Supreme Court Document from XXXX XXXX XXXX included : XXXX See also Document Rehearing Denied Details below : Today, Saturday, XX/XX/XXXX, I received by regular mail 2 letters from XXXX XXXX XXXX XXXX related my complaint number XXXX - XXXX filed through the C.F.P.B. about the incorrect credit reports made by XXXX Santander Puerto Rico over the past years regarding my 2 accounts I paid to them as agreed, no matter, Santander Bank never wanted to recognize the facts at the 3 main credit bureaus unfairly affecting my credit report scores at the 3 main credit bureaus, and earning the unfair denial of the first option for a simple consolidation loan at XXXX XXXX XXXX XXXX, to which I applied last XX/XX/XXXX, and the application number ends in number XXXX as shown within one of the 2 letters from XXXX XXXX XXXX XXXX XXXX.
This 2 letters from XXXX XXXX arrive nearly 5 months after their response to my C.F.P.B. complaint of XX/XX/XXXX, but the main reasons for this new complaint are not only to request that XXXX Santander updates my credit report regarding my Certified Payment Agreement for the XXXX MasterCard Credit Card I paid directly only to Santander Bank XXXX XXXX XXXX ; Is to emphasize the following facts, disregarded by Judge XXXX XXXX at the local U.S. District Court for the District of Puerto Rico, then by the U.S. Court of Appeals for the First Circuit in XXXX, MA, and then by the Supreme Court of the United States, under my Petition number XXXX last XX/XX/XXXX and on XX/XX/XXXX : This facts are the following : 1. Judge XXXX decision prevailed through the 3 federal courts system no matter he clearly wrote and quote : The Court does not weigh the facts Please refer included Document number XXXX Filed XX/XX/XXXX Page 2 of 10 Judge XXXX final opinion and judgment HAS NOTHING TO DO WITH THE VERIFIABLE EVIDENCE I SUBMITTED : FIRST, TO THE SAME SANTANDER BANK, THEN TO THE 3 MAIN CREDIT BUREAUS, THEN THROUGH THE C.F.P.B.TO THE 3 CREDIT BUREAUS, AND SANTANDER BANK AT THE SAME TIME, THEN TO 3 FEDERAL COURTS, HAVING THE SUPREME COURT AS ONE OF THE LAST RESOURCES, BUT THEY SEE CASES BY PETITION, AND RECEIVE BETWEEN 7,000 TO 8,000 PETITIONS EACH YEAR AND DECIDE TO HEAR ONLY A FEW.

There is another federal agency that investigates frauds committed by business and government professionals, and this includes the federal judges, no matter how complex, please see https : //www.fbi.gov/investigate/white-collar-crime 3. I really do not see what the complexity is in this specific case, because : - Santander Bank is not a collection agency, but the original financial institution where my credit for the Santander Personal Loan and Santander XXXX XXXX Master Card were originally granted.
All my constant communication, since XX/XX/XXXX before a problem started affecting my payments with Santander Bank was maintained since a discrimination problem at work affected my regular monthly payments to this 2 referenced accounts, through the granted payments extensions for the loan, which require a payment, and for the credit card also through their Central Office Bank Officer named Mrs. XXXX XXXX back then, and this evidence was presented to Santander, the credit bureaus, the C.F.P.B., and to the 3 federal courts ; See evidence included, original communication sent from Santander XXXX Branch as XXXX XXXX, and Scan 3 hand writing shown by female Santander Officer, and one of the many faxes sent from Santander XXXX XXXX XXXX Branch not all communication with Santander included.
- In the case of this 2 accounts with Santander Bank, I never decided to pay no attentionto the Bank and this problem, like other people that pay no attention and banks had no other choice than to sell the accounts to a collection agency : - that was not the specific case here at all : Santander Bank received constant evidence on my part of the status of my situation with my employer, which ended in a discrimination complaint I filed, and also ended at the 3 federal courts, but also all the payments extension and agreements were made and paid directly to the same Bank where the credit was originally granted, Santander Bank : 4. I was able to re-start the regular monthly payments back in XX/XX/XXXX, more than 4 years 4 months ago, but, Santander Bank decided not to specifically report all this to the 3 main credit bureaus.

Instead, Santander Bank decided to report this 2 accounts as under collection, charge off, paid after loss, but all that is false : the accounts remained at Santander Bank, the original institution, after all this and by the time my regular monthly payments re-started : none of this 2 accounts had to go to a collection agency, because both were fully updated and paid as agreed at the same Santander Bank : SANTANDER BANK NEVER HAD TO CALL A COLLECTION AGENCY FOR THIS 2 ACCOUNTS : THEY DID IT BECAUSE THEY TRIED TO JUSTIFY SELLING MY CREDIT CARD TO A COLLECTION AGENCY IN SPITE OF MY CONSTANT COMMUNICATION WITH THEIR OFFICER XXXX XXXX, TO TRY TO RECUPERATE MOST OF THEIR MONEY FASTER ; - NO MATTER THEY HAD TO IGNORE ALL MY PAYMENTS EXTENSIONS, GRANTED BY THEM!! MY CERTIFIED PAYMENT AGRREEMENT, AND THAT I FULLY UPDATED WITH THEM THE LOAN BACK IN XX/XX/XXXX UNTIL THEY, SANTADER BANK, DECIDED TO PROHIBIT MY REGULAR MONTHLY PAYMENT TO THIS SAME LOAN BACK IN XX/XX/XXXX, TO MAKE THIS SAME LOAN ACCOUNT UNFAIRLY APPEAR AS FAILED TO PAY, WHEN THAT WAS NOT TRUE!!!
- BY THIS TIME, THIS SAME LOAN WOULD BE 8 MONTHS TO BE FULLY PAID WITH A FINAL ADDITIONAL PAYMENT NOT SHOWN ON THE SAME LOAN NOTEBOOK WHICH IS USUALLY MUCH LOWER THAN THE REGULAR MONTHLY PAYMENT 6. NOW, SANTANDER BANK IS ALSO FAILING TO REPORT ON TIME THAT THE CERTIFIED PAYMENT AGREEMENT FOR MY CREDIT CARD ENDED EARLIER, WITH THE LAST 2 REQUIRED PAYMENTS MADE IN JUST ONE LAST XX/XX/XXXX. As I type this, XXXX XXXX, Saturday, XX/XX/XXXX Santander Bank has not reported this to the 3 main credit bureaus.
This same Santander Jet Blue Master Card Credit Card is paid in full since XXXX XXXX, XXXX, but they do not care to report that on a timely manner after all this, presented once again here. See evidence included.

Yesterday, Thursday, XX/XX/2019, I decided that due to the incorrect credit report information that still appears on my report from Banco Santander Puerto Rico, who against the Law, the Fair Credit Reporting Act, keeps reporting my 2 accounts with them as bad Debt, Charge Off, Collections, but all that is not true as the evidence included clearly shows, the only choice I had to cover an unexpected expense from the company called XXXX, was to apply for a Secured Credit Card, and after years with this unsolved problem, which is now waiting for the Appellate Judges Judgment and the U.S. Court of Appeals for the XXXX XXXX, under Appeal No. XXXX, the fact is daily expenses and emergencies still have to be covered, and with the help of my Mother XXXX XXXX XXXX and a cash advance from my XXXX Credit Card now part of the Bank called XXXX XXXX, I was able to find the {$300.00} required in order to apply for this XXXX XXXX XXXX Secured Card, which is a Bank product precisely designed to help re-establish our credit, but no matter I was a former XXXX XXXX XXXX client, with a credit card with them that I closed years ago in good terms, a credit card that passed to XXXX XXXX XXXX when they bought XXXX XXXX XXXX years ago, they denied this Secured Credit Card. I am including evidence from a credit report, showing that I had a XXXX XXXX XXXX credit card, but the incorrect reports from Banco Santander simply are making my credit possibilities reduced to Zero, and is probably impossible to qualify for a personal loan, just to cancel the remaining balance with Banco Santander under this conditions, because they keep reporting that I am not paying my accounts with them, which is completely false. Both accounts are Paid as Agreed, in spite of a Discrimination Problem at work, currently waiting for a specific date at the Supreme Court of the United States, next XXXX XXXX 2019, as the included evidence shows. I was able to fully update this accounts, even keeping contact all the time with this Banco Santander Puerto Rico during the whole year I was without inclome, even with some intermediate payments to both accounts, which was supervised by the same Banco Santander Puerto Rico internal customer service, and Mrs. Miss XXXX XXXX was one of them, from their Central Office. Please see the documentation included showing all this the truth. I sued Banco Santander after they decided not to recognize their obligation to comply with the Law called Fair Credit Reporting Act, no matter the evidence sent first to the same Bank, then to the 3 credit bureaus, and then to the Bank, the credit Bureaus, through here at the C.F.P.B. With a a main Bank violating the Fair Credit Reporting Act like they do with me in this Case, even a Secured Credit Card could be denied, because XXXX XXXX XXXX made an automatic decision within 60 seconds : It takes more than that to write just a line here in this specific part of the complaint. Nobody from the Bank saw this evidence, saw I think is better, faster, and possible to send also to the 3 credit bureaus, and to XXXX, which because their unfair request of a full payment for a balance that was not past due, denying my request to divide the payment, or to accept a partial payment until days before next XXXX XXXX, as they approved many times during the past year due to this same problem, because I had no choice but to apply for this payment extension for extra time to pay that XXXX was offering. Now, because of their finance department bad decisions in this case, against me no matter I am their customer for more than 12 years and counting, I can't simply leave XXXX and buy a new cell phone from another company with a pre-paid offer, without hurting my finances in the middle of this unfair problem. I don't want to continue at XXXX, as I informed them even to a Supervisor who tried to convince me over the phone a couple of days ago, but I will have to stay because under this unfair conditions provoked by Banco Santander, not even XXXX XXXX XXXX wants to approve a Secured Credit Card .This is impossible.

Last Friday, XX/XX/XXXX, more than 2 months ago already, I was able to qualify for a small loan at XXXX XXXX, a division of XXXX XXXX, here in Puerto Rico, which allowed me to fully update the past due balance of this installment loan I made with Banco Santander Puerto Rico, back in the year XX/XX/XXXX. The amount paid last XX/XX/XXXX, was {$2000.00}. If any of you look at the included documents with this additional complaint made because of this problem, that this Bank is more than aware, the same Bank web site is not reporting as of today, any amount in late charges, or any kind of past due amount for this same loan. But, the reported information at XXXX, shows that there is a past due amount for this loan, of {$8000.00}, which is not true. If you at the C.F.P.B. take a look at the document included here called, " Incorrectly reported by Banco Santander past due XX/XX/XXXX 2 ", any of you will see that it shows the current balance, as " XXXX XXXX '' in XXXX of {$10000.00}, and that screen shot is from just minutes ago, at XXXX XXXX local time, today, XX/XX/XXXX. The same bank web site also shows, the next payment amount as " XXXX XXXX XXXX XXXX ", in XXXX, which is {$260.00}, the regular monthly payment, which is due next XX/XX/XXXX, and this appears right below the {$260.00} amount. Below the XX/XX/XXXX date due date appears the date of last payment, which was XX/XX/XXXX, in XXXX as " XXXX XXXX XXXX XXXX ", so this loan is been paid as agreed by myself, monthly, since I recovered my job last XX/XX/XXXX, and it also shows the number of late payments as XXXX, in XXXX as " XXXX XXXX XXXX XXXX XXXX ". It also shows that there are no charges due for delays, it shows XXXX, in XXXX as " XXXX XXXX XXXX XXXX XXXX " so if there are no late payments, no charges due for delays, it simply shows the current balance, the next payment and the date of the previous payment, who can explain why this same loan continues to be reported to XXXX by Banco Santander as Past Due by {$8000.00}? What else I have to show to this Banco Santander? They have already all the evidence, e-mails, phone calls to the correct people at the Bank, this Bank was also never paid to any collection agency, but always was paid at the same Banco Santander and its local branches, so why they still report it as past due to XXXX, damaging unfairly my credit report? There is no justification for this. Why this loan is not reported as Pays as Agreed to XXXX, because that is what it is more than 2 months ago, because there are no past due balances, and no charges due for delays either? Banco Santander was notified by myself in person, with evidence, about th e problem at my job which is currently been seen at loc al U.S. District Court in Puerto Rico, because I sued my employer as well as 2 other government agencies, for 3 types of discrimination. During the whole year I was not receiving my salary, this bank als o received late payments on my part, with the help of my immediate Family, meaning Parents in this case, Just by the same time the Bank decided to say this account was a lost, soon after I recovered my job, and I immediately notified this in person and with evidence to this bank, that I recovered my job last XX/XX/XXXX , and started to work next day on XX/XX/XXXX , and that as soon as my first salary was available, payments will re-start. The bank first, had on my checking account all the late payments charges, that with my initial deposit to that checking account after recovering my job were collected by the same Banco Santander. Then, the bank sent a notebook so I can continue with the payments, this account never actually was at a collection agency no matter the problem at my job and late payments, because I recovered my job and re started the payments before all that happened, why then is been reported as a negative account at XXXX , damaging all my efforts of credit recovery after paying on time since the job was recovered? This account never had a payment arrangement like my credit card with this bank, which does have a certified payment arrangement with the same Banco Santander , because I was able to re start the payment before that step, why then is reported as a negative account, as not been paid, when payments re-stared on my part before any certified payment arrangement like th e one with my credit card? Also, XXXX shows that there are no collections on my file? Who can understand this? My complain is against the Banco Santander of XXXX XXXX, Puerto Rico. The Bank made a mistake in their systems and sent incorrect information to the credit bureau 's agencies, XXXX, XXXX, XXXX and XXXX. Since XXXX XXXX 2004 I have a mortgage loan with Banco Santander from which I was and I 'm the primary loan owner. All my credit history was reflected in my credit reports for the past eleven years until a recently. A change was made in the mortgage loan account to remove my ex-husband from the account ( as agreed on the divorce settlements and court ). " Apparently '', a mistake was made by the bank were their systems sent the incorrect information to the credit agencies and all my eleven years of credit history were eliminated and transferred to someone else. During the process to open a dispute with XXXX and XXXX to correct the error made by the bank, I learned that they transferred my credit history to someone else ( apparently my ex-husband ) by the instructions or information received from the bank. I contacted the back to inform them about the error and to open a dispute to restore my credit history and to reflect my current balance due in the credit reports. Today, the bank has not yet contacted any credit agency to correct the error. All my credit history was deleted from the Transunion data systems and even do I sent them evidence to prove that I 'm the owner of the account they ca n't restore the data until the bank resubmit my credit history. My mortgage loan payments and history are now reflecting in someone else report and since the error occurred ( close to 2 months ago ) every payment I made to my loan y going thrust someone else credit account. I need your help to restored my eleven years or credit history in my credit report and to reflect accurate data which includes current amount due and the payments history. I have all the necessary evidence to prove that I 'm the owner or the loan and the property in question. I 'm afraid this could be a security breach or something done intentionally to favor someone else that has not rights over the loan, the credit history or the property purchased with this loan. I 'm concern that the bank is not taking the necessary measure to contact the credit agencies and fix the issue. None of the process issues to report listed in your first question of this complain is applicable to the issue that I 'm complaining about.

Since XXXX of this year I have been trying to get the bank to make a correction in my credit report for an account reported incorrectly. I had a personal loan that had a balance of about {$1800.00} in XXXX of 2013 and it was about 30 days past due. I contacted the bank and indicated that I could pay the amount in full if an adjustment was made to the interest rate already paid and a waiver was granted for the accumulated late charges. After several phone conversations, the bank agreed to let me pay off the account with a discount. The amount of discount was {$570.00} which consisted primarily of late charges. The loan was paid off in XXXX of 2013. In XXXX of 2013 the bank reported the debt as charged off to the credit bureaus. The account was 30 days past due at the time the bank agreed to a discount, but reported the account as 120 days past due and for that reason was charged off. The account never reached 120 days past due to justify being charged off as the report to the credit bureau indicates with the charged off code. Subsequently, the account was sold to an investor. The investor sent me a collection letter, however, after I explained the situation the investor verified the information with the bank, and they proceeded immediately to delete the information in the credit report and sent me a letter indicating that I have no debts with them ; however, the bank refuses to do the same and continues to report incorrectly an account they do not own anymore. I have disputed the information in the credit bureaus, but when the credit bureaus contact the bank, the bank indicates the information is correct and takes no action. The bank refuses to change the credit report despite several conversations and after two bank officers agreed with me that the account is incorrectly reported and promised to make the required changes. Also, the bank has not returned the cancelled promissory note despite several requests on my part.

As resolution for this matter, I want the bank to delete completely the account from the credit bureau since their actions have caused considerable damage since I have been trying to obtain a loan for a house I have under contract for deed, and I have not been able to obtain a loan.

My name is XXXX XXXX XXXX XXXX, the mortgage account number is XXXX. This loan is with Banco Santander de Puerto Rico.
At XX/XX/2015 I was working a Loss Mitigation process with the Santander Bank in Puerto Rico, at the same time the bank was filing motions to the court with the intention of executing the property. In This case the debtor was submmited the Loss Mitigation Package complete and the bank indicated the alternative was aproved are a payment plan but at the same time the bank and your legal representation submmited to the court a motion in continue the foreclosure process. This action is in total violetion with the Regulation X and incurred in " Dual Tracking ''.
Respa indicated the following : " The rule restricts dual tracking, where a servicer is simultaneously evaluating a consumer for loan modifications or other alternatives at the same time that it prepares to foreclose on the property. Specifically, the rule prohibits a servicer from making the first notice or filing required for a foreclosure process until a mortgage loan account is more than 120 days delinquent. Even if a borrower is more than 120 days delinquent, if a borrower submits a complete application for a loss mitigation option before a servicer has made the first notice or filing required for a foreclosure process, a servicer may not start the foreclosure process unless ( 1 ) the servicer informs the borrower that the borrower is not eligible for any loss mitigation option ( and any appeal has been exhausted ), ( 2 ) a borrower rejects all loss mitigation offers, or ( 3 ) a borrower fails to comply with the terms of a loss mitigation option such as a trial modification.
If a borrower submits a complete application for a loss mitigation option after the foreclosure process has commenced but more than 37 days before a foreclosure sale, a servicer may not move for a foreclosure judgment or order of sale, or conduct a foreclosure sale, until one of the same three conditions has been satisfied. In all of these situations, the servicer is responsible for promptly instructing foreclosure counsel retained by the servicer not to proceed ''.

This is a response to complaint # XXXX which was responded to us by Santander Bank. Their response is inaccurate and untruthful to say the least. They state that they sent a letter in XX/XX/XXXX and received no response. If they sent the letter to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, then they should've known that I left the property because that's what they agreed to. In fact, the house was listed after that and pad locked so I wouldn't have access. I also gave them my forwarding address and my email address. I lost my job and came to Michigan to live with family to rebuild. Foreclosure was a traumatic experience and I reached out to cooperate so I could move on.
In addition, if what they are stating is correct, it took from XX/XX/XXXX to XX/XX/XXXX to foreclose? Is that a timely response? Is that acceptable to the CFPB? Below is what they are reporting to my credit report. I just want the accurate information reported, they had possession of the home as of XX/XX/XXXX How could I be late in XXXX, XXXX, and XXXX if I didn't own the property? They sent one letter in XXXX years? They knew I would cooperate because I was in contact with them since I wanted to make the process as easy as possible. I didn't want my house to just sit empty and I wasn't angry with them, I just couldn't find work. I owned the home with no issues for close to 9 years prior to that and I paid on time until I fell on hard times.

I live in Italy with my American military husband. I 'm not working because of this situation. The situation that I have is that in XXXX I communicate with the Santander Santander for a lost mitigation why I was left without the income of unemployment to complete the payment of my mortgage. I had the apartment rented. They proposed a shortsales for my tenants. But they did not accept. The difference in the payment of my mortgage with the rent was more than 300 . Plus the condo was asking for a spill for {$1400.00} upgrades. Then the bank proposed to me voluntarily. He asked my husband and mine for statements. Forms, evidence of non-payment student loan and my capitulations to process the grant. I fulfilled all your demands. Then they made me break contract with the tenant. And make them evict the apartment. After the process was completed, I was required to pay attorney fees for the grant. I reminded them that I have no income and that I have capitulations with my husband. Then I demanded original capitulations what I could not send because then I could not recover them. The lawyer who made them no longer lives in PR and can not do anything for me. The bank was harassed because it saw my husband 's income on the statement. I asked them to stop harassing and they closed the case for voluntary giving after I fulfilled all their requirements. They demand the original capitulations. They did not accept their certification or the affidavit that the Italian lawyer offered them. They only want to damage credit.
The tenants moved. The apartment was empty since I do not have the income of them. I have a chapter XXXX bankruptcy in XX/XX/XXXX . The bank hurt my person when what I asked for was help to lower the payment. On XX/XX/XXXX a lockdown was declared in Puerto Rico due to the COVID-19 Pandemic by PR Commonwealth Governor, XXXX. XXXX XXXX XXXX. Among the governor Executive Order 2020-23 provisions to help citizens deal with the pandemic economic impact, there was a relief remedy for banks to provide a moratorium of three ( 3 ) months mortgage payments, which could be paid once the 3rd month was reached or be moved to the end of the loan. In my case, of the three choices for moratorium that the Bank offered, I applied for the Option 3, which was to move the payment for the end of the loan. This application was sent by email to Banco Santander of Puerto Rico on XX/XX/XXXX, and as of today, XX/XX/XXXX, I haven't received yet an official response from the Bank regarding my application, either for acceptance or denial of the application. I have been under the Chapter XXXX Bankruptcy Court since XX/XX/XXXX, and all my monthly payments for the debt during year XXXX and for the first trimester of year XXXX were up to date, until the lockdown was declared effective in XXXX XXXX XX/XX/XXXX, time from which I have been out of my job due to the COVID-19. I have provided follow up emails ( XXXX, XX/XX/XXXX & XX/XX/XXXX ) and telephone calls ( XX/XX/XXXX & XX/XX/XXXX ) to the Bank in an effort to find out an official response from them regarding the moratorium request, but all what I have received from them are default email letters describing their program scope and Plan availability, but nothing regarding acceptance or denial of the application. I have been paying on a monthly timely basis the loan debt through the Chapter XXXX Trustee, but obviously, its difficult to pay in full the part belonging to the mortgage until I can return to my job, which I expect to be at some point during the month of XXXX. This situation is making me to feel anxious and desperate since its my desire to protect and continue paying my mortgage, but need some relief support towards this objective.

I am writing regarding timely processing and disbursements of Escrow Payments. I have had a mortgage with Santander for MANY years. In XXXX after the impact of Hurricane Maria I performed my first Insurance claim and everything ran rather smoothly. Now in XX/XX/XXXX with the impact of the Earthquakes I tried to initiate a new claim and then is when I find out that since XXXX Santander had cancelled my insurance policy and I have no coverage even though my Escrow account has the funds paid by me, Santander just did not perform the Timely Escrow Disbursement nor did they notify me. I continued to be charged the full monthly payment which included the Insurance policy portion. Santander is claiming that Santander Insurance cancelled the coverage in XXXX and that I was not notified because they were not able to contact me. This is hard for me to believe because I have had many calls with Santander Collection and Santander Loss Mitigation, every time I get a call I do respond. My house has been significantly impacted by the ongoing earthquakes and I have been pushed back and forth between Santander and Santander Insurance, each blaming each other but neither are assuming responsibility. We are currently in the peek of the hurricane season, which this year is a very active one. I have had XXXX XXXX XXXX just thinking that I have no coverage. Mr. XXXX XXXX ( Director ) at Santander reached out last week requesting information in order to get a new policy in place, when I asked status upon my claim of the damage he reassured that Santander will not be paying anything because there was no active policy.

I have had a credit card with Banco Santander Puerto Rico for several years. I pay my balance off every month on time, so my credit history with the bank is excellent. Even though I was a resident of PR in XX/XX/XXXX, due to a work assignment I traveled to New Jersey in XX/XX/XXXX for several weeks. Since the due date on my credit card was XX/XX/XXXX, I mailed my payment on XX/XX/XXXX from New Jersey, just like I had done several times in the past. Under normal circumstances, 13 days was plenty of time for the check to arrive and be processed before the due date. However, hurricane Maria struck the island of PR on XX/XX/XXXX, which among other things, caused the US Postal Service to stop operations and delay all mail activity to and from the island. For this reason, my check # XXXX in the amount of {$2500.00} ( credit card balance due on XX/XX/XXXX ) did not arrive on time at the bank. This check was reflected on my account on XX/XX/XXXX, 14 days after the due date, and 27 days after I mailed it. To reiterate, my credit card payment arrived late at the institution not because of negligence or inability to pay, but because one of the worst natural disasters that has ever struck PR delayed the postal service. The bank charged me {$60.00} in late fees on XX/XX/XXXX. I disputed the charges on a letter sent to the bank on XX/XX/XXXX. On XX/XX/XXXX the bank replied stating that the charges would not be cancelled because my payment arrived late, even though it was through no fault of my own.

I ran into trouble with my mortgage back in XX/XX/XXXX due to a job loss and the bank agreed to take the home back which assumed would hurt my credit and prevent me from buying for a period of three years. I explained to the bank that I was leaving the home and they asked that I fax a letter which I did. They came and took pictures, filed out paperwork, and I vacated the property and moved to Michigan. In fact, the bank pad locked the doors and we didn't have access to the home as of XX/XX/XXXX. They are reporting late 's as of XXXX of this year which is preventing me from getting a mortgage. I tried reasoning with them and they won't communicate with me. They claim I didn't fax the hardship letter but I have proof and I faxed them the information. I have a fax from XX/XX/XXXX that they are stating they didn't receive. I tried calling their attorney and they stated I had to talk with the bank. I tried to dispute it with the credit bureaus and they responded to state that I was late in XX/XX/XXXX. How could I be late on a mortgage for a home I didn't own? They are rude when I call and that's only when they actually answered. My rights are being violated and they could easily fix their error but they refuse. They are stating that they couldn't reach me which is probably true because I left. However they should've know that because they padlocked the doors. Please help, thanks.

I make a deposit of XXXX dollar in a ATH machine in the outside of my bank local, and they never credit it to my account. I submit a claim to them and suggest them to check the video camera. Then they send mi a letter where they said that the video show the envelope was empty which is completely false. I check the video with them and it is clear that I put the money in the envelope. I never put back the money outside the envelope. They reject to give me a copy of the video which it is clear they are hiding something, After I ask them for the transaction journal and the show me a list of transaction that show I cancel the transaction which I suspect is an altered list for three reason. First I never cancel any thing during my transaction, the machine give a confirmation number in the screen. Second The machine do not allow cancel once the money is inside and it is contradictory with the version of them of finding an empty envelope inside. Third if there were a cancelation of my transaction they would said me that in the letter since they said that they check the ATH transaction also. They stole me a {$200.00} dollar and them betray me with a very respectfully letter suggesting I am doing some trick which I found very offensive. I have direct deposit in this bank, XXXX account including my house mortgage and I have been client of them for 15 years.

Unlike in the US, about 90 % of the customers that have mortgages do not bring a hazard insurance policy to the closing, thus the bank affiliate place the hazard insurance. Last XXXX an insurance company started offering a policy directly to the client offering a 20 % cash back if there were no claims on the hazard policy. A lot of clients have decided to purchase this policy. However since the hazard policy is paid from the escrow account, altough the client has chosen the new policy, Banco Santander Puerto Rico has declined to follow the clients order. And instead of paying the policy chosen by the client, they pay the policy that they had on file, which most of the time is to their insurance affiliate. The order of the client is signed electronically with the e-sign program. The bank excuse for not paying the policy is that they are waiting from their legal derpartment to see if they can accept the electronic signature. Since XXXX Banco Santander has said theat they are waiting from the legal department. We are now in XXXX and they are still providing the same excuse. Meanwhile Banco Santander is using the money in the escrow to pay their subsidiary and not paying the policy chosen be the client, thus depriving the customer of getting the 20 % cash back.

On XXXX XXXX, 2016 Banco Santander forwarded a letter to me advising me of a second notice of payment. This letter was given to my son by a neighbor which we do not know, because it was placed in their mailbox incorrectly.
The issue is that Banco Santander violated my privacy by providing in clear view inside the address window my full name, address, the reference being a personal loan, including my account number, the total amount due for the loan, and that it was a second notice.
This violated my rights by a financial institution by providing in open view private information that should have not been previewed in plain sight.
I made contacted Banco Santander on XXXX occasions. XXXX XXXX ( supervisor ) on XXXX/XXXX/2016, And XXXX XXXX @ XXXX XXXX XXXX XXXX, XXXX. As of this date my financial institution has not return my calls made any attempt to contact me nor provide a resolution to this date.
This issue openly embarrassed me in front of my neighbors, and my children. I formally request an investigation, and fines to correct this abusive practice by Banco Santander. Enclosed are pictures of the envelope as received.

By XX/XX/XXXX XXXX Santander XXXX returned to me over {$13000.00} in " error '' charges they had incorrectly made to some of my Commercial Bank Accounts ( ie # XXXX ). We held then a personal meeting at their XXXX XXXX XXXX XXXX in XXXX XXXX where they ( XXXX XXXX, XXXX XXXX, etc ) told me that for " seeing only '' my accounts via internet the charge would only be $ XXXX/month from then on. However they did not comply with that disclosure/promise and instead repeatedly kept on over charging my account from XX/XX/XXXX through XX/XX/XXXX up to {$3200.00}. They should keep the agreed $ XXXX/month x 18 months = {$270.00} and return to me the excess money the took from my account ( $ XXXX $ XXXX {$2900.00} ). I have all evidence and correspondence of efforts made with several of their present employees trying to get my money back during recent months in XXXX. Thanks for your kind attention.

My father was a XXXX Veteran. He purchased a home using a FHA loan in XX/XX/XXXX. In XX/XX/XXXX he passed away. None of the heirs are in a good enough financial position to assume the loan. I am the youngest son and I am actually living in the house right now but I am unemployed and do not qualify for a loss mitigation program. The house was put up for sale with no success. My father 's sister ( my aunt ) was interested in buying the house through the short sale program but I am told relatives do not qualify for this program. I find this rule discriminates against the relatives because it essentially allows non-relatives to purchase the home for a lower price than a true relative can. I, as a son would basically lose a home and the family would lose an inheritance if relatives are not allowed to use the short sale program to save the property.

During the XXXX storm I was told that I did not have to make 3 months worth of mortgage payment to alleviate with the conditions faced in Puerto Rico and that these 23 months will be added to the end of the Mortgage life. I have been trying to dispute this account on my credit report for months and have not heard back. I have sent numberous dispute letters to the credit bureaus and to Santander. They are failing to delete this account from my credit report because it is actually reporting twice on my credit report which is a violation of the FCRA. iI 'm trying to refinance my mortgage thru the credit union. We need a letter of mortgage cancelation in order to proceed. My current financial institution, Banco Santander almost deny such letter.

They collect an annual charge of {$45.00} and maybe that 's ok. but suddenly they started to charge late fees and other fees up to {$90.00} I tried to negotiate with them opening a claim but they declined turn down and charge off the account for just {$90.00}.
