On XX/XX/2023, I called the XXXX XXXX XXXX XXXX to settle student debt ( not federal or private loan ) in the amount of {$6000.00}. I was told by XXXX of the cashiers office that the debt was turned over to S & S Recovery ( XXXX ). I called XXXX & XXXX XXXX and was connected to XXXX at extension XXXX, who happened to be the representative handling my case. XXXX advised me that I owed {$1500.00} in addition to the {$6000.00}. Baffled, I questioned the additional fees. XXXX advised me that the additional fees were late fees assessed by XXXX XXXX. This immediately presented a red-flag because I had just spoken to XXXX of XXXX XXXX XXXX XXXX XXXX and XXXX spoken to a representative at the XXXX XXXX XXXX XXXX XXXX XXXX XXXX prior, XX/XX/2023. XXXX assured me that the additional fees only came from XXXX XXXX when they had taken over the account. I told XXXX that I would call her back at her extension in XXXX to XXXX minutes so that I could verify some information. I immediately called the XXXX University XXXX XXXX to verify the information provided to me by XXXX. XXXX answered the phone and was distraught by the information I had received from XXXX. XXXX stated that the information provided by XXXX was completely false and that XXXX University had assessed no additional fees onto my student account. XXXX stated that the additional {$1500.00} fee was apparently assessed onto my student account by XXXX & XXXX XXXX. XXXX stated that I owed XXXX University {$6000.00} and that no additional fees were assessed. I told XXXX that XXXX knowingly, willfully, and deliberately lied to me about the additional fee and was using XXXX University as a scapegoat to force collection efforts on me and possibly other students. XXXX readily named XXXX as my S & S Recovery representative and stated that she was going to give her a call. XXXX stated that if needed, she would get additional contacts involved in an effort to remedy the situation. XXXX asked if she could call me back while she attempted to make contact with XXXX. At XXXX XXXX on said date, XXXX XXXX me back advising that she had spoken to XXXX XXXX extension XXXX. I am unaware of the contents of the conversation, but XXXX urged that I give XXXX a call at the aforementioned extension. I attempted to contact XXXX at XXXX thereby leaving a voicemail message, and again at XXXX without success. At XXXX XXXX, I called XXXX & XXXX XXXX at XXXX and left a message for XXXX XXXX a receptionist. At present, I have not received return correspondence from XXXX or any other representative of XXXX & XXXX XXXX. It is based upon reasonable belief as a retired law enforcement official that S & S Recovery is assessing unreasonable collection fees on XXXX XXXX XXXX accounts under the fraudulent guise that such fees are late fees assessed by XXXX XXXX. S & S Recovery representatives are knowingly providing materially false and fabricated information to unsuspecting students who may not have the means to challenge the additional fees. It is highly unlikely that a reasonable and prudent person would believe that I am the only XXXX XXXX student subject to such vile conduct by XXXX & XXXX XXXX. Based on my legal and law enforcement background, I hereby request that the CFPB conduct a full and thorough investigation on S & S Recovery collection activities with regard to my XXXX XXXX student account, in addition to all other student accounts associated with XXXX XXXX. On XX/XX/XXXX, I received an email from my credit monitoring service. It informed me that my credit score had dropped a tremendous amount of points. I logged on and found that S & S RECOVERY, INC., had illegally posted an alleged collection account to my credit profile. Prior to the email, I have never heard of nor had an account with this company. My report shows that it is an open account and was opened on XX/XX/XXXX with a balance of {$2500.00}. I had no knowledge of this company nor this alleged debt. I have never had any dealings with this company. By federal law, a debt collector is supposed to make contact with an alleged debtor and give them 30 days to validate or dispute. I never receive a letter in the mail that gave me 30 days to validate or dispute this account. I never received a letter stating that I have an alleged debt with this company and owe a balance on that account. Again, I have absolutely no knowledge of this account with them. I understand that, under the FDCPA guidelines for collection agencies, they have to provide ( 1 ) proof that they are the original holder of this debt and can legally hold me responsible for paying this debt and ( 2 ) contractual proof of obligation or an assignment SIGNED from an officer from the original creditors corporation that I am supposed to pay them. 15 USC 1692g Sec. 809 ( b ) of the Fair Debt Collection Practices Act ( FDCPA ) grants me the right to request validation of this alleged debt they say I owe. I did not receive notice of right to dispute nor did I receive enough information to verify that the alleged debt belonged to me. If I would have gotten anything in the mail or phone call from this company before they illegally reported to my credit report, I would have respectfully requested evidence that I am the person they are asking to pay this debt and a contractual obligation that legally binds me to pay them this debt. Upon them receiving my validation letter, they would have to legally cease from collection calls, letters, and efforts and delete the account from my credit files until they can validate this debt. But again, I never received such a letter about this account or phone call ever in the mail. They have illegally posted and reported to my credit file without adhering to the FDCPA laws. Im not sure if this company is a scam, but I know that this company has broken FCRA and FDCPA laws by reporting an alleged account to my credit report without informing me through mail or phone and I did not receive notice of right to dispute nor did I receive enough information to verify that the alleged debt belonged to me. My credit score has dropped tremendously in the middle of purchasing a car. Please help me get his account removed immediately. I'm preparing to sue under the FCRA and FDCPA because of the damages to my credit and opportunity costs with the purchase of my home and business ventures that have to be delayed until this illegal account is removed. I noticed a derogatory " paid collection '' by a predatory collections company by S & S Recovery out of Tennessee. I submitted my full payment directly to the university via the university 's portal, not a collections company. However, when reviewing my credit reports, I was dismayed to learn that XXXX XXXX XXXX was the ONLY credit reporting bureau showing a derogatory account. I know for a fact that S & S violated many FCRA and FDCPA laws and as a licensed private investigator, I've compiled a court records and testimonies to corroborate a pattern of abusive behavior. I never received a letter from S & S Recovery nor could they ever prove to me that they were in compliance the FCRA/FDCPA laws. S & S Recovery never sent a letter, the university never provided me communications nor did they remit the services I paid for due to COVID-19. Since I am a survivor of XXXX XXXX I'm enrolled in the Texas Attorney General 's Address Confidentiality program where they assign a po box to receive mail in lieu of a publicly listing a physical address to add a layer of protection. I have attached that enrollment letter from when I joined the program. Also, the university was not physically opened during XXXX and working remotely. Any letter they sent to me were not received. Despite paying the university, I now have a collections with a company I never interacted with! COVID-19 displaced many people and the university could not adequately follow with any notifications of derogatory payment. I submitted a complaint by the CFPB portal against S & S along with a formal dispute via XXXX, yet S & S is engaging in their typical " bully '' behavior and refusing any goodwill effort to delete the stain on an otherwise FLAWLESS credit report. This negative collection has dropped my report by XXXX points and is preventing me from opportunities and setting my interest rates higher. This is illegal. I have a tentative meeting scheduled with a news network who is willing to speak with me on the record for an " expose '' news story about this very matter should the issue not be resolved.

S & S Recovery has violated my rights. I am aware of all rights that I have, and which are protected by Congress under the FCRA and FDCPA. I still have not received any communication from S & S Recovery on how to dispute this matter in their office. I have received validation of debt by S & S Recovery via Mail Dated as the XX/XX/2022 information is attached to this complaint. The referenced Account # XXXX Reference # XXXX. There was an inaccuracy in which I was incorrectly billed in the amount of {$1400.00} was supposedly refunded back to the account. I did not receive any funding for an overage nor was this information shared with me until the investigation from S & S Recovery. The account balance reported from S & S Recovery is not reflected as the SAME BALANCE reported on my XXXX Credit Report. ( Doc. Attached ). I am contacting you because you claimed to have completed this investigation and verified this information with XXXX XXXX XXXX as reporting 100 % accurate. However, this account is STILL inaccurate and is STILL continuing to report errors on my credit file, which is causing damage to my credit score. I have previously requested that you investigate and you have failed to correct the errors you are reporting on my credit report. Now is not the time to update, I demand that you IMMEDIATELY DELETE and remove this inaccurate account from my credit report.

Today - XX/XX/19 S & S called me 5 times, called my husband 's personal phone, and called his work. I tried calling them back and they would hang up on me, send me to voicemail, put me on hold for long periods of time, and kept transferring me to people that weren't involved in the case without transferring me to the person I needed to talk to. The Vice President, XXXX XXXX was extremely rude to me, kept interrupting me, and not listening to what I was saying. Back a few months ago I told S & S that they were not allowed to contact my husband, but they call so many times a day, sometimes 3 times within a 20 minute period. I feel harassed by them. Also, they claim that I owe a higher amount than I actually do, almost {$2000.00} more than I do. I tried to resolve this but the managers were just rude and told me they could call whoever they want whenever they want, which is clearly against the Fair Debt Collections Practices Act. XXXX claims that everyone in his company is FDCPA certified but they can not follow simple laws.

This debt is relating to a balance owed to XXXX XXXX College in the ammount of XXXX. I contacted XXXX XXXX College on XXXX/XXXX/XXXX in reference to this account and they let me know that it had been placed With S & S RECOVERY , INC . I CONTACTED THEM THE VERY SAME day regarding the account they stated that they did not have any information regarding the account and I had not recieved any letters or communication from them regarding the balance. I have been receiving frequent phone calls to collect a debt from a college that I have not attended since XXXX. I answered initially to see what this was about and where these phone calls were coming from. I was told they were looking for XXXX XXXX to collect a debt of {$1300.00}. This is a debt I had no idea that I had acquired. I let this know this information and they continued to call me to collect this debt on my behalf. Yesterday, I called my college to order a transcript and there is a hold on my account due to this debt. This debt is not mine. XX/XX/23 I got a call from SS Recovery over student loan at XXXX, a XXXX bill over getting committed last three weeks of school, and one wF out of fur grades meaning i owed them XXXX three years ago. I ; ve disputed the bill but decided to pay it off XXXX a month XX/XX/23 and gave them my acct number to take it out of only to have them declare XXXX delinquent on my credit reportas a write off. I want to pay the whole thing off when i can, next month, when my Dads estate is settled and I receive inheritance for sale of his house, but its already making black mark on credit report since i agreed to pay it.

They called again today XX/XX/2018. Twice. After they called more than 3 times yesterday. Lied saying they were not a collection agency, But when I called the number back the automated greeting was XXXX XXXX XXXX XXXX. They were rude and harassing. and I intend to look more into the legal laws about the calls. 1 man I spoke to even suggested they had gotten people fired for their the way they were talked to, and processed to threaten about finding the owners and contacting them.

S & S Recovery agreed that if I paid the total amount I owed on XX/XX/2023 of XXXX, they would remove it from my credit report. However, the debt has been paid, and they haven't removed it from my credit report. Therefore, the representative agreed to DELETE it if I paid in full.
