I opened a car loan with Sierra Auto Finance back in XX/XX/XXXX for {$14000.00} and my monthly payments were {$350.00}. After making payments for 2 years, I figured I would review the loan balance and add up all of my payments. Per the payment log of all of my emailed receipts, I decided to request a pay off of the loan to see the progress of my payments. I was hoping to pay my car loan off in full or at least refinance the loan to lower my payment since I figured that I paid a good portion of my loan off. I received the pay off amount on XX/XX/XXXX and it was for {$10000.00}. I was shocked at the amount trying to figure out the math and what happened. I then decided to call customer service back to see if there was a mistake. I got the run around and no one could explain to me what was going on. Everyone was extremely rude and I was treated like I was inhumane. I did not think this was fair and could not believe after all of the money that I paid out over the last 2 years that I was being treated the way that I did. Despite the rude and unfair treatment, I decided to keep making my payments as I needed the car. I even paid a little more or sometimes doubled my payments to try and reduce the loan amount at a faster rate. On XX/XX/XXXX, I got into a car accident. The car was still drivable, but the airbags deployed and I was in need of a new car. So I called Sierra Auto Finance to let them know what happened, hoping to resolve the loan balance in full. This way I would be able to apply for another car. The customer service rep stated that I could give the car back since I did not owe that much on the loan and they would sell the car in auction and deduct the amount that the car sold for. Then they would subtract that from my overall balance. I cleaned and vacuumed the car even though it had been wrecked just to show my appreciation and to make things easier for them. A tow truck came and picked that car up and the keys and thanked me for having the car cleaned. I didt here back from Sierra Auto Finance for months. I never got a new loan amount or a price for what the car sold for. Nothing showing my new loan balance after the deductions. So I just figured that maybe the loan was paid off with the money that they received from selling the car in auction. I even made a payment through the portal as I transitioned out of the wrecked car on XX/XX/XXXX. I wanted to show them that I was still trying to take care of the loan without even having the car. I then hired XXXX to reach out to them regarding this matter because I figured something was not right. I was abruptly and swiftly notified by XXXX that Sierra Auto Finance reported the loan on my credit as bad debt/write off and that I owe {$11000.00}!!! It knocked my score down tremendously and made me feel even worse for trusting and investing in this company. I quickly tried to reach out with no response or way in getting in contact with them. I also leaned in the process that they went out of business as I was trying to file a complaint with the XXXX. No wonder they have a 1.8 star rating and a massive amount of complaints about people going through my same situation or worse. I have all of my receipts of payments, pictures of the wrecked car along with the insurance claim, the pay off requests attempts, and my credit report showing the inaccuracies. I want this removed from my credit immediately because this is not fair or is it best business practices.

For the past 3 months, I have been disputing the inquiries listed below for unauthorizations of pulling my credit reports with the credit bureaus and the businesses that have inquired. I have never given permission, written or oral, to any other these companies. I have enclosed documents that I have received in the mail stating that each individual company was unable to locate any information indicating that particular company made an inquiry on my credit file. I have sent certified letters with return receipts proving they accepted the mail. Again, they have yet to respond with written or oral proof of my authorizations. It shut down months ago. Address listed on credit report is invalid. I received returned mail on the address listed because it was unclaimed. Mail was unable to forward because there was no other address listed to send the letter. Copy of returned mail is enclosed. The listed unverified inquiries have been proven invalid. None of the businesses can provide an original signed agreement or oral recording of my consent giving authorization for them to pull my credit report. According to Section 604 of the Fair Credit Reporting Act Permissible Purposes of Consumer Reports 15 U.S. Code 1681b In general. Subject to subsection ( e ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( F ) otherwise has a legitimate business need for the information ( i ) in connection with a business transaction that is initiated by the consumer. Under 15 U.S. Code 1681i, Paragraph ( 5 ) Treatment of Inaccurate or Unverifiable Information ( A ) In general. If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall- ( i ) promptly delete. Please help me delete these inquiries from my credit reports immediately. I am tired of fighting with the bureaus and businesses about these inaccurate inquiries on my credit reports.

'' A " lemon car '' generally means an auto with defects. Given there are about XXXX components in the average auto, include human error on the assembly line and it 's not surprising that a substantial number of " lemon cars '' are produced. The lemon law was established to protect your consumer rights by providing legal recourse after the purchase or lease of a defective new motor vehicle which fails to meet the manufacturer 's warranty after a reasonable number of repair attempts. If a manufacturer refuses or fails to offer a replacement or a refund for your lemon car, you have the legal right to file a civil action in a court of law. When you win a lemon law case, the manufacturer must : Provide a replacement or a refund Pay the consumer 's costs and expenses, including attorney 's fees The manufacturer can also be liable for a " civil penalty '' of up to twice the consumer 's damages ( usually the price of the defective goods ) State and federal rules are in place to protect consumers from auto dealer fraud when they shop for vehicles. Laws are designed to punish dealerships that take advantage of their customers and deal with deception and unfair practices by dealers. Auto dealer fraud law includes the FTC regulations ( the Used Car Rule ), other federal and state consumer protection laws, and the common law tort of fraud. Many car dealers use financial fraud to sell their vehicles. Car dealers can trick you out of a low car loan rate ( APR ) you thought you had committed to. For instance, you purchase a car and sign for a low APR. A week later the dealer phones and says you did n't qualify for that low interest - apparently the loan you thought you signed was " subject to loan approval ''. Then they ask you for more money and increase your payments. To avoid this scam, do n't finance your car at the dealership. Another trick, called the " Straw Purchase '' happens when the dealer says you have a terrible credit score and need a co-signer. However, the dealer knows your credit score is so bad you would never qualify for a loan. He gets you to find a co-signer for the loan, but in the paper shuffle, it ends up that the " co-signer '' is the actual purchaser of the vehicle. Some car dealers can " forget to pay off your trade-in ''. You trade in a car that you still owe payments on, and the dealer is supposed to pay off the loan for you and add the amount to your new purchase. Then the bank calls : the dealer has not paid off the loan, the car is still in your name, the bank is charging late payments to your credit rating and you have no contract to prove that the dealer said he would pay off the loan. I worked with Sierra Financial to apply for a {$1000.00} short term loan, they contacted me and said they worked with a loan broker. My primary complaint is what was disclosed to me over the phone was not the loan contract I signed for, the following deceptive and predatory lending practices were used to enter into a bait and switch loan agreement. Basically the on the phone consultant told me I was signing up for a short term loan that had a high APR of nearly 240 % which I knew was the case and there would be a {$140.00} finance fee added to the loan balance in addition to any accruing interest. I then asked the on the phone consultant to setup the installment payments to pay off the loan balance in 4 months ( 8 installments ). She said that would be setup and I would see the payments of {$250.00} debited from my account on a biweekly basis and that would pay off the loan. Surprisingly I never received any additional disclosures by phone, email, or mail showing the terms, due date, payment schedule or loan amortization chart. I had requested these verbally. The only notification I received was that the loan was funded. Then I noticed {$250.00} auto debited from my checking account at the same time as my pay period, I assumed this was my payment plan I setup. After two months and approximately {$920.00} in payments were made I wanted to see my loan balance online my balance as of XX/XX/20 was {$1200.00}. I immediately called Sierra Financial to talk about my concern, they notified me my payment had only been applied toward the finance fees and loan extension fee which totaled {$250.00} biweekly. I told them I did not request any extension and only the initial fees were disclosed to me ( not the additional {$250.00} finance fee or how the determine those fees ), and I specifically asked for the payments to be setup to payoff the loan. They then got very rude with me and said that they can not help me and the terms and conditions state payments can not be setup and the full balance needs to be paid to resolve the debt, then they hung up while I was still talking. So I would like for the complaint to be handled and investigated because this company is disclosing false information and preventing consumers from getting full information they need to make a decision.The company has a very bad reputation on XXXX and if I would have investigated them I would have never did business with them, but they contacted me and their potential clients marketing themselves as a different company under a different name, through a different referral sources to trick consumers they are doing business with a legitimate company. I'm not question weather I owe them the amount they stated, I'm questioning the validity of the contract since it was not disclosed and me as the consumer did not get to make a decision on the correct information.

Unfortunately my lack of knowledge concerning loans and refinancing has me in a car loan that is now upside-down. I paid cash for my car 11 years ago. I was asked on XX/XX/XXXX to co-sign/co-borrow for a XXXX XXXX XXXX XXXX, I told the sales manager I was not comfortable with the amount of the finance charge or the length of the loan. As I am on XXXX, and did not want a debt I would normally not get myself in. Amount financed {$15000.00} which includes {$290.00} for the Gap Addendum Waiver, had I known I could get that on my own instead of adding it to the amount financed I would have not agreed to it. And yes this is a subprime loan but even with a co-signer Sierra Auto Finance charged 20.58 % APR making the finance charge {$11000.00} almost as much as the car! After 72 months the total of payments is {$27000.00} for a used car. The manager assured me the loan could be refinanced without me after a year of on time payments, what he did not say was no one will refinance a car that is 10 years old and it was at the end of 9 years when we signed and 10 by the time I found out. On XX/XX/XXXX we went to a car lot and they ran a report and due to a wreck and potential odometer rollback that we were not told of, they offered {$3000.00}! The payment is {$380.00}, but he did not explain that it is a simple interest contract and the finance charge is charged daily from payment to payment not due date to due date, so if you pay 2 weeks before due date and think your ok until next due date, they are going to be charging you finance charge for XXXX instead of XXXX so basically you are screwed. Earlier in that week of XX/XX/XXXX we had signed a contract for a XXXX XXXX from XXXX XXXX, 60 months and {$5000.00} cheaper but Sierra turned that one down but approved the higher priced one. In my contract that XXXX XXXX XXXX XXXX, the company that is servicing the loan now, the one they sent to CFPB, the dealer section is actually from the XXXX not the XXXX. After I found out about not being able to refinance the car I called Sierra and explained the situation and asked if they would refinance and was told they do not refinance their own loans. I have a copy of the sales contract where XXXX XXXX XXXX XXXX, buyer has same last name as CEO of XXXX XXXX, they bought the car from the auction for {$8700.00}, the finance charge is more than that, and I am paying {$27000.00} for the same one that will be 15 years old by the time it is paid off!

I recently purchased a car through a dealership, XXXX XXXX. A few days after purchasing the vehicle the company who financed the vehicle, XXXX XXXX XXXX, called asking about the deal, where I was informed that the down payment XXXX XXXX asked for was double what I was suppose to pay. After clearing up that issue the week continued. After a week of documentations not being handled, returning the car for break issues, coming to the location about 4 times, and calls not being returned, the dealership gave me a call and asked me to come into the location to sign a missing document. When I arrived at the location I was informed that the finance company backed out the deal because of the down payment issue. I was told by the " finance manager '' that it was my fault the company back out because of the down payment issue. After reminding the man that he was the one who told me and my boyfriend, upon signing the contracts, to bring in the additional {$500.00} two weeks later, I asked to speak to a manager in a position over him. He informed me that they ran my credit again without my authorization and I had no choice, but to either pay the new doubled down payment and higher note through another company or give them the car in a few hours. I left the dealership and called the finance company who informed me the truth. The company had backed out the deal because the company sent over a warranty with someone else 's signature not mine. I also declined the warranty upon finalizing contracts when they asked if I wanted the warranty, they still proceeded to add the warranty after I left the dealership, without my knowledge. The finance company did send the warranty part of the contract, with my disclosed information on it. Also, after deciding to go look at other dealerships. I was informed by a few dealerships that XXXX XXXX " shot gun '' my credit everywhere, adding numerous inquiries to my credit. Two dealerships would n't offer to run my credit because of the numerous inquiries. The salesman from XXXX XXXX, then called me and told me to bring in the car his manager is leaving and that " they are doing me a favor. '' The manager would not even speak to me personally when coming in to get a refund. They made me speak to a salesman who never played a part in any of the issues & contracts, who basically tried to make me settle on two more contracts. I denied both contracts and opted to deal with another company.

In XXXX of XXXX my sister purchased a vehicle from XXXX XXXX where originally I was going to cosign on the car, however the sales representative decided my credit was stronger and placed the loan in my name unbeknownst to me. I never signed any documentation or even visit the location and had no idea about the loan until XX/XX/XXXX when I received a call regarding late payments. I explained that I had not financed a car through them and that the car belonged to my sister, I never signed anything so how do I get this handled. I was forwarded over to a supervisor by the name of XXXX XXXX who immediately recognized the signed contracts had been forged because all the signatures looked the same, she forward me the contract and advised to have my sister call in to refinance in her name. I spoke with my sister and she assured me everything was taking care of. I happened to pull my credit report and saw a repossession on my report, I called the finance company immediately and was advised even though she still had the car, because it was repossessed and she retrieved it back it would stay on my credit for seven years I advised them the car should have been removed out of my name and placed in hers because I never signed any documents, I was advised that once she completed the payment arrangement and get back in good standing they would refinance the loan in her name. To date that have not occurred and is still reporting negatively on my credit report. I never signed a contract, I never been to that dealership, I was never told about the loan or the terms regarding the contract and the finance company is well aware of the fraudulent act and did nothing to rectify the situation and continue to report negatively to the credit bureaus. I have contacted Sierra Auto Finance several times over the past year and a half as an attempt to resolve the issue. XXXX representative even went as far as to say, why are you requesting that I send this information? The issue is that none of this was ever received. I have yet to receive any documentation, however whenever I contact for the documentation, Sierra Auto Finance will re age the account and report it as if the account is a new account. They refuse to validate the debt I say I owe. They have yet to produce a contract that shows that I owe them, a full billing and payment history that shows how they arrived at the balance, documentation of who the alleged repossession agency was and licensing, proof that local authorities were located within XXXX hour of recovery, required notice of Deficiency Balance or Notice of Default with timely and proper service for any said repossession, A copy of your notification and proper service of my right to reinstate, prior to the sale of this vehicle/ Notice of Intent to Sale showing proper with timely and proper legal service, Proof that the repossession agency you used contacted me within XXXX hours of the said repossession with proper documentation ( Notice of XXXX ) as well as the inventory list of personal effects, Inventory of items that was in the vehicle at the time of repossession, as well as the manner in which it was disposed i.e. ( proof of disposal ), XXXX. ) Please provide documentation that the vehicle was sold in a commercially reasonable manner. I have asked that this account stop being reported as a new account with updated terms as well. So not only will Sierra Auto Finance not validate the debt. They also are being predatory in their reporting practices. I have also disputed this with XXXX, XXXX and XXXX with no success. Next stop law suit! Contacted this company on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. This is a case where I am not getting the XXXX validated as required by law. Do I even owe this debt? Why is it being reported. This is my last stop before filing suit against Sierra Auto Finance.

I have a car loan with XXXX XXXX XXXX. Admittedly, on occasion, I am late on my payments, usually by no more than 2-5 days, maximum. On several occasions, I have received numerous calls attempting to collect the debt owed. I understand they have the right to call as collections, but excessively? Calling me 18 times in a day, while I 'm at work, is utterly unacceptable after being 1 day past due. This is harassment. On top of the harassment on my own phone line, they began calling my references. I also understand this is the purpose of a reference, however, when calling a reference and leaving a voicemail, in no way, shape, or form should voicemails be left that state, " Hello, this is so and so from XXXX XXXX XXXX calling to get in contact with XXXX XXXX regarding her auto loan with us. Please have her return our call or make a payment at her earliest convenience. Thank you. '' These are REFERENCES, not consigners!! It is against the law for them to inform anyone not financially responsible on this loan that I have an account with them, let alone that I am late on my payment. Once again, this is illegal. The media will be contacted to advise of these unethical and malicious collection practices to steer everyone away from using this company. This has caused extreme emotional distress on my part as I am constantly concerned about how they will depict my image to my references when they 're spilling all of the details of my payments. I am a human. We have all been late on something before, and we have all struggled at one point or another. Why would they want to smear the image of a customer? I feel sufficient compensation for this extreme inconvenience and horrible practices would be to forgive one loan payment. Once again, I will take every method possible to expose this company for these malicious practices to steer anyone from doing business with them if they do not find a way to rectify the stress they have put me under.

XXXX XXXX XXXX has been a big pain!. I've never experienced a negative credit hit and i'm always relatively on time and serious with my payments! My loan has been open since XX/XX/XXXX and each month my bill comes due on the XXXX. Every month I either call in my payment using a checking account or via web to take advantage of a of the free option.On XX/XX/XXXX I logged into their website to make a monthly payment. XXXX XXXX XXXX only provides two ways to 3 ways to make a payment without charging a fee ( i.e. ACH, by mail, and auto pay ) For some odd reason online it kept forcing me to pay a now {$6.00} fee to make a payment using my checking info ( ACH payment ). After several failed attempts to make a free payment i decided to wait til the next day so i can speak with someone about the issues that i was having. On XX/XX/XXXX I contacted XXXX XXXX XXXX to see why I couldn't make a payment for free like I had done the entire time. I spoke with an agent who advised me as of XX/XX/XXXX there is no way to pay free unless its auto pay or by mail. The representative also advised me that management told them to inform us consumers that a letter and email was sent out regarding the update. I advised the representative and spoke with a manager to inform them that they failed to inform their consumers regarding a significant update. I was charged 10 days worth of interest due to me having to mail in a check to take care of my payment. If I had been properly notified, this issue would be unheard of. After speaking with manager, the only thing they could do was apologized for the " inconvenience ''. I have provided proof that on XX/XX/XXXX there website still showed paying ACH as a free option. this financial institution failed to properly notify their consumers of new fees and payment methods. You can not penalize the consumer for this improper conduct

XX/XX/XXXX I financed a blackXX/XX/XXXX XXXX XXXX through Sierra Auto Finance InXX/XX/XXXX, my car was wrecked. After my car was being repaired, I was waiting for rental car reimbursement from insurance company ; the repair shop placed a mechanic lien on the vehicle. During the time, I was waiting for reimbursement from insurance company, I was still making payments to Sierra Auto Finance so I did not think it was an issue. Once I received reimbursement check I went to pick up my car & was told it was picked up by dealership after mechanic lien. I called Sierra Auto Finance to get my car and pay for repair expense, I spoke with someone named XXXX & was told that he did n't know exactly where my car was because it was on it 's way to an auction ; he would try to locate it & call me back. I never heard anything from anyone @ Sierra Auto Finance ever again. I never received anything in the mail via USPS regular mail nor certified letter notifying me of anything such as a deficiency balance letter, Notice of Sale & Right to Redeem, Reinstate Information for Repossession Agency, Notice of Seizure/Inventory List Vehicle Condition Report Proceeds or Sale documentation. Initially it was listed as a repossession on my XXXX credit report, after I disputed the information it was changed to a charge off with a balance of {$XXXX}. XXXX and XXXX are still reporting repossession. I have requested validation through all 3 credit bureaus without resolve.

I bought my car through XXXX XXXX XXXX In XX/XX/XXXX. On XX/XX/XXXX I made a payment of {$200.00}. I owed {$190.00} plus late fees for XXXX payment, and XXXX payment of {$190.00}, I call them and told them the payment was made. They said it was alright and when could I make another payment. I told them another payment would be made on XX/XX/XXXX and that was good with them.Nothing was mentioned to me, and I never received anything in the mail being repo On XX/XX/XXXX they had my car repossessed, when I called them and asked about it, '' They were not very helpful and would not try to explain the reason for this ''. All they would tell me is to pay {$500.00} dollars and I could get the car back. After they told me that making a payment next week would be fine. I called and ask to speak with a supervisor they would not get one, so I talked to XXXX, I got the same thing from her saying pay the {$500.00} to get the car back. She told me {$200.00} was for past due and {$300.00} for repo fee. I also have to send proof of insurance,2 check stubs, and a utility bill in my name for proof of address. I have always made payment arrangements with them in the past when behind and always got it caught back up as fast as I was able. Sierra Auto Finance has been calling me at my place of employment for over a year now. I was ( without my knowledge or consent ) put down as a reference on a loan by an individual that worked with me briefly. I have contacted the company four times to request that they not call me at my place of employment. They have continued to call looking to get a message to this individual. Today I called in reference to their last call ( XXXX/XXXX/15 ) where their agent left a voice message on my work voice mail. When I called and asked for their corporate address the rep I spoke with, XXXX, refused to disclose this information and instead repeatedly asked for my information which I repeatedly told him he was not going to get. I was then transferred to XXXX, a manager, who disclosed the company address but refused to disclose who the current CEO of the company is. I finally gave my work number and explained the situation and she stated she would add the number to filter so they would n't call again. However this is exactly the same thing I was told last time I had to call this organization XXXX XXXX of 2015 ). I find their unwillingness to disclose publicly available information discourteous at best, and at worst fraudulent and deceptive.

I was approved by Sierra Auto Finance, XXXX, TX for a vehicle loan in XXXX 2016. I found vehicle at XXXX XXXX XXXX, XXXX, MI-signed applicable documents, paid my down payment and took possession of said vehicle. XXXXfour days later, I received a telephone call from Law Auto Sales explaining that Sierra is unwilling to fund my purchase because Sierra can not verify my income after both Sierra and Law Auto Sales verified such income prior to me signing the " Retail Installment Sale Contract '' and taking possession of my vehicle. On XX/XX/19 I obtained a copy of my credit report from the three bureaus, listed on the report was a charged off auto loan listed by XXXX XXXX XXXX. I asked them to validate the debt because I know the account had been paid by the co-signer and removed from the co-signers account. I did not receive validation of the debt from XXXX XXXX XXXX. I went on to their website on XX/XX/2019 to find that they have transferred all of their accounts to a new company, XXXX XXXX XXXX XXXX ( XXXX ). I contacted XXXX and was advised by both a representative and manager that they have no record of the account and was given an email address to contact XXXX XXXX because they no longer have a telephone number. The email address I was given was faulty and not accurate. Sierra auto charges their customers over {$100.00} a month if they are over 10 days late ( contrary to how their contract reads ). Their payment system processes their payments as cash. Most major credit cards have a cash limit that does not meet the price of the monthly payment. By having this in place and not working with their clients to change their due date, Sierra is forcing people to pay way more than originally agreed upon.
