This complaint is my final communication regarding your claim that the information below has been verified and that the information being reported is accurate. Same Day Auto has avoided liability of furnishing incorrect information to the credit reporting agencies far too long and if this information is not removed, I will be filing a statement of claim against your company. I have repeatedly asked for evidence to support your reporting, but you have failed to provide me a copy of valid and viable evidence for account SAMEDAY AUTO XXXX. I initially sent a dispute letter XX/XX/ detailing the inaccuracy and unethical practices of your company and you failed to acknowledge my dispute. Last month I submitted a cfpb complaint XXXX, and you gave a generated response and provided no validation or explanation to the reporting of incorrect payment history, date last active, and loan balance. I have requested your method of verification and you have not complied, which is an additional violation of the Fair Credit Reporting Act 611 ( a ) ( 7 ). In the absence of any such documentation, I demand that this information be immediately removed from the credit file you maintain under my Social Security Number. Should you continue in your non-compliance, the law is very clear as to the civil liability and the remedy available to me for negligent non-compliance. I am maintaining a careful record of my communications with you for the purpose of filing a complaint seeking relief and monetary damages under FCRA Sections 616 and 617. Please see the attached dispute letter, which is dated, and time stamped, my 3-bureau credit report which shows the inaccurate information.

I submitted a complaint to which your company stated that you could not verify the account with the information provided. According to the FCRA, this is a violation and grounds for removal. Your company also asked to provide the account listed on my credit report. I have attached the account in question. Your company should have record of all accounts being furnished to the CRA 's. You are reporting inaccurate information, and I am requesting the removal of this account from my credit report immediately. The location of the specific branch is XXXX Tx. However, if I have to take this to small claims court, I will be suing the company as a whole.

You are reporting incorrect payment information for account SAMEDAY AUTO FINANCE XXXX. This is a clear violation of the FCRA. I will attach my credit report to show the inconsistent information being reported. I also sent dispute letters 5 months ago. The letters are dated, and time stamped and will also be attached for your reference. I do understand that each violation has a fine up to {$1000.00}. I will be seeking legal action due to negligence, pain and suffering, and many FCRA violations. I am requesting that this account be removed or updated to show my true creditworthiness.
