This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Harassment by Debt Collectors Is Illegal The Fair Debt Collection Practices Act ( FDCPA ) prohibits a number of harassing behaviors used by many unscrupulous debt collectors. The process required a ton of documentation, and I was never told that XXXX Investors would be the creditor. The majority of my payments go toward the astronomical interest. The loan feels like it is designed to skim as much interest as possible before the remaining amount is place toward the principle. I called customer service and asked about an interest rate reduction, '' but all I got was rude treatment informing me that I am obligated in the loan until XXXX ''. After the shock wore off, I filed a better business bureau complaint to ask about the interest reduction again, '' my complaint was never answered ''. I understand the process of Arbitration since I am also a paralegal, and I would like to challenge XXXX investors. My credit score has increased XXXX points, XXXX investors will not even discuss a rate reduction, I am unable to trade my vehicle for a new car due to the interest being charged, and the principle that doesn't seem to go down. Asking about a reduced interest rate doesn't raise any eyebrows, '' so I am considering a voluntary surrender after I get a new vehicle ''. As a consumer I have researched and discovered that there have been multiple reporting violations to not only my privacy but accuracy of information. This has causes hinderance in my daily life as a consumer as I have tried to resolve these reporting issues plenty of time only to receive denial and rejection of every attempt when removing inaccurate items from my credit report. I have attached a letter directed to 3 main financial institutions and 3 main Credit reporting agencies that have hindered my progress as a consumer and created great hardship and mental strain. Please refer to the attached letter for further details of this situation. I have noticed multiple inaccuracies and unfair consumer reporting practices amongst XXXX, XXXX, and XXXX along with XXXX XXXX XXXX XXXX, Stellantis, and XXXX XXXX which are financial institutions that have negatively impacted my credit report. They are in direct violation of the Fair Credit Reporting Act 15 USC 1681 section 602 a which states " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX. XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared this rule is mentioned in 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. " XXXX XXXX XXXX XXXX, Stellantis, and XXXX XXXX are all financial institutions by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. XXXX XXXX XXXX XXXX, Stellantis, and XXXX XXXX, the financial institutions and the Consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX, XXXX XXXX XXXX XXXX, Stellantis, and XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX, Stellantis, and XXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. I, XXXX XXXX XXXX, am opting out of your reporting services. Any and all reports that have previously unlawfully reported must be removed upon notice of this letter.

I recently went to a dealership and was discriminated against, and denied an extension of my credit as the dealership initiated transactions and I was given no benefit, but to be a as precise as possible I will send the letter I sent to them. Explaining precisely what was done. During the time of the transaction at the dealership when the credit extension was initiated, I informed them of my knowledge of the laws and how the consumer credit transaction is supposed to take place and the general manager should clear indication of agreement and then Mocked me out of the dealership refusing to comply and inform the banks of my consumer rights and laws. Purposely he refused to follow through after running my credit. XXXX XXXX, XXXX, XXXX of XXXX. Precisely this is what occurred and also the letter that was sent to them. In Pursuance of 15 usc 1602 L the term credit card was used to initiate a consumer credit transaction. The term credit card means any card, plate, coupon book or other credit devices existing for the purpose of obtaining money, property, labor or services on credit. I am also the cardholder and holder in due course. So in pursuance of 15 usc 1602n I am the one who came in with the credit card to initiate the transaction, it is not possible to get denied with something I came in with. The term adverse action never mentions anything to do with the consumer getting denied credit because it is impossible to get denied in something that Im granting to your corporation, the right to extend credit. So in pursuance of 15 usc 1602 the term credit means the right granted by a creditor to a debtor to defer payments of debt or to incur debt and defer its payments. Credit is my right and Im the one who regularly extends credits in the connection with loans in pursuance of 15 usc 1602G. I am the original creditor and I am well aware of my rights. I know that reporting to the consumer reporting agency is voluntary. This is a private transaction and this an unfavorable situation to me the consumer. No where in the term adverse action defined within the FCRA does it mention that a natural person can be denied credit. So as an original creditor it is not lawful to be denied my right to grant credit, furthermore my credit was used and I received no benefit from the use of my credit. An inquire popped up on my consumer report which is a receipt of the transaction meaning someone got paid off my credit and I received no benefit at all. In fact damages were done to the denial of my rights mentally and financially. As used in section 1643 of the title the means of a credit card by a person other than that, The cardholder who does not have actual implied or apparent authority or such use from the cardholder which receives no benefit. Ive been discriminated against as there are no federal laws that state a credit score can deny me my right to extend credit. Ive, in good faith exercised my right, and I, the natural person, have been discriminated against in pursuance of 15 usc 1691. So it shall be unlawful for any creditor to discriminate against any applicant with respect to any aspect of a credit transaction. For the damages that have been done to my mental distress and financial reputation, as I take my consumer report and life seriously, I will take this to a federal level if my request to open the account in which adverse action has taken place is not met. Im aware of my open end credit plan my right to contract unlimited without being denied. I demand your company reinvestigate this matter, abide by federal law and open up the accounts in which Ive extended credit.

I have repeatedly have tried to contact First Investors AKA Stellantis Financial Services. I am getting no response and no help. I opened my loan with this company in XX/XX/XXXX. I had made all of my payments debit for each month. Nobody at First Investors contacted me until I called in a payment for the month of XXXX to pay via phone ( I usually make my payments online ) and my account showed normal and on time. While on the phone with this operator in XX/XX/XXXX. This operator advised I was multiple months behind on my loan and I advised them that is impossible because everytime I have made my payments the money is debit from my account ( s ). The operator kept telling me that EACH bank I used was putting a " stop '' on the payments. I contacted my bank ( s ) and each bank advised that they were not putting " stop '' on my payments and that the recipient had received the funds. First Investors claimed that they " refunded '' stop payments to me BUT I NEVER received a refund from First Investors. In order to get my money back I had to file disputes ( MULTIPLE ) to get my money back just to deposit it into a different account and repay the money. Which I did. My account appeared current everytime I logged in online which I did almost weekly to keep track. There was no evidence/reason for me to feel that there was anything wrong. I attempted to contact First Investors Compliance Department MULTIPLE times with NO assistance. In order for First Investors to even research and correct their wrongful documentation and negligence I had to report First Investors to your agency ( CFPB ) and the Federal Reserve. The DAY AFTER filing these complaints First Investors looked into my account after I had called and told an operator that I had reported them to these agencies due to being negligent. First Investors claimed I owed them money, which I didn't. Their agency documented my account incorrectly and therefore they had falsely reported to the credit burues which I tried for weeks to get help and NEVER DID. This is NOT the first complaint this company has received in reference to this same issue. The day after reporting first investors to government agencies they finally researched my account and advised me that an employee incorrectly documented my account and that they were going to correct their mistake financially on my account due to their negligence and claiming I owed them money ( which I did not ). I made each one of my payments. Due to this negligence they falsely reported to the credit burues and I have attempted to reach out to this agency via email to the CHIEF COMPLIANCE OFFICER XXXX XXXX, XXXX XXXX, AND the Credit Compliance department with First Investors AKA Stellantis Financial Services. I have got no response in reference to my inquiry. They have claimed to have corrected the report to the credit burues BUT THEY HAVE NOT! I have even sent them copies of my credit reporting and still NO RESPONSE. This company is falsely reporting information and neglecting to correct their mistake. ONCE AGAIN! please help me. I also on this date, XX/XX/XXXX, I submitted a report to https : //www.econsumer.gov. I can provide this reference number at your request.

A lot has happened with this matter, so I am summarizing in short to get the process started and reserve the right to clarify and provide a more detailed response, as needed. Some items were resolved so not going into much/any of those. In my opinion, my experience and perception suggest that Stellantis and Stellantis Financial have not been ethical in dealing- I think there is a conflict of interest and has cost me, as a customer, financially. In short, I wanted to lease a XXXX with Stellantis ( XXXX XXXX, as the dealer ) and was not given an option with the finance company, where I was told I would be going with Stellantis Financial. Only some issues, as follows : - Had issues receiving the XXXX at the onset ( XXXX sat at " the yard '' for weeks/no movement ), the XXXX wasn't detailed ( e.g., packing adhesive still on vehicle ), there was chipped paint, had to pay for extension of registration as a result -The XXXX was delivered with more mileage than the contract. When I questioned, told it would be corrected and never was. Folks from XXXX XXXXStellantis shared that the finance company requires the contract to be under 500 miles otherwise it " throws up a bunch of red flags, '' although I was assured it was in my best interest. I dont see how that's the case. From my perspective, the contract was falsified -The contract didn't state any stipulations in terms of over-mile charges or alike. I was contacted a week later ( after I took possession of the vehicle, provided {$5700.00} down/they cashed the check ), they shared I dont have a contract and they need to make changes to the contract and I needed to initial those changes -- otherwise I don't have a contract and they would need to take the XXXX. They said the Financial Services company said they will not book the loan. Financial Services company said this was not the case. Not sure what is accurate. -Lease booked with incorrect due date vs. what was state on contract. Representative XXXX XXXX XXXX told me she could only make that change if I paid another payment with her over the phone. I told her I have auto-pay. She made me make a payment anyway. Auto-pay then took out another payment days later. -When attempting to work directly with Stellantis and Stellantis Financial directly, emails and phone calls are ignored, wait times to speak with a manager ( if at all ) vary from 30-60 minutes ), promised return calls have not been returned. After 4-5 of these experiences over 45/60 days, I can only conclude that this is their tactic to ignore customer complaints. I personally believe that Stellantis and Stellantis Financial have a conflict of interest, as they are doing the right thing for themselves ( my experience/examples above ), but not the right thing for the customer/client. This whole situation has not only taken 10-12+ hours of my time, much frustration, and a financial impact/loss. Due to a personal matter, I have fallen 1 month behind on my car note with First Investors Servicing Corporation. I have been calling since XXXX to get a XXXX extension filed. Back when I first called in I was told I was eligible for an extension, but in order to be approved I needed to update my insurance. Well that's what brings me to this complaint. I have done my due diligence in providing proof of insurance, however, their system is still showing that my insurance is inadequate. The first rep I talked to was XXXX XXXX. He gave me the info to contact their vendor XXXX XXXX to send them the documents to update my insurance. I worked one on one with a rep for XXXX XXXX and provided my declaration page. She said I was good and everything is showing updated. Wrong!!! Call First Investors back after XXXX business days to do the extension and my insurance was still showing inadequate. So I talked to XXXX XXXX and he said to send him my declaration page and he'll send it over to the insurance vendor for me. Gave it another XXXX business days, never heard back from anyone, so assumed everything was good and called back to file the extension again. Insurance is still showing inadequate. So the rep XXXX XXXX I talked to said the same thing send him the declaration page and he'll send it over for me. So I did, waited another 7 business day and called back and still showing inadequate. At this point I'm getting highly frustrated that I can't get nothing done in order to file my extension. So that time I called back I talked to XXXX XXXX again and this time he told me they just had changed vendors and I would need to update my insurance with www.myinsuranceinfo.com. So I did and it said that it couldn't locate my loan information. So I called the vendor at XXXX and they said yes XXXX XXXX is our new client, but however, they haven't sent over all of the loan documents, so therefore, there wasn't nothing they can do to update my insurance. Then on XXXX XXXX I called back and talked to XXXX XXXX and asked to speak to a XXXX. Well the XXXX or supervisor never did take my call and instead had asked XXXX to ask me to email her my declaration page and they would review and get back with me. So I did and as of today I have yet to speak to a XXXX and my insurance is still showing inadequate. I'm not understanding why it's so hard to update insurance on their system. I've never had this issue since being a customer for 3 years. Something tells me they use to do the verification in house and decided to outsource to a vendor, and I'm going to tell you from experience that having a vendor to do your work isn't all that great. I'm needing to speak to a XXXX ASAP to get this taking care. Check my notes on account # XXXX and you'll see what I have been dealing with for a month now. This is ridiculous. According to The Family Educational Rights and Privacy Act ( FERPA ) 20 USC 1232g ( b ) is a federal law enacted in 1974 that protects the privacy of student education records. FERPA applies to any public and private elementary, secondary, or post -secondary school. I would also like to add according to the Fair Credit Reporting Act 15 USC 1681 section 602 ( a ) states " There is a need to insure that the consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states 'It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customer 's nonpublic personal information. " ( XXXX XXXXXXXX XXXX ) is a financial institution by definition under that title .15 USC 1681 section 604 ( a ) section 2 states that " In general subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' This account is an adverse item they are reporting again without my permission which is against law. 15 U.S. Code & 1681 s-2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code & 1681 ( e ) states " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681 ( C ) of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681 ( b ) of this title. In XX/XX/XXXX I refinanced my XXXX XXXX XXXX. The original loan was through Stellantis Financial and it was refinanced through XXXX XXXX. On XXXX via priority USPS mail I sent a XXXX XXXX XXXX to Stellantis in the pay off amount of {$28000.00}. Per USPS tracking this was received by Stellantis in their XXXX, TX address on XXXX. ( see attachments ) This check was cashed by Stellantis and the funds were paid out on XXXX. ( see attachments ) However, Stellantis continues to send me late payments notices, late fee notices, and now a letter threatening vehicle repossession citing they have not received payment. I have contacted Stellantis via phone XXXX times. On XXXX I spoke with a manager, XXXX XXXX, and emailed her a copy of the cleared check which XXXX XXXX had provided me in an attempt to help remedy this. XXXX XXXX confirmed receipt, said she would look into it and I would be contacted in XXXX business days. ( see attachments ) Stellatis never contacted me except via an automated text to alert me my payment was due. On XXXX XXXX, a XXXX XXXX representative, contacted Stellantis with me on the line via a XXXX call to further certify they had paid out these funds to Stellantis and to obtain proof of ownership or vehicle title reflecting XXXX XXXX as the first lien holder per the refinancing agreement. Over a XXXX XXXX XXXX XXXX XXXX time span, the XXXX XXXX Representative and I were transferred to XXXX different people with no one providing any remedy. Again the cleared check was requested and emailed to XXXX XXXX who confirmed receipt. The only explanation given was that the check was cashed but not processed because they ( Stellantis ) are having problems on their end with their payment processing and their payment processing team is behind with " a long queue '' of payments. I was told I needed to be patient as " first come, first served. '' Supposedly there have been XXXX payment researches opened on my behalf. Meanwhile I continue to receive calls, texts, and letters about missed payments and late fees. On XXXX I received a letter from Stellantis threatening repossession if they do not receive their funds by XXXX. ( see attachments ) They have received these funds and cashed them via the company 's XXXX XXXX account. I can provide this account number as it is indicated on the back of the cleared check ( see attachments ). The back of this cleared check also indicates the po box the check was sent to, the same address I sent payment to on XXXX via USPS certified mail as stated previously ( see attachments ). The advertisement was everything {$79.00}. My husband and I spotted a XXXX XXXX that was a part of the {$79.00} advertisement inventory. The lines were very long, and we stood outside for more than 6 hours, they had a person on the microphone being loud and saying very inappropriate and unprofessional statements. I was very tired, and my blood sugar was very low, the sales rep at this point was pushing to get my file to another office across from the car dealership that was advertising the {$79.00} deals. The car salesman was working other deals at the same time he was working mine, do the paperwork was never reviewed with us step by step. He had us to sign the area on the contract without fully reviewing anything with us. We finally finished after being at the dealership for well over 9 hours out of my Saturday. Once, we drove off the lot with the car the engine light started coming on and not to mention this car deal had nothing to do with the {$79.00} deals as it was advertised. After going through all of this, my husband and I decided we didn't want the vehicle and would return it within the time frame the law supports. The deal with the car was not completed until after XXXX that Saturday afternoon. Due to the weekend and Monday a holiday and the dealership was closed we returned the car that Tuesday early morning. We submitted a letter to the dealership stating that we are returning the car and didn't want to proceed with the deal. They took the letter but was trying to refuse our request to stop the contract and that the car was now returned and we didn't want it. We were treated very unfairly by the dealership, but we never once kept the car upon us returning it along with a letter stating we had returned the car and didn't want to proceed with the deal. I have attached documents pertaining to this claim. Now the loan company XXXX has attacked my credit rating, and we don't have the car it has been at the car dealership since XX/XX/2023. We have no collateral, and it is still at the dealership. On XX/XX/2023, Stellantis Financial Services XXXX received a negotiable instrument in the form of a cashier 's check in the amount of {$80000.00} from XXXX XXXX, with the stated purpose of settling and discharging the associated account. Stellantis Financial Services credited the account with the aforementioned negotiable instrument, resulting in the closure of the account for a period of XXXX days. However, on the fourth day, XX/XX/2023, the account was inexplicably reopened, and the negotiable instrument was subsequently reversed, as per Stellantis Financial Services XXXX. This reversal indicated a failure to honor the negotiable instrument, effectively reinstating a fictitious loan amount, as per the provisions of UCC 3-604 ( Notice of Dishonor ) ( b ). Per UCC 3-604 ( Notice of Dishonor ), if a tender of payment is made for an obligation related to an instrument and is refused by the entity entitled to enforce the instrument, a discharge of the obligation, to the extent of the tendered amount, occurs for any indorser or accommodation party with a right of recourse pertaining to the said obligation. This discharge was anticipated due to the dishonor of the instrument. However, Stellantis Financial Services US failed to provide any notice of correction concerning the instrument, thereby violating my consumer rights through deceptive practices and unjust enrichment. In accordance with Title 15, Section 45 ( a ) ( 1 ) of the United States Code ( 15 USC 45 ( a ) ( 1 ) ), which empowers the CFPB to prevent unfair or deceptive acts or practices in or affecting commerce, I wish to draw attention to the company 's apparent violation of this provision. On XX/XX/XXXX I made a payment to 1st Investors Servicing Corporation to pay off my loan in the amount of XXXX. This was the total the website said I owed. My XX/XX/XXXX bill said {$860.00}. So apparently I have an overpayment of {$400.00} that is due to be refunded to me. My bill, the website and customer service balance are all difference amounts. In trying to get the account straight with customer service I was passed around, then their customer service was down, then I called back. This all took place on XX/XX/XXXX. All the while they kept wanting to send my call to " titles '' since my car is now paid off. I spoke with " titles '' and they verified they have absolutely nothing to do with the issuance of my {$400.00} overpayment and they can not request the funds to be released as it is not their department, they handle titles only. Makes sense. I spoke with five different people and no one could tell me when I would be getting my overpayment. One person said it would be at least 20 days before released. Unacceptable. Not delivered in 20 days. They were just going to hold on to it. When I said it was unacceptable and what was the reason, they could not give me one. It's " titles ''. Again, titles said they had nothing to do with the release of payment but customer service kept blaming them. The " best '' they could do was to put in a request to have my payment refunded but it probably would not be. Because of titles,,, The title should have nothing to do with my refund. A title should be issued when the account is at XXXX. Mine is at XXXX. I was told no one could issue my refund. Nobody knew what they were doing or what department handled the refund. Literally, I do not know. Even the supervisors. Again they kept blaming " titles '' which " titles '' again, said they have NOTHING to do with billing. I finally had to start refusing to be sent to titles. Listen to the calls. They say they record everything. It is unfair and unethical that 1st Investors Servicing Company is holding over {$400.00} and will not refund the money, nor give me an acceptable answer when it will be or why they are holding it. The title release doesn't make sense. It's a negative balance! A title should be issued at {$0.00} so why won't they refund me?

Due to extenuating circumstances I went on a payment plan with them in the beginning of this year. I told the rep that my hours were furloughed and I needed some help. So I was to pay one month of payment in two installments as I did not qualify for deferment and they never even mentioned anything about COVID deferment at that time. I did not think much of it. I paid half {$320.00} when I called and then I paid the other half along with the monthly payment {$970.00} on XX/XX/XXXX before their due date of XX/XX/XXXX. Since it was a Saturday I even emailed their customer service on XX/XX/XXXX stating to update their records and not report the account late. But what do you know they reported this account late not only for XXXX but also for XXXX as well. I disputed with the CRAs to no avail. So I sent First Investors a goodwill letter to not report it as late. They declined to update my report even when it was their oversight and so I think it is gross misrepresentation of the reporting they have furnished. And of course they don't err on the side of customer service like all the other companies yet are intent on destroying people 's credits and credibility. Most of the complaints online where they have mistakenly reported and ruined people 's credits their response is if we do a goodwill adjustment to you we have to do it to all. That is just ludicrous. So they would rather destroy everyone 's credit not just yours. Dismal customer service. If anything else could be said for this company, it is that their customer service, for all their bluster, is atrocious. I realize that it is next to impossible to place the blame squarely on the customer service representative, since their managers and supervisors are ultimately responsible for the way their staff interact with customers. Apologies does not solve problems, results and actions do. As a matter of course, I occasionally become frustrated with the service and simply depart but in this case you can't do that because you have a mortgage with them. I even emailed goodwill letters to their executives about my issues and never even received an acknowledgment that they have received my messages. That is why I said their service is left much to be desired as it falters from top down.

On XXXX, I applied with my personal bank for auto financing. When approved, I contacted the dealership that I wished to purchase from and affirmed with them that they had received the financing package from my bank, and that I could come down and purchase a car. Once I chose the vehicle, an unknown financing agent in the auto dealership, continued without my authorization, to pull various credit reports, with unknown and unapplied to lenders. At the dealership, I informed the finance manager, that the inquiries were unauthorized and should be removed from my credit report immediately. Furthermore, I have a FULL FRAUD ALERT/CREDIT FREEZE on my credit files at all XXXX credit reporting agencies, and it requires them to contact me to verify if a credit application has been sent to them. None of the companies that were not authorized to receive my credit, followed the proper procedure, and this is a violation of my rights under the FCRA, when a credit freeze is applied. Furthermore the companies in violation, have made no attempt to correctly follow the verification process for my credit file. On XX/XX/2023 at XXXX, XXXX, I contacted the credit reporting agency responsible for allowing my credit report to be given to unauthorized parties, but again, this CRA XXXX XXXX, stonewalled with an automated system for XXXX minutes, then hung up the call when I reached the consumer affairs department to speak with XXXX XXXX and then XXXX XXXX who hung up the call ). This type of behavior, is again a violation of my rights under the FCRA, and if continued, I will engage, once more, in aggressive litigation against all parties who were involved in this egregious violation of my personal credit information, which also caused a loss in credit score, which is a damage/recoverable offense, in litigation, on my behalf. If these companies do not comply with immediately removing their inquiries from my credit report, and refrain from any future unauthorized credit access to my information, I stress again, that I will file aggressive and financially punitive litigation against the offending parties.

The XXXX XXXX accord which was financed by First Investors Financial Investors, was traded in for a complete and total payoff from the dealership as part of the new XXXX sale. During the XXXX XXXX conversion, I " re-affirmed '' the XXXX Vehicle Loan, that I would continue to pay which I did, up until the trade in. After review of my credit report, the status of the XXXX XXXX XXXX is being referenced with a date of last update being XX/XX/XXXX in a " re-affirmed '' status. This is incorrect and needs to be corrected. Although initially re-affirmed during the bankruptcy conversion, due to the trade in, this account was paid in full per the terms of the trade, and First Financial Investors has failed to update this account appropriately to reflect a " Paid in Full '' Status only versus any references to being " Re-affirmed '' as the official status. This account was not paid out through the bankruptcy, and the continued reporting of " Re-affirmed '' is incorrect and malicious. A check was supplied to First Investors Financial Investors on XX/XX/XXXX from the dealership to pay the loan off in full, which they accepted, which acknowledges they accepted the full and complete payoff through check form, closing the loan out, which has nothing to do with the bankruptcy. It is unacceptable that you accepted a check, cashed it, and intentionally chose to falsely report the status of this account ascribing it to the bankruptcy, when you received a complete and full payout from the dealership. I received credit denial for an auto loan from this bank from a dealership. Their reasonings for credit denial were based off of credit reporting for items that went delinquent due to unemployment delayed from a XXXX and several XXXX unemployment claims still unpaid and unresolved. And XXXX pandemic assistance received during the entire XXXX timeframe. Everything was delinquent and caused my credit issues because of delayed unemployment, delayed assistance, and I applied for thousands of jobs claiming to be hiring and they were not. I started doing XXXX XXXX XXXX of XXXX because I was homeless and sleeping at rest stops seeking help for shelter, etc. Or I was denied the jobs based off of XXXX violations. I have had this vehicle since XX/XX/XXXX and I traded in another vehicle as a down payment for this one. After that deferment I have made every payment after that. As of this email I am due for my XXXX. First investors never explained to me the interest on the deferred payments and I asked what would happen to those payments and they said they would be put to the end of my loan so now they are saying I owe XXXX and I asked them if they would be willing to take the amount of the deferred payment and they said no they would need XXXX and would put my account as paid for less than owed or something like this. Then I get a email stating I only made XXXX payment, how is that when I only deferred XXXX payments. I believe this company is doing something fraudulent because theres no way I only made XXXX payments since I had this truck. I have been receiving harassing calls and visual voicemails from XXXX XXXX at First Investors XXXX for a XXXX XXXX who is apparently using my number to obtain fraudulent debts and attempting to evade said debts. However, I do not know this person, as this is a new number I received from XXXX a year ago when trying to resolve similar issues with XXXX wherein I received harassing messages from creditors and even suppliers from a methadone clinic for a former XXXXXXXX subscriber. I have reported to XXXX on several occasions the issues with the harassment from creditors on their recycled lines. XXXX has attempted to resolve the issue by alleging that the Scam Caller ID option available through their service would prevent this, but it does not prevent the harassment. Instead, this service only sends the harassing calls in violation of TCPA and FDCPA to my voicemail, so I continue to receive the harassing visual voicemails. I receive at least one per day, and this has been going on since XXXX of this year. It is now XXXX, so the calls are incessant and will not stop. I tried to call the number back, but I can not reach a live human being to request a cease and desist. The robo-dialed service instead then verifies as if I am the debtor calling and continue to ensue with more harassment. XXXX has failed to protect me. The National Do Not Call List has failed to protect me. I have filed a complaint already with the FCC. My next step is to file a complaint with the Illinois Attorney General against XXXX for failure to block this harassment.

This company has failed to acknowledge my account being paid in full as of XX/XX/XXXX. There was a garnishment for the total amount of {$16000.00}, issued for the loan in XX/XX/XXXX with payments starting on XX/XX/XXXX to my employer group. On XX/XX/XXXX, the final payment of {$200.00} was made to satisfy the stated amount provided to my employer group and on court docs. This balance owed is incorrect. The report also shows a term of 74 months versus the original contract of 72 months. The term info is incorrect. Additionally, it states my last payment was XX/XX/XXXX, which is inaccurate as well. My last payment was XX/XX/XXXX for the loan amount. I called in XX/XX/XXXX to XXXX, XXXX, XXXX, XXXXXXXX XXXX XXXX at XXXX and was transferred to XXXX XXXX, XXXX for the law office representing First Investors in reference to the balance owed. XXXX advised me my loan balance was paid in full and emailed me on XXXX confirming the principal balance was satisfied in XX/XX/XXXX. He also sent me a pdf file showing what my total balance owed was from the legal docs. The balance of {$1000.00} is not the correct amount for the loan in which is being reported. The docs show a breakdown of the principal {$13000.00}, {$1000.00} interest, {$1400.00} attorney fees, {$310.00} fees and {$160.00} in late fees, totalling in {$16000.00}. To whom it may concern I made an uniformed use of credit when I entered into a consumer credit transaction with XXXX on XX/XX/2021. The contract/agreement was not easily understood or explained. The information in the contract was not clear or conspicuous. I rendered the vehicle due to the annual APR being 21.99 % and it being charged off. The debt was originally paid for by my social security number ( credit card ) Then when the loan defaulted it was paid for by insurance and the premium. With the account being charged off I have written numerous letters asking for the company to send proof of the loss. I also asked for who the debt was sold/assigned to. I have been trying to get my account back on track. My job sends me traveling and me and my crew became ill of covid and the project was shut down for 2 weeks we are unvaccinated. While I have attempted a number of times, I have yet to receive all outstanding responses to my questions, from the finance company 's perspective - Stallantis Financial Services ( SFS ), pertaining to my most recent lease. I was told by the dealership that they didn't want to state accurate/actual mileage on the lease contract, since it was over XXXX miles because it 'throws up red flags '. I would like to better understand this, from SFS perspective - what process and procedures are there for new lease vehicles with over XXXX miles. Would SFS ever tell a dealership this? Why would the dealer potentially have this understanding? I would like to understand SFSs view on this statement the dealer made, on behalf of the finance company/SFS. Related, regarding the contract, the dealer/Finance Manager did not indicate any over-mileage stipulations ( i.e., overage charges ) as part of my contract at signing and when I took possession of the vehicle. The dealer, a week later, came back and stated that the finance company/SFS communicated that I 'do not have a contract '. I would like an explanation, from SFS, whether or not this is what was communicated back to the dealership to communicate back to me, as that is what I was told. On XX/XX/XXXX, First Investors Servicing added {$220.00} to my balance under XXXX ( non-sufficient funds fee ). The reason for this amount was due to a XXXX DMV registration fee that was included when I refinanced this car. The fee was not due to XXXX. I continued making my monthly payment of {$280.00} and would pay extra every month to pay off the {$220.00} balance. On XX/XX/XXXX, the balance of {$220.00} was completely paid off. I continued making my monthly payment of {$280.00} and I continued to may extra payments every month ( now ) towards the principal balance. I called customer service several times to inform them that I would continue making additional payments ( in addition to my regularly monthly payment of {$280.00} ) and I wanted those additional payments to be paid towards the principal balance. First Investors Servicing has not applied those additional payments towards principal rather simply applied it towards my monthly auto payment. I was not informed that my vehicle was being reposted until a tow truck showed up to my house without prior knowledge. When asked about why he was there I was told he was doing his job. Twice prior a car drove by as if it was recording me or my neighbor 's houses. After the tow truck which was months later another car drove by recording and taking pictures of our houses. I got a car loan with Stellantis Financial for a XXXX XXXX XXXX. My first payment date was XX/XX/XXXX, I went on their online portal to make a payment. My debit card was not going through so I decided to use my checking account. 2 days later, {$720.00} came out of my bank account and then another 12 days later, another {$720.00} came out of my account. I called Stellantis and they repeatedly stated that the payments were returned and did not come to them. I then called my bank as I saw both payments on my statement and they confirmed that both payments went through and provided me the e-check numbers. In XXXX, I drove my XXXX XXXX XXXX XXXX vehicle to the XXXX XXXX dealer in XXXX MD because they said they can help me trade in my vehicle for a new XXXX car of the same model. I was just getting over XXXX and needed most of the work to be done before I got there. As far as I was concerned, it was a trade and the lender was First Investors. First Investors Servicing is the company I pay my monthly vehicle loan payments to. I send in payments on a weekly basis. I also send an additional amount which I want applied directly to principal. Based on the response from FISF, they do not accept principal only payments. I've asked them to send signed documentation stating this, but they have failed to do so. They have also failed to apply my additional payments to the principal. They are applying the additional payments to the interest. I would not send additional payments to have them applied to the interest because that does not benefit me. I keep explaining this and they keep saying they can't accept principal only payments. This is a simple interest loan and as far as I know I can pay extra which gets applied to the principal in order to HELP ME pay off the loan quicker. I had a vehicle financed through First Investors. I was in a car accident in XX/XX/2021 in which the vehicle was totaled out. In XX/XX/2021, I was told by First Investors that the gap insurance claim was denied and that I would still have to cover the remaining balance ( approximately {$1400.00} ) on the account. I have an existing car loan through First Investors. Previously I had some late payments on my account, and when I called them to resolve they recommended I sign up for their Fresh Start program. I was told by the company, Stellantis Financial Companies, after I had them finance the car after 8 months that they had a 10 day grace period and that would give me additional time after due date. what they did not tell me is that it would still be late for those 10 days and that they would charge a large enterest fee for those 10 days.
