The collection agency ( Sprechman & XXXX, PA ) is attempting to collect on a non-valid, non-validated and disputed debt within the thirty-day period in direct and blatant violation of FDCPA 809 ( b ) Validation of Debts. Disputed Debts : Summary of Salient Facts : XXXX/XXXX/XXXX : Date of letter by Sprechman & XXXX, P.A. indicating that your office represents XXXX XXXX, XXXX for an account with an alleged delinquency. XXXX/XXXX/XXXX : Alleged delinquency letter was delivered to XXXX XXXX at XXXX XXXX XXXX, XXXX XXXX, FL XXXX. XXXX/XXXX/XXXX : XXXX XXXX mailed letter to XXXX XXXX XXXX advising that collection agency was attempting to collect on a non-valid debt and requesting confirmation that collection agency was would no longer be attempting to collect on this non-valid debt. XXXX/XXXX/XXXX : Sprechman & XXXX ( as Attorney for Plaintiff XXXX XXXX, XXXX ) filed a Complaint and issued Civil Actions Summons against XXXX XXXX and XXXX XXXX alleging a breached contract with Plaintiff. Both the Complaint was filed and Summons issued ( these both constitute an attempt to collect a debt ) prior to the 30-days in which XXXX XXXX was in receipt of original alleged delinquency letter. It was also filed after the letter sent to - and likely received by - Sprechman & XXXX informing them that they were attempting to collect on a non-valid debt. XXXX/XXXX/XXXX : XXXX XXXX emailed an electronic version of the letter ( that was originally mailed on XXXX/XXXX/XXXX ) to XXXX XXXX of collection agency per XXXX instructions. XXXX/XXXX/XXXX : XXXX XXXX was served the Civil Actions Summons at XXXX XXXX XXXX, XXXX XXXX, FL XXXX. Serving a Civil Actions Summons is an attempt to collect a debt. XXXX/XXXX/XXXX : XXXX XXXX received a letter from Sprechman & XXXX informing me that I have been served with a lawsuit and instructions to call the Collection Department. Bottom of letter states, " This is an attempt to collect a debt ... '' Sprechman & XXXX has had many violations of the Fair Debt Collection Practices Act ( FDCPA ) 809 ( b ) Validation of Debts. Disputed Debts, by continuously attempting to collect on a non-valid and disputed debt. The open complaint is a continued and ongoing attempt to collect on this non-valid, unverified and disputed debt.

On XX/XX/XXXX, I received XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX. ) XXXX was botched badly. I am constantly in Hospital with XXXX 's, XXXX 's, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX For almost 2 years I was not aware that XXXX XXXX took out a loan with XXXX XXXX for an amount I think I found out with last mediation from XXXX of XXXX dollars. I was under the assumption pmts was to be made to XXXX. As per the agreement. I found out in XXXX that this was not the case. I told XXXX XXXX XXXX XXXX, that last time in mediation, but now they are going after my only one car and stated that they would lean it. if i don't pay. I HAD NO KNOLEDGE OF THAT LOAN!!! I DID NOT GIVE PERMISSION FOR THAT LOAN. I HAVE TRIED TO RECTEFY BY MAKING SMALL PMTS SINCE THEY ARE RUINING MY CREDIT!! I tried taking XXXX to court to have the credit charges reversed to XXXX XXXX, but got entered a default judgement, since I was in Hospital and Defendant Attorney gave me a wrong court date. But now XXXX XXXX wants close to XXXX. And I am having severe medical complications due to negligent of XXXX XXXX and XXXX Again.. I thought I had a loan with XXXX. I did not give permission for any other credit Also this is my only car ... ..I had my last one for 10 years with XXXX before I bought another ... Request that car will not be liend. I request that XXXX returns the money charged to that creditor for whatever amount it was ( I do not know, since I never saw the amount. ). And removes those entries from court records and my credit. XXXX XXXX Yes I gladly give my name to ensure that others can learn from my experience and be more vigilant. I was a victim of greed. I was not aware that credit was taken out on my behalf. I still do not have a copy of that paperwork I signed.. imagen that... Again.. please help.. I have tried every avenue between the more than XXXX XXXX and endless hospital stays. Request that XXXX XXXX gets refunded by XXXX XXXX, and XXXX XXXX in XXXX XXXX, for my botched XXXX that has cost me my health and my life. On Thursday, XX/XX/XXXX at approximately XXXXXX/XX/XXXX I made an initial call, in earnest , to Sprechman & Fisher regarding Case No. XXXX to begin discussion for a payment arrangement ... I spoke to a collector, " Ms. XXXX '', who began the call stating aggressively stating, " BY FEDERAL LAW, THIS IS AN ATTEMPT TO COLLECT A DEBT! '' without providing the FULL Mini-Miranda. Ms. XXXX repeated the statement again stating, " This is an attempt to collect a debt! " ... In addition, during the conversation, I expressed I wanted to discuss payment arrangements and " Ms. XXXX '' kept talking over me very loudly and extremely aggressively. I shared with " Ms. XXXX '' that the tone of her voice was extremely aggressive/threatening of which I found to be an attempt to control the call via intimidation especially by beginning the incoming call response with " BY FEDERAL LAW.. '' ... Furthermore, " Ms. XXXX '' advised and attempted to collect an amount of {$19000.00} instead of the Case No XXXX amount of {$7900.00}. I offered a balance in full payment plan of {$50.00} down for XX/XX/XXXX and $ XXXXmonth beginning XX/XX/XXXX towards the Case No XXXX amount of {$7900.00} which was not accepted. 1. Debt collectors are required to give the FULL Mini-Miranda in their initial communication with you. 2. If a third-party debt collection agency or collection attorney contacts you and doesn't give the disclosure, it has violated the Fair Debt Collection Practices Act. 3. Even if you initiate contact with a third-party debt collector, they are still required to read you the Mini-Miranda. 4. " The FTC enforces the Fair Debt Collection Practices Act ( FDCPA ), which makes it illegal for debt collectors to use abusive, unfair, or deceptive practices when they collect debts. ''

Sprechman & XXXX has made another attempt to collect on a disputed, non-validated personal alleged debt. I have repeatedly requested that they validate the alleged debt. Their reply is that it is a commercial debt, and therefore it is not necessary to validate the debt. This alleged debt was to protect my personal property rights for my primary residence. I did not engage the original law firm ( XXXX and XXXX ) to set up a bed and breakfast. I had a contract to sell my property but because it was proposed that this right would be taken away in my XXXX XXXX XXXX, the sellers canceled the contract. This was for the sale of my personal residence. Had XXXX and XXXX been successful in defending my personal property rights, then I would have been able to sell my primary residence. In the Fair Debt Collection Practices Act, Section 803. Definitions. ( 5 ) " The term " debt '' means any obligation or alleged obligation of a consumer to pay money arising out of a transaction in which the money, property, insurance or services which are subject of the transaction are primarily for personal, family, or household purposes, whether or not such obligation has been reduced to judgement. '' Hiring a law firm to protect the sale of my personal household is practically the verbatim definition listed in this Section of the FDCPA. And Sprechman & XXXX 's refusal to validate the disputed alleged debt is a clear violation of the FDCPA.

On XX/XX/2016, I was the victim of identity theft, when my brother XXXX XXXX, opened ( 2 ) checking account with XXXX XXXX XXXX XXXX accounting ending in XXXX and XXXX. He attempted to finance a truck and wrote a check to XXXX XXXX XXXX in the amount of {$2500.00} on account No. XXXX which at the time was closed due to account abuse. XXXX XXXX, XXXX guaranteed the check would be paid, they in paid XXXX XXXX. XXXX XXXX XXXX XXXX, as successor in interest to XXXX XXXX XXXX XXXX XXXX seek to recover the {$2500.00} from me by a civil suit seeking damages over {$8000.00}. In late 2016, I notified XXXX XXXX, XXXX, that I am a victim of identity theft and the debt is not mine. XXXX XXXX, XXXX, sold the debt to XXXX XXXX XXXX, XXXX, after I informed them that I was a victim of identity theft. The XXXX XXXX XXXX Sprechman & Fisher, is the debt collector in this matter and have been notified that the debt is not mine and was fraudently obtained by identity theft. I am now being sued by this company in XXXX County Court XXXX JDC, case No. XXXX. I have filed a police report in this matter and am actively working with the XXXX Police Department, Detective XXXX XXXX, Police Report No. XXXX

Collection agency trying to collect the amount of {$1600.00} for XXXX XXXX XXXX XXXX, XXXX ( XXXX ) - attached- below is the letter sent back to the collection agency. XXXX refused to move the case forward while in court taking me with no other choice than agree with a a number to pay. Law firm, Sprechman and XXXX, P/A. did cause to be delivered to complainant without explanation or cover letter, a Waiver of Claim of Exemption form, in an attempt to deceive complainant into waiving a right to claim exemption and request a hearing. Complainant answered with a Claim of Exemption Form. Law firm then filed a motion under oath, denying complainant 's claim of exemption. Complainant then provided law firm with Federal Tax Return, pay stuff, Social Security Benefits letter. Law firm continued to move forward and filed a claim with the XXXX XXXX XXXX XXXX, and complainant 's employer, XXXX XXXX XXXX XXXX XXXX. I received a phone call from someone at the XXXX. They stated they were attempting to collect on a judgement from XX/XX/2004 from XXXX. Upon stating that I had no knowledge of this judgement, the individual became irate. He continued to question me on whether or not I knew of the judgement. I stated once again that I was not aware of any judgement against me, especially one XXXX. I stated that I would not be acknowledging any liability of the amount requested without further detail. At this point the individual asked me if I wanted to resolve the issue now. I again stated I would not, and said they should go through the procedures to inform me of the details. The individual then said " oh we will be doing what we have to do ''. I requested his name multiple times and asked that I be mailed the information. The person immediately hung up.

I Had XXXX XXXX in 2016 had no insurance. I live in XXXX. The XXXX bill alone was over XXXX XXXX dollars. There repayment plan was XXXX dollars a month which I don't have. I recently received letter from a bill collector representing as a lawyer Sprechman & XXXX PA. Stating I owed {$11000.00} plus interest {$1000.00} ( my Dr does not charge interest ) also my Drs have their own lawyers here in XXXX . This is a collection scam they have negative reviews on their website regarding fraudulent practices. My lawyer indicated to me to file a complaint with FTC.

I XXXX XXXX, received a court summons for an aleged debt. I have no knowledge of this aleged debt, and would like validity of said debt. There has been multiple FDCPA violations by this company including but not limited to harassing phone calls. An affidavit sign by a third party, that was not present at the time of the aleged transaction was submitted to the courts.
