Under the Fair Credit Reporting Act, XXXX XXXX XXXX and Schreiber/ Cohen LLC , & Schreiber Law, have violated my rights. Ultimately, violating the law under the FDCPA which I will provide evidence to support my claims herein. On XX/XX/XXXX XXXX XXXX XXXX & Schreiber/Cohen LLC ( LAW ), won a default judgment without hearing, against me. The small claims writ and notice was sent to my sisters ' address in XXXX XXXX where she resides with her daughter who would have been approximately XXXX years old at the time. The statement of service says it was left in the mailbox. I never received the small claims writ and notice to provide an answer to it. However, in XX/XX/XXXX I was alerted to a credit collection discrepancy. Immediately I sent a Cease & Desist to XXXX XXXX XXXX. Furthermore, in my document I expressed only a desire to work with my original creditor over the alleged debt. A point worth mentioning, in the letter I explained I have no clue who the original creditor was. Lastly, the letter sent to XXXX XXXX XXXX was accompanied by a validation of alleged debt request. My request was ignored entirely. On XX/XX/XXXX I filed a formal Cease and Desist against XXXX XXXX XXXX utilizing the Consumer Financial Protection Bureau. Another point worth mentioning, I did not realize that there was a default judgement against me at that point in time. Moreover, in my CFPB complaint this is evidenced as I did not mention Schreiber/Cohen LLC ( LAW ). Unfortunately, I did not realize until I received a response from Schreiber/Cohen LLC ( LAW ) & XXXX XXXX XXXX that I was sued and lost by default thru the CFPB response given. Today I have discovered that XXXX XXXX XXXX and Schrieber/ Cohen LLC ( LAW ) have filed a wage execution against me naming my employer as debtor. This comes after XXXX XXXX XXXX & Schrieber /Cohen LLC ( LAW ) responded to the CFPB that they would Cease & Desist. On XX/XX/XXXX I would receive thru the CFPB a response from a XXXX XXXX XXXX an encore capital group company document. The document lists my original creditor as XXXX XXXX and an XXXX XXXX XXXX. It also includes and XXXX #, an original account #, and a case #. XXXX XXXX XXXX & Schreiber /Cohen LLC ( LAW ) have violated my rights under the FDCPA in the following ways noted below herein : They were deceptive and engaged in misleading representations when they communicated to me in their response through the CFPB ( Exhibit A document ). In which they did not clearly state the identity of the current creditor to whom the debt is owed, in violation of 15 U.S.C. 1692a, 1692g, and 1692e. In document labeled Exhibit A I have no idea whom is actually the original creditor. Not to mention I am still confused about who I have been sued by. The letter says " we became the servicer '' but I have no clue as to who the servicer is or what that means. Is the alleged debt with XXXX XXXX XXXX, XXXX XXXX, XXXX, Schreiber/Cohen LLC, Schreiber LAW LLC, XXXX XXXX XXXX, XXXX XXXX XXXX, or XXXX?. They did not adequately inform me as to the identity of the current creditor to whom the debt is owed. As a matter of fact, on the last page I am instructed to make my payments to Schreiber/Cohen LLC ( LAW ). As can be seen, document Exhibit A XXXX XXXX XXXX & Schreiber/Cohen LLC ( LAW ) are deceptive, misleading, and engaging in unfair debt collection practices. This document is subject to more than 5 interpretations which could all be wrong. Exhibit A is misleading as a matter of law. Lastly, I want to make clear I was served a small claims notice at the wrong address. The default judgment took place in a court not of my jurisdiction. According to the response submitted to the CFPB the XXXX XXXX statement has an address for XXXX XXXX. The address listed is not my sister 's address in XXXX, XXXX where the small claims was sent. If the mail is not sent to the correct address, and if the correct address is known, the rule is clear. Service by publication and mailing requires that the mail be properly addressed. What is clear is that XXXX XXXX XXXX & Schreiber/Cohen LLC ( LAW ) certainly knew how to locate the address of my employer. I certainly could have been served through my employment originally. They have demonstrated they know how to find me. Evidently, from day one they knew how to contact me and I believe had no intention of serving me properly. If I can not defend myself, this is their default win. When I make the reference " their '' this is because I have no clue who has actually sued me. This also is a violation of the FDCPA. I will be forwarding this letter to my Connecticut Attorney State General XXXX if need be. I will also be attaching this letter with a wage exemption execution claim form as well. In closing, for the very last time, I want to formally request a Cease & Desist. Under the provisions of Public laws 95-109 and 99-361 known collectively as the Fair Debt Collections Practices Act I formally notify you : Schreiber/Cohen LLC, Schreiber Law LLC, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, and XXXX to Cease & Desist all communications with me in regards to this alleged debt or any other debt you allege that I owe. Please be advised that if collection attempts continue after receipt of this notice I will notify my State Attorney General 's office and the Federal Trade Commission. Additionally if I am contacted again after receipt of this notice, I will pursue both criminal and civil claims against you and your company for violations of the FDCPA. Please be aware that going forward, after I have confirmed your receipt of this notice, any communications from you or your company may be recorded to be used as evidence of my claims against you. Also be advised that any negative information appearing on my credit reports pertaining to this account will be handled with the full legal rights and remedies available to me with regards to current consumer protection laws. I will be providing the CFPB with documentation in which there is no possibility that other parties mentioned will have any difficulty in identifying me should that be an excuse for not responding.

Under the provisions of Public laws 95-109 and 99-361, known collectively as the Fair Debt Collections Practices Act ( FDCPA ) I formally notify Schreiber Law , LLC and affiliates to CEASE & Desist in all communications with me in regards to an alleged debt with XXXX or any other debts you allege I owe. Please be advised, that if collection attempts continue after receipt of this notice, I will immediately file a complaint with the Federal Trade Commission and the Connecticut Attorney General 's office. Additionally, if I am contacted again after receipt of this notice, I will pursue both criminal and civil claims against you and your company/firm for violation of the FDCPA. The emotional distress, anxiety, and frustration that I am suffering from due to your firms intimidating and constant contact DURING a PANDEMIC is beyond words. On XX/XX/2020 I submitted to the CFPB a complaint about Schreiber Law , LLC and requested that they CEASE & DESIST. Schreiber Law , LLC responded to the CFPB that they could not confirm who submitted the claim. Moreover, stated they would send a response directly to the consumer. In brief, my cease & desist request was ignored again and case was closed. In light of this firms response it begs the question. If Schrieber Law LLC, could not confirm who submitted the claim then how is it in their owns words to the CFPB do they respond by stating they will contact me directly? I will enclose Schrieber Law, LLC 's most recent letter sent to me. I am in the hopes that the CFPB will take note of this deceptive and misleading letter sent.

I supposedly had a debt from the early XXXX in which this company Schreiber Law LLC XXXX XXXX XXXX XXXX XXXX XXXX, NH XXXX phone number listed is XXXX is claiming I still owe and they are collecting from a credit card company. The debt is so old I dont even remember owing it. Next thing I know I was taken to court for a debt that is over 20 years old I panicked in court because I felt intimidated and agreed to make payments on the debt that I was told I would get all the information on the debt which this company still has not provided. Ive paid over {$400.00} on the debt but my balance is still the same it never goes down and Ive made several attempts to contact the company but never can reach a person Ive left several messages but still do not get a response. Ive contacted them to ask for the proof I was told I would receive to prove its my debt and calls and messages go unresponsive. I have recently lost my job and contacted them and actually got a live person for once in my life and explained to them the whole situation that I never received the proof and my employment situation was then told my agent would be told and would be in touch now Im getting letters stating action will be taken for non payment even though I spoke to someone and explained my situation. Now I am feeling like this company is a scam because they never call me or send proof of the debt. I was told after so many years the debt can not be collected. They take my money but the debt amount is still the same after paying on this for 2 years. No one ever answers the phone and I feel this is a scam. I ask for answers and proof of this debt but dont get anywhere but I paid because I was afraid I would go to jail because I did agree to pay in court. This debt isnt even on my credit report so I am in desperate need to know what the next steps are for me I need answers and help to figure out if this company is even legit. Please help because I dont know what else to do.

The credit collection for my XXXX XXXXXXXX credit card account was bought by Schreiber Law LLC- XXXX XXXX Attorney at Law who violated Federal and State Statutes trying to collect a debt by the following : They had me served a false small claims district court complaint veiled as legal legitimate court paperwork without a docket number by a XXXX XXXX XXXX XXXX XXXX XXXX when No such documents were actually filed at XXXX XXXX district court both actions are considered against the law under the unfair debt collection acts in the Maine Revised Statutes Annotated & United States Federal Code via false representation of legal action and the intimidating use of a legal court officer sheriffs deputy by being served papers to intimidate me that werent actually filed with the court and do not have a docket number listed on the forms. The deputy XXXX XXXX who served me papers first left his card on my door Friday XX/XX/2021 noting he was here to serve me civil paperwork as the reason for his visit. I then texted with him 4 times he wouldnt disclose any information over the phone which had me wondering and worrying until i got served by him on monday XX/XX/2021. I have all the false court documents and discovery paperwork with my personal information relating to the account, deputy XXXX XXXX business card with handwritten date and his phone number with text messages as proof of these deceptive and false representation debt collection practice acts and violations of the XXXX and XXXX [ ch 109-A Title 32 Chapter 109A Subchapter 2 section 3 subsection I ] stating the violation of unfair practices by using or employing any officer authorized to serve legal papers in the collection of a claim I also printed out the statutes and highlighted each section that could apply to my unfair and deceptive collection acts violation claim against Schreiber Law LLC located in XXXX, Maine.

I had received paperwork by mail in XXXX XXXX regarding a debt owed, and this company Schreiber, Cohen LLC was the firm hired by XXXX XXXX XXXX XXXX to collect via State of CT Superior Court small claims. I filed chapter XXXX bankruptcy on XXXX/XXXX/XXXX, XXXX was included on the bankruptcy petition, and notified. Schreiber Cohen LLC was also notified of this action. The bankruptcy was discharged on XXXX/XXXX/XXXX. I received communications from State of CT Superior Court regarding this case on XXXX/XXXX/XXXX, it was a notice that a hearing was scheduled for damages on XXXX/XXXX/XXXX XXXX. I contacted the clerk on XXXX/XXXX/XXXX approx. XXXX XXXX to let them know this was a discharged debt and what do I do? The clerks office told me to contact Schreiber Cohen LLC, XXXX. I called them on XXXX/XXXX/XXXX @ XXXX XXXX and spoke to XXXX XXXX ( sp? ) explained the above to him in detail and he said this would all be cleared up. Yesterday XXXX/XXXX/XXXX I received another notice from State of CT Superior Court that a default was entered against me because I had not filed an answer to this proceeding which I was assured would be cleared up by XXXX @ Schreiber Cohen LLC. I am extremely upset as to how a company that was notified months ago can still try to pursue litigation?????? I am beyond stressed, and can not lose time from work to try to rectify this myself nor should I have to, this company needs to be held responsible for their pure disregard to the law.

I entered into an agreement with Schreiber Law to resolve a XXXX account. The agreement was for 12 monthly payments. On the XXXX payment, made in XXXX of XXXX, Schreiber Law applied the payment to another account in their office, which they allege is mine. Each month when I send the XXXX payment I include a letter stating that the payment is for the XXXX account and I include the last 4 digits of the account number. I never authorized Schreiber to apply the payment to anything else but the XXXX account, as agreed. I received email communication from XXXX XXXX at Schreiber, on XX/XX/XXXX stating " I am looking into this and should have an answer shortly. I think I know what happened and it was through no fault of your own. I will remediate this. '' That was the last communication I received from Schreiber on this issue that they clearly caused. I followed up with Attorney XXXX via email on XX/XX/XXXX and XX/XX/XXXX, with no response. I called Schreiber on XX/XX/XXXX and was told Attorney XXXX was not available to discuss the issue. Additionally, XXXX has continued to send me letters stating that I am behind in my XXXX payments. I have copies of each check that they have cashed each month. I have held up my end of the agreement and continued to make the monthly payment in XX/XX/XXXX, and I will be making the last payment of the agreement in XX/XX/XXXX.

XX/XX/2021 I settled a debt owed to Schreiber Law Firm, who was claiming to represent XXXX XXXX. I have the confirmation documentation of the payments receipt. Upon negotiating and receipt of payment it was understood that Schreiber Law Firm, would inform their client, XXXX, of the payment received and under XXXX XXXX standard " pay for deletion agreement '' the account would be removed from my credit within 30 days. This agreement was negotiated with XXXX XXXX of Schreiber Law. On XX/XX/XXXX the account remained. I contact XXXX XXXX of Schreiber Law who informed me that the fault is on XXXX. She told me to call XXXX. I called XXXX who claimed they had no information on the account and no record of payment and told me to call Schreiber. I have called and emailed each company over 6 times in the past 50 days. Each company is claiming they can not speak to me about the account and that I need to call the other company. XXXX XXXX has stated that she will " Reach out to management '' however has not provided any follow up correspondence. As it stands now : - It appears that XXXX XXXX simply pocketed my payment and is refusing to tell their client XXXX. XXXX as a result is refusing to mark the account as paid and remove from the credit bureaus. These actions are preventing me from obtaining a home.

I was called by the collection dept. of Schreiber/Cohen llc. XXXX, a nice female employee talked to me about payments that were past due, I informed her that i left a message at that office for a motion to continue because i would be out of state, she asked me why I said to visit my parents in Florida from XX/XX/XXXXto the XXXX and the hearing was for XX/XX/2018. She then put me on hold and the manager of the collection dept. picked up the phone he informed me that if i can go on Florida then i have money to pay my bill, I informed him that everything for the trip was purchased by my parents. He then said rudely that he doesn't understand, that he was going to look into my savings and stocks and bonds to see if i had money to pay the bill, and even investigate what kind of care i drive '' maybe I drive a new XXXX '' he said. told him i have no savings and certainly no stocks or bonds that i was broke but i could meet him at any time besides XX/XX/2018.He said that if i didn't pay the whole back amount that i would not receive a motion to continue and that if i miss the hearing a bench warrant would be issued, he was incredibly rude i even told him that if we couldn't have a normal conversation that i would hang up and deal with the court and file my motion for continuance.

On XXXX XXXX, 2017 I received a letter from Schreiber/Cohen, LLC which I will attach. This letter is a notice of a debt collection for their client, XXXX XXXX, XXXX. The original creditor being XXXX , XXXX . I have never in my life even heard of XXXX XXXX. I have never in my life acquired debt from XXXX. I went online and read the long history of problems and deceitful practices by both Schreiber/Cohen, LLC and XXXX XXXX. I think it is disgusting that this can happen to someone. I am in the process of going through a mortgage and if anything happens to disrupt this process I do n't know what I will do. I am SO upset about this. I had a recent problem with XXXX XXXX and their reporting of a debt, and the CFPB really helped me a lot. XXXX ultimately admitted the error and I would have never been able to do that on my own ... I tried, having spent hours on the phone. I am frankly fearful to even call this Schreiber/Cohen, LLC company after reading the stories about them online. I work full-time as a single parent and am in the midst of moving and I do n't have time to do what I did with XXXX. I responded in writing to Schreiber/Cohen within the 30 days they state that I need to do before the debt is then assumed to be " valid '' ... .seriously?? Please help!!

I defaulted on a credit card and they were sending me notices of collection to an address that I have not lived at since XX/XX/XXXX, therefore I was not receiving the notices. XX/XX/XXXX I was served by a XXXX with a XXXX notice which also had an incorrect address that was hand crossed out and my correct address hand written in. I called and made a settlement agreement and payment arrangements with XXXX of Schreiber/Cohen and paid {$420.00} towards my {$900.00} agreement. I also made sure that he had my correct address to send all future information. On XX/XX/XXXX I reached out to XXXX, Chief Compliance Attorney for Schreiber/Cohen to change my dates of payment. I have an email from him stating that if I pay the remaining amount by XX/XX/XXXX that no further legal action will be taken. On XX/XX/XXXX I received a forwarded letter with a State of XXXX Small Claims notice and court date. The amount listed for claim is inaccurate and my previous payments were not taken into account. Once again it was sent to an address I have not lived at since XX/XX/XXXX. I attempted to contact Attorney XXXX to discuss the court filing. He has not returned my email.

Just prior to XX/XX/2021 my husband and I refinanced our mortgage and arranged to pay off some outstanding debt. One of these was a XXXX XXXX XXXX account. This was paid off by XXXX XXXX XXXX XXXX XXXX XXXX, MA XXXX, a law firm retained by the bank we were borrowing from. A letter closing the account was sent to XXXX XXXX as well as a check for {$600.00}. The check was cashed and returned as paid to XXXX XXXX. Since then XXXX XXXX XXXX turned this paid debt over for collection to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX SC XXXX who has retained Schreiber Law LLC XXXX XXXX XXXX XXXX XXXX. XXXX NH XXXX to collect this paid debt. I have made numerous phone calls and provided copies of a letter closing the account and copies of the payment check and record of deposit to XXXXXXXX XXXX XXXX XXXX XXXX XXXX, and Schreiber Law with no success toward resolution and in fact receipt of a most uncooperative and evasive response. Schreiber Law , LLC contacted me via phone on XX/XX/2020 at XXXX. A message was left by a " XXXX XXXX '' requesting a call back. The call came from XXXX. The call back number provided was XXXX. Both numbers are associated with Schreiber Law. I have the message save and can provide upon request. The next communication I received from Schreiber Law was a letter dated XX/XX/2020, advising they represent the current creditor, XXXX XXXX XXXX XXXX as an assignee of XXXX XXXX XXXX An incomplete account number was provided. Schreiber LAw referenced their file number XXXX. This is a blatant and brazen violation of the Fair Debt Collection Practices Act 15 U.S.C. 1692g ( a ), as Schreiber Law was required to send Notice of debt/contents within 5 DAYS of the XX/XX/2020 phone call. This is clearly unfair and deceptive communication tactics of an alleged debt not proven to be owed by me, or owned by the current creditor, or legally collectible.

On Thursday XX/XX/XXXX I received a call from an unknown number which I ignored. Moments later I received a call from my son stating that he just got a call. When he answered the phone, the man said " Is this XXXX XXXX, Social Security number XXXX ( actually reading off his social ) my son said yes, now who the XXXX is this. The man asked if he knew me. My son said yes, what is this about?. The man said " She knows what this is about. Have her call XXXX extension XXXX. He then hung up on my son. I then called this number and asked this person who he was and explained that what he did is illegal. He stated " no its not. Just wait for your papers in the mail. '' The company is Schreiber law of XXXX NH, hired by XXXX XXXX XXXX. I have a job that requires clearance. This company calling relatives and rattling off social security numbers without knowing who they are speaking with is a breach. Can someone please educate them. Thank you.

I enrolled into a debt consolidation company, one of the debts I enrolled went into collection, it went to civil court, I agreed to pay XXXX a month until debt is paid, I continue to get statements with the wrong amount owed, I called the collection agency several times and emailed numerous times and they refuse to update the amount owed, I explained to them that I want it fixed for the credit reporting agency and that because they are withdrawing the amount from my bank account, I would like it corrected so that they dont take out funds that I do not owe. The last statement sent they have balance at XXXX and the balance as of today should be XXXX I have made payments of XXXX dollars every other week since XX/XX/XXXX till the most recent XXXX XX/XX/XXXX, and they refuse to update balance owed.

I have attempted to settle a debt that was owed several times. All of my attempts were either ignored or rejected. I was sued for a much higher amount than I owed because they kept on accruing interest after I had made several attempts to settle or to arrange a monthly payment plan that I can afford. They brought me to court and I had no representation and did not know what I was doing at all. They bamboozled me into accepting a monthly payment plan based on an inflated figure and the payment is more than I can afford per month. I will be paying this debt forever while they collect money on a debt that I do not owe the full amount for. It is wrong and deceptive.

I was advised at the court proceeding the amount of my debt was {$5000.00}, and that the amount would never increase as no interests will be charged. I have been making my monthly payments ever since and I was just advised on a phone call that my account is accruing 12 % interests and the amount on the balance increases {$81.00} dollars a month versus the agreed {$25.00} dollar a month payment. Therefore, this debt will never be paid down. As a consumer I feel that I have been lied to in attempt to collect this debt and it is unfair. In addition, why was I not told this in the beginning I would have seeked an alternate method of payment.

The judgment was in MY favor., so I have called many times and sent letters informing them of Judgment in MY favor but they, gave my the run around saying I had to call original creditor ( XXXX XXXX ) although XXXXXXXX XXXX continues to update and report it on all 3 Credit Bureaus XXXX

I have sent a letter to the Schrieber Law, LLC requesting that they cease and desist in contacting me regarding any and all matters pertaining to the alleged XXXX debt. They are not my original creditor and I have no desire to work with them. I am dealing with more than my fair share of financial strife right now due to COVID 19 and do not need the added stress from Schreiber Law, LLC as well. I am letting the CFPB know what is going on because I want a record of this issue on file.

I am attaching the documents I received today from Schreiber/Cohen LLC on behalf of XXXX XXXX XXXX XXXX. The documents were very poor quality photocopies. Parts of the documents were blacked out and the envelope was hand written. I have no idea if this is legitimate. I have NO problem working out a payment plan with a creditor if it is legitimate but this looks questionable.
