Sarma Collections Incorporated never provided any valid evidence of debt within the 30-day time frame from a dispute filed from the alleged debtor. I requested information from the creditor by affidavit ( from a commissioner of the court ) and the company didn't provide any information requested but a printed bill ( with the missing government state identification that must be used to verify debtor ) nor did they remove any debt from my credit report. I have already informed this company that I do not want to contract with their company, not do I have a law and binding contract with their company. ALSO 1 ) Please provide proof of notice that was given that was to be submitted Within five days of the collector 's initial communication, it must send you a notice include the amount of the debt, name of the creditor, and notice of your right to dispute the debt within 30 days. [ 15 USC 1692g ] 809 ( a ) A debtor must be allowed to validate the debt that they are being called on. Once a collections agency notifies the individual that they owe a debt, the individual has 30 days to validate or dispute the debt. The collections company is not allowed to continue collections procedures until after the debt is validated or disputed. 1. Please attach a copy of any signed agreement alleged debtor/claimant has made with debt collector, or other verifiable proof that debtor/claimant has a contractual obligation between the debtor and Sarma Collections Incorporated to pay debt collector which will give your company jurisdiction to report this debt on my credit. NOTICE OF DISPUTE ; DEMAND FOR VALIDATION AND PROOF OF CLAIM To Whom It May Concern This letter is being sent to you in response to a computer generated, unsigned letter received by Claimant from your offices. Be advised that your claim is disputed and validation and proof of claim of the disputed debt is requested in accordance with the Fair Debt Collection Practices Act, 15 USC 1692 and as amended by adding the following new Title 8 USC 802 et seq., and the Fair Credit Billing Act, 15 USC. 1666 et seq. All of which work in conjunction with each other, including the Truth In Lending Act ( TILA ) 15 USC 1601 et seq. It is not now, nor has it ever been, my intention to avoid paying any obligation that is lawfully owed by the Claimant. In order to make arrangements to pay an obligation which may be lawfully owed, please document and verify the debt by complying, in good faith, with this request for validation and return it to me, within thirty ( 30 ) days of receipt of this letter. This is NOT a request for verification or proof of Claimant mailing address, but a request for VALIDATION and PROOF OF CLAIM made pursuant to the above-named Titles and Sections. I respectfully request that your offices provide Claimant with competent evidence as per the attached Declaration and Proof of Claim that I have any legal obligation to pay you the unsubstantiated alleged debt. Furthermore, you shall cease all verbal communication. No phone calls to the Claimant. Due to this fact ; if any negative mark is found on any of Claimant credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you and your client for the following : Violation of the Fair Credit Reporting Act Violation of the Fair Debt Collection Practices Act Defamation of Character Violation of United States Code TITLE 18 PART 1 CHAPTER 63 1341 ( Mail Fraud ) This debt is considered to be invalid until I receive proper validation and your offices provide Claimant with proof of claim of the disputed debt. Your offices have 30 days to produce the required documentation in accordance with FTC guidelines. During this validation period and proof of claim, if any action is taken which could be considered detrimental to any of Claimant credit reports, said action will be considered a dishonor and cause the self-executing contract portion of this notice to be implemented. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated. If your offices fail to respond to this validation and proof of claim request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from Claimant credit file and a copy of such deletion request shall be sent to Claimant immediately. Validation of debts [ 15 USC 1692g ] ( b ) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such validation and verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. The nature of my compliant is due to a series of false reporting and underhanded tactics XXXX have committed over the last XXXX or so years which have a negative impact on my financial life. On XXXX XXXX , XXXX I contacted XXXX because I never received any notices of my account and to discuss a payment plan. A representative in their company told me that the account was no longer in their possession and that if I wanted to make a payment I needed to contact SARMA, a third party collection agency. I got in contact with XXXX XXXX XXXX who was in charge of my file at SARMA and she stated that I owed {$2900.00}. I asked if that was the correct balance because XXXX reported {$4100.00} on my credit reports. She stated that the system only reflected the {$2900.00} balance and that if I paid it, it would satisfy the account and considered " Paid in Full ''. After saving enough money I excitedly called SARMA on XXXX XXXX , XXXX and made a full payment of the {$2900.00} to satisfy the account and on XXXX XXXX , XXXX I received my " Paid in Full '' with {$0.00} balance due from XXXX of SARMA. In the end of XXXX , XXXX nor SARMA had not updated the account and I submitted a dispute to get the status updated due to my work in the military and the importance of having a clean report as possible. Equifax and Experian notified me that the account was " Settled for Less Than Owed ''. I contacted XXXX to receive clarification. They stated that I still owed them money yet my credit report shows a {$0.00} balance and that I " settled '' on the account with SARMA. I told them that I never requested or authorized a settlement with SARMA through voice, letter, nor email and that giving a consumer the wrong pay-off balance is deceptive. Nobody in XXXX got in contact with SARMA or vice versa to clarify or verify any information. After speaking to SARMA, they told me that the account is considered " Paid in Full '' still. Neither company however were willing to divulge whether there was an Assignment of Debt or Purchase of Debt to shine light on this dilemma and to who has ownership of my account with the authority to report on my credit with what should be the correct status. Because of this inaccurate reporting, my credit score took a massive hit and my XXXX XXXX re-investigation with the XXXX and XXXX came to a screeching halt in spite of me reporting this collection account to them. This is not the first time however that I have had issues with XXXX in regard to this loan. In XXXX XXXX , I called XXXX to take the vehicle back because the transmission had ceased to function and I did all I could to get it fixed to no avail. The representative whom I spoke with at the time stated for me to make XXXX more final payment and that account would be closed after the car had been picked up, which was XXXX weeks later, and they would notify me of sale and remaining balance on the car. All the information needed to be gathered first in order to create a payment plan and not pay more than what was left. We mutually agreed to have to car picked up on XXXX XXXX , XXXX and I signed a " Voluntary Surrender '' document to send back to the bank by the tow man who picked it up. XXXX kept reporting late missed payments on my credit report in the months following while remarking that the vehicle was " Involuntarily Repossessed ''. I called after seeing such a mark on my credit, the representative in their " Asset Recovery ' ' department told me in a demeaning tone that " since the car was in their possession at XXXX point is considered an involuntary action ''. The next instance, again was the fact that my account was in SARMA 's possession. XXXX never notified me about this conveyance nor did SARMA contact or mail me any information of this collection until I reached out to them. Again neither company could tell me whether the account was assigned or sold and the credit reporting agencies failed to look into it in accordance to the FCRA Section s 611 and 623, and 15 U.S. Code 1692L. Attached to this complaint is the following : 1. The balance sheet via fax, receipt of my payment XXXX . from XXXX of SARMA including the message sent to me. 2b. " Paid in Full '' letter via email that was attached XXXX . Confirmation of my payment to SARMA 3 . An archived Equifax report dated XXXX XXXX , XXXX showing the " Involuntary Repossession '' remark and the additional late payments from XXXX XXXX til that month. XXXX . Lastly is the document I signed reflecting the surrender on XXXX XXXX , XXXX . Thank you

I am writing to express my deep concern and dissatisfaction with XXXXXXXX XXXX handling of my consumer request and their apparent disregard for federal law, specifically the Fair Credit Reporting Act ( FCRA ), as it pertains to my request for the removal of inaccurate accounts from my credit report. The specific account I am referring to is as follows : ACCOUNT : XXXX XXXX XXXX - {$17000.00} - XX/XX/XXXX INQUIRY : SARMA XX/XX/XXXX I have repeatedly informed XXXX that the information contained in this account is inaccurate. The character of the account is incomplete, and XXXX continues to report a charter amount that is both incomplete and inaccurate. It is essential to emphasize that information on a consumer report must maintain maximum possible accuracy, as defined by federal law. Accuracy, as per 15 USC 1681e ( b ), is explicitly defined as being " correct in all details ; exact. '' XXXX XXXX reporting of the details of this account falls short of this standard, as they are neither correct in all details nor exact in terms of the amounts reported. Furthermore, XXXX is mandated by law to comply with the FCRA, as stated in 15 USC 1681. One critical provision, 15 USC 1681i, requires XXXX to notify me of the results of any reinvestigation. XX/XX/2020 I began shopping around for a vehicle and I visited 3 different dealerships. I visited XXXX XXXXXXXX XXXX XXXXXXXX XXXX, XXXX, and XXXX. At XXXX, I was approved for a new car. Upon looking at my credit report, all three dealerships ran my credit through several credit approval companies. I have a total of 46 credit inquires across the three credit bureaus within a 7-day time frame. XXXX XXXX XXXX XXXX XXXX XXXX placed a hard inquire on my credit 22 times. I sent letters to each of the individual companies and received a letter stating I agreed to them running my credit by providing the merchant my driver 's license. I did not agree or approve these companies to run my credit 46 times through several different companies, including those I have never heard of. XXXX XXXX could have used the first inquire as it remains available in the system for 30 days. I was preapproved through XXXX XXXX and presented my preapproval to each of the dealerships. Unfortunately, all three of the dealerships ran my credit through several agencies without my consent. I did not authorize these companies to run my credit or view my credit report. I have contacted these companies several times to request the removal of the inquire and even hired a law firm to help, but they will not budge. I also contacted the three major credit bureaus and I did not receive a response. 46 inquires across 3 credit bureaus within 7 days are truly excessive and violates several consumer laws. XXXX is refusing to refund the amount of XXXX to us, as this would be an over payment, plus we already received a pay off letter from the debt collector. After reviewing Texas Law regarding Debt collection they appear to be in violation being of failing to give information on regards to actuall who holds the debt, over-charging, and presenting false information regarding balances as XXXX in the collections department will not tell me the total amount XXXX that was charged-off. I immediately contacted Sarma to see why this was added to my credit reports and she did not provide with sufficient response. I told her that XXXX should be taking care of the bill and you should remove this debt until you give XXXX some time to look into my claim and pay for it. This complaint is in reference to SARMA!!!!! I disputed the SARMA collection account through XXXX on XX/XX/2019 ; however, I have never received a response from XXXX. I have sent two certified letters to SARMA and they are not being delivered for an unknown reason. I have a medical collection with Sarma for {$130.00}. I didn't recall getting a bill from the original medical facilities, XXXX XXXX of XXXX Texas, but I did go and some of my medical expenses were not fully cover by my insurance. So it seemed reasonable that this was truly my debt. I called Sarma and asked if I paid this debt if they would take it off my credit report. I've called three different times and have spoke to the same agent each time, XXXX XXXX. The first time I called after asking for the deletion of the account from my report she 'they do not delete accounts ' and promptly hung up. I thought this was very odd since I have paid other collection agencies and they were more than happy to take my money in exchange for deletion. The second time I called she was extremely rude. I submitted a dispute to the following credit Agency : XXXX They are incorrectly reporting a medical debt collection under my name and social security number. The collection happens to be under a person with the same first, last name and DOB as myself. Her address is also being reported incorrectly under my social security. I called the Sarma Agency before submitted the original request through XXXX and they could not find it because the social securities are different and I also called the Medical Doctor and they have no record of my name and social security number. I notified the building manager that I was leaving. During the process of me leaving the complex called XXXX and had my lights turned off, went into the apartment took items that were mine and trashed the place with the spare key. XXXX sold my credit card debt to Sarma. I negotiated a 50 % settlement. I would make XXXX payments of {$100.00} a month for XXXX months with a balloon payment on month XXXX. At the time, I was told that the balloon payment could be negotiated into a new payment plan if I was not able to come up with it. I called in XXXX again in anticipation of the balloon payment approaching in XXXXXXXX XXXX 2022. Again, I was told if I could not make the balloon payment I could negotiate the balance. On XX/XX/2019 a company that goes by the name Sarma, location XXXX XXXX XXXX XXXX XXXX, TX XXXX had illegally pulled my credit report for a mortgage broker that never obtained my consent to pull my report. I received a negative credit score, so I disputed the collection because I did not even know about this amount owed or to who. Impacting my credit was the first I heard of it. I currently make payments on the account that is supposed to be delinquent and is showing up as a negative on my credit report. At one point, I tried to call and make a payment to the hospital and after 3 weeks of phone tag I forgot to call back. The following month I forgot about the bill and by the time I remembered I called and they had already sent it to collections. I have made consistent payments other than that incident. This is also a medical bill, and it is against the law for a hospital to turn over that information to a third party.
