I am writing this complaint against SchoolsFirst Federal Credit Union and it's Loss Mitigation Department in response to their abusive and negligent loan servicing practices. Despite the length of this complaint, it is by no means a comprehensive accounting of my experience and I am willing to elaborate and/or provide additional documentation if requested. After falling behind on my mortgage due to a COVID related hardship, I was contacted by a representative from SchoolsFirst who recommended enrolling into their COVID-19 Forbearance program. I was initially hesitant at the idea of a lump sum payment, but agreed after being reassured that I would have multiple options upon conclusion of the forbearance such as a forbearance extension, reduced monthly payments via a loan modification, as well as a deferral. Prior to this hardship I had maintained over 200 consecutive mortgage payments that spanned 12 years of owning one home and six years of owning two homes. Having never been in this sort of situation before, I felt that I could trust SchoolsFirst and appreciated their offer of a reprieve. As my forbearance was drawing to a close, SchoolsFirst once again reached out to me to discuss my options. I remember this call vividly because it was such an unusual occurrence for them to contact me through my work number. We discussed my intention to remain in forbearance for the full year with an expected start payment date of XXXX XXXX XXXX, as well as the plan to defer the past due amount. Upon the conclusion of the extended forbearance I resumed making my regular monthly payment. After encountering an issue with making the payment in the third month, I called SchoolsFirst and was informed that my payment had been refused because I had a past due balance of over XXXX XXXX dollars, which was due in full. I recalled the plan that we had discussed in the fall of XXXX at which point SchoolsFirst informed me that a deferral was not something that was granted automatically as the forbearance had been, and that I needed to process the paperwork. Although I was alarmed to learn that the suspended payments had not been deferred like I'd been led to believe, I was told not to worry because they would work with me to restructure any arrearage once I'd submitted my application. It then took several weeks for their application packet to arrive in the mail in spite of their claims that they had already sent it out multiple times. The weeks evolved into months (and eventually years) of an endless cycle of my application being denied any sort of consideration, and returned to me as "incomplete". Reasons for being deemed "incomplete" included but were not limited to: Document not received (even though I had confirmations of receipt), expired documents required resubmittal (among them documents with no expiration date and documents that had not expired, such as a w-2 form in XXXX), document missing a signature (it was not) (see attachment 1), incorrect form entirely (even though they were the ones who had provided the form to me in the first place), and the list goes on. I was repeatedly required to submit documentation that I'd already resubmitted multiple times. On more than one occasion they claimed they hadn't received the required "missing" documentation in time, closing out my application, and forcing me to start the application process all over again. At the same time I was also inundated with a barrage of (what I would describe in retrospect as) XXXX from SchoolsFirst which appeared to not be written with any context whatsoever, as they would request that I submit an entirely new application from scratch (along with requesting the exact same information and documentation all over again), as if that had been our very first and only communication thus far. These letters would also ignore any of the phone call transactions I'd had with them during that time. This all served to further confound my understanding of where I was at in the process, and what was being asked of me, thus hindering my ability to jump through their absurd hoops. According to SchoolsFirst, they are the owner, assignee, and servicer of my loan. Despite the fact that SchoolsFirst provides services exclusively to California, they contract with a New Jersey-based third party subservicer. SchoolsFirst uses this distance as an excuse for the delay in sending and receiving time-sensitive mail. It would often take several weeks for them to notify me in writing of whatever new barrier existed now. Considering today's technology, their decision to utilize antiquated methods of communication like this speaks volumes. This is all undoubtedly by design, as it had originally taken only one phone call with an incomplete application for SchoolsFirst to agree to "assist" me with a forbearance in the first place. And of course when I initially applied for the loan, and when I opened a Home Equity Line of Credit on my home I was immediately notified through a Single Point of Contact via direct phone call and/or email- of exactly what was missing and exactly what they still needed, even going so far as to meet me in person to retrieve these documents. Naturally the severity of my delinquency, my perceived creditworthiness, and the fate of my home (my most valuable asset and investment to date), have been held as a hostage along a timeline that SchoolsFirst has moved forward only to their benefit and at their leisure. I had eventually begun calling Loss Mitigation almost daily, sometimes multiple times throughout the day just to check on the status of my application. I learned to take every conversation with a grain of salt, as the sheer volume and scope of the downright lies, misinformation, and misrepresentations I've been provided from one representative to the next has been truly inconceivable. Among the representatives I have spoken to I have been: yelled at, hung up on, lied to, told that there is simply nothing that they can do to help me and to just "sit tight", spoken to in a condescending manner, left on hold for an obscene amount of time often just to be hung up on anyway, and my personal favorite- being hung up on and (when I called back) finding out my file had been notated as a "Spanish-Speaker only". Information I have been given has varied between unhelpful, incorrect, inconsistent, and illegal. For example, one of the more innocuous lies I'd been told was that my actual lender was XXXX XXXX. According to XXXX XXXX and SchoolsFirst, it is not. Even when these agents were competent enough to understand the issue at hand, or considerate enough to pretend like they cared, there was still no point in talking to them because they did not have any decision making authority. They had no ability to rectify errors, and they could not (or would not) transfer you to anyone who did. On more than one occasion I requested to be provided a Single Point of Contact under the California Homeowner Bill Of Rights. In response I was either outright refused, ignored, or told that they were simply unable to transfer me. During one phone call in particular I spoke with a lady who specifically introduced herself as my Single Point of Contact. When I requested to be transferred to her in a subsequent phone call, I was told that I could not be transferred, and I have never heard from that woman again. In fact, there was no escalation process. Their scam is to hide behind a seemingly incompetent and undertrained call center that is ultimately incapable of providing accurate information, and incapable of providing any actual assistance to distressed homeowners. I've had to take off what's amounted to weeks from work in an attempt to find a resolution on this matter (being restricted to east coast business hours while living in a west coast time zone has made this all the more difficult). A review of two months of cell phone bills showed that I had called in 27 times and spent 343 minutes on the phone in that span alone. And yet my time has just been wasted away while on the phone for hours, with no resolution in sight. For a while I could not even figure out who my servicer was because that answer varies depending on who you ask or which documents you're looking at. The information is obfuscated by the fact that SchoolsFirst misleads their borrowers by referring to their third party subservicer as simply their "Loss Mitigation Department". It took some time (over two years) and some serious investigating just for me to even figure out that I was dealing with two entirely different businesses because both businesses claim only one name. I have only ever received mail from "SchoolsFirst" and never "XXXX" even when the letter has indeed been sent by XXXX. XXXX employees specifically introduce themselves as SchoolsFirst employees (despite the fact that their company exists on the opposite side of the country). Its not just via telephone conversations; they do this on legal documents as well. The woman who filed the Substitution Of Trustee appointing XXXX XXXX XXXX as the new trustee for my loan- swore to a notary in Missouri that she was the "Vice President Document Execution" for "SchoolsFirst Federal Credit Union". Yet this same woman represented herself with the exact same title in the Notice of Default that was recorded in my county in California, but instead working for "XXXX XXXX, servicer for SchoolsFirst Federal Credit Union (see attachments 2 and 3). Another person I spoke with refused to even confirm whether he worked for XXXX or SchoolsFirst. They would not confirm which company they worked for, and yet SchoolsFirst both gives free access to and forces me to furnish private and confidential information to every random work-from-home low level call center employee who picks up the call, just to get information on my own loan. Their misrepresentations have made it nearly impossible to know who it is I should be in contact with and who it is that I have been in contact with. Their fraudulent and obscured identity has also made it easier for SchoolsFirst to provide varying degrees of conflicting information, and nobody to be held accountable. One example of this was on one occasion in particular I had called Loss Mitigation while at my wits end, wanting answers to a myriad of questions, and during this conversation I received the following information (information in italics) which contradicted the information I had been given previously: The forbearance I had been granted had been a "regular" forbearance. I had not been granted a "COVID forbearance" because my "hardship did not qualify.". (Prior to this I had no idea that there was more than one type, I've since been told that there isn't, and I'm still not sure where the truth is in either of those statements. None of the CARES act had applied to me because my loan was/is not federally backed, and therefore my loan had not been protected under any state or federal guidelines. Learning that I did not have a federally backed loan was both shocking and infuriating as this was in direct conflict with what I had been previously told by another agent and with what SchoolsFirst had communicated in writing. These communications were therefore intentionally misleading, as they had made it very clear to me at the time that I did in fact have a federally backed loan (see attachments 4,5 and 6). It was during this conversation that I was informed for the first time that the forbearance I had entered into had only been for a total of 3 months (XXXX XXXX and XXXX of XXXX), not for the year as we had discussed. According to their records, the phone call I had with Loss Mitigation in which I extended the forbearance never happened. While I am unable to retrieve my employer's phone records from nearly 3 years ago, I have attached the loan statement that had been prepared in the month following what would have been the end of the forbearance that clearly stated You accepted a forbearance. (see attachment 7). After being confronted with this shocking disregard for any truth, I requested an investigation into the recordings of my conversations. I was initially told that they do not keep recordings. I've since been told that they only keep up to six months worth of recordings. These conversations took place two and a half years ago. I was recently provided a copy of the Loan Activity correspondence between Loss Mitigation and I. I've attached a few of those excerpts to this complaint (See attachments 8, 18, and 31). It serves as a window, but it is not complete. This is because the "complete" report omits information, and omits entire conversations such as the one in which I extended the forbearance (as well as others that can be substantiated through my cell phone records). For example, it logs numerous attempts to call me often followed by "customer hung up", but omits that when these calls actually did occur, they were in fact robocalls that did not lead to a live person, but instead an automated message informing me to call SchoolsFirst. Each time I would return the call, the agent would have no idea why I'd been told to call. There were several instances upon which I would receive this notice mere minutes before the close of business, which left me no time to call back even if I'd wanted to. I thought this was a particularly cruel sort of call to receive, as I was already being held captive in a desperate and indefinite state of worry and XXXX over my home. The notes also log their attempts to contact me via email, but they omit how I cannot view whatever was written in that email because my "account status" prevents it. There are also several notations on there that are very clearly not related to me. For example on XXXX "POSTDATED CHECK.. TAD XXXX MADE PMNT XXXX DATED FOR FRIDAY XXXX RFD LOSS OF EMPLOYMENT THANK YOU FOR CALLING BCU. THANK YOU FOR YOUR MEMBERSHIP" (see attachment 8). I do not own checks; its XXXX for Gods sake. I have never owed nor paid specifically XXXX to SchoolsFirst, I have never even heard of XXXX, and I have never been let go from my place of employment. While this meticulous record keeping has nothing to do with me, perhaps they should find and review the notes of the person who wrote that post dated check (if they even exist) to see if my notes are with theirs. On XXXX XXXX XXXX, over a year after I had exited the forbearance, I finally received a letter from SchoolsFirst which stated, "A review on XXXX determined the application is complete and no further information is needed at this timeWe will not initiate any foreclosure actions or proceedings by sending first notice or filing first legal documents until your complete assistance package has been evaluated." (see attachment 9). The following day, like a sick joke, I received another letter from SchoolsFirst which stated "Please be informed your mortgage loan has been referred for foreclosure proceedings. We did not receive a response to the previous letters we sent regarding foreclosure prevention alternatives, but if you are still interested, it is not too late" (see attachment 10). I received two additional letters dated XXXX XXXX XXXX from XXXX XXXX XXXX informing me that a Notice of Default had been recorded against my property. In response I sent three separate Qualified Written Requests via certified mail in which I contested the Notice of Default and requested an itemized statement, but those letters have never been acknowledged (see Attachment 11). The Notice of Default specifically indicated "XXXX XXXX XXXX" as "the date contact with the borrower was accomplished pursuant to Civil Code Section XXXX". However, according to the loan activity notes as provided by Loss Mitigation, no such contact ever occurred on that date. Immediately leading up to the filing of the Notice of Default my application had been refused for months as SchoolsFirst kept refusing my application and repeatedly asking me to submit a "signed financial form". This was several months of me calling back in a perpetual state of confusion and having them look through my application to verify that it was: a.Received b.The correct form and c.Not missing a signature. This would be followed up with receiving yet another letter from SchoolsFirst informing me to submit a "signed financial form". They finally let me know months later that I had been submitting the wrong form the entire time because they had sent the wrong form to me. I've attached one of my latter responses to SchoolsFirst that directly addressed this (attachment 1). Coincidentally, this had lasted right up until they had filed the Notice of Default. Soon after, SchoolsFirst resumed their "missing documents game. Their new document request was originally posted with such a vague description that I was forced to call Loss Mitigation in an attempt to get clarification on what was even being asked of me. Loss Mitigation's original interpretation of the request was wrong of course, which prolonged the delay even further. Even after I had successfully submitted the requested document, SchoolsFirst continued to refuse acceptance of the document for weeks. Attached is my 3rd submission to them regarding this (see attachment 12). Despite the multi-colored map I drew outlining how this document was indeed what they asked for, it was also rejected. In spite of my tireless efforts to meet their demands and in spite of their promises to work with me, on XXXX XXXX my request for assistance was denied. The three programs I was considered for were FORBEARANCE PLAN, REPAYMENT PLAN and LOAN MODIFICATION. I was denied a forbearance because my hardship reason does not meet program guidelines. The repayment plan was denied because after they reviewed my financial information, it was determined that your income is insufficient to qualify for any foreclosure alternative programs at this time. And lastly I was denied a loan modification because after reviewing my housing expense to income ratio we determined that it does not meet the requirement for a loan modification (see attachment 13). Using my "housing expense to income ratio" to deny assistance is a highly self-seeking decision for a lender to make after playing a significant role in shredding the figure before evaluating it. My income is also XXXX higher now than it was when I originally qualified to both refinance and open a HELOC in XXXX. It is approximately XXXX higher now than it was when they approved a forbearance in XXXX. But now my income is no longer a "sufficient amount"? More importantly, a deferment was not even included among the list of loss mitigation options I was considered for despite my request in my application and repeated assurances from SchoolsFirst. Attachment 14 is just one of many emails Ive sent to SchoolsFirst about a deferral and attachment 15 is a screenshot from SchoolsFirst's website that unequivocally states that you can defer payments after the forbearance period. Denied any assistance, my only option now was to pay the full amount in one lump sum. Taking a comprehensive accounting of my loan has been a nearly impossible task since I do not have access to my full mortgage payment history. I am no longer sent monthly paper statements, and my website access and app access to all past and current statements have been blocked by SchoolsFirst due to my "account status" (see attachment 16). SchoolsFirst states that you can have 24/7 access to your loan and updates regarding your loss mitigation requests online at loansolutioncenter.com. That is yet another lie (see attachment 16). Whatever numbers I have been able to retrieve are extremely unclear and inconsistent. Lack of access and equivocal information is problematic since throughout this time I have had the financial ability to resume my monthly payment, and I have made multiple attempts to make those payments. Despite these attempts, my payment history appears hit-or-miss as SchoolsFirst has either accepted or refused my payments at-random. There were several months where I was prohibited from making a payment because I was told that it was considered a "partial payment" and they would "not accept anything less than the full amount of the delinquency". One representative stated that they would not accept the payment because "it was not going to cure the delinquency". Of course neither were my interest-only HELOC payments (that were secured by the same collateral), and they've had no problem regularly removing that payment from my account every month. When my payments were accepted, I breathed a sigh of relief and did not realize at the time that I should scrutinize where my payments were going after I'd been provided confirmation of receipt. So when I went through my escrow transactions, one of the few things related to my mortgage that I still have unrestricted access to (see attachment 17), I was shocked and confused at how irregular my payments had been applied and whether or not they even had. I compared the escrow transactions to the loan statements I had and noticed that several payments were misapplied, not applied when received, or not applied at all. Several of my payments did not move forward my delinquency date, making it appear as though I am even further behind than I actually am. Monthly late fees and "property preservation" fees have accumulated regardless of whether or not I'd made a payment (see attachment 19). On several instances, Schools First refused payment until the payment was past due, which resulted in assessing frivolous late fees (see attachments 18 and 19). Some months my payments were even shown as being accepted but then "refunded", subsequently accruing more late fees. In reality those "refunded" payments were never actually reimbursed to my account. I went through and compared every bank statement from the past two years and noticed that there were several instances where I had received emails indicating to me that my payment had been accepted, in spite of whether or not that was even true. In XXXX XXXX for example, I received three separate emails from SchoolsFirst that thanked me for making three individual mortgage payments. Despite having not authorized all three of these payments, my bank account at the time indicated that my account had been debited for them. These payments are still shown on my loan statements and escrow transactions, yet not one of those payments were ever applied towards reducing the loan, and the withdrawals from my bank account are no longer reflected in the transaction history. Meanwhile, an XXXX XXXX mortgage statement indicated that a full periodic payment was fully applied to my negative escrow balance. Yet according to my bank statements, no such amount ever even left my bank account at that time! In fact my bank statements show several mortgage payments which resulted in an actual decrease of my total available account balance, but my loan statements do not accurately account for each of those payments. The money in my "Unapplied Funds" account seems to appear out of nowhere and disappear just as quickly. I've recently found the most success in being allowed to make a payment by going into an actual branch, and I recently discovered that they would print my past statements for me at my request. Yet even when paying inside of an actual branch, my payments are still not accounted for appropriately nor are they applied upon receipt, and the transactions do not make any sense even to SchoolsFirst! The manager at the nearest SchoolsFirst branch can't explain any of this. I know because I have sat down with her and she has tried. In addition to this, I have also attempted to address the discrepancies with them in detail via telephone and email, and the issue continues to be either ignored or dismissed (See attachments 20 and 21). The most recent time I brought this up, I was told that Loss Mitigation had attempted to call me three times on one particular day (along with leaving a message for me). According to my cell phone records, this is simply not true. As a result of this apparent book cooking, Ive made several attempts to request an itemized accounting of my loan and a full payment history beginning with the date of delinquency. In addition to the previously mentioned ignored Qualified Written Requests, I also attempted to contact the lawyer/trustee that had been assigned to my loan. Their phone number led to an automated recording which instructed me to contact them via email. I attempted to email and was charged XXXX for an emailed response of a payoff statement that was neither itemized, nor accurate, in spite of that being the specific point of my request (see attachments 22 and 23) However that statement stated "For itemization please call XXXX. So I did this, and I was connected to an automated recording stating that Id reached XXXX XXXX XXXX, although I do not bank there nor hold a loan with that credit union. The man who answered claimed to be from "Schools Credit Union", claimed to have never heard of XXXX XXXX XXXX, and had no idea what I meant when I asked for a simple itemization. The man had the audacity to ask me if I was calling the correct number and ultimately stated that he would forward the request to the attorney assigned to my loan. I was then charged another XXXX to be sent another emailed statement that was again neither itemized nor accurate, and like the statement before, it said "For itemization please call XXXX" (See attachment 24). By letter and by email I've submitted a Request To Know under the California Consumer Privacy Act, and in response they denied my inquiry for my own personal information and they stated that they were unwilling to complete my request. SchoolsFirst simply refuses to provide accurate and timely information regarding my loan or anything at all for that matter! Whether it's regarding my own personal information, or the total amount I owe, to who actually owns and/or services my loan, to when exactly (and if) my home has a sale date, or who to contact regarding any of this information. One payoff statement I received directed me to send payment to XXXX XXXX. XXXX XXXX XXXX (See attachment 25), so even who to pay is questionable! My purported monthly mortgage payment changes from one document to the next as well. The amount that they provided to the IRS on my 1098 was a different amount than the one shown on my loan statements. So they do not report accurate information to the IRS (in addition to the wrong mortgage payment on two 1098s, they also reported inaccurate amounts regarding what I have paid to them and what they have refunded to me). In XXXX and XXXX they reported that they had paid out money from my escrow in order to refund several of my periodic payments. While I did receive those checks, I did not cash them. However that money was still reported as being removed from my escrow account. I had asked to have those checks reissued and instead, according to my loan statements, it appears as though that money was applied towards my loan, (where it was sent by me in the first place several months prior). I can only assume that this is what happened since according to my loan statements- money was applied to my loan, and it was money that did not come from out of my bank account at the time. I was told however, that the checks "were reissued" to me. I never received a reissue of these checks. They also do not report accurate information to any of the credit bureaus. Their incorrect reporting played a significant role in the status of my alleged past due balance and the debt to income ratio that SchoolsFirst used to justify their determination to deny my request for a loan modification. Specifically, their denial letter stated "The consumer reporting agency contacted that provided information that influenced our decision in whole or in part was XXXX XXXX." So I requested the report from that agency and according to that report, my loan has had no payments made since XXXX of XXXX, (see attachment 26) despite the fact that I have made more than 15 payments since then according to my escrow balance sheet (see attachment 17 highlights). Shortly after receiving the denial letter, I had gotten into contact with a "Loss Mitigation Specialist" from the Real Estate Servicing Department, after emailing and then calling their department in a desperate attempt to find anybody willing to help me. I attempted to explain everything that had led up to this point, and was initially hopeful and relieved to not have to continue communicating with SchoolsFirst's unhelpful call center. I was encouraged to submit an appeal to the denial, and to "trust the process". I did so, and on XXXX XXXX I learned I'd been approved for a repayment plan. Fortunately by now I'd had the wherewithal to know better than to rely on their mailed correspondence, and only through my own relentless calling was I able to retrieve this information in a timely manner. Left to SchoolsFirst's mailings, I received the letter with the details of this repayment plan on XXXX XXXX, two days after I was required to communicate my intent, and a full day after I was expected to have made a down payment of an amount that wasnt even possible for me to make. The plan was scheduled to begin on XXXX XXXX and the first payment required was a down-payment of XXXX (see attachment 27), just shy of 17 months worth of payments. On top of this, the repayment plan indicated that my mortgage payment would nearly double for the next two years. While I have a sizable down payment saved because of the gaps in time where they refused to take my payments, XXXX was an amount they knew I would not have even if I had completely cleared out every cent I had. SchoolsFirst knew precisely what I had and did not have, after I had been forced to send in multiple applications, Financial Forms, bank statements, paystubs, tax returns, w-2s, mortgage statements, hardship letters, letters of employment, and even my divorce decree. Not to mention I had also discussed all of this again with my contact in the Real Estate Department as she easily reviewed my accounts from her side seeing as how my lender is also my bank. Even if I could've somehow procured XXXX in that short amount of time (they couldn't even deliver their letter requesting the payment within the amount of time they were expecting me to furnish that amount!), they were asking me to completely drain everything I had in my checking and savings combined, and then hike up my total mortgage payment to nearly 60% of my take home pay- to repay an amount that was more than what I ever even owed to them! The "total amount due" in the repayment plan once again was not accurate, nor was it consistent with itself or any other document. It stated that the total past due amount was XXXX, yet when I did the math the total amount it had me paying back throughout the life of the repayment plan was XXXX. Why would I have to pay back a different number than the indicated "total past due amount"? If what I owe is actually XXXX, why wouldn't it just state that number instead? (see attachment 27) Meanwhile the loan statement for that month stated the total past due amount was XXXX with a XXXX amount due, and the reinstatement document I received stated the total to reinstate was both XXXX and XXXX! (See attachment 28). The repayment plan indicated that I had the option to either accept or refuse these terms by XXXX XXXX (see attachment 29) or appeal one final time by XXXX XXXX (see attachment 30). I called and spoke with an agent to discuss and confirm my right to appeal (see attachment 31). Not one to be

Title to personal vehicle was sent to bank by mistake. The bank sent a presentment and it was replied to with a conditional acceptance per the billing errors seen on said presentment. Attached to the conditional acceptance was a negotiable instrument for full satisfaction of any assumed debt. That negotiable instrument was refused and the bank refuses to release my title. 3-603. TENDER OF PAYMENT. Primary tabs ( a ) If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument, the effect of tender is governed by principles of law applicable to tender of payment under a simple contract. ( b ) If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge, to the extent of the amount of the tender, of the obligation of an indorser or accommodation party having a right of recourse with respect to the obligation to which the tender relates. ( c ) If tender of payment of an amount due on an instrument is made to a person entitled to enforce the instrument, the obligation of the obligor to pay interest after the due date on the amount tendered is discharged. If presentment is required with respect to an instrument and the obligor is able and ready to pay on the due date at every place of payment stated in the instrument, the obligor is deemed to have made tender of payment on the due date to the person entitled to enforce the instrument. ( a ) Written notice by obligor to creditor ; time for and contents of notice ; procedure upon receipt of notice by creditor If a creditor, within XXXX days after having transmitted to an obligor a statement of the obligors account in connection with an extension of consumer credit, receives at the address disclosed under section 1637 ( b ) ( 10 ) of this title a written notice ( other than notice on a payment stub or other payment medium supplied by the creditor if the creditor so stipulates with the disclosure required under section 1637 ( a ) ( 7 ) of this title ) from the obligor in which the obligor ( 1 ) sets forth or otherwise enables the creditor to identify the name and account number ( if any ) of the obligor, ( 2 ) indicates the obligors belief that the statement contains a billing error and the amount of such billing error, and ( 3 ) sets forth the reasons for the obligors belief ( to the extent applicable ) that the statement contains a billing error, the creditor shall, unless the obligor has, after giving such written notice and before the expiration of the time limits herein specified, agreed that the statement was correct ( A ) not later than XXXX days after the receipt of the notice, send a written acknowledgment thereof to the obligor, unless the action required in subparagraph ( B ) is taken within such thirty-day period, and ( B ) not later than two complete billing cycles of the creditor ( in no event later than ninety days ) after the receipt of the notice and prior to taking any action to collect the amount, or any part thereof, indicated by the obligor under paragraph ( 2 ) either ( i ) make appropriate corrections in the account of the obligor, including the crediting of any finance charges on amounts erroneously billed, and transmit to the obligor a notification of such corrections and the creditors explanation of any change in the amount indicated by the obligor under paragraph ( 2 ) and, if any such change is made and the obligor so requests, copies of documentary evidence of the obligors indebtedness ; or ( ii ) send a written explanation or clarification to the obligor, after having conducted an investigation, setting forth to the extent applicable the reasons why the creditor believes the account of the obligor was correctly shown in the statement and, upon request of the obligor, provide copies of documentary evidence of the obligors indebtedness. In the case of a billing error where the obligor alleges that the creditors billing statement reflects goods not delivered to the obligor or his designee in accordance with the agreement made at the time of the transaction, a creditor may not construe such amount to be correctly shown unless he determines that such goods were actually delivered, mailed, or otherwise sent to the obligor and provides the obligor with a statement of such determination. After complying with the provisions of this subsection with respect to an alleged billing error, a creditor has no further responsibility under this section if the obligor continues to make substantially the same allegation with respect to such error. ( b ) Billing error For the purpose of this section, a billing error consists of any of the following : ( 1 ) A reflection on a statement of an extension of credit which was not made to the obligor or, if made, was not in the amount reflected on such statement. ( 2 ) A reflection on a statement of an extension of credit for which the obligor requests additional clarification including documentary evidence thereof. ( 3 ) A reflection on a statement of goods or services not accepted by the obligor or his designee or not delivered to the obligor or his designee in accordance with the agreement made at the time of a transaction. ( 4 ) The creditors failure to reflect properly on a statement a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. ( c ) Action by creditor to collect amount or any part thereof regarded by obligor to be a billing error For the purposes of this section, action to collect the amount, or any part thereof, indicated by an obligor under paragraph ( 2 ) does not include the sending of statements of account, which may include finance charges on amounts in dispute, to the obligor following written notice from the obligor as specified under subsection ( a ), if ( 1 ) the obligors account is not restricted or closed because of the failure of the obligor to pay the amount indicated under paragraph ( 2 ) of subsection ( a ), and ( 2 ) the creditor indicates the payment of such amount is not required pending the creditors compliance with this section. Nothing in this section shall be construed to prohibit any action by a creditor to collect any amount which has not been indicated by the obligor to contain a billing error. ( d ) Restricting or closing by creditor of account regarded by obligor to contain a billing error Pursuant to regulations of the Bureau, a creditor operating an open end consumer credit plan may not, prior to the sending of the written explanation or clarification required under paragraph ( B ) ( ii ), restrict or close an account with respect to which the obligor has indicated pursuant to subsection ( a ) that he believes such account to contain a billing error solely because of the obligors failure to pay the amount indicated to be in error. Nothing in this subsection shall be deemed to prohibit a creditor from applying against the credit limit on the obligors account the amount indicated to be in error. ( e ) Effect of noncompliance with requirements by creditor Any creditor who fails to comply with the requirements of this section or section 1666a of this title forfeits any right to collect from the obligor the amount indicated by the obligor under paragraph ( 2 ) of subsection ( a ) of this section, and any finance charges thereon, except that the amount required to be forfeited under this subsection may not exceed {$50.00}. am in desperate need for any advice or assistance is recovering my Grant money from my Credit Union. I'm going to do my best to keep this letter short and to the point. I was awarded a Nevada GOED Pandemic Emergency Support Grant in the amount of {$10000.00}. THe money was deposited on XX/XX/2021 into my daughter 's checking account that I was listed as a joint owner. On XX/XX/2021, I started buying supplies needed for the office, and after 2 transactions, my card started to decline. I called my bank, Schools First Federal Credit Union out of XXXX California, and asked them to increase my card limits. They increased my limits to {$1000.00} per day. Still not what I needed it to be, but I figured I'd just go into the bank the next moring and withdrawl what I needed. Well 5 minutes after I hung up the phone with Schools First Representative, I went into a store to make a purchase. Again my card was declined. I called them back and was transferred to representative by the name of XXXX XXXX. HE then proceeded to tell me the funds in the account are currently on hold due to my seperate account with the same credit union, had a negative balance. ( The seperate account was just in my name and at the time the account was negative due to fradulent charges on my account. There was an active claim open on that account as we were still going through what charges were authorized and which ones werent. ) Anyways, so XXXX told me that the funds were not available for use and to check back in 2 days. The next day I still went into the bank to see what I could do, show them my Grant award letter so they can get a better understanding on what and where the funds came from. All they did was again, forward my documents to the same representative, XXXX XXXX, and told me he wouldnt be able to get back to me until Monday. Monday came and it was almost XXXX and I hadnt heard from XXXX yet so I decided to call him. The representative told me he wasnt in the office today. Again Tuesday, around XXXX hadnt heard from XXXX so I called them again. I was told XXXX wasnt in the office, woud i like to leave a message. I left him a message to call me at his earliest convienence as this matter is Urgent. About a week later, after no call from XXXX, I called the credit union again. AFter 45 minutes on hold, XXXX gets on the line and tells me that the funds are not going to be available for use and that the funds are going to be transferred to my seperate account to pay off the negative balance. I explained to him that The {$10000.00} was protected money under the CARES ACT, and also Executive Order N-57-20 Section1 stating Financial ASsistance made available under section 2201 The CARES ACT and any other federal-, state-, local-government financial assistance made available to of individuals in express response to the COVID-19 pandemic, shall be EXEMPT from any attachment, levy, execution, garnishment or setoffs ., Civil Code section 3054 or Financial Code section 1411 where no financial institution shall have any lien upon, or any right to setoff against any financial assistance or funds received as CARES ACT funds ( paragragh 1 ), Section 4 states that it is UNLAWFUL to COLLECT ANY MONEY in a matter inconsistent with PAragraph 1 or Paragraph 2 OR TO RETAIN ANY MONIES COLLECTED. ANY MONEY COLLECTED SHALL BE POMPTLY REFUNDED without any further action, Declaration of Emergency Directive 017 Section 6 which clearly states, setoffs from COVID-19 stimulus funds are PROHIBITED. THe NAtional COnsumer Law Center stated the Code of Federal Regulations Title 44 subsection 206.110 ( g ) states all assistance provided under this subpart is EXEMPT From garnishment, seizure, encumberance, levy, executive, pledge, attachment, release or waiver. I've submitted all these Codes and orders to XXXX XXXX at Schools First Federal Credit union. As of XX/XX/2021, he still is telling me that the credit union is not going to put the funds back into my account and to call a lawyer or somebody that might help me. THis whole situation has been very stressful, frustrating and caused even more financial problems for not only my family and I, but also for my business, my employees, etc. MY question is who do I need to call, write, email to have my funds returned to me ASAP. The credit union needs to be held accountable for not complying with the SEVERAL State and Federal codes and Orders that are supposed to protect my COVID-19 PROTECTED Grant funds. I received stimulus check for {$4200.00} from the Department of Treasury of the U.S. issued XX/XX/XXXX it was mailed to my address in XXXX CA XXXX in the summer of XXXX. I delayed in cashing the check because I misplaced my mail key and I also wanted to check with the IRS if it was a check truly granted and issue to me. I checked online on the IRS website and confirm it was a legitimate stimulus check issued in my name. I deposited the physical check at my School 's First Savings Account on XX/XX/XXXX in person at the XXXX, CA branch and XX/XX/XXXX I was able to review my account and noticed the deposit was reversed on XX/XX/XXXX. I called customer service and they informed the same check was deposit at XXXX XXXX XXXX XXXX. I then went to the XXXXXXXX XXXX to get a copy of the check but unfortunately, School 's First Credit Union didn't request the copy of the check processed by XXXX XXXX. I was told they couldn't and wouldn't be able to retrieve this information due to privacy laws. After several attempts in person and over the phone with both banks. I was able to obtain a fax number to XXXX XXXX XXXX XXXX department to request the copy of the processed check needed to report to the XXXX Police Department. School 's First Credit Union failed me in the following ways, lack of communication, lack of investigation by their Fraud Department, lack of empathy and customer service, and was abused my trust and threatened to freeze and hold my funds on other accounts and/or canceling my membership and ruining my credit card accounts and line of credit if I didn't comply with their policies and procedures ahead of 45-day grace period to bring the savings account current. 1. They failed to notify me by phone, text, or email the amount of {$4200.00} was reverse by the IRS due to the check already processed by XXXX XXXX XXXX XXXX XX/XX/XXXX by an individual named XXXX XXXX in XXXX AZ. 2. My Savings/Checking account was flag under suspect of Fraud and demanded payment in writing for the deficient funds of - {$800.00} in my savings account and took the {$500.00} a had available in my checking account and reflected {$0.00} balanced in my checking account on XX/XX/XXXX. When I called and reported a merchant informed me my ATM debit card was flagged for FRAUD when I attempted to make a purchase for groceries. 3. I called customer service and they told me they were going to hold my funds in my checking account and not making them available until I paid them the- {$800.00} deficiency balance in the savings account. I asked if they could release the {$500.00} funds because I had payments schedule to debit my checking account and customer service supervisor XXXX refused because she didn't have the authority to release funds asked if I can wait till Monday XX/XX/XXXX. My accounts were all flagged for suspicion of XXXX. 4. I went to the XXXX XXXX XXXX and the Branch Manager XXXX XXXX was kind and she was able to release by funds after speaking to corporate. However, they refused removed the FRAUD alert on my account and I was not able to use my ATM debit card until I came up with the deficient balance of - {$800.00} and no one has the authority to issue a temporary credit on the account until the issue is resolved. I was offered to take a loan to cover the deficient balance. I did apply for a loan of {$1000.00} to cover the cost of no wrongdoing of mine. I just decided to wait because I would have to pay interest on this money I borrower of {$86.00} a month and I would like to see if the US treasury can reissue the check in the next 30 days. XXXX. Today XX/XX/XXXX I received the processed check from Bureau of Fiscal Service and took it in person to XXXX XXXX XXXX, XXXX XXXX the Branch Manager was kind enough to confirm the suspicious check had another name address and deposited to XXXX XXXX XXXX XXXX the same date reported by IRS with same check number, account and routing numbers. She was able to get my ATM debit card activated again. I'm very grateful for her helped and I never felt judge by her. Unfortunately, every other attempt with customer service I was not getting the same treatment and my issues were not being resolved. I felt the need to submit this information to the CFPB because these policies and procedures have to improve for these two financial institutions.

On XX/XX/XXXX my personal loan with Schoolsfirst Federal Credit union charged off, I was unaware that this action was taking place since in all previous conversations no mention was made to me that this was happening. Because this loss took place my Membership was in danger of being closed. On XX/XX/XXXX I emailed XXXX XXXX and XXXX XXXX and outlined the discrimination and retaliation that I felt I was receiving. I felt that no mention of my account being charged off was mentioned in an effort to close my account, prevent my direct deposit from being received and cause me further financial hardship. I received no response, acknowledgment or phone call to discuss my concerns. On XX/XX/XXXX I was advised by XXXX XXXX that I had to make a deposit to cover the {$22.00} negative balance in my account so that my Membership could be closed. Not once was I provided a payment arrangement or options to prevent my account from being closed as all other members are offered. I was told by XXXX that she never asked me to pay on the personal loan because she wanted me to pay on my car loan. So to me that tells me that management was purposely setting me up to cause a loss to have restrictions placed on my account with the intent of closing my membership. On XX/XX/XXXX I emailed XXXX XXXX, XXXX XXXX & XXXX XXXX as I realized that my account had been shut down. I received a response from XXXX XXXX who promised to look into my complaints and respond to my claims. Her response was unfair, deceptive, and abusive. In my response to her I asked if she would have responded to any other member the way she had to me. As is standard with upper management when it came to my membership I received no response. On XX/XX/XXXX I responded to XXXX 's email that highlighted how my Membership according to her wasn't closed. I would like to point out that when your Membership is under par {$5.00} it is an attempt by the credit union to close your accounts. You have to satisfy the {$5.00} minimum but every time you deposit those finds will once again be offset in an effort to close your membership. My debit card was canceled without my prior knowledge, my direct deposit was captured, my funds were not made available to me without the assistance of management. In her response to me XXXX denied closing my account although the facts show otherwise. XXXX spent time outlining assistance provided to me in XXXX and didn't address my current concerns. On XX/XX/XXXX I was forced into payment arrangements that I knew I couldn't afford to meet but again was not receiving any assistance that a typical member would receive a reage, deferment were now being denied because management forced me into creating a loss and were retaliating based off the emails that I sent to upper management. I was told by XXXX XXXX that I couldn't be removed from my husbands account where I appeared as a joint unless he removed me. I asked that my direct deposit be deposited into this account and was told my debit card would not be canceled or restricted as any action taken would have to come from my husband. On XX/XX/XXXX I realized my debit card was canceled this came after Schoolsfirst realized I had redirected my direct deposit into my husbands account where I am listed as a joint. Because I didn't have access to my money I wasn't able to put gas in my car and ran out of gas on the freeway almost costing me my life. I had been guaranteed my membership on my husbands account wouldn't be impacted without notice they canceled my debit card. No previous calls, letters or emails were sent to me. Schoolfirst has not been unfair to me as a previous employee not being granted the same assistance or service as a typical member. They have been deceptive as they have allowed my account to create a loss preventing me access to my account fully. They have been abusive in their handling of my account which has caused me harm as all their Standard Operating Procedures have not been followed. I confirmed when calling in that automatic closures take place every Saturday my account was closed on a Wednesday purposely and with intent to cause me harm.

Dear Sir or Madam : My name Is XXXX XXXX XXXX I am a potential enrollee with the schools first credit union. My application ID : is XXXX. I initially applied for membership on XX/XX/2022, via an online portal. During the process, I uploaded all required documents, including my school transcripts. On Monday, XX/XX/2022, I called customer service to request the status of my application. I was told by a representative that I needed to upload my transcripts, so once again, I uploaded my transcripts via the online portal. On Tuesday, XX/XX/2022, I called again to find out the status of my application. I was told again that I needed to upload my transcripts, so I uploaded my transcript yet again via the online portal. On Thursday, XX/XX/2022, I called customer service again, this time I was told I just needed to add a funding source. On Friday, XX/XX/XXXX, around XXXX AM I went to the schools first credit union XXXX XXXX branch located at XXXX XXXX XXXX, XXXX XXXX California. I was properly greeted and then stood in line I spoke to a very polite young lady who signed me in, as I sat and waited to be called. The employee who served me was named XXXX, he started to process my application. He asked me for my school ID which I gave him. He then asked me for my transcripts, for which I pulled up on my cell phone and I asked him if I could print them or how can I upload them so that he can see them. He stepped away and apparently talk to his lead. He then came back and sat down and told me Unfortunately you need to be in a student assistant teaching position in order to qualify to be a member here at the schools first credit union. I thanked him for his time, as I proceeded to walk out. I then called customer service and explained to the representative what this member service representative told me, the representative then talk to the membership applications department and said it was incorrect, and that all I would have to do is upload my transcripts. So once again I uploaded my transcripts, this time I called and spoke to the customer representative in the membership department. The Lady I spoke with was very polite and started to process the application, again they asked for the transcripts. So once again I uploaded the transcripts. I called back and spoke to another membership enrollment agent. Again, this lady was very polite but said I do not qualify because I am not enrolled in a credentialing program, I reply to her yes, I am. I uploaded yet another copy of my transcripts as well as a curriculum sheet. I explained to her in great detail, that I am a XXXX study major with a XXXX studies option, within that option is the credentialing. I went as far as to explain to her and once again upload my course syllabus for classes that were related to teaching. She apologized and said she doesnt see where its related to education. At this point, I was beyond frustrated and angry at the level of blindness by your staff. I have literally had to add an additional class to show XXXX course material to supplement an application for the credit union. How beyond ridiculous are your membership requirements!! I have now since started a complaint with the consumer financial protection Bureau. The reason why am doing this is that your schools first credit union should honor what it is representing. I do applaud you on the faade of your business model, which indicates that it is 100 % positivity and teachers first, we got your back great marketing!!! However, I wish it were true. I have attached once again for the record, a new copy of my transcripts including the highlighted version showing the XXXX course curriculum. Including the initial curriculum plan for which I enrolled in the program. I hope to hear a response soon from your executive team, I would appreciate a call not from a customer service agent, nor from a manager, but rather someone who can expedite applications.

According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. Therefore I am the Consumer and have the right to make sure my private information isn't shared which is backed by 15 USC 6801 stating as follows : " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by that definition so under that title as well as 15 USC 1681 section 604 a section 2 states that In general Subject to subsection ( c ), any consumer reporting agency XXXX furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. ( Furnisher of information to credit agencies ) the XXXX XXXX and the Consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish this information. They do not have my written consent. Any and all consent to XXXX, XXXX and XXXX ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked for all past, present and future issues. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' and ( Furnisher of information to credit agencies ) never informed me of my right to exercise my nondisclosure option. Not to mention 15 USC 1681C ( a ) ( 5 ) states as follows : Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which anteaters the report by more than XXXX years. This account is a negative item and is reporting again without my permission which is against the law. I have been at my wits end with this identity theft in the worst fashion of anything i have ever experienced in my whole life XX/XX/2023 I was given my injury work comp settlement for approval of XXXX. Since before that I have been having issues with XXXX every month. My identity was stolen, my devices that should of been turned in to XXXX werent logged into their system in XXXX and someone somehow mirrored my devices and even my location to act to take over my newly acquired XXXX, my company XXXX where I am a sole proprietor. They would even dupe transactions and use cash app ( where I was investing In the stock market for the first time ) where I was being charged double, Triple and even signed up to things I never signed up for! The hackers are able to even spoof my ip, location, devices and make it seem like its actually coming from me! It feels way beyond my grasp of concept and my credit went from almost XXXX to a XXXX in less than a day! Ive been complaining and schools first credit union now says its too old to despute one major one was a balance of a XXXX in my account where I closed one checking to open a new one where they credited me my remaining funds than took it right back but the money disappeared! This has happened to the majority of my funds, atm withdrawals duped where yes some of which were mine but somehow the people behind it are using a technology far more advanced than any Ive seen before.. I know have people following me, Im literally scared, not knowing what these people are doing in my name. Even feels like they want to frame me for something or set me up because I am an inventor and came up with a invention to help stop human trafficking. Maybe not the most popular business plan, and another an electricity to run without plugging in to any plugs.. cars, phones, houses, you name it. They have taken everything and I can barely make my car payment. I feel now they even are responsible for me missing important court dates, altering my business plans, sabotaging my resumes, partners, stocks, my insurance, even my car! Somehow they are able to remotely access my car without having my key faub, they are tracking me, intercepting everything and anything I try to do! On XX/XX/XXXX, Schools First FCU, sent an email alleging, Schools First FCU Home Equity Line of Credit Statement, while claiming to be the owner of the claiming to have purchased the property on Auction under a fake created loan number. This fraudulent action scheme could have been carried out because I have a Home Equity Line of Credit with Schools First FCU, which I have been paying on since on or after XX/XX/XXXX, through a direct withdraw monthly payment schedule, dating back to XX/XX/XXXX and has not changed. On Friday XX/XX/XXXX, I found a Notice to Vacate my legally owned property. The Notice to Vacate appeared to be with a Void judgement from the Superior Court of California County of XXXX, with attached XXXX County Sheriffs Office, ( XXXX ) XXXX. No documents were attached to the Notice to Vacate to prove alleged ownership, by Schools First Credit Union, which can not be proven because the Judgement was void on its face. SFFCU acts constitute to unfair and deceptive practice. I own my property and I have the Grant Deed to my property to prove ownership. The Note the Deed of Trust Schools First claim to have obtained had no out standing Debt and the Deed does not transfer the property ; nevertheless, Tile or Deed of Trust together with the note by law can only be transferred by owner or it dedicated agent, and with documentary evidence to prove agency relation and certify the statute of fraud.

The Credit Union 's information : SchoolsFirst Federal Credit Union - XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, CA XXXX ( XXXX ) XXXX On XX/XX/22, I contacted SchoolsFirst Credit Union regarding unauthorized transactions totaling {$5700.00} of over 20 transactions of a few hundred from XXXX and appealed for a fraud claim. On XX/XX/22, I was contacted by XXXX from the fraud department and was asked questions if I was involved in an online scam where I had given away my information, but I told her I was not involved in anything XXXX. I told her I lost my wallet at work before, but that it happened over 1-2 years ago and the charges just came recently from XXXX which I had never used. I was then told I would receive provisional credit in the meantime as the investigation was ongoing. On XX/XX/22, I had to contact them again because they haven't replied back in over 10 business days regarding my fraud claim either by phone, email, or physical letter. I was told the fraud claim was denied on the basis that I logged into my online checking account and saw the transactions, but did not report them in a timely manner. However, when I pressed them if they had received contact or received any information with the XXXX company, they told me that the process takes time and they had not received anything regarding the unauthorized transactions that went through. I believe this Credit Union is under violation of Regulation E as they were pressing me in the interview about my negligence, but I did not do anything stated under Regulation E. 12 CFR 1005.6 ; Comment 6 ( b ) -2. I told them several times they were unauthorized online transactions, but they had closed my claim on the basis of not reporting in a timely manner and for having logged in to my account even though my account is protected and I am signed up for fraud alerts ( which all of these transactions were never flagged as being suspicious ). They did not give a reasonable investigation and closed the case prematurely having never worked with the company to solve the issues and also did not formally update me either email or physical letter. Provisional credit was also denied as a result.

On the week of the XX/XX/2020, I received information that my credit union, XXXX XXXX XXXX XXXX, would be merging with XXXX XXXX on XX/XX/2020. Included in that information was my new debit card -- I would later be informed that 40 checks and a guide for switching over should have been included, but they were not. On Friday the XX/XX/2020, after exhausting available options -- registering my new debit card online and in the ATM -- I went to a branch of School 's, now XXXX XXXX, to talk to a teller directly. My debit card was going to expire, and I would be cut off from all access to my bank. The teller discovered I had not received the transition information, and printed this out in person. I asked what would occur on the XXXX of XXXX, since he refused to authorize the new debit card, and my old one would expire -- he explained that the card itself would continue to work until the new card was authorized, and confirmed this with his branch manager ( lies told by employees, myself and dozens of other users in the thread we started have discovered ). Assured, I received my new member information and went home. I followed the instructions on the sheet to set up my account before the switch ; not only did the website deny I was a member, many of the links were not working. I discovered that the website and all their banking systems would go offline on Sunday, the First, when my bills were due. I watched in horror as a stream of declined card notifications rolled in, and when I started asking around, I realized I was not alone. I had to get someone else to pay my phone bill, just so I could call around, but all the bank 's phone lines are down as well. Someone was even trapped at a gas station ; this is unacceptable. No bank or credit union should be allowed to be this incompetent, cut hundreds if not thousands off from their money, maintain radio silence, and pick the worst possible date to do so. They should also not be allowed to lie to me and others as they had -- they're a credit union, not a XXXX XXXX. This is something they've handled terribly and I want some scrutiny and someone looking into this.

I received a Personal Loan that ultimately was Constructive fraud. The loan was suppose to be placed into my checking account and I would pay off the credit cards that I choose called peer to peer. But instead Schools First Federal Credit Union made it a Credit Card Rewrite Loan forcing paying off the cards themselves. They misrepresented the loan they gave me in writing. I got loan 81 XX/XX/2018. . They also were lying stating that they only do loans up to 48 months when they do them for up to 60 months. I have XXXX XXXX which was for {$6800.00} with interest is {$7900.00} at 7.45 %. My loan documents say nothing about a Credit Card Rewrite loan. I paid it down to {$5400.00} so far. The loan documents are not accurate do to the CONSTRUCTIVE FRAUD. I always pay. Never late! I was also offered Overdraft Protection on my checking account with them which I was told was not a line of credit. However, if I had insufficient funds it had a 3 % fee which does not affect the credit score. And I was also told the bank does not send out disclosure notices on it. When I finally used it several months later, my statement showed a 12.90 % rate for the {$1300.00}. I called and asked several times for the disclosure notice to be mailed but it was never mailed. Another bank I do business with sent me a disclosure notice on their Overdraft Protection today. It is not a line of credit. The overdraft protection above turned out to be a line of credit from SFFCU. CONSTRUCTIVE FRAUD AGAIN. Again, I was not accurately informed again. It was not for insufficient funds. Also, I was offered a line of credit at 8.49 % elsewhere at {$5000.00} at the same time as the {$1300.00}. XXXX offer. Why would I take {$1300.00} at 12.90 %? This is Constructive Fraud or IMPLIED DUTY OF GOOD FAITH TODAY SFFCU offered me {$20.00} to correct the interest of {$6.00} on the overdraft protection with new loan options which will r hi n my credot score. However, the issue is they gave me a loan lying about what it really was and deceived me on loan 81 also. I would not have taken it. I will need an email or fax to send documents.

Hello, I am an actual proud customer of SchoolsFirst Federal Credit Union and even have a car loan with them that I purchased XXXX week of XXXX of this XXXX. I disputed several times as I was contacted by the bank and saw that I had a personal loan in the amount of $ XXXX on my account that I did not authorize to open. For months, I have been in contact with XXXX and tried stating the truth to them that my boyfriend and now ex opened the account with no income and put my information down to obtain the loan. He has also let me know he does not plan on paying back the loan as I tried to ask him to pay on it so it does not affect my credit. I have disputed this with all 3 of my credit bureaus in XXXX and XX/XX/2022 and even submitted a payment to the bank on XX/XX/XXXX when I was surprisingly contacted by them for late payment. I have also presented to both the bank and all 3 credit bureaus fraud and attempts by my ex to include a restraining order I have had on him since XXXX of this year to stop all communication. XXXX has instructed me to dispute with the credit bureaus as well as file fraud charges. Currently, there is also an open criminal case of domestic violence against him as well as he continues to harass me. I have also re-submitted the disputes stating litigation and fraud for this loan. I have had thousands of dollars stolen from me by this man and this loan is still active. He is now stalking, harassing and even threatening me to pay him {$8000.00}. I have never had an issue with my bank and have always maintained a great relationship with them. I have also had several accounts that were opened illegally by XXXX XXXX to include a pet wellness account that I had ( after several months ) finally get canceled once I shown the restraining order and attempted accounts opened in my name for him to receive loan money. I have been a victim of check and ATM fraud. Someone is using a fraudulent debit card to commit check and ATM fraud on my checking account. On three different occasions, someone used a debit card with my name ( counterfeit debit card ), deposited the checks into my bank account, and withdrew money from my checking account. I did not do or authorize all transactions. My debit card has always been with me, and my debit card information nor PIN has been shared with anyone. A fraud claim has been reported and opened with my bank SchoolsFirst Federal Credit Union, requesting a credit of {$3000.00} back to my checking account. The bank has a video of the person committing the crime with the fake debit card ( they have confirmed it is not me in all ATM videos, but a known scammer to SchoolsFirst Federal Credit Union ). The bank also has all the names of the person names ( payers on the checks ) on the fraudulent checks used. I filed a police report with the XXXX XXXX Police Department for Check & ATM fraud, identity theft, and forgery ( case # XXXX ). The bank is still holding me liable for the fraudulent {$3000.00} transactions done without my authorization and knowledge on my checking account.

on XX/XX/2016 I enrolled into a XXXX Counseling XXXX for all my credit cards. I enrolled through XXXX. XXXX of my credit cards with Schools First FCU was enrolled into the program and accepted by them. I was to make reduced payments of {$170.00} effective immediately. Around XX/XX/XXXX-XX/XX/XXXX I began to receive collection phone calls on my account from Schools First FCU regarding my Credit Card Account. I received a voicemail that it was imperative that I returned the call back to them. I phoned back their office and spoke with a collections representative regarding my account. I also let her know that I was enrolled into a consumer debt management program. She stated that she had that information on file, but that she needed to speak to another department. I also informed her that a payment of {$170.00} ( proposed payment was sent to Schools First on XX/XX/XXXX ). She re-assured me that she was looking into the issue and not to worry. I also asked her to make sure the account was not going to be reported as past due to the credit bureaus or any late reportings. After she came back to line doing her research she told me that the credit union had not properly processed the information and in fact after speaking with that department my proposal was accepted and good to go. She also assured me that everything was taken care of and I was not to worry about anything. I should not get any more collections calls and everything was good to go on my credit card account. Now as of today, Schools First FCU is reporting my account as beyond 30 days past due to the credit reporting agencies and providing false information when in fact I was told something different on XX/XX/XXXX and XX/XX/XXXX. Also my XXXX spoke with Schools First Federal Credit Union on XX/XX/XXXX and they confirmed as well that everything was good to go and the proposal was accepted.

I have a car loan through Schools First Federal Credit Union and have had difficulty dealing with them in terms of receiving billing statements and written communication about the status of my account. In addition, they have given me misleading information over the phone which has led to the placement of my vehicle into " repossession '' status. I also have attempted to rectify the payment issues and have made several calls to their customer service department, but the representatives are not helpful and appear to be determined to repossess the car regardless of my attempts to bring the account current. I use the car to get to work and depend on the car as my sole form of transportation. I also utilize the vehicle for advertising purposes for a travel agency business and the vehicle currently has a " wrap '' for XXXX on it because I also use this vehicle to advertise for the travel business. The actions of School First Credit Union have caused me a great deal of XXXX frustration and my requests that they communicate with me through mail and written statements have been ignored. When speaking with their phone representative XX/XX/XXXX, I specifically asked when I needed to send in a payment, and was assured that if I mailed a payment in before XX/XX/XXXX, that it would be credited before the 60-day late period. I also mailed a payment to them on XX/XX/XXXX which would have put my account within the 30-day late period if they had accepted these two payments. I am anticipating bringing the account current right away but because they will not accept my payments or honor what they indicated to me on the phone, I am unable to do so. This has caused a great deal of emotional distress and places my ability to work into jeopardy. In addition, my parents are both deceased and I am divorced and have no other source of financial assistance.

I had an existing vehicle loan with schools first federal credit union when I purchased extended warranty from them for this vehicle. On XXXX XXXX I purchased the extended warranty platinum plan for XXXX miles for approx {$1200.00} which was added to the existing auto loan. In XX/XX/2023 the vehicle broke down. Upon reaching out regarding warranty an info email was sent to me. This email reflected incorrect start and expire mileage for the vehicle warranty. It was alarming because it appeared the warranty had expired based on mileage. I followed up and the company indicated that was the mileage reported by the bank at initiation of the contract. I would need to have the bank make the correction on their end. It seemed an easy fix. The bank confirmed correct mileage using car fax info and submitted the request only to discover i would have not been eligible to even purchase this plan because at the time the car mileage was above the cut off for the platinum plan. This is resulting in a {$500.00} increase to backdate and adjust to the gold plan which the warranty company agreed to. The gold plan is only covering about half the cost of repair -which I anticipated based on my purchase of the platinum plan that i would only be responsible for the deductible. With the comfort of my full warranty for XXXX miles i made the choice to keep this vehicle rather than trade it at which time the value of my car was very high. Now the value is lower and XXXX left with high rental car cost and {$2000.00} out-of-pocket repair. I feel the bank is responsible for this cost since I was unable to make informed decisions at XXXX XXXX of warranty purchase and subsequently since with regard to keeping the vehicle or not based on their error. The bank has denied request for reimbursement of out of pocket cost less the deductible. Thank you

In XXXX I refinanced two mortgages with my credit union, Schools First Credit Union. At the end of the refinance process I only received closing documents for the one of the home but no the second home. When I inquired about the missing documents I was told to wait because of course the County of XXXX XXXX was backed logged. I wanted a complete year. I notice that only the taxes on my primary home was paid in XXXX of XXXX, so I inquired about the second home not being paid. They ignored my concerns so I paid the complete bill myself. It is only then that they tried to come behind and pay the same bill ; however, my payment cleared first. She informed my that they would put the money into my checking account in 5 days. Instead the institution took an other withdrawal from my escrow account and sent it to the County. Schools First was given proof that XX/XX/XXXX and XX/XX/XXXX taxes had been paid in full by in XX/XX/XXXX by me. Their mishandling of paperwork and my funding has caused emotional and financial hardship. It is giving me XXXX and I can not catch a break with my bills and spending because they have not refunded me the money. It seems that their institution is penalizing because I inquired about the missing documents at the end of the refinance. Working with California Mortgage Relief and Schools First, my lender. Schools First engaged in a pattern of lies and deception for almost a year as they scheduled 5 foreclosure sales on my home without informing me of a single one of those sales. " Lost '' my paperwork for the program XXXX times ( not an exaggeration! ), then used these " losses '' of paperwork to schedule even more foreclosure sales. " Lost '' recorded phone calls proving I had an agreement with them. " Lost '' details of other numerous phone calls I made to them. I filed a complaint with the CFPB - their response? " Why, we here at Schools First are *wonderful* at customer service. XXXX XXXX is just a grouch and he complains all the time ( by the way, almost 40 years there and I have never complained before! ). We do everything right and he's just a meanie! '' As of now, the California Mortgage Relief allows {$80000.00} to catch up. I was {$36000.00} behind and they illegally added late fees and interest ( against the law when the amount is in dispute ), ballooning it to over {$75000.00}. That leaves {$5000.00} for the 2nd mortgage. I applied for that {$5000.00}. I sent Schools First screen captures showing that I had applied for the rest of the funds to be applied to the 2nd mortgage. On XX/XX/21, I sent SchoolsFirst FCU a letter stating the following information pursuant to 15 USC 1692g ( b ) : The alleged debt of {$3900.00} is disputed. They received the letter on XX/XX/21. Per complaint XXXX first agreed once again to remove negative information off credit report. And again they have failed to do what they have promised. This should be investigated. Upon working on our taxes on XX/XX/XXXX, we discovered 32 withdrawls from our checking account, to XXXX XXXX, on the dates of XX/XX/XXXX and XX/XX/XXXX, totaling {$380.00}. I did some research and looked at all of our households XXXX IDs. I found the charges for in-app purchases for the game called XXXX XXXX XXXX 2 over a three day period from XX/XX/XXXX- XX/XX/XXXX. I believe these purchases were accidentally made by my XXXX year old son. These purchases were unauthorized and quite excessive. I did not receive notification or emails regarding these purchases, nor did my bank flag these purchases as possible fraud. As soon as I discovered these unauthorized purchases, I contacted XXXX to ask for a refund. The XXXX rep, XXXX, tried to reverse the charges but said she could not do it because it had been more than 90 days. She recommended that my bank might be able to help me. I called my bank and they were unable to help me, since they said they tried to do a chargeback to XXXX, but that this would not work as it has passed the 60 day period that XXXX guarantees. Received an email from my credit union on XX/XX/XXXX XXXX Schools First of California- that my account email had been changed. Went to check my account and someone had been using XXXX to connect to my Savings account, evident through microdeposits and withdrawals. I tried to freeze the accounts with my credit union, but they said they could change all of my accounts except the one that had been compromised, because it held my " stake '' in the credit union. They assured me they would cover any losses, and put a stop payment on XXXX, and told me to keep an eye on it. A few days later there were new micro deposits and withdrawals from XXXX. I called the credit union again, and after several hours on hold they told me someone would call me back within five days. I found this insufficient action to protect my life savings, so I asked them to close my accounts. They wired the money to a new account I had opened that day and told me that confirmation of the closed accounts would follow in the mail. I'm not sure if they looked into who accessed my account, but the email address they used was XXXX. They also email bombed my email address the same day they changed my email address in my bank account. I'm hoping my identity information has not been further compromised.

SchoolsFirst uses their unique position as a branched bank to execute XX/XX/XXXX collection tactics, while skirting FDCPA and FCRA laws. Aprox. 7 months ago, my spouse visted the XXXX CA branch to apply for an auto loan for our daughter. This was an individual application with no co borrower. For reasons unknown, the agent told my spouse that I owed the bank money. My spouse was confused because she did not solicit any information regarding any accounts, balances, disputes or alleged debts not associated with her legal obligation of repayment. My name was not given, and I was referred to as " her husband. '' The agent had no idea of our legal marital status, and assumed that we were still married. My retirement account hardship withdrawal is being delayed and processed in a discriminatory manner by a mean-spirited manager at my employer 's third party administrator, Schools First FCU. I originally submitted the hardship withdrawal request request to the custodian of my retirement funds, XXXX which received the same documentation ( attached ) and they issued an approval one hour later by Facsimile. The approval is noted on the first page of their facsimile. I placed an order with XXXX on XX/XX/2021 through their website in XXXX as we were vacationing in XXXX at the time. The order was immediately cancelled after being placed realizing that the shipping address being displaced on the order half in XXXXh and half in XXXX. I have provided the financial institution with copies of the orders cancelled with XXXX, and a letter explaining in detail how the situation occurred. On XX/XX/2022 in the early morning after checking my bank account I noticed multiple fraudulent transactions one after another from a merchant outside of the country. The total of the transactions was about {$5400.00}. My Credit Card Account ( Schools First Credit Union ) was sent to the credit bureaus as a 30-day late in XX/XX/2022 which took my score down XXXX points with XXXX. I was issued two cards one with a $ XXXX limit and the other $ XXXX limit. One of the cards was compromised and a new one needed to be issued. After receiving the new card, it was not automatically set up on auto payment as the one it was replacing. Unbeknown to me their new website would not roll over the same auto payment information from the previous card or let a member set up auto payment anymore. Therefore, I called to get it all straighten out. I spoke to a person that told me the best thing to do was to combine the two cards that way it would only be one card. So of course, I agreed, then come to find out they kept the card that had previously been reported 30 days late. For some reason they are the only ones that can process automatic payments on their side. I disagree to have a 30-day late reported on my credit reports, due to it was not my fault they upgraded their system and without my knowledge my cards were no longer on auto pay.

I disputed an error on my credit report previously. It was fixed at that time. Now XXXX has again messed with that same account and has this old, closed, satisfied account marked as LATE as recently as XXXX/XXXX/XXXX!!! The balance of this account has been XXXX since XXXX XXXX. It now shows a balance of {$4500.00}. I tried to dispute the error with this account AGAIN and I am told that I can not dispute it because it has previously been disputed. I called customer service and the employee became HOSTILE towards me. This account is WRONG. it is not late. It was satisfied and closed in XX/XX/XXXX. I want the account removed immediately and permanently. Even if it were to be fixed AGAIN, I no longer trust XXXX to not change it back. On XX/XX/2022, between XXXX to XXXX, I got a call from someone claimed that they are XXXX California XXXX that I need to make a payment of {$190.00} through XXXX or they will shut off my electricity with 30 minutes. So I did. Then they transfer me to their " supervisor ''. The " supervisor '' said the {$190.00} is not enough to stop them to cut off the electricity. The lowest is {$280.00} otherwise the electricity will shutt off still with 30 minutes. So I had to pay the {$280.00}. I had fraudulent charges on my account due to my card getting stolen and I potentially knew who the suspect may have been. I reported it to my bank gave them all the information I had and they asked that I do a police report. I did the police report answered any questions they had and that was it. My bank tells me Im denied because I didnt name the potential suspect to the police. They also said there were no errors on my access code to my debit card. I called back explaining that I believed the information I gave the bank and the police were sufficient for them to work together to look at cameras to see who may have actually used my card. This account is has been showing on my consumer credit reports as a charge-off for 7 years plus. Ive been trying to dispute this issue for 2 years now. It is illegal to furnish income on a consumer report. A charge-off, according to the IRS, is income and you must file a 1099-C. They can't charge it off then report it to IRS. Wrote an email to SchoolsFirst Credit Union after I received by statement saying I qualified to skip a payment ( which they did not include in the statement ), but that I would continue to have interest accrue. This does not help - a deferred balloon payment with compounded interest is no help. The statement also proffered that they were 'UPDATING '' a " new design ''. I had asked for help in XX/XX/2020 because of COVID-19, schools were closed, so there were no paychecks since XX/XX/2020. I purchased my house in XXXX of 2019. I signed the contract with agreement to the established predetermined payment. I bank with Schools First Credit Union for many years. I have a personal and car loan through them. I do n't normall look at the transaction but today I did. My payment is set up to pull from my checking account automatically. The banks allows a 15 day grace period before the payment is considered late. Today I discovered that the day after the payment is due if the funds are n't able to auto draft they charge a {$20.00} NSF fee even though they have a day grace period. Can they legally do that? What about a 15 day grace period? Between both loans I have been charged about 10 times ( {$200.00} ) just this year. I have no idea how long this is happening. Schools First Credit Union has issues with their insurance system. I upgraded my home insurance and their system is having issues recognizing that I submitted proof of insurance several times even though they have even notes in their system showing that I have submitted proof of insurance. To whom it may concern, My wife and I were trying to do a loan modification with our lender, Schools first Federal Credit Union, after receiving forbearance. My wife was laid off and we were getting behind on our payments. We still are behind on our payments and last year when we reached out to Schools First we believed that the Loan Modification was going through the process. Well come to find out all that Schools First did was defer the payments. When we talked to our lender and mentioned to them that we really wanted to do the modification so we can lower our payments. Debit card was stolen earlier this year and theif apparently knew my PIN number ; Schools First Credit Union honored the claim and refunded my money. I notified the bank of my missing walled within 8 hours. I lost my new debit card ( new PIN ) and thief, somehow, used my PIN ( according to the bank ) and the bank will not honor my claim. In 2016 I was in an accident in my finances XXXX through schools first credit union. I was having issues with 2 insurance companies and it took a while for the pay off to get authorized.
