XXXX XXXX XXXX has an unfair and very misleading, billing practice with their customers. On XX/XX/XXXX, I had contacted with XXXX XXXX XXXX 's billing department after receiving an non-itemized, bill in the total amount of {$530.00}. I requested to obtain an explanation for the charges under my account. I had spoken with a representative by the name of XXXX XXXX on a recorded phone call. Additionally, XXXX was not able to provide a breakout or explanation of the charges. In doing so, I had requested that she research the charges and provide me with a statement of the charges, reflecting an itemization and/or breakout of the service/equipment being charged. Further, I had explained to the agent that a secondary insurance, which is on my records, is typically billed for any remaining obligation after my primary insurance had satisfied charges. At that time, I had explained that I needed to see how billing and payment activities, so that I can discern what my insurances paid as allowed costs to see if there was in fact a patient 's responsibility. I also informed XXXX XXXX that I needed the explanation because 1 ) I had no knowledge of the charges nor did I receive previous bills for that amount prior to the letter, 2 ) that amount was astronomical high for me to pay all at once as I was a XXXX furloughed employee at that time, which was during the XX/XX/XXXX XXXX government shutdown, and wanted to resolve the bill as it would unfairly and negatively impact my XXXX employment. XXXX XXXX had requested that I email her a copy of the furlough notice to XXXX, and assured me that she would have her supervisor to further research my account. I emailed the requested letter to XXXX XXXX on XX/XX/XXXX via my XXXX email account. The next day, I received a recorded phone call from XXXX XXXX, apologizing while notifying me that the {$530.00} charges were in fact erroneous and would be immediately, removed from my account. She further stated that I owed nothing on my account. I had asked XXXX XXXX to send me a copy the decision in-writing for my permanent records. I had not heard back nor received any additional communications from XXXX 's billing department until I received a bill in the mail for the same amount of {$530.00} bill in XX/XX/XXXX. In XX/XX/XXXX, I received the same bill with a note, requesting me to either dispute or pay the bill within 10 days from the date of the letter, then threatened me in-writing to forward my account to collections. I contacted the billing department and was served by an agent whom identified himself as, Mr. XXXX to resolve the erroneous notification. I had immediately, explained to Mr. XXXX that XXXX XXXX from his department notified me by phone back in XX/XX/XXXX that the {$530.00} bill was an error and was removed from my account. I requested that he research the records and follow-up research with the supervisor and notes from XXXX XXXX Mr. XXXX claimed he could not locate any notes regarding the recorded call from XX/XX/XXXX. I had immediately requested to speak with a Supervisor and was told that one was not available and that he would leave a message for a supervisor to contact me. I never received a return call back from any of the supervisors. More recently, I had contacted XXXX XXXX XXXX 's billing department after receiving a Collection Notice from Simm Associates , Inc . I had explained that the billing department supervisor was very negligent in contacting me back and had failed to provide me with an explanation of charges as I had requested 6 and 12 months ago. And, I requested to speak to a supervisor numerous times during the phone call to resolve the conflicting information, which was provided to me. But, instead the agent continued to dispute with me for a total of 50 minutes with no out any explanation of the charges or key information to me. And, on numerous times during the call, I requested that he ask for the billing department supervisor to research the records and review the recorded phone call that had taken place back in XX/XX/XXXX, when I was notified that the charges of {$530.00} was erroneous and would be removed. More astonishingly, the agent claimed that there were no records from XXXX XXXX on file other than the logged, timestamp from when she and I had spoken back in XX/XX/XXXX. The agent ignored my request for the call review and an escalation to the supervisor. During this call, I paid {$100.00} for charges for XXXX and XX/XX/XXXX. After a long dispute, the agent agreed to have one of 3 supervisors to contact me back. I had inquired about the protocol for timeframes when supervisors are expected to return the customers ' call and was told there was no timeline. I asked if there was a timeframe of 24 -72 hours, days, weeks, months and the agent said that the department do not have any timelines for return calls. Meanwhile, I am stuck with an collections account, which could negatively impact my employment and credit because I would not pay for a bill that was dismissed and dissolved at the billing supervisor 's decision back in XX/XX/XXXX. The entire practice of this company 's billing department seems very unethical, impractical, and completely obscured and unfair.

This is the servicer of student loans that Simm Associates somehow obtained despite the fact these loans are not loans that are legal to collect for. When I attempted to contact the XXXX XXXX XXXX as well as the customer service of XXXX and Simm Associates via email none of the parties replied. After I sent a complaint to the NY DFS and CA DFPI I received a response from XXXX that states that they have not attempted to collect on my loans or sent it to a third party collection agency. However, this contradicts the phone call I received from Simm Associates who stated they obtained my information in XXXX of 2021 but called in XXXX of 2021, it occured after I attempted to send a NJ Bar complaint regarding the loan company XXXX former general counsel XXXX XXXX and believe it might have prompted a chain of events. For XXXX to claim they have not sent my loans to a third party while Simm Associates has my loans is the issue. However, these are also not loans XXXX is entitled to collect for and the loans should be removed altogether. In the complaint to XXXX which they responded to only the NY DFS before the response the issues was and continues to be that the student loan servicer XXXX sent my loans to Simm Associates and it is only through a voicemail from this third party collector with number that I learned about there has been any sort or collection activity, it's not just that they have not sent me any mail or emails it's that XXXX sued me and the case was dismissed and they have no right to collect, I had already disputed and removed the loans - it was illegal collection activity and behavior at the time and the case I believe was a total fraud. In sending to the third party, they did not know anything about this legal case and are proceeding as if nothing has happened. They do not have the right to have a 'fresh start ' collecting on loans they have no right to collect for, but in this clear lapse of information I am set up for even more victimization. I need for the loans to be immediately removed and I believe both XXXX and XXXX link to larger crimes I am being victimized by. I would like to assure that these loans are permanently removed.Furthermore, XXXX was not the party that was apparently the lost servicer of these loans. As stated in my complaint, there has been no collection activity from XXXX - they have not sent me any mail, or emails for years and XXXX attempted to sue me then dismissed the case. During this time, I believe I was still being victimized and when XXXX relocated from XXXX XXXX to XXXX XXXX and XXXX XXXX XXXX was the servicer, I felt it was suspicious - hence I made another CFPB complaint. I would like the highlight the response I received from Goal Structured Solutions in the response to my complaint the new servicer XXXX XXXX XXXX ( owner of XXXX XXXX XXXX ) stated after our legal case was dismissed : " There is no longer any collection activity by Goal or XXXX on XXXX XXXX 'XXXX Education loan held by XXXX, and therefore, the parties believe Mr. XXXX has no further claims or complaints to be addressed and consider their legal obligations in this matter complete. " This response came from XXXX XXXX XXXX, they are the new servicer of XXXX. It is not clear how XXXX still is a factor, they have not sent me any sort of mail or emails from XXXX in years and I also had a legal case with XXXX, and then somehow very recently they sent these loans to collections. It is not just the loans, as I describe in the XXXX attachment, the issues link to larger crimes affiliated with the student loan company XXXX addition to the pdf I have also provided a few XXXX affiliated emails, I believe they are actually hijacked emails that the targeting from corrupt law enforcement with any sort of forensic analysis that my efforts at dealing with these loans, that they actually connect to corrupt law enforcement and the service I have received is an injustice apart of this also

I am currently a " XXXX and XXXX '' XXXX veteran who has had my federal student loans discharged ; however, I am experiencing severe credit problems and financial difficulty due to predatory private student loans taken out prior to XXXX. I have been unsuccessful in trying to verify who my current servicer/ the " owner '' of these loans is, but have been lead to believe that I owe XXXX XXXX XXXX and their current collection agency, SIMM ASSOCIATES {$110.00}, XXXX ( according to my XXXX XXXX app ) with ever increasing interest since XX/XX/XXXX. I have not been able to contact XXXX XXXX XXXX directly due to them not having contact information available to the public. The only written correspondence I have received was regarding a threatened lawsuit if I refused to pay their collection agency. I have sent my VA letter verifying my XXXX and XXXX XXXX to SIMM ASSOCIATES which also states that I have a very limited income and that I am prevented from working due to my XXXX ( I have no taxable income ). I have repeatedly called the collection agency to find out who my current servicer of these student loans is, but they continue to fail to give me a direct answer. They told me XXXX XXXX XXXX, but after talking to them, I do not have a balance with that company. Then I was told that XXXX XXXX XXXX owns them, but I am unable to verify this. In addition, I was told that my private student loans " never go away '' by customer service at SIMM ASSOCIATES, and that the only way to stop the ever increasing interest and repair my credit was to pay over $ 2,000XXXX month or settle my balance by paying at least {$70000.00} ( my disability checks are only about {$3100.00} in XXXX XXXX XXXX County , CA ( XXXX ). I have updated my contact information with SIMM ASSOCIATES and requested that my account manager, XXXX XXXX return my phone calls, but have received neither written nor phone correspondence from them. I am unmarried, and the original co-signer of these private loans, my father XXXX XXXX died in XX/XX/XXXX. In addition, I have a copy of his will, which specifically states that even though I was his only child, I had no legal right to his estate. Basically, I'm on my own financially trying to deal with this. Besides negatively impacting my credit, I have been denied housing and VA- backed home loans, SIMM ASSOCIATES has threatened to repossess my ex-husband 's vehicle that I co-signed on, and my mental health has deteriorated significantly ( my XXXX XXXX XXXX XXXX are mental-health related, which prevent me from working ). I was recently hospitalized from XXXX XXXX XX/XX/XXXX at a VA hospital in XXXX , AZ for XXXX XXXX problems, including stress related to potential bankruptcy, student loan debt and reduced income following my divorce in early XXXX, which the VA has documented. When XXXX " XXXX XXXX XXXX, '' I came across lots of information regarding fraudulent collections and contact information for attorneys for victims such as myself who have been paying on these loans without any proof that XXXX actually has the legal right to collect on these debts. As previously stated, I have a very limited income and it will cause further debt and financial/ credit problems and emotional detriment if I am forced to get a lawyer regarding these issues. I am a victim of identity theft. I recently learned that my personal information was used to open an account at your company. I did not open or authorize this account, and I therefore request that it be closed immediately. I also request that [ XXXX ] absolve me of all charges on the account, and that you take all appropriate steps to remove information about this account from my credit files. The company has been notified by me via mail with no response, as well by all 3 credit bureaus XXXX, XXXX, XXXX. The company has refused to dissolve me from this debt and is continuing to persue the debt and violating federal law and my rights under The Fair Credit Reporting Act, 15 U.S.C. 1681. Enclosed is a copy of my Identity Theft Report supporting my position, and a copy of my credit report showing the fraudulent items related to your company that are the result of identity theft. [ Consumers should redact information that is unrelated to the dispute with this company. ] Also enclosed is a copy of the FTC Notice to Furnishers of Information, which details your responsibilities as an information furnisher to credit reporting agencies ( CRAs ). As a furnisher, upon receipt of a consumers written request that encloses an Identity Theft Report, you are required to cease furnishing the information resulting from identity theft to any CRA. The Notice also specifies your responsibilities when you receive notice from a CRA, under section 605B of the Fair Credit Reporting Act, that information you provided to the CRA may be the result of identity theft. Those responsibilities include ceasing to provide the inaccurate information to any CRAs and ensuring that you do not attempt to sell or transfer the fraudulent debts to another party for collection. Please investigate this matter, close the account and absolve me of all charges, take the steps required under the Fair Credit Reporting Act, and send me a letter explaining your findings and actions. Fraud Alert has been placed on a 3 credit bureaus, XXXX XXXX, XXXX, XXXX XXXX and other consumer reporting agencies. An unknown person has been using my identity to open bank accounts, rent houses and apartments, open credit cards, obtain loans and other fraudulent activity. They have been using my identity to my knowledge since 2016. Accounts opened fraudulently in my name includes XXXX XXXX ( XXXX ), XXXX XXXX, XXXX XXXX XXXX, XXXX Bank, XXXX XXXX XXXX and more. There have been fraudulent addresses, jobs, businesses and telephone numbers that have been used fraudulently without my permission. Someone has been living their life for years pretending to be me, using these accounts to live a normal life while I suffer unable to buy a house, apartments, credit cards etc. as a result of Identity Theft. I also request any legal action that was taken against me for this debt be expunged and removed from my public records. I am requesting this debt is cleared from my records immediately. Failure to do so is violating law and my rights as a United States citizen under The Fair Credit Reporting Act, 15 U.S.C. 1681. I am curious to why she called my number instead of my husbands cellphone number. I was told by XXXX that my cellphone number is also associated with the loan. I contacted XXXX after receiving a debt collections letter in the mail. I explained to XXXX that XXXX and I had married and divorced on XX/XX/XXXX. XXXX and I were married on XX/XX/XXXX and we divorced later that year in XX/XX/XXXX. XXXX and I remarried on XX/XX/XXXX. XXXX and I lived apart until XX/XX/XXXX. I resided at XXXX XXXX XXXX and XXXX resided at XXXX XXXX XXXX XXXX. There were other people in and out of his home at XXXX XXXX XXXX XXXX. I moved in with XXXX on XX/XX/XXXX and we were remarried on XX/XX/XXXX. I am curious to why my cellphone number is associated with this alleged credit card account. I am always curious to why XXXX called me on this morning versus calling my husband at his cellphone number which is XXXX. After XXXX and I divorced in XX/XX/XXXX, I kept my married name XXXX. XXXX and I married and divorced the same year, XX/XX/XXXX. We applied for another marriage license the same year and were remarried 4 years later. I am in no way associated with this account yet the Collections Agency contacted me in reference to the account. I do not want this account to be charged against me in any way. My husband has been a victim of identity theft in the past and he alleges this is not his account. At the time the credit card was acquired, I was unemployed. XXXX and I have requested, information from XXXX credit in reference to the account. I am afraid that my name is associated with the account and it could potentially show up on my credit report. I had found out that my husband was paying to a collection company called SIMM Associates Inc. for about XXXX years. XXXX had a XXXX mortgage through a Company called XXXX XXXX, then the Company was sold to XXXX. My husband and I have had XXXX problems ( XXXX XXXX etc. ) We last paid on the loan thru XXXX XXXX on XXXX/XXXX/XXXX. Our balance at that time was {$35000.00}, our annual percentage rate was 6 %. When XXXX XXXX took over we made payments until we could n't anymore. Our last payment XXXX was XXXX/XXXX/XXXX. XXXX XXXX XXXX XXXX made a Charge off/Default on XXXX/XXXX/XXXX. Approx, XXXX yrs. ago, a Collection agency called Simm Associates , Inc . bought our loan for I 'm guessing 'pennies on the dollar '. I did n't understand why my husband was uptight all the time until I discovered this horrible Simm Associates. I called them and talked to a rude 'manager ' named 'XXXX ' I talked to him about the loan asking him why we have a statement from them showing we have a balance of {$110000.00} that we owe them pointing out that last paper I looked at that we had a balance of under {$36000.00} and that my husband had been paying Simm Assoc XXXX {$160.00} a month for XXXX years! He told me first off he wanted me to know that we could or not be conversation recorded. I said ok., like that 's going to scare me. I asked if he would negotiate for like {$13000.00}. Just a # I through out because I realize now, we owe less than this, I believe. He said sure, pay it in 1 month or 'short sale ' your home to pay it, or keep paying them I think was the XXXX thing. I told him it would cost us more rent than are mortgage now 'Short Sale ' our home! I got upset about the way he was speaking to me and reminded him I was on the line to solve this issue. He reminded me that he was recording the call and I told him " Ditto ''. He instantly got mad and said " you never told me you were recording our conversation " and hung up on me, I recently talked to a lady there named XXXX XXXX and asked her why her collection agency was charging me so much and she told me and I quote '' {$14000.00} in fees and {$63000.00} in interest! This is hiway robbery! I have learned 3 things, 1 XXXX from my Bank yesterday- this is no longer officially a second mortgage after it went to the collection agency, so they ca n't threaten to take my home 2 ) I did n't know where to turn to for help XXXX our bank ca n't help us because our credit is ruined and they feel the high interest they would charge us would take XXXX yrs. just to pay it off ( {$13000.00} XXXX. 3 ) Do n't hide things from your spouse. I ca n't believe I did n't know or he was to ashamed to tell me! Now I know why he has XXXX problems and 'why ' he 's always angry. I have tried to call XXXX XXXX XXXX XXXX to see if we can settle through them. They have there own Loan Default Department. I have tried the Dept 's XXXX number but it says that our loan has been sent to Simm Associates Inc. Please help. We owe the money for under {$30000.00} we admit that. We need HELP!

Company Name : XXXX XXXX XXXX XXXX XXXX XXXX aka XXXX XXXX. XXXX XXXX XXXX XXXX XXXX XXXXXXXX ( XXXX ) XXXX XXXX. Company called repeatedly both during and after business hours from different phone numbers beginning around XXXX XXXX. XXXX. Company would reach voicemail and leave no message. XXXX. When I finally answered the unknown number, Company would not provide information about the Company, but demanded information, including PII from me. Company did say that they were part of XXXX unknown to me. XXXX. I initially refused to provide unknown Company with personal information, and asked for Company to provide partial information to verify that they had me as the proper contact, and to reduce the threat of fraud. Company refused. XXXX. I asked to speak to manager, who validated that they do not provide information until they verify my identity. Company would not provide type of business, or any other information on demand. After working in compliance, I knew that this seemed like a violation. XXXX. Despite feeling wrong to do so, I felt so much pressure that I provided enough personal information to the company that they told me they were a debt collector. XXXX. Company could not tell me where the debt originated, or from what purpose. XXXX. Company told me that I owed a significant principal balance, and that I was overdue. XXXX. Company told me that if I did not make a payment they would report negative credit. XXXX. Despite feeling uncomfortable, I decided to pay the amount they demanded to avoid negative credit impact. XXXX. Company required additional PII, including social security number and then payment information. XXXX. I paid 'past due ' balance, verified address and contact information, despite never knowing where this loan originated. I can not find the charge to my account -- anywhere. It is either mislabeled, parsed into smaller payments, or never happened. XXXX. Company never provided reasonable information despite asking, demanding, escalating my issues, and representative admitted to knowing that the order of events did not make sense. XXXX. As of today, Company claims I owe {$2800.00}, claims I am {$150.00} past due, and has submitted negative credit reportings creating a very significant XXXX point decline in my overall credit score. I made the payment, and never had a clear explanation of where the loan originated from, or the circumstances under which I assumed any type of financial relationship with SIMMSXXXX. Since providing all PII, I am now receiving bills with late fees, with nothing more than dollar amounts. The bills do have notices of CFPB protections. Simms Associates is a debt collection agency that initially contacted me on XXXX XXXX 2015. I was greeted by a representative who kept asking me for my name, social security and address. She specifically asked for me via phone when she called my workplace and after providing my social security and DOB, she said that was not what she had on file. After a few minutes of determining that the other family member, my grandmother 's information was the XXXX on file ( she allowed me to provide her SSN and DOB and then gave me all the information regarding the debt ), she informed me of the balance I owed and with what company the charge off came from to collect the debt. I informed her that I am unable to make lump sum payments due to other debts accrued from student loans, and after she implied by stating that if I do n't pay, they do n't know what would happen, I may go to jail or get sued or go to litigation, that I was forced into making some sort of settlement. We ended up with {$25.00} from my checking account until I could pay them more. After feeling cornered and coerced into sending in a payment, I filed a complaint with their local XXXX in Delaware. The only response received was that they would provide a verification of debt. Like the rep 's " I will email you a receipt '' issue - neither came via email or regular mail. I assumed that our debt was already in repayment and never checked back again. Apparently they decided voluntarily to not accept payments arranged, because no automatic payment was posted to my checking account in XXXX. I called on XXXX XXXX and they refused to let me provide the same information the previous representative allowed me to provide. They refused to let me provide any sort of information and repeatedly informed me they can not talk about this account any longer. I submitted a second complaint today to the Delware XXXX after talking with XXXX XXXX who charged off the account and put Simms Associates in charge of collecting my account on their behalf. XXXX collections department representative filed the complaint, and agreed to take payments direct from me and not through the Simms Associates. I informed Simms via the XXXX complaint of this outcome. I feel that their collection practices, especially casually implying that I would go to jail or get sued just to get payment out of me was flat out wrong. There are several online complaints regarding their practices. I can not believe that they refused to let me pay! How ridiculous is that. I hope that someone takes care of this business and ensures that they are unable to threaten or coerce other people out of payments.

I was contacted by SIMM associates regarding a past due balance for a private student loan serviced by XXXX XXXX. I was in contact with XXXX about possible forbearance options as I had recently lost my job. I am not one to miss payments and had a track record of on time payments since XX/XX/XXXX. In conversation with an associate from XXXX ( XXXX XXXX ), on Friday, XXXX XXXX, XXXX, I told XXXX that I would be making a payment directly to XXXX on the XXXX of XXXX XXXX my XXXX paycheck after 5 months of unemployment ). She insisted that I call to make the payment with her instead and I declined. After my interaction with these in incompetent people, why would I give them my bank account information? These people can barely formulate a sentence with proper grammar. On Fri, XXXX XXXX, I contacted XXXX to let them know I would log on to my account and make a payment to get my account to current status. I spoke with a nice lady named XXXX and she also said she has heard terrible stories about XXXX associate interactions. XXXX said that if I contact SIMM, to supply them with this number in order to stop receiving phone calls. I, XXXX XXXX have been abused for years on a privatized student loan debt that is no longer enforceable in the state of XXXX This debt was originally procured through XXXX XXXX XXXX, then assigned to XXXX XXXX XXXX XXXX XXXX XXXX. Now I was living in the state of XXXX when I dropped out of college several years ago. I have been harassed with multiple collection agencies for these years. The statute of limitations for XXXX is 5-years. Since I now live in XXXX the statute of limitations is 3-years. This student loan never had a connection to the U.S. Department of Education. However, for years I have been harassed by a company known as Simms Associates. This agency has moved this collection to my personal credit report as well as my mothers credit report. Now the scam has gone to a new level of corruption. Simms Associates has no standing legal collection process. So recently they assigned the collection to a law firm known as XXXX XXXX XXXX XXXX, XXXX, located in XXXX, MD XXXX. An agent that has my power of attorney made a settlement offer on two occasions. There is not even a requirement to settle the matter. An individual from this law firm stated that their client has refused both offers. When a demand for the law firms client was, the name was refused. We all know that this is Simms Associates trying a new threatening method trying to collect a debt no longer owed. The timeline for summary judgment has passed for both Florida and Maryland. This aggressive collection practice is a clear violation of the Fair Debt Collection Practices Act. The third-party must always be presented, and this is not the case in this matter. The one-time settlement offer presented by my agent is still on the table until XX/XX/2019. After that date, I will file a complaint against XXXX XXXX XXXX, XXXX. with the Maryland Bar Association. In XXXX, the statute of limitations requires that a law suit be filed within 3 years for written contracts, and 3 years for open accounts, such as credit cards. For credit card debt it means the date of the last activity on the account or the date the account was written off as a bad debt was at least 3 years ago. This means that if your account is older than 3 years you can raise the statute of limitations as a defense to the complaint. However, the statute of limitations only covers the right of the creditor to sue you in court.

On XX/XX/XXXX, I was notified by XXXX XXXX Customer Service my account was in collection and was sent to XXXX XXXX XXXX ( Contact # : XXXX ). This was the first time I was notified I was overdue. I have not received any notifications from either XXXX XXXX or the Collection Agency ( XXXX XXXX XXXX ). I immediately contacted the Collection Agency to figure out how this happened. History : On or about XX/XX/XXXX, I purchased some items from XXXX XXXX XXXXr. This line of credit was through XXXX. On or about that same year, XX/XX/XXXX, XXXX closed the XXXX XXXX XXXX website requiring XXXX XXXX XXXX XXXX XXXX to link their XXXX accounts. I linked my accounts, as required and requested by the website. Additionally, I verified it was done by trying to re-register, but it gave me an error stating my account had already been linked. In addition to my XXXX XXXX XXXX I have a XXXX XXXX Account. The registration should have linked my overall XXXX account, but I am unable to see my XXXX XXXX XXXX account status ( website is shut down ) or unable to see a balance on my XXXX Account. XXXX Customer Service/Collections stated they sent email messages and mail to my home address listed. I always monitor my account information and update the address as needed. XXXX XXXX stated their process is to send out email notifications first, followed by letters to the address on file and as a last resort calling the phone number listed. I was not afforded my due process to respond to a debt prior to collection. Furthermore, since the systems were not linked, I was unable to see a remaining balance due. My account has been overdue for over 400 days yet nothing reflects on my credit report. How can a consumer be charged late fees and interest on a balance he or she is unaware they owe due to a poor notification and system miscommunication/technical issues? Over the 400 day period, my balance went from {$170.00} balance owed to {$360.00}. The difference in balance can be attributed to late fees and interest charges. I do not dispute I owe a balance of {$170.00}. I made those purchases and do not dispute the charges. The remaining {$190.00} ( interest and late fees ) is a gross overcharge and should be reflected as a bad credit card practice when the consumer has no knowledge a balance is due. As a consumer, I should have protection and provided due process.

On XX/XX/2019, I filed a compliant against Simm Associates through CFPB because I had not received any written communication to verify the debt they claimed I owed for 5 months but was paying {$100.00} each month to them. The XXXX complaint came because even though I called 3-4 times each month from XXXX 2019-XXXX 2019, every phone conversation with a representative of Simm Associates was ineffective in obtaining clear information pertaining to my debt. The XXXX complaint was requesting that paperwork be sent outlining the account summary for my debt and providing proof that the {$100.00} payment each month was helping to reduce my debt. She encouraged me to call them back. I did and they have not picked up or called me back. The lack of communication along with the fact they incorrectly state my name on all documentation I have receive, is the reason I am complaining. Simms Associates was hired to collect for my XXXX delinquent student loan accounts owned by the XXXX XXXX XXXX. Simms made contact with my cosigner ( NOT me ) prior to engaging in what I believe to be illegal activity. On XXXX/XXXX/16, Simms claims that they spoke with my cosigner and that my cosigner authorized for payments to be taken from my bank account. My cosigner denies this, stating that she specifically did NOT authorize any transaction on any of our accounts. Regardless, on XXXX/XXXX/16 {$870.00} was withdrawn from my XXXX bank account ( which is in my name only, not my cosigner 's name ) by Simms Associates and paid to XXXX XXXX XXXX, my loan servicer, and listed as a " Borrower Payment. '' I myself had no contact with Simms Assocates regarding this particular loan issue prior to XXXX/XXXX/16, and I made my first contact with them on this date inquiring as to how it was permitted for my cosigner to authorize payment from an account that does n't have her name on it. I also inquired as to how they were able to obtain my XXXX bank account information if me and my cosigner have never provided information for this specific bank account EVER to anyone at Simms Associates. I contacted XXXX XXXX XXXX to determine whether or not they provided my bank account information to Simms, they claimed they had not. Which would mean that only XXXX Bank could have provided this information to them. XXXX Bank was the original owner of my loans, but sold them some time ago to XXXX XXXX XXXX. I am curious as to why they might provide my bank account information for loans that they claim to not own anymore. If they did not provide this information to Simms Associates, then someone else did, and did so illegally. Simms Associates told me that they would have to look into the phone call they had with my cosigner on XXXX/XXXX/16 and would get back to me-they have yet to do so. I also contacted XXXX asking them to stop the payment of this {$870.00} pending transaction, to which they stated they would attempt, but could n't guarantee that the payment could be stopped since it was already pending. I took out a private student loan with my father as a co-signer through XXXX XXXX XXXX ( XXXX ) while attending XXXX University XXXX. After I withdrew from school, I used used up all the deferrment and forbearance options while trying to work and pay off loans and living expenses. At the moment, I am 147 days behind on my monthly loan payments through XXXX. I have spoken with them and they are attempting to work with me to keep my loans out of default. However, both me and my father are also being continually contacted by agents from Simms and Associates, a collection agency out of XXXX, who says that they are servicing this same debt and seeking payment. They keep telling us that we must make some sort of immediate payment to them to keep the loan from defaulting, going " outside their office '' and causing them to seek a judgement against both my father and myself that would include garnishing my wages and taxes as well as garnishing both my father 's social security payments and his pension. I have repeatedly told the agents from Simms and Associates that I am working directly with XXXX and they tell me that my loans are not in default at the moment and that they are currently not seeking any judgements against either me or my father. Nevertheless, the agents from Simms and Associates maintain that I am to pay them and not XXXX directly in order to avoid garnishments. What I would like to do is keep working with the service providers at XXXX to keep my loans out of default, but I am unsure if I should take the threats from Simms and Associates seriously and, if so, if I should be making payments to Simms and Associates or keep making payments to XXXX. Furthermore, I would like to make myself as the primary person responsible for this debt the contact person for all calls, letters and other communication and stop them from harassing and threatening my XXXX father about garnishments on his social security and state pension. I hope there is some way to find a solution to this problem that will work for everyone involved? I am more than willing to make payments on these loans, but I need them to be payments that work within my budget and place responsibility entirely on me and stop the harassment and threats to my father.

On XX/XX/2022, I received a call from Simm and Associates in Delaware. I missed the call and a voicemail message was left. I returned the call to them immediately, but their voicemail system kept kicking me out. I knew what the debt was about even though I had never received notification from this company because I am involved in a dispute over a medical bill. When I returned the call the following Monday, I gave my telephone number and name, but due to the fact that I was unwilling to provide any additional details to them, they refused to talk to me. I told them that this was fine, that they could send me a letter and I would respond in writing as I knew what it was about and it is in dispute. The lady I spoke with said that she was not sending me a letter. I advised her that I knew she was required to send me a letter within 5 days of our communication to which she replied we did not have a communication because I would not verify my address. I advised her this was a communication, I told her who the debt was owing to and that I am disputing it and that I expect to received my written notice. She would not confirm or decline sending me a notice. I then contact the company I was disputing with again, and after several additional phone calls and a complaint to the Civil Rights Bureau, they advised me that on XXXX they have written the bill off and would be notifying the collection agency of this. I then called the collection agency to verify that it had been written off. Once again, I verified my name and telephone number and in one of the calls I even verified my date of birth, but because I wouldn't disclose my address, they would not discuss the bill with me. As a matter of fact, the gentleman I spoke with hung up on me. I called back 2 additional times and was hung up on again. I called back a 4th time and asked to talk to a supervisor or manager and after arguing with me a bit, the wiman I was speaking with finally transferred me to a manger. Again however, this party refused to discuss it with me. I advsed them at that time that I knew my rights and that I still have not received a written communication from them and that I would be contacting the CFPB.

Early in 2021 I decided to use XXXX to purchase an electric skateboard. They offered financing that seemed favorable at the time. There was a dispute with the merchant which I reported to XXXX. This event triggered the auto pay that I set up to be paused. The dispute was eventually resolved and I received my skateboard. Since their system automatically disabled my auto pay it was a reasonable assumption that their system would also reactivate the arrangement. Little did I know that I was falling behind on payments. In the meantime, after the fairly positive experience, I made several other purchases using XXXX. Their app aggregated the monthly payments of the various transactions I made using XXXX. Over several months, I received emails stating that my payments were being deducted and I received an email every time I paid off a purchase. Several months after I made the skateboard purchase I received an email or call notifying me that I had been sent to collections. As far as I knew, I was making the payments for all the purchases I had made. If XXXX had sent emails regarding the skateboard purchase was falling behind they were overshadowed by the successful payment emails that implied my good account status. XXXX did not contact me before putting my account in collections. Of course I initiated a dispute but they had already referred me to a 3rd party so it isn't surprising that my dispute went nowhere. I should also point out that while I was missing payments to that single loan, XXXX continued to offer me higher and higher purchase amounts and approving transactions ; this further contributed to my perception that all was well. They claimed that I stopped the payment agreement to that initial loan. They however can not provide proof that I authorized any such action. On the other hand, I have an email that was sent to me when I initiated a dispute against that merchant that explicitly says that they were pausing my payment arrangement. They screwed up and then sent me to collections without notifying me. They have not taken any steps to undo their referral to collections.

I have had the unfortunate experience of dealing with Simm Associates, a collection agency, in handling my student loans. After losing my one of my jobs in XX/XX/XXXX and working at my other job only 30 hours/week ( employer given hours ) I was not able to make full payments on my student loans. I offered to make reduced payments, however, the original lender, XXXX XXXX, refused a payment reduction to $ XXXX/month vs the required $ XXXX/month. They then sent my loans to SImm Associates. Since XXXX 2016, I have received multiple calls to my business cell phone which I have asked them nicely on MULTIPLE accounts to not call. I then began taking screen shots of the calls so I could document the continued calls. The next step was calling me during the business day at my place of employment. I asked that call to stop as well, but they continued. They even went as far as to call my father-in-law harassing him for information- again, I asked them to stop and they did not. Each of these callers from Simm Associates were rude and threatening, telling me they were going to put a lien on my assets, garnish my wages, continues to call my work office until a solution could be reached. EACH AND EVERY TIME I offered to again pay them {$100.00} and they would only laugh and tell me that was not enough money. I asked for a payment plan of some sort, or a long term solution for paying off these loans. XXXX person, by the name of XXXX, actually hung up on me saying I was wasting his time asking for a payment arrangement. This was the same person who told me I graduated from an XXXX school and should know better. Simm Associates is a collection agency- they DO NOT have the right to harass me, tell me they are going to put a lien against my property, take me to court, to call family members not associated with this loan nor call my cell phone. They have my home phone number which I have asked them to call to speak with me. They are utilizing unfair collection tactics as described in the Fair Credit Collections Act.

I have been harassed by postal mail several different times, by several different collection agencies representing XXXX XXXX XXXX. The first harassing letter was sent by XXXX, which after I filed a complaint here with CFPB, in XXXX, they said they would stop contacting me regarding the debt they allege against me as it has absolutely no merit. The second harassing communication came by way of XXXX XXXX XXXX in XXXX, XXXX, the next was by XXXX XXXX XXXX, also representing XXXX XXXX XXXX which occurred in XXXX, XXXX. The most recent communication was sent to me by their third company, SIMM ASSOCIATES , INC. dated XX/XX/XXXX. The letters are the exact same each time. Each time they allege that I owe money for a student loan account that they allege I defaulted on XXXX, XXXX, XXXX. Not only do I not owe this debt, the information they have and continue present is completely false. I dispute this debt!. Each time they threaten me, they present false documents and they allege that I benefited from proceeds of a student loan that I do not own. I have statements from both my private and federal student loans to show that I do not owe any outstanding debt. This is a fraudulent company who buys false documents from somewhere and they harass you at every end using fear and intimation tactics each time. What I know about XXXX is they have been party to a Federal Court case over 20 times for violating consumer 's rights and using illegal harassing communication tactics to coerce a payment. Well, it will not happen in this case. These practices must stop. It takes me time and great effort to continue responding to these harassing letters every few months. It also causes me emotional turmoil to be accused of owing a debt that they threaten against me. These actions are malicious and are intended to inflict emotional distress to coerce me to pay for something I do not owe.

In XX/XX/XXXX I was diagnosed with XXXX XXXX and prescribed a XXXX machine. Doctor directed me to XXXX XXXX and XXXX XXXX who fit me with a CPAP machine and supplies. At that time, I had XXXX XXXX through my employer, but three months later in XX/XX/XXXX, my employer changed insurance companies to XXXX. Under XXXX guidelines, I would own the machine after 10 monthly payments. XXXX paid two months of payments before I was enrolled with XXXX. Under XXXX guidelines, however, I would own the XXXX machine after only SIX monthly payments, and the two payments made by XXXX would be counted towards those six months if XXXX requested what is called a " transition ''. XXXX did NOT request a transition, but instead billed me directly. I paid XXXX 's third party billing company, XXXX, {$190.00} on XX/XX/XXXX representing two months CPAP rental, and XXXX {$220.00} on XX/XX/XXXX for two months CPAP rental and CPAP supplies. With those payments AND the two payments XXXX already paid, my full six months should have been paid off the XXXX machine had XXXX requested a transition. Not my fault that they did not. I have tried to resolve my balance with XXXX since XXXX of XXXX. When phone calls didn't work, I escalated the matter to a manager via e-mail but he eventually stopped responding. I received multiple collection calls and each time I told them to stop. I eventually got the name and address for the Agent for Service of Process for XXXX on the XXXX Secretary of State website and sent him a letter disputing the debt -- again with absolutely NO RESPONSE. NOW, I just received a bill from a DEBT COLLECTOR for three months of rental at {$68.00} a month for a total of {$200.00}. I called the debt collector today and once again disputed the debt, but I don't believe that will stop this madness.

I ' am writing to complain about Simm Associate Inc Referance number XXXX and XXXX. This collection agency engaged in the following unfair and abusive collection practices specifically prohibited by the Fair Debt Collection Practices Act, 15 USC 1692. Simms and Associates a debt collection company has called me no less than XXXX times regarding an alleged collection for my daughter XXXX XXXX. I have informed them each time this is not her number, I have no involvement in this claim and in fact they will not disclose ANY information to me about it as they acknowledge that I am not party to the transaction and they can not disclose any information to me, yet they continue to call. Each time they insist they have never called me before, today I said, " then how do I know who you are and what you are calling about. " Each time I have asked them to stop calling yet they continue to call me. The latest call was today. My daughter has spoken to Simms and Associates approximately 3 months ago ( so yes they have been in contact with her directly ). She asked them to send her a letter with proof of the debt and explanation of the debt. Their response was they already sent it, however, she has received no such letter or information to date. She asked them to send the information and it still has not arrived. The person I spoke to today was aggressive, insistent about getting personal contact information for my daughter, refused to provide ANY proof they have a valid reason to contact her, and denied the firm has ever contacted me before. I told them they are violating the law by continuing to contact me and harass me. She insisted they are not violating the law by contacting me about a debt I am not a party to. A {$9400.00} loan for a non-degree certificate program I participated in ( XXXX XXXX ) was sold to a XXXX party servicer. I recently received notification of an unpaid balance of {$1100.00} from SIMM Associates , Inc . It appears that SIMM Associates , Inc. reported this missed payment incorrectly. The program through which I incurred the loan with XXXX XXXX has a contract stating that the loan I took out is not credit bearing and is interest free. In XXXX of XXXX, a payment of {$6000.00} was applied to the principal balance, but XXXX XXXX XXXX XXXX have been harassing me for payments ever since. I have also been receiving repeated phone calls after having notified the XXXX XXXX representatives that I currently am XXXX. Under the agreement from the program per the program contract, payments can be paused for up to XXXX months at a time if program participants are unemployed. This pause can be renewed without any limit. Furthermore, there is a recorded phone call I had with a XXXX XXXX XXXX in XX/XX/XXXX during which the representative stated that there was no deadline to submit confirming unemployment documentation, yet XXXX XXXX has continued calling me multiple times a day. I received an initial letter from a debt collector dated XX/XX/2021 with no verification of a legitimate debt owed. I made numerous phone calls to the company requesting verification but that information was never received. A letter dated XX/XX/2021 indicated as a formal demand listed hardship options being offered to settle this matter so I chose one of them and called the company and made a payment to settle the debt in full on XX/XX/2021. This payment was made via an XXXX card and the payment posted on XX/XX/2021. At the time I made the payment I requested a settlement in full letter be sent to me via email and was told I should receive it within 3 business days. I found it odd that a local number would call so many times without leaving a voicemail but ignored it nonetheless because no one who knows me calls without texting me first unless it's an emergency. Due to the amount of times this number appeared in my logs alone, I decided to call them back on the XX/XX/XXXX. When I dialed the number, it rang once, then bounced me to the queue for Simm Associates Incorporated and immediately puts me in line to speak to a live agent. My phone number works perfectly fine and I'm open to returning calls of those who leave voicemails, but these practices are done in a way that I believe is in violation of my rights as a consumer under the FDCPA and the TCPA because not only is it deceptive, but because the company masking their number with a local line to establish contact with me in a way that misrepresents the nature of their calls, which is spoofing.

Made a payment to the original company. few hours later got a phone call from SIMM associates looking for me. They required address and DOB for the nature of the call. I refused the first time and they hung up the call. Decided to call back because they knew my name and gave information because they told me they had the information they just needed to verify. Told SIMM associates I made the payment earlier that day. The associate asked if they were allowed to call back if they did not receive the payment. I said if the debt is paid dont call me back and erase my records from their system. Decided to call the original company and asked if SIMM associates were actually the debt collector and if they have been notified by the original company. The original company states SIMM associates was notified by the original company the moment my payment was received. Got the reference number to call regarding this conversation from the original company. Called SIMM associates back and told them they should have received an electronic notification from the original company and that the notice was sent out immediately. The person on the call told me that what I said is " not true '' and that it usually takes 2-3 days. Is this a violation since they are calling me after my debt had been paid off. And why is an electronic notification not instant?

Received notices from Simm Associates, XXXX XXXX XXXX, XXXX, DE XXXX, dated XX/XX/2020 addressed to both myself and my wife regarding debts owed to XXXX University XXXX. We were not aware of these debts and never received any bills related to them from XXXX. The dates of service noted on the two letters were the same and the amounts alledgedly in dispute were the same. I spoke to XXXX on XX/XX/2020 and they indicated that they do not do business with Simm Associates, that we had no services on the dates listed, and that we did not owe XXXX the amounts involved. I left a message for Simm Associates on XX/XX/2020 and did not receive a reply. I called Simm Associates again on XX/XX/2020. Their representative stated that they would transfer me to the " person in charge of my account '' ( but they had not yet asked me for any identifying information ) but they stated that " they were not available ''. The person then said they would try to help me, I just needed to give them my name, address, and date of birth. I received a call on XXXX/XXXX/XXXX from a private number advising that I had missed a court date & needed to call XXXX. I called and was advised by XXXX at XXXX that they were going to have a cop come to my work, have me arrested, & have my wages garnished. I said that he had to have a court judgement to garnish my wages. He said that no he did n't. He would get my employer to sign a paper showing what I made then they would file at the court house to have my wages garnished without any kind of court case. He requested a " payment '' of {$1200.00} to settle an account that was paid off to the original creditor in XXXX. I asked for a mailed copy showing what I owed and was told they do n't do that. Yet at the beginning of the call he advised that a " certified '' letter was sent. My mother recently passed away on XX/XX/23. On XX/XX/XXXX, I received the letters of administration & forwarded them to my mom 's banker same day and told her I wanted to pay off her XXXX credit card immediately which was due XXXX. Instead of replying in a timely fashion while still holding my mother 's accounts closed, XXXX turned the account over to SIMMS collection agency! They called me from a scrambled number and insisted I owed them and XXXX was their client. When I checked with XXXX XXXX at XXXX she said I had to pay them. As soon as she released my mother 's funds, I opened an estate account and paid all my mother 's bills. I sent a check to SIMMS and they refused to cash it. After 7 days I called them and they scoffed at the starter checks that every other creditor had cashed, and told me I could not sign the checks " The Estate of XXXX XXXX XXXX '' which is how the bank told me to sign the checks. They refused to deposit the check! and then extracted personal information from me in a very sleazy way, insisting they want to make an ACH withdrawal from the estate account now. I am not comfortable with this coercion and I am dumbfounded that they refuse to cash the check, and have the nerve how to tell me to sign it. I am only trying to pay the bill off in full!

XXXX XXXX, XXXX XXXX XXXX is reporting an erroneous and inaccurate charge-off with a past due balance on my credit report with XXXX and XXXX. In violations of FCRA, a charged-off account is already written off. There should be no past due balance of {$4500.00} when the account is charged-off already. I dispute the entire balance pursuant to FCRA Section 623 ( a ) ( 1 ) ( C ), FCRA 623 ( a ) ( 2 ) ( B ), and FCRA 623 ( a ) ( 5 ) ( A ) against XXXX XXXX, XXXX XXXX XXXX. I previously disputed this erroneous and inaccurate information with XXXX and XXXX XXXX, XXXX XXXX XXXX was removed from my credit report for inaccurately reporting a charged-off account with a past due balance amount owed. A direct violation of FCRA, requiring all inaccurate information to be removed. XXXX XXXX, XXXX XXXX XXXX sold the charged-off account to SIMM ASSOCIATES XXXX INC. Who notified me on XX/XX/2022 by letter attached as a Collections agency. Pursuant to FDCPA Section 809. I received a request for payment of a debt from SIMM Associates that they indicated my deceased son XXXX XXXX owed them money. I have no knowledge of the debt so I repeatedly requested that they provide documentation to prove XXXX had an account with XXXX XXXX Bank, proof there was a balance, proof that XXXX XXXX owned the debt, and proof SIMM and Associates had the authority to negotiate or collect for XXXX XXXX XXXX or XXXX XXXX. I have been having terrible financial difficulties for a couple of years now and have n't been able to pay off my debts in a timely manner like I used to. For one debt, I have been receiving letter after letter, phone call after phone call from a debt collector trying to collect the debt. That 's OK -- that 's their job and we do owe the money. However, yesterday, the lady from the debt collection agency called the co-signer on one of my loans and berated and harassed him, using mean and abusive language. She even suggested that he put his land and house up for sale or put it up as collateral to help pay off our loan. That is taking it way too far and is absolutely uncalled for. In addition, when they leave messages on our phones, they do n't do what every other debt collector does : say that the message is intended for someone in particular and if the person listening is not the intended recipient of the call then he/she should hang up. Instead, they just start spouting personal information, like the name and the account number of the debtor and then say that it is an attempt to collect a debt. I am appalled by the divulgence of my personal information in a voicemail message.

I have a student loan that was cosigned by my grandfather. Simm Associates on XXXX XXXX, 2015 apparently was attempting to contact one of us reference this loan. The person representing this company left the following voicemail on my parents phone : '' Hi this message is intended for XXXX XXXX XXXX or XXXX XXXX XXXX. This is an attempt to collect a debt and any information obtained will be used for that purpose. I need a return phone call back today. My number is XXXX. Refer to file number XXXX. " Someone from Simm Associates had spoken to my grandfather around the XXXX of XXXX. Apparently the company did not like the information my grandfather gave them so they continue to call looking for me. My complaint is does n't the voice mail violate the FDCP Act? It is my understanding that according to the act they can communicate with a third party by advising who they are and obtain location information. It is also my understanding they ca n't advise they are a debt collector and that I owe a debt.

So, these XXXX hired SIMM ASSOCIATES in XX/XX/XXXX to collect a debt that I don't owe that allegedly originated in XXXX. On XX/XX/18 I received a telephone from a woman stating she was with XXXX XXXX XXXX and that she was attempting to collect a debt. I asked the lady to cease and desist in calling me on my job. She became very hostile and noted that she would not and that upon signing a contract that i have not seen or had knowledge of that she had the right to contact me and that she would continue. She told me that she had a court summons and that she was going to serve it on my job. I asked her again and also told her to contact my attorney. I am under Chapter XXXX currently. About 3 minutes later a man called and asked for the Human resources department. He was given the phone number. About 3 minutes later he called and asked to speak to me and noted that the HR Department informed that he could not deliver a summons on their property and insisted in an angry voice that I give him a home address. I inquired as to the address that was listed and he mentioned a PO box I told him to send it that he noted that he would not and that he was going to serve it on my job whether my company liked it or not. This company SIMM associates, INC were told on XXXX XXXX, XX/XX/2015 .via certified mail, That this account that they are trying to collect on is a result of IDentity Theft. The company who sent them the information ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX had been informed on XXXX XX/XX/2015 that this account was a result of Identity Theft and they sold them an uncollectable account. I received my first letter on XX/XX/XXXX from XXXX XXXX XXXX XXXX saying that I owed my XXXX account {$58.00} and that I had 30 days to pay this amount. I called my XXXX account and they I spoke to an agent named XXXX and he said I did not have any outstanding bills and that he would check into it. I co-signed for two loans with XXXX XXXX for my son back in XXXX and XXXX which he has been paying but lately the restaurant business hasnt been doing well and he got a little behind. XXXX sent me a statement showing that he was past due. About that same time I received two letters from a debt collector called SIMM Associates , Inc. XXXX XXXX XXXX XXXX, DE XXXX saying they were trying to collect a debt. Only thing is they got the account numbers wrong and the amount was a little different then what XXXX showed. My son made a payment to XXXX and got caught up with his payments. I then called XXXX to make sure everything was caught up and they said yes. I then asked them about SIMM debt collections and they said that they had no clue what I was talking about and that they did not send it to collections. They said it was probably a scam or phishing for more information and advised me not to contact them. On XX/XX/2018 I called to attempt to settle my debt with Simm Associates. The agent was polite at first and outlined options for what I could do to pay. I informed her that I did not have the money now, but would have it in XXXX. She was aggressive about me paying, and then attempted to get me to pay some amount today. I informed her that I would need to speak to my wife and see our financial situation before making any such action. At that point, the agent became very rude and used aggressive language " You have a history of making promises and never delivering '' and repeatedly cutting me off, even as I strove to continue being polite and explaining myself. Company states fake phone numbers are " purchased '' by the company, yet they are owned by people not associated with the company. It is called XXXX search. Easy to find out who owns the phone numbers and easy to find out when the phone number is called back that it does not belong to SIMM Associates. I DO NOT ANSWER CALLS FROM NUMBERS I DO NOT KNOW. XXXX XXXX XXXX sent a bill to collections in XXXX of XXXX. They did not process the billing through insurance. A dispute was sent to XXXX XXXX XXXX and the collection agency, XXXX XXXX XXXX XXXX XXXX XXXX contacted me after the dispute letter on XX/XX/XXXX, to state that the insurance would not cover the medical equipment because I was not using the machine. Hello, My name is XXXX XXXX and I am writing to XXXX and SIMM Associates , Inc. regarding a debt claimed to be owed by me. It is claimed I owe {$200.00} when this is not true. XXXX attempted to send funds using a card that I had suspended due to theft and fraud. When they found out that this card was not functioning, they sent {$200.00} anyways and claimed that I owed them this money. XXXX did not consult me on sending funds on my behalf and did so without my permission. I disputed this transaction with them then and I am disputing it now. Through their own internal review of this transaction they still have been calling me and emailing me incessantly to pay an amount they sent without my permission. I do not owe these funds and I want this debt collection case dismissed. There are multitude of class action lawsuits against XXXX at this present moment regarding these issues. Your organization closed this response with the company responded. They responded with giving me a list of dates and amounts not addressing who, what or where.They list an account opened one year past with no activity until a year later whereas within one month there were transactions that were not in chronological order and all within one month amounting to {$2600.00} with no identity as to what was purchased. There is an email address that is not my email and a secondary email address that appears to belong to whoever opened this account. There are ARC activities with no account number or routing number that could identify the bank and individual. All activity occurred a year after the account was opened and was within one month. None of my original questions where addressed regarding this account. Now the two companies XXXX and SIMM Associates XXXX Inc have double their calls and insistance I pay an account that is not mine.

XXXX XXXX XXXX XXXX cancelled my debt with them on XX/XX/2016 and reported to the IRS, so now the IRS is saying I didnt claim that as income. To my knowledge I didnt know it was cancelled because the debt was transferred according to this debt collection agency, SIMMS ASSOCIATE. They started making calls to my federal job and even to HR. I fell into their trap and made a settlement payment of {$8000.00} for them to settle my debt to a lower amount. After making that payment, I had to make a monthly payment for two years in the amount of {$370.00}. I am now finding out that I shouldnt have been making those payments because those payment could be going to IRS since I owe them because of the cancellation of the loan. I received a letter from Simm Associate 's that stated that I owe XXXX for a XXXX account. i called and spoke to XXXX and explained that i never had a XXXX account. i was told that i would need to either pay or call XXXX but not paying would mean that they would sue me and seize my bank account. Then he identified the himself and what company he worked for. He told her the debt and ask what for type of payment for debt. We informed him that we were not able to pay it at this time and to have a nice day with that we ended the call. He called right back and when I answered the phone I asked his name and what company he was working for he hung up on me. I have cosigned for my daughter but am unable to pay the delinquent payment. Simm Associates contacted me at my husband phone number I told them contact me on my cell phone number only. I called SiMM and associates after logging into their portal to pay a debt. The website offered 4 options. 3 payment plans and " decline offer '' When I called them to find out what the offers were, they said I should " just pay them '' that they do not know what the three offers were. Simm Associates, a collection agency, left several voice messages and then sent a letter informing me they were collecting for a delinquent student loan, for which I am the cosigner, with XXXX. This loan is being serviced by XXXX. After contacting XXXX, I was told the loan was NOT delinquent and since the student not graduated yet, it is impossible for this loan to be declared deliquent. The agent at XXXX was very helpful. When I contacted Simm Associates, the collection agency, at the number listed on the letter they sent, I was asked for identifying information such as my date of birth. I have attached details and the letters I am sending today in a final attempt to settle this issue. I have spoken to agents on multiple occasions and I did ask them to stop calling and send me written communications. They are now calling me with unknown numbers and have done so 3 times. Now this weekend over XX/XX/XXXX break they contacted my ex-wife and discussed the issue with her prior to speaking with her father the co-signer. I will submit a notarized and signed affidavit from her if requested. Received numerous calls and messages per day. Agents threatened to go after my mother and her home. Agents threatened to garnish my wages and my mother 's wages. Agents refused to accept that I was unable to pay. They coerced me into liquidating my retirement fund at huge penalties to get them money ( I feared they were going to take my mother 's house ). Representative from company continues to call after several requests from myself and spouse to quit calling. I have asked for a letter of proof of debt and who the owner of the debt is and never received it. They tell us it is a federal student loan when in fact it is a private student loan and they are threatening " federal repercussions ''. A company continues to call my parents home. They have called several times over a span of 6 months. The person from SIMM associates that I was contacted by identified me ( without XXXX stating that it was an attempt to collect a debt ) by discussing a payment arrangement we had made, then reading out to me the last XXXX of my SSN. He then disclosed that it was an attempt to collect a debt - without my telling him any information, only confirming that information which he read to me. I got a call from a number that displayed number with no name with a local area code, the rep made the greeting sound like it was a law firm that was calling. She then voluntarily gave personal information without knowing for fact that it was the person she was looking for. When I pressed who, what company, she was calling for, she hung up.
