According to 15 USC 1692e ( 3 ), a debt collector, in collecting a debt, may not use any false, deceptive or misleading representation i.e. a debt collector may not falsely represent or imply that he or she is an attorney or that communication is from an attorney. I hereby put your firm notice that it has violated the provisions of the above-mentioned section. Further, as per the judgment made in the case of George W Heintz V. Darlene Jenkins, the provisions of the Fair Debt Collection Practices Act applies to attorneys who " regularly '' engage in consumer-debt collection activity, even when that activity consists of litigation. Therefore, as per the judgment mentioned herein, your firm is liable as a debt collector.

I sent out several affidavits to XXXX XXXX XXXX and Sonnek & Goldblatt. I also sent a cease and desist telling them cease all forms of communication and they still have yet to do that. They have also failed to lawfully validate this alleged debt and they are refusing to pay the attached invoice as well. However, they are now garnishing my wages and I do not consent to these proceedings. I'm sure a court hearing with all the facts and exhibits brought forth will show they are in default by failing to properly respond to my affidavit ( s ) and violating my rights.

I received notification that my wages were being garnished because of medical debt, the situation is complicated, but I was advised to settle with the law firm -- XXXXonnek and Goldblatt. I have the terms of our agreement in writing, and made the payment to settle the debt as in our description. The payment was made on XX/XX/27. My wages were still garnished for the pay date of XXXX, and the firm claims that the money will be 'returned ' but can't give me a timeline as to when, or alternative options if my wages continue to be garnished.
