We are reaching out because we recently tried to sell our house and discovered that there were two partial claims totaling about {$50000.00} that we did not remember agreeing to and we were unaware was being processed through FHA not our lender. We thought we were accepting a loan modification without a partial claim, and when we signed the paperwork for the second partial claim in XXXX of XXXX we were told by a representative of our lender that it was some paperwork needed for the first partial claim we got back in XX/XX/XXXX, not an entirely new partial claim. Because of the partial claims, our house is worth less than what we owe on it, and we attempted to pursue a short sale of the property however because the partial claims were through FHA rather than with Bell Bank we were unable to do a short sale. We are now looking at foreclosure being we can no longer afford the house and with two liens/claims on the house we can not make a profit, break even or do a short sale. I am also including a communication with Bell Bank as we had reached out to them prior to accepting an offer on our house as we were unsure fully what we owed on the house and wanted clarification. As you will see in the email we were told we owe nothing other than the mortgage balance on the house which is {$140000.00}, we were also told this in phone conversation with a rep with our lender. This was highly inaccurate information they gave us which led us to taking an offer on the house that fell short of what we actually owed.

XX/XX/XXXX ( phone call ) -I was told there was a $ XXXX contingency and there was none.
XXXX ( email ) -I reported the concerns of unlicensed contractors during our build, and they washed their hands of it.
Builder sought over $ XXXX at reconciliation ; claiming he wasnt paid for the land, and I owed him $ XXXX out of pocket. Many of these discrepancies werent rectified until I provided the accounting showing the inaccuracies, receipts payable, and credits not disclosed.
The contract states, " Your contract contains a provision that all change orders were to be paid at the time of the change order signing. '' This was done with proof of record. If not, or the funds weren't available, Bell Bank should not have released the funds for such. Therefore, giving me ( the borrower ) the option to pay the builder out of pocket or not approve the change order.
I did not receive inspection reports until I asked for them at final reconciliation.
