We have been attempting to pay our monthly condominium fees XXXX to XXXX XXXX XXXX XXXX. The payments for 5 months keep being returned. We emailed the management company, and delivered a letter to the Board of Directors by certified mail, and have been ignored by them ( a direct violation of the Ethics Code for being a Board member and fiduciary duty ). We finally sent emails to the officers of the management company, and received a reply from the president, XXXX XXXX. He informed us that our payments were being returned because we had been placed " in Collections '', and our payments had to be made to the association 's Attorney. The association Attorney, under VA 's Civil Code, is required to inform us, in writing, by certified mail, that we have been placed in Collections. We have not had any response or communication with the management company office since XX/XX/2020 despite emailed requests for information ; and we have received no information from either the Board or the Attorney, by email or letter, let alone a certified letter. We have continued to make our payments by XXXX -- several times a month -- but they continue to be returned. Our condo unit will need to be sold as part of an agreement for the VA loan program for our current domicile. We think the Board and the Attorney are attempting to falsely foreclose on the condo unit, or to hold it hostage for fraudulent collection charges. This is not the first time the Board or the Attorney have acted in an underhanded manner with unit owners. We can not do anything and can not verify anything. We can provide receipts of our payments showing we are current in payments -- if they would be applied when received and not returned to us. If we were put in collections some documents need to exist -- including a proof of certified mail received by us. We can not obtain proof of anything : not when this collection started, nor for what amount, nor proof of certified mail sent to us. We do not know what we should pay and to what address. We asked disclosure of our financial situation for our account repeatedly, by certified mail and emails and we have not received it. We have the receipt of our certified mail sent to the Board, and emails to prove our efforts. We are kept in the dark and, despite our payments, our account is unpaid now for as much as 5 months. And, apparently, we are in " Collections ''.
