been on their registry. They furthermore explained to me that two errors could have occurred. One : The information was entered incorrectly. XXXXwo : There was an error in the footnotes. They directed me towards the XXXX XXXX XXXX registry to prove to them that I was not on the database.
I called Sterling Talent Solution again and emailed the documentation that displayed that I was not on the XXXX XXXX XXXX and had the confirmation confirmed by the Department of Justice. They claimed that as the report was already done ; there was still nothing I could do. No editing to my report or second report done.
For this reason, I feel my Fair Credit Reporting Act rights has been violated. After closely examining my background check, it confirmed that my rights was guaranteed by FCRA. More specifically, the right to dispute and correct inaccurate information, and their legal responsibility to investigate claims made against my report. They have been negligent and refuse to investigate the claim made against me even though I have provided sufficient proof.
Today, XX/XX/XXXX, they claimed that no error was made on my report in an email. They said that the XXXX XXXX was meaningless, but no employee told me that after the numerous calls I had with them. I feel the only reason they said that is I said I was talking with my legal counseling to see what my options were. My job that I beat dozens of candidates to get is now being called into question over this. I am upset that they could care less that a faulty report is costing me an amazing job.

The issue is at this point I can not get a copy of my report, even though it was requested. The report was completed today XX/XX/2023 ( which I don't understand how because I just completed the drug screening yesterday and that is supposed to be in the report as well. ) When I log into the XXXX XXXX, the background report is there. When I click on it says " retrieval error, '' and does not open- so I have no access to the report.
Now prior to this, XXXX did not send me the information for the background check or the drug screen after I was pushed through by the company to move forward.
I reached out to the company and was told I did not respond to their email and they have confirmation they sent the email. I advised the XXXX that is incorrect. I had to call Sterling several times ( about XXXX or so ), Sterling even told me that the person at XXXX probably did not know the correct info or didn't know where to look or something to that effect- not exact words, so I told the XXXX and she says she does have access and they told them I did not respond. When I called back, the XXXX rep said they had not received anything from the company I applied with for me to have a background check or drug screen which is because they probably made an error in registering me. So the company XXXX told me to call the hotline for help with their company and I left a message, but I called XXXX back. I received a voicemail ( which was transcribed in my phone ) from XXXX admitting they did not send it because she could not find it in the system that they sent it. They need to tell the company I applied with they made this horrible mistake because I could have lost out on this position due to their errors and it makes me look distrustful.
Currently, where I am, I can not get a copy of my background report and no one there is telling me why it gives me a retrieval error. I called and talked to about XXXX people and then I asked XXXX for a supervisor and he transferred me to someone I spoke to earlier, XXXX, and he was not a supervisor. I don't appreciate this. I am currently waiting for XXXX whom I was told is a supervisor. XXXX transferred me to XXXX, who told me I should get the report today even though I told him the email said XXXX hours. XXXX said the drug screen was on it as well.
At this point I am waiting to see the background so that I can make sure there were no other mistakes made.

I am submitting a complaint in regards to a background check performed by Sterling Infosystems. I had recently applied for employement with XXXX for a warehouse job in thier XXXX California location. Staff Management/XXXX is the contracted company used for hiring process. I qualified for every step in the process until the background check. Sterling Infosystems is also contracted to do the background check. I recieved an email and regular mail copy of the background check and the " Notice of Adverse Action '', disqualifying me for employement. The " Criminal Background Check '' information was correct. The problem was that this information was not only misinterperated but due to the in ability to read and understand the court doc info the agency or Staffing company both tagged the information as " High Risk ''. The court dcoument were transcribed, are not an Official Signed copy of the original court docs. Sterling Infosystems claims that there are XXXX ( XXXX ) seperate charges of a XXXX ( c ) XXXX, that is incorrect. The information shows XXXX Docket/case numbers which represent " Transfer of Juricdiction '' from XXXX California to XXXX California. This is due to my moving to another county. The Incidents are the same within 1 day, again typo error. In the " Additional Information '' field you see the transfer to XXXX XXXX but is the same case/charge. Both Sterling Infosystem and StaffManagement XXXX were made aware of this problem vis a phone call using XXXX XXXX of Staff Management and XXXX from Sterling Infosytems on Thursday XXXX XXXX. I have not had any further contacts with Sterling or XXXX regarding this issue. I am troubled that the background check company was neglegent/incompitent in reading the court document and risking my employment with XXXX. Once again the information on criminal background check is correct but was not interpreted correctly by said professionals. I want this claim investigated and all parties made responsiable for this crime in it self, fraud claims, to correct thier said expert positions in background checks. Same goes for Staffing ManagementXXXX, they too did the same or may seek damages for violations to FCRA.

On XXXX XXXX, 2016, I responded to an online ad for a XXXX position for XXXX XXXX XXXX XXXX disclosed online, their background requirements and the process for securing a job. Their background check screening goes up to 7 years so I applied for the position. Later, I learned that XXXX XXXX background check requirements was misleading when I received a copy of my background report from Sterling XXXX XXXX the " Background Screening Service '' where my background check revealed that a 7 plus year background screening was performed on me which, I was not aware of nor did I authorize XXXX XXXX or Sterling XXXX to do.
On XXXX XXXX, 2016, after I received my report from XXXX XXXX. I immediately requested that Sterling XXXX investigate the errors on my report and demanded to know why their company disclosed information to XXXX XXXX that was more than several years old. I believe Sterling XXXX clearly knew what they were reporting and how far back that they were reporting this information to XXXX XXXX. I believe that they deliberately distorted and lied about my clean motor vehicle record and there were a couple of dismissed cases on my report that were more than 15 years old, that Sterling XXXX XXXX reported to the employer. On XXXX XXXX, 2016 I received an email from Sterling XXXX Representative " XXXX '' stating that she completed the investigation and that she sent me a copy of my report but, I have yet to receive it.
Even if, Sterling XXXX send me this report, the damages have already been done. XXXX XXXX sent me a new email on XXXX XXXX, 2016 with a second and final decision not to hire me. I believe that Sterling XXXX is at fault for this and for violating the Fair Credit Act. I feel that I have a right to sue for damages in the state or federal courts and I need to know how to proceed in this case.
I am going to attach a copy of the email I wrote to Sterling XXXX CEO XXXX XXXX and XXXX XXXX. Representatives in regards to my complaint against both companies and I 've attached a copy of the background check that was emailed to me by XXXX XXXX including an online link to XXXX XXXX background check requirements. XXXX XXXX XXXX was contracted by a prospective employer to perform my background check. I provided contact information for my prior employer XXXX and a contact name and number, they failed to contact the company and or the direct manager contact I provided. They completed the background check, and they submitted the background report to my prospective employer and indicated my time and service length was in accurate. They put down that I worked at XXXX for 1 year and 8 months, simply because they were lazy and did not want to do the requisite call into HR at XXXX and or my contact to verify my complete length of employment. I worked at XXXX for 1 year and 9 months as a XXXX and 1 1/2 years as a XXXX XXXX. Instead of XXXX XXXX XXXX doing the legal work they are supposed to by law, they decide to skate their professional responsibilities and submit a non-accurate employment timeline at XXXX to my prospective employer. The report indicates a consider on this employment verification, when they should have called HR or my contact which would have provided the accurate timeline which I put down in the initial background check and would have closed this employment verification as complete. FCRA and federal regulations require XXXX XXXX XXXX to meticulously VERIFY before submitting to client. In this case, they not only didn't call to verify - choosing instead to type into an automated system, but they never called after the data mismatch to properly and meticulously confirm with a Human being, HR rep or my point of contact at the company. They instead submitted the inaccurate information in the completed report to my prospective employer and put CONSIDER on the results which is 100 % not accurate and reflects my submission in a negative light to the prospective employer. XXXX XXXX XXXX has a long record of inaccurate reporting, they have had numerous lawsuits, class actions lawsuits, FCRA violations etc. I am reporting them for this and I am also filing an FCRA complaint forth with. They have tarnished my reputation, defamed my reputation and have caused undue harm and stress with this mistake.

I was hired through XXXX to work at XXXX in XXXX, TN. When XXXX asked me to convert to a full-time XXXX employee XXXX I accepted and started the on-boarding process. Sterling Infosystems conducted my background check. The XXXX XXXX, TN courts reported to Sterling that I plead guilty for a wrongful arrest the Sheriff 's Office conducted on XXXX. This XXXX employment manipulation by Sterling Infosystems, XXXX, XXXX, and the XXXX XXXX courts has resulted in 10+ years of unemployment with 8+ years of homelessness. And the extortion continues despite my constant reporting to federal authorities such as the XXXX XXXX field office and TN XXXX headquarters in XXXX. To continue the coverup, a XXXX XXXX, TN Sheriff 's Deputy has been murdered, XXXX XXXX. I sent XXXX an email containing incriminating information about an arsonist that was involved in the intellectual property theft that moved into her county. In less than a month, she was murdered and her house was set on fire twice. XXXX XXXX has been arrested for the murder. But like my wrongful arrest, I strongly suspect XXXX is being framed. This is what happens when the Republican Party takes over a growing small town. The small town corruption grows too. I have applied for a company called XXXX and was offered a job, contingent on the results of a background check. I then agreed to said background check and have been waiting for the results. I got them today and there is a lot of information on it that is incorrect, belongs to someone else, or is not even my name. I want the background check corrected, and I want the employer to know that there was an error from the party they have doing their checks.
I am no angel, and some of the information on the report is in fact mine, however, I have passed checks before with this on my record for the same line of work. Charges from XXXX, XXXX, XXXX, XXXX, and any from XXXX are mine and I do take responsibility. However that is not all that is listed.
First off, I am NOT a XXXX XXXX This report has me as a XXXX XXXX out of XXXX. Second, I DO NOT know who XXXX XXXX is, nor do I think his background should be included with my report at all. Third, I am going to lose the opportunity to work for this company because of the errors that this service provider has so graciously given them a background report with false information- that is very sensitive to the role I applied for. I have never had to file a complaint for a background check before, but this company, Sterling, has done a BANG UP job of the work they are paid to do. Not only that, but the information that they verified my education with, came from me. They emailed me asking for verification of the education. Correct me if I am wrong, but that is the job that they are hired to do! Verify the background of the individuals that XXXX has asked them to, and I am pretty sure that verification is not simply asking the potential employee if this is accurate. I opened an issue before and got an email you were not able to send complaint to the company for a response ( XXXX ). Not sure if I filled it out wrong or did not provide enough info. I will add more now.
The background check company Sterling ( Sterling Infosystems, XXXX XXXX, XXXX XXXXt, XXXX XXXX, XXXX XXXX XXXX ) ran a background check and provided to a company that I did not authorize. It seems Sterling operates under multiple names ( see above ) so it is difficult to find who to talk to.
My employer ( XXXX XXXX XXXX ) told me I had to fill out a Sterling form online, but when the consent box popped up there was no way to say no, it asked for my name to be typed in so I just put 'no ' that I did not consent. XXXX is saying their system just assumes everyone consents and they in no way need to have written consent, just being on their site implies consent. In summary I did not provide written consent.
Also the disclosure forms were confusing the name of the company requesting the report was not one name but two companies " XXXX XXXX XXXX '' was the name on the disclosure. I am a current employee of XXXX XXXX XXXX, but I assumed the check was only for XXXX, which is who I thought requested it and that XXXX would not get or take actions against me because of the report. I work for XXXX, but was told to fill out the background check to be a XXXX contractor in a XXXX facility. But it turns out both companies got the report ( as per Sterling ).
Based on the report XXXX is working to revoke my employment.
I have emailed with XXXX XXXX who is the director of Compliance at Sterling email ( XXXX ) phone ( XXXX ext XXXX ), but she is saying no written consent is needed for background checks.

A police officer came to my house because the cab driver filed a report against me. I was not arrested and the police officer said just take him to court so the cab driver did. XX/XX/XXXX Sterling Talent Solutions Did employment background screening.
It was reported on a XXXX report a XXXX XXXX that took place back in XXXX
The Fair Credit reporting act states the report must show the date the crime was committed not the date the case was resolved.
After Explaining this to Sterling an agent -- -- -- -- " said it no longer matters conviction happened employer doesn't want a conviction. '' It is an SEC-regulated company if anyone should be reporting fair and honesty and abiding by what the law stated it should be companies such as these.
Sterling Talent Solutions said they went to the courthouse to get information and I was wrong.
I contacted the courthouse they stated they do not offer this information to 3rd parties.
I have a paper showing my case was a XXXX
Also They created a virtual list of incidents that had to happen but on the side, they wrote clear. Its a form of a virtual background check because the people that work there know The incident happened but since it says " clear '' they feel They are following the law of The Fair Credit Reporting Act.

I want to know what data furnisher provided this information to Sterling Talent Solutions it is my right because it is inaccurate.

I have had a consumer report background check made by Sterling. report number XXXX Candidate code : XXXX It shows a XXXX XXXX. Going back the past seven years and I would like to know where they got this information. They had run back. Background of the previous year. I had disputed it with sterling, and they removed it last year. They had removed it from the report.

They state that their verification method was through name, date of birth, and government ID.
However, I've tried to search for this information myself at the.
Courthouse, and they stated that there is nothing that they had given anyone that matched my ID identification.
They do not provide such information any government identification is redacted from all records.
So if they are reporting based on government identification, how is this possible?
That information is redacted and sealed. Are they getting this information from a cached database? And aged data furniture that is. That is providing them with this information.
Also if someone pays fines and closes a case And do they age re-age? Records and their consumer background checks by the source of when cases are closed or when they are started.

Sterling background checks also known as Sterling Check XXXX Requested official US gov documents namely DD214 to be attached to their portal as a supporting document. Requested from candidates that possess a security clearance in screening process sensitive information and documents such as social security numbers, DD214, W2s, IRS tax returns. When doing so were told by Sterling Background Check employee that the Acting Director of the Department of Defense named XXXX XXXX requested this information. The employee nor the company could tell the candidate/consumer where or how their documents would be stored or how their personal data would be used. The employee also gave false information regarding the method of retrieval of such information. The company is using a foreign call center to process this data and US citizens sensitive data and transmission of gov documents that may or may not contain sensitive personal information protected by the US Gov. As part of such checks Sterling is also collecting personal health information that must be protected under HIPPA. I was also told that the XXXX XXXX XXXX XXXX does not do business with Sterling Background checks for which they claim they were contracted to conduct business. Inaccurate reporting by Sterling Background checks may cause significant delay in employment start date and or a risk to employees loss of employment. I have retained correspondence with Sterling Checks and have CC Dept of Homeland Security, CISA, and the Department of Defense.

Around XXXX EST I received a copy of my background check copy as requested.
There were several discrepancies so I called the company.
1. They didn't verify my employment as confirmed when speaking to them via phone however they listed that I provided false information on the report and did not state that they did not verify with my previous employer. The dispute here was in regards to when I worked for an employer. I had someone from their agency prior only ask for verification of a XXXX for the year 2017, not for what the final background report said. I also had supplied them with the employers number. They stated they did not call them. I asked them to correct the statement made to reflect they did not verify my employment with the employer and it was jot because I provided inaccurate information.
2. I noticed there was a name listed as an alias associated with me. Not a variation of my name but a completely different person. I asked for this to be removed and disputed for accuracy and was denied the request and told I would have to pay them to have it removed.
3. The job title for on3 company was listed as employer verified and that I misrepresented my job title. I asked how they verified and they provided the name of an individual that does not work for my employer let alone in their hr. Which means they are verifying infirmation without verifying they are speaking to the employer.

On or about XX/XX/2017, XXXX XXXX XXXX completed an order for XXXX in XXXX XXXX, CA about me. ( Order XXXX XXXX, XXXX XXXX ) In this report were items about me that are outdated, and it being a 'Level 3 ' report, criminal records were disclosed that are more than seven years old plus.
I don't know the scope of 'level 3 ' reports, but this one led to an adverse action taken by the company, XXXX .
I strongly urged the company to remove said records about me, for I am in the process of paying the courts back all of their fines and fees imposed pursuant to statute and orders, pursuing restoration of my civil rights, and have not been a recidivist.
I hold a Level 1 fingerprint card with Arizona Department of Public Safety, and this type of information does not accurately reflect my current activities within the public sector and private.
I will pursue any and all remedies available to me as a consumer including litigation.
Please kindly reply with your response to my request, as this is not the only report that has led to adverse action against me as an applicant.
I take great care of patients, clients, and hold the highest level of clearance this state offers for student doctors, and investigators.
Adverse action was taken by two different employers that included being denied employment solely on the grounds of the existence of this slanderous information.

On XX/XX/XXXX, I paid for a background check on XXXX, which is processed through Sterling Check. The background check was supposed to take only XXXX days. On XX/XX/XXXX, I called Sterling Check to see what the status was and the reason for the delay. I was told to call back on XX/XX/XXXX, which I did. They provided no update except they changed the " estimated '' completion date to XX/XX/XXXX and to call back in XXXX hours to check the status again. I called again on XX/XX/XXXX to check the reason for the delay ; their response referenced that the Kansas Court system is down and they don't know when it will be back up. Based on a news article about a security breach, the Kansas Court system has been down for XXXX weeks and will not be back up until after XX/XX/XXXX- making the background check take more than 3 months. In addition, I do not live in Kansas ; I only landed in Kansas for a few days while I was waiting on my apartment in Missouri. I updated my address with XXXX but XXXX refuses to use my current and permanent address for the background check. I barely stayed in Kansas for a few days. There is no reason for XXXX to be forcing a background check in a state I was only visiting.
With the background check taking an estimated more than 3 months to be completed, I demand a full refund of the fee I paid to rover for the background check.

I am writing a complaint against Sterling located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX, OH XXXX. This company ran a background check for employment with XXXX. Sterling did a background check and reported a XXXX from 20 years ago in the state of Texas. The Texas Business Code Section 20.05 clearly states that XXXX are not to be reported over 7 years of the XXXX. This reporting led to me not receiving this job. Below you will find that section.

I recently was disputing the time in which Sterling is reporting a criminal case on a consumer report. as well as the Method in which they verify.
Sterling responded back stating that there was no database and that they used name date of birth with a former Florida drivers license.
I am requesting to see the verification. XXXX, based on the word of someone isn't verification. Sterling has many cases of inaccurate reporting as well as their methods of verification. I understand it is not entirely their fault due to the overwhelming inquiries how ever, Automation sometimes needs to have a person take the time to look at specific cases.
Please provide proof of the method of verification which was used.
The re-aging of accounts is a Violation of my consumer report.
By law, it does not go by the date of disposition it goes by the date in which it happened.
There are many cases where someone has a debt that was charged off and in collections or paying or communication triggers re-establishment of an account, but that is not the correct procedure. That is considered re-aging of a consumer 's information.

I recently applied for employment with XXXX XXXX in XXXX XXXX, Texas. As part of the application process I submitted to a background investigation. I was later notified that my investigation results had me ineligible for employment by XXXX and that the decision was based on information outlined in the report conducted by Sterling XXXX. The report contains information of a firearm conviction for a XXXX, by comparison my name is XXXX. I have never used an alias, but Sterling XXXX saw fit to utilize aliases using variations of my name and submitted these findings to my prospective employer. I was later notified and informed that my offer of employment had been withdrawn as a result of this erroneous information. To clarify this matter I acquired XXXX separate background investigations, XXXX from the XXXX Bureau of Investigation and the other from the XXXX Sheriffs Department. Neither of these reports contained the lengthy and misleading info found in Sterling XXXX report. I fully believe that the erroneous information regarding firearms convictions resuted in my loss of employment opportunities that would have led to management opportunities with the largest employer in the country.

According to paperwork I received from a neighbor ( The mailing address was wrong, so it didn't come directly to me, and we have many new mail carriers who are unfamiliar with our neighborhood, so I'm guessing they didn't recognize my name ), my job requested a motor vehicle background check on XX/XX/2019 after working for them for over 5 years. I did not sign any documents giving permission for a background check to be done, so this was done without my consent and then provided to my employer, who sent a letter this week, saying they are terminating my employment for a speeding ticket from almost 2 years ago. I need help addressing this matter where illegal action was taken in regards to my personal information, then provided to my employer, resulting in termination. I applied for a XXXX XXXX at XXXX. They did a background check through a company called Sterling Talent Solutions. The report had a traffic ticket that was taken care of in XXXX. All cleared. I went on the XXXX website to update my profile and there was a notice that my account is suspended due to a negative report. I called XXXX and they said to file a complaint, they were no help. When I was sent the report from Sterling Talent Solutions they also gave me a Summary of my rights. It says in one portion of my rights that " Consumer reporting agencies may not report outdated negative information. In most cases, a consumer reporting agency may not report negative information that is more that seven years old, or bankruptcies that are more than 10 years old. '' The incident that they are reporting is over 15 years old. This has impacted my finances as I am looking for work through XXXX. Ive been on at least eight jobs interviews that continues to background check me and lie to me about why they not hiring me and one is XXXX through this background check company called sterling talent solutions who Ive disputed the proper way in correcting what they thought might been or seen as a new XXXX and I have not committed a XXXX since XX/XX/2010 and I explain this to everyone and explain their dates and errors of judgment showing XXXX violations which is not a XXXX and shows 90 days XXXX XXXX a XXXX is over a year and they didnt hire me nor contact me back acts of discrimination against me cause Im on XXXX XXXX from a XXXX XXXX I was XXXX years old.this is blocking me from work anywhere they wont say it but thats what they see cause Im a civil rights activist and I know if you didnt commit a felony in the last 3 to 7 years you should be hired well Im not XXXX twice XXXX XXXX XXXX XXXX XXXX all these companies and I know XXXX has over 50,000 thousand workers with XXXX to judge me with fair chance or any equal opportunities.thank you please help me address this issue and fight back against it.

I'm extremely frustrated with Sterling background check services. I've submitted my details as a result of offer employment on XX/XX/XXXX. I've received a deficiency request on XX/XX/XXXX and I provided them the details on the same day. My date of joining was early XXXX.
Currently, the criminal check is pending from one county in Kansas. The anticipated date of completion of the check was XX/XX/XXXX. However, the completion date ( with escalations ) was pushed back to XX/XX/XXXX, XXXX, XX/XX/XXXX, XX/XX/XXXX and now I have no idea when it is expected to complete. I'm sure a background check should not take 45 days.
I have to call them to find out the dates and all the support representatives say is to wait until the targeted date. When I call them on the said date, they say it is postponed to a future date. All the representatives suggest is for me to ask the company that offered me a job, to let me work without Sterling doing their job of finishing my report.
The financial loss and XXXX that Sterling is causing me is immense. All I ask from them is finish my background check at the earliest.

Sterling Infosystems XXXX, OH XXXX The above company conducted a background check for a potential employer. They reported a forfeiture u violation as a felony to the company. They did not reach out to me prior to publishing these results. An example of a forfeiture u is a speeding ticket so there is a huge difference between these violations and felony.
When I called in to dispute I found out they did not have a phone number on file, a correct address, or an email. I received no opportunity to dispute prior and they published the results to the company before contacting me or providing the report.
They have acknowledged their mistake and said they will file an amended report. However the damage is already done and it is too awkward a situation for me to step into with the company.
They offered no apology during the process and did not seem to understand the severity of their mistake.
I still have not received a copy of the report either the initial one or the amended via email or in the mail.

I applied for employment and was offered a job with XXXX XXXX XXXX XXXX, SC. I was excited to start this career as I have tons of experience that would have helped this company grow. They utilized Sterling Talent Solutions to conduct their background report which I was not at all concerned about. When the results came back, I was appalled to discover that I had a public record from 21 years ago ( I am XXXX now and would have been XXXX when that was reported ) that stated I had written a {$66.00} bad check. This was all handled over half of my life ago and was a huge misunderstanding. I was not given a chance to explain this and was immediately denied employment.
This denial is discriminatory and against the law. The law states that consumer reporting agencies are not to report outdated negative information more than seven years old ( bankruptcy being 10 years which I have never had ) and I did NOT agree to anything being pulled past that date. This should turn into a HUGE legal issue for both Sterling AND XXXX XXXX as I feel like I was unjustly discriminated against.

At the top of the e-mail in bold it said : BACKGROUND SCREENING NOTICE.
XXXX. XX/XX/2019 at XXXX XXXX I receive an e-mail from XXXX writing in reference to the recently reviewed background check report provided by STERLING INFO SYSTEMS INC. XXXX gave me a link where I could review/verify the report.
XXXX after reviewing the report decided to temporarily suspend my account and contact me to confirm the information on the report. XXXX asked me to review the report closely and if after reviewing the report, if I would like to clarify any information to contact Sterling Info Systems Inc.
XXXX continued on by stating that the e-mail constitutes a pre-adverse action notice and a copy of my Rights under the Fair Credit Reporting Act could be found at a link they provided. In addition, WA State laws were made available at a link they provided as well.
This ended the e-mail.

Under the Report published by Sterling regarding my background screening check, there is information about my name appearing in Criminal Records Database. However, the records are not verified and I am not aware of any criminal proceedings against me in the past and I am not aware of any details of the Cases mentioned.
i would like to mention that it is not ethical to put up a record in the report without identifying information about the mentioned case and if such published information is accurate. By reporting false information which is mentioned in the public database without verification creates prejudice and can harm my reputation based on the information presented and not a factual representation of the Fact.

XX/XX/XXXX I was notified by Sterling with an email showing me my background report that was shared with perspective employer. I was alarmed to see that they had shared information dating back from a XXXX XXXX that I was discharged from XXXXXXXX for in XXXX.
When I called and asked them why did they share my complete history when Texas laws protects me from this form of reporting, I was told that the Fair Reporting Act allows them to share my entire credit history.
On the employer application I did not explain anything more than 7 years ago and this impacts my ability to now give an explanation and makes me appear as though I was hiding this. I had a backgound check done for a job, my background was flagged by Sterling Background Checks. This stopped the hiring process for the position I was being considerd for. The only negative information contained in my background check dates back to XX/XX/2009. Under the Fair Credit Reporting Act Consumer reporting agencies may not report outdated negative information. I have contacted Sterling Consumer Reporting Agency twice about this violation of the FCRA and they have been uncooperative to resolve this issue in a timely manner. under Sterlings guidelines I have only 5 days to dispute this issue, which the days are up. They state they made a phone call to verify my information with the XXXX County District Court which is prohibited under the FCRA as 100 % variable and 100 % accurate. I demanded for them to remove the information as I have filed a second dispute under my Federal rights in accordance of the FCRA to them which they should have received by now. XXXX County District court stated to me they do not send verification or gave any information to XXXXXXXX XXXX XXXX. I will exercise my rights for the damages including and up to litigation.
