To review my full complaint, please review the Attached File " Civil Action File NO XXXX '' Summary of Violations & Complaint : Clouded Title & Failure To Follow Federal Lending Guidelines. 1 ) Lender did not provided borrower a 3 Day Closing Disclosure Provide ( see exhibit A & B ) 2 ) Failure to disclose terms and condition as set forth in illegal assignment of deed to XXXX 3 ) Lender failed to disclose sale of note and interest to XXXX XXXX ( see exhibit C-Allonge ) executed XXXX XXXX, same day as original promissory note, ( executed on behalf of SEM ) no offer, consideration or acceptance was made to complainant for XXXX XXXX contract ) 4 ) Conflicting sale ownership transfer dates from SEM to XXXX. As per XXXX dated XX/XX/XXXX, transfer ownership was executed on the XX/XX/XXXX. This contradicts the notice from Southeast Mortgage dated XX/XX/XXXX from SEM, states that transfer to take place on XX/XX/XXXX ( see exhibit C & C-1, C-2 ) Additional conflict, notice from XXXX, dated XX/XX/XXXX, state sale/transfer to place on XXXXXXXX & Notice of sale/transfer from SEM are in contradiction.

5 ) Non compliance of federal lending guidelines, failure to record sale transfer of note ownership with XXXX County Record of Deeds from SEM to XXXX.

6 ) Additional confusion and conflict in determining who to make payment to and what amounts as created by receiving notification dated,XXXX advised of yet another transfer from XXXX XXXX to XXXX effective XX/XX/XXXX. ( see exhibit C-3 ).

7 ) Furthermore confusion and conflict in determining who to pay and what amounts created by receiving notification ( see exhibit C-4 ) dated XX/XX/XXXX advising of sale transfer of note ownership from XXXX to XXXX, also effective on XX/XX/XXXX, effective on the same exact date as the previous transfer from XXXX to XXXX ( see exhibit C-3 ).

8 ) Further confusion and conflict in determining who to pay and what amounts, being created by receiving notification dated XX/XX/XXXX from XXXX, transferring serving to SEM, effective beginning XX/XX/XXXX. Having also received notification dated XX/XX/XXXX from SEM, indication transfer of servicing from XXXX to SEM, effective XX/XX/XXXX.

9 ) Non compliance of federal lending guidelines, failure to record sale transfer of note ownership with XXXX County Record of Deeds regarding XXXX to XXXX ( see exhibit C-3 ) 10 ) Non compliance of federal lending guidelines to record sale transfer of note ownership with XXXX County Recorder of Deeds from XXXX to XXXX ( see exhibit C-4 ) 11 ) Non compliance, failure to in file XXXX County, GA, a Public Record Deeds any and all sale/ownership transfers from lender to lender, and/or servicer to servicer, as of XX/XX/XXXX.

12 ) Deceptive Lending Practices ( see exhibit A & C ) Withholding crucial information needed for borrower to make an informed decision based on all the facts associated with loan origination, terms, and/or sale/transfer of note transfer and interest.

13 ) Extortion of Funds attempt to collect mortgage payments from borrower on note that had already been sold prior to date of collection notice sent by SEM, dated. ( see exhibit D, D-1 ) 14 ) Non compliance of federal lending guideline regarding failure to provide borrower 30 notice for validation of debt prior to executing foreclosure proceedings ( see exhibit E, F, G-foreclosure notices ) 15 ) Non compliance of Federal lending guidelines. Failure to provide borrower notice of default. prior to acceleration of debt ( see exhibit E & F ) 16 ) Non compliance of Federal lending guidelines to provide borrower 30 day notice of opportunity to cure to prior to illegal forclosure ( see exhibit E, F ) 17 ) Non compliance of Federal and/or State regulations regarding the combined 7 day notice of opportunity to cure received on or about XX/XX/XXXX, with an accelerated amount of XXXX being demanded for payment no later than XX/XX/XXXX. Included on this same notice is the intent to foreclose notification three after 7 days ( see exhibit G, G-1 ) 18 ) Illegal acceleration of debt ( see exhibit F, G, H ) 19 ) Abusive Collection Practices, accelerated debt collection attempts ( see exhibit H ) 20 ) Non compliance of Federal mortgage/foreclosure guidelines. Under provisions, as held per TARP of XXXX, XXXX. " All American citizens are protected from foreclosure and sheriff sales at the state level.

21 ) Public humiliation, loss in personal credibility and creditworthiness caused by publishing multiple illegal foreclosure advertisements in public newspapers. ( see exhibits I, J, K ) & credit reporting to major credit bureau agencies.

22 ) Failure to provide copy Mortgage Insurance Policy issued by HUD paid for by Complainant, in the amount {$4800.00} ( see exhibit M, pg 2 sec 'b'-05 ) 23 ) Failure to record certificate of satisfaction with state of Georgia public records to publicly record the purchase of my home from builder, XXXX XXXX.

24 ) Violation of privacy. Borrower was not informed or made aware that pivy information to SOUTHEAST MTG ( SEM ) would be sold, shared and/or disclosed to others without prior notification or my consent. I believe that that law is called Gramm Leach Blily Act.

RE : XXXX XXXX XXXX is in violation of the NATIONAL CURRENCY ACT, now NATIONAL BANK ACT. XXXX XXXX XXXX is attempting fraud, therefore we rescinded all contracts and signatures. XXXX XXXX XXXX is now attempting to foreclose on our home next month. DEMAND XXXX TO STOP FORECLOSURE ATTEMPTS IMMEDIATELY. CONCERNING According to UCC 9-102 Article 9 Definitions ( 28 ) - DEBTOR means : ( a ) a person having an interest other than security interest or other lien. ( b ) a seller of accounts, chattel paper, payment intangibles, or promissory note. The bank is the DEBTOR. According to 15 U.S.C. 1692g The debt must be validated. XXXX XXXX XXXX never responded to my affidavits, which required XXXX XXXX XXXX to validate the debt. According to UCC 9-513 ( a ) ( 1 ) XXXX XXXX XXXX never made an advance and never value to XXXX XXXX or XXXX XXXX. 31 U.S. CODE 3123 - Payment of obligations and interest on the public debt. ( Has been violated ) 31 U.S. CODE 5103 - Legal Tender ( The original note was treated as legal tender ) 18 U.S. CODE 8 - Obligation or other Security of the United States defined. ( Has been violated ) According to National Currency Act - Section 27, 28, & 53 ( Banks can not own property ) XXXX XXXX CONTACTS : ( XXXX ) XXXX or ( XXXX ) XXXX First of all we have never signed a contract/ agreement binding XXXX XXXX to XXXX XXXX XXXX showing both parties signatures. Weve asked for any evidence of this contract/ agreement and we have never gotten a response from XXXX XXXX XXXX . XXXX XXXX XXXX and its representative, XXXX XXXX is attempting fraud. REQUIRE XXXX XXXX XXXX TO STOP FORECLOSURE IMMEDIATELY. We have researched very thoroughly over the last year or so to find ways to have XXXX XXXX XXXX respond to our Affidavits to verify where they had given us value through a loan or any other agreement and they never responded to our requests or Affidavits. We tried this for several months. We even went as far as contacting other agents that they hired along with their attorney, XXXX XXXX. They all refused to respond to our Affidavits. XXXX XXXX is representing XXXX XXXX XXXX, but also acts as ATTORNEY IN FACT for XXXX XXXX. This is a fraudulent conflict of interest and TREASON against XXXX XXXX, Estate. We suspect XXXX XXXX XXXX is attempting to commit fraud. We rescinded all contracts and signatures possibly binding XXXX XXXX XXXX and XXXX XXXX. XXXX XXXX XXXX is now attempting to foreclose on property controlled by XXXX XXXX. XXXX XXXX XXXX is in violation of the NATIONAL CURRENCY ACT, now NATIONAL BANK ACT, which states that banks can not own property. XXXX XXXX XXXX is required to stop foreclosure attempts immediately! We are asking your office to please contact XXXX XXXX XXXX immediately ; according to NATIONAL CURRENCY ACT, now THE NATIONAL BANK ACT this is a requirement. If a contract or agreement is void for fraud or voidable for fraud, and the opposing party ignores ( does not respond to/rebut ) one 's affidavit of rescindment for fraud, a dishonor has occurred ( UCC 3-505 ) for non acceptance of refusal for cause ( of unconscionable instrument UCC 2-302 ). UCC 1-103.6 mandates all parties to construe the statute in harmony with the common law, within statutorily created legislative agency, forcing recognition of common law rights. I, XXXX XXXX, a well know XXXX and my husband being a XXXX XXXX XXXX with substantial social followings decided not to go public with our story about bank fraud concerning XXXX XXXX XXXX thus far, because this could cause uproar in communities across the country. Again, we are asking your office, with all due respect to contact XXXX XXXX XXXX immediately to reverse their dishonorable and possible fraudulent actions.

I started a mortgage loan on XX/XX/XXXX with a company SouthEast mortgage. It started as a USDA loan they preapproved me on. Well after some time they contact me and say the house is too much for the USDA loan I needed to get the FHA loan and qualify for the GA dream loan for the down payment. XX/XX/XXXX I worked for myself and have filed for a tax extension. Which they have known about since they asked for my XX/XX/XXXX XXXX in the beginning. They said it will be fine most likely after the underwriter reviews it before conditional approval. Some more time goes by and turns out I did not qualify for GA dream like they said I did because of the XX/XX/XXXX tax extension which they already knew about but I guess forgot. I was told to get an appraisal to make sure the house was going to appraise for the sellers asking price. I did so because they kept telling me all my paperwork was pretty much good so far including the XX/XX/XXXX tax extension and my self employment of that year. So we get conditionally approved for the FHA loan and everything we sent over ( after explaining to them at least 3 times in e-mail and even more times over the phone had to remind the mortgage agent that I did not have XX/XX/XXXX XXXX or returns for them at this point ) and they just wanted a few more documents and explanations which I delivered to them. XX/XX/XXXX comes around we have already paid the inspection now and my mortgage agent stated " the underwriter has approved everything '' when I asked about buying home insurance but was concerned if the underwriter was going to deny me because of the taxes ( since they kept asking for it no matter how many times I explained it to them it seemed ) after I bought insurance. So after being told my XX/XX/XXXX taxes were approved long before conditionally approved than being re-assured everything was approved and ready for closing on XX/XX/XXXX they got behind somehow we found out XX/XX/XXXX that we were not going to be closing cause they got behind and had to file for an 8 day extension. Later on in the evening I get a call saying the underwriter has decided to deny my loan because of my XX/XX/XXXX taxes and work year. Something I was told was okay since XX/XX/XXXX something they have known about for so long it took them until 3 days before closing to deny me based on information that never changed and they had access to review since XX/XX/XXXX. With this sudden change of heart by them I had already bought the appraisal and inspection and lost my earnest check. Not to mention I gave up the lease at my apartment so at the end of this month my girlfriend and newborn daughter and I will have no where to go because of this on top of them keeping all my money. The amount of XXXX XXXX and XXXX this mortgage company has caused my family with their lies and theft is unbearable with my current situation. Please help me I followed through on my due diligence gave them all the info they asked for and they scammed me.

Southeast Mortgage, XXXX, GA was the lender on the purchase of our home in XXXX Ga. On XXXX XXXX, XXXX. The process for the FHA streamline loan took 71 days from initiation - excessive and unacceptable. The XXXX Lead Representative assigned appeared to lack the knowledge of the FHA requirements and process. For example, we were not provided information on our responsibilities to get the contractors, forms which contained the FHA requirements were not provided. Questions on our part to wade through this process were almost always answered with 'the requirements for the FHA streamline process changed in XXXX '. The lender should be educated in these changes and pass on information which helps the consumer to get through this process. I did my own research, my son created his own contractor form based on the information received by the lender. When submitting, the rules changed several times. First, the bid information had to be received from XXXX contractors, listing the cost and labor for the proposed renovations. Each time we submitted what the lender required we were told 'just XXXX more document and we 'll be good '. Delays due to this, lack of response to emails and phone calls added to the frustration. When we were told the appraisal could now be ordered, it was n't because the underwriting process was slow and when issues were discovered our application went to the bottom of the pile. After many complaints to the lender, we would get some movement, but again were told it was due to FHA requirements. Once the appraisal was finally ordered, and completed, we were told a new form had to be completed by the contractors which was our responsibility to get completed, signed and returned. We travelled over an hour to meet with the contractor to get this done same day and returned to the lender. Once received by the lender, we were told it had to go through underwriting again, which took several days. We are now at 45 plus days in process. When told the new form required a contractor resume, the contractor failed to provide since his references and all contracting information had already been provided. We had to resubmit all our information for a regular FHA loan. Again the forms had to go through underwriting, another appraisal had to be ordered. XXXX extensions had to be filed with the owner to keep the home in process. Finally, we signed on XXXX XXXX, XXXX. Three months we had to stay in hotels and with relatives and pay for the storage of our belongings because we moved from Arizona to Georgia. The cost to us waiting on this process was more than a month longer than we expected. Tensions and frustrations are beyond explanation. Southeast Mortgage motto is to make the experience Awesome and not average. It was AWFUL not Awesome.

Misleading and Guarantees made that could not be kept. In XXXX 2015 my wife and I had found a home that we wished to purchase. Before finding the home I spoke to XXXX XXXX and he pre-approved us. When we found the home we started the process for XXXX backed loan. XXXX assured us and even guaranteed that we would make it through XXXX even with our bankruptcy in the past. I was attentive to what XXXX needed and returned all items within 48 hours to him. During this process ( once it was to late to find a new mortgage company, XXXX started to be less responsive and we ended up missing our loan commitment date. XXXX XXXX kept us from going to XXXX and having loan commitment letter on XXXX XXXX like we where suppose to, this was not done till XXXX XXXX. I was vary clear with XXXX upfront about our past, I did not lie or hide anything and informed him when our current lease was up. Due to his delays we had to stay past our lease which caused expenses, by no fault of our own. Once XXXX started reviewing our file, they asked for documentation. I typed up a letter that explained our bankruptcy in more detail and called the XXXX XXXX office and Called XXXX XXXX XXXX Director of GA XXXX XXXX. XXXX ended up denying us, and XXXX never submitted the letter I typed up to them ( that XXXX requested ). When I spoke to XXXX XXXX and the XXXX XXXX, had that letter been submitted then they would have approved us and it did show we where less of a liability then we where when we filed for bankruptcy. So due to XXXX 's lies, incompetence, misrepresentation I am left with a lot of money lost, a forever home lost and expenses that I have to pay now that are not my fault. I have spoken to a few people and found that shortly before I began my process with XXXX Mortgage, XXXX employee 's walked out because of this same unethical behavior. I have also discovered that XXXX Mortgage claims to be a preferred provider for a lot of organizations, when they really are not. After speaking with parties involved in this ( minus XXXX Mortgage XXXX and my attorney, we believe this is a bait and switch style scam. I have all e-mails documenting my entire experience with XXXX Mortgage.

Monday, XXXX XXXX. SouthEast Mortgage called me and explained that my loan ( that they previously said was fully approved last week on Thursday XXXX XXXX is not denied " unless '' I pay {$7000.00} or {$10000.00} in 48 Hours ( Closing Date was Wednesday XXXX XXXX ) And asked which option ( before the end of the day ) would work better for me? I applied for the Georgia Dream loan and was working with the team for 4-5 months and each step of the way they were making me aware of what needed to be taken care of and " fixed '' yet 48hours before the closing and keys were handed to me and my family, now all of a sudden my " tax issue '' that currently has a monthly payment installment agreement in place, in now causing my entire loan to be denied. He also instantly required me to pay off all my tax debt before 2017 for All Years. He also informs me that my GA Dream file was submitting to 2nd set of underwriting last week around Thursday XX/XX/XXXX. From my personal expert team, they made me aware it normally takes 10 days to clear. Once I ask the SouthEast Mortgage official for a document to show the denial letter/information, and call him again, he explains that GA Dream is now Not Possible No Matter What. Even after several attempts for the official denial letter, nothing was produced. The mortgage is off the table, my earnest money is lost, my apprasial fee is lost, my home inspection fee is lost, and my 4-5 months of patience and persistent has been wasted. We spoke to Georgia Dream agent and she explained there is a simple document that I need to clear this condition, it's a lien right documents that changes the order of rights away from IRS in primary position. XXXX did not even discuss this with me at all and just proceeded to let me know that I am " denied '' with no options. Last week he explained to me that I was " approved '' and congrats but Monday he explains my file was not submitted to GA Dream underwriters until around XXXX XXXX. I was told I was approved, then it was just taken away from my family and I. I have attached the only " denial '' they sent us.

I have extended my credit to Southeast Mortgage for a Mortgage Consumer Credit XXXX on XX/XX/2022 with XXXX XXXX. I informed XXXX that I hoped they was not providing generic contracts as they are to have adequate disclosure pursuant to Federal Law. Pursuant to 15 USC CH 41 doesnt define a loan nor a borrower so neither can I and I have informed XXXX XXXX the same. XXXX has provided me with a Uniform Loan Application and my name as the Borrower. Southeast Mortgage are coercing me into paying for a down payment/closing cost but Financing is involved which includes the sum of all charges which violates 12 CFR 1026.4. Next, they are denying me my rights as a consumer of extending my credit to them and creating a false and deceptive loan form under XXXX XXXX XXXX which is for the lender and not the consumer which violates 12 CFR 1002 -Regulation B, ECOA. I asked Southeast Mortgage General Counsel XXXX XXXX, CEO XXXX XXXX, and Vice President XXXX. XXXX to provide me with a typed consumer credit transaction form and make it clear that I am extending my credit where there will be no security interest, no lien, and no down payment necessary as stated in Federal Law and CFR Regulations. I asked if Southeast Mortgage operated under The Truth in Lending Act and they proceeded to say that they operated under regulations but not FEDERAL LAW. I can name more violations on how Southeast Mortgage is violating multiple Federal Laws but all I asked for as a consumer for a fair and equitable mortgage consumer credit transaction. The CEO XXXX XXXX did not protect me as a consumer who has Consumer training of 11 years within his biography on southeastmortgage.com which is false representation of oneself. I also informed them that I have a right to exercise who I am under Consumer Credit Protection Act-Federal Law and if they chose to do anything other than what I am asking then you are in violation of discrimination, as a courtesy please refer to 15 USC 1691 .

I applied for a FHA Mortgage through Southeast Mortgage of Georgia. The night before our closing date, they informed me that I was denied of the financing, due to insufficient income. I changed jobs almost 3 weeks before my close date, but they didn't say this was an issue until the night before closing. They asked if my wife could be added to the loan, and we told them it was a possibility but not something we wished to do, or we would have done so from the beginning of the application process. They asked for some financial documents ( pay stubs, bank statements, a picture ID, property tax information and a mortgage statement for our current home ), which we provided, but never mentioned pulling her credit. After providing the documents listed above, we were informed on the XX/XX/XXXX that we still would not qualify, due to our Debt To Income Ratio. They then pulled her credit at all three Credit Bureaus, XX/XX/XXXX and XX/XX/XXXX, without our verbal or written consent. My wife is subscribed to a credit monitoring service and this is how she was notified of the inquiry. No one from Southeast Mortgage ever told us they were pulling her credit, nor was this necessary due to us being unqualified. This is a serious violation and we don't want this to happen to other borrowers in the future. We appreciate you looking into this matter.

Good morning, for the month of XXXX the PMI was taken out 3 times, on the XXXX and twice on the XXXX. Is there a reason for this? Please get back to me as soon as you can, Thank you ( this is the email I sent 2 weeks ago XX/XX/22 ) I have been calling and leaving voicemails and no one is responding to me about this problem. My concern is every time they do my escrow analysis they say I have a shortage but my wife and I are very good with making sure enough money is in there to cover the insurance, property taxes, and the once a month PMI ( we even put in extra every month to avoid this and right now it feels like its impossible ). I feel like this company is stealing from us and we just want to be able to pay our bills and remain in our home without wondering every month why this extra money is being pulled from our escrow account without any communication.

When trying to purchase a home through XXXX XXXX of XXXX XXXX, I was denied a home loan in XX/XX/2021 because I am a XXXX XXXX and I did not work for 6 months in 2021. XXXX recommended another lender. I spoke to XXXX XXXX of Southeast Mortgage in XXXX and explained my situation. XXXX was fully aware of my situation being a XXXX XXXX and not working for some time during the pandemic. The closing was pushed back to XX/XX/XXXX. I was denied for the same reasons made known up front. Why didnt they give me an answer sooner? I spent money on the deposit, appraisals, inspections and they made me put the UTILITIES in my name. I ended up losing my XXXX money.
