On XX/XX/XXXX, I received an unsealed envelope from a neighbor that stated the envelope was in their mailbox with my name on it. My neighbor lives next door and stated they received it on the same day it was provided to me. The envelope was only secured with small metal wing closures without the envelope glue utilized. The envelope contained a Maryland Request for Writ of Garnishment of Property. Of note, there is a time stamp on the Writ that reads " E-Filed XX/XX/XXXX at XXXX. '' Additionally, on the Request for Service, there is a handwritten issued date of XX/XX/XXXX. Moreover, on the front page of the Writ was my social security number, prominently handwritten just below my name and address. My social security number was underrated. On page # 4 of the documents I received, there is a notice that states " PLEASE DO NOT WRIT SOCIAL SECURITY NUMBERS ON ANY DOCUMENTS TO BE RETURNED TO THE COURT. FEDERAL PRIVACY LAWS PROHIBIT THE INCLUSION OF SOCIAL SECURITY NUMBERS IN THE DISTRICT COURT FILES. '' Despite this warning being clearly listed in bold print on it's own page, my social security number was still displayed. On XX/XX/XXXX, I attempted to use my bank debit card while out of town and was informed that my account had been placed on hold due to a garnishment hold. At the time, I had {$2100.00} in the account. The bank stated they received notice of a garnishment the week of XX/XX/XXXX. On XX/XX/XXXX, I contacted the agency Silverman Theologu, LLP, which is working on behalf of XXXX XXXX XXXX XXXX about the Writ. I informed them that I had the right to dispute their initial request but was not afforded the opportunity due to their untimely filings and lack of proper service. The representative, XXXX XXXX, ignored my claim of untimeliness and improper service and stated they had the right to garnishment. I again explained that I was not properly served with notice and that my privacy had been violated as my social security number was listed on court documents. She then transferred me to attorney XXXX XXXX who defended their processing. Once again I complained that my privacy had been violated as my social security number and information was listed on court documents and that the envelope lacked the properly security to protect my private information. He stated that he would speak with my their process service to ensure it does not happen in the future, but provided no remedy for violating my rights. He stated that they were open to working out a payment arrangement and upon agreement, would dismiss the Writ. I was then transferred back to XXXX XXXX to work out the arrangements. We agreed on a monthly payment plan however, they demanded the first payment at that moment. I explained that I could not provide the the demanded first payment immediately because of the hold on my bank account. I asked if they could begin the process so that the bank could release the agreed amount directly to them as agreed. They refused to proceed further and stated that without the initial payment, they would not proceed with an agreement nor will they dismiss the Writ. XXXX XXXX stated I should contact my bank to see if they would release the amount of the agreement in order to proceed. On XX/XX/XXXX, I contacted my bank ( XXXX XXXX XXXX ) to see if they would release the agreed amount directly to Silverman Theologou as we were attempting to secure an agreement to dismiss the Writ. The representative stated that they could not release any amount nor my account until they received an order to do so from Silverman Theologou. I concluded my call and contacted XXXX XXXX to inform her of their request. She stated that the person in her office that could give that permission in writing was not in and to try back the next day. I contacted her on XX/XX/XXXX and XXXX and was told that the person still did not return to work. I called her again on XX/XX/XXXX. During that conversation, she stated that she consulted with someone in her office and that they would not send a request in writing and would wait for the bank to provide account information, which could take up to 30 days. It should also be noted that I have automatic payments, monthly, for this account being paid directly to XXXX XXXX XXXX XXXX since XXXX of XXXX. The most recent payment to XXXX was made on XX/XX/XXXX. When I provided this information to Silverman Theologou, they stated that any payment should be made to them, not XXXX. When asked if they coordinate with records of payments, they stated they do but still had the right to garnish wages. This obviously made me extremely frustrated as my bank account is my primary source of income as the funds deposited are exempted by law, from garnishments. Silverman Theologou violated my privacy rights by exposing my personal information, failed to properly process the Writ, and failed to serve the Writ in accordance with MD rules. Moreover, they have disregarded payments being made to XXXX directly and still improperly obtained a garnishment writ. I find it inappropriate to pursue garnishment when payments are still being made on this account. There appears to be a lack of coordination between XXXX and Silverman.

On XX/XX/2022 Silverman and Theo LLP contacted me through phone and left a message. Not once but TWICE. THIS IS HARRASSMENT. I never gave them my permission or consent to contact me. Pursuant to 15 USC 1692. ( C ) ( A ). A debt collector may not communicate with a consumer in connection with the collection of any debt. According to 15 USC 1681n ( a ) ( 1 ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} Evidence and Proof shows I was contacted on XX/XX/2022 XXXX and a voicemail was left. I was then called and another voicemail was left XX/XX/2022 XXXX. THIS IS HARRASSMENT. THIS IS ALSO A VIOLATION of my Federal CONSUMER rights. Pursuant to 15 USC 1692 d ( 5 ) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number. Who did Silverman and Theo get my private banking information from? Because According to the fair credit reporting act 12 USC 1681. I have the right to privacy. Also according to 15 USC 6802. No financial institution is suppose to share my information to third party people. Silverman and Theo LLP has also violated my Consumer rights through the form of a letter. EVIDENCE AND PROOF SHOWS They have a included their business logo on the envelope of their letter. THIS IS A VIOLATION. Pursuant 15 USC 1692. ( B ) ( 5 ). Not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. This has caused me great XXXX and XXXX and has increased my visits to the doctor as I am a XXXX XXXX with XXXX. Also, in this letter they say that I owe a debt. THIS IS A VIOLATION. Pursuant to 15 USC 1692. ( B ) ( 2 ). Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall not state that such consumer owes any debt. These are clear violations of my federally protected consumer rights. They also failed to date the letter

I was working with a collection agency on a debt of {$2800.00}. I offered a settlement to be paid of {$1800.00}. They submitted the offer and it was declined. During this time, I received a bill of {$2000.00} for a lawyer and found out that my position at work would be decreased. I said that I could offer {$50.00} a month and it would have to be dragged out. The debt collector told me that I originally made an agreement for {$150.00} a month and if I didn't pay it, he would start a legal process on me. He told me if I could afford a {$1800.00} lump payment, I could afford {$50.00} a month. I let him know that I just received a lawyer bill for a divorce and he told me that he didn't care and it was a personal matter. I told him that this personal matter is now affecting my financial situation. Once again he threatened to take legal action and then when I asked for a copy of my signed agreement ( there isn't one ), he told me he was taking legal action. Also, I have asked for a written statement so I know who I am paying, and they have refused. How sad that a woman who is going through a divorce with a husband who is an XXXX, had to sell her house because she almost went bankrupt, and is in the middle of a terrible divorce would receive such terrible treatment. Other debt collectors have been great in helping and understanding my situation.

In XX/XX/2023, I was contacted by Silverman Theologou , LLP by phone that XXXX XXXX XXXX XXXX retained them to sue me for a credit care debt. They claimed they were going to file a lawsuit against me if I did not work out a payment plan with them. I was told to make a payment of {$900.00} by XX/XX/XXXX and payments of ) {$180.00} for 72 months until my debt was paid. I explained to them I had no income but I would try. I was told I would receive documents to my email to sign the payment agreement. I never received anything. I could not make the payment in time and Silverman Theologou , LLP tried to charge my card 72 times and cost me more fees for declining. I contacted Silverman Theologou , LLP and told them I did not have the money. When my taxes came in XXXX I contacted Silverman Theologou , LLP and made a payment of {$500.00} because that was all I could afford, I was told payments would stay the same and that my receipt would be sent to my email as well as the new payment agreement. I never received either. Silverman Theologou , LLP Repeatedly calls me several times a week and has yet to provide me any documentation. I contacted the original debt and they confirmed that Silverman Theologou , LLP was their attorneys but did not provide me any information either.

in XX/XX/XXXX The law office of Silverman Theologue sued me on behalf of XXXX XXXX XXXX XXXX. I was naive and did not use the statute of limitations defense. I asked the Collector was this debt past the statute of limitations, but they stated it was not and I owed XXXX to thier client. They cohersed me into an agreement that I stuck to until I was unemployed during the pandemic. The violation was when I asked for a settlement agreement to keep it from getting into court in XXXX and the collector said that I still owed XXXX and the settlement is for XXXX. I never owed that amount and they charged this account off in XXXX. My understanding is once an account is charged off there is no additional interest that occurs. I asked for this amount in writing and the collector stated no I could not have it. I also asked for a ledger of my payments. I obtained a copy and the amount was XXXX

I paid off a debt directly with my bank 's internal collection agency in XX/XX/2023. I recently received a letter postmarked XX/XX/XXXX from XXXX XXXX XXXX to collect credit card debt from my bank ( XXXX ). The notice looks legit and has a reply form for me to include payment and a number I can call to pay it over the phone. I called the number, and there was no person to speak to ; the initial prompt offer was to make a payment, but as I continued on the line to try to talk to someone, it went on an indefinite hold. The postdate and notice date were a dead giveaway for me, but I wanted to call to catch them.

I have contacted XXXX XXXX after the last response for the CFPB and I could not get anyone to respond to the offers stated in the previous complaints. Several months have passed and they have pursued a garnishment of my wages after attempting to settle the matter outside of court in numerous ways. I have been forced to discuss chapter XXXX options to aviod being garnished. I was told on XX/XX/23 that they will accept XXXX to settle, I am seeking assistance to resolve this matter with XXXX XXXX. I called several days in a row after the last coorespondence and no one would take my call.

On XX/XX/XXXX, the collection agency took funds from my debit card without authorization. Furthermore, I received a call from XXXX XXXX, a rep from the agency, sometime during the summer of 2022. He advised that I owed approximately {$6000.00} in debt. However, I informed him I did not believe I owed that amount and asked for proof of said debt.
