On XX/XX/XXXX I received a pre-approval from XXXX home mortgage in the amount of {$380000.00}. I found a home for {$360000.00} and put in an offer. Upon putting in an offer to purchase I received a call from XXXX XXXX, XXXX ID # XXXX the mortgage lender with XXXX whom I had been working with indicating I had been issued the " pre-approval in error ''. When I informed him, I had put in an offer and I had already received the pre-approval, he indicated he could not go through with the loan offer " because you are self-employed ''. I reminded him we had discussed this before I completed the application and before I was issued the pre-approval, he stated he would call me back and I never heard from him again. My realtor XXXX XXXX contacted me shortly thereafter and informed me she had received a call from XXXX stating I had been issued a " pre-approval in error ''. XXXX then reassured me she could help, she referred me to XXXX XXXX with SWBC Mortgage via email. I spoke to XXXX via email and he informed me to complete a formal loan mortgage loan application online. I completed the application on XX/XX/XXXX. I received a call from XXXX XXXX from XXXX and b began to discuss my income and the loan applications with him. I received a call from XXXX XXXX stating she had been informed by XXXX that I never completed the mortgage loan application. I informed her that I had another loan officer contacted me and we were discussing the loan. It was at this point I was told to contact XXXX XXXX. I reached out to XXXX via email and informed him I had been contacted by another agent with SWBC Mortgage to which he stated he would reach out to that agent and inform him he would be working on my mortgage application. I informed XXXX I was instructed to remit {$2000.00} in earnest monies to which he stated I needed to submit payment. I also reached out to XXXX to confirm if I should remit the XXXX monies to the sellers. I inquired about whether or not I should rescind the offer to purchase at which time she stated " no, XXXX will get this home for you ''. XXXX then told me I still had to remit {$2000.00} in earnest monies to the lawyers although I never received a pre-approval from SWBC mortgage. She insisted that XXXX remit payment to the lawyers to begin the process of closing on the home. I then emailed XXXX with SWBC and informed him I had been told to remit earnest monies in the amount of {$2000.00}, he confirmed that I needed to remit payment to the lawyers so I could move forward with the loan to which I did ( email correspondence to support ). SWBC Mortgage lenders are engaging in unethical and illegal practices. Some of the realtors are working with the mortgage loan officers to target people of color. Potential buyers are not receiving pre-approval letters until they agree to accept a loan that has an interest rate of nearly 11 % ( XXXX XXXX to be exact ). They also told me that I needed to have XXXX of reserves in the amount of {$1800.00} for each month and an additional {$94000.00} down. This mortgage loan company ran my credit but when I didn't agree to the terms that was specified in the agent phone call ( XXXX refused to provide this information via email and demands that correspondence occurs via a telephone call ) I received a one sentence email stating my loan was denied. XXXX XXXX is licensed in Virginia XXXX # XXXX, however, he provides potential borrowers with a Viginia zip code so he could be assigned to them even if the borrower lives and is seeking a home in another state. When asked to see the contract in question, the contract that states the interest is nearly 11 % and the downpayment of {$94000.00} is required, XXXX indicates it is too much " legalese and you wouldn't understand ''. XXXX also refers you to a credit repair person named XXXX XXXX who then charges you {$650.00} that begins to " work on your credit ''. However, your credit begins to decline and old items suddenly begin to reappear on your credit report, decreasing your score and making you ineligible for a mortgage loan with other lenders. XXXX encourages you to give him a verbal acceptance of his offer before you are able to obtain a pre-approval letter, if you refuse you are given a denial in the form of a one sentence email ( email correspondence to support ). No further denial is received via email or standard mail. I have all of this information recorded. The realty agent he works with is XXXX XXXX ( XXXX XXXX ), who also worked with me, brings all potential, vulnerable buyers to XXXX. Although I have declined XXXX 's " offer '' he continues to call telling me I will not be able to have the " home of my dreams '' as he knows I would be a first-time home buyer unless I agree to his offer. I declined the home, rescinded the offer to purchase, and the mortgage loan at the rates XXXX specified on XX/XX/XXXX. I received a voice mail message and text from XXXX on XX/XX/XXXX stating XXXX found a way to return my " earnest monies '', however, I would need to forward the email to her of his denial and contact him immediately. However, when I contacted XXXX he wanted to discuss another home and " the special mortgage loan created a few months prior ''. He stated " XXXX home loans was a terrible company and he wouldn't be surprised if they closed down soon '' as he has been " cleaning up their mistake with several other people struggling to buy a home ''. I reiterated to XXXX I could not afford the " special mortgage loan '', and he would not tell me the name of the loan he was proposing nor show me a breakdown of costs. XXXX continued to reassure me in phone calls and texts as recently as XX/XX/XXXX I could afford it. He kept insisting if I accepted this loan, I would have been the first person in my family to own a home. He encouraged me not to discuss this loan with anyone, if I needed to discuss the mortgage loan to communicate with either him or XXXX directly. During the conversation he boasted about " helping other people like me who wanted the XXXX XXXX ''. As per XXXX, he is helping at least 3 people close on a home this month. XXXX 's statement further confirms for me that many people are being exploited in their quest to own a home. I was contacted by XXXX XXXX on XX/XX/XXXX, stating there may be a way to get the earnest monies I sent to the sellers back. I sent her the denial email from XXXX ; however, I was encouraged to reach out to XXXX as well. I was told I needed to reach out to XXXX to discuss how this would be done. I contacted XXXX and the only thing he wanted to discuss was the " special loan '' asking me to " ok '' the loan so I could be in my " new home ''. He encouraged me to upload 12months of bank statements in the portal so I could get the approval. I was not comfortable with the downpayment amount he quoted me, the {$10000.00} in reserves, or the 10.37 % interest rate so I did not provide additional documents. I requested a denial notice on XX/XX/XXXX so I can retrieve my earnest monies back, however, he stated he could not provide me with one. He encouraged me to contact XXXX and see if I would get one from them. I reminded him I could not get one from XXXX and reminded him I did not pay the earnest monies until after we had began working together and following his suggestion ( I have email correspondence to support ). I asked him again for a formal denial notice to which he insisted he could not provide. I then reached out to XXXX and told her XXXX would not give me the denial notice and I informed her I would be contacting SWBC mortgage for a formal letter. I contacted the mortgage company on XX/XX/XXXX, however, when I put in my social security number after telling XXXX I would be contacting the company the automated system stated there was no record of my application. *The home I put the offer on is also off the market.

This letter is to serve as a complaint against XXXX XXXX, XXXX Loan Officer at XXXX Oklahoma City branch. We started communicating with XXXX on XX/XX/2022 in hopes of obtaining a home loan for our move to Oklahoma. The loan was to be in my fiances name which we will call XXXX. However, because XXXX worked long hours, I did most of the communicating with XXXX. XXXX application was submitted on XX/XX/2022. I reached out to XXXX on XX/XX/XXXX to ensure there was nothing pending on our side as we were about to be in Oklahoma and needed the pre-approval. At this point we were already noticing a lack of communication from XXXX but decided to continue with him because we were in a time crunch while in Oklahoma to search for houses. On XX/XX/XXXX, XXXX provided us a spreadsheet with loan options. During a phone call on the same day, we discussed the amount of loan we wanted was around XXXX to XXXX. XXXX stated because of XXXX income we could potentially go higher if we wanted. However, both XXXX and I told him that we had no interest in going higher. On XX/XX/XXXX, we requested that he forward the pre-approval to our realtor to which he sent it on XX/XX/XXXX. On XX/XX/XXXX, our offer on a house was accepted. XXXX started working with his new manager regarding the income verification letter. On XX/XX/XXXX, I advised XXXX that XXXX would like to use funds from his 401k but needed a copy of the contract or estimate in order to do the withdrawal ; XXXX replied that we would have the initial disclosures the following Monday ( XX/XX/XXXX ). I emailed him again on XX/XX/XXXX for an update to which XXXX stated we would receive the disclosures by the end of the day. We never received this and ended up using the contract from the realtor. We provided multiple income verification letters to XXXX, each time he took over a week to respond that they werent acceptable. On XX/XX/XXXX, XXXX provided us an example of how the verification letter should be outlined and on XX/XX/XXXX we sent back the final verification letter. I followed up multiple times over the next few days and was advised that the letter was still being reviewed. On XX/XX/XXXX, XXXX advised that it was accepted and they would be able to use the same income because he was continuing work with the same company. I asked if there was anything else that he would need from XXXX prior to closing he stated that he would be updating documentation and notifications will be emailed. On XX/XX/XXXX, I was asked by our realtor if we had heard anything about the appraisal. I reached out to XXXX via text and he stated that it should be back by the end of the week and that he would update everyone. On XX/XX/XXXX, we loaded up everything we owned and made the trip from XXXX XXXX XXXX so we would be here for our original closing date of XX/XX/XXXX. On XX/XX/XXXX, I also reached out to XXXX via phone to follow up on the appraisal. XXXX stated the appraiser had been lacking in communication and it was supposed to be due a week prior. On XX/XX/XXXX, I again reached out to XXXX via text regarding the appraisal. He said he would have it uploaded by the end of the day. I stated that it would be very much appreciated because we would be able to close on our new closing date of Friday, XX/XX/XXXX to which he replied correct. On the morning of Thursday, XX/XX/XXXX XXXX told our realtor that it would be down to the wire but we should be good to go for closing the following day. That afternoon our realtor forwarded us an email from the lender stating he was working on a potential issue with XXXX income. I tried reaching out to XXXX via phone to which my call was forwarded and I received a text message that stated XXXX minutes please. At this point, it was our understanding that the only thing that was holding us back was the closing cost assistance program XXXX was trying to use. We told XXXX that we would rather move forward without the program so we could get into the house sooner and not be stuck living in a hotel for another week. Because Monday, XX/XX/XXXX was a holiday our next closing date was not set until XX/XX/XXXX. On Tuesday, XX/XX/XXXX I asked for updates multiple times and XXXX stated they were close. That afternoon he sent us the following message We got it. XXXX have final numbers first thing in the morning. This signified to us that we were approved and would be able to close Thursday, XX/XX/XXXX. On Wednesday, he stalled to give us final numbers multiple times and again started telling us were close. XXXX stated we would be able to close the next day, XX/XX/XXXX. XXXX got off work early that day and he went down to XXXX office to try and get everything straightened out. During XXXX conversation with XXXX, XXXX stated he was unaware of how much the seller was providing towards closing, how much funds we had on hand, and made the general impression to XXXX that he was nowhere near being close to an actual deal ( all of this information was provided to him on multiple occassions ). Thursday, XX/XX/XXXX was our third closing date. XXXX had taken the day off work in order to be able to pick up the keys so we could move out of the hotel and into our home. XXXX called XXXX. XXXX told him that we would not qualify for the closing assistance but that everything should be good to close that afternoon. We then received a message from our realtor. Our realtor stated he had just heard from the title office and XXXX told them we were still a couple of days away from being able to close. We called XXXX to see why there was a difference in what he was telling us and the title company and he stated that he was still waiting on approval ( even though at this point he had told us we were approved multiple times ). XXXX sent XXXX a text requesting a copy of the appraisal because we had yet to see it. XXXX stated our file was locked pending review and he would get it to us after the review was finalized. The next morning, Friday, XX/XX/XXXX, XXXX advised us XXXX was denied for the loan. We again requested a copy of the appraisal. XXXX stated that we would have it within the hour. We then received a follow-up email from XXXX stating if we were working with another lender to have them reach out and request for it to be transferred to them. I emailed XXXX and told him we had already requested a copy from him and had yet to receive it. From there XXXX stopped responding. We decided to try again with another lender. When the lender reached out to XXXX, he told her the appraisal was never completed nor ever ordered. Throughout this entire process we were lied to, ignored, and led to believe XXXX was approved for the home loan. We have now been living in a hotel for almost 3 weeks with a XXXX and two dogs. We moved halfway across the country to give our son a higher quality of life and we are left completely bamboozled by XXXX actions. This entire process has caused an immense amount of stress for our family, not to mention the amount of money weve had to spend on hotels, food, and storage for our belongings. My family and I are essentially homeless and out thousands of dollars in lodging and storage. XXXX actions are of gross negligence and we hope action is taken to correct this situation.

As the homeowner, I defaulted on my home loan due to loss of income. My lender, SWBC Mortgage approved my request for a loan modification for a forbearance for XX/XX/XXXX through XX/XX/XXXX. I agreed to pay {$5.00} per month during my forbearance period. The final payment was logged into the lenders system as received on XX/XX/XXXX. Upon my final payment I was not informed on the next steps to achieving a temporary or permanent loan modification. Therefore in XXXX and XX/XX/XXXX, I contacted the lender and was told that I needed to submit another request for loan modification application. The representative stated a packet would be sent to me. According to the lender, the 1st packet was sent to me in XXXX, I waited, but I did not receive it. After several calls to lender, letting it know that I had not received the packet, I finally received the packet in XX/XX/XXXX. I sent to the lender the request for a loan modification application and supporting documentation. The lender documented in their system that they received the work-out packet on XX/XX/XXXX. Unknown to me, the lender had activated foreclosure procedures on XX/XX/XXXX, the day after logging in my final forbearance payment. The lenders correspondence on XX/XX/XXXX, XX/XX/XXXX, and a second letter on XX/XX/XXXX highlighted their interest to help me to resolve the default on my loan. Both letters dated XX/XX/XXXX contracted the status of my effort for the review of my packet. One letter dated XX/XX/XXXX stated that the documentation was either incomplete or requires an update sent to the lender for review for my modification request. The second letter with same the same XX/XX/XXXX date stated that we are unable to complete a review of the application and fully evaluate you for a homeowner assistance program because the application was received less than 15 days prior to the scheduled foreclosure sale on XX/XX/XXXX. I do not believe the lender followed the Georgia foreclosure process according ( GA Code Ann. 44-14-162, 44-14-162.2 ) : 1. I did not receive a 30-day Notice of Intent to Foreclose. I also did not receive a notice of foreclosure via registered mail, certified mail, or overnight delivery. The only notification that I received that foreclosure was going to happen was the letter received on XX/XX/XXXX regarding the review of my loan modification request application. 2. I contacted the XXXX XXXX, the local newspaper, to confirm that the lender had followed Georgia Code that the lender made advertisement, a Publication of Notice of Sale, in a newspaper in the county where the property is located once a week for four weeks before the scheduled sale date ( GA Code Ann. 13-1-11. ) According to the local newspaper, the lender did not through public notice process. The search was made for the period of XX/XX/XXXX through XX/XX/XXXX. The XXXX XXXX confirmed that the lender had NOT made public notice. Now the lender has requested through magistrate court my removal from the home. My court date has been scheduled for XX/XX/XXXX at the XXXX County Magistrate Court in XXXX, Georgia. I believe the lender violated my rights as a consumer. I believe the lender did not want to work with me in good faith because they have identified that my home has increased in value ; the homes market value is over {$190000.00}, more than {$50000.00} above my purchase price 7 years ago. The lender did not operate by good faith after making my payments according to the forbearance agreement. The lender delayed sending to me the request for loan modification application. The lender stated it took 3 mailings for me to receive the packet, however I had only received one packet inXX/XX/XXXX, 30 days after making my final forbearance payment. I was unaware of the activation of foreclosure procedures. I did not receive notification via certified or registered mail and the lender did not conduct a public advertisement of the foreclosure to be completed on XX/XX/XXXX. My request is for the mortgage loan to be reinstated or new loan issued. I am also requesting that the foreclosure to be removed from my credit report. I would like for the {$4000.00} that I sent to the lender in XX/XX/XXXX to be applied as loan payments. In XX/XX/XXXX I sent {$4000.00} to the lender as required by lender as per the representative. The lender is holding it in escrow as per the representative to pay the attorney fees ; I would like for the money to be applied to my reinstated loan or returned to me. If the loan is not to be reinstated, because the lender did not follow proper foreclosure process, then the lender is to pay me the {$50000.00} for the equity they took from me for their decision to deliberately foreclosure so that they can take advantage of the current fair market value and obtain the equity through the resale of the property. And in addition to the payment, I want the foreclosure removed from my credit report. I am requesting that the lender not be able to seek a deficiency judgement.

In XX/XX/XXXX, my hours were cut due to COVID-19 and I made an online request for information regarding a COVID-relief Forbearance plan. I did not sign any paperwork authorizing a forbearance nor speak to a representative regarding my options. At that time I was able to continue making my mortgage payment and chose not to pursue a forbearance plan. Automated phone calls from SWBC mortgage began during the month of XXXX making reference to my " forbearance plan ''. In XX/XX/XXXX, I contacted SWBC mortgage to ask why these calls were coming in, the representative indicated that they needed to extend my forbearance plan and needed my permission to do so. I explained that I should not be on a forbearance plan, that I had only requested information about my options. I further explained that I had been making my payments on-time as expected. They informed me that I had been signed up on a Forbearance plan in XX/XX/XXXX. I told them to remove me from forbearance and explained that I was very frustrated that they enrolled me without my consent and essentially " burned through '' this option in such a way that it would not be available for me to use if it was needed in the future. Then in XX/XX/XXXX, my hours continue to be cut back and I'm not able to make my payment. I contacted SWBC explaining that they previously had me on a COVID-19 forbearance plan, but that I needed to have it reinstated and I asked if there was a way to " start it back up ''. They indicated that I had only ever used 5 months of the 12-month availability of the COVID-19 Forbearance, and the remaining 7 months were still available. They required that I go on a 1-month plan and then call back in XXXX to request further months. I agreed to this on XX/XX/XXXX with a representative on the phone. At the beginning of XXXX I check my SWBC mortgage account and noted that I had been assessed late fees and there was a past due notification on my account. I also noted that there were not messages regarding my COVID-19 Forbearance that I had requested in XX/XX/XXXX on my account. I called SWBC mortgage and they had NO RECORD of me being placed on a Forbearance plan in XX/XX/XXXX. They said my account was simply past due with not special notes or information. I explained in detail the entire process going all the way back to XX/XX/XXXX and the representative said there were not notes to that effect on my account. After vehemently and repeatedly explaining that I should be on a Forbearance plan the representative finally admitted that they found notes to this effect on my account in the " Loss Mitigation '' notes section. From there they indicated that they would be able to place me on a COVID forbearance plan and they could make this retroactive back to XX/XX/XXXX. They said they would remove my late fees and recall the negative reporting to the credit agency on my account as well. This call concluded with me believing that I was reinstated on a COVID-19 Forbearance Plan as of XX/XX/XXXX and that all would be fine from here on out. Since then I have repeatedly received calls and letters from SWBC mortgage attempting to collect my late payments and assessing me further late fees. They indicate that I am now 2 months past due and they DO NOT have me enrolled on a Forbearance plan. Today I spent 2 hours on the phone with representative going over the entire process. According to her once my COVID-19 Forbearance was terminated in XX/XX/XXXX it closes out that option and I am no longer eligible to use COVID assistance. So their placing me on a forbearance plan without my consent in XX/XX/XXXX has now caused me to be 2-months behind without a means to provide me with assistance. Furthermore, they have continually provided me with false information that has caused me to believe that my account is under a forbearance, but it is not. I am now considered 2 months past due instead of 2 months on a forbearance plan and I'm being told there is no COVID-19 assistance available for me.

XX/XX/XXXX- XX/XX/XXXX : I have automatic payments without any issue. XX/XX/XXXX : I enrolled a new bank account to make payments. XX/XX/XXXX : Received foreclosure warning in mail. No notification from SWBC about past due payments. Called and authorized payment in full from new bank account for entire balance. SWBC notified by email that payment was scheduled. XX/XX/XXXX : Noticed funds not withdrawn. No notification from SWBC. Called and agent gave vague error - " no account / unable to locate account. '' Appears to be technical error on their system as I have provided account. Authorized payment in full for entire balance + additional month again. SWBC notified by email that payment was scheduled. XX/XX/XXXX : Noticed funds not withdrawn ; no notification. Called and agent informed me my old account was still present in system despite me removing it in XXXX. Agent removed. Agent informed me last payment was attempted against old bank account. This is illegal as I did not authorize this. I authorized agent to make full payment from new account again. SWBC notified by email that payment was scheduled and I confirmed a payment withdrawn days later. XXXX XXXX : Discovered autopayment inactive and I am 6 days past due. Immediately called to authorize payment exact same way as before. Registered for autopayment once again. Several days later, noticed funds not withdrawn. Called and found payment failed and autopayment inactive ; no notification. Agent informed me I am no longer allowed to submit electronic payments and must mail cashier checks. Obviously I accrued a late fee as the cashier check could not be delivered in time to their out-of-state payment office. Asked to remove restriction ; not possible due to 3 failed electronic payments. After informing them that the fault was on SWBC for charging the wrong account I was told they can not assist me and I must fax my concerns to a special number. SWBC failed to notify me appropriately of failed payments, causing me to lapse. SWBC also charged an account number I did not authorize which is illegal. My credit score has been affected by late payment reporting and restrictions make it unnecessarily difficult to keep account paid by deadline as the payment office is out of state and checks take over a week to mail there, as well as having to visit my bank during regular hours to order a cashier check despite being a fulltime employee who works during these hours. It is obvious to me that the lender has made an error processing my payment, is now punishing me for their error, has failed to notify me timely of payment issues which allow me to casually accrue late charges, and has placed restrictions on my account that especially encourage late payments. SWBC 's failure to process my payment correctly and legally has resulted in me accumulating late fees and affected my credit. I do not have any financial issue making payments and I have the resources available to pay off my entire loan today if desired, it is only technical errors on the lender 's side that I am experiencing such issues. I have attached exchanges with SWBC. The concerns I mention have never been properly addressed and SWBC has on multiple times replied with the same exact message on different dates. This company is failing to provide any mechanism to resolve this issue appropriately as I continue to rack up penalties that affect my lifestyle. I have proactively tried to resolve my issue on many occasions and have always made an attempt to get my account rectified as soon as I was made aware of an issue. The lender is the one with serious problems and the penalties they have given me are now affecting me financially. I am forced to file a complaint because the lender refuses to assist with my issues and is content with continually charging me unfair late fees and requiring legacy payment methods inconsistent with any other company I do business with.

SWBC Mortgage did not answer or address my questions or my complaint. Instead of looking at the Closing Disclosure and investigating the disbursement of the lender credit SWBC is attempting to blame the shortage on an insurance payment sent to the insurance company. SWBC did not apply the lender credit to my Property Taxes or my Escrow Account in the amount of {$1800.00} in section G of the Closing Disclosure. I was told that lender credit would go to my property taxes escrow. It is listed in the Closing Disclosure to be applied to my property taxes. However no lender credit in the amount of {$1800.00} was applied to my property taxes or deposited into my escrow account. The shortage is not due to the insurance payment its due to me not receiving the lender credit in the amount of {$1800.00}. The shortage occurred in XXXX 2016 when SWBC paid my property taxes and no lender credit had been applied to my property taxes or the escrow account. In exchange for a higher interest rate I was supposed to receive Lender Credits totaling {$5000.00} and I did not receive a total of {$5000.00} in Lender Credits from SWBC Mortgage. SWBC made a vague and general statement about lender credits being applied for administrative fees but there is no accounting for the specific lender credit of {$1800.00} for property taxes. That Lender Credit was never placed in my escrow account to assist with the payment of my property taxes. Since I did not get {$5000.00} in Lender Credits I should either receive the lower interest rate or Lender Credit either needs to be applied to the escrow account or I should be reimbursed. The APR is understated and the Finance charge is understated based on the calculations out of APRWIN the OCC Application to test the accuracy of the APR and the Finance Charge. The reason that my APR and Finance Charge is understated is because SWBC failed to include the FHA mortgage insurance as a finance charge for the life of the loan. An FHA mortgage includes both an upfront cost, paid as part of your closing costs, and a monthly cost, included in the monthly payment.My LTV is greater than 90 % and mortgage insurance premium will be paid for the life of the loan. My APR was understated by .3904 % and the Finance Charge was understated by {$32000.00}. My Total of Payments on the Closing Disclosure is {$640000.00} but it shouldve been {$670000.00}. The Finance Charge was disclosed {$310000.00} but it shouldve been disclosed as {$340000.00}. The response and reasons that SWBC listed as to why my APR & Finance Charges are not understated was not sufficient. SWBC has not provided the calculations, disbursements, or accounting of points, fees, of what was a finance charge. The response did not even discuss the mortgage insurance premium being calculated as a finance charge. I should be reimbursed. A mortgage loan originator should not get to pass responsibility to Title Companies, Brokers, and sub-servicers that they chose to conduct business. I did not choose XXXX XXXX for title or my closing services. SWBC chose XXXX XXXX. Failure to provide all disclosed Lender Credits is a violation of Truth in Lending Act. This is also a breach of contract because I did not get the benefit of my bargain. I was told that I would receive {$5000.00} in Lender Credits at the Loan Estimate and specifically disclosed that a Lender Credit would be applied to my property taxes and in exchange for that I took a higher interest rate.

I bought my home with a VA loan through SWBC Mortgage Corp. My issue is that SWBC is making misrepresentations to me about my loan and denying me access to government homeowner assistance programs. My estranged wife became XXXX XXXX XXXXXXXX and this caused major problems when she gained access to all of my bank accounts and savings and drained all of this money. As a result I fell behind on my mortgage loan. I tried to apply for a loan modification or forbearance agreement and was told that those were not options, the only program was a repayment plan and that I would need to be " current '' before they could look at any other options. I entered into the repayment plan and made the payment for several months until the weight from the drained bank accounts crushed me and I fell delinquent again. I tried to get SWBC to work with me but they told me they would not and could not consider any assistance options until I became current. I have checked around and this is not true. There are modification programs for homeowners with VA loans but SWBC is not being straight with me and not allowing me to be considered for these programs. I served in the XXXX XXXX as an XXXX XXXX XXXX for 8 years. Upon discharge I entered into the private sector performing the same job for a XXXX company. My wife and I bought my home in XXXX with a VA loan.. Several months later I discovered that she had become XXXX XXXX XXXX and she moved out. She began draining money from the bank account and in XX/XX/XXXX she was somehow able to gain access and take all the money that I had. I was only a couple of payments behind at the time and contacted the SWBC agents to request help. I was told that I could enter into a repayment plan. I made these payments as long as I could but my estranged wife had gained access to all of my bank accounts and had taken all of my money to feed her habit. I finally defaulted on the repayment plan in XX/XX/XXXX. When I contacted their agents to try and be considered for other options I was told I would have to first become " current '' and then they would look at options. This was a blatant misrepresentation because I know there are several different homeowner assistance programs available for struggling borrower 's such as modification and forebearance, and you do not have to be current on your loan to even be considered. SWBC Mortgage Corp. has intentionally denied access to government programs that they are required to make available. Things took a turn for the worse in XXXX when I was laid off from my job. At this time I am receiving unemployment compensation and have asked that SWBC consider me for the forbearance plans they have available for homeowner 's on unemployment. Once again, I am ignored and passed along and told that I can't be considered for any programs unless I am current on my loan. I have new employment lined up and have the means to afford a fair mortgage payment. The issue that I need to address is the delinquent payments. This is an avoidable foreclosure situation if only my servicer were to follow the rules and work with me.

My wife and I have owned and resided in our home in XXXX since XX/XX/XXXX. In XX/XX/XXXX, we suffered damage to our home as a result of Hurricane Harvey. This damage included approximately a foot of water inside our home, which ultimately forced to remove sheetrock and flooring from our first floor. In addition, all of the lower cabinetry and the island in our kitchen had to be torn out as a result of floodwater damage. In late XX/XX/XXXX, we notified SWBC of the flood damage to our property. It was at this time that a XXXX representative offered us a mortgage forbearance lasting XXXX months. Since we had previously paid our mortgage for XXXX and XX/XX/XXXX, the three-month forbearance period covered the months of XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. The XXXX representative explicitly told us that we would pay for these XXXX months at the end of the mortgage period, and not all together at the end of the forbearance period. In XX/XX/XXXX, my wife called XXXX to inquire about our forbearance status. At the time, she informed XXXX that she had been laid off that month. She was then told by XXXX that we could extend the forbearance until XX/XX/XXXX. With her job loss and our need to make home repairs, we took the opportunity that was presented. During her conversations with XXXX representatives, she asked if the terms of the forbearance as they were presented to us in XXXX had changed, and she was told in no uncertain terms that they had not. Unfortunately, the information we were given turned out to be erroneous. As a result, we are now in danger of foreclosure despite our continuing attempts to resolve our status. Prior to Harvey, we had been homeowners in good standing who paid our mortgage on time. We think it is relevant to point out that one of the homeowners, who has been gainfully employed prior to and throughout the period in question, began a new job in XX/XX/XXXX in which he grosses an additional {$7000.00} a year. Moreover, the other homeowner has received unemployment for the past several months. We believe this information demonstrates both our ability and willingness to be consistent mortgage payers. Currently, we are in arrears as a direct result of the information several XXXX representatives provided us regarding our forbearance situation. In addition, we've been given several contradictory versions of our status each time we tried to contact XXXX to resolve the issue. As you can imagine, this has resulted in a greatly frustrating and stressful experience for us, one that could've been avoided if XXXX demonstrated any degree of basic competence and organization.

The defrost mechanism in our refrigerator broke and water was leaking under it without our knowledge. This caused substantial damage to our bamboo flooring. A flooring contractor informed me that we had water damage, but stated he could refinish the floor. After initiating a claim, the mitigation company contracted by our insurance company determined the floors could not, in fact, be refinished. As a result, we had our kitchen floor and a large portion of the adjacent wall ripped out. We have now lived like that for 2 months while we waited for our insurance company to determine an " appropriate '' value for floor replacement. Finally, they informed us that they would be issuing us a check that would allow us to move forward with our renovations. I have since learned that it is fairly standard for insurance companies to require checks larger than {$10000.00} be managed by the property lien holder ( mortgage company ). What is NOT standard is the ridiculous amount of hoops that our mortgage company, SWBC, is asking from us. We must not only send them a XXXX with a signed contract from any contractor working on projects, but continuous itemized receipts to receive any money. Are they planning on paying the interest on the credit card I will be forced to use to buy flooring? I am so confused and wondering why they are micromanaging our project? I do realize that they have a vested interest in the integrity of our home, but I would like to manage the finances of this project on my own? So, if I am able to find flooring and a contractor to do the work for less then the amount of money placed in escrow, where does the remainder of the money go?? Do they keep it, send it back to XXXX? This has been such a disaster. I have spoken to many persons with similar claim amounts wherein their lender simply required them to sign a waiver showing intention to complete repair work. I have since been on the XXXX site where I discovered multiple complaints on the same issue of prompt insurance check payments from SWBC. They complained of waits upwards of 2 months! I simply can not have holes in our kitchen for another 2 months while I wait to be repaid for repairs? Is the escrow check interest earning? Is SWBC really paying to employ persons to manage this? This seems like an unbelievable waste of resources. I am so regretting using this lender, and we will immediately refinance after this debacle ends, but for now ... our insurance claim money is being held hostage?? I never knew this was legal. : (

On XX/XX/XXXX and XX/XX/XXXX, I scheduled payments of {$1200.00} and {$1200.00} respectively, to cover my XX/XX/XXXX mortgage payment. Without any attempt to contact me beforehand, my mortgage company mailed the XX/XX/XXXX payment back to me using snail mail with a letter stating that they were unable to accept the payment because they considered it a partial payment. By the time that I received the letter and XX/XX/XXXX check in the mail, and was informed of this policy, I had already scheduled my XX/XX/XXXX, payment and when I looked at my account, that payment was showing up in a suspended status. I contacted the mortgage company immediately and was encouraged by a supervisor ( XXXX ) that if I scheduled the payment again it would post in time to merge with the now pending suspended XX/XX/XXXX payment and result in a full payment being posted to my account. In response, I promptly re-scheduled the payment of XXXX. However, when I called back the next week for an update, I was informed that instead of merging the funds, as the supervisor had stated would occur, the XX/XX/XXXX check had now been sent to me using snail mail again and the new payment was now pending. At that time, I was encouraged by another representative to reschedule the payment in order to have them merge. This cycle has now occurred a total of three times. Each time, I have been encouraged by a customer service representative or supervisor assisting me, that when the other payment is received it can be merged with the suspended payment and credited to my account. Yet, instead of this happening as promised, my mortgage company is sending the pending payment back to me. To date now because of this, my XX/XX/XXXX payment has not been credited despite multiple efforts. Further, in spite of multiple assurances by multiple supervisors and representatives to override this automated process, nothing is being done on their end to remedy the situation and I am apparently being left completely at the hands of a failing automated process. As of today XX/XX/XXXX, I have been told by yet another supervisor that I will need to try again. I feel as if the mortgage company is forcing me into default on my mortgage payment which has never been late and I need real assistance in getting this issue resolved before XX/XX/XXXX when my payment will be considered late and in default. I am seeking a correction regarding an event occurring XX/XX/XXXX I was notified of a late payment regarding my account. My account was scheduled for auto-pay and I have enclosed an ACH transaction receipt number with this letter showing that XXXX withdrew XXXX from my account. After speaking with XXXX customer representatives to rectify the situation I was instructed to fax proof to the XXXX XXXX department, the enclosed ACH transaction number was sent in the fax. After sending the fax there was no follow-up or communication from XXXX regarding the issue or notifying me that the investigation was closed. This error caused my account to become delinquent and according to XXXX customer service representatives, this caused my auto-pay scheduled for XX/XX/XXXX to not draft since XXXX had not credited the XX/XX/XXXX payment. At no time has my account settings changed to deactivate auto-pay. As I have not been delinquent prior with auto-pay scheduled and functioning properly, I was unaware that the payment was not drafted until receiving correspondence from XXXX. Most recently I spoke with a customer service representative that notified me that the last written request sent in XXXX, XXXX to address this issue was closed without my notification and XXXX investigated the wrong date and event. From this conversation occurring on XX/XX/XXXX I was notified that a ticket with roughly the following information was executed by XXXX in XXXX of XXXX. TICKET NUMBER : XXXX CONFIRMED WITH CLIENT TICKET. TO REVERSE PAYMENT ON XX/XX/XXXX AND APPLY ENTIRE {$3700.00} AS A PRINCIPAL CURTAILMENT. A series a XXXX Reversals on the account payment history to occurred on XXXX XXXX along with a Principal Curtailment of {$3700.00}. On XX/XX/XXXX the funds appear to be inappropriately reapplied as mortgage payments. This caused me to have to pay an additional mortgage payment on XX/XX/XXXX to bring my account to good standing as XXXX had not credited any prior payment spanning from XXXX to XXXX as current. XXXX has reported a negative credit report that should not have occurred, which has severely affected my personal XXXX XXXX.

This is reference to SWBC Loan # : XXXX. Property address : XXXX XXXX XXXX XXXX CO XXXX Please note that I had recently sold my home XX/XX/21 and need to address this retrospectively since I was unable to resolve this after numerous attempts to contact both XXXX and the USDA who handled the payback of the forbearance prior to my house closing. This is in regards to the payback of a 6 month forbearance that I had with the swbc. When it came time for the proceeds of my home sale to pay off my mortgage balance and forbearance there was a discrepancy in the amount that they had me pay back versus the actual amount of the forbearance. The forbearance period was for 6 months with no penalties or interest as per the documentation I was provided. However, the mortgage payments were XXXX per month for 6 months. This would make the amount owed XXXX not the XXXX I was ordered to pay the to U.S. Department of Housing and Urban Developement. My calculations show that there is a discrepancy of approximately one month of mortgage payment that I am owed as a refund for overpayment due to them not giving me the opportunity to resolve this beforehand. I had after spending numerous hours finally reached the USDA and spoke to someone on an escalated call in a desperate attempt at resolving this and they informed me that I had to consult with SWBC mortgage in regards to this issue. I then if course attempted to no avail contacting swbc and have also spent numerous hours both being on hold and then being transferred to incorrect customer service agents on their primary customer service number. This is in addition to of course calling the assigned forbearance executive resolution number at XXXX. On this is number they do not answer and ask the consumer to leave a message assuring they would get back to you within 48 hours. Ive been leaving multiple messages over the course of the past 2 weeks week and have yet to receive a response which is what has prompted me to finally make this complaint.

I am a senior and sold my home in XXXX ( XXXX XXXX ) in XX/XX/XXXX The mortgage was held by SWBC Mortgage. I moved near my grandkids in XXXX XXXX. On about XX/XX/XXXX my son received at my home an escrow refund check for XXXX from SWBC. I was traveling and I asked my son to deposit it at XXXX XXXX XXXX in XXXX XXXX. He called and asked how he should endorse it and XXXX recommended to deposit it " For deposit only '' which he did because he didnt want to sign my name. At the end of XX/XX/XXXX I received a notice from XXXX that the escrow check from SWBC would not honor the check for " non endorsement ''. I called SWBC immediately and they transferred me from office to office. They said they would call me back on the cancelled funds. No return calls were EVER made. I then called two times per month beginning inXX/XX/XXXX, was told that twice that the funds would be " resent within 48 hours '' yet nothing was sent. They asked that XXXX send a certified letter from XXXX itself stating they didnt cash the check. XXXX did and still no replacement check. Finally after 5 calls the end oXX/XX/XXXXI received the check inXX/XX/XXXX I have had a credit score of at or near XXXX for over 15 years. In XX/XX/XXXX I had a notice that SWBC did n't receive my payment for my new home in XXXX XXXX, and had a statement owing for two months, which I paid, minus the XXXX late fee. I never got late fees from them for the 5 months they owed me XXXX and I also had been assessed bank fees from XXXX for XXXXSWBC told me they would ask for a waiver and get back to me. In XX/XX/XXXXI found that they reported my payment being 1 month overdue, and drastically affected my credit score to XXXX. I want this removed from all credit agencies. The XXXX owed was paid and I am still disputing that fee. SWBC held XXXX of my escrow money while I was trying to pay for my new home in XXXX also mortgaged by SWBC. I was contacted in XX/XX/XXXX to collect on a loan originally with XXXX XXXX XXXX. Held as security on said loan was a car that we were riding in when in an accident XX/XX/XXXX. Insurance adjusters deemed the car a total loss.XXXX charged off the balance in XXXX, we were not aware there was a balance remaining after insurance issued payment to XXXX. We received a phone call in XX/XX/XXXX from XXXX XXXX XXXX stating we owed a balance to XXXX regarding vehicle totaled in XXXX. We made payment arrangements and began repayment on XX/XX/XXXX of {$150.00}. Same amount was paid on or around the XXXX of the month through XX/XX/XXXX. At this time we were in the process of selling our current home and buying a new one and found out that our credit score significantly dropped. It was determined that XXXX XXXX XXXX had transferred our account to XXXX XXXX XXXX. Our credit report revealed that the transfer occurred in XX/XX/XXXX ; however, we had continued to make payments to XXXX XXXX XXXX through XXXX. We were not notified in writing of the new company servicing the debt and the balance did not reflect payments made XXXX - XXXX. We contacted XXXX XXXX immediately to explain the situation and make arrangements to pay the amount in full to improve our credit score so that we could proceed with our new home purchase. To date, our balance has not been adjusted to reflect payments made from XX/XX/XXXX - XX/XX/XXXX despite the fact that proof of payments has been provided. Our credit report still reflects balances owed to both collections agencies, reporting as a duplicate item further impacting our credit score. It is our wish through this dispute to correct the amount owed and obtain a payoff amount so that we can pay the account in full and be assured that this debt will be settled. It is also our request that our credit reports be updated and our credit score adjusted to reflect the payoff as quickly as possible so that our home purchase is not affected.

I had an issue last year where hail damaged occurred. I filed a claim with my insurance, and they issued me my first check. They made the check out to myself and SWBC. I sent this into SWBC for endorsements, and was asked to file numerous paperwork. I did that, and they issued me a check for the half of the insurance payment, made out to my roofing company, and myself. However, due to the length that it took them to process the check, I had to switch roofing companies, in order for the repair to be completed in time. I reached out to SWBC and told them I needed to have the check re-issued to myself, and I would pay for the roof repair out of pocket. I had to send in more paperwork in order for that to be done. I did, and they told me they would issue the check just to me. I continued with the repair ( paying for it all out of my pocket, since their process was taking forever ), and their inspector came out to approve. They sent me the XXXX half of the XXXX insurance payment, and endorsed the check for the XXXX insurance payment. However, I never received the re-issued check for the first insurance payment. I called them, and they told me my account was closed, and the check had been sent months prior. When I told them I never received it, they asked me to send in the check ( issued to myself and roofing company # XXXX ), and they would send me another check. They did n't however, only endorsed the check ( which made no sense ) and sent it back. I have sent the check back again, and they are now telling me I need more paperwork in order to get my money back ( which I do n't understand when the account was supposedly closed out ). I have asked to speak to a supervisor with none available. I still am out the {$3600.00} that I have already paid to my roofing company, and it has been 2 months. I keep getting the run around from SWBC on what it 's going to take to get this money paid to me.

On XX/XX/XXXX I took out full insurance coverage on my property and informed SWBC that I was fully covered, provided them written proof ( uploaded and physical documents sent directly to their stated address by my insurance carrier ) and instructed them to immediately stop taking out money toward my homeowners insurance as it was pre-paid in full for a year. In spite of repeated attempts to contact them over the next several months, both by me personally as well as my insurance carrier, SWBC continued to charge my account for insurance coverage that I was already carrying and for which I had directly pre-paid ( to GUARD ). At some point in the earlier part of 2020 SWBC finally stopped doing this, after at least five attempts by me through the company 's online customer service portals and appropriate channels to get them to stop. I don't know how much SWBC collected from me between XX/XX/XXXX and today to cover homeowners insurance -- I am unable to discern those exact figures in any of my statements from SWBC. I do know that SWBC continued to charge me for insurance for several months even after I informed them repeatedly to stop. I have been trying to get an accounting of that money and have it refunded to me and have met with nothing ( my most recent attempt was in early XX/XX/XXXX ) and my complaints have all been automatically re-routed to an automated AI/robot system that is not understanding the issue, most recently on XX/XX/XXXX. Additionally, the website login for SWBC is only intermittently available, so it takes repeated login attempts throughout the day to get into my account with my valid password and username. The time it has has taken me over the past many months is unacceptable. This kind of behavior by SWBC is a form racketeering and theft. They have taken my money, refuse to account for it, and do not respond to repeated requests for clarity and resolution.

I interviewed several Lenders and informed them of my ultimate goal is to purchase a new home in XXXX, CO & need a lender that is willing to use income from my Rental properties. XXXX XXXX with SWBC said ; We can use Income from Rental Properties to assist with LTV and we will have all your information & documentation in our system as we move along in the process. But first, let 's start with Refinancing one of the properties. They approved me for a 75 % LTV w several stipulations, I met the stipulations but their system was not accepting them, so they had to reduce the approval to 70 % LTV. I asked what it would take to get qualified at 75 % and XXXX said ; I would need to increase my base pay to $ XXXX month. I informed him that I 'm having an annual review & expecting a substantial raise in XXXX and will contact him then to re-submit my loan. I received an excellent review and increase in pay to $ XXXX. I sent XXXX and copied the General Manager ; XXXX XXXX. This is the email I received from XXXX : " We are now using a new computer system and it 's been too long so we would basically need to start from scratch. We would need all new documents, appraisal, etc. I do n't have the capacity at this time to handle the new business so I 'm going to have to pass '' This is so 'UNPROFESSIONAL ''!! ... and wasted ALOT of my Time and Energy. So I contacted XXXX the General Manager to let her know how unprofessional this was and asked if she could refer me to another Originator and she started to point out all of the issues and challenges they had with the loan! ... .and when I started to tell her : I had NO idea there were issues or challenges, she started to get defensive and making false accusations at me ... I quickly realized from the reaction of the GM that I was being Profiled & Rejected due to Prejudice.

I get paid twice a month. I paid my mortgage two months ahead and then began sending 1/2 of my monthly mortgage in every time I got paid. My Mortgage company will not post the partial payment until a full payment is received. This practice allows my money to benefit them and does not effectively reduce the principal and subsequently lower the interest I have to pay. Their practice also does not allow me to pay my loan off sooner than 30 years, due to their posting practice. I called and asked why and was told if I would sign up for Budget drafting I would benefit and my payments would be posted upon receipt. I mistakenly believed the auto drafted payments would be posted upon receipt but they are again waiting for a full payment to be received before they post it even though I am ahead of my scheduled due date by several months. My Bank is not allowed to do this so why is a mortgage company allowed to? This is unfair and to me and ( in my opinion ) is deceptive. I called again today ( XX/XX/2017 ) to see if I could remedy the posting issue and was told they were allowed to post it that way because I had signed up for budget billing. I told them the ONLY reason I signed up was because they told me that I HAD to if I wanted my payments posted upon receipt. This is a very bad practice and it is deceptive. The payment history also shows " payment applied '' however the payment is placed in my " syspense account '' until the next auto debit is taken ... this is misleading and a false statement. I am a single, mature ( XXXX ), XXXX female and wonder if a man would be treated the same way? They dismiss my concerns as unimportant and still wo n't give me the courtsey of a return call on the process and acknowledge that by holding my payment and not applying it when received cost me additional interest.

I was in a Chapter. XXXX Bankruptcy and fell behind on my mortgage payments by 3 months. The mortgage company sent for a dismissal of my bankruptcy on XX/XX/XXXX if I didn't pay the three months immediately. So to avoid getting dismissed I paid all three payments at one time on XX/XX/XXXX. They still certified the dismissal of my bankruptcy even tho I paid all three payments within the 30days. When I call to speak to the mortgage company no one can give me a answer on why they did that. My bankruptcy attorney said they should have pulled the dismissal ounce I paid> Every time I call the mortgage company they avoid the issue by putting me on hold until I hang up. On XX/XX/XXXX I was put on hold for a hour and eight minutes with out anyone coming to check in on me or anything before they just hung up on me. I have called and ask to speak to a supervisor to try and get some answers and help and every time they tell me one will call me back within 24 hours and no one ever does. I asked to speak to a supervisor on XX/XX/XXXX and I never got a call back. Now they are sending me demand letters that I bring the account current for XXXX and XXXX payments or else they will foreclose on me> Since I have just made 3 payments in XXXX its hard for me to pay two more payments this month. So I just have one payment set up for the XXXX of this month to pay XXXX and sent in a loss mitigation assistance package with supporting documents like bank statements and they say they wont accept my bank statements because I got them from my bank online. So my main complaints is that they got my Bankruptcy dismissed after I paid the amount I was told to pay and that I cant get a supervisor on the phone and they keep putting me on hold for over a hour and then just hanging up on me.

I opened a mortgage with SWBC in XX/XX/XXXX and sold the property in XX/XX/XXXX. I had to pay the outstanding property taxes at closing. I am still awaiting refund of the paid taxes. I initially filed a complaint with the TX Dept of Savings and Mortgage Lending in XXXX XXXX after four months of dealing with SWBC and them raising my escrow amount due to " predicted '' property taxes increasing without a valid assessment by the tax collector and for them not paying my prior year property taxes in full. I was told by numerous SWBC customer support reps that they would abide by their Truth in Lending statement and charge me the lower mortgage payment but it never happened. Had they done so, we would not be in this predicament of overpaid taxes in the amount of {$6000.00}. I submitted another complaint after being told three different scenarios for getting my tax refunded. They responded to the state agency with a lie stating they had confirmed receipt of my tax refund on XX/XX/XXXX and would send the refund in 5-10 business days. We are now at business day 23 and I called 4 times in the last week ( their message states they will call back the next business day, another lie ) and was told tonight that their tax department does not have the refund and it could tax another 4-6 weeks. As you can see with the letters they sent ( attached ) only 4 days apart, it's not even close to the truth. How can you confirm receipt by check number on one day and then 4 days later state you don't have the refund? The document on XX/XX/XXXX was uploaded to my Documents Center on their website but the one dated XX/XX/XXXX was what was sent to the state regulators. An obvious attempt to lie to the state regulators.

I have a mortgage with SWBC mortgage and have for about 5 years. In XXXX I took advantage of the Covid forbearance program due to lost of income and increase in expenses. I put in an application for modification to start paying back on my mortgage in XXXX. I submitted ALL documents asked for, I have the email to prove. Later I was asked to submit a document from my husbands previous employer on their company letterhead stating that my husband no longer works for the company and validation of expenses " documentation can be in form of bills, statement or bank statments ''. I let SWBC know that this is something that I wasnt able to provide, his company did not let him go in a letter, they are not even in business anymore. I did however attached his tax documents for receiving unemployment in XXXX. I spoke with a representative on the XXXX and asked was that sufficient and was told that that is enough to show lost in income. Email 4 is when i sent the unemployment stub on XX/XX/XXXX. Email 1 shows utility bills sent XX/XX/XXXX. *Note* my husband is not even on my loan as a borrower or guarantor. Everytime I ask for a supervisor they say I have to wait 48 hours and I NEVER receive a call. I call the customer service the rep tells me they are working from home so its no way to get supervisor help or ask the underwriter specific questions. I do have a hud counselor involved now but things are not moving. This is my home! I dont understand why they will not take unemployment documents from the government to prove that he was unemployed instead of a letter. I have attached all documents submitted by email with time stamp.

I applied for a FHA/HUD loan with SWBC Mortgage, XXXX, TN. I submitted all paperwork and documentation to receive a pre-approval, GFE, and loan was sent to underwriting after submitting a letters and other documents to processor. I was called on XX/XX/XXXX by loan officer XXXX XXXX and was told that loan was denied because of statement in letter regarding " why '' I amended XX/XX/XXXX taxes. I stated it was the request of a former lender ( XXXX ) in which I did not close on foreclosed home. I scheduled a meeting with XXXX and his supervisor. I was informed that I was committing fraud and falsifying documents. I informed SWBC I did nothing wrong. I do not know anything about their industry as I am ignorant to the lender/mortgage industry. I 'm working on becoming a XXXX time homeowner. I did what the lender requested of me. I asked that they call FHA/HUD while in their presence to verify what was stated and amendment of taxes is illegal and verifiable reason for loan denial. Unfortunately, XXXX ( FHA/HUD customer service line ) stated only an underwriter can speak with HUD underwriters to get the information. Also, I requested the SWBC 's underwriter to send me documentation of the information as I may have to retain an attorney due to the implications of fraud ( me and/or lender ). I was told by XXXX supervisor that XXXX underwriters of SWBC have denied the loan. I 'm still awaiting the denial letter from SWBC Mortgage and the information from the underwriter that verifies I have committed fraud via FHA/HUD policies and they have the right to deny me the loan.

I have recently refinanced my mortgage loan and the previous servicer was SWBC Mortgage. In this process, I have experienced two main issues related to payments and escrow accounts. The previous loan was paid in full to SWBC Mortgage as of XX/XX/XXXX. In anticipation of the upcoming pay-off, I canceled the " automatic payment '' feature on the account on XX/XX/XXXX. The payment was still automatically withdrawn from my bank account at the beginning of XX/XX/XXXX, despite the loan being paid in full and the request to discontinue automatic payments. When the withdrawal was still pending with my bank, I called SWBC and asked them to intervene and I was told there was nothing they could do, and that the funds would be returned to me ASAP. After several weeks ( on XX/XX/XXXX ), when I had not received the refund for the mistakenly drafted payment, I called SWBC and asked when I could expect to receive it. I was told that this payment refund would be coupled with the escrow account settlement and that I should receive it within 20 business days from the payoff date of the loan, which would be Monday, XX/XX/XXXX. Well today is XX/XX/XXXX and I have still not received the escrow settlement or the refunded payment. And so I called again today ; and I was told that the payment would likely arrive next week sometime. To summarize, my complaint is that a payment was erroneously withdrawn and the remediation has taken far too long, and the timeframe for the escrow account settlement has exceeded the required 20 day window. I lost my job two years ago and took advantage of the Alabama Hardest HIt program where they will pay your mortgage for one year. I was assured in a three-way phone conversation by both Hardest Hit Alabama rep and SWBC rep who works with these types of programs that this would not negatively effect my credit. I was concerned when i first went through the application payment because the end of the month would come and they hadn't paid it so I would pay it to keep it current and they told me to stop paying it, late payments under these programs would not be reported to my credit. This fall, the Hardest Hit program made three late payments, I believe on over 60 days late and two over 30 days late. This was reported on my credit and now my score has dropped drastically and I am having my credit card companies cancel cards on me. I filed a dispute with the credit agency, who told me I had to also file one with the mortgage company, which I did via a letter and also email. I received a letter from them last week assuring me it was under investigation. Yesterday, XX/XX/XXXX, I received a second letter from SWBC stating that the found the information to be accurate and are not going to fix this. This puts me in great jeopardy as I have started a business and my money is tied up and until it becomes liquid, I am dependent on credit cards - which I have always made my payments to all of them, mortgage included ON TIME!!! Please help me! I'm going under! My retirement is at stake here! Please help!!!

In XX/XX/XXXX, I notified SWBC Mortgage Corp that I need a forbearance as I was financially impacted by COVID-19. I was given a 6 month forbearance period beginning in XXXX. In XX/XX/XXXX, I called SWBC to start the loan modification process as I was able to start making mortgage payments. I was given a deadline of XX/XX/XXXX to have all documents submitted. I emailed the remaining documents on XX/XX/XXXX directly to the underwriter who stated that they would process it the same week and the mortgage payments would continue in XXXX. The underwriter did not process the documents and I had to start the whole process over again in XX/XX/XXXX. All documents were submitted to SWBC prior to XX/XX/XXXX. I continue to receive letters and phone calls stating they are missing documents. Every time I call to speak to someone, I am told that different documents are needed than what the previous person told me. I have requested to speak to a supervisor or the underwriter on three separate occasions. I was told I would receive a call back within 24 hours but I was told today that no one had ever submitted a request for a manager to call me back. I called two times today, XX/XX/XXXX, and each representative refused to let me speak to a supervisor or underwriter and each one hung up on me. I am now being assessed late fees, penalties and negative impacts on my credit. I can't refinance the mortgage with a different lender as the mortgage is showing as 6 months past due.

On XX/XX/2020 I closed a refinance transaction with XXXX XXXX XXXX, XXXX. XXXX XXXX XXXX, XXXX disbursed my payoff with an effective date of XX/XX/2020 to SWBC Mortgage. The payoff was sent via XXXX and delivered on XX/XX/2020 at XXXX XXXX. and signed for by XXXX. at the payoff department in XXXX, NJ ( XXXX, NJ ). The payoff department did not deposit the check from XXXX XXXX XXXX, XXXX and stamped it received on XX/XX/2020. SWBC then returned my payoff check to XXXX XXXX XXXX, XXXX with a letter stating that my check was not received until XX/XX/2020 for the full payoff and also included an updated Payoff Statement good through XX/XX/2020 for an additional {$400.00}. Multiple phone calls have been made by XXXX XXXX XXXX, XXXX to the customer service department and associates state that they will escalate it to upper management. XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, has been told by three different associates that a payoff department manager would return her call and she has yet to receive a phone call. She also faxed copies of the XXXX label and confirmation of signature receipt as directed by customer service. The faxed cleared to SWBC and no action has been taken. I have now wired a full payoff to SWBC and am disappointed and frustrated that I have had to pay an additional {$400.00} due to the error of the payoff department. This constitutes predatory lending behavior and I have been advised to contact CFPB for this purpose.

We were told we would be able to do an FHA Streamline refinance on our house as soon as we were paying on it for since months by our lender, XXXX XXXX at SWBC. We talked about this probably once a month until the date was close enough to start submitting the paperwork. The process started on XX/XX/XXXX. We submitted all the paper work he needed almost immediately and was told not to make the XXXX payment because of the refinance costs. My wife and I trusting our lender did not and waited for him to get back with us. The last I heard via email was on XX/XX/XXXX and was told they were sending it to underwriting. We waited another week or so and started getting worried so I reached out to XXXX. I received a text back saying he would call me in an hour or so but it wound up being the next day before I heard back. This was nearing the end of XXXX and he told us there was some issue but he would get it resolved. He finally told us after several attempts to contact him later, at this point its after XX/XX/XXXX, that they can not do the refinance. This sent me and my wife reeling trying to catch back up on two mortgage payments and were unfortunately not able to get caught back up until XX/XX/XXXX. Now because all of this my wife and I have negative history on our credit and are unable to refinance somewhere else to get away from SWBC. This whole thing feels like a ploy to keep us shackled to them.

My name is XXXX XXXX I have been with SWBC for over 5 years. I have always used SWBC budget drafting and never had an issue until now. In XX/XX/XXXX, I refinanced my property at XXXX XXXX XXXX XXXX XXXX, GA XXXX and set up bi-weekly payments ( via automatic payments ) with SWBC in XX/XX/XXXX. Recently, I received a notice that I have a past due amount of {$2200.00} ( which is for the total month of XXXX. ) After speaking with XXXX customer service agents, they can not explain why the budget drafting did not occur. However, everyone sees my payment in XX/XX/XXXX of {$2200.00} which was required to establish the auto-draft to meet the XXXX month payment ahead requirement. Since SWBC did not set-up my budget drafting, I now owe {$6700.00} ( this includes XXXX and XXXX payment plus another {$2200.00} to reset auto drafting. ) Because the organization made an error with setting-up the auto-draft, I should not have to pay another {$2200.00} ( to be one month ahead ). I understand I need to pay XXXX and XXXX payments. I asked to make a payment arrangement via auto -draft so that I can pay for XXXX and XXXX. Additionally, I need my auto-draft to start this Friday ( XX/XX/XXXX ). I informed the company that I was sending an official complaint to the consumer financial protection bureau. About two months ago SWBC sent me correspondence saying I needed to pay an escrow shortage to my account in the amount of c. {$750.00} if I didn't want my monthly payment to increase, and that I could log into my account and pay it online. I logged in and filled out the fields to pay it in full. However, SWBCs website interface instead charged me a full second mortgage + the monthly overage I had been paying PLUS the escrow overage. I have called four times now to get them to apply the overage I signed up for for the escrow and, going forward, to stop adding overage payments to my monthly accounts -- to return them to the minimum/basic payments. I have called and been on hold for over an hour multiple times and explained this issue to four separate customer service reps who all apologize and say they have fixed the issue. All are incompetent. I just logged on to my account and see it is STILL on track to be charging me the overage ( {$2000.00} ) in XXXX instead of the base rate that I have repeatedly requested ( {$1700.00} ) and I am unable to adjust this online. I also can not see where I was credited the additional escrow I paid in XXXX. The system is completely broken and there is no recourse to correct it. I have wasted hours of my time trying to fix this and nothing has worked. SWBC is negligent, incompetent, grossly inept and criminal in this level of willful dysfunction.

I was in forbearance for a while and during that time I signed up for the HAF program. Right before my last moth in forbearance I was given 3 options for the past due amount. The option I selected was the Partial claim to move the amount to the back of the loan ( At the time I didn't know it was a HUD program ). Almost a week later I find out I was approved for the HAF program and I quickly contacted my mortgage company SWBC about it. Since the beginning of the forbearance my calls get directed to the collections department and they aren't the most helpful crew. During that and ever call I made or they made to me this point was raised. At no time was I advised that this program would need the lumpsum payment made to HUD and not them. Towards the end of XXXX the XXXXAF program sent them a lumpsum and the first months payment. SWBC just sent both the payments back to the HAF program. They stated because of the partial claim I now show no payment due. I asked them why was it not to the loan? They had no answer for that. I'm now having to go back and forth with 3 different companies ( SWBC, HUD and HAF ) and I feel like there's nothing happening to correct this. I'm now officially late on my mortgage they are going to put this on my credit and no hope in site. My family and I need help and feel like this situation has just made it worse for us.

We close on our home XX/XX/XXXX, FHA loan, SWBC Mortgage Company. Since our very first payment, SWBC has not kept accurate records of payments they said we missed our XXXX XX/XX/XXXX payment. on XX/XX/XXXX we paid {$4600.00} because they said we missed XX/XX/XXXX payment, so the XX/XX/XXXX payment was for the missed payment for XXXX which brought us current. XX/XX/XXXX we paid {$2300.00} on XX/XX/XXXX we paid another XXXX because they said we was behind again, but we where current because we took out our 401 plains to make those payment to become current. Every since then records have not been accurate both double payments kept us behind along with XXXX having to go on workman compensation for a XXXX so we ask for a loan modification.On XXXX XXXX that's when the loan modification was granted along with a trial period we passed the trial period. XXXX XXXX HUD gave SWBC {$95000.00} toward our account it took our payments for {$2300.00} to {$1600.00} per month. After we were granted the loan modification our payments were {$1600.00} our payments went up to {$2100.00} per month. This is not a loan modification. We have tried numerous of times to work this out with SWBC to no avail. Now we are right back where we started, XXXX, XXXX we paid {$1600.00} and XXXX we paid {$1900.00} now we are at {$2100.00} per month. This is no loan modification.

Dear Consumer finance team, We have had a conventional loan for our property in XXXX, TX since XX/XX/XXXXwith our lender, SWBC mortgage. We were never late on payments and in XXXX we took advantage of the CARES act forbearance plan, as provided by federal government. This was due to financial hardship and thankfully, we were able to resume monthly payments in XXXX and we were current ever since. Because we have been paying PMI on our loan since XX/XX/XXXXand since our home value has increased substantially, we asked SWBC for the PMI to be removed but were told because we took advantage of the CARES forbearance program, our payment is considered late in XXXX and that we no longer qualify for PMI removal, despite our good payment history and despite the property value increase. We find it to be very unfair to be put into this position because according to their assertion, we may never qualify for PMI removal since the CARES act caused a late payment in their system. I tried numerous times to reach out to the SWBC team to find a fair solution to this, but unfortunately, no one could help me with my ask. The COVID pandemic was not our fault, and I find it unfair to be penalized by my mortgage company for something that is an act of XXXX. I really hope you can help me with finding a resolution and thank your team in advance.

I went online to my personal checking account and I noticed that SWBC Mortgage accessed my checking account and withdrew my mortgage payment without my authority. I never let company 's auto draft on my account, and I have always submitted the payment manually. I called SWBC mortgage and they said I gave them authority to withdraw my mortgage from my account through an autodialer ( Robo call ). That's complete XXXX I said if you have the recording of the call with me giving you permission let me hear it. Of course they couldn't do it, because it never happened. It's a crime to access anyone 's personal bank account without that person 's permission and I'm sure its a felony to misrepresent themselves for payment. I spoke to XXXX XXXX and I asked them why they let someone without authority access my account. On XXXXXXXX XXXX XXXXXXXX weekend, I received a fraud alert on my account and I called XXXX XXXX and they are investigating it. When I hear back from XXXX XXXX I will know whether the fraud alert was triggered from SWBC Mortgage. I had to cancel my debit card during the weekend. We refinanced with SWBC in XXXX. The annual escrow disclosure statement came to us around the same time that our loan was sold to XXXX in XX/XX/XXXX. That is when we learned that our escrow opening balance was a negative {$1200.00}, rather than a positive {$1900.00}. As a result of my investigating as to why the escrow account was in the negative, I found out that a " pre-paid '' check of {$1600.00} that was intended for a 1 year premium of homeowner 's insurance was not sent -- and that SWBC took this premium from our escrow account instead, therefore making the account short. Since then, I have sent 12 emails asking where this check is. I have also called many times and spoken with supervisors, XXXX XXXX being one of them -- to no avail. I have called and spoken with XXXX numerous times explaining that what had happened, and I needed time to resolve this. In the meantime, I have been sending the original {$1400.00} payment each month, including the {$390.00} intended for the escrow account. XXXX has now sent a letter saying that they have alerted the credit bureaus and returned the last mortgage payment, less the escrow account monies, saying that they don't accept partial payments ( because I didn't send the extra monies to bring the escrow account up ) .Please help!!!

In XX/XX/2018 I called the Mortgage company to help with the setup of my online account profile and to establish the automatic payment on my account. I later found out in XXXX that the autopayment that was supposed to be setup by the mortgage company failed. As a result, a mortgage payment was missed. I was not informed that the autopayment did not process and was only notified by the mortgage company after the payment was 30 days late and they proceeded to start collections. After receipt of a letter from the mortgage company of the nonpayment, I immediately brought the loan current and asked the company to review the customer service calls that I placed to establish the autopayment, but they did not and I further asked that after review that they remove the negative remark from my credit report - due to the fact that the mortgage company employee that setup the autopayment failed to successfully setup the autopayment on my account. I have acted in good faith to try to resolve this with the company, but an unable to seek a resolution of for the company to acknowledge the customer service phone call that was made to establish the autopayment. As a result of the refusal to review the call logs my credit has been negatively affected and I am unable to obtain credit.

On XXXX XXXX, 2016 I closed on my house with SWBC Mortgage. I received my closing disclosure via email from loan officer XXXX XXXX from SWBC Mortgage dated X/XX/2016 via email. My closing disclosure listed a Lender Credit of {$1800.00} for property taxes in Section G of the Initial Escrow Payment at closing. However the lender credit of {$1800.00} was not applied to my property taxes or escrow account and has subsequently created an escrow account shortage.

In addition to not receiving lender credits disclosed on the closing disclosure the APR was understated over the .125 % and the Finance Charge was understated by more than {$100.00}. The disclosed fees exceed the tolerances under 12 C.F.R. 1026.18 ( d ) of Regulation Z and are reimbursable. I contacted SWBC Loan Administration and they expressed that I owe the funds for the shortage and that SWBC could not assist or clarify the Lender Credits, APR, or Finance Charges. I was told to contact the investor XXXX XXXX because SWBC is only servicing the loan. I contacted XXXX XXXX with SWBC Mortgage by phone and email however she has not contacted me regarding the disbursement of Lender Credits or the understatement of the APR and Finance Charges.

I bought my home in XX/XX/XXXX I used the VA Home loan and I am a XXXX veteran. I have made all my payments on time the entire time I have owned my home. In XX/XX/XXXX, my house payment was kicked back to my account. Unbeknownst to me, SWBC changed the payment portal website and did not notify me in any way. When I called to find out why my payment was sent back to my account, they told me that they have a new payment portal and to use this website from now on. So by the time my payment was processed again it processed on the 31st day so it was late. I paid XX/XX/XXXX and XX/XX/XXXX payment together and I was told I was current and up to date. I go to purchase another home utilizing a different company and on my credit report it showed XX/XX/XXXX was late. When I go to dispute it, it was taken off and then moved to XX/XX/XXXX on my credit report. SWBC refuses to write any type of letter saying that my account is in good standing and current when it is. I have nothing late and the one payment that was late would not have been had it been processed the first time and I was notified of the payment portal change. I feel like they are hindering me of a purchasing a new home with a different company.

In XXXX of 2016, my home was flooded in the Louisiana Flood. I have flood insurance. A claim was made to the flood insurance company and a claim was paid. The claim check was made payable to myself and my mortgage company. I contacted my mortgage company to inform them of the damage and of the insurance payment. I also worked with the mortgage company because I intended to self perform the repair work on the house. The mortgage company requested a letter of qualification that i was capable of performing the work and also requested that they be allowed to perform inspections. A letter of qualification was sent, I was approved to self perform, I completed the work on the house utilizing my personal savings account funds. Mortgage company was contacted and an inspection was performed that stated the house was complete. I also turned in receipts for materials spent. To date, the mortgage company will not release my insurance payment to me. It is sitting in an escrow account. Every time i contact them, they give me a different story. I have done everything requested of them and spent my savings to repair my house and they will not release my money. Please help!!!

In XXXX of XXXX, I changed my mortgage insurance from XXXX to XXXX and was issued an escrow refund. I called my mortgage lender SWBC and asked what I needed to do so that when I mailed to escrow refund to SWBC it would be applied to my escrow and not as a mortgage payment. I was told to include a note on the check. I asked for the person taking the call to make a note on my account that this additional money was to be applied to escrow and the person I spoke with agreed to note it on my account. I put a note on the check and sent it in to SWBC. SWBC applied the money as an additional mortgage payment causing my escrow account to come up short and now SWBC is demanding {$4300.00} in repayment. I called SWBC XXXX times. Each time I asked them to go back into my account and apply the money I sent as it was supposed to be applied and correct any accounting on my account. They refuse. They want to move money here and there and allow me to skip a few payments but pay off the escrow. I want the accounting corrected and straight so that later on my account is in tack as it should be. SWBC continues to ignore me and play with my money. I need help asap, please.

I have had the WORST experience with SWBC and more specifically, XXXX XXXX. I contacted XXXX and her team in XX/XX/XXXX. After 9 months of having to email her multiple times starting in XXXX of XXXX, I've had the last straw. She's run my personal credit report three times ( the last of which she didn't even tell me about ), allowed my appraisal report to expire, and not listened to what I've asked for. Today she finally told me, in XX/XX/XXXX, that she won't do my loan. The only way I got her to respond after emailing her several times was by emailing her employees. I have provided what they've asked for time and time again and she drug this process out for 9 months. I've had to make changes the last few months which have changed my financial position which is why I contacted SWBC back in XX/XX/XXXX. She is the most unprofessional, unhelpful employee in your company and I will be sure to let everyone else know to steer clear of XXXX and SWBC. I called the mortgage company two days after closing on my property to update my address so they could send me a check for the amount due back to me of {$1500.00}. After a month and a half of not receiving payment I called again and was told there was no record that I had called in and the check was returned because it was sent to my old address. I then updated my address again and was told I would receive the check within two weeks. After two weeks I called again last night and was told it would be a month before they would send the check. After I complained I was told the manager would call me first thing in the morning and they would overnight a check to me. After no call this morning I called and was told they would need 24 more hours before a manager could call me. Finally I was able to speak to a customer service manager but she said she could not send the check until the Escrow Department could stop the original check and then rerelase the funds which could take a day or two and she would mail the check so it would take 7-10 days. We are going on three months since I closed on my house and I get a different story every time I call in.

This account was part of a covid-19 forbearance. When the covid-19 forbearance ended they marked me as 120 days late even though our arrangement to get it current was fulfilled and no payments missed. This is fully inaccurate, proof enclosed. The loan underwent a loan modification that included 3 trial payments to be made in XXXX, XXXX, and XX/XX/2023. The conditions of those payments stated that as long as the payments were made in the month they were due, they would be considered on-time and apply. All three payments were made. At the end of the three payments, their information suppression failed causing a 120 day late saying no payments had been made, even though they had. Please note that for XXXX payment, it was posted on their website in XXXX but the charge did not hit my bank until XX/XX/XXXX. This does not affect the agreement as it was scheduled via their online portal. They removed this late data before recognizing it was a mistake, only to reinsert it without warning. All three trial payments were made but upon completion of the trial payments my account was immediately flagged as 120 days late.

On XX/XX/XXXX We made a payment as always to our mortgage company SWBC Mortgage who is also sister companies with XXXX XXXX. The agent received all of our information and " applied '' the amount to our loan. Couple of months go by and we start receiving foreclosure letters on a missing payment from XXXX. We fax in bank statements showing the amount was drafted from our account only for them to tell us it is not sufficient, they then start asking for a transmit XXXX form from our XXXX XXXX which our bank says they do not have or ever provide. After speaking to numerous agents and managers they are unable to help us and they do not know where the payment went, they open numerous cases and keep telling us they will reach back out to us. This account fell into default due to the covid-19 pandemic. As part of the relief I had requested a loan modification. The loan modification was granted pending three trial payments. As part of this agreement no late action penalties would be taken against my account, including late reporting or foreclosures, or late fees etc. The payments were set to begin XX/XX/XXXX for three months, at which point my mortgage would be refinanced into a forty year note at reduced payments. SWBC informed me via telephone that I would have a grace period for these payments, and that as long as I made them in the month it would be valid. My payday was XX/XX/XXXX and I made the payment the same day. It posted, and cleared, and is attached. On XX/XX/XXXX I was reported as 167 days late ( from 0 ) causing a massive crush in my credit score and potentially jeopardizing the agreement. I want to emphasize in absolutely no uncertain terms that SWBC told me that even though the paper said XX/XX/XXXX was the deadline, that if I made it on XX/XX/XXXX it would not be an issue. I first requested the assumption package on this loan back in XXXX, XXXX. I did not receive the actual package until sometime in XXXX. The initial package was returned to them on XX/XX/XXXX. There have been continuous delays by the lender and they have simply used the excuse that because of the lower rates on the assumption they are very busy. When this process started the loan was in both mine and my husband 's name. He passed away on XX/XX/XXXX and I informed them right away. I sent them copies of my husband 's death certificate and requested to proceed in my name only. On XX/XX/XXXX they informed me that they required a whole new application package. The loan officer XXXX with SWBC misrepresented the product with her company by claiming to have a three in one close with an VA approval. I discovered that SWBC do not offer an construction when XXXX claimed she would have to speak with another bank. She mislead me to believe she was the one that would process the loan and do the lot, construction and permanent loan all in one. She falsely stated that the VA loan offered only 5 % and that I would only have one close. All this turn out to be false and again SWBC do not offer construction loans. She violated my trust and presented false statement about the loan process and when confronted about what she did, she attempted to avoid the conversation. They acted in a malicious manner and refused to be truthful about what she stated but the realtor that referred her to me was on the phone when she claimed what she could do and the type of loan she would provide.

During the process SWBC is showing us 30 days delinquent in XXXX 2020 where are loan was closed by XXXX. We tried sending SWBC the information showing them this was taken care of. SWBC refuses to help us with this situation and after talking with people at SWBC they even admitted this was in error therefore, whoever is doing the background check for this delinquent time frame isn't doing their due dilingence. Since XXXX of XXXX SWBC Mortgage was hitting me with late charges because they stopped taking XXXX XXXX on line e payments from my account. I called there customer service and they did not offer any help at all only choosing to say it was my responsibility. They eventually waived XXXX and XX/XX/XXXXXXXX late payments because they eventually received the paper bank checks XXXX XXXX sent out but in turn hit me with a XXXX late payment after XXXX XXXX put a stop payment and I in turn made back to back mortgage payments to bring the account u to date. This is in reference to swbc loan # XXXX. I was approved for a 6 month forbearance plan under the CARES act XX/XX/20. At that time I was also insured that this was not to have any record whatsoever on my credit report under the condition that I resume paying my mortgage when the forbearance plan ended as per conversations with executive resolution specialist XXXX XXXX with our last contact XX/XX/20. I have been making timely payments since the plan ended yet discovered that swbc placed record of this on my credit reports which has negatively impacted my personal credit rating. If I was not promised that this would not be the case I would not have enrolled in the forbearance plan since I work hard to maintain impeccable credit and do not appreciate the frivolous this company has done this despite stating they would do otherwise.

We sold our home mortgaged through XXXX in XX/XX/2016. On XX/XX/2016 a refund of our escrow account was mailed to our old address. Apparently the refund check was deposited by unknown person on XX/XX/XXXX. Two attempts made to properly fill out these forms. Both times rejected, assumed destroyed, and new ones re-sent, due to me not meeting previously untold requirements, according to SWBC, namely in-person notarization, and particular fields of information that allegedly went unfilled, even though thorough review of the 2nd signing attempt was overseen and notarized by an experienced notary public. A letter suddenly received days later ( dated XX/XX/2023 ; was not officially notified via email until XX/XX/2023 ) declaring the entire application for foreclosure prevention is now rejected and that I am ineligible, due to an unspecified deadline overrun for the forms to be submitted. I have been approved for HAF payment for my pass due mortgage payment and the. Mortgage company SWBC Mortgage continues to threaten foreclosure but HAF has been in touch with SWBC Mortgage so have I. Never received any notification of my home foreclosure. The dates that it happened I was thrown in XXXX on bogus charges. I have never been in XXXX before. Then my mail was stopped and not by me. The only forclosure I did get was from the new owners which they signed in XX/XX/2018 the letter indicating I have to be out by XX/XX/2018. While on the payment plan they accidentally removed the credit suppression causing my current and paid as agreed account to report as 120 days late. I have two mortgages with SWBC, both adjoining properties. In XX/XX/2021 I noticed that my escrow payment per month has doubled. My property taxes did not double. Indeed, working with SWBC I was told in XXXX that both my property tax bills were assigned to both properties, thus each property is receiving two tax bills when they should only be receiving 1. My mortgage company continues reporting a balance {$10000.00} greater than my loan. This has contributed to me being declined for credit accounts with other merchants. This was previously disputed with the credit bureaus and corrected in XX/XX/2020. I had mortgage payments scheduled through my bank 's bill pay service, scheduled for the XXXX of the month. The last payment was sent out on XX/XX/XXXX but was not cashed until XX/XX/XXXX. This incurred a late fee of {$120.00}. On Friday XXXX XXXX 2017 at XXXX XXXX, I received a phone call from my mother stating that someone named XXXX from a company named AP Services called her asking for me about a " business matter ''. I have not lived with my parents in many years for them to receive any phone calls at their home. She gave me their phone number XXXX. I called this number and received a prerecorded message stating that someone would be with me shortly. I was on the phone for 22 minutes and never spoke to anyone.

We are trying to pay our mortgage through Bill pay through our credit union. Our credit union keeps returning payments to our account because we have been given 3 separate addresses to send our payments to. One on our statement which gets returned, one from the website and one new one from a representative on the phone. We keep getting late notice and calls but we are concerned and upset that bill pay for XXXX is so hard when we do not have this problem with our other payees.
