This appears to be a continuation of a previous complaint : CFPB # XXXX. Despite repeated communications with XXXX XXXX XXXX / SACOR Financial disputing the validity of any claimed debt or other business dealings with them, they continue to harass me through local law firms. Although the previous law firm rightly ceased all activity and asserted that would notify the above-referenced creditor to communicate with the original attorney about illegal activities taken on their behalf, no such communication appears to have taken place. Instead, they have apparently hired another local law firm in an attempt to further perpetuate a pattern of abuse and harassment which has lasted for many years. The following timeline reflects the history of this ongoing activity. -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- - XXXX XXXX XXXX / SACOR -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- On XX/XX/XXXX I became aware of a final judgment was filed against me on XX/XX/XXXX. I had never been served and no judgment shows on my credit bureau reports from XXXX, XXXX, or XXXX. That same day I contacted the lawyer on the case, who stated that he had no proof of service and had returned all files to XXXX XXXX XXXX XXXX XXXX ( XXXX ) at their request. Note : XXXX was purchased by SACOR Financial Inc on XX/XX/XXXX. I went to the Courthouse and according to the file an Order Confirming Arbitration Award was filed by XXXX XXXX XXXX on behalf of XXXX on XX/XX/XXXX. State law regarding arbitration in the state of Georgia ( OCGA 9-9-4 ( c ) ( 1 ) ) states that " [ a ] demand for arbitration shall be served on the other parties by registered or certified mail or statutory overnight delivery, return receipt requested. '' The file includes no record of service. It also includes no return receipt - only a returned improperly addressed letter ( not registered or certified ) postmarked XX/XX/XXXX which had been returned to the courts as improperly addressed. This letter had been addressed to the last name " XXXX '' which I assume was an incorrect spelling of my name, " XXXX. '' Instead of proof of service an Affidavit of Due Diligence dated XX/XX/XXXX is included in the file asserting that a " due search, careful inquiry and diligent attempts '' were unable to effect service through a private processor ; service was purportedly attempted on XX/XX/XXXX. Further, in response to a Motion for Final Judgment the court had added the written notation that " [ t ] his Court shows no service in file or on docket. '' In addition to the lack of proof of service I also noted that there was no documentation which indicated with sufficient specificity that XXXX had purchased the asserted debt. Additionally, I was aware that in XX/XX/XXXX, the National Arbitration Forum ( NAF ) agreed to cease administering arbitration disputes after the Minnesota Attorney General brought suit against for NAF for failure to disclose its relationship to credit card companies. Attempts to contact XXXX were unsuccessful as they had filed for bankruptcy protection in XX/XX/XXXX. Based on the above factors there was clearly no merit to any claims, the court appeared to agree with this assessment, and I considered the issue to be closed. -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- XXXX XXXX XXXX -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- On XX/XX/XXXX I was served with a Subpoena and Notice for Deposition on the above action, with the Plaintiff now listed as " Sacor Financial , Inc. as assignee of XXXX. '' This subpoena notified me to report to the office of XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX ) on XX/XX/XXXX for a deposition. I went to the office of XXXX XXXX XXXX on the stated date and time in the hope that an explanation would be the quickest way to resolve this action which is clearly in error. On XX/XX/XXXX I went to the office of XXXX XXXX XXXX and informed their counsel that : I disputed this debt ; I had never received service regarding an arbitration hearing ; the Court had no record of service ; the file lacked documentation indicating that XXXX had the legal right to collect on the purported debt ; and that if the NAF had handled the arbitration it was likely invalid. In addition I asked to see if there was any proof of Sacor 's purchase of the debt in question from XXXX. The lawyer showed me a " Notice of Sale and Assignment '' from XXXX to Sacor. The Notice lacked the legally required specificity to indicate proper assignment and I informed Sacor, through XXXX XXXX XXXX of that, saying : " This, obviously, is not with specificity, as you know ... this says everything that XXXX has is being sold because 'we are filing for bankruptcy. ' '' When I then asked " [ d ] o you have any other assignment documentation, '' Sacor 's attorney refused to confirm or deny if there was other, legally sufficient proof of assignment. The lawyer did remark however, that " [ y ] our concerns regarding the validity of the judgment have been included in the record. '' XXXX XXXX XXXX increased their level of harassment by sending subpoenas to XXXX XXXX and XXXX XXXX XXXX demanding financial records associated with myself. Although I do not have a bank account with XXXX XXXX, the XXXX XXXX that I founded does have its account at XXXX XXXX. I filed complaints with the Consumer Financial Protection Bureau and with California 's Office of the Attorney General. XXXX XXXX XXXXXXXX responded in part : " On or about XX/XX/XXXX, XXXX XXXX XXXX , XXXX ( XXXX XXXX XXXX ) was hired to collect a judgment issued by the Superior Court of XXXX County in XX/XX/XXXX against the consumer. [ ... ] The first time XXXX XXXX XXXX became aware of any issue, whatsoever, with the judgment was when the consumer conveyed the information during his post judgment deposition earlier this year. [ ... ] In order to be able to respond to the consumer 's claims, XXXX XXXX XXXX has requested that the creditor contact their original attorney and have the attorney respond to the allegations. Until then, XXXX XXXX XXXX has placed the file and all collection activities on hold '' To our knowledge and belief, communications from XXXX XXXX XXXX ceased after the above communication from them. Importantly however, there has been no information from SACOR or " their original attorney '' to " respond to the allegations. '' Although XXXX XXXX XXXX claim to have placed " 'all collection activities on hold '' it appears that some party has continued to pursue collection activities against me for this claimed debt. -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- XXXX XXXX XXXX XXXX -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- On XX/XX/XXXX several legal documents were received regarding this matter from XXXX XXXX, XXXX. of XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, XXXX XXXXXXXX, XXXX, GA XXXX ( XXXX ) XXXX. There were four Subpoena Duces Tecum addressed to XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX ; and XXXX XXXX. I believe that some of the recipients for these subpoenaes are based on information I previously shared but am concerned that XXXX XXXX XXXX / SACOR and/or its agents are accessing my private information through credit reporting agencies in violation of the Fair Credit Reporting Act. At this point I do not have any additional information about the purpose for the subpoenaes I received as there were no other communications from XXXX XXXX of XXXX XXXX XXXX XXXX. At a minimum however it appears that, like the previous law firm, that this is an effort by a " junk debt buyer '' to collect on funds not owed them through a pattern of abuse and harassment. As before I will also file a complaint with California 's Office of the Attorney General. I also reserve the right to pursue any other options available to me.

On or about XX/XX/XXXX-XX/XX/XXXX, I received a call from XXXX XXXX XXXX, a collection agency telling me that I owed about {$11000.00} on a XXXX XXXX Visa Card purchase. I told the collection agent, that I did not make any purchase from XXXX XXXX, and that if such purchase was made in my name, it was certainly as a result of fraud, and I asked the collection agent to send me the verification of debt document : copy of the purchase receipt, and the signed delivery receipt to verify the name and signatures on the purchase. The agent told me that the debt is in my name, and that they will attach my home if I did not pay the debt. I did not receive the verification of debt document. Then in XX/XX/XXXX I received a call from Mr. XXXX XXXX of Sacor Financial Inc, a debt collection agency, who told me he was trying to collect a debt I owed to XXXX XXXX, and that XXXX XXXX had obtained a judgment against me on the account. I told Mr. XXXX that the debt was a fraud, and that I disputed the debt as a fraudulent debt with XXXX XXXX. I again asked Mr. XXXX to send me the verification of debt documents such as : the original purchase receipt, and the signed, proof of delivery receipt. Mr. XXXX told me that Sacor does not have those documents on file, and that he can not get the document. I asked Mr. XXXX to get the documents from XXXX XXXX, XXXX XXXX, or XXXX XXXX. He did not, and I never heard from him again. Then, on or about XXXX, I received a call from Mr. XXXX XXXX of Sacor Financial, who said he called to collect payment my XXXX XXXX debt. I again told Mr. XXXX XXXX that the debt was fraudulent. That I did not make any such purchase from XXXX XXXX. I again asked Mr. XXXX XXXX to send me the verification of debt documents. Mr. XXXX told me they don't have it on file, and that they can not get it, because XXXX XXXX was closed. I then asked Mr. XXXX XXXX to get the documents from their principal. That was the last time I hear from Mr. XXXX XXXX or Sacor Financial. And I did not get the verification of debt document. Then about XX/XX/XXXX, I received a letter from Mr. XXXX XXXX of Sacor Financial, demanding that I make payment arrangement of this disputed, and fraudulent XXXX XXXX debt. This time, Mr. XXXX XXXX, told me that the XXXX XXXX Visa account, was a " joint line of credit account '', branded through XXXX XXXX, and that they have attached my home in the amount of {$69000.00} includes interest and court fees. Mr. XXXX XXXX, threatened to enforce a court judgment against us on this disputed, fraudulent account. I replied and told Mr. XXXX XXXX that the account was fraudulent, and was not a " joint account '' with my wife. I suspect that Sacor Financial may have illegally converted the " individual account '' to a " joint account '', in order to attach the home, that I own with my wife as joint tenants. I again asked Mr. XXXX to provide me with the debt verification documents, listed above. He did not. Instead, he sent me a copy of my XXXX credit report and copy of the court judgment obtained against me on this, illegal, disputed, fraudulent debt. XXXX XXXX and Sacor Financial, side-stepped my legitimate claim of identity theft and fraud on the XXXX XXXX account. They also ignored my request for debt verification document, because I am a home owner. They think they can illegally attach a lien to my home, and force me to pay for a debt I did not create, nor derived any personal benefit from. I don't know if XXXX XXXX or Sacor Financial misrepresented the debt information to the Court, and I don't remember receiving a Court summons for the case. I believe my Visa Credit Card fraud protection clause protect me and all credit card holders from all illegal, unauthorized and fraudulent purchases, and that the statute of limitation protects me from this very, very old collection account, that has run from XX/XX/XXXX-XX/XX/XXXX.. That is where we are on this abusive, high pressure, debt collection. I just want to end this fourteen year debt collection ordeal. It has been nothing but XXXX and nightmares dealing with this same issue, because, someone thinks they can illegally, convert a known fraudulent debt into a lien, and illegally, slap the lien on my house.

I had a credit card when went into collection, and eventually the credit company won a case to garnish my paychecks in XXXX/XXXX/XXXX for a total judgment of {$3600.00} ( {$3300.00} plus costs {$340.00} ). In XXXX/XXXX/XXXX, 1178 days later, they finally started to garnish my wages after adding {$1100.00} to the original award amount. The company I worked for ( before XXXX ), from XXXX to XXXX my employer paid the amount the original legal representative requested, a total of {$3500.00} ( {$130.00} less than the judgment amount ).. In XXXX, with a new legal representative, the credit company again requested my employer pay the same garnishment for the original {$3600.00}, and post-judgment interest. I was no longer employed with this company, and they spent three years trying to garnish my new employers with no success. In XXXX, they filed for an extension to the award, which was granted. This year, XXXX, after 3 years of working with my current employer, the credit company finally started garnishment, again requesting the original award amount {$3600.00}, and now claiming post-judgement interest of {$4000.00} After receiving my current garnishment, I went back to my original employer to get the garnishment payment records from XXXX/XXXX/XXXX to XXXX/XXXX/XXXX. Speaking to the original lawyer representing the credit company, they claim they no longer represented the credit company after the XXXX verdict. Yet, three years after, these legal representatives were sent payments between XXXX/XXXX/XXXX to XXXX/XXXX/XXXX, which they also claimed they had no records of. From XXXX/XXXX/XXXX to XXXX/XXXX/XXXX, remaining payments were sent directly to the credit company. Yet, as stated above, the credit company and the new legal representative continued to claim no payments were made while pursuing garnishment from XXXX until now. Their new legal representative took over around XXXX. After sending the payment records to the new legal representative, they adjusted out the {$3500.00} in previous payments, now claiming {$3300.00} in remaining balance from post-judgment interest accrued to date ( a difference of {$730.00} in interest from their original claim minus {$3500.00} in garnishment payments made ). -To date, there have been no clear reasons for why no actions were taken between their award date of XXXX/XXXX/XXXX and XXXX/XXXX/XXXX, nor what happened with the original legal representative, or why payments were sent to them if they were not handling my case for three years, nor why they were sitting collecting interest for XXXX days. -There is also no reasoning of why they tried to garnish the original judgment award plus interest in XXXX, three years after said garnishment was paid, again allowing over XXXX days to pass. -There is no reason why they did not send a letter confirming the original garnishment amount was paid after XXXX/XXXX/XXXX, no satisfaction of judgment was noted by my employer. -They have added {$1100.00} in interest between XXXX/XXXX/XXXX and XXXX/XXXX/XXXX, when the garnishment payments were already completed according to the order received by my original employer, thus allowing XXXX days to elapse and accrue interest.

Around XXXX I opened an I had an account with XXXX XXXX ( XXXX ). The original amount was {$1800.00} for the purchase of a computer at 26 % interest. They sold the account to another company, which name I don't recall. That company subsequently sold the account to Sacor Financial. In around XXXX. Sacor contacted me over the phone and advised me that I owed them {$3800.00} on said debt. At that time I agreed to make a payment arrangement of {$40.00} Monthly. After that I called them multiple times over the years to ask how much I owed and for them to send me statements by mail. However, I was told that they didn't ; have to send me any statements. Recently, I contacted them because I wanted to pay-off my bill. Consequently I received a letter from them, just stating that I owed them {$14000.00}. When I called them and asked them how could that be possible, They told me that it was due to accumulation of interest. I then requested a breakdown and the account Representative didn't know how much did I owed when they bought the debt. They told me that they did not have that information. They bluntly told me that I owed them {$14000.00}, They took my payment of {$40.00} a month for ten years totaling {$4800.00}. Where did that money went. I am willing to pay the correct amount and that is the correct amount. I hope you can help me on this matter there are many consumer in the internet ( website review ), which are having the same problem with Sacor. Can you help me on this please. or do you recommend for me to hire an attorney to deal with this company. I hope to hear from you soon Thank You,

A collection company called SACOR FINANCIAL with their representative called XXXX XXXX XXXX, came to our house in XXXX broke our garage door took XXXX XXXX and his XXXX truck to their possession told us because we have a judgment against us that they can seized any valuable things from us for non payment. I was XXXX XXXX XXXX was in a XXXX because I never, never knew my husband took a loan on my name and his without me been aware of at the first place. He paid {$5000.00} to get both cars out. Then XX/XX/XXXXthey came again took his car again lucky for that time mind was n't there, that time he could not do nothing to get it back because he was n't working. In XXXX they again came to the apartment I am at, took my XXXX XXXX XXXX car away I called SACOR FINANCIAL asked them how can I get my car back, SACOR told me I have to talk to XXXX XXXX XXXX which I did, he said to pay {$2000.00} to him then agreed to make a {$500.00} direct withdrawal payment. I asked both parties to tell me how much was the loan, the {$5000.00} plus both cars taken how much left on the loan both parties can not say why?. I report the matter to BBB they investigate but still nothing so BBB told me they ca n't do anything since both parties refused to corporate so if I want I can take the matter to court and see. I can not afford one so I do n't know what to do. Now thru research on XXXX I came across with you people, I said let me give it a try and see what you guys can help me with.

Sacor Financial XXXX Inc has taken over the debt that I owed to a credit card. They take {$300.00} from my bank account on a monthly basis. I have asked if there is interest and do not get clear information. I have asked for a statement and was told that is not there practice. They only send me a reminder letter on a monthly basis reminding me they are withdrawing {$300.00} from my bank account. I have asked how I can keep track of the balance re : my payments and interest. They informed me they are under no obligation to do this and it is not their practice. They are not " set up to do that. I have called and emailed numerous times and XXXX XXXX XXXX - the only person who can help me is always out of the office. I have not actually spoken to him in XXXX months. I am not disputing that I owe money - I am asking for verification as to my balance on a monthly basis.

A judgement was placed against me in 2008 by XXXX XXXX Bank and the debt got sold to Sacor Financial Inc in XXXX, CA. I was never properly served any court documents. Sacor XXXX Inc has levied my bank accounts and collected over {$8000.00} from me. The judgement was for about {$15000.00}. It has been over 8 years since this judgement and they are still harassing and calling me even though I have requested numerous times for them to provide me with the accounting breakdown of what is owed and all documentation retaining to this judgement. I have a debt collection company trying to collect a debt from XX/XX/XXXX that they purchased from a credit card company. They went to my home state of Louisiana and got a judgement to empty one of my bank accounts without serving me any papers to go to court. and are threatening me now in the state I live in. the debt is 12 years old and past the statue to collect on. and further more XXXX passed a federal law against collection companies doing this in XX/XX/XXXX.
