XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX GA XXXX XXXX XXXX Account Manager, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX RESPONSE TO DECLINATION OF HOMEOWNERS INSURANCE COVERAGE Policy # : XXXX XXXX XXXX File # : XXXX Date of Loss : XX/XX/XXXX Coverage : XX/XX/XXXX XX/XX/XXXXXX/XX/XXXXDear XXXX XXXX, I, XXXX XXXX, am XXXX years old, XXXX XXXX XXXX and living on a fixed Social Security XXXX income since XX/XX/XXXX, purchased the property at XXXX XXXX XXXX XXXX XXXX GA XXXX ( XXXX XXXX ) in GOOD FAITH meeting ALL NECESSARY REQUIREMENTS for becoming a current Participant of the GEORGIA DREAM HOMEOWNERSHIP PROGRAM ( Georgia Dream ), while trusting that I was buying my DREAM HOME, along with knowing I would be living in XXXX XXXX Georgia for the rest of my life, a year and four ( 4 ) months ago ; since I DID NOT PURCHASE A FIXER UPPER HOME, because my closing was delayed four ( 4 ) times, due to alleged repairs and NOW I FEEL LIKE I WAS TAKEN ADVANTAGE OF! Since the XXXX XXXX property is in XXXX XXXX, Georgia, the probability of a tree collapsing and falling on my home is 1000 % because of hurricanes, tornados, severe thunderstorms, floodings, strong winds, lighting strikes and heavy rains, INSTEAD of SUB-STANDARD and PREDATORY COVERAGES like VOLCANO ERUPTION, RIOT AND CIVIL COMMOTION and VEHICLES, when there are no volcanos located within the XXXX region, especially since there is XXXX XXXX DOLLARS ( {$8500.00} ) to cover the structural damages! For anyone to believe there has not been any hail/wind storms in the state of Georgia since XX/XX/XXXX MUST NOT be a Georgia resident! Two ( 2 ) proposals were submitted prior to theXX/XX/XXXX closing, i.e., Acceptance Insurance my car insurance agency at the time and XXXX XXXX Insurance a required Home Buyer Education class recommendation. I am SHOCKED to know the SUB-STANDARD and PREDATORY homeowners coverage was chosen for the closing, with it not meeting the specific needs of the XXXX XXXX property, in the amount of {$820.00} and an AOP {$500.00} deductible. ( Attachment 1 and Modified Homeowners Declaration Page Attachment 2a & b ) However, I should not be CONNED, FORCED, SLAMMED or TRICKED into a PREDATORY insurance that does not cover my specific ownership needs, along with a mortgage company ( State Home Mortgage ) making payments on my behalf which cultivates this type of PREDATORY COVERAGE! I AM OLDER ; however, I DO NOT LIKE BEING TREATED AS A FOOL or TAKEN ADVANTAGE OF!!!! ( Letter dated XX/XX/XXXX Attachment 3a-d. ) Prior to closing the XXXX XXXX property and taking the advice of my real estate agent XXXX XXXX with XXXX XXXX XXXX XXXX , XXXX XXXX I paid and actually received a Home Inspection Report ( Inspection Report ) by Qualified Home Inspector XXXX XXXX , XXXX , GA XXXX dated XX/XX/XXXX. XXXX XXXX is not related to me or my family in any way! This thorough Inspection Report is 24 pages and includes photographs, observations, comments and summaries concerning the replacements and/or repairs of the XXXX XXXX property. There are no extenuating damages to the roof at the time of the Inspection Report and notations concerning the roof are as follows according to the TABLE OF CONTENTS : 1. Roofing beginning on page 5, 6, 7 and 2. General Summary on page 21. ( Attachment 4a-h ) A GENERAL SUMMARY is included with additional comments on Page 21 and again, there are NO EXTENUATING ROOF DAMAGES ; however, I am not allowed to review your Field Adjuster XXXX XXXX of XXXX XXXX REPORT comments he made about my roof damages! OnXX/XX/XXXX at XXXX XXXX, I made my first call to State Home Mortgage inquiring about my homeowners coverage and initially spoke with XXXX XXXX who referred me to XXXX XXXX Equity Home Loan Specialist, who told me how XXXX XXXX property did not have any insurance coverage and I needed to take out a personal small loan for any type of home improvements, i.e. ceiling, leaks, gutters. ( Attachment 5 ) Upon homeownership, I have been consistent with maintenance, upgrades, certifications and registrations in the following areas : 1. gutters cleared of debris ; 2. cleared entire overgrowth from backyard and removal ; 3. cut down several trees from backyard and removed debris ; 4. pest control treatments ; 5. installed a burglar door on front exterior door ; 6. installed a 6 foot private fence of 470 yards and wire fence removal ; 7. installed a deck onto rear exterior ; 8. installed 5 ceiling fans ; 9. installed alarm security system with camera ; 10. registered for homestead exemption, and 11. painted exterior walls. Again, I am XXXX years old, XXXX XXXX XXXX and living on a fixed Social Security XXXX income since XX/XX/XXXX and have almost exhausted my life savings with maintenance, installations, certifications, replacing and repairing what I can. Since I DID NOT PURCHASE A FIXER UPPER HOME, because my closing was delayed four ( 4 ) times, due to alleged repairs and NOW I FEEL LIKE I WAS TAKEN ADVANTAGE OF! The closing was delayed four ( 4 ) times and the fifth ( 5th ) time was the charm, due to repair issues and after residing at XXXX XXXX for seven ( 7 ) months, I discovered how many of the alleged repairs were NEVER MADE just painted over!!!! The same areas captured in the XX/XX/XXXXInspection Report began revealing themselves in XX/XX/XXXX, i.e., gutters. I began doing research for homeowners insurance companies that would meet my specific needs and found XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX by XXXX XXXX XXXX XXXX XXXX Policy No : XXXX ( Declaration Page Attachment 6a-d ) OnXX/XX/XXXX, I received correspondence from XXXX relating to a routine inspection of your property in order to identify any exterior conditions that may affect the safety of your home. ( Attachment 7 ) This letter included the following damages : rotting soffits, fascia and/or eaves that need repair. I began researching gutter companies so I can make the necessary repairs/improvements to the XXXX XXXX property! The above-mentioned letter began my inquiries into making these improvements. I received a bid from XXXX XXXX, XXXX XXXX XXXX XXXX XXXX dated XX/XX/XXXX ( Attachment 8 ) On XX/XX/XXXX, I received correspondence from XX/XX/XXXX stating IMPORTANT NOTICE REGARDING THE STATUS OF YOUR POLICY. This letter insisted I contact State Home Mortgage to ensure the process of my homeowners insurance policy payment for XX/XX/XXXX XX/XX/XXXX for Policy No : XXXX and if payment was not received byXX/XX/XXXX, my homeowners insurance policy coverage would be CANCELLED! ( Notes & Attachment 9 ) Then, I called State Home Mortgage and spoke with XXXX XXXX XXXX XXXX XXXX XXXX, Loan Servicing Specialist Customer Service, who actually shared with me the following : Policy # : XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX GA XXXX XXXX contact {$720.00} paid onXX/XX/XXXX Prior to this information, I had NEVER RECEIVED any correspondence, policy, renewal or declaration page fromXX/XX/XXXXto XX/XX/XXXX. This is the exact time the REVEALING of the above-mentioned insurance came about and the reasons State Home Mortgage REFUSAL to pay XXXX homeowners insurance policy was exposed. On XX/XX/XXXXat XXXX XXXX, I spoke with XXXX at XXXX and we called XXXX XXXX via conference call to inquire about the discrepancy of homeowners insurance NON-PAYMENT and CANCELLATION on XX/XX/XXXX Allegedly,XX/XX/XXXX NEVER submitted the policy premium to State Home Mortgage was stated. On XX/XX/XXXX at XXXX XXXX I spoke with XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX XXXX, inquiring WHY I NEVER RECEIVED any correspondence, policy, renewal or declaration page from him and/or XXXX XXXX and he stated how he submitted the renewal to State Home Mortgage because their company PAID THE POLICY and I DID NOT! Pursuant a letter datedXX/XX/XXXX from XXXX XXXX Account Manager, XXXX XXXX ( Attachment 10 ), I have NEVER RECEIVED any correspondence, policy, renewal or declaration page from XXXX XXXX XXXX Third Party Administrator ( TPA ) and/or XXXX XXXX XXXX XXXX XXXX XXXX XXXX and/or XXXX XXXX XXXX until receipt of my homeowners insurance company XXXX XX/XX/XXXXletter IMPORTANT NOTICE REGARDING THE STATUS OF YOUR POLICY notice. In the XX/XX/XXXX letter, XXXX XXXX states,... services of an Independent Adjuster to assist me in documenting your claim by performing a field investigation. This independent adjuster was XXXX XXXX with XXXX, who investigated the XXXX XXXX property on Wednesday, XX/XX/XXXXarriving around XXXX XXXX spoke about hail damage, my roof looking as if it was put together in parts and how he could stand on the roof and look straight into the windows, along with stating the windows had been installed incorrectly. XXXX XXXX had NO IDEA an Inspection Report was done onXX/XX/XXXXOnXX/XX/XXXXat XXXX XXXX, in tears, I called XXXX XXXX to discuss the heavy rain water flowing through the top of my window frame going into a bucket to stop any further rain water damage to the home, wall and hallway! He stated he cant help me. OnXX/XX/XXXX at XXXX XXXX, in tears, I first spoke with XXXX XXXX ( sp ) and then to XXXX XXXX Supervisor with Georgia Dream, who stated he would look into the matter, get to the bottom of it and get back in touch with me. I explained to him about heavy rain water flowing through the top of my window frame, stopping it with a bucket and how my homeowners insurance has RIOT OR CIVIL COMMOTION and VOLCANO ERUPTION coverages for the state of Georgia, along with {$8500.00} of structural damage coverage. Again, I am XXXX years old, XXXX XXXX XXXX and living on a fixed Social Security XXXX income since XX/XX/XXXX and have almost exhausted my life savings with maintenance, installations, certifications, replacing and repairing what I can. Since I DID NOT PURCHASE A FIXER UPPER HOME, because my closing was delayed four ( 4 ) times, due to alleged repairs and NOW I FEEL LIKE I WAS TAKEN ADVANTAGE OF!! Since XX/XX/XXXX XXXX XXXX XXXX, personal care physician ( PCP ) has questioned WHY my XXXX is at such a XXXX XXXX and insists on my XXXX XXXX XXXX XXXX XXXX to AVOID a XXXX XXXX or XXXX ( XXXX XXXX is not related to me or my family in any way ) I have NEVER paid late, in arrears and/or delinquent in my payments to State Home Mortgage and I dont know what to do, who to speak with or how to stop the deteriorating of my 16-month purchased home, along with the collapsing and/or condemning of the structure due to hail storms, heavy rain water and wind damages to my roof and absorbing throughout the entire XXXX XXXX property. Am I victim of PREDATORY insurance practices, fraud or failure to disclose damages, so I could purchase the property at XXXX XXXX XXXX XXXX XXXX GA XXXX AT ANY COST and having the property condemned because of deteriorating and collapsing weather-related damages to the roof and LOOSE IT WITHIN A YEAR AND A HALF, due to water related exterior/interior structural damages? This was sent via email to XXXX XXXX on XXXX/XXXX/XXXX, this followed numerous emails to their office to XXXX XXXX. During this time I was told that they were experiencing a changes within the company and a system shut down had caused a modification that was applied for in XXXX to linger to still not be decided upon in XXXX, and that is why I may not have received any responses back. I was not given the opportunity and time needed to make informative decisions regarding my home. " Hello XXXX XXXX, XXXX loan number is xxxxx and I am hoping to reach someone about my options after forbearance. Initially, I was not explained that my home would immediately go into foreclosure if I was not able to bring the loan current before the end of the month. I received a phone call from one of your representatives on XXXX XXXX stating that foreclosure or approval of a modification were my only options. According to the plan contract, I was supposed to be contacted 60 days prior to plan ending and also sent a XXXX XXXX XXXX. I did not receive a phone call or the packet. I also requested a modification packet on XXXX XXXX and have not received that either. I am wanting to do all that I can to save my home. Please cooperate with me so that I am able to benefit from any of the options available to struggling homeowners. The cooperation from State Home Mortgage has been a standing problem for a many years that I have resided in my home. Just last year I was forced to file a complaint due to the neglect of XXXX XXXX refusing to respond appropriately to the submission of my modification request application forcing me then into this XXXX XXXX Offer. This offer, if I had understood the terms more clearly, would not have been an offer I would of settled upon. According to the woman that offered it, I would not have to worry about payments until the 6 months was over. She neglected to explain that I would not pick up payments regular payments after the plan ended. Yes, I do now understand the delinquency warning suggested that it would report to credit but it was not explained that the 6 months of payments were still due during the Forbearance time period. I am requesting a knowledgeable representative contact me at xxxxx and be ready to discuss all of my options to save my home from foreclosure. I desire assistance with modification once the modification paperwork is sent to me at my address. I would also would like to know what the meaning of reinstatement, repayment, and other alternatives to foreclosure mean and consist of with your company XXXX State Home Mortgage XXXX. Thank you, On XXXX XXXX I discussed the modification trail with XXXX XXXX. She notified me that there was a lien on my property and that will hinder me from getting an approval on my modification. I did speak to her about options of bankruptcy to clear the credit card charges off my credit and would that affect my modification. But I did not suggest that I would bankrupt my home for any reason. She has always been very aware that I would like to save my home of 10 years. I then asked XXXX to send me over the liens that she had so that I may confirm the liens at the XXXX XXXX courthouse. The same day I went down to the XXXX XXXX XXXX office and they notified me that there were not any liens on my property in their system. That there may be liens on my name or social security number due to credit or medical bills but not on my property. Due to me being self employed, he informed me that companies could not garnish my wages or place a lien on my property especially without me being personally notified of that. Never received any calls about missed payments or lien info until XXXX XXXX from XXXX XXXX. After leaving the clerks office I emailed and called XXXX XXXX back informing her of these findings and asking what was the next steps for the modification at this point. I have email on XXXX XXXX that proves that. XXXX has also informed me in reference to the other times in which they have tried to help me, that their notices to me have returned to them undeliverable. This was indeed the case for reference XXXX XXXX XXXX plan. XXXX advised it has return undeliverable so she will a new plan that would start XXXX XXXX. There were many times I had not received their notices. Just as Ive recorded my last conversation with them, that they had not sent me a trail plan default as they had suggested was given to me. XXXX then went back in his office and printed off the XXXX XXXX letter that I was supposed to get and said it should have been sent. I received this noticed on XXXX/XXXX/XXXX after receiving the notice that I breeched the forbearance agreement therefore receiving my XXXX and XXXX payments back from State home. The modification terms that State Home has breech reads as followed : If you successfully complete the Trail Period Plan by making the required payments, you will receive a modification with an interest rate of 3.50 % which will be fixed for 40 years from the date the modification is effective. * If we determine that the unpaid balance of your mortgage is more than 115 % of the value of your home, you will be eligible to have up to 30 % of your principal balance deferred First payment effective XXXX XXXX for XXXX, XXXX XXXX, and XXXX XXXX. All payments were completed as agreed upon and there was still no agreement or approval of modification after this time. The conversation about Liens happened 3 months later ( still making trail payments at this time ) when I was supposed to be completed with trail period according to the agreement. Furthermore, there has been no contact or written notice of explanation given to me beyond our last email on XXXX XXXX. I was not sent an official denial notice, state home continued to accept my trail payments, and they also sent me a payment coupon book to resume regular payments of XXXX as of XXXX XXXX, XXXX. This lead me to believe that they had cancelled the modification and now I was to make regular payments. Everything has resulted in domino effect due to their negligence to handle these agreements in a timely manner. They have done nothing to help me as a home owner. The past modification that was suggested that I did not qualify for was based upon their negligence to account for paperwork that had been sent to them from the HUD counseling center. We have had nothing but problems with getting paperwork and cooperation from state home. It is so bad that a representative over heard my complaint while in the office speaking to XXXX and pulled me to the side to suggest to me how to get around him to save my home. The employee left the company but she is the reason why the first modification was approved and I was able to apply for the HARP. No one that helped me offered any of what this said employee offered me off the record. It is sad that they do not offer what is indeed in place to help homeowners afford their homes in such a trying economy. If I need to provide any emails or recording, I can provide that. I also have my contract that they also received that specifically states that it ended XXXX XXXX. I would of never told them that I didnt have a job. I have been self-employed for that last 4 years. I paid all my trail payments on time up until XXXX. I am not unemployed, I am self employed. Mortgage Statements Present receipt of payments for the following months in question : XXXX. AFFIDAVIT OF TRUTH 1. According to USC 1602 ( I ), XXXX XXXX XXXX is considered a consumer, in that the home mortgage transaction of XX/XX/XXXX was for personal, family and household purposes, regarding the real property at XXXX XXXX XXXX, XXXX, Georgia. 2. Georgia Housing and Finance Authority ( GHFA ) was the assignee of a security deed given to XXXX XXXX in XX/XX/XXXX. Atty XXXX XXXX ( of XXXX and XXXX, XXXX ) is an agent for GHFA. State Home Mortgage ( SHM ) is a loan servicer ( also an agent ) for Georgia Housing and Finance Authority. Neither State Home Mortgage, nor Georgia Housing and Finance Authority are registered with the Georgia Secretary of State, as any type of corporation. 3. State Home Mortgage harmed XXXX XXXX XXXX, by violating OCGA 11-3-603 ( b ). Beginning in XX/XX/XXXX, she mailed in 8 tenders of payment, on time, via certified mail, to mortgage account XXXX, as follows. 1. XX/XX/XXXX, personal check XXXX, this check was processed in a timely fashion XXXX XXXX, personal check XXXX, this check was returned, claiming it was not acceptable. XXXX XXXX XXXX sent the check back to State Home Mortgage, noting that there was no defect with the check, seeing that they had processed the previous month 's check completed in the same fashion. XXXX check was held by SHM, and never processed. 2. XX/XX/XXXX, personal check XXXX, this check was processed in a timely fashion 3. XX/XX/XXXX, personal check XXXX, this check was returned, now with the excuse that 2 months ' payments were outstanding. XXXX XXXX XXXX also returned this check to State Home Mortgage, noting that they had processed both the XX/XX/XXXX and XX/XX/XXXX checks, with no issue, and that they should also immediately process the XXXX and XXXX checks. XXXX check was held and never processed. 4. XX/XX/XXXX, personal check XXXX, XXXX check was held and never processed. 5. XX/XX/XXXX, cashier 's check XXXX XXXX XXXX. XXXX cashier 's check was held and never processed. 6. XX/XX/XXXX, personal check XXXX, XXXX check was held and never processed. 7. XX/XX/XXXX, personal check XXXX, XXXX check was held and never processed. The above acts constitute multiple violations of ( Georgia Code ) OCGA 11-3-603 ( b ) - If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge. Relief sought : Discharge of the 6 months payments that were tendered on time, to State Home Mortgage, Remove any late fees accrued, Return of all 7 of the instruments listed above, which should not have been held by any loan servicer, for any extended number of days. 3. As a result of the tenders of payments refused by State Home Mortgage, XXXX XXXX XXXX has been harmed, by putting the mortgage account XXXX in default status, not to mention the missed work, required to address this situation and related stress. 4. State Home mortgage never responded to affidavits delivered on XX/XX/XXXX to the default department, and CFO, XXXX XXXX, requesting that the refused payments be processed. 5. Recently, State Home Mortgage and/or Georgia Housing and Finance Authority contracted with law firm, XXXX XXXX XXXX XXXX XXXX XXXX via Atty XXXX XXXX ), to threaten XXXX XXXX XXXX with foreclosure, under the power of sale in a security deed, transferred to Georgia Housing and Finance Authority in XXXX of XXXX. 6. However, the Promissory Note that XXXX XXXX XXXX made out to XXXX XXXX ( the loan originator ), was never transferred to Georgia Housing and Finance Authority, along with the corresponding security deed. With these two instruments bifurcated, Georgia Housing and Finance Authority HAS NO STANDING TO FORECLOSE on the property in question ( XXXX XXXX XXXX, XXXX, Georgia ). 7. XXXX XXXX XXXX did request ( in writing ) specific verification that Georgia Housing and Finance Authority is the present holder in due course, of the corresponding promissory note, from Atty XXXX XXXX, by XX/XX/XXXX. No reply was received as of XX/XX/XXXX. Therefore, I understand that Georgia Housing and Finance Authority is not the holder in due course of the promissory note. 8. As such, Atty XXXX XXXX and State Home Mortgage ( as agents for Georgia Housing and Finance Authority ), are both in violation of USC 15, 1692 ( f ) ( 6 ), ( unfair debt collection practices ) by threatening foreclosure to the consumer, XXXX XXXX XXXX, and causing me and my family extraordinary hardship and stress. Relief Sought : Cancel Invalid Security Deed, Remove late fees, Remove derogatory reports to credit bureaus 9. Contacting me again after receipt of this notice without providing procedurally proper validation of the debt, constitutes the use of interstate communications in a scheme of fraud, by advancing a writing, which is false, with the intention that others rely on the written communication to their detriment ; a violation of United States Code TITLE 18 PART 1 CHAPTER 63 1341.

The above acts constitute multiple violations of ( Georgia Code ) OCGA 11-3-603 ( b ) - If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge. Relief sought : Discharge of the 6 months payments that were tendered on time, to State Home Mortgage, Remove any late fees accrued, Return of all 7 of the instruments listed above, which should not have been held by any loan servicer, for any extended number of days. 3. State Home Mortgage ( servicer of FHA loan ) acting on behalf of Georgia XXXX was made aware of my Chapter XXXX discharge XX/XX/XXXX. I requested approval for short sale XX/XX/XXXX XX/XX/XXXX, and again XX/XX/XXXX. State Home Mortgage representative XXXX XXXX advised that a non-traditional short sale would be approved. State Home Mortgage was aware that the house was under contract for {$180000.00} and that I had hired a realtor to represent my interest in the sale. State Home Mortgage collected all appropriate documents XX/XX/XXXX ( sales contract, realtor representation agreement, hardship letter, previous contracts, etc. ) related to the sale. State Home Mortgage knew that XXXX additionally liens where on the title ( down payment assistance lien and XXXX lien ) and knew that I had no intention of keeping the property due to prior history of construction and safety issues with the property. XX/XX/XXXX I showed up for the closing and was advised that I had I need to write a check for approx. {$1000.00} ( of which I do not have ) related to the XXXX lien on a property that I surrender in Chapter XXXX bankruptcy. State Home Mortgage actions in fact was an approved short sale as 1 ) the document I signed prior to closing clearly stated, 2 ) emails to the buyer 's attorney from State Home Mortgage, and 3 ) they knew that the XXXX lien was their responsibility to clear on the property that I relinquished in bankruptcy per my discharge papers and Statement of Intention. However and again, they had me sign papers for a short sale and they advise ( XXXX XXXX, XXXX XXXX, and then escalated to the manager XXXX XXXX ) would have to pay the XXXX lien out of the reserves they would have given me under the provision of HUD short saleXXXX ( i.e., " cash for keys '' ). At closing, they sent a payoff that did not include the XXXX lien payoff which has created an alleged liability of {$1000.00} for me that under Chapter XXXX bankruptcy was discharged. Further according to the XXXX mediator, State Home Mortgage NEVER submitted the file for short sale approval by HUD although they had ample documentation submitted since XXXX to them and they fact that I personally visited and gave them every accounted detail of the transaction ( i.e., pictures of the damages, hardship letters ( XXXX ), income documentation showing financial hardship, tax returns, bills, etc. ) documentation showing financial hardship, tax returns, bills, etc. ) My compliment is that I was refused the benefits of a short sale although this state/governmental agency in their actions accepted and agreed to the terms of the short sale. This state agency did everything to make this process of relinquishing this property out of my name ABSOLUTELY DIFFICULT. I sent numerous letters, factual evidence, and complained to the HUD Mediator, and complained to State Home Mortgage prior to the XXXX forcing me into bankruptcy. The state agency employee, XXXX XXXX, lied to my realtor and the HUD mediator that this was not a short sale. As such the XXXX Mediator refused to listen to my compliant that the mortgage servicing was indeed processing the sale as a short sale, period!!!! The email and documents I was encouraged to signed with Georgia XXXX XXXX XXXX stated SHORT SALE. XXXX XXXX advised that the only way I could receive any funds ( i.e., " cash for keys '' ) to assist with moving was to 1 ) do a short sale or 2 ) allow the bank to foreclose. He advised of a short sale and that they would satisfy the XXXX lien. However, they forced me to sign a document to relinquish the 2nd lien and advised that they would send me a XXXX form to be claimed on my taxes. That is predatory and discriminating as per the bankruptcy. I am not personally responsible for any lien on the property that I surrendered in bankruptcy.

The XXXX Rescinded this transaction with the purported Mortgage Company along with copies sent to this Debt Collector in XXXX. The Rescission was done pursuant to XXXX XXXX XXXX XXXX XXXX XXXX a UNITED STATES SUPREME COURT DECISION. The Debt Collector ignored this Rescission according to notarized XXXX County Recording. The Debt Collector was sent paperwork to discharge the Debt and the Debt was taken off then put back into files. I have a sale on XXXX XXXX which is this Tuesday. I 've been speaking with different ppl and doing research where I came to a realization that something is n't right. Before I begin I would like to say that the customer service is awful. For one it 's hard to get in touch with someone. Two the times I have spoke with someone other than the supervisor there were attitudes which is unprofessional. I had a slight argument on XXXX separate occasions with someone name XXXX. I believe that 's her name but her attitude needs to improve. The first incident happened when noticed the tone in her voice ( talking to me with an attitude ) which i told her do not get smart with me. The 2nd incident was we were talking about making a payment. She asked me was I 'm ready to make a payment. I told her yes but I have to put the money in my account first. She asked was the money in my account I told her no. I explained to her again that I have to put the money in my account before I make the payment electronically. She then tried to argue me down and try to tell me that I told I her yes when in fact I told her no when she asked me was the money in my account. From that point on I decide that I will directly with the supervisor. After missing XXXX and XXXX payments due to financial hardship I was told by XXXX that the foreclosure process would begin if I did n't have both XXXX and XXXX payments by XXXX XXXX. When I made XXXX payment I dealt with XXXX the supervisor. He was helpful as far as holding off from signing off on the foreclosure and giving me extra time to make the payment. I explained to him that I began doing real estate wholesaling and that I was closing on XXXX of my deals which I 'm still waiting to get paid til this day due to constant delays. What I realize now is 2 things. 1st is when I was told by XXXX that they will foreclosed on my home after missing XXXX and XXXX payments. She quickly mentioned that to me but did n't bother to tell me about different programs they have to offer in order to help me prevent foreclosure. I spoke with XXXX multiple times throughout the process and he never told me what other programs they have to offer either but he 's the supervisor. According to my research, mortgage companies are suppose to tell the mortgagor what other options they have to prevent foreclosure which State Home Mortgage failed to do. With me being a first time home buyer, different should have been explained to me. 2nd is I received a letter from SHM on XXXX XXXX regarding my loan being approved for foreclosure. The kicker is that the letter was dated XXXX XXXX, 2016 which I thought was ridiculous. It says that my loan was scheduled to be referred to a foreclosure attorney on the morning of XXXX XXXX even though I received the letter on XXXX XXXX. The letter shows on the XXXX page what options are available to prevent foreclosure but it was already too because I receive the letter after the fact. Way to go and thanks a lot. It 's crazy that I received this at the time that I did receive it. I called the supervisor XXXX and left him a message and heard from him the following week. I feel that letter could have been sent to me at least 30 days in advanced because I 'm pretty sure some of the options available will take a while before a final decision is made. I did n't get the at least 7 days prior. Those are my issues with this company. Now I see why there 's been a lot of bad reviews and lawsuits.

On XX/XX/2021 my closing attorney reached out to STATE Home Mortgage, for my final payoff quote for my mortgage. This being due to the fact that I recently was selling my home and the loan was going to be paid off in full. The payoff request was faxed to the fax number notated on State Home Mortgage 's website. Upon checking back with the attorney to see whether she had received the pay off quote, she told me no. She had not received any correspondence yet, as to the request. I proceeded to contact State Home Mortgage myself, to find out what the status was on my attorney receiving the payoff quote. They then proceeded to inform me that it needed to be emailed, that they did not receive anything. Upon receiving the payoff quote back within my HUD settlement agreement, it was quoted that I owe a total of {$24000.00} for my first loan and {$7500.00} for my second loan. This grand total equaling {$32000.00}. Please see attached documents I have also attached the payoff information that was forwarded to the attorney. Upon conducting my closing, the transaction was closed and everything was finalized. All monies were disbursed according to the HUD statement. A week later my attorney called me back informing me that my mortgage company contacted them and the payoff quote they provided was short by {$100000.00}. The correct amount upon receiving the new payoff quote was {$95000.00}. The amount in which this payoff quote was off is totally unacceptable. It was a week before this situation was brought to my attention, after I continuously called to check and see if the payoff payments were applied to my account. I could have spent the money, bought another house, I would then be sued for the remaining balance from the people who bought the home. The title would no longer be free and clear. This situation created a major hardship for me and was handled in a very negligent way. I have reached out to the Manager at the payoff department and asked that disciplinary measures be taken on this employee for this negligence. She should no longer be able to continue to serve in the capacity in which she serves. I asked the manager who's name is XXXX XXXX, what the person 's name is who requested the original payoff quote. She did not inform me of her name. There is only a signature on the payoff information that was sent to my attorney. I believe her name is XXXX XXXX. This matter needs to be tended to, to where this type of careless mistake does not happen again. When you are dealing with something as serious in nature as high dollar mortgage payoffs, the individuals in these positions should be thoroughly trained ; to know how to properly carry out this type of major transaction. Your attention to this matter is urgently needed.

On XX/XX/2018 ( 38 days before foreclosure ) we submitted by fax requested information of getting loan modified due to death in the family of primary mortgage holder ( XXXX XXXX ) per conversation with Mr. XXXX XXXX of State Home Mortgage. Mr. XXXX verified that he had received the docs on XXXX XXXX. On XX/XX/2018 Mr. XXXX needed more documents an asked for info on roommate and it was sent via email given by Mr. XXXX. After two weeks had passed with no calls, emails or any other form of communication a call was made to Mr. XXXX concerning status and was told that a letter was sent out requesting documents ( to our suprise ). We waited another 3 days but still nothing came in the mail so another call was made and another representative unknown started inquiring about the loan and made reference to proof of residency after having provided the requested documents on XX/XX/2018. The file had been closed because information hadnt been received but nothing was ever asked. She then requested more documents and said that an email would be sent to detail everything. So on XX/XX/2018 ( Friday ) an email was sent requesting detail documents and those documents were sent back on XX/XX/2018 ( Monday ). After a 3 days a call was made but no answer, 4 days another call but no answer. Another call was made on the XXXX but no answer so an email was sent asking for updates but no response. After routinely calling everyday finally a voice picks up on XX/XX/2018 and Mr. XXXX informs us that file was turned down due to missing information not being turned in before the deadline on XX/XX/2018. I explained to him how can it be turned down for missing information that you just emailed us on XX/XX/2018 that was promptly given to you on next business day. Mr. XXXX said the lady that was handling this was out an wouldn't be back until after the foreclosure day. He said he would call back but we have yet to hear from him and I dont expect he will he hasnt been trustworthy in responding. While we had been going thru all this foreclosure proceeding was still proceeding. We have always provided the information that was needed in a timely manner, and have done as asked accordingly. We had thought to work something out but now given that it is 3 days before foreclosure and we havent resolved this we are forced to do the drastic measure of possibly filing bankruptcy. State Home Mortgage XXXX or XXXX or XXXX call contact numbers that me and many other consumers are having issues with when calling in to get answers on mortgage matters. I received a call from State Home Mortgage on XXXX/XXXX/XXXX at approx XXXX EST asking me when do I plan on making payment. I felt that this number one was very unprofessional versus asking me what is going on or if I was aware that they had not received payment. I then explained to the representative that I made my payment via online Bill pay through my financial institution on XXXX/XXXX/XXXX and that the payment was taken out of my checking account on XXXX/XXXX/XXXX. I then proceeded to ask since the check that is cut and mailed out is post dated if I would receive any late fees the rep stated yes if they do n't receive payment by the XX/XX/XXXX. Why is this this does not seem to be fair or ethical maybe I am wrong. So I immediately called online bill pay to have an escalation to have them do further research on where the check is. Upon calling back on XXXX/XXXX/XXXX numerous of times and selecting the option to speak with customer service directly again at State Home Mortgage the phone lines kept disconnecting my call as if their were some technical difficulties. Once I was finally able to get someone on the phone they stated they are aware of the issue but it is due to their high call volume. Sounds like they need more representatives. Upon reading XXXX reviews I discovered after being locked out of my online account to review information as it pertains to my mortgage that it seems as if State Home Mortgage has deceptive practices that I feel need to be investigated immediately. One being their phone lines and no one being able to get the answers they are looking for and two getting a call back in a timely fashion upon leaving voice mail after voice mail after voicemail. It is ridiculous and shameful that I have to call 20 something times for their phone line not to hang up on me. Another issue that many consumers are having is not being able to make a payment on their website as the representative suggested to me because they are having issues with Bill Pay. What type of issues when a check is cut and mailed to you all 15 days before I am late with the exception of myXX/XX/XXXX payment.

My mortgage was paid off XX/XX/XXXX, yet State Home Mortgage/ XXXX XXXX XXXX XXXX held my check and didn't report my payment until XX/XX/XXXX and erroneously reported me late with the credit bureaus. ( I have proof and can provide upon requests ) Additionally, during the process along the way I have documented proof of contact with several employees from this company that was communicating either with myself and/or the closing Attorney leading up to the payment being made. ( I can provide that proof upon request ) When I first discovered this error I made numerous attempts to contact them both via phone and e-mail. My e-mails, voicemails and phone calls were ignored and never returned. ( I have proof and dates, can provided upon request ) After I was being ignored by way of no return calls and/or e-mails I submitted a complaint with CFPB ( previous complaint number XXXX-XXXX ) CFPB made numerous attempts to contact State Home Mortgage and over 30 days later still no communication. ( I even have proof of a letter I received from CFPB stating how unacceptable it was that neither of us hadn't heard anything from this company and that I had to wait that long. By late XX/XX/XXXX I got a credit alert that State Home Mortgage had finally reported the mortgage as paid off. However, State Home Mortgage/ XXXX XXXX XXXX XXXX is still fraudulently reporting me late for 6 months on my credit reports. Additionally, I was owed a balance from funds in my escrow, and they have illegally retained those funds. This is my last effort to resolve this matter with this creditor, before I seek other legal options. What they've done to me is illegal and atrocious. They delayed updating my mortgage to show my loan paid off. They didn't respond to my attempts to contact them for over 90 days, and they didn't respond to CFPB for over 30 days involving my ( previous case XXXX-XXXX ) Once they finally reported the loan as being paid off after over 6 months, again no one tried to return my calls nor e-mails to discuss what was the cause for the delay. Additionally, they have illegally retain my rightfully owed funds from my escrow. This is fraud and I want an example to made out of everyone who was involved. This has not only affected my credit, but it also has affected my life.

I would like to file complaint on State Home Mortgage. I have been with this company for a decade and I have always had such difficulty with loan servicing with them. The personnel there is very rude and are not there to support the home owner in any way. 1. On XX/XX/XXXX I received a 6 month forbearance after receiving payments of {$710.00} from me once last payment from XXXX XXXX XXXX ended on XX/XX/XXXX. 2. On XX/XX/XXXX I received a modification trail plan payments to be effective for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, which I paid as agreed. I continued to make the trail plan payments until XX/XX/XXXX. My complaint is that XXXX XXXX XXXX XXXX never issued me a permanent modification. They signed the modification plan/contract on XX/XX/XXXX to start the trail plan agreement. In the interim, I 've received a coupon book in XX/XX/XXXX for payments of {$710.00} starting XX/XX/XXXX with interest rate of 4 % which is not in line with the modification agreement which stated an interest rate of 3.5 %. Which were the payments of {$680.00} that they 've collected from me the months of XX/XX/XXXX-XX/XX/XXXX. During the time of waiting on the said modification to be approved, life has happened where I struggled to get payments in for XX/XX/XXXX and XX/XX/XXXX. I sent a check/payment in to State Home Mortgage for the amount of {$1500.00} for the months of XX/XX/XXXX and XX/XX/XXXX plus coverage for any late fees assessed on XX/XX/XXXX. I assumed I would need to pay the {$710.00} after receiving no response from emails and seeing that my online account had not been updated to reflect accurate information. I have been in constant contact with XXXX XXXX and has filed a second investigation with them. They are also confused on what has happened after their last in counter to remedy this issue with State Home Mortgage after they had advised them to place me on the Streamline Modification. I have also had to obtain a lawyer to communicate on my behalf going forward due to so much push back from XXXX XXXX of State Home Mortgage on providing me with the correct information on my case to save my home from any other delinquencies and/or foreclosure.

I have been contacted concerning a debt I attempted to pay. I am running behind in my mortgage payments and have had continuous communication with them pertaining to why I fell behind. I usually pay the current month but on the last day of the month while attempting to get caught up. XX/XX/XXXX I was unable to go to the mortgage company to provide them my payment as my manager called a mandatory meeting. I explained that and stated I would pay them tomorrow morning. I was denied by XXXX XXXX that payment and she advised they would need to collect 2 months at that time. I have not signed anything pertaining to this type of agreement and have nothing in writing from this institution pertaining to this type of agreement. I advised XXXX XXXX at that time I can not pay two months and if I had to, I could not pay it until the end of the month. Additionally I have paid and they have sent my payments back to me on occasions. This causes an adverse rating on my credit as well as additional charges due to being late. Also I am charged for property inspections when I am delinquent. I have written to ask why no payments are being reported on my credit report to no avail. I realize I filed bankruptcy in XX/XX/XXXX but they were excluded and still they will not report anything on my credit. I also have a second loan which is a balloon payment. No one can seem to find that second loan. I am almost positive these actions are to take my house from me. My loan was sent to foreclosure while working with my mortgage company in XX/XX/2016. I do not want my loan to go back into foreclosure. I was unemployed and not able to pay my mortgage XXXX XXXX. I got in touch with my mortgage company. I was told to submit information to XXXX. I was denied but started a new job. In XXXX, I was then told to work with another department in mortgage company for options on bringing my loan current. I submitted the paperwork as requested and my loan was sent to foreclosure XX/XX/2016. I was told to wait and not make payments because the mortgage company was working with HUD on my loan. In XXXX, five days before my house was to be sold, I was told a claim would be filed with HUD on my behalf. I was to make payments starting XXXX. In XXXX, I received the claim paperwork which listed my mortgage as 9 months behind. From XXXX is only 7 months. The payment I made XX/XX/2016 is being held in suspense. The information in the document I received from an attorney regarding the HUD claim states if I default on my mortgage loan the exasperated figure must be paid immediately. I pay mortgage insurance with my loan as well. This document also states that I give over the right to sale my house. I called the attorney and no response. I contacted the mortgage company and they are not being honest. My loan should have never went to foreclosure in XXXX. I fear it will go back into foreclosure before this is resolved. I only want to pay my mortgage. I was going on their advise but was never given the option of just paying the money owed. Now the numbers are exaggerated and I am only being given the option of filing a claim with HUD.

State Home Mortgage was in possession of a check in the amount of {$200000.00} payable from XXXX my insurance company for losses my home incurred as a result of a fire XXXX XXXX, 2016. On Thursday XXXX XXXX I received a call informing me that the loan ( XXXX ) was paid off. That decision was made due to miscommunication at State Home Mortgage. I did not receive answers to my questions regarding loan pay off ; I did not sign an agreement for pay off, I did not receive an email or phone call providing answers to my questions regarding loan pay off, nor the company 's intent to pay off the loan! XX/XX/XXXX, I left a voice mail for XXXX XXXX ( XXXX ) expressing my interest in discussing a loan pay off. I called back within 24 hours and spoke with her. Expressing my intent to rebuild the structure, I also posed several questions including pay off amount and role of mortgage company regarding quality assurance. My decision to pay off the loan was contingent upon answers to those questions and more. Although XXXX XXXX understood my need to secure answers before making a final decision, she was incapable of providing them, noting the complexity involved in my desire to rebuild and payoff the loan. She eagerly promised to speak with XXXX XXXX and/or others with expertise in the area and call me back later that week. Ive tried to make several attempts with my lender State Home Mortgage to bring my account current. They have returned several payments. They have never offered me a forbearance, payment plan, nor a loss mediation option. All communications amongst XXXX XXXX ( Supervisor ) and I were total fabrications and a waste of time. Every time he quoted a different amount and expressed how They Do Not Except Partial Payments.Which after being told by Ms. XXXX ( account manager ) and himself so many times it became redundant. SHM denied receiving the check for two weeks, rejected my XXXX, then said they had the check however it was titled incorrectly. XXXX XXXX XXXX mailed them a check titled the same way in the amount of {$380.00} and it was cashed. While the money order I dropped off was returned to me twice as partial payment. Mr XXXX also violated the Privacy Act on XX/XX/2018 by releasing private non public information about my mortgage to a XXXX XXXX ( volunteers at church ) without my consent to release any information.

On XX/XX/XXXX I requested cancellation of PMI ( I called several times within the last 2 years to request but was told I was not allowed to request this ). This time I stated by law that I was allowed to request cancellation. I received my denial letter, but I have read the homeowners protection act, and I don't feel that legally they should be allowed to continue to force me to pay PMI. I was first time homebuyer, and I assumed that it would go away once I reached below 80 %. My home is valued at {$150000.00} by the county and my principal unpaid balance is {$59000.00}, and I have been below the 80 % for quite some time. I have looked into refinancing my home, but the interest rates have risen, and combined with closing costs, this would cost more than continuing to pay PMI for the life of the loan. Everyone I have spoken with regarding this had never heard of PMI for the life of the loan, and I feel this should have been disclosed to me at closing, but was not.

The problem is State Home Mortgage made errors on my account and instead of acknowledging their error, they are hoping the problem goes away. I would like a resolution for this fraudulent company. My mortgage was sold to this horrible company soon after the closing and I have had the worst experience possible. This situation is regarding them not paying my mortgage insurance which wiped my escrow account the following year, which resulted in a major increase in my monthly payments. I went above and beyond in XXXX to make sure my payments were lowered and due to SHM not taking the time to catch the error my account is now ruined. They calculated the incorrect amount for my future insurance payments which did not cover the actual insurance payment, and the insurance company DROPPED my account. So, I was stuck with no insurance and a high mortgage payment. They did nothing to fix the issue.

I was approved for a loan modification. As with any business offerings I was presented with a contract, and they supposedly explained all details. However one detail was missing, an explanation of corporate fees. According to a letter I received a letter months later, I had accumulated almost {$3000.00} worth of these fees. These fees were not initially mentioned and I was led to believe this process would cost me nothing out of pocket. I was approved for the loan modification and my payment was lowered and I was able to catch up my mortgage. However I ran into some financial trouble where I missed 1 payment. This is when my mortgager made me aware of these fees. It was only after I missed this one payment that my mortgager began demanding payments for these fees. This Debt Collectors ( STATE HOME MORTGAGE ) Attorney XXXX & XXXX, went to the Courthouse Steps and Foreclosed upon property that they did not verify nor validate, and allowed, a third party purchaser to buy something that was Rescinded on XX/XX/XXXX, and they purportedly sold the property in XX/XX/XXXX. They did not have any standing to do that because the transaction was rescinded. They only ignored it and then the THIRD PARTY DEBT COLLECTOR ( STATE HOME MORTGAGE ), sent communication stating that the Property was paid for. The Attorney ( XXXX XXXX XXXX ) sent an acknowledgment, waiver and release agreement for {$22.00}, XXXX to release them from being responsible for their error. The Servicer foreclosed on my home in spite of the Rescission that was done in XX/XX/XXXX, they said I owed money, I sent an XXXX, and they foreclosed in XX/XX/XXXX despite the Rescission of the loan, and they tried to send me {$22000.00} afterwards to Acknowledge, Waiver and Release Agreement for them so they wo n't have to answer for the injustice that they have created for myself and my family members. We have had a mortgage with State Home Mortgage for 5 years. We have never missed a single payment during that time. We are now trying to sell our property and buy a new home. In order to process our new mortgage, we need the most recent statement from the mortgage we hold with State Home Mortgage. I have a good solid contract and the buyer has already been pre-approved for the loan. The bank will not consider the short sale. Also, when I phoned the bank regarding foreclosure alternatives, it was relayed to me that my only recourse was to do a short sale. No one ever informed me about being able to apply for a loan modification. I had to go to an outside source to learn about this particular foreclosure alternative. I am trying my hardest to get this done. At this point I am desperate for assistance and I am reaching out to you as a consumer for help. When I purchased my home, I used the Georgia Dream program, which gives {$5000.00} towards closing costs and down payment. I was told it would be a 2nd lien on my property, but that it would go away after 5 years. I just learned that it does not go away and has to be paid back upon refinancing or selling of the property. I have spoken to other people who signed up for this program and they also thought the lien would go away after 5 years. There is not enough information online regarding the Georgia Dream program and I could not look this up to verify it. It is not fair to market something like this only to find out later that it has to be paid back unless you stay in the house forever.
