My Loan Number is XXXX My Name is XXXX XXXX I have had my mortgage sense XXXX XXXX XXXX years on a XXXX Fix rate mortgage loan as of now XX/XX/XXXX. XXXX XXXX XXXX took over my mortgage sometime between XX/XX/XXXX and XX/XX/XXXX from XXXX XXXX XXXX. XXXX XXXX took over my mortgage from XXXX XXXX XXXX. XXXX XXXX XXXX took over my mortgage from XXXX XXXX. When XXXX XXXX took over my mortgage they were supposed to let me know they took over my mortgage from XXXX XXXX within 15 days after the effective date of transfer. Instead of getting the notice from the servicerXXXX XXXX XXXX XXXX that they took over my mortgage, I got XXXX monthly statements at one time in XX/XX/XXXX. Mortgage statements, XXXX, XXXX XXXX, and XX/XX/XXXX. That's how I found out that XXXX XXXX was my mortgage company. Along with a letter from XXXX XXXX XXXX XXXX XXXX saying, to make things easier for you dealing with your loan he was my personal contact. I call him right away because I was now behind on my mortgage cause of not knowing who my mortgage company was until months later. Instead of working with me to get caught back up over XXXX mistake, XXXX XXXX start threatened me with foreclosure if I didn't come up with XXXX. I try to get XXXX to work with me, but he assists that i must have the whole XXXX. I told him i can send XXXX and since it was not my fault if he would do a deferment on the rest of the remaining balance of XXXX and get me back current on my mortgage. XXXX finally agreed and gave me one week starting on Monday XX/XX/XXXX through XX/XX/XXXX. And when I went to send the XXXX of the XXXX on XX/XX/XXXX, on a Friday like we agreed on, it told me that I had an invalid account number not accepting the XXXX XXXX. I call XXXX XXXX to find out what the problem was with my account number saying it was invalid. XXXX XXXX broke the arraignment and put my mortgage on Foreclosure XXXX days before the date of the arrangement on XXXX XXXX. XXXX XXXX never even try to help me out. He just constantly threatened to Foreclosure on meXXXX XXXX and XXXX to me. Soon after I was told that XXXX XXXX no longer worked for XXXX XXXX. Second attempt to get my mortgage current. XX/XX/XXXX, I talk with XXXX XXXX a manager from XXXX XXXX. XXXX XXXX and I made arrangement for me to start making my mortage payments in the amount of XXXX a month for 6 months starting XX/XX/XXXX. Knowing XXXX was a lot on me to pay that amount every month for 6 months I agree to it because I was trying to get all of this behind me. I call XXXX XXXX back a couple of days before the XXXX of XX/XX/XXXX to speak with XXXX XXXX. Instead of talking to XXXX XXXX I talked to a lady name XXXX. XXXX got on the phone and told me XXXX XXXX no longer works for XXXX XXXX. I ask XXXX if XXXX was going to stand by the arrangement that XXXX XXXX and I agree to. She was rude and didn't do anything but fussed at me and told me she was not standing by the arrangement we had and threaten to foreclose on me if I didn't come up with XXXX dollars. Now for the second time XXXX XXXX has broken the arrangement on helping me to bring my mortgage current over something XXXX created for me getting further behind. At this point I'm starting to believe that XXXX XXXX only wanted to take my home and land from meXXXX XXXX due to them backing out of XXXX arrangements that we had. What kind of mortage company backs out of arrangement on two different agreements? Now because XXXX XXXX backing out of arrangements and NOT sending me the notice about XXXX XXXX taking over my mortgage. And due to XXXX XXXX refusing to take any payments from me/XXXX XXXX XXXX and according to the statement i have gotten from XXXX XXXX , they claimed my balance due is XXXX as of today XX/XX/XXXX. This balance is not right, and I ask XXXX XXXX Supervisor in XXXX of XXXX if he could send me how they got that balance on my statements, and he said he would. I never heard back from him as of today XX/XX/XXXX. Also XXXX XXXX sent me a payoff amount of XXXX and it also is not correct. On XX/XX/XXXX my pay off amount was XXXX, XXXX years ago when my mortgage company at the time was XXXX XXXX XXXX. On XX/XX/XXXX, the payoff was XXXX. And now XXXX XXXX is saying my payoff is XXXX. They're now saying I was charged XXXX in deferred. They're saying I was charged XXXX in fees that I have no idea what they're talking about. They're saying between XX/XX/XXXX, and up to today I was charged XXXX in interest. All the payment of XXXX that I have made for 20 years, and my payoff amount goes up instead of down in XXXX. I have all my documents, paperwork, receipts, from the sign agreement contract since the first day of signing my contract on XX/XX/XXXX, up to today XX/XX/XXXX. My Balance is not right. And my Payoff is not right. I need to know how is XXXX XXXXXXXX XXXX getting these balances and payoffs? XXXX XXXX claim they sent a transfer of notice to me, but I never received a notice of transfer from XXXX XXXX. I sign my mortgage contract at a fixed interest rate an unchanging rate during entire term of the loan on XX/XX/XXXX. I received monthly statement from XXXX XXXX on XX/XX/XXXX for the month statement for XX/XX/XXXX mortgage payment that says ( UNAPPLIED FUNDS BALANCE ) of XXXX. Then I received my monthly statement on XX/XX/XXXX for the month statement for XX/XX/XXXX mortgage payment that says ( UNAVAILABLE PAYMENT AMOUNT ). Then i received my monthly statement on XX/XX/XXXX for the month statement for XX/XX/XXXX mortgage payment that says payment amount XXXX. I made a payment in the amount of XXXX for the month of XX/XX/XXXX. My balance goes from XXXX in the month of XX/XX/XXXX to XXXX in the month of XX/XX/XXXX when my monthly payments are XXXX? That's a jump of XXXX from XX/XX/XXXX to XX/XX/XXXX. I don't understand what's going on with those statements, doesn't make no sense? And since Shortly sometime after those dates XXXX XXXX took over my Mortgage ( I'M ASSUMING ). I need to know what happen to the payments I made for those months. I have copies where I have made them? I'm not sure because I never received a transfer notice from XXXX XXXX. I have gone through my statements I have received from XXXX XXXX since XX/XX/XXXX when I got four monthly statements at one time from XXXX XXXX. And from statement dated XX/XX/XXXX to the next statement dated XX/XX/XXXX XXXX XXXX had my monthly payment at XXXX. The monthly statement from XX/XX/XXXX to the next statement dated XX/XX/XXXX XXXX XXXX had my monthly payment being XXXX. The monthly statement from XX/XX/XXXX to the next statement dated XX/XX/XXXX XXXX XXXX had my monthly payment at XXXX. Every monthly statement from those dates up to today XXXX XXXX have been different like a variable-rate, when my mortgage contract is a fixed-rate contract at XXXX a month. It seems that XXXX XXXX violation and broke the binding agreement of my mortgage contract. I also had home insurance on my home in the year XXXX and XXXX. I sent the declaration page to XXXX XXXX for those years and XXXX XXXX still added their own home insurance charging me and adding it to my mortgage payments. On XX/XX/XXXX, I got a HUD Housing Counselor from XXXX XXXX XXXX XXXX XXXX and XXXX XXXX to help me try to get my Mortgage back on track with XXXX XXXX XXXX XXXX and I spoke about XXXX sending out loan modification to me in XX/XX/XXXX. XXXX said he would, but he never did. XXXX then said he sent loan modification out to me XXXX different times on XX/XX/XXXX, but he never did. And then XXXX told me that he did a loan modification on me and said I didn't qualify and said it was because my work situation has not changed. XXXX just flat out lie to me ; he never got any information from me to do a loan modification when he said he did a modification on me. He just kept lying to me and pretend he done a loan modification on me when he never did. XXXX treated me like I was ignorant and disrespected my intelligence by consistently lying to me. I got him recorded and XXXX XXXX got it recorded as well if you need to listen to the conversation. XXXX talks to me on XX/XX/XXXX, after XXXX no longer worked there. XXXX wouldn't give me her last name for some reason and told me that my type of loan didn't do loan modification. So right there it tells you that XXXX didn't know what he was doing when he told me he sent four loan modification out to me. And also saying he did one on me. He just kept lying and postponing helping me/XXXX XXXX getting back on track with my mortgage. I'm assuming because XXXX XXXX just wanted to take my home from me and didn't even try to help me out. At this time, I file a complaint out on XXXX XXXX with the Federal Trade Commission on XX/XX/XXXX. XXXX and XXXX XXXX XXXX XXXX XXXX told meXXXX XXXX and XXXX HUD Counselors XXXX XXXX and XXXX XXXX that the owner that own my loan didn't do loan modification on my type of loan ( Whatever that means ). But when Federal Trade Commission got involved and investigate XXXX XXXX. Then XXXX XXXX email my XXXX XXXX XXXX and said that now they are going to do loan Modification on meXXXX XXXX XXXX XXXX XXXX also told the Federal Trade Commission that they are going to do a loan modification on meXXXX XXXX XXXX XXXX XXXX lies to me again about the owner of my loan not doing loan modification when clearly, they did. Again, XXXX XXXX didn't even try to help me get back on track he just kept lying to me as well. And once again I'm assuming XXXX XXXX just wanted to take my home from me. I called XXXX XXXX on XXXX XXXX and I talk to Manager XXXX XXXX, and he tells me that I can fax my documents to them without even having a loan modification package sent to me. Once again not wanting to send meXXXX XXXX the loan modification package to me. XXXX XXXX responded XXXX Submitted STATUS Submitted to the CFPB on XX/XX/XXXX PRODUCT Mortgage STATUS Company responded on XX/XX/XXXX Company 's Response XXXX XXXX XXXX XXXX XX/XX/XXXX, XXXX XXXX XXXX XXXX XXXX SC XXXX Loan Number : XXXX Dear XXXX XXXX : This letter is in response to your correspondence received on XX/XX/XXXX, concerning the above-referenced loan. Upon further review of your loan, XXXX XXXX has placed the foreclosure proceedings on hold pending the outcome of the LOSS MITIGATION process. XXXX XXXX have sent out a loan workout package to offer you available options for your current situation and get you back on track with your loan repayment. Please thoroughly go through the package and return all requested documents within a timely manner to enable us to assist you in this time of need. If you have any further questions, please contact our Customer Service Department at ( XXXX ) XXXX, Monday Friday, XXXX XXXXXXXX XXXX XXXX XXXX. XXXX. Sincerely, XXXX XXXX XXXX. My HUD Housing Counselor XXXX XXXX forward the loan modification and all the documents on the XXXX of XX/XX/XXXX to XXXX XXXX. I waited on XXXX XXXX to let me know about the status of the loan modification and never heard anything back from XXXX XXXX. So, I started calling XXXX XXXX to find out the status of the loan modification and was told XXXX XXXX was still working on it. I have record phone history showing meXXXX XXXX calling XXXX XXXX XXXX XX/XX/XXXX, through XX/XX/XXXX, about the loan modification. XX/XX/XXXX, XXXX XXXX sent me a letter telling me that XXXX signed her to be my personal loan counselor. ( I GOT RECORED CONVERSATION ) between me/XXXX XXXX and XXXX XXXX where she calls me on XX/XX/XXXX, not to tell me about the loan modification but to ask me about what I was going to do about catching up my mortgage. I ask her what about the loan modification that XXXX XXXX was doing on me. XXXX XXXX didn't even know anything about the loan modification and then put me on hold and when she came back on the phone, XXXX XXXX told me the same thing XXXX and XXXX XXXX told me on XX/XX/XXXX, that the owner of my loan didn't do loan modification on my type of loan. Then after we talked some more, she put me on hold again and came back on the phone and told me she was sorry that she made mistake that XXXX XXXX told her to tell me that XXXX XXXX was still doing a loan modification on me/XXXX XXXX XXXX I called XXXX XXXX in XXXX and talked to a XXXX, she told me during the conversation, that ( I HAVE RECORDED ) of her telling me/XXXX XXXX , that XXXX XXXX didn't normally do loan modification on my type of loan. I ask her if XXXX XXXX didn't do loan modification on my type of loan, then why did XXXX XXXX send me two loan modification packages. ( I HAVE THAT RECORDED CONVERSATION ). I had another conversation with an employee name XXXX from XXXX XXXX in XXXX that ( I DO HAVE RECORDED ) where she told me that XXXX XXXX was aware of meXXXX XXXX was needing to talk with him because she told him. ( I HAVE A RECORDED CONVERSATION ) where XXXX telling me that I have a copy of the loan modification that was done on me. I have never received any copy of any loan modification showing me/XXXX XXXXr as of today XX/XX/XXXX the outcome of the loan modification/LOSS MITIGATION. Because the loan modification was ( NEVER DONE ON MEXXXX XXXX XXXX XXXX ( I HAVE RECORDED PHONE CONVERSTION ) from XXXX XXXX on XX/XX/XXXX after a year of meXXXX XXXX and my HUD Housing Counselor XXXX XXXX forward the loan modification package and all the documents back to XXXX XXXX that was requested. Conversation from an employee that works for XXXX XXXX giving meXXXX XXXX a message from XXXX XXXX telling me the same thing XXXX XXXX told me before he sent me/XXXX XXXXXXXX, the loan modification/LOSS MITIGATION package on XX/XX/XXXX. That the owner that own my loan didn't do loan modification. XXXX XXXX sent out two load modification/LOSS MITIGATION package out to meXXXX XXXX that he had ( NO PLAN WHATSOEVER ) of doing the load modification/LOSS MITIGATION on me. XXXX XXXX was only covering, protecting himself ( FROM LYING TO THE FEDERAL TRADE COMMISSION ) when he told them he has sent out a loan workout package to offer you available options for your current situation and get you back on track with your loan repayment. Once again just flat out lied to meXXXX XXXX again . But this time he just didn't lie to me, he lied to the Federal Trade Commission about the loan modification. XXXX XXXX was never planning on doing a loan modification on me/XXXX XXXX XXXX XXXX XXXX was just covering his self from the Federal Trade Commission when he sent the LOSS MITIGATION out to meXXXX XXXX. AFTER I SENT THIS COMPLAINT LETTER ON XX/XX/XXXX, TO XXXX XXXX, INSTEAD OF XXXX GETTING BACK IN TOUCH WITH ME AND STRAIGHTENING OUT MY MORGAGE OVER THEIR MISTAKE THEY GOT XXXX & XXXX XXXX, XXXX TO BE A DEBT COLLECTOR TRYING TO COLLECT A DEBT. I HAVE ASK XXXX XXXX XXXX XXXX XXXX SEVERAL TIMES TO CONTACT ME SINCE XXXX ABOUT MY COMPLAINT AND HE HAS NOT DONE SO AS OF TODAY XX/XX/XXXX WELL OVER THE 15 TO 30 DAYS WITH THE CONSUMER BY LAW. I HAVE HAD XXXX XXXX AS A LOAN COUNSELOR THAT DIDN'T DO NOTHING BUT LIE TO ME CONSTANTLY AND THREATENING ME CONSTANTLY NOT EVEN TRYING TO FIX THE SITUATION WITH MY MORTGAGE LOAN. I'M NOT PLANNING ON LEAVING MY HOME WHATSOEVER AFTER I HAVE PUT A LOT OF MONEY AND WORK IN ON MY PLACE. CREDIT REPORTING AGENCY FOR NEGLIGENT OR WILLFUL NONCOMPLIANCE WITH THE LAW WITHIN TWO YEARS AFTER YOU DISCOVER THE HARMFUL BEHAVIOR OR WITHIN FIVE YEARS AFTER THE HARMFUL BEHAVIOR OCCURS, WHICHEVER IS SOONER. I never receive transfer of notice from XXXX XXXX. Isn't possible that XXXX XXXX can make up a transfer of notice letter and date the letter like it was the original transfer of notice copy letter and send it out claiming they sent the transfer of notice out to me, to cover up for XXXX XXXX not sending it out like they were supposed done in the first place by law? In XX/XX/2019, my mortgage account was acquired by XXXX XXXX from XXXX XXXX Beginning in XX/XX/2019 I began submitting loan payments to Southwest Stage Funding LLC ( dba XXXX XXXX ) under former XXXX XXXX number XXXX. In late XX/XX/2019, I submitted my XX/XX/XXXX payment as regularly scheduled. On XX/XX/2019, I submitted early XX/XX/XXXX payment. On or about XX/XX/XXXX, I received a mailed notice of late payments from XXXX while almost simultaneously receiving notice via email that my credit score had changed. When I checked, XXXX had turned in late payment information that had been received by XXXX and XXXX, and my credit score that was +800 points had been reduced by 69 points. I called XXXX customer service at XXXX and was told that because of the difference in computer systems for loans from XXXX, and since it was during the time frame when my adjustable mortgage would see any adjustment in interest rates, along with the payment adjustment, my payments had been placed in " unapplied '' status, and unfortunately their automated reporting system had sent out erroneous late statements. I was told I should dispute the late payment reporting through the credit bureaus, which I did. Those are unresolved to date. However, I called back to customer service on or about XX/XX/XXXX to confirm that the problem had been resolved, but it hadn't. I was told that they were working on getting all of the problems resolved and that my loan would be resolved by COB and I received a call at approximately XXXX on XX/XX/XXXX that they had indeed resolved the issue and my payments had been appropriately applied. Then sometime between XXXX XXXX I received my XXXX monthly statement that reflected the adjustment to my payment, which I DO NOT dispute. What I dispute is that they tacked on " Unpaid Late Charge '' to my statement, which after calling customer service on or about XX/XX/2019 at XXXX, told me that my disputing the late charge would have to be escalated to a manager, and within seconds I was disconnected. No matter how large or small, I do not owe any " Unpaid Late Charge '' because they failed to properly credit my on time payments to my account when received.

It is very common in our area and we have been told by FHA and Hud that this is possible if the lender requests it. On XXXX XX/XX/2020 I attempted to make my normal monthly mortgage payment through the lender web portal with XXXX XXXX XXXX Southwest Stage Funding , LLC. The payment came back " denied by bank. ". I called my bank and explained the problem but they assured me the problem wasn't on their end and there didn't seem to be any issues with my account. I called the lender back and explained this however they said they could not fix it since now my account had a block on it due to attempting to make repeated payments. They also said that they were showing invalid account number on their end which is bull because I had just spoken with my bank prior to calling them to make sure I was inputting the correct ACH info ... which was saved anyhow under my XXXX XXXX profile and had been for over six months. They then said that they would have to mail me a form to fill out to unblock my account and that I would need to mail them a check or other form of payment since they don't accept debit cards. I was pretty angry but did as instructed. I had a cashier 's check for {$930.00} drawn up at my credit union and then sent it certified mail to the address Southwest Stage Funding gave me. This was done at XXXX on XXXX XX/XX/2020. It also cost me {$28.00} to send it two day Certified Mail. I called them as soon as I got home to request that they call me as soon as they receive and process it. It is now XXXX XX/XX/2020 and as of this afternoon, they are saying they still don't have it. The only reason I think that they are screwing with me is because I have an open refinance loan with a different lender at a much lower interest rate and monthly payment. I think they are giving me the run around on purpose. Something needs to be done ASAP. My payment has never been late and the same account info that is saved on their web portal is the same account info I have been paying with for the last six months without issue, on time. I applied for a forebearance under the CARES Act with my mortgage company, XXXX XXXX. I was granted the forebearance but began to assess late charges and receiving notices. When I contacted the company in XXXX after receiving multiple letters stating that my loan was late and that I needed to pay the full amount immediately. I was treated really poorly by the representative with XXXX who basically told me that I was going to have to pay all of the money {$6200.00} on XX/XX/XXXX or I was going to lose my house. I tried to ask about the details which I understood was that I could either tack those payments from the forebearance to the end of my mortgage or spread it out over time. I was told NO. I did not lose my job but our finances were impacted due to the fact that my fiance who is XXXX XXXX had a loss in wages. With all the uncertainty and the struggle we were in we thought this would give us some respite. I feel like my home is under threat and I am terrified of losing it. I went ahead and paid out all the money I had including all of the stimulus check to try and get caught up. In addition, I feel like I was bullied due to the fact that I have an FHA loan on a mobile home and they felt since I am poor they could get away with treating me badly. I asked to speak to a supervisor and was put on hold for an hour before speaking to a woman who wasn't as rude but told me basically the same thing - that on XX/XX/XXXX the total amount of the deference was going to be due. We worked for months with cascade to get to closing. They used a bpo and undervalued the land i owned outright and then right before closing, they said we didn't qualify and declined the application. The second business day after declining us we were informed they had " changes to their tiers '' and we could move forward. Then we learned the day we got our closing disclosures that our rate went up a whole point and changed our monthly payments. We had a contract with the dealer and the home we ordered was ready so we felt we had no other option. I gifted my husband a specific dollar amount in property I just inherited 's equity for the down on the home. It was supposed to be the amount I gifted him that was used but they are trying to foreclose the whole thing. They have somehow eliminated my parents in the chain of title and the property description is not accurate and doesn't match my original deed. The county records for tax payments on the other home on the property show that cascade paid the taxes. They didn't and I have proof of my step dad paying it because that house is still in his name. We were unable to make payments due to loss of my job during the corona virus. We tried talking to them and filled out a loss mit application immediately after missing the first payment which they confirmed they received and would be in contact within 30 days. We have heard nothing about the app since then. I just received a letter dated XX/XX/XXXX to inform us that the property will be foreclosed and sold XX/XX/XXXX. The letter was mailed XX/XX/XXXX according to the envelopes. So they waited until the last minute so we couldn't do anything to stop it. There are multiple issues that are suspicious to us and we need some help before I lose the land where I grew up even tho it isn't even all mine to lose.

Southwest Stage Funding LLC has not and refuse to send me documents of the on and off ledger for the account. I have requested numerous times per IRS Publication 583 and 12 CFR 1026.17. They have gotten a law firm involved XXXX XXXX XXXX XXXX to collect the debt which is illegal per the Constitutional Law 15 USC 1692 ( e ) which states a lawyer can not get involved in any debt collections. They have not presented me with the original promissory note or ledger on file stating that the all cap name owe them anything. A Confessed Judgement is illegal when it comes to a mortgage. Only the all caps signature is on the contract in which makes the contract an incomplete enforceable document. Southwest Stage Funding LLC is a debt collector in which clearly says we do not owe them. They will not produce the XXXX because the loan is securitized per MERS in which they no longer have it because it was sold to different shareholders. They placed my home for foreclosure knowing they are debt collectors and that it is illegal to not give me documents to support their claim. We have filed a Form W4 with the IRS to audit the account because they refuse to give us documentation. I'm in the process of suing for filing false documentation in the courthouse. I also been sent them an Estoppel by Deed to stop all transactions from my account as well as a Form 56 to revoke all rights as Trustee on my account. They committed fraud because under fiduciary obligation as the Trustee, they suppose to do what's right in which I sent a negotiable instrument for full payment and they received it and did not return it. Therefore, waiting on the IRS to audit the account so that they can pay for their wrong doings.

I applied for a XXXX mortgage through Cascade Financial Services based upon their rules and criteria as stated on their website and I received a Pre-Qualification Letter dated for XX/XX/XXXX, in the amount of {$71.00}, XXXX. The website states that a certain XXXX had to be met, minimum and maximum loan amount, single-wide or multi-sectional homes are eligible, 5 % down payment, debt to income ratios as high as 50 %, and loan terms XXXX years. After receiving Pre-Qualification Letter, I made a deposit in the amount of {$1000.00} to purchase a single-wide house from XXXX XXXX XXXX XXXX XXXX WV. The sales contract is in the amount of {$67000.00}. I shared with XXXX that the house would be placed on property that I purchased in West Virginia as the XXXX XXXX is for the house only and not the property ( land ). The loan then moved through the Processing Department of Cascade after sending the required documents but on Friday, XX/XX/XXXX, I received a phone call from the Processing Manager explaining that the loan was denied by underwriting because of a deed that is in my name for a property in New Jersey. She also told me that underwriting denied the loan because of a foreclosure on the property. I explained a foreclosure is not on my credit report therefore your company is making up things that are inaccurate. Then she explained that underwriting denied the loan because of a past bankruptcy that was discharged in XXXX of XXXX. All the accounts that are listed on my credit report was not given permission to share my social security number with anyone and the distributed it without my consent. They all have violated 15 USC 1681, 15 USC 1681 Section 602A, 15 USC 1681 Section 2 of 604A. I have sent all information to both Experienced and XXXX and have not gotten the problems corrected. All were sent out negotiable instrument from attached statements as well as approved 1099-A payments and all of the companies kept the negotiable instruments as payment but didn't apply it to my account. I sent all companies a copy of my documents with a Conditional Acceptance Letter. I do not owe neither of them because I am not the person of the " all caps '' name. I am the representative of that person and they knowingly sent the information without consulting me. I request the original primossary note, 1099-A, that was filed according 15 USC 1666D , 15 USC 44 , and 12 CFR 1026.17 that is defined in the IRS Publication XXXX. Still have not gotten that and its been since XXXX. Everyone was asked to provide me with proof of claim that the credit agreement was a lawful and enforceable contract signed by both parties giving equal consideration. I have an adjustable rate mortgage that has been sold to or purchased by XXXX XXXX XXXX XXXX took over my loan in late XXXX. Thus far there has been irregularities for 7 of the 8 months they have held the loan. Payments in XXXX XXXX we placed in a reserve account instead of being placed towards the loan because they claim that we were not paying enough each month. The loan has been set up on an automatic draft since XX/XX/XXXX. When I discovered the issue in XXXX, it took about 2 days to get the information corrected, the money placed in the appropriate place, and the draft corrected. We were told there would be not late payments. The issue occurred because we were not issued a rate change letter for our ARM, and to this date we still do not have that letter. I was told the new payment would be {$370.00}. and some change. In XXXX, 2 months late charges appeared the account. I again called customer service and was told it was an error and would be corrected. In XXXX, a larger payment than we were told was drafted from my checking account. When we called we were again told that there was a computer issue and it would be corrected. I again requested a copy of the rate increase notice. I also requested a payoff as I have decided to refinance. On the payoff, it notes that my current interest rate is 5.125 %. On my XXXX statement, my interest rate is now 5.250 %. The second change this year. This is in violation of my ARM which states one interest rate change per year beginning at the XXXX mortgage payment. In XX/XX/2020 we made the decision to have our mortgage placed in forbearance as a result of the financial strain resulting from the Covid19 pandemic. I had been speaking with " XXXX '' during this time. XXXX offered another financial plan that would move the forbearance amount owed to the end of the mortgage term. During my conversations with XXXX, I understood that as long as I resumed paying our monthly mortgage payment beginning XX/XX/2020 the account would be in " good standing '' and without penalty or effect to our Credit. We were able to resume making our mortgage payments since XX/XX/2020, and have done so since. During this time, we suffered roof damage to our residence and became involved with the " loss draft '' department of XXXX. While waiting for the funds to be released, from Loss Draft, our contractor 's time frame for repairing our roof wax delayed. Recently I was reviewing my credit report and it is showing that I have negative remarks from XXXX saying that I am 120 past due on my loan. I don't understand why but XXXX is not wanting to add the 5 months of forbearance to the end of the loan term and then on top of that they are ruining my credit in the process. I had damages to my home and my insurance co sent a check for the repairs but had my name and my mortgage company name ( XXXX XXXX XXXX ). The check was sent to mortgage company on XX/XX/XXXX. No one called me from the mortgage company until I heard from the contract and we reached out to the mortgage company on XX/XX/XXXX and was told to email the documents over. I called back the next day and was told they never got it and to fax it over er XXXX. My mortgage has been in forbearance under The Cares Act for 6 months. The loss mitigation application the company sent me, gave me the option of providing my last federal income tax return in lieu of a lengthy and complicated ( to me ) set of forms to fill out. They have had the application for several months and I have heard nothing. I inquired about the status of my application on XX/XX/23, and was told it is no longer valid. The company now has sent me another application for mortgage assistance which again is extensive and complicated ( to me ) but does not allow me to provide last years federal tax return instead of the numerous forms. It appears the company has changed the rules regarding a loan modification request. I believe this is a violation of mortgage service loan modification. The company is aware that I am a XXXX XXXX XXXX XXXX XXXX veteran ( XXXX and XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX, and has made no accommodation for my XXXX, but has in fact completely disregarded the same. The company has committed at the least, I believe, the following violations.1 ) Refusing to honor or review my loan modification request. 2 ) Not responding to my application for loan modification within 30 days.

Cascade Financial, XXXX, AZ XXXX. I requested " forbearance, '' under the CARES Act due to a COVID 19 financial hardship. I was required to fill out several forms in order to prove hardship, and was then told I would have to wait up to 30 days for a decision. I was finally given a 90 day period of forbearance, which I requested to be extended for 30 days, but Cascade refused to do so ( XX/XX/XXXX ). I was told I was not eligible for an extension because VA loans are not eligible past XX/XX/XXXX. I have requested that forbearance be granted again since the CARES Act has been extended for another 90 days, and that I am indeed eligible. ( XX/XX/XXXX ) I continue to request forbearance, but Cascade will not give a definitive answer one way or another. I believe this is a stalling technique until the current 90 day CARES ACT expires. I have also been told all the paused payments are due in a lump sum at the end of the forbearance period. I have requested that the paused payments be moved to the end of my loan as provided for in the VA regulations for CARES Act forbearance.

I received the payment stub in the amount of {$1000.00} without any explanation, without having received any communication about it. My monthly payment is {$780.00}. I have never been late in payment. And they know that I pay the mortgage with my social security and they know the amount that I receive. The amount of the collection is much more than my monthly income. And I was always informed that the payment would be lower annually. They never said it would go up. My monthly payment is : Principal {$180.00} + Interest {$430.00} + Escrow ( Taxes + Insurance ) {$160.00} = {$780.00}. The receipt received is : Principal {$180.00} + Interest {$430.00} + Escrow {$400.00}. I can not pay more than {$800.00} per month. XXXX states I owe today, {$1600.00} after I was approved for deferment onXX/XX/XXXXin the amount of {$970.00}. I am currently today behind 3 months owing {$1000.00} which I just paid {$710.00} towards that amount. Speaking with rep today, he informed me that the additional {$680.00} are misc fees from my previous services ( XXXX, XXXX ) between the years of XXXX. My complaint is when my loan was transferred in XX/XX/ these fees were never disclosed. When I received this deferment in XXXX non of these fees existed, were not on my billing statements nor disclosed in any manor. Now I have almost {$700.00} in unexplainable additional fees from other servicers per the XXXX customer Service representative. I believe XXXX is attempting to collect money not owed to them. If I received a deferment in XXXX all fees should ha e been disclosed. And finally they are reporting to the credit bureau Im always 30 days late because of these additional fees. Illegal.

I file a complaint with cfpb on XX/XX/XXXX and my complaint ID is XXXX I just wanted to let y'all know something i didn't realize till after I submitted my complaint. I apologize for that but really thought cfpb should know. My mortgage company XXXX XXXX sent me a transferred of my loan letter to new owner that now owns my loan on XX/XX/XXXX. But still told me to not send payment to new owner but to continue sending payments to XXXX XXXX. And then on XX/XX/XXXX I got a letter from XXXX XXXX XXXX XXXX XXXX, is a debt collector trying to collect a debt from the previous owner of my mortgage loan XXXX XXXX XXXX XXXX XXXX as trustee for XXXX XXXX XXXX XXXX XXXX XXXXXXXX. I will download what I have so you can see what I'm talking about. But it really seems that my mortgage company is sketchy. Something isn't right ever since XXXX XXXX supposedly took over my mortgage loan that I never received transfer of notice from.

On XX/XX/XXXX I contacted XXXX XXXX services, XXXX, left a msg, and XXXX called back-XXXX. I explained that I wanted to get a loan for a manufactured single wide home w/ land in a park, in AZ XXXX He stated that they only had VA and FHA loans. So we talked about FHA. He informed me that I would have to pay PMI on this loan, and no matter how much I put down, even 50 %, I would still have to pay it FOREVER! I said there there must be a time frame that this drops off, and he said no. Is this legal? I have owned 7 homes, and because of my wonderful credit history, I have never had to pay escrow or pay PMI. Same time frame, I had also been told by another company, XXXX XXXX, a mortgage broker in AZ, that I HAD TO USE a broker cause no lender works with buyers in AZ w/o a broker. They told me that they only used XXXX and XXXX XXXX for lenders. Sounds very crooked to me. Can you get some answers for me?

Cascade/Southwest Stage Funding XXXX Has used creative accounting practices on applying my payments. In an attempt to pay off my mortgage earlier I have sent in extra payments to be applied to Principle. It was discovered that this money was being shown as ADVANCE INTEREST. I had sent notice that any and all extra payments in a billing cycle should be applied directly to principle. When contacted about this, Cascade/Southwest Stage Funding , then shown payments were corrected. I feel that I was charged interest on money that had been attempted to be paid. I have requested an audit by Cascade/Southwest Stage Funding to ensure payoff amount is correct. This action has not been performed. Due to displayed accounting actions of Cascade/Southwest Stage Funding I request an investigation into their accounting applications..

I have put my home up for sale and the new buyers lender wants a copy of the title. I only owe {$4000.00} on the house. It is a Manufactured Home. I am having a problem getting the information and have been on the phone virtually everyday for the past 2 weeks with XXXX which apparently is part of Southwest Stage Funding XXXX. They are required by law to supply me with this information within 7 days and we are now approaching 20 days. I've been dealing with a very nice lady by the name of XXXX and she has tried very hard to try and get this information for me. She has even gotten her Director involve and yet still nothing. I am about to lose this sale as well as a job transfer in another state because of this problem. It is also a violation of lender law to inhibit the sale of a home.

On XX/XX/2021, spoke to my Mortgage company about a forbearance due to XXXX XXXX XXXX XXXX XXXX XXXX for 3 weeks and needed a payment for this month deferred because we are low on funds. The Agent took like a credit application and said we do not qualify because we don't have enough money coming in!! Isn't that what a forbearance is? To help people get back on their feet? This made no sense to me when that's why we asked for a payment to be deferred. If we had the extra we could pay it!! Now they denied us we had to take money we don't have and pay it then try to live!! I have never heard of a Company doing this practice! Take a credit application for deferring a payment. Then deny us when that's what a defer means, to help people get back on their feet!

My loan servicing provider recently changed ( effective XX/XX/2018 ). Upon receipt of my first statement, 1. Not only was my current payment not credited ( {$670.00} was due according to my statement from the previous servicer, XXXX, and I paid {$700.00} ), there is another charge for " Total Fees and Charges '' in the amount of {$1500.00}. These dollar amounts don't add up. 2. There is a charge for " Deferred Balance '' in the amount of {$2200.00}. I have paid this account consistently for many, many years and do not have a " Deferred Balance. '' I have never deferred anything on this account. 3. I requested a payoff from this company once on the phone ( XX/XX/18 ) and twice in writing. I have yet to receive the payoff quote.

On or around XX/XX/2023 Cascade XXXX sent a check to my county tresurer for somewhere in the neighborhod of XXXX dollars for property taxes. I have a property tax exemption. The tresurer called me and said she could not cash the check and would send it back to Cascade XXXX with an explanation about the tax exemption and siad I should call Cascade also to tell them, which I did do. I talked to someone in the tax department and explained the tax exemption. As of this date XX/XX/2023 I have made 3 or 4 calls telling them to fix my problem and nothing has happen. In fact they are still collecting taxes on my property. Oh and the XXXX XXXX check that was returned has mysteriously disappeared.

Cascade loans reported my account past due to credit reporting bureau for the month of XXXX and XXXX. Even though my payments were automatically debited from my account for years prior, cascade stopped debiting my after balance were payed off from original loan, but not the deferred balance from a previous company and automatically report my account as delinquent without notification the deferred balance would not be automatically taken from account like all other payments and I wasnt aware of this I feel they should of made me aware that deferred balance doesnt qualify for automatic payments

The builder did such a horrible job the home didnt pass fha inspection The lender started foreclosure and refused the cares act because the house didnt pass a fha inspection. The contract the bank biased the loan on is invalid contract. It has no start and stop date, no 3 day recession.
