CREDIT AGENCIES AGREE TO WAIT BEFORE ADDING MEDICAL DEBT TO RATINGS XXXX XXXX XXXX Statewide Credit Services At this time I make the claim that the medical debt procured against me on any or all credit reporting agencies, should be deleted permanently. Too many consumers have learned the hard way that their credit rating can be tarnished by medical bills they may not owe or when disputes delay insurer payment. That should change under new policy agreed to this week by the three major credit reporting agencies. The agencies say they will establish a 180-day waiting period before medical debt is added to someones credit report. In addition, the agencies agreed that when an insurer pays a bill, the debt will be promptly removed from the consumers credit report, unlike certain debts that remain for years. The changes are part of a settlement between the credit rating agencies XXXX, XXXX and XXXX and the New York Attorney Generals office that aims to improve accuracy and enhance procedures for disputing credit report errors. The agreement covers consumers across the country. The three agencies gather information from banks and collection agencies about consumers credit such as payment history and how much someone owes to credit score for more than 200 million individuals throughout the country. A persons credit score is used as a measure of credit worthiness, and can influence peoples ability to get loans and the interest rates they are charged, among other things. This is going to help millions of people access more affordable loans, says XXXX XXXX, a principal at XXXX XXXX XXXX in XXXX XXXX, Mass. People will no longer be penalized for having a medical bill slip past them and get on their credit report even though the bill gets paid. Insurers sometimes wrangle with patients and providers for months before paying a bill. The new six-month waiting period will give consumers time to resolve such disputes, XXXX noted. Medical debt accounts for more that half of the collection items on credit reports, according to a report by the Consumer Financial Protection Bureau. Among people facing collection for only medical debt, about half have otherwise clean credit reports with no sign of past debt collection problems. XXXX XXXX Company Mishandled Consumer Credit Reporting Disputes, Prevented Consumers From Exercising Debt Collection Rights WASHINGTON, D.C. Today, the Consumer Financial Protection Bureau ( CFPB ) announced an enforcement action against a medical debt collection company for mishandling consumer credit reporting disputes and preventing consumers from exercising important debt collection rights. These practices potentially affected the credit scores of thousands of individuals and caused consumers distress and confusion. The CFPB is ordering the company to provide over {$5.00} XXXX in relief to harmed consumers, correct its business practices, and pay a {$500000.00} penalty. XXXX XXXX XXXX mistreated consumers and prevented them from exercising critical debt collection rights, said CFPB Director XXXX XXXX. These violations are particularly egregious given the challenges many consumers already face who are attempting to navigate the medical debt maze. Today we are putting a stop to these illegal practices and getting consumers the relief they deserve. XXXX XXXX XXXX, XXXX, which does business as XXXX XXXX XXXX, is a debt collection agency that primarily collects medical debt on behalf of hospitals, doctors, and other healthcare providers. The company is an indirect subsidiary of XXXX XXXX XXXX, XXXX, which provides billing and other services to more than XXXX hospitals nationwide. XXXX XXXX XXXX, a publicly traded healthcare services company based in XXXX, Texas, is the parent company of XXXX XXXX XXXX. Companies that collect medical debt and supply this information to credit reporting agencies have a significant impact on consumers credit scores. More than 43 million Americans have medical debt adversely affecting their credit reports, and more than half of all overdue debt on consumer credit reports is from medical debt. A recent CFPB report found that the complex processes by which medical bills are incurred, collected by a wide range of debt collectors, and reported to credit reporting agencies can create unique challenges for consumers. The Bureau also found that medical debt can overly penalize consumer credit scores. As part of its debt collection business, XXXX XXXX XXXX regularly supplies information on the status of its medical debt collection accounts to credit reporting agencies and is considered a furnisher under the Fair Credit Reporting Act. Credit reporting agencies track a consumers credit history and other consumer transactions based on information supplied by furnishers. The reports that credit reporting agencies sell are used in determining everything from consumer eligibility for credit to employment decisions. XXXX XXXX XXXX typically initiates collection efforts through letters and telephone calls to consumers. Within five days of their initial communication, debt collectors are generally required to send debt validation notices to alert consumers about their right to request proof that a debt is valid or dispute the debt. A CFPB investigation, however, uncovered that XXXX XXXX XXXX failed to send debt validation notices to thousands of consumers. The CFPB also found that the company mishandled consumer credit reporting disputes by failing to investigate and respond to consumers within the 30-day timeframe required under the law. Because the company furnishes information related to past-due medical debt, the information consumers seek to dispute or validate has the potential to lower credit scores. The CFPB order charges the company with violating the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. The violations specifically include : Mishandling consumer credit reporting disputes : XXXX XXXX XXXX failed to respond to more than 13,000 consumer credit report disputes within the 30-day timeframe required by law. On average, the company took more than 90 days to respond to consumers disputes and, in some cases, took over a year. Consumers spent time and money attempting to follow up on unresolved disputes and experienced distress and confusion due to the delays. The CFPB found that the company had no policies or procedures in place to investigate these consumer credit report disputes. Instead, the company treated consumer credit report disputes in the same way as other consumer complaints and had no deadline for responding. Preventing consumers from exercising important debt collection rights : XXXX XXXX XXXX failed to send debt validation notices to more than 10,000 consumers. During this time, the company continued to collect over {$2.00} XXXX from consumers who did not receive the notices. Failing to provide notices denies consumers the opportunity to assess whether the debt is valid and whether the amount or source is correct. These notices can be an especially important consumer safeguard with regard to medical debt, where issues like insurance reimbursements and medical billing processes are commonly fraught with complexity, confusion, and delay, and can lead to consumers being unsure of how much to pay or even whom to pay. Together, these violations had the potential to harm thousands of consumers and in some cases, negatively impact their credit scores. This can hinder consumers ability to obtain credit or increase the rates they may pay for credit. In some cases, the company reported inaccurate information to the credit reporting agencies and then failed to provide a timely response to consumer disputes about the errors. Some consumers may also have been able to avoid negative information on their credit reports if they had known about their right to assess and dispute the debt in question. Enforcement Action To address these violations, the CFPB order requires XXXX XXXX XXXX to take the following actions : Provide over {$5.00} XXXX in relief to harmed consumers : XXXX XXXX XXXX must identify all affected consumers and provide monetary relief. Consumers who were never sent a debt validation notice and who made payments to the company will receive a full refund and have remaining account balances forgiven. The company will pay {$100.00} to consumers who were never sent a debt validation notice and did not make any payments to the company. The company must also pay damages ranging from $ XXXX {$1000.00} to each consumer who did not receive a timely response to his or her credit report dispute. The amount that each consumer receives will correspond to the duration of the companys delay in responding to the consumers credit report dispute. The company must submit a written plan to the CFPB for approval detailing how the company will identify affected consumers and provide relief. Correct errors on credit reports : XXXX XXXX XXXX must identify all consumer accounts affected by its illegal business practices and fix any inaccuracies. The company must also update the account information it has furnished to the credit reporting companies and notify all affected consumers of this update, to the extent it has not already done so. End illegal credit reporting and debt collection practices : The company must cease its illegal business practices and develop new policies to comply with federal consumer credit reporting and debt collection laws. Establish consumer safeguards : XXXX XXXX XXXX must change how it does business and establish safeguards to ensure it has the staffing, facilities, systems, and information necessary to timely and completely respond to consumer credit report disputes. It must also establish a strong oversight program to identify any systemic inaccuracies to ensure that it informs consumers of their right to validate and dispute inaccurate debts in collection. Pay a civil monetary penalty of {$500000.00} : XXXX XXXX XXXX will pay a {$500000.00} fine for the illegal actions. The CFPB will continue to enforce federal laws to ensure accuracy in credit reporting and debt collection. Consumers should check their credit report for inaccuracies at least once a year. Consumers can order a free credit report once every 12 months from XXXX.

XX/XX/XXXX To whom it may concern : This is regarding the erroneous information that is appearing on all 3 of my credit reports from Statewide Credit Services Corp . First, this account should only be in my name. Please refer to letterhead from Statewide Credit Services. My husband, XXXX, it NOT involved in this. His social security number is XXXX. This date of birth is XX/XX/XXXX. However, this information is showing on all 3 of his credit reports. Second, on XX/XX/XXXX, I had a leak with one of the drainpipes in the main bathroom of my home, located on the upper level of my home. This pipe was in the soffit under the main bathroom and leaked behind the wall of the bathroom on the lower level, as well as the outside patio. I called XXXX XXXX of XXXX, and XXXX, a technician, came to my home. Because of the water damage this pipe caused the lower level of my home, XXXX gutted the downstairs bathroom as well as the outside patio to get to the damage. XXXX also recommended XXXX of XXXX for the water damage. XXXX from XXXX arrived at my home on XX/XX/XXXX to give me an estimate of the damage. XXXX informed me that there was thousands of dollars worth of damage to the bottom structure of my home because of the leak. XXXX stated this structure was compromised because of the water damage. He stated there was at least {$20000.00} in damage, and I had to file a claim with my home insurance XXXX as soon as possible. XXXX led me to believe the den in the upper part of my home was so damaged from the water, it could collapse at any minute. On XXXX recommendation, I immediately called my agent at XXXX. XXXX left with a check for {$500.00} to cover my deductible from XXXX. XXXX also set up fans to help with the water damage. The balance we owed was {$1000.00}. Approximately one week later, my agent from XXXX, XXXX XXXX, arrived at my home to give me an estimate. On XX/XX/XXXX, Ms. XXXX XXXX completed her summary of the real damage to my property. I learned that the damage was not anywhere near {$20000.00} in damage. Since I have a deductible of {$500.00}, the check I received from XXXX was {$1300.00}. However, it cost me 4x that amount to replace everything they took down. Also, although a certificate of completion was signed, that certificate was for the bags of wet sheetrock that XXXX took out of my home, and for the fans they brought in to dry my carpet. That is it. Also, please note the date. CWD of XXXX was signed on XX/XX/XXXX. However, the final report from XXXX is dated XXXX days later. I had no idea what XXXX would find until after I received their report. I called the owner of XXXX of XXXX, XXXX XXXX, approximately XX/XX/XXXX and informed him of the discrepancy with his estimate that XXXX gave me. According to XXXX, he tried to cheat my insurance company. No part of XXXX estimate was correct. I have spoken to the managers of XXXX, and they all agree that XXXX of XXXX tried to cheat XXXX. XXXX demanded payment in full. While trying to rectify this amicably, Mr. XXXX showed up at my husbands business on several occasions. He also harassed the agent at XXXX, XXXX XXXX on numerous occasions. He located my husband on XXXX and wrote erroneous information about his business ( Mr. XXXX never had any business dealings with my husband ). I had to report him to my local police station, as well as to the owner of XXXX XXXX. I spoke with a representative from XXXX and XXXX of XXXX, NY who informed me that they dropped Mr. XXXX as a client after speaking to me and learning how he tried to cheat XXXX XXXX. This account was put in to collections, however, my balance as of today is {$1300.00}. It goes up every month. On XX/XX/XXXX, Mr. XXXX reached out to me through XXXX and offered to " stand down '' and stop any further action if I took down my negative reviews that were posted about his company. I had attended classes at a trade school titled, " XXXX XXXX XXXX XXXX XXXX. '' I enrolled prior to the pandemic. I was given an old school catalog for the prior academic calendar year XXXX. Despite not having clear understanding of dates of courses and deadlines, I paid full tuition out of pocket for first block of classes. Prior to the second block of classes, I had experienced financial hardship due to loss of hours and income as a result of the pandemic. As clearly indicated in the course catalog, it states 'student may cancel his/her enrollment at anytime and date of withdrawal is last physical attendance. ' I notified the dean on XX/XX/XXXX in writing that I can not continue with this program prior to instruction of second block of courses which prompted a meeting. During the meeting, I was very clear that I can not continue with this program. I was blamed and also shamed for my decision to withdraw and high pressure sales tactics were used. She eventually offered to waive the initially required XXXX XXXX course, something I had taken in my prior schools. Out of pressure, I did take 2 additional classes ( which were also paid for in full ). I was also promised by the dean that the Financial Aid office would assist with giving some of the relief funds awarded through HEERF through Cares Act though I did not receive. Ultimately I I continued with my initial decision to withdraw from the program and informed my teacher the second time around rather than notifying the dean. After receiving several harrassing bills expecting me to pay for a class that I did not take, I sent a certified letter to the school on XX/XX/XXXX. The dean sent me a reply letter on XX/XX/XXXX indicating that my corrections were correct and acknowledged that I do not owe anything. I had the understanding this matter was resolved. I received a call on XX/XX/XXXX from someone identified as XXXX XXXX from Schwartz Schwartz and Associates located at XXXX XXXX XXXX in XXXX. She spoke to me in a threatening matter indicating how their office will come after me, my credit score will drop and I will be taken to court. They were and continue to insist that I owe the amount of XXXX for a class that I did not take. Despite attempts to reason with this office, they spoke over me and frequently attempted to intimidate me. I tried to reason with XXXX XXXX however she spoke to me in a very offensive manner, spoke down to me and insisted that I was wrong. After XX/XX/XXXX, I have received over 50 calls from this office including threatening letters and now a letter from Statewide Credit Services Corp located at XXXX XXXX XXXX. This agency issued a demand letter which stipulation indicating that a lawsuit will be brought to me. I am writing this letter as a form of a formal complaint, particularly with the office of Schwartz , Schwartz and Associates along with Statewide Credit Services for harrassment. I have spoken to 2 other colleagues who also withdrew from this program and are not being targeted or being treated like I am. Given that these other students are not being harrassed, I even feel being potentially discriminated against due to this unethical business practices. I would like these offices to refrain from contacting me at this time. I think it is important to bring attention to this matter, especially how some businesses are operating in such a matter in the time of a pandemic and health crisis.

Dear CFPB, I am writing to address several significant concerns related to the actions of a debt collection agency, Schwartz , Schwartz & Associates ( LIC. # XXXX ), and their handling of a debt purportedly owed to XXXX XXXX XXXX XXXX XXXX Failure to Verify Debt : I filed a dispute regarding the debt on XX/XX/, providing comprehensive details, including evidence of my dispute, and requesting the debt be verified. To date, I have not received any response or verification of the debt from the debt collection agency. This is in violation of the Fair Debt Collection Practices Act ( FDCPA ), which provides me with the right to have the debt verified. I have attached a copy of my initial dispute letter and evidence for your reference. Continued Attempts to Collect Disputed Debt : Despite my dispute, and even after submitting the dispute to Schwartz , Schwartz & Associates, the agency has continued its attempts to collect the disputed debt. This is a blatant violation of the FDCPA. The debt remains in dispute, and I have clearly requested that all collection efforts cease until the dispute is properly addressed. Communication After Request to Cease : I sent a cease and desist letter to Schwartz , Schwartz & Associates, instructing them to cease all further communications. The letter was received on XX/XX/XXXX ( USPS Tracking number XXXX ) and proof of delivery attached. Unfortunately, the agency has ignored my request and continued to contact me regarding the disputed debt. This ongoing communication is not only in direct violation of the FDCPA but is also causing significant distress. I received several calls from XXXX XXXX. XXXX from Schwartz and Schwartz & Assoc. I inquired about the concern. I explained that I did not receive letters and asked for the address on file. They had the wrong address. XXXX XXXX stating I owed funds from when my daughter attended school. I told her that was not accurate and I asked if I could call her back after speaking with Mr , XXXX XXXX. During the four days attempting to get in contact with Mr. XXXX, XXXX XXXX called several times during the work day. I repeated told her I was attempting to get in contact with Mr. XXXX. Ms. XXXX continued to threaten reporting this debt to the credit agency. I told her that I was in the home buying process and will correct this error. I continued to receive calls a day later. I finally called the office and asked for a different person on my case as she was harassing me via email and phone. Almost two days later, I told the Mr. XXXX XXXX I did not own that amount of money and would gather the evidence to prove that I did not owe the money. He stated that it was no longer in hands. I told him that I personally paid him in for my daughters tuition and that he did submit most of it right away. I remined him that I called in the Summer to ask that he make the corrections as well as there was still a balance. He acknowledged that I did pay him ; however, he stated it was out of his hands. I asked him for the name and number of the Business office manager. He refused and stated he would not provide me with that information. I again stated that I paid him, and he yelled at me and hung up on me. Immediately after my call with Mr. XXXX, I reached out to the collection agency ( XXXX XXXX. XXXX , Schwartz , Schwartz & Assoc . XXXX XXXX XXXX. XXXX XXXX XXXX, NY XXXX ( XXXX ) XXXX LIC. # XXXX ) and told them the I did not owe {$1400.00}. They called me several times and kept threating my credit report- this happened in one week. I asked them to allow me until next Thursday to gather the necessary information to prove that I paid all bills and that my daughter was only in school for 4 1/ months. A few days later my credit report showed I owed the balance of {$1400.00}. This lowered my score and prevented me from moving forward with a mortgage loan

I realized just about a month ago when my credit report was pulled that I had a collection for a medical bill that was fully paid by my primary insurance. The collection was from XXXX XXXX Medical Center in New York and the claim was for {$200.00}. As soon as I was made aware of this outstanding bill I had, I contacted my primary health insurance company to see if they had knowledge of a claim that was submitted and if I owed any sort of deductible payment. It wasn't even 12 hours later when I was contacted incessantly by Statewide Credit Services out of XXXX XXXX New York. I tried to make a good faith effort to resolve this issue and was met with such abusive and demeaning responses when they did reply to my communication. The other half of the time they completely ignored me and offered nothing but ultimatums basically threatening to make my life miserable and turn this into a vendetta. I am not used to such business dealings with unethical treatment. This was just probably something that was coded wrong by a health care biller and it has turned into an issue that has been stressing me out to the point of exhaustion. I really wasn't aware that collections agencies were immune to a code of ethics or could outright make threats, and handle business with outright abusive personnel. During this time, the economy crashed, we were devastated by Hurricane Sandy, lost two cars our home was unlivable for one month and I didn't qualify for any programs because of my gross income which does not take into account loss of pay due to time/pay loss from work to attend numerous and frequent appointments and my dental coverage was dropped.My credit was greatly effected from these events. Prior to this monumental time in my life, my credit was great. I am appealing to you to remove this derogatory account from my three credit reporting agencies. It has been with great difficulty attempting to recover from our my unfortunate situations. It is almost seven years reaching the statute of limitations. I paid this debt XXXX of 2019 for XXXX dollars in full. This company never send me any information to my address. I never got any bill. I was only conscious of this bill when it opened up on my credit report. I then contacted the creditors with the info from my credit report. I never received any notice. When asked what address they have. It was a incorrect address that I no longer lived at. They also stated sorry we wont be removing anything off your credit even thought you paid it due to you not paying on time. When I explained I never received a notice and I was on knowledgeable of this due to my credit report when it appeared on it. I gave proof of my correct address and ask can it be removed from my credit report due to me clearing the balance with a XXXX balance due to me never receiving anything and not knowing anything in regards to this bill. We hired a company called " XXXX XXXX XXXX XXXX '' to get us access to our lighting control system after purchasing an apartment. The sellers of the apartment were difficult to reach so we believed this would be a faster solution. The company came to the apartment and changed the system so that it was only accessible to them and then billed us despite performing the opposite service they were hired to do. This company then sent the debt to " Schwartz Schwartz and Associates '' who have harassed both myself and my wife by phone nonstop since, threatening our credit, insisting that this is a legitimate debt and refusing to help promote an amicable solution with the original service provider. This is a small debt and would be a very easy thing to resolve if the either of these companies cared to seek a solution. Our lighting controller is now tied to an account that only " XXXX XXXX XXXX XXXX '' has access to and is being held hostage. Both of these companies should be avoided by consumers.

I paid a settlement amount over two weeks ago and got a confirmation number, yet the amount is still showing as active and going up. When I called this creditor they claimed that they just sent proof of payment and the letter is on its way.
