XX/XX/XXXX XXXX I was affected by covid and had no work. I called My mortgage company at the time was XXXX XXXX and discussed the matter and then went on forbearance for 3 month XXXX XXXX I mailed a my payment {$2000.00}. A few weeks went by when I received a letter From Capitol Mortgages Of Texas stating they are my new mortgage company. I then called XXXX XXXX verify about my payment from XXXX they said my loan was sold to Capitol mortgages of texas and that my payment had been sent to them. I then called Capital Mortgages Of Texas and spoke with someone in the forbearance department and confirmed they received but because of all the Covid and new loans they had received my payment was floating in the air and that once they found it it would be applied to my account my payment from XXXX. I continued having difficulty paying my mortgage due to covid so I decided then to continue on forbearance. I was on forbearance for a total of 6 months. XX/XX/XXXX XXXX is when I came off the forbearance and decided to get a modification. I then started talking with XXXX XXXX who works for Capital Mortgages Of Texas to get my modification. My modification agreement was sent to me by XXXX XXXX I signed and Notarized it and sent it back to her. I will provide the modification agreement in attachment. XXXX XXXX I began paying my monthly payments till XXXX XXXX total of 15 payments. Every month since the modification I never received a closing letter and received delinquent payments on my monthly mortgage statements when Id call XXXX shed always say just disregard those and to continue paying my monthly payments and that she was working on getting my closing note to my modification for 15 months she kept saying the same thing over n over again. I also spoke with XXXX XXXX who is also supervisor of the loss Mitigation Department and XXXX XXXX as well all 3 ladies always said the same for the entire time of the 15 months. XXXX I Asked XXXX for something in writing stating that once capitol mortgages of texas received the closing note all my payments would be applied to my account I will also provide in attachment. XXXX was my last payment to capitol mortgages of texas XXXX In XXXX of XXXX I called XXXX for a payment extension for the month of XXXX and XXXX. I explained to her I XXXX XXXX XXXX and hadnt been back to work also because of Covid I didnt want to expose my XXXX she understood and said yes it would be fine and to make sure id get those payments to her by the end of XXXX XXXX.First week of XX/XX/XXXX My Husband XXXX XXXX and I XXXX XXXX decided to Refinance my home got approved. I began asking repeatedly for the closing note and still got the same response we are still working on it. When the refinance asked for the payoff this is when my husband and I realized Capitol mortgages of texas werent honoring the modification agreement. The numbers nothing made sense also will provide in attachment. I then called XXXX and XXXX thats when they started giving me the runaround. XXXX wouldnt answer my calls or emails. Then I started talking with XXXX. Last I spoke with XXXX was on XXXX XXXX All she said was that the document custodian was researching it. The Refinance bank then decided not to proceed because the calculations of my modification was off the numbers nothing made sense and it was showing as if I was delinquent since XXXX of XXXX. I then began to email and call both ladies XXXX and XXXX. XXXX had left on vacation for the XXXX XXXX weekend and wasnt gon na be in office till XX/XX/XXXX. So I then started talking with XXXX same story saying that they were still working on getting my closing note she then stopped answering me. Since we began receiving mortgage statements our servicer had our account listed as convention, though we in fact have an FHA loan. We have called many times in the last three years to remind them that we have an FHA loan and to be sure that they ahve been making our FHA MIP payments. At the end of XXXX I spoke with XXXX at ext. XXXX who stated that their system was not updating FHA MIP due dates as the payments were being made and first analysis ( XXXX/XXXX/XXXX ) reflected an escrow negative over {$900.00}. She double checked payments and dates, found the error and re-ran analysis which then reflected a surplus. I asked her to re-analyze the account because I did not want her to refund escrow money that was for MIP payments. We were assured that the FHA premiums were being paid and in XXXX XXXX we received an escrow refund check. When we recently received our XXXX statement for XXXX it showed no FHA premium payments. We contacted our servicer who researched the account and stated that they had made the payments to FHA for our account for the last three years. I explained that a year earlier I was assured that the payments were made and even received an escrow refund. I was told that the escrow refund would not have anything to do with our FHA MIP because the payments were being taking by the lender but that they had failed to remit those payments and that this error would not affect our escrow balance. The servicer said that we would receive a revised XXXX statement that would reflect three years of premium payments because they had not reported those payments on the prior years ' statements. Today I received XXXX substitute XXXX statements. The first showed MIP {$2500.00} and XXXX XXXX escrow balance of & XXXX. I called to find out why the amount was low and was told that they may only be able to show one years worth of premiums on the statement and that they would get back to me. I then received by email another revised XXXX showing MIP {$7300.00} and XXXX XXXX escrow balance of {$71.00}. I emailed back concerned with the fact that now, in XXXX XXXX, they have changed my 2015 year end escrow balance and now I am missing {$4700.00}. I had been assured on more than one occasion that our account was correct. I was told that their error would not affect our escrow account. Now I can not trust their accounting and am concerned that I have no way of ensuring proper application of our funds. FHA has confirmed that our account was not past due yet my servicer says that as of today they still had not paid all of the premiums due. I can not believe what they tell me.

I was contacted by Capital Mortgage Services of Texas, my current mortgage holder, in XXXX of XXXX. I was advised that due to interest rates being low, it would be a good idea to look at a possible refinance. After agreeing in XXXX of XXXX to do a refinance to a 20 year term, I would shave a year of my mortgage off and reduce my current monthly mortgage payment by {XXXX}. We got to work in early XXXX on getting them all the required documentation on our part. They required additional items throughout the month that we provided. We signed disclosure statements on several occasions and didnt hear back from them after XX/XX/XXXX til XX/XX/XXXX. We had assumed during this time they were processing the paperwork for closing, but they needed the same documentation that had already been given to them to ensure nothing had changed financially with our situation, which it hadnt. We got them the needed documents and then they informed us that there is a subordination on our mortgage that needed permission to do the refinance. They said this would take 2 weeks to get approved. So they dragged their feet on processing our paperwork and didnt find out about a subordination until 3 months after we started the process. It is now XXXX and rates have gone up and they were only able to lock us in at the lower interest rate for 60 days from the agreed upon time in XXXX. They informed me that it was due to the need of us getting the additional documents that they requested a second time and the subordination approval. I called and spoke with the account representative, XXXX XXXX, who took no ownership of the situation and passed the blame onto the processor and informed me that he would call me back the same day after speaking to his supervisor about the situation after I explained how I believed this to be deceptive practices on their part with interest rates going back up, being able to make more money. I believe they knowingly dragged their feet on processing the paperwork and finding out about the subordination 3 months after starting the process is highly questionable. I have yet to hear back from them after trying to call XXXX XXXX back and leaving him a voicemail.

I have submitted a complaint previously to the Broker ( XXXX XXXX XXXX XXXX ) as I was told by the Lender ( Capital Mortgage Services ) they were providing incorrect information to me. The complaint number is XXXX. However, after receiving a response from XXXX XXXX XXXX XXXX it was stated that the loan was closed incorrectly and by Capital Mortgage Company. We were originally told that we were going to making " interest only payments '' for the construction period of 12 months from the start of construction. However, that was incorrect. Therefore XXXX XXXX XXXX XXXX stated they included a reserve account and that would provided monthly payments to our mortgage during the construction period. I've attached the documents that was SIGNED at the closing of our mortgage that states we were supposed to have a reserve account. I have reached out numerous times to Capital Mortgage Company and was told they would provide information and be in touch. This has now gone on for a month and NO ONE has responded or came up with a plan to make this right. We are currently having to make fully amortized payments every month while paying rent and building our home. We also have not received any money for the construction as of today. We closed our loan in XX/XX/2018. So we are also paying on money we don't have! We were told by both our lender and broker that upon closing we would be able to take our first draw. That was not true at all and have no money to provide to our contractor as of today. I am demanding that something be done to provide monthly payments to our loan each month so we can afford to pay rent and build our home. I also want to be able to make draws on a timely manner so we can fund our contractor up front. No contractor would start the building process without any funds up front. The company that is in charge of processing our draws would like our contractor to pay for all cost upfront then be reimbursed. All of this from the closing of our loan to the draw process seems very unreasonable and I can't imagine this is how things are supposed to be processed. Please let me know ASAP!!

Around XX/XX/XXXX I sent the following letter : Dear Sirs ; I am, by this letter, disputing your stated balance of $ XXXX XXXX on Loan Number XXXX and informing you that correct balance is {$0.00}. I believe your erroneous balance is the result of the following three errors : 1. Incorrect Balance Transfer from OTHER $ XXXX 2. Interest Charges Related to carrying the Additional $ XXXX $ XXXX 3. Interest Calculations Made Using Due Dates Not Payment Dates $ XXXX On XX/XX/XXXX I received a letter dated XX/XX/XXXX from OTHER informing me that my loan was being transferred to Capital Mortgage Services of Texas ( see attachment 1 ). I sent to you on XX/XX/XXXX a letter stating that the balance OTHER was carrying was in error ( see attachment 2 ). I advised you in that XX/XX/XXXX letter that I would not accept any amount other than $ XXXX XXXX transferred from OTHER on XX/XX/XXXX as the amount that I owed to Capital Mortgage Services of Texas. As I received no response to this letter I called your office and spoke with one XXXX XXXX on several occasions. During these conversations I expressed my concern that interest on my payments was being calculated based on the Payment Due Date and not the actual payment receipt date. After several telephone conversations and email exchanges Firstname assured me that you had my letter on file and both the incorrect balance transfer and the interest calculation variances would be resolved when the loan was to be paid off ( see attachment 3 ). That Day of Reconciliation has now arrived. Please review the attached payment history with my interest calculations shown ( see attachment 4 ) and forward to me any comments or questions you may have. Thank you for your help on this issue. Sincerely, My Name

I suffered damage to my home from Hurricane Maria on XX/XX/2018. I received a settlement check from my insurance company which I sent to the Mortgage company ( Capital Mortgage Services of Texas , Inc. ) since they had to endorse it. I have a contractor fixing my house now, but I could not obtain a contractor immediately due to their current work load. They started work on XX/XX/XXXX. Between the time of XX/XX/XXXX and XX/XX/XXXX I had to undertake a few repairs myself, such as demoing hazards from my damaged roof and patio deck. My contractor had already quoted a price for this, but its no longer necessary to do some of that work, since it has already been repaired. We removed the work from the contractor 's contract that had already been done. I asked my mortgage company what happens to the surplus money since insurance had already paid for these repairs. They said that they could not return any surplus funds to me and that it had to go to pay towards the balance of the loan. I am in good standing, and never missed a payment. It was my understanding that they could only collect on insurance claims if you are not in good standing. They also stated that they can not pay home-owners for self performing work. Additionally, they will not issue disbursements to me without first getting an inspection. They are automatically deducting {$120.00} from my escrow account for each inspection. The paperwork I signed said that inspections may be required and would cost between {$25.00} and {$50.00}. They are calling for the inspections and then taking money from my insurance settlement to pay for them, which seems unscrupulous.

On XX/XX/2014 I have refinanced my second house ( Condo ) in XXXX Florida with XXXX XXXX XXXX and mortgage included escrow account which covered taxes and insurance along with the interest and insurance. I was making regular monthly payments for entire amount which included taxes and insurance and never been late with my payments until my mortgage company lost my property due to non payment of property taxes. In meantime I had moved and County clerk sent a foreclosure notice to my old address but I never received it and was returned back to the county clerk as non deliverable. County Clerk also send notices to the Lender but they failed to make any payments ( even dough they have received my payments on monthly basis. ) and my property sold to the highest bidder at a tax foreclosure sale auction. When lender found out that they lost my property to contacted me to see if I would take the property back if they can reverse the foreclosure sale. I agreed to take it back if they can reverse the sale. They went to court for over 2 years and they lost the case and winning bidder still owns the property. I tried to negotiate with my mortgage but they don't want to compensate me for any losses or give me any money for damages. Only thing they offered is wipe out the loan principle balance. I am in court with them trying to get any relief from them. I just got to know about your company and now I am reaching out to you if you may help me with this matter. On XX/XX/2020, I contacted the payoff department to request a payoff statement. Within that email I stated that the reason for the request for was for sale of property. I then received a email from XXXX XXXX ( payoff dept ) on XX/XX/XXXX, stating the reason again for the payoff. I responded with that I needed a payoff for 30 days because at that point I didn't know the closing date. On XX/XX/XXXX, payoff was received and everything looked corrected. On XX/XX/XXXX, I sent another email to the payoff department requesting a updated payoff, since at this point I actual had a closing date. Within that email I stated the closing date and closing time. On XX/XX/XXXX I received the updated payoff. I reviewed the payoff, and notice a {$750.00} attorney fee. Which was never on the first payoff that was provided. I reply back to the payoff department and instructed them to remove the fee since I had no knowledge of the fee. At this point, another individual responded back and stated it was for the foreclosure process and that the lender had no knowledge of what was going on. I then responded with I wasn't 60 days past due to proceed with a foreclosure process and that I had never been given attorney documents for such a fee. I also let them know that I did make them aware of what was going on with the property. I asked them again to remove fee and that is when they stated the fee would stay on the payoff statement. I was a former employer, so I feel that they added the fee as vengeance.

I have been trying to get a payoff from Capital Mortgage Services of Texas for a closing that is supposed to happen in a little over an hour from now. I first faxed the request along with the borrowers authorization on XXXX/XXXX/16. I called twice last week to confirm if they received my payoff request, ( even though I got a faxed confirmation that they did ) and get an XXXX on the payoff, but I could n't get a human on the phone and had to leave voicemails. The borrower called them on Friday, XXXX/XXXX/16 and she was told that they were sending the payoff out to me that day. When I got to the office on Monday, I still had n't received it so I called again. They stated that it would be emailed to me yesterday ( Monday ). At XXXX yesterday when I still had n't received it, I called again and they stated that I would get it some time today, if not first thing in the morning. This morning I still did n't have anything so I called again. Capital Mortgage Servicing stated that it was still in the final stages of being processed and that she would " try to rush it through '' and if I did n't have it by XXXX to call or email back again. It 's now XXXX and I 've emailed them twice more with no response. The closing is in less than an hour and I 've informed Capital Mortgage Services if the closing was delayed because they are not providing the requested information I would report them to the CFPB.

We have a mortgage that is serviced by Capital Mortgage Services of Texas. This is the second CFPB complaint that we have filed against this company. The first was settled after the CFPB interviend on our behalf approximately 4 years ago. We have had several problems with how the company has applied our payments over the past 4 years, but we have been able to resolve the problem with the company. However, we have an ongoing problem with the company that dates back to XX/XX/2019 when they changed our escrow payment requirement without notice and without providing us with an escrow analysis. Our tax and insurance escrow amount increased from {$100.00} to {$190.00} without any explanation. Capital Mortage has a history of appling PMI to our loan amount eventhough the loan was closed without PMI, we think the increased tax and escrow is due to this PMI. But we have not received a escrow analysis to be able to determine this. After several months of email complaints Capital Morgage applied several credits to our account to correct the balance. Then in the very next month another incorrect escrow payment was added to our statements. I have been trying to reach the company by email, but I have not been able to get a response.

My wife and I build our home about 12 years ago, and we had a 30 year mortgage. About 2 years ago, we lost a job, and needed to refinance our mortgage. This company came along and said they would be able to lower our payment. What they didn't tell us is they were going to lengthen the term of our loan. Now in XX/XX/2018, we have a 40 year mortgage, and my wife and I are in our mid-late 50 's and will be in our 90 's when the mortgage is paid off. We were never told this would extend the length of the mortgage from a 30 year to a 52 ( 12 years of house payments plus a 40 year mortgage ). This is outrageous. We are in a little better financial position, and would be willing to up the payment, but can not buy into a mortgage that will end in our 90 's. And now I found out we have an outstanding balance of {$12000.00} against our home. We have made all of our payments, a couple of them have been late, but they have been made. This has sent our credit rating way down, making it impossible to get ourselves out of the mess.

In XX/XX/XXXX we applied for a mortgage using our mortgage broker - XXXX XXXX through Capital Mortgage of Texas- NMLS # XXXX. Our mortgage broker and I supplied all requested documents and was approved for a loan. We had multiple extensions due there request for updated information from the HOA ( purchasing a condo ). Yesterday Capital Mortgage informed our broker that the loan was denied. The reason was that the HOA budget for XXXX and XXXX were in different fonts and the XXXX budget had over a million dollars added to it with no explanation. Our broker told them they would provide supporting information regarding the HOA funds, and explained the money was from an insurance settlement from the XXXX Hurricane. Capital refused to accept this and stated the loan was denied. Capital Mortgage had the documentation for several months. They have now cost me over {$10000.00} in unexpected rent and fees to move forward with loan ( application fee, appraisal, inspections, credit report, etc ). I believe this predatory practices.

I need my accounts audited because my impounds are incorrect, and I think my money is being stolen by this company. the company leaves during the business hours when they are supposed to be available for any borrower that needs any help or has any questions. I spoke to a gentleman XX/XX/XXXX in which he said he would call me back with more info. he called me XX/XX/XXXX and updated me slightly, he said he would be contacting me XX/XX/XXXX ( TODAY ) with an answer. I never received a call, so when I called in and spoke to a woman. she said that he was not in today and that he did not work yesterday ( XX/XX/XXXX ). So at that point I was completely fed up and confused so I resorted to calling in and filing a complaint with your company. They gave me an appraisal on my home that I have had for 2 years. They told me it is worth less than what I bought it for. They will not remove my mortgage insurance which is why I wanted my appraisal done to have a higher amount go to my principal instead of interest

On XX/XX/XXXX, reached out to Swivell, Inc., Capital Mortgage of Texas since I have a closing on my property located in XXXX Florida. When I spoke with Customer Service requested to get a Release and satisfaction of the mortgage on loan # XXXX since the loan had been already paid off on XX/XX/XXXX. I was transferred to the person in charge of Release XXXX XXXX and all I got was a voice mail, left several messages on XX/XX/XXXX and XX/XX/XXXX, and sent a text via chat on their website and as of today, have no heard from anybody nor received a release of the mortgage that was paid off. The Title Company that is working on the closing also faxed them a request for the satisfaction of mortgage and called XXXX and spoke with someone by the name of Mr. XXXX and no one has responded back to her. I want the Release of the Mortgage. Just wondering why they do not want to release the mortgage that have been paid. Is highly questionable why the do not want to release a mortgage that has been paid in full.

Couple of months ago, I contacted XXXX about Capitol Mortgage Service Co. out of XXXX, TX because they were not reporting my payment history being made to all credit agencies. Then they report to ONE credit agency in XXXX and XXXX closed the case. They did not report since then nor to the other agencies. On XXXX and XXXX agency it shows my last payment in XX/XX/2018, it is now XXXX On XXXX is shows my last payment in XX/XX/2018. I contact Capitol Mortgage Services- -again and I was told " there is a process we have to use, we are doing the best we can '' - -at this point, I told her their " process '' needs to be reviewed and please update my payment history, it brings down my credit scores, I was told they are " working the process. '' All In the world I am asking is for them to keep my payment history updated. To ME, this is not a hard situation, but it seems that way with this company. I have never had a problem with mortgage companies NOT doing this before.

On the end of XX/XX/XXXX I e-mailed XXXX XXXX XXXX company that the payment date is incorrect and would they up date it. I receive a note by e-mail saying they would check on it. In the end of XXXX it was still not corrected, XXXX XXXX XXXX said they were having computer problems then and they would check on this. To THIS date and several e-mails to them again almost begging I have asked them to update the payment date. It shows " last payment made XX/XX/XXXX '' as of today 's date, XX/XX/XXXX. One lady said they can't do this, the credit agencies have to, when all three agencies said the mortgage company has to report last payment, that they were not allowed to change any dates without the mortgage company requesting this. XXXX XXXX XXXX company refuses to update my credit report all all three credit agencies, it is hurting my credit score. To ME, it is simple, but for some reason XXXX XXXX XXXX won't do anything, can you help me?

Capital Mortgage received a payoff request on XXXX XXXX from XXXX XXXX and did not process my request until XXXX XXXX causing additional cost to my loan. I 'm not sure why it took Capital until XXXX XXXX to process my payoff request when it was submitted on XXXX XXXX with my authorization. The additional prepaid interest cost on my loan is {$1100.00} as opposed to {$57.00} if I had closed on XXXX XXXX as planned. Now I have to close an FHA loan in the middle of the month. XXXX XXXX XXXX has generously offered to pay for my interest owed to Capital Mortgage until they can pay loan off. Capital Mortgage should be responsible for charge applied to my loan for missing the payoff deadline of 10 days. In addition, Capital Mortgage charged me an extra 2 months of PMI of which they have credited now however If I did n't call this out they probably would not have credited me the amount of {$350.00} x XXXX.

Capital Mortgage Services of Texas raised our house payment by {$1100.00}. When we reached out to them to ask them why, they claimed we were not paying enough in Tax and Insurance so that made us owe a little over {$7000.00}. The only options that were given to us were to either just pay the new high monthly payment or refinance which neither was an option for us. This was very frustrating since they also had decided to lower our payment by a couple hundred dollars 2 years prior. We resolved the problem through a different route without any help from the mortgage company. We did manage get the payment back down, but it is still up {$300.00} from what it has been for the past couple of years.
