On XX/XX/XXXX I received a Notice from XXXX XXXX XXXX, XXXX dated XX/XX/XXXX stating they were initiating foreclosure proceedings and the Notice stated that " The following information is provided to you as required by the Federal Fair Debt Collections Practices Act ... This is an attempt to collect a debt, this is a communication from a debt collector ... '' On XX/XX/XXXX, I sent a letter via certified mail to XXXX XXXX. XXXX, XXXX requesting verification and validation of the alleged debt. To date, I have never received verification and validation of the alleged debt. On XX/XX/XXXX, XXXX XXXX XXXX, XXXX filed a non-judicial foreclosure action against me to dispossess me of my personal private property without a legal right to do so.
In XX/XX/XXXX, I filed an FDCPA claim against XXXX XXXX XXXX, XXXX and their employees for the illegally filed non-judicial foreclosure action. On XX/XX/XXXX, the United States Court of Appeals for the Fourth Circuit, Appeal Number 15-1444, determined that XXXX XXXX XXXX, XXXX and its employees were " debt collectors. '' In the XX/XX/XXXX opinion it states " In sum, we hold that ____ complaint adequately alleges that the XXXX XXXX and the Substitute Trustees were debt collectors and that their actions in pursuing foreclosure constituted a step in collecting debt and thus debt collection activity that is regulated by the FDCPA. '' On XX/XX/XXXX, in a later Memorandum and Order the judge stated I sufficiently stated a claim under 15 USC 1692g ( b ). The judge is now stating the XXXX XXXX and substitute trustees never verified and validated the alleged debt back in XX/XX/XXXX and had no lawful nor legal right to file the non-judicial foreclosure action without verifying and validating the alleged debt.

Samuel Whitaker Associates called me numerous times, supposedly collecting for an XXXX account that no longer shows on my credit report. They threatened me with legal action ; that they would come to my home or work with a summons. Supervisor cursed at me over the phone, demanding that I agree to automatic payments from my bank account. She hung up on me. I called back, but they would not answer.

On XXXX XXXX received a call from a XXXX XXXX stating I had 72hrs to Connact her at Samuel Whittaker and associates at XXXX XXXX XXXX XXXX XXXX, XXXX NY XXXX. Her telephone number XXXX. She stated if I did not call within these 72hrs than I would have a civil suit filed against me and XXXX in XXXX and XXXX county and I have been warned and have a great day!
