'' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. '' This account is an adverse item they are reporting again without my permission which is against the law XXXX and XXXX are consumer reporting agencies and I am the Consumer According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy.15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. I had the IRS assess my account by sending SAFCO a1099a and 1099c. I completed a 1099a and 1099c IRS forms to cancel the debt. After SAFCO received them I contacted them and asked if they received them. I was told they were not in my file. I sent them a copy that I had when I submitted them to the IRS who mailed them the copies. I sent them a letter with the forms and negotiable instrument stating that according to UCC law dealing with legal tender that the debt had been settled. They responded back saying that that the negotiable instrument I sent was not an accepted form of payment. I sent another letter stating that it was according to UCC 3-603. They need to settle and satisfy the debt or there will be a Notice of Claim and Intent to Sue. They end up sending me papers that I signed, and their CFO knows that pertaining to the UCC law that I am right after I did my research. I addressed all my letters to XXXX XXXX XXXX, XXXX SAFCO Corporate Headquarters, XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, FL XXXX. As an American, all debts are obligations of the United States U.S. Constitution Article VI because according to HJR 192 the United States ( which is a corporation ) is insolvent. The credit of the American people is used as collateral for U.S. debt. They were told to send me the papers saying the lien is released, contract paid-in-full, and title to the car. They decided that they are going to ignore the law. I send a letter about GAAP ( General Accepting Accounting Principles ) questions that they are supposed to respond to along with an affidavit to XXXX XXXX XXXX, CFO which was completely ignored. I also sent the 1099oid and 8281 to IRS for the account. I have a copy of a letter from President Trump on Pre-Paid Non-Obligatory Commercial Debt Obligation Arrangement with the United States in relation to 12 U.S. Code Sec. 95a. All of this and they still want to continue to extort money from me knowing that what I have submitted to them is lawful. What good are laws if you are not going to obey and follow them? However, I am completing an administrative process in this commercial transaction to have this account settled and satisfied. After I complete the administrative process if they do not comply, they will be in default and then that is when I will take legal action. According to U.S. Constitution Article 1, Section 2, Clause 3 American Indians are tax-exempt. I do hope that your investigation will bring about some type of result to address my issue.

On XXXX XXXX I received a phone call from a Manager at Safco he advised me that my loan was behind for XX/XX/XXXX and XX/XX/XXXX. Advised I could make payment on XXXX XXXX he advised me he couldn't wait. I asked why and he had no response. He asked me if I had possession of the vehicle and I advised him no the car was In the Repair shop due to a legal issue that I was having with XXXX XXXX. He asked do I have to pay for the repairs and I advised no, he advised me he was going to call and verify the repairs don't have to be paid for and give me a call back. I never got a call back nor did he call the dealership to verify work on car instead he send someone to pick up my car and called me about 4 days later telling me I need to pay $ {$1500.00} within 10 days to get the car back. Very Unprofessional!! I recently found out that My credit is reporting 30days for XX/XX/XXXX and 90 days for XX/XX/XXXX ( incorrect ). Safco advised me that they placed a repossession on my credit for the month of XX/XX/XXXX, I don't understand why you took my car in the first place and report a repossession when you had the car for less than 5 days in your possession, in order to remove the 90 days on my credit report the R listed for XX/XX/XXXX have to be remove. Safco refunded me all the fees I paid for my repossession in XX/XX/XXXX due to my XXXX comlplaint. They refuse to remove The Repossession, They are very unprofessional, I speak with XXXX the manager everytime I call and she has no patience to the point where she just want to hang up the phone, her only response is we report accurate information. I asked her why is my credit showing 90 days when at no point was my account 90 days, she advised me it was. That's incorrect at no point it was. I asked how do you report a repo on a customer credit when you had the car for roughly 5 days and the way your company did it was unprofessional. She got snotty and said dispute it with the credit bureau but I don't get anywhere because they go back to the lender. My car was repo in XX/XX/XXXX and the repossession was reported on my credit in the year XX/XX/XXXX. I recommend everyone stay AWAY FROM SAFCO! I will do everything in my power to get this issue resolve If we cant come to a agreement I will see them in court.

This info below includes Safco as well, here is the situation Safco ... ... .I received a call from XXXX advising me my account was past due, and l told her no it is not, l told there there is an error, she told me l needed to contact Safeco, which l did on XX/XX/2020 who told me they will reach out to XXXX XXXX in the meantime XXXX told me that they would have repossessed and l told here for what was she talking about that l am 100 % current on my loan and payments. I am asking your department to get ask for an update of what the discretion is as Safco tols me it is not in arrears and that also they told me XXXX has not sent over payment l spoke to XXXX a supervsior at Safco. I have email confirmations on all payments. There calls are recorded on XX/XX/2020 l submitted payment, then on XX/XX/2020 l called to see what the problem was that my payment had not gone through the bank XXXX said it did not go through, so l said it never went to my bank as my bank verified they never attempted to send the payment to my checking account and that is what prompted me to call them, gave them the checking account info again and then on XX/XX/2020 get called from XXXX telling l was 3 months in arrears and was getting ready to have my car repossessed and told her my account is up to date, she tried telling me that both dates in XXXX did not go through and l told her that she told me on XX/XX/2020 that there might have been one number out, there calls are recorded l welcome they pull the call, on XX/XX/2020 she never said my account was in arrears which it is NOT it is current and up to date and l told her that l have all email payment confirmations, I called Safco and they told me it is not in arrears and that they will also call XXXX as XXXX has not been documenting in my account and Safco said have not sent over payments as well. The right hand does not know what the left is doing, l am asking they fix this error that has occured with my account and there company. Safco told me they have never reported, my discharge date to them as well.

Southern auto finance company " aka '' SAFCO practiced unauthorized use of my credit card. Southern auto finance company " aka '' SAFCO has violated multiple rights and I the consumer received no benefit, Congress has stated this under 15 usc 1602 ( p ) and it states : ( p ) The term unauthorized use, as used in section 1643 of this title, means a use of a credit card by a person other than the cardholder who does not have actual, implied, or apparent authority for such use and from which the cardholder receives no benefit. Only I the consumer and natural person have authority over my credit card because I am the card holder the natural person. I am currently past due about 67 days on my Auto Loan. The finance company is un willing to work with me to bring it current. I have offered a payment and for them to auto draft another payment on my next payday. They state unless I pay late fee 's plus a payment that is almost {$700.00} ( one payment {$450.00} plus late fee 's on the account ) they will not take a payment from me. This extra amount over XXXX does n't even help me with the next payment. I feel that getting my account current should be more important than late fee 's. Fee 's is something we can worry about once I get the account current. I am trying to bring the account current to the best of my ability but they will not allow me to make my regular payment amount to help bring my account current to aleast take it from 60 something days past due to 30 something and another payment in a week to bring it due for the current month. They state that they do not have to work with me and they can repossess my car at 1 day past due. I have made late payments on the loan but I have not ever broken an arrangement I have made with them. I know that making late payments is n't a good thing but the finance company should be willing to work with me not blocking me from making payments my account is not charged off. They are pushing for me to give the unit back and I want to make the payments and keep it. Now they have been refusing to take a payment for a week now and with this being a simple interest loan the interest accures daily so now they also stand to collect more money in interest. Discovered an auto loan account in my XXXX credit report being handled by SAFCO ( XX/XX/XXXX ). I called SAFCO ( XX/XX/XXXX ) to inquire about the account, but they were unable to locate an account with my personal information ( SSN, Address, Name, DOB, Phone Number ). This occurred on multiple occasions ( XX/XX/XXXX, XXXX ). I also filed a dispute with XXXX ( XX/XX/XXXX ) to have the account removed. The dispute results ( XX/XX/XXXX ) were provided and SAFCO reported that the account did in fact belong to me. Again, I called SAFCO and they are not able to find an account number associated with my personal information. I then called XXXX ( XX/XX/XXXX ) and uncovered that there are several addresses, an employer, phone number, and name ( similar to mine but with a hyphenated last name ) tied to me. They were able to remove one of the addresses, employer, and telephone number, but not the auto loan account and name ( with identification number ) that is not mine. It seems the second address, auto loan account, and name ( hyphenated ) are tied together. XXXX acknowledged via phone call that the information being disputed is not mine, but refused to remove the information since SAFCO asserted the information belonged to me. SAFCO is also reporting my name is different via an email I received from them on XX/XX/XXXX asking for my SSN and copy of credit report. I did not respond as they should be requesting the information through XXXX and not be contacting me directly. This is my second dispute in regards to Safco. In regards to the dispute that i submitted on XX/XX/2018 and Safcos response.The notice to default was Mailed on XX/XX/2018 stating that I had until XX/XX/2018 to bring my account current but, the account was closed on XX/XX/2018. How can I respond to a notice to default if the account was closed 4 days before the default date? Currently there is a missed payment on my credit report, and because of that my score has taken a huge hit and no matter what i do will not get any better. According to Safco i missed a complete payment on my auto loan and that is inaccurate i have never missed an payment. I have been late on account but never past 30 days. or without speaking with a representative first due to me being in military its times when i am in field training and can not have electronics which causes me to make payments after due date but per multiple agents with this company no payment has been missed that would fit there reporting policy to be late. I already had one report corrected through this company because inaccuracy. This is not fair. I can not move forward with anything else in life as far as housing and possible vehicle upgrades due to this account reporting the missed payment which is not accurate. all the bank can do is send me a payment history and i understand what there systems may say but the info is inaccurate and its just not fair that i have to continue to take the hit for something that is not true.. XXXX in turn pays safco without notice to me out of my bank account from a transaction thats over a year old ( {$3500.00} ) .Thats an u authorized Transaction and illegal. They should all be investigated they are multimillion dollar companies stepping on the backs of working Americans. I noticed that there were some inconsistencies on my credit report. This is damaging my credit score and needs to be looked at immediately. See items listed below. Account number XXXX They are reporting 3 different current balances that are all different, as well as 3 Original balances that are total different, the opened dates are different, the last reported are all different, last payments are not the same or accurate. Charge offs should not have past due balances because they are late by default and all XXXX have past due balances. As well as each one of reporting that I owe a different past due amount. XXXX has 24 late payments attached to this account when there should be no late payments on charge accounts. This has impacted on other credit decisions I have applied for and have been denied. And continues to impact me negatively especially since I have not only the charge off but also each late payment that gets reported. This isn't just a reporting one error on their part this is numerous errors. This is inaccurate reporting therefore please remove this account from my credit report or update it to paid as agreed due to my FCRA right. My complaint is regarding the Southern Auto Finance Company is known as ( Safco ) reporting inaccurate information on my XXXX report. I had a loan with Safco for a XXXX XXXX XXXX. The vehicle was flooded in Hurricane Harvey in XX/XX/XXXX. Safco has reported to the three credit bureaus that the account is still open, past due {$2300.00} over 150 days late. In XX/XX/XXXX, Safco received Gap payment of over {$4000.00} and on XX/XX/XXXX I made a payment of {$380.00} which brought the account to a XXXX balance, paid in full as of XX/XX/XXXX. I had one deferred payment during my loan and gap did not cover that deferment, therefore I made that payment on XX/XX/XXXX to bring the balance to XXXX. I checked by credit with XXXX and they stated the account was updated at the end of XX/XX/XXXX and again on XX/XX/XXXX. It was updated incorrectly. the status still shows a balance due and a open account. I have called Safco many times and I have also faxed them documentation which included my " paid in full letter '' which was not received until XX/XX/XXXX, as well as a copy of my credit report from Experian dated today XX/XX/XXXX. My credit report is not correct and I can not qualify for a loan with this incorrect information on my report. My status should be paid in full, XXXX balance, late payments due to gap paid in XX/XX/XXXX, due to natural disaster Hurricane Harvey. It is not my fault that Gap insurance took so long to pay. SAFCO has an auto account that is reporting on my credit report. They are reporting the full loan amount on my report instead of the deficiency balance. This information is incorrect. By law they are violating multiple sections of the FDCPA and FCRA. I have sent numerous letters for this to be rectified. SAFCO also they keep change and ballooning payments to add try and collect more money which is also a violation of the acts listed above. SAFCO failed to provide notice of repossessed vehicle being up for auction, notice of final sales amount of the auction ( with deficiency balance included ), they also failed to provide notice of how to recover the car during the repossession time period. They sold the vehicle and are trying to pawn the full balance of the loan plus interest on me. Law states that a deficiency balance notice must be provided. FCRA and FDCPA both state that if a debt is written off by a company through taxes, that legally the debt has been paid. I am requesting records of the charge-off loan balance that was written off, statement of vehicle sale through auction after repossession whether public or private, deficiency balance statement from the date of sale through auction proceedings. SAFCO will need to provide all documentation of the loan paperwork signed with dealer and alleged debtor, and items listed above for my attorney 's review. At this point, we are pursuing legal recourse for violation of the FCRA and FDCPA.

I have made my car payments on time even after I lost my job. My car payment was my # 1 priority. I had surgery and when I made my Payment I didnt realized I paid the wrong amount. When I noticed I went back to pay the correct amount only to time the system was down and did not allow my payment to go through. I was unable to make a phone payment at the time. Being in the hospital but when I was able to make the Payment they have already reported to the credit bureaus. Now my score went down 154 points and i was denied for the house i was approved for already because of the late Payment. I would have not received a late Payment if the system was not down. I spoke to someone that said they would help me and nothing happened again I called and no one then was willing to help me. I have called several times with no help and I am living in an efficiency with my kids now because I will not be approved for anything right now. Recently I looked at a copy of my credit report and noticed some things that is VERY upsetting! The account SAFCO Account # - XXXX are reporting some very inaccurate things. I have tried and tried numerous of times to dispute this account with them through XXXX & XXXX but I guess I will have to go higher up to get this solved. This account is a CLOSED CHARGED OFF account. Which means IT CAN NOT INCUR INTERESTS!!!! The company has legally been compensated for the loss & can not continue to add fees, a charge off is essentially a XXXX account. There should be no changes reported to it AT ALL!!!! On XX/XX/2018 XXXX XXXX XXXX recovered my vehicle due to motor issues and my car not cranking. I contacted SAFCO and asked if thy could postpone my car payment because i had to pay to have the car towed. My next scheduled payment was XX/XX/2018 because they deferred the payment. In between that time i lost my job and could not afford to get the car out of the shop and the mechanic placed a Lien on the vehicle. Basically I have a 30 day lateness on my Credit Score from XX/XX/XXXX This 30 days lateness happened at the height of the Corona Virus pandemic. I was told the call was being recorded and I also told XXXX I was recording the call and since there was no rebuttal from her, we continued with the call. She was calling about a late payment. The company that I have an issue with is SAFCO. I voluntarily turned my vehicle in to this company and was actually in good standing with the company but due to mechanical issues ( after a major engine recall ) I had to make that choice. To date I continue to receive notification that SAFCO falsely reports that I am missing payments, and they report to the three credit bureaus every month that I am late with my payments when in fact the car was sold at auction and written off as a charge off. I have disputed Safco ( account # XXXX, XXXX ) several times. The company would remove the account for months even up to a year then it would reappear. I took the necessary steps that customer service instructed me to do, which were to obtain a police report. The documents that I uploaded are the same documents that I sent to Safco when the company were removing the account ( I only updated ftc ). Safco hired an attorney ( XXXX ) to collect a debt on my auto loan. I won a settlement agreement against Safco and the attorney due to illegal collection tactics.By Florida law Safco is not suppose to still be reporting late fees and payments to all three credit agencies. In XX/XX/2018 I was in a car accident and the vehicle was pronounced total loss. So, I get a little behind in my car payments and I had tried to work out a solution to the problem. But it seemed like to me the creditors wanted to act like complete Hotheads. They illegally in my defense repossessed my vehicle without proper notice. They say they called but in my defense it must have been them calling from a private number without any messages afterwards never no letter in the mail. The representative basically called me liar over the phone. I definitely understand the importance of good credit and being a responsible person. During the year XX/XX/2017, I experienced some health problems that caused me to missed several days, even weeks of work. That lead to getting behind on bills and payments. I contacted SAFCO to explain the situation. After several months of treatments and doctors, I am able to get my situation back on track. When I contacted the company, they informed me that my social security number and other identifying information was used in an attempt to acquire a car loan.
