Received a phone call from my mother stating that some contacted her pertaining to a legal matter and wanted to meet me jn person. I returned the a message o my phone from the same person who answered the phone " hello ''. I told them i was returning a call and he said my name then started asking personal questions. I interrupted him and stated I would give no information without verification of who he was. He mumbled " SCM '' a few times before i asked him what " SCM '' was. after a few times of asking he told me Secure Capital Management. He asked when the best time would be for me to be home and meet someone who would be delivering me certified legal papers for me to sign. He then went in to give supposed details of the balance owed, to whom, the date opened, and what he could settle it for. I told him I would contact my legal counsel and they could deliver the paperwork to him. He stated he had to have this taken care of by end of business today or they would go forward with garnishment and court proceedings. I let him know that it would cost them way more to take it to court than the little {$390.00} balance I was to supposedly owe, all I want is official paperwork proving the debt. I told him I would need confirmation of a debt owed and he stated that its legit and would be on me to prove its not because all my personal information was tied to it. I told him I had no problem paying the balance if I received paperwork or something showing this debt owed was true and the company was real, I explained to him I was not handing my personal information over unknown if it was a scam or not because how he answered the phone and with never receiving a bill or phone call prior to this date. He stated that he would send me an official email but I had to call him back within an hour so he could follow up with the clients for further legal action if needed and I ended the call. He never relayed to me that it was an attempt to collect a debt and any jnformation would be used for that purpose. I confirmed with original debtor that there was an outstanding balance and did call the company and spoke to another staff to pay the debt. Debt was paid but he did relay the information I requested from him that the original staff name was XXXX XXXX who gave out my information without ensuring it was me, did not tell me that this was a call to collect a date, and that was dishonest about it having to be finished today or court proceedings would begin. Can theh call and tell you to set up a time to have someone meet you to sig for certified legal paperwork? I thought court papers would be mailed certified amd signed for through XXXX or delivered by county sheriff and signed for through them.

Below is a copy of the compliant submitted to the XXXX : Complaint Type : Consumer to Business ComplaintNature of complaint : Billing or Collection IssuesProblem description : I received a call from XXXX XXXX at XXXX, on XX/XX/XXXX, stating that I owed a balance of {$510.00} to a payday loan company. I asked him for the name of the company and he indicated they act on behalf of multiple companies, XXXX of which was EZ ***** which I have done business with. He never mentioned to me that this was to collect a debt per the FCRA. They indicated that they had attempted to serve me papers on a number of occasions and that they are going to begin the court process to collect funds. I have never received any such attempt notifications or paperwork regarding this debt owed. As I have done business with that company, I agreed to a payment plan of {$25.00} every two weeks beginning on XX/XX/XXXX. My final payment would be on XX/XX/XXXX. On XX/XX/XXXX, this company ran my debit card for {$28.00}. I notified the above individual and after giving him my name, he proceeded to tell me that they needed updated payment information. HE BEGAN TO TELL ME INFORMATION ON ANOTHER INDIVIDUAL and had no attempt to verify who he was speaking with. He told me a letter was mailed out on XX/XX/XXXX stating that due to a change in payment processor, the amount was increased. I never received such letter. Told him advanced notice must be given when the is a change to an agreement and he could only say that this was a 'last minute change '. I have worked in banking for 13 years and something like this is never last minute and notices MUST be sent out. Desired Resolution : Other ( requires explanation ) Desired OutcomeBilling adjustment - I was never appropriately notified that there was going to be a change to the amount of the agreement. Contact by the business - would like to receive e-mail communication from company regarding my agreement. Apology - official apology for the lack of communication

On XX/XX/XXXX around XXXX PM eastern time I received a call at my place of business/employer from a man name XXXX from Secure Capital Management advising that he is calling to collect debt or a court judgment will be place on my behalf. XXXX XXXX from Capital Secure Management stated I owe {$1700.00}. He stated XXXX XXXX XXXX is taking legal actions on my behalf due to me financing furniture with a mattress company in XXXX, FL. I asked XXXX XXXX if he can give me more information because I was never aware that I owed XXXX XXXX XXXX money. He proceeded to say I dont know, I am just calling because your file was forwarded to us and we have to take action I informed XXXX if this is true this XXXX XXXX XXXX needs to be investigated because when I financed with them back in XXXX I authorized XXXX XXXX XXXX to have my account set up for automatic payments monthly, XXXX then advised me that only XXXX payment was received and the rest of the payments could have bounced back due to low balance on my bank account. I informed XXXX that if this was true why I didnt receive a call from XXXX XXXX XXXX advising me of this issue. I explained to him I never got a phone call from them or a letter advising me of this. He then stated He doesnt know why this wasnt done on their behalfs then attempted to work out payment plan with me and was very adamant that I have my debit card on file with him even though I advised him I am unable to make a payment until Friday, XX/XX/XXXX. He stated he will not charge my account until Friday XX/XX/XXXX, but he needs to have it in file to start the process. I informed him I can not do that and requested he contact me today XX/XX/XXXX at XXXX ( XXXX ) to discuss this further. I am aware of my rights and aware that contacting my place of business or employer to collect a debt from XXXX is ILLEGAL.

I have been receiving harassing phone calls from Secure Capital Management , Inc. They are calling on behalf of a pay day loan I am not able to pay back. I spoke with the loan company a couple of months ago and told them of my financial hardship. XXXX called me repeatedly back to back yesterday at XXXX, XXXX, XXXX, XXXX, called my friend and my job. He verified my contact info and address. Shortly after he threatened me saying an officer is coming to my home to serve me and I will have to appear in court. I told him ok and he asked for my address again saying he did n't have it and needed it to give to the officer. He connected me to XXXX to make payment arrangements on yesterday to begin payment on XXXX XXXX, however, XXXX XXXX, an employee of SCM, called me today at XXXX and XXXX asking for my payment info. I understand I have a debt to be paid, and if I had the money I would surely do so. I am working on reduced hours due to cut back and I simply just do n't have the money

I received several phone calls from XXXX XXXX stating that I owed XXXX XXXX and he was wanting me to settle this debt before they end out a summons to take legal action against me. I informed XXXX that I paid my loan and that I have the document to prove that the loan was paid. He asked me to email the documents and I refused and asked for his address. He gave me a XXXX. XXXX. He continues to call and demand payment and has stated that the loan must have been sold and that I had additional payments to make. The loan amount he stated is not what I paid and the loan was paid over 1 1/2 years ago.

Representatives from SCM ( Secure Capital Management ) googled me ( I 'm assuming ) and contacted my dad 's wife and left a voicemail that had my last XXXX of my social and a threat that if I did n't call them back they would show up at my job. There was no way they could 've known she was affiliated with me and there 's NO reason to leave my name and the last XXXX of my social on a voicemail of someone who could 've been a complete stranger and done something with that information.

Documentation of loan payment was located Threating summons requests to non-associate addresses and other untimely Harassment including places of employment.
