Qualified Written Request and Complaint against State Farm and XXXX XXXX XXXX Dear CFPB, Please find my QWR and complaint against State Farm and XXXX XXXX for deceptive business practices and illegal securitization scheme ( masqueraded as " lending '' ) operated by XXXX XXXX XXXX. Most recently I received a {$370.00} refund from purportedly State Farm for my home insurance. The refund actually came from XXXX XXXX XXXX bank, on State Farm 's letterhead which was unsigned and lacked any contact information or identity of the person who prepared and sent to me this letter and the check. I assume it must be done by the accountant/bookkeeper for State Farm. The payment for some reason was mailed directly to me - instead of my faux Servicer XXXX XXXX XXXX, XXXX who claims to receive my mortgage payments and my escrow money. When I contacted State Farm agent XXXX XXXX, he provided me a copy of State Farm ACH ( why State Farm 's ACH and not Sender/Payor 's ACH? ) where some unidentified XXXX XXXX XXXX XXXX sent State Farm {$1000.00} as a payment for my home insurance. There are seven main steps to process ACH payments. The first step occurs when the originator initiates the ACH transaction. The originator can be a bank, business, or individual. In other words, this ACH must be originated by my faux " Servicer '' XXXX or their paying Agent XXXX XXXX XXXX XXXX who poses as Trustee for non-existing XXXX XXXX 's Trust, as confimed by HUD. From there, the bank of the originator will submit the ACH entry. Again, it must be XXXX 's bank - which is XXXX XXXX XXXX. Banks send ACH entries to ACH operators in batches. Each bank has a predetermined schedule for sending these batches. The ACH operator within the network sorts the entries into deposits and payments. Following sorting, the ACH operator sends the entries to the recipient bank. The receiving bank must confirm the originators account has enough funds to allow for the transaction. Finally, the receiving bank either debits or credits the account of the receiver depending on if it is a payment or deposit. Thus, ACH payments have very clearly explained procedure - none of it apply to State Farm ACH. Bear to repeat, when on XX/XX/2021 someone hired some Third Party Payment Company it lacks any corporate identity, even the name or contact information and even operates from someone's home. No other details about this transaction were included, including payment information who sent this payment ( some " mortgage company '' ) or banking information ( from which bank it was sent ) or reference number for this transaction. This Third Party Payment Compnay sent State Farm {$1000.00} on XX/XX/2021 This makes {$450.00} l difference with my {$600.00} due for home insurance posted by XXXX on my escrow account State Farm ( XXXX XXXX ) sent me a refund {$370.00} - which does not make any sense. How this refund was calculated? That is the Reference number for this transaction? That is the name of this " Third Party Payment Company '' and their mailing address and contact information? I demand State Farm and XXXX XXXX to provide me following information XXXX. Name and contact information for State Farm employee who prepared and sent me a refund check for {$370.00}. Please identify this employee 's position with State Farm. 2. Please explain how this amount was calculated if due was {$600.00} and payment was {$1000.00} 3. Please provide full corporate name for Third Party Payment Services ; name and contact information for their employee who send this payment ; and name and contact information for payor who hired this Company and who provided them access to my escrow funds. 4. Please disclosed full financial transaction where exactly this ACH was originated and by whom information as appear in the link on ACH, inlcuidng the name of the Bank where this payment was originated. 5. Please provide me reference number for this transaction 6. Please provide me contact information for XXXX 's and Bank XXXX New York employees who are responsible for accounting and disclose whom State Farm contacts at XXXX or BONY ( or any other party, please identify ) when customers dispute payments. 7. I recently received a credit alert that my credit score was reduced from XXXX to XXXX, and upon further investigation, I discovered that my State Farm XXXX loan was showing 54 days past due. I was shocked, as I had not been contacted by State Farm, and no late notices were sent to me either - if I had not gotten the credit alert, I would have never known. I called State Farm at XXXX on XXXX at XXXX XXXX EST, and spoke to a rep named XXXX, who informed me that my auto debit, which had been in effect for over three years since the start of the loan was stopped due to a bank change on State Farm ' end, which is why payments never came out. He also said that it was a known issue, and that my credit would be fixed, late charges waived and a new auto debit form would be mailed to me. He also advised me to dispute the rating with the major credit bureaus. I immediately paid the late XXXX and XXXX payments as well as paid ahead for XXXX to ensure no additional problems, which was a total of {$1300.00} ( ref ID XXXX ) with XXXX. The funds were always in my account, they just were never debited by State Farm. The call lasted 25 minutes. Once I got off the phone, I processed disputes with XXXX and XXXX. XXXX did not show a late payment, so I was unable to dispute the rating. Today ( XX/XX/XXXX ) I received a notification that State Farm denied my dispute with XXXX, so I called State Farm back and asked to speak to a supervisor and was connected with a floor supervisor named XXXX. He told me that companies ' position now is that I was notified and the credit reporting will not be fixed, which is not acceptable. I also discovered that for my auto loan, they had never updated to my current address, which may explain why no notices ever came to me. However, we have had home and auto insurance ( two vehicles ) with State Farm and have for many years, and have been getting a lot of mail from State Farm- but never anything for the auto loan. In addition, on my online State Farm profile, my auto loan showed my current address. Nowhere on my account online showed the old address. My auto loan was paid as agreed since XX/XX/XXXX, right up to when the auto debit was stopped due to an issue with a State Farm banking change. I see State Farm 's refusal to make things right an unfair, deceptive and/or abusive practice. I am not asking for money or any other type of special dispensation ; I just want State Farm to do the right thing and rate the account paid as agreed with no delinquent payments showing. State Farm 's practice of proactively waiving late fees on accounts affected show that they acknowledge the issue is on their end and adjusting credit reporting would just be an extension of correcting the issue. I took the initiative to fix everything the best that I could, and I expect the same from State Farm. Lastly, I was told that State Farm Bank no longer exists, and a entity named XXXX, XXXX XXXX is who now services my State Farm loan. However, I want to file this complain against State Farm, as the handoff of my loan was apparently processed poorly, which may have led to the issues on the State Farm end. This has been a very poor customer experience for me as well, as I have been on the phone for hours to correct this issue. I was even told on XXXX that it would be corrected, only to be told later that I was misinformed and it would not be.

My vehicle loan has very high interest rate ( 8.14 % ) and very high interest to principal. It was transacted in XX/XX/XXXX with State Farm Bank. Payments were made on time through XX/XX/XXXX. In XXXX, XXXX a two-month extension was approved for financial difficulties. Payments again were made on time thereafter from XX/XX/XXXX through XX/XX/XXXX. Again, during the pandemic in XXXX and loss of 2 jobs, in XX/XX/XXXX, an extension was offered and taken for XXXX, XXXX and XX/XX/XXXX. Payments were resumed in XX/XX/XXXX. Presently, I find it a struggle to make these payments and have been in contact with collections to let them know since early XXXX of my difficulties. I have continued to make payments as I am able but I am in a 30-day late status at this time. During recent efforts to understand where I am, I shockingly noted that on-line statements do not reflect any principal payments made to my account since XX/XX/XXXX and I can not get a satisfactory explanation why all payments made since then have gone for interest only. After several unsuccessful attempts on my part to call to get an answer, My Agent, XXXX XXXX, then got involved and attempted to a have loan support supervisor call me back and explain line by line explanation for each month on the loan starting XX/XX/XXXX and running through the present : Beginning balance Payment made Payment applied ( principal, interest? ) Fees charged. We both requested this on Monday XX/XX/XXXX, and requested a return call no later than 48 hours after the formal request. It is now late in the afternoon XX/XX/XXXX and I have had no return phone calls. They sent the agent a print out that looks exactly like the on-line statement, which the agent suggested was not intelligible. ( attached ) I believe this is a predatory lending practice and I certainly did not know or understand that past the extension for Covid relief, I would not be gaining any ground by any of the {$740.00} payment applied to the principal. Consequently, I am now underwater on this loan and can not sell the vehicle to repay this loan. It seems to me that the " relief '' offered for compassion during a pandemic became a way to rip me off with an already high interest rate. Within the last 2 years, I tried to refinance this vehicle loan with State Farm but was turned down on my request.

I refinanced a vehicle loan via Statefarm Bank in XXXX of XXXX. I paid off my vehicle loan in XX/XX/XXXX. Despite placing over XXXX calls with customer service representatives of Statefarm Bank over the last 2 years, I have still not been issued an electronic title release to the state of North Carolina in order to receive my vehicle title. I have confirmed with the North Carolina DMV that the title is showing held up in their system & can not be released with a paper lien release. Multiple DMV employees have stated that they must receive an electronic lien release from the bank in order to issue my title. I have placed over XXXX phone calls in the last 6 months to Statefarm Bank communicating that the NC DMV must receive an electronic title release. I do not have records of every call, but most recently I have placed calls on the following dates : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. Additionally, when I have asked to speak to someone in the Titling department at the bank, I was advised this department does not have a phone number, email address or any way for consumers to make contact. I have been promised that I would receive a call from the Titling department on several occasions ( most recently on XX/XX/XXXX ) & have never once received any communication from this department. The only thing I have ever received since paying off the vehicle has been several paper copies of the lien release via mail, despite clearly communicating to the bank that the DMV will not accept paper releases and must be provided an electronic release. My most recent call on XX/XX/XXXX, the representative I spoke with, XXXX, advised that there is no update from the titling department. They have told me for the last month that the Titling Department is pending communication with the DMV regarding this issue. We have heard this several times over the past year with no resolution. It is clear that the bank is not taking my request seriously and have made it impossible to make contact with the appropriate parties which should be able to solve the issue. Consequently, I am unable to sell my vehicle because I can not receive a title. Please let me know if you need any further details. Thank you!

I got used car auto loan from Statefarm on XX/XX/XXXX of XXXX and I have been paying on time via auto payment and all of sudden they transferredmy loan to another entity name called XXXX XXXX and it turned out to be same company of Statefarm but they changed a different name of company on XXXX I don't know which month they changed because I was out of country at that time and when I came back to the state, I noticed that there was past due 30 days marked on my credit report and I called them and explainedmy situation and they said they sent a letter to my home but I haven't received any letter from them and I didn't receive any email or phone call include text message from them while I was out of country and I told them that I haven't received any notification and this is not fair because I never changed my contact information and my auto debit bank account but they said it's a different company so they don't have any control so they were not be able to help me on this case. After that, I logged into the Statefarm account and it's about the same platform and I did make a payment through the system. Basically same Statefarm but they did change a company or I don't really know what happened and what was the intention of doing this but this is totally unfair because I haven't received any notification of this and everything is the same never changed on my end and they did post 30 days past due on my credit without saying anything to me. Totally unfair behavior and not acceptable in this matter. That's the reason why I am reporting to you on this matter. The loan is paid off now because I don't want to use service from them but that 30 days past due mark still remains on my credit report so I would like to ask you to help me in this case. I never have missed any payment in my life including Credit cards and Loan entire my life. Please help!

Thursday, XX/XX/XXXX - That morning I was unable to find my car. I called 911 thinking it was stolen. Come to find out it was repossessed by XXXX XXXX ( EMVLP , LLC ) I called my State Farm Bank and they informed me they are now with XXXX XXXX. I was never made aware of this change and they stopped my auto payment. Therefore I did not realize I was missing payment as it was never brought to my attention. The loan servicing agent said they do not leave a message by phone as it is an automated message and the mail was sent to my previous home address. I paid the full amount owed ( {$2000.00} ) the same date I was made aware ( XX/XX/21 ). I find it strange they were able to find my car at my new address and not mail the warning to the same address. I called my State Farm agent the same day XXXX and they requested me send them bank statements of my autopayment as they found it strange that the autopayment would stop with no warning. I gathered all this new information on XXXX ( State Farm Bank transferred to XXXX XXXX ). Why did the autopayment suddenly stop. I went through the protocol and wired {$2000.00} to final retrieve my car the next day. I called XXXX XXXX today XX/XX/21 and asked if they could send me the autopayment paperwork so I can properly fill out. I have never missed a payment and only have {$6700.00} left to pay. The funds were there but XXXX XXXX ( EMVLP , LLC ) / State Farm stopped the auto payment with zero warning to the customer.

I purchased a car through a small dealership and StateFarm financed my loan. I've been paying the loan and insurance for 3 years now. Back in XXXX, my car engine mount broke due to a pothole. I look my car to XXXX dealership and submitted an insurance claim. The adjuster went there and looked at the car and said it had all these prior damages years ago before I got which made it a salvage title car so insurance wasn't willing to pay for my car. I then begin to check my statefarm documents because on my credit account it had a different vin that wasn't my car. XXXX proceeded to send me my loan agreement in the mail because I was curious due to the fact they don't finance salvage-titled cars. There it was on my loan promissory agreement it had the incorrect vin. My agent committed fraud so the deal could go through. I believe this is due to the fact one or two things weren't messed up about the vin it was a whole completely different vin and it's to the same make and model as my car down to the color. So yeah they definitely committed fraud to make my deal go through. I told specifically that a resolution I want bare minimum was to have my loan cleared because they were trying to just change vin to correct one. I'm like that doesn't work for me because my car is salvaged it was never supposed to be financed y you guys in the first place. My StateFarm agent was there at the dealership with me he inspected the car and all.

This is to reference State Farm Bank also EMLVP, LLC as the loan originator for my RV trailer. I had called in XX/XX/2022, XX/XX/2022 and XX/XX/2022 to check on terms to Voluntarily Surrender my trailer. I was mailed via USPS a form and I diligently faxed it back after I had spoken with a rep from State Farm Bank for over an hour and a half making sure I was clear on the terms I received a Fax successful so I knew that it had been received. I called today to check status as a rep never called within the 10 days the form and rep said would happen today after seeing a 90 day late payment status on my consumer credit report I called State Farm Bank and was told, The image was distorted so they couldnt accept it. I replied, No one could call or follow up on this matter? Rep did apologize as I am sure it wasnt his direct fault. I had assumed since I gave instructions initially on address phone and all pertinent contact info that the RV had been picked up since it wasnt being used and in possession of my ex husband in XXXX. ( I have since relocated to XXXX ) and no longer communicate with him. I stopped making payments as directed. I am frustrated with the lack of communication and honestly believe it is an unfair and unethical business practice. I want the negative payment status on my credit report removed as it shouldnt be reflected this way. Also, I am contemplating if I should seek legal council on this matter.

I am writing to dispute a declined bank error late payment on my car loan account with EMVLP , LLC. I have never made a late payment on this loan or any other loan in my credit history. The late payment was caused by a bank error, and I have proof that the payment was made on time. On XX/XX/XXXX of XXXX, I made a payment of {$320.00} to my car loan account. I have attached a copy of my bank statement showing this payment was processed and deducted from my bank account on that date. However, for some reason, EMVLP , LLC did not receive the payment, and as a result, it was marked as late on my account. I immediately contacted EMVLP , LLC to resolve the issue and sent a letter disputing the late payment. However, my dispute was declined, and my credit score has been negatively impacted by their mistake. I have always been a responsible borrower and have maintained a perfect credit score until this incident. I am requesting that EMVLP , LLC remove the late payment from my account and correct my credit report. I have provided proof that the payment was made on time, and I believe that their mistake should not be allowed to damage my credit history. Thank you for your time and assistance in this matter. In XX/XX/XXXX I applied for an automatic monthly payment plan authorization with State Farm Bank. I followed up with a telephone call and learned from State Farm Bank that the authorization was received. Statefarm held my car loan which was paid off by me in 2021. I never received a lien release certificate from them. I am trying to sell the car now in Washington state and the dealership requires a lien release. Statefarm after contacting them multiple times has not endured that I received the lien release so that I can sell the car. As per statefarm they mailed the lien release on XX/XX/XXXX and until XX/XX/XXXX I have not received any documents and they are not even sure if the document has a wet signature when I called them on XX/XX/XXXX.
