On XX/XX/2018, I, using my Omni Financial ATM debit card ( ending in XXXX ) - that was issued to me on XX/XX/2018, in relation to my having been approved, the same day, for a loan totaling {$520.00}, by XXXX XXXX office of Omni Financial ( of Omni Financial Group that specializes in the granting of loans to retired military members and veterans of the U S Armed Forces ) ; purchased an XXXXXXXX laptop, for anticipated educational training to obtain certifications in various computer applications per the instructions of a job counselor at XXXX XXXX County, Colorado WorkForce Center, along with a pair of XXXX headphones and other items, including but not limited to a laptop bag ( the total cost for which being almost {$400.00} dollars ) from the XXXX XXXX Store in XXXX XXXX, which is situated at XXXX XXXX XXXX XXXX, XXXX XXXX, CO XXXX ( phone number XXXX ). The XXXX laptop, that I purchased on Friday, XX/XX/2018, from the XXXX XXXX Store at XXXX XXXX XXXX, began to malfunction, the same day that I purchased it. I then returned the defective laptop to the XXXX XXXX Store, situated at XXXX XXXX XXXX XXXX, XXXX XXXXXXXX, CO XXXX, two days later, on XX/XX/2018, as opposed to the actual store from which I bought it. As the # XXXX bus, which is the bus that would have taken me closest to the XXXX XXXX XXXX XXXX XXXX Store, doesn't run on Sundays. As such, I opted to return the item to the XXXX XXXX Store at XXXX XXXX XXXX XXXX. Several days later, however, after having purchased the laptop bag and despite my handling the bag with care, one of the small handles unraveled, prompting me to return the laptop bag, as well, on XX/XX/2018. In that I used my ATM debit card and keyed in my pin number, with which to purchase the laptop bag and the other afore-referenced items, from XXXX XXXX ; by any standard, the purchase was a point-of-sale transaction - the same as cash. This being the case, I expected to receive a cash refund, in return. Even so, I was informed by the XXXX female in-store customer service rep, who processed the return and refund, which was confirmed by XXXX XXXX, General Manager of the XXXX XXXX Store at XXXX XXXX XXXX XXXX, when I returned the laptop to the XXXX XXXX Store, that as of two years ago, ALL ATM debit card purchases, due to complaints from numerous customers who SUPPOSEDLY did not want to be refunded in " cash '' from an ATM debit card purchase, but wanted the refund returned to their ATM debit card ; are now refunded in the exact manner that the product was purchased. Meaning that XXXX XXXX no longer refunds cash money for an ATM debit card purchase, according to Mr. XXXX. As such, Mr. XXXX went on to say that the refund, from my return of the laptop bag, would be returned to my Omni Financial ATM debit card, that same day and " should '' appear in my " checking account, within 3-5 days ''. Mr. XXXX went on to say, that depending upon the bank or financial institution that had issued the card ; in some instances, the monies would appear in the customer 's bank account the same day. Because I had doubts about Mr. XXXX XXXX claims, regarding the method of refund and the number of days that it might take for the refund to appear in my checking account, at Omni Financial ; I contacted Omni Financial, the same day, while still inside the XXXX XXXX Store, where the refund transaction was processed, to ascertain if the monies were there. According to the customer service rep, at XXXX XXXX, with whom I spoke, the refund had not appeared in my account, as of yet. Whether Mr. XXXX meant 3-5 business days or 3-5 calendar days, yesterday morning, Friday, XX/XX/2018, six ( 6 ) days after the refund had been processed and five ( 5 ) business days later, after having already contacted the VERY ARROGANT and VERY NONCHALANT-responding customer service unit employees, at XXXX XXXX ( of which Omni Financial is a member ) at XXXX XXXX to confirm whether the {$27.00} had been put back in my account. Having been informed by the customer service rep, with whom I spoke, that that my balance was - {$3.00} ( the reasoning for which the customer service rep could offer no valid or lawful explanation ) ) and that there were " no pending deposits or credits '' associated with my account, including but not limited to none from XXXX XXXX ( for ( {$27.00} ) ; I then contacted Mr. XXXX to ascertain if the problem lied with XXXX XXXX. A short time later, Mr. XXXX, who claims to have confirmed, with XXXX XXXX corporate headquarters, the correct and timely processing of the refund to my ATM debit card, on XX/XX/2018, then emailed me a copy of the actual transaction, including the " acquirer reference number '' ( Please see attachment ) which he verbalized was provided to him by XXXX XXXX corporate office and appears to show the refund having been actually returned to my ATM debit card, on the same day ( XX/XX/2018 ) when I returned the defective laptop bag. Armed with this information, I then contacted Omni Financial 's office, here in XXXX XXXXXXXX, at XXXX XXXX XXXX, XXXX XXXX, CO XXXX, on Friday, XX/XX/2018, during which time I spoke with " XXXX, '' who claimed that she would need to contact Omni Financial Accounts Payable office, in XXXX XXXX, NY office, situated at XXXX XXXX XXXX, XXXX XXXX, NY XXXX, to ascertain what had happened to my refund ; adding that she would call me back the same day. However, as of the filing of this complaint, I have not heard back from XXXX, regarding this matter. During the same conversation, with XXXX, and considering all of the unnecessary hoops through which I was required to jump and navigate, by Omni Financial, here in XXXX XXXX, Colorado, unlike my XXXX counterpart military members and the impermissible long amount of time that it took, just to be approved for the afore-referenced {$520.00} loan, which I received on the afore-referenced ATM debit card, on XX/XX/2018 ; I informed XXXX, yesterday, Friday, XX/XX/2018, that if the {$27.00} refund was not in my Omni Financial account and if I did not have access to those monies, by this morning ( Saturday, XX/XX/2018 ), she should pass on to the Omni Financial 's XXXX XXXX, New York office, that I would exercise every legal remedy, at my disposal, to TAKE BACK the {$27.00} refund, including but not limited to taking the matter into Federal Court. It is now seven ( 7 ) consecutive days, since the refund was processed by XXXX XXXX, and STILL those monies are NOT showing in my bank account ; neither are they available to me and I do NOT have access to them. Accordingly, I ask that this statement, be accepted as my official complaint, collectively against XXXX XXXX, XXXX XXXX and Omni Financial, for FRAUD and for WRONGFULLY and UNLAWFULLY withholding my monies from me, since I am unable to definitively identify which organization is SOLELY at fault. Either way, as a presently-unemployed, honorably discharged, service-connected, XXXX XXXX female XXXX veteran of the XXXX XXXX XXXX XXXX, whose ONLY income is a small monthly XXXX compensation and XXXX retiree check, from the U S Department of Veterans Affairs and XXXX XXXX XXXX XXXX combined ; to be DELIBERATELY and MEAN-SPIRITEDLY deprived of the {$27.00} refund, feels like being deprived of a monetary windfall. This being the case, and in light of these circumstances, it is my SINCERE hope that whichever organization is responsible for the deprivation that I have described ; they be CRIMINALLY and CIVILLY prosecuted to the FULLEST extent of the law.

In finding this the consent order found they were in law violation in the conditioning loans to the service members on repayment by allotment, in violation of the MLA and so forth. I am writing a complaint because in reading this I was not informed via mail or email of the changes obtaining to the allotment and should have been notified of the conditions surrounding the fact to continue with the allotment to be notified and was not. Also with the MLA protection they have illegally charged us at the interest rate that of a regular payment ach should have been and have not abided by that. It states in the finding and conclusion as to omni allotment practice section 7 among these protections the MLA makes it ILLEGAL for a creditor such as Omni during the relevant period ( XXXX XXXX XX/XX/XXXX now time frame ) to extend consumer credit to covered members or their dependents if the creditor Requires them to repay by allotment. 10 U.S.C 987 ( e ) ( 6 ) in this section they have violated that during the time frame given was paying the company back via allotment and therefore violation occurred and paid back an extreme amount of funds which was illegal of them to do. Also section 10 state when XXXX XXXX servicmembers and XXXX XXXX members who are covered members apply for loans from Omni, Omni employees tell the covered members that in order to get the loan they must repay allotmentand that is what was done without informing us otherwise of different payment methods. The next section states Omni has benefited from this practice because allotment system helps guarantee payment on unsecured loans meaning that borrowers who repay by allotment have lower delinquency and default rates. And affected consumers have been harmed in the amount of interest and fees paid because they were wrongfully deprived of the option to pay by means other than allotment. Therefore Omni violated the MLA. So in regards to this they violated and kept myself paying through allotment so they can have the interest rate so high and benefit themselves with the extra funds that they could profit. In section 23 of the conduct provisions it states that Omni may not violate the consent order including by conditioning a loan to a borrower who is a covered member under the MLA on that covered member agreement to repay by allotment or 15 U.S.C 1693k ( 1 ) by conditioning any loan on a borrowers agreement to repay by preauthorized eft. They have in this case violated this notice by still allowing the allotment payments to process through. This was a violation. Also 24. States Omni must contact in writing which may be electronic to each borrower who has a loan with an outstanding balance and who as of the effective date is repaying his or her loan by allotment and clearly and prominently : inform the borrower of this consent order and provide a summary of the bureaus findings and conclusions, inform the borrower that the borrower may choose to repay loan using a different repayment method, list all repayment methods available to the borrower and provide a method by which the borrower may elect an alternative repayment option. This was not informed to myself and therefore violated the order because it states may not draft the bank account of a borrower who has an outstanding loan as of the effective date unless Omni obtains a new authorization to draft the bank account and the new authorization must be in writing, which may be electronic and signed by the consumer. This was not the case no notification via mail or email was given. In section 26 may not accept a payment by allotment without first obtaining authorization that is signed by the consumer to repay by allotment. Such authorization which may be electronic must be in a document that is separate from the loan contract document and any other document and must be clearly and prominently disclose to the consumer that repayment by allotment is optional and that the consumer may change his or her repayment method at any time. This was never notified to myself and therefore they did not follow this section because they have continually taken payments via allotment without my consent since this effective date. Therefore violation occurred with Omni. This company has not only lied and deceived so many individuals including myself but has continued to abuse the system and has not abided the rules and continued to take via allotment without consent and informed myself of this order but is also violating the covered members law/rule since I am qualified and covered and has been keeping the interest rate way above what is legally allowed since I have been repaying this business via allotment since XXXX to present XX/XX/XXXX. I was not contacted in regards to being able to change my payment method and therefore feel they have stole more than I owed since I was not given a choice and was given the maximum interest rate. I had allotment set up to make sure payments were good and they had kept interest rate at just below the maximum 36 % interest rate for the MLA law. But appears that since I had allotment this last was broken and they also violated this consent order. I want to see this issue taken to court because they would lose this case and why they have done to not only myself and to the many others is illegal and messed up. They have taken thousands of dollars to make a profit for themselves to bank on top of the payment that I understand comes out to repay any loan. But this is a military friendly business to serve the military and they have intentionally taken advantage of the service members and myself in this situation and they need to be held accountable for their actions and have this issue not just thrown under the rug but taken to court. I went to speak with the district manager of Omni and informed of this and was informed by him that they did no wrong but all the evidence given shows they are wrong and they are guilty for what they did. Please I urge you to do something about this. They have taken so much and are not taking responsibility for their actions. Thank you

On XX/XX/XXXX, I received a personal loan from Omni Financial of Nevada , Inc. in the amount of {$700.00}. The terms of my loan were that I would pay {$110.00} a month for 7 months by either : allotment through the XXXX XXXX and XXXX XXXX ( XXXX ) or set up Electronic Fund Transfer ( EFT ) through my personal checking account at XXXX. Ultimately, my repayment method was by allotment through XXXX. Omni violated the Military Lending Acts prohibition on requiring repayment of the loan by allotment and the Electronic Fund Transfer Acts ( EFTA ) prohibition against requiring that consumers preauthorize electronic fund transfers as a condition of receiving credit. Omni also violated the consent order that requires Omni to provide notice of the Consumer Financial Protection Bureaus XX/XX/XXXX findings to all customers repaying their loans by allotment. That notice was never extended to me and I wouldnt have known to ask for it. Along with the violations, my first repayment was not to be made until XX/XX/XXXX and my final repayment to be made XX/XX/XXXX. Omni took my first repayment by allotment on XX/XX/XXXX, and two additional payments after my loan was fully repaid by allotment on XX/XX/XXXX and XX/XX/XXXX. I am able to see the XXXX allotment due to my XXXX online account which shows my mid month and end of month pay plus any allotments 7 days before my end of month paycheck. I decided to check that today ( XX/XX/XXXX ) due to the unauthorized allotment on XX/XX/XXXX. The XXXX payment was refunded XX/XX/XXXX in the full amount of {$110.00}. The XXXX payment was refunded XX/XX/XXXX in a partial amount of {$100.00}, I was not made aware of the fact they owed me anything until XX/XX/XXXX, 7 days after the allotment was sent to them. I am unable to get the XXXX payment refunded until after the XXXX as their systems wont receive it until then despite my Leave and Earnings statement showing the future transfer. Omni did not terminate the allotment on their end and never contacted me via phone, e-mail, or my Omni dashboard once the loan was fully repaid to notify me that I needed to terminate the allotment through DFAS if they were unable to do so.

YOUR COMPLAINT I have been actively disputing an account with Omni Financial of Nevada for years. I recently began cleaning up my credit and notice, Omni was still reporting inaccurate information to all three credit bureaus. I requested a verification of debt because I was uncertain the debt even belonged to me with such conflicting information. Recent disputes began in XXXX XXXX. On several occasions via filed disputes, XXXX, XXXX, XXXX and Omni Financial verified the inaccurate data using XXXX and continued to report across all three bureaus. Data provided, did not coincide with data provided through the debt verification. If all three bureaus were receiving different information, this would be impossible. Over the years and especially in the last few months, this willful non-compliance of the FCRA is a violation of my rights. Previous credit reports show Omni was reporting inaccurate data such as high balance, payment amount due, date account was open, date of last payment, amount past due etc. After filing a complaint with the XXXX, Omni Financial updated my credit file, again with inaccurate data. There was even a difference in the amount added to the monthly balance for the month of XX/XX/XXXX across the bureaus. One bureau had an increase of {$100.00} and the others {$100.00}. In addition XXXX and XXXX are reporting a high balance of {$6600.00} on a closed account, and the XXXX is showing a balance of {$0.00}. Instead of correcting the data, Omni, instead chooses to harm my credit file with XXXX, XXXX, and XXXX assisting by validating inaccurate data continuously on my credit file. In addition, when you attempt to contact Omni about your credit file, they say the account was sold to XXXX credit Services, yet Omni is reporting. Please remove from my credit file.

I have been a customer of Omni Financial for years and never missed a payment until XX/XX/XXXX. I wasnt even aware it happened at first but I had an XXXX set up through XXXX XXXX and XXXX XXXX as I am an XXXX XXXX XXXX XXXX Member of 20 years. It was brought to my attention for some unknown reason my XXXX was either stopped or wasnt paid out on XX/XX/XXXX so I immediately resubmitted my XXXX to be in effect right away and it was successful. My XXXX XXXX did show in XXXX XXXX that the XXXX was re-established and payments was active again. We just had XXXX deaths in our family, my mother died XXXX XXXXXXXX and father-in-law XXXX XXXXXXXX XXXX XXXX XXXX XXXX and it caused great hardship on our family. I have had an excellent record in my payment history with Omni and recently was notified I was entitled to check payment due to lawsuit with Omni. I called Omni and asked if it was possible for them to please be forgiving and remove the late payments from my credit and I doubled my monthly payment to {$750.00} to make up for the payment missed by error. They confirmed they received it and we was current now but refused to help assist with the removal of late payments. I am XXXX in XXXX and will be leaving the XXXX and I need to buy a home for us and this is really impacting the loan and even if I have to lease until the late payments are removed it also may impact someone from leasing to us. We will have nowhere else to go. We always lived on XXXX XXXX and dont have rental references. Im praying you can assist us and they will be forgiving and remove those late payment flags on our credit bureaus. I have been a good customer over the years and it was heartbreaking that wouldnt even think of helping us. This company is reporting 14 thirty day late payments on my XXXX credit report for a loan that was taken out on XX/XX/XXXX. On the day the loan was taken out, one of the representatives informed me that I had to sit at one of the computers they have set up in their office and set up automatic allotments to get the loan repaid before I would be allowed to leave the premises with the loan check. As I was XXXX XXXX military at the time, I logged into my DFAS account right then and there and set up an automatic allotment for the amount of $ XXXX monthly. This account was paid every month using this automatic payment. This account was closed in XX/XX/XXXX due to the balance being paid off in full and I even received a refund check as the allotments were still being paid for even after this account balance was at XXXX. I filed a dispute with all three credit reporting agencies as well as the XXXX on XX/XX/XXXX. XXXX about the false reporting of several late payments on this account. On XX/XX/XXXX the company responded to my dispute saying that I missed one payment on XX/XX/XXXX yet they are reporting 14 late payments on XXXX and placed a remark stating " no more than two payments missed '' on my credit report. After continuing to dispute this information, the incorrect payment information was deleted from XXXX and XXXX, but the company failed to remove it from XXXX. Also, even though this account was closed with a {$0.00} balance on XX/XX/XXXX, they reported a 30 day late for XX/XX/XXXX as well as for XX/XX/XXXX. The company reported to both XXXX and XXXX that my payments were late from XX/XX/XXXX-XX/XX/XXXX, three times as late by XXXX days then twice as late by 60-89 days late. I had paid on this loan within the XXXX day mark mid-month and paid it in full XXXX. Originally, this company re [ ported my account current but then when I received the 60-89 days late status to XXXX and sought an investigation, the company retracted my current status ' from XX/XX/XXXX-XX/XX/XXXXas late for all three months, thus prompting me to believe this was in retribution. I paid this on this account XXXX XXXX to cover any late fees and past due balances to ensure my account was not only paid for said month but had enough to be extra careful. Furthermore, I had taken on a new loan late XX/XX/XXXX ; said company is still reporting on my past loan ( the one I was just discussing ) and decided to report my status as 60-89 days late when I have a new loan established. My complaint is as follows : 1. My account balance was current for the months of XX/XX/XXXXand XX/XX/XXXX. 2. My account was not delinquent by 60-89 for XX/XX/XXXXand now, XX/XX/XXXX. The loan was taken from Omni financial of Nevada, in which they have given the debt to a company named XXXX XXXX XXXX XXXX. I spoke with a lady name XXXX XXXX on XX/XX/XXXX, she " stated '' that she has to put a request in for the manager to contact Omni in order for them to send me any statements or a copy of the contract. I was able to get their address which is XXXX XXXX XXXX XXXX, XXXX, NY XXXX. I did follow up on XX/XX/XXXX regarding if they were able to send me the statements and Omni told them " that they are not going to send out any documentation due to me being stationed in Hawaii because it was a personal loan through the Hawaii internet lending '' and they gave XXXX XXXX a " verbal '' of why I owe the money with no documentation. The total amount is {$8000.00}, and the account went into collections in XX/XX/XXXX. XXXX XXXX received the account with a balance of {$4800.00} and they are charging me {$3100.00} in interest and Omni is only willing to settle for {$6000.00}. When I was in the military I took out a loan with omni Financial. I filled out all the paperwork and I also had XXXX insurance on the loan I payed the loan for years and refinanced several times and never been late. I got severely hurt in the military and became XXXX when I was XXXX I told omni they sent me a XXXX letter to fill out and send to the insurance company so they could dis charge my debt. When I called to get help with filling out the paperwork the representative told me I did not have insurance and she did not why the other rep gave me that info I explained to her that I get Inuance on all my debts because I 'm a XXXX and at any point any thing can happen to me. Since XXXX of 2019, we have been struggling to deal with Omni Financial. My husband is XXXX XXXX military and after learning about the Service Members Civil Relief act and the Military Lending act, we realized that our experience with them has been unlawful. Unfortunately, we were taken victim by them several times. Seven in fact, because we simply couldn't pay our bills. Our interest rate has always been at 36 % with them. Which should have obviously sent a red flag from the start. Not only because 36 % is astronomical, but because it is the exact limit that they can charge my husband. Each time we applied, they told us that we had to set up direct deposit from my husband 's check. At the time, I didn't realize that was a violation under the MLA. I have tried several times to contact them regarding my concerns, however it's obvious that I'm being blatantly ignored. The last request was ignored for an entire month until I had time to sit down and call several times in a day. Still I was told that I would receive a response, and nothing. This morning she actually got back to me and tried using the term " obligation '' as a loophole in the law. In XX/XX/XXXX I enrolled in XXXX XXXX XXXX. I included a loan with Omni Financial. In XX/XX/XXXX I contacted Omni and made them aware that I enrolled this debt into the program. I also told them that XXXX XXXX would be the point of contact and they would receive information on this in the mail. There have been several phone calls and threats of calling family members that we listed as references. We contacted XXXX to ensure they were going to contact Omni Financial. XXXX told us that they sent them a letter as well as a power of attorney acting on our behalf. Last month we had this conversation with Omni Financial and stated that they were not allowed to contact our references on our account. Today ( XX/XX/XXXX ) Omni attempted to call my house phone, with a private person 's cell number that I did not know. XXXX XXXX XXXX. Then she proceeded to call my mother in law at XXXX. When I first joined the United States XXXX I received a loan from OMNI FINANCIAL they set up auto payments thru allotments, I was having pay issue which I wasnt getting paid so of course if I cant paid neither can they but this was due to finance department not on my behalf, I recently started checking my credit report and noticed they are reporting charged off account of {$3600.00} with a PAST DUR BALANCE OF {$7300.00} now if not mistaken a account can not be REPORTED PAST FOR IF ITS CHARGED OFF VIOLATION OF FCRA and XXXX .. also noticed that they violated another enforcement by recovering payments via allotment The Bureau is authorized to implement and enforce Federal consumer financial laws, including the Consumer Financial Protection Act of 2010 ( CFPA ), for the purpose of ensuring that all consumers have access to markets for financial products or services and that those markets are fair, transparent, and competitive. I paid off a past due account on XX/XX/XXXX totaling {$1000.00} in preparation of purchasing a home. After I purchased the home in XX/XX/XXXX I later disputed the account the following year and the company updated the account incorrectly having it show that I was delinquent in year XXXX when I disputed it. I disputed the account again and the company updated the account for this year XXXX. The account was first opened well over 7 years ago and should not be on any of my 3 reports. I recently disputed and sent communication copies of emails and letter of explanations I had with XXXX XXXX XXXX XXXX. The account was paid in full and had to be paid in full in order for me to qualify for a home loan to purchase a home XX/XX/XXXX. This makes like my 5 or 6th time trying to resolve this issue. To note : I did manage to make an account online but the loan paperwork nor documents would not download. I have been a customer of Omni financial beginning XX/XX/2019. Since this time I have taken out 2 loans with their company and have made all payments on time. I am XXXX XXXX military and recently applied twice to have XXXX XXXX civil relief act ( SCRA ) benefits applied to past and present accounts in which my interest rates would be capped at 6 %. I provided all necessary documentation in my request including the state references that extend benefits to service members whose home of records fall within the key provision states. Today, I got a message from my dad that XXXX XXXX, an employee at Omni Financial, was trying to contact me from an Alabama number today, XXXX XX/XX/2023. I call back at XXXX EST and reach her. She said she called my references because I was 23 days past due. I explained not to do that because my father is XXXX and will worry. And also explained that I am going through a hardship but will pay on the XXXX. She states that the company had been directed to call several times and I told her thats against debt collection practices you cant even call 7 times in a 7 day period she starts cussing at me saying all types of curse words at me I yell at her back like what is happening I cant believe this?! I have a loan through Omni Financial in an approximate amount of XXXX dollars. The company told me that I had to make an allotment or they would go to my bank and take money directly from my account. Not realizing that the actions done by Omni were illegal my financial adviser seen this allotment and told me to terminate it immediately. As well an employee from Omni spoke to her husband to contact me about paying the loan. around the end of XXXX I revived a phone call from her husband which is my co worker as well.Telling me that I need to answer his wife and pay Omni. I have reviewed my credit report and saw numerous of inaccuracies on my report. Omni financial are reporting several inaccuracies to begin with monthly payment {$170.00} with XXXX and $ 0 monthly payment with XXXX and XXXX. How is it I have a balance due when I had monthly payments of {$0.00}. Also, the balance and past due amount for XXXX is significantly different from the other two credit bureaus. The initial loan taken out in Virginia was made by me in store. There several other loans that were taken out in my name that do not match my bank statements. There are no deposits to my account on dates that have loans taken out by OMNI financial. I spoke to company to try and pull loan documentation they sent me over loan papers that dont even have a signature and some that dont match my signature. The initial store doesnt exist no more so they said that those documents they can not find. I have been paying this loan off for years and should have been done. Omni Military loan reported the same collects twice on my credit. I tried to call them but the call sent me to sunrise bank. I explained to them what happened and they told me they cant do anything about it. I asked to speak with their manager and they told me they cant give me his number only email. I obtained a loan from Omni Financial ( Military Loan ) for {$4700.00}, I could not meet my obligation due to loss of employment. When I contacted Omni Financial to work out a payment plan or alternative agreement, Omni Financial refused to work with me. Omni Financial, XXXX North Carolina, started reporting an old debt that I originally was not able to pay starting in XX/XX/XXXX. On my credit report they closed the original account in XX/XX/XXXX and re-opened another in the same month, placed it on my credit report and began reporting as a charge off every month since XX/XX/XXXX. On XXXX I was given a loan in the amount of {$3700.00} by Omni Financial, I had made several payments since the start of the loan and called to see what my current balance was only to hear that it was still {$3000.00} and change. I asked if there was a way to pay more monthly and was told that the allotment amount couldn't be changed. I was told I had to set up an allotment and have the monthly payment come out of my check every month as the only way to pay back the loan. I came across the Military Lending Act which states " No mandatory allotments. A creditor cant require you to create a voluntary military allotment in order to get the loan. The collection agency claims to have reported the paid off debt to the creditor, yet the creditor insists on not having such information in order to update the credit bureaus. Omni does not provide any loan information as to current balance, interest rates, payment amount for my loan online, nor do they send mailed statements. I have called numerous times with no answer and have not received a call back. I am unsure of any of my loan specific information and do not have access to it. Omni said when I opened up the loan, I was encouraged to setup an allotment. That is what they specifically stressed. They also said if I stopped the allotment at anytime, they would debit my bank account for the amount. I defaulted on a loan with OMNI Financial around 2013. It was a military loan where they take out a monthly allotment. The value of the loan was probably around {$4000.00} at the time of default. Now they charge me an unfair late fee of {$180.00} a month which over 3 years has now become over a {$13000.00} debt. I believe this is ridiculous and unfair for the service member to even attempt to repay. I would be more than happy to settle the loan at the original amount but I m not willing to give into this crazy markup of late fee 's. I had a personal loan with Omni Financial back in 2020. I paid the first loan off and was asked if I wanted another loan. I said yes because I needed the money at the time. The process was quick but there is currently a very high interest rate of 35 % which makes it extremely hard to pay off. They also used an allotment to do so.
