Potential Legal Ramifications of Disclosing Medical Data on a Credit Report, I am writing to demand the removal of medical accounts on my credit report. The XXXX accounts reporting are from XXXX XXXX XXXX As a consumer who values the protection of personal information, I believe it is important to highlight the potential legal ramifications associated with the inclusion of medical information in credit reports. As you may be aware, various federal and state laws govern the privacy, security, and appropriate use of medical information. These laws include but are not limited to the Health Insurance Portability and Accountability Act ( HIPAA ), the Fair Credit Reporting Act ( FCRA ), and state-specific laws governing medical privacy and consumer rights. It is essential to consider these legal frameworks to ensure compliance and protect the rights of consumers. HIPAA : HIPAA regulates the privacy and security of protected health information ( PHI ). Disclosing medical data on a credit report without the consumer 's explicit consent could potentially violate HIPAA 's privacy provisions. Healthcare providers, insurance companies, and other entities covered by HIPAA must be cautious about sharing medical information without the necessary legal authorization. FCRA : The FCRA regulates the reporting and use of consumer credit information by credit reporting agencies. it is generally understood that the inclusion of medical data in credit reports could raise concerns about fairness, accuracy, and potential discrimination. Credit reporting agencies are encouraged to exercise. There is also the issue i did not give consent, written instruction or permissible purpose to share this information. Regulatory Enforcement Actions : Regulatory agencies such as the FTC and federal banking agencies can initiate enforcement actions against financial institutions for GLBA violations. These actions can result in cease and desist orders, fines, and other corrective measures Including but not limited to civil penalties, injunctive relief and jail time. Failure to comply with the applicable laws and regulations regarding the disclosure of medical information on credit reports may result in legal consequences, including but not limited to : a. Legal action from affected consumers, including potential claims for privacy violations, damages, and injunctive relief. b. Investigations and enforcement actions by federal and state regulatory agencies, such as the Consumer Financial Protection Bureau ( CFPB ), the Federal Trade Commission ( FTC ), and state attorneys general, HHS and OCR XXXX Reputational damage, which can adversely affect the credit reporting agency 's standing in the industry and its relationships with consumers, businesses, and other stakeholders. Given the potential legal and reputational risks involved, I strongly urge you to exercise diligence and caution when it comes to the disclosure of medical data on credit reports. Prioritize compliance with applicable federal and state laws, conduct thorough reviews of reporting practices, and implement robust security measures to protect the privacy of consumers ' personal information. These are hefty violations with serious and expensive penalties and fines, I hope you will give due consideration to this matter, as it concerns the rights and privacy of consumers. I am prepared to seek legal remedy under Fcra, fdcpa, glba Hippa, ETFA and all applicable privacy and state laws if items are not deleted. I would also like to make it know this company does not have a certificate of authority to transact business in the state and this is a breach of the arbitration agreement. Last year in XX/XX/XXXX, I reached out to Harvest Associates Inc., for the XXXX time regarding XXXX inaccurate and erroneous accounts : the XXXX account in the amount of {$660.00} for services they claimed was rendered on XX/XX/XXXX and the XXXX account in the amount of {$620.00} for services they claimed was rendered on XX/XX/XXXX. Both inaccurate and erroneous accounts are listed on my credit report. I previously sent Harvest Associates Inc., a letter explaining to them that both of my insurance companies did not receive any claims from Harvest Associates Inc or the original creditor XXXX XXXX XXXX. My primary insurance company XXXX. My secondary insurance was with XXXX which paid for any additional expenses my primary insurance would not cover. I contacted via phone both of my insurance companies and they stated to me that no claims were submitted to them for either {$620.00} or {$660.00} amounts from Harvest Associates Inc and/or XXXX XXXX XXXXXXXX. I even sent another letter to Harvest Associates attaching a copy of both insurance cards requesting them to call, write and verify with both insurance companies that my plans were active on the dates they claimed I received services on. However, Harvest Associates refused to follow-up with either insurance companies. I also requested the validity and accuracy of Harvest Associates Inc., last investigation of both accounts. However, I received a certified letter back from Harvest Associates stating that : " we have verified with the creditor that services were provided to you, or you are listed as guarantor on the account. According to the creditor 's records, the balance reported is still outstanding. " Harvest Associates did nothing to assist me and never contacted XXXX or XXXX. So, both accounts went straight to collections with Harvest Associates after XXXX months of not ever submitting a claim to my insurance providers in the amount of {$660.00} and after XXXX months of not ever submitting a claim to my insurance providers in the amount of {$620.00}. Harvest Associates refused to remove both accounts from my credit report and the credit bureau claimed that they had researched both collection accounts and had verified that the items had been reported correctly. This is not true because I sent the credit bureau proof that I had XXXX types of insurances on the service dates and the account numbers listed on my credit report for both Harvest Associates accounts is listed incorrectly. The credit bureau researched, verified and kept incorrect and erroneous accounts listed on my credit report. Both accounts are listed with different agency names on my credit report and not reflecting Harvest Associates Inc. To that end, Harvest Associates even have the name of my street misspelled on their letter.

I did not give HARVEST ASSOCIATES INC the permission to furnish information on my consumer report non consent is identity theft. 15 USC 6802 prohibits disclosure of nonpublic personal information without the knowing and expressed consent of the consumer. As a financial institution they are not to disclose non public personal information to a third party unless such financial institution clearly & conspicuously discloses to the consumer in writing or electronic form or other form permitted by the regulation prescribed under section 6804 of this title that such information may be disclosed. I did not receive any of the 3 disclosures I just mentioned, which Ive discovered is against consumer law and a direct violation. HARVEST ASSOCIATES INC and XXXX denied any inaccuracies but after further investigation I can confirm they are reporting inaccurate information on my consumer report which is a another violation under the FCRA 15 USC 1681. USC 1681b states that consumer agencies can only furnish something in accordance with the written instruction of the consumer to whom it relates. I did not give HARVEST ASSOCIATES INC permission which is another violation. TILA 15 USC 1601 protects me as a consumer against inaccurate & unfair credit billing. As a consumer, I never signed an agreement to enter into a credit transaction with HARVEST ASSOCIATES INC yet they have reported that I opened an account on two different dates because my consumer report is incorrectly showing XXXX different dates violating me even further. My complaint is also with XXXX who is allowing HARVEST ASSOCIATES INC to report inaccurate information on my consumer report which is a violation under the FCRA 15 USC 1681. USC 1681b states that consumer agencies can only furnish something in accordance with the written instruction of the consumer to whom it relates. I did not give XXXX permission which is another violation on their behalf. Not only did I not give permission to furnish this information on my consumer report, the information is also incorrect which is a violation under 15 USC 1681b for those two violations under FCRA I am seeking {$2000.00} from XXXX.

My medical debt was paid by me on XX/XX/XXXX {$680.00} to Harvest Associates Inc and I received a receipt it was paid. Requested it to be removed from my credit immediately. Called my medical insurance company on XX/XX/XXXX and was told they paid the debt as well on XX/XX/XXXX {$650.00}. I requested a transcript of all medical payments for XXXX since I never received them. I contacted XXXX XXXX XXXX XXXX XXXX and was told they did not know how to retrieve the virtual payment online, per the associate. Per a three way call with XXXX XXXX to my insurance company. I was able to get the insurance company to stop pay and reissue the payment sent on XX/XX/XXXX. Did three way call again another 2 times for payment to be reissued. Faxed copy of payment receipt to XXXX XXXX XX/XX/XXXX. My Insurance company would not allow me to cancel a payment to be reissued. Had to come from XXXX XXXX. Tried to get my insurance company to make the payment to me on XX/XX/XXXX was told the XXXX XXXX XXXX billed them it had to be paid to them. I faxed XXXX XXXX copies of receipt from Harvest Associates payment on XX/XX/XXXX and XX/XX/XXXX. Did not receive any contact from XXXX XXXX until XX/XX/XXXX requesting payment and I explained the issue again. I received a text to pay the {$25.00} co-payment on XX/XX/XXXX. I contacted XXXX XXXX on XX/XX/XXXX to tell them again the bill was paid in full to Harvest Associates and I will not be paying the {$25.00} co-payment until I receive a refund of {$680.00}. Per XXXX XXXX XXXX no one reported to them it was ever paid. Per XXXX XXXX they contacted Harvest, on XX/XX/XXXX was waiting on response. On XX/XX/XXXX XXXX XXXX sent them a copy of the receipt again and was told it had to be researched. Not sure why, its a receipt they provided to me on XX/XX/XXXX. Called Harvest on XX/XX/XXXX, to avoid this letter and was told I would get a call back on Friday XX/XX/XXXX or Monday XX/XX/XXXX with a refund status. The owner that cuts the checks will be out till Friday XX/XX/XXXX or Monday XX/XX/XXXX. No contact from Harvest. I feel Ive been a victim of fraud.

I gave all insurance and contact information to the staff. I only received one bill from the hospital and paid in full when I received the bill. It is in XXXX, XXXX, when checking my credit report, I noticed there is a collection of {$1400.00} against me. I called the hospital and was told it is from the doctor, not from them. I had not and have not received any bills from the doctor and the collection. So, I called the the collection, and according to them, the doctor did not get my contact and insurance information from the hospital and thus gave the debt to them. They admitted that neither the doctor nor the collection have ever contacted me about the bill because they don't have my contact information. I told the lady it was not my fault because I gave the information to the hospital and they had my information and sent me the bill and the insurance claim for their part. It is the doctor 's and the hospital 's responsibility communicate the information correctly and timely. It is unfair to penalize the consumer by putting this directly to the collection and to the credit report, negatively impacting my life. I also gave her the correct address and the correct insurance information. She promised the collection record would be removed from my credit report after the insurance paid. However, after they successfully claimed the insurance on XX/XX/XXXX, the collection record is still on my report showing a smaller amount due. Fine, if it is something I owe I will pay, but until today I have not received anything in the mail from them. It is very unethical that they did not do what they promised, which is not my fault from the very start to the end anyway, and did not communicate anything once they have got the money. I called their number, but could not reach them this time.

Dear Sir or Madam : I notice a collection account for XXXX XXXX with account # XXXX. The original Account # XXXX is with a balance due of {$960.00}. Ever since 2013 when it was first reported to the credit bureaus, i disputed the creditors in question in writing via US Postal Mail and demanded proof under the Texas Finance Code section 392.202 ( b ) that I am their customer. I asked for proof of the alleged debt, including specifically the alleged contract or other instrument bearing my signature. Section 392.202 ( b ) of the Texas Finance Code requires the debt collector to provide a Statement that verifies the accuracy, confirms the inaccuracy or states that they have not yet completed their investigation or determination. There is a requirement that response be provided within 30 days of request, however the response can state that they have not yet completed the investigation. So far XXXX XXXX has been able to provide NO such proof to me. I have sent follow-up letters to each of them and there is still no proof. I have attempted phone contact, but I simply get transferred around and nothing ever gets accomplished. Despite credible debt validation letters sent & their obligation to cease collection activities, XXXX XXXX showed willful ignorance to the law with inaccuracies in their response times. Under TX Finance code section 392.202. ( b ) collectors are required to delete their reported collection if they do not provide their statement within 30 days of request & have the option of re-inserting the reported collection if they have legitmately validated

'' My Nine digit Social Security card number that was used to extend credit in the below account is prohibited by law to publish on any credit reporting agency. On XX/XX/XXXX I sent a second dispute to XXXX regarding an inaccurate/ fraudulent Medical bill that they are reporting on my credit. I was never in the hospital when the bill stated that I was, and my insurance has no records for any request for payment for the bill in question. XXXX sent me a statement report on XX/XX/2021 report # XXXX The report states that they have investigated item account # XXXX and that the item belongs to me. XXXX did not provide any details as to how that Item was found to belongs to me, Per the dispute, I requested for the second time that XXXX furnished proof that such an item belongs to me and a copy of the HIPPA release form that I signed by me authorizing my medical data to share with these above-mentioned third parties. This is a clear violation of my rights according to HIPAA. Harvest Associates INC and XXXX for the second time failed to furnish the requested proof yet, the negative item continues to reports on my social security credit device.

I recently received a copy of my credit report that your company publishes and after reviewing it I found a number of items on the report that are inaccurate. The accounts in question are listed below. Please send me copies of the documents that you have in your files as of this date that you used to verify the accuracy of the accounts listed below. Under the Fair Credit Reporting Act, 15 U.S.C. 1681g I have the right to demand that you disclose to me all of the documents that you have recorded and retained in your file at the time of this request concerning the accounts that you are reporting in my credit report. Please do n't respond to my request by saying that these accounts have been verified. Send me copies of the documents that you have in your files that were used to verify them. If you do not have any documentation in your files to verify the accuracy of these disputed accounts then please delete them immediately as required under Section 611 ( a ) ( 5 ) ( A ) ( i ). By publishing these inaccurate and unverified items on my credit report and distributing them to 3rd parties you are damaging my reputation and credit worthiness. Harvest Associates INC. has reported an alleged debt of {$950.00} to the credit bureaus but never sent me anything validating the suspected debt or any form of verification in the mail. I sent them a request which was delivered and signed for on XX/XX/2023, at XXXX XXXX via certified mail with a return receipt ( attached ) asking for validation but Harvest Associates INC failed to respond within the 30-day timeframe allotted to them. I sent out a second notice on XX/XX/2023 which is currently in transit via USPS-certified mail ( attached ) notifying them of their failure to validate and verify the alleged debt being claimed against me. Pursuant to FDCPA SECTION 809 ( a ) Validation of debts ( 15 USC 1692 G ) they must validate the alleged debt if requested. They have failed to respond to my request to validate and/or verify the alleged debt within 30 days. They also failed at notifying me before claiming it on my credit report. Due to their failure to respond and unfair practices, I am expecting immediate removal of the alleged debt from all credit reporting agencies, ( XXXX, XXXX, XXXX ) and that the alleged debt in its entirety along with any assumed fees is promptly deleted from their files and all public files due to their failure to validate it within 30 days of my request. I have reached out to XXXX regarding erroneous, and unvalidated information from XXXX collection agencies, XXXX of which has since stop reporting on it's own after I asked the company to validate the alleged debt. The XXXX remaining collection agencies are Harvest Associates and XXXX XXXX XXXX have yet to validate their alleged accounts. I have never given Harvest Associates nor XXXX XXXX XXXX permission to receive, collect, nor furnished any of my personal information and private information to any agency ( ies ) or person. XXXX seems to be violating the law. 15 USC 1681b Permissible Purpose of Consumer Report. ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. XXXX stated that they investigated the alleged accounts and it was verified, and will not reverify the alleged accounts. I wrote XXXX again requested information regarding their investigation in XXXX, XXXX. As of now XX/XX/XXXX I have not receive the requested answers to my questions regarding the validation of those 2 alleged accounts. 15 USC 1681 a 2 ( a ) ( i ) Exclusions.Except as provided in paragraph ( 3 ), the term consumer report does not include ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report.

I was living abroad during the period of XX/XX/XXXX- XX/XX/XXXX as an expat. Upon repatriating, I found that my credit score was severely affected due to a number of fraudulent accounts reported under my name. I disputed those accounts and was able to have them removed except the one reported by " Harvest Associate Inc. '', which is shown as in collection, with the original creditor listed as " XXXX XXXX XXXX '', a hospital XXXX XXXXXXXX that I have never visited in my entire life, let alone during the reported year of XXXX, where I was physically living in XXXX / XXXX. There is simply no possible way that I could rack up a medical bill when I was on a different continent!! I was able to successfully dispute this account with XXXX. However, XXXX insists that the record from Harvest Associate Inc. is correct, without conducting any actual investigation. " Harvest Associate Inc. '' also insists that the collection account is definitively mine, even though they could not provide any definitive proof ( they could not have because, again, I was not physically in the country when the medical cost was incurred ). This record has negatively affected my ability to secure an apartment lease when I first moved back to the US. After multiple disputes, both XXXX and Harvest Associate Inc. still insist on upholding their false claims. Now it's affecting my chances of getting a mortgage for my new home.

New cell phone number was assigned to me over 1 year ago and then shortly thereafter, Harvest-Inc. Medical Debt Collectors have contacted me almost daily using phone numbers XXXX ; XXXX ; XXXX ; XXXX in attempt to collect an apparent debt from another person. When I called them over a year ago and told them this was an assumed phone number from a previous owner and they told me who the debt was for, I informed them that person no longer had this phone number and did not reside here. Despite telling them this and also complaining to Do NOT Call Federal and State agencies, they continue to offend almost on a DAILY basis. My cell phone number filed with the DO NOT CALL agencies and which Harvest-Inc continues to call is XXXX. I have also sent Harvest-Inc. a letter form developed by the XXXX XXXX XXXX titled : Request for Debt Collectors to Stop Contacting You that gives them formal notice in writing under the Fair Debt Collection Practices Act to cease contacting me-EVEN though they were informed OVER 1 YEAR AGO they are contacting the wrong individual and that I am registered on the DO NOT CALL list, yet they have offended by continuing to contact me almost daily for OVER 1 year despite telling them to cease all contact OVER 1 YEAR AGO.

This company is trying to collect {$360.00} from me for a medical bill they claim I owe. I have written them several letters since XXXX 2016 demanding that they comply with the Fair Dept Collection Practices Act and the Fair Credit Reporting Act by ( 1 ) providing me a contract or bill with my signature on it as follows : " I am requesting validation, made pursuant to the Fair Debt Collection Practices Act. Harvest Associates is reporting a collection account on my reports that I have been disputing for a while now. I sent them a letter requesting for verification of this debt. In return of my dispute they sent a letter stating that the original creditor is XXXX XXXX and that the balance they say I owe is {$2500.00}. They have not sent any sufficient documents or proof that this account belongs to me or that XXXX XXXX gave Harvest Associates permission to collect on this debt. I have never even received a letter from XXXX XXXX stating that this account was sold to a collection agency. I am filing this complaint because a collection agency ( XXXX XXXX XXXX ) reported a collection account on my credit report that I completely disagree with. I don't acknowledge this account. I sent this agency 2 dispute letters by certified mail in an effort to resolve this matter. I demanded proof of the debt that they claimed was mine. On XX/XX/XXXX, HARVEST ASSOCIATES , INC sent a letter in the mail stating I owe them {$820.00} for a service that took place XX/XX/XXXX. I sent a letter of validation and they could not verify the debt. I also sent them a cease and desist letter that was ignored. They are also in violation if 15 USC 1692b and 15 U.S.C. 1692d. I recently pulled my credit report and there is a collection account that is listed. I have know knowledge of the account and have never been contacted by phone or mail about the account that the company say 's I owe. The account is affecting my credit score. I also see where the account was assigned on XX/XX/2018 in the amount of {$93.00} I also have not signed any HIPA forms giving permission for this or any other third party companies to obtain my medical records. I explained to the collector that insurance was provided and time of service and then I also provided insurance information again to them several times. I was told they would apply it to applicable accounts as some accounts they waited to long to file with the insurance company which was not my fault. However, the creditor agreed to remove these debts from my credit report but did not. I then disputed it with the 3 credit bureaus and each time XXXX come back verifies the debts as accurate. I also believe that any company that has given Harvest Associates any information concerning any medical information about me is in complete violation of HIPPA and so is Harvest Associates because I have never given any company permission to share my medical information. I saw many collection accounts on my credit file from Harvest Associate. They took one emergency rom visit and broke it down to several collections and changed the dates on each to make it look like I went to the emergency room every other day. One of the collections are duplicates on m credit for XXXX it is reported twice.
