Rushmore Service Center Collection Agency, XXXX, Rushmore Service Center ( RSC ) debt collector and XXXX, RSC debt collector violated our rights and three known statues of the Fair Debt Collection Practice Act and Privacy Act of XX/XX/XXXX. XXXX and XXXX were informed that we were recording the phone call. In the state of Nebraska, it is a Class III misdemeanor to violate the Fair Debt Collection Practice Act. The following will provide detail regarding the aforementioned statutes and offenses with RSC and it 's debt collection representatives, XXXX and XXXX. The statues are listed below which RSC has violated : The Fair Debt Collection Practice Act : ( 1 ) The Fair Debt Collection Practice Act Section 805. COMMUNICATION WITH XXXX PARTIES. [ 15 USC 1692c ] Except as provided in section 804 ( noted below ), without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a post judgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. ( 2 ) The Fair Debt Collection Practice Act Section 804. Acquisition of location information [ 15 USC 1692b ] Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall - ( 2 ) not state that such consumer owes any debt ; ( 3 ) The Fair Debt Collection Practice Act Section 805. [ 15 USC 1692c ] CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt. For the purpose of this section, the term " consumer '' includes the consumer 's spouse, parent ( if the consumer is a minor ), guardian, executor, or administrator. ( 4 ) The Fair Debt Collect Practice Act 806. [ 15 USC 1692d ] Harassment or Abuse. Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with the intent to annoy, abuse, or harass any person at the call number. In XX/XX/XXXX, during, approximately 3 or 4, phone conversations and with a written notification included with my check payment, I had informed RSC several that I wanted to exercise my rights under the Fair Debt Collection Act and Privacy Act of XX/XX/XXXX to resolve this debt with XXXX. RSC continue to call and harass me. On XX/XX/XXXX, XXXX from RSC called my home phone. My wife, XXXX XXXX, answered the call. XXXX informed my wife that she was with RSC and she was recording the conversation. XXXX XXXX then informed XXXX that she was recording the phone conversation as well. First, XXXX asked to speak to me, XXXX XXXX. XXXX XXXX informed her that I was not available and offered to take a message. Next, XXXX without my consent told XXXX XXXX about the origin of the debt and the amount of the debt. XXXX consistently tried to provoke and engage my wife to commit to pay the debt or make payment arrangements to pay the debt. XXXX XXXX continued to inform XXXX that she was recording the call and requested the necessary information for written message. XXXX continued to harass XXXX XXXX for a payment. At one point, XXXX would not provide a call back number. Finally, with my wife 's persistence, XXXX finally provided the necessary information for a written message. I need to be compensated for my rights being violated, secondly my wife need to be compensated, and third RSC needs to fined.

On XX/XX/XXXX I reached out to XXXX XXXX XXXX Credit Card company in order to resolve an issue on my account. My account is reflecting a balance that should reflect paid in full as of XXXX. The company is stating I owe a balance of approx {$310.00}. I was working with XXXX XXXX XXXX XXXX XXXX For 2 years to pay off debt. I completed the program as of XX/XX/XXXX. At the time, XXXX XXXX XXXX Credit Card company sold my debt to Rushmore Service Center but as of XX/XX/XXXX they switched debt collections to XXXX XXXX XXXX. We ( credit counseling company and I ) were never notified of the changes. Payments began to be forwarded to XXXX XXXX after the change. XXXX XXXX states that Rushmore cashes the check and then electronically submits payment over to them. A total of {$1000.00} was the beginning balance owed to XXXX XXXX and was paid in full with XXXX XXXX XXXX XXXX. After back and forth calls to XXXX XXXX and Rushmore service center, both stated to me that they can not provide a statement of all the payments received so that I can compare with my XXXX XXXX statement of payments sent out. After being denied, I asked to speak with a manager at XXXX XXXX to help with receiving a statement and was denied that request. I asked for the representatives name in which she denied me that information as well. On XX/XX/XXXX I contacted XXXX XXXX so that they can verbally go over payments they received. XXXX provided me the payments but also made sure to reiterate she wont be providing me a written statement. From the payments she listed, there are several payments missing. She said she could not help me and to contact green path. I spoke with XXXX at XXXX XXXX who took the time to contact XXXX XXXX while on the line to help find missing payments. We spoke with XXXX, who seemed to be very dismissive and defensive. She then advised us to contact Rushmore. We both called Rushmore and they referred us back to XXXX XXXX. XXXX faxed over the payments that are missing, to one of Rushmores credit reps. I asked for copies of the check they received or if they can check to see if checks were applied to the wrong account. They have been unprofessional as well as very dismissive of my issue. I am being denied written statements and they cant account where my money was being applied to. I should not still owe a balance with them.

Right after that they put me on a new program referred to as partial claim on XX/XX/XXXX, I spoke several times with RushMore representatives and asked them if I was still protected on my credit and ALL of the said yes that I was protected without any risk of being sent to the bad credit, I spoke over 6 times with them about that in different dates since XX/XX/XXXX and even all the way until XXXX XX/XX/XXXX Rushmore transferred my loan to XXXX XXXX on XX/XX/XXXX and the situation got even worse, During the transition, the apparently lost the partial claim paperwork and by the time they were able to locate the paperwork from Rushmore it was XXXX weeks later. When I initially called Rushmore in XXXX of XXXX, they said they were going to delete the mortgage lates and to expect something by XXXX of XXXX. In XXXX of XXXX, I reached out as nothing had happened, and they said another XXXX weeks. This has now been going for XXXX mos. And still nothing. Recently, I had my credit pulled, and the 3 month mortgage late was still reporting. I dont know what else to do, but really need help! theyre saying or acting like it was nobodys fault both parties Rushmore and XXXX XXXX saying it was Rushmores fault, I dont think is fair to us since we need to sell our actual house due a personal situation with a baby girl that we have with especial needs and she has medical equipment as well going now more often to XXXX, XXXX for XXXX to be seeing by doctors over there, for that situation and location of the actual house we need to get a house closer to the way to XXXX, XXXX since we live XXXX XXXX XXXX right now, apparently theres an easy option to delete those late months through E-Oscar, I dont know why Rushmore dont fix their mistake and let us move forward with the purchase of our new home, we need this matter to get fixed ASAP If you have any other questions please dont hesitate to contact me at XXXX XXXX XXXX Thank you so much for helping on this matter, Sincerely XXXX XXXX

I FILED AN FTC COMPLAINT AGAINST XXXX XXXXXXXX XXXX BACK IN XX/XX/2020, FTC FILE # XXXX. THIS COMPLAINT WAS FILED DUE TO FIRST XXXX XXXX 'XXXX FALSE AND DECEPTIVE ADVERTISEMENT TACTICS OF CREDIT PROTECTION. THE CREDIT PROTECTION PROGRAM XXXX XXXX CHARGED FOR EACH MONTH WAS IN THE EVENT OF LOSS OF EMPLOYMENT, OR NO LONGER WORKING, THE CREDIT PROTECTION THAT THEY CHARGED YOU FOR EACH MONTH WOULD PAY THE MINIMUM MONTHLY CARD PAYMENT EACH MONTH FOR UP TO A WHOLE YEAR. HOWEVER, ONCE THE COVID 19 PANDEMIC STRUCK AND SHELTER IN PLACE ORDERS WERE IMPLEMENTED FOR THE STATE OF NEW JERSEY, THE COMPANY BEGAN REPORTING DELINQUENCIES TO THE CREDIT BUREAUS EVEN AFTER ADVISED THAT I WANTED TO USE MY CREDIT PROTECTION THAT I HAD BEEN PAYING FOR. THE CREDIT PROTECTION PROGRAM WAS A FRAUD, MORE OF A SCAM IN ORDER TO GET EXTRA MONEY EACH MONTH OUT OF CONSUMERS. AND THE COMPANY WHILE ON THE CREDIT PROTECTION PROGRAM SENT OUT THREATENING LETTERS THAT STATED THEY WERE REPORTING NON PAYMENTS/DELINQUENCIES TO THE CREDIT BUREAUS. AFTER I CONTACTED XXXX XXXX XXXX CERTIFIED MAIL WITH A DISPUTE LETTER. XXXX XXXX XXXX FAILED TO RESPOND TO THEIR FRAUDULENT CREDIT PROTECTION PROGRAM. INSTEAD, XXXX XXXX WAITED NEARLY 8 MONTHS LATER FROM XX/XX/2020 AND RE-SOLD THE EXACT SAME ACCOUNT TO RUSHMORE SERVICE CENTER. AS A RESULT, I HAVE FILED AN FTC COMPLAINT AGAINST RUSHMORE SERVICE CENTER. THE FTC FILE # IS XXXX. NOW RUSHMORE SERVICE CENTER IS CONTACTING ME REQUESTING PAYMENT FOR THE EXACT SAME DISPUTED ACCOUNT THAT XXXX XXXX IGNORED ALL CERTIFIED DISPUTES ON WHEN THEY RECEIVED THE DISPUTE LETTERS CERTIFIED MAIL. Beginning XXXX, Rushmore Service Center LLC started harassing my workplace, my co-workers and my Supervisors. I work only a few days a month at my workplace and do not even live in XXXX XXXX SD. When the process server came to the business they showed the paperwork to our guards with personal information regarding me. They then refused to leave when told I could not come out or was not there. They followed and questioned co-workers about me and my schedule. Then a week ago they started harassing my Daughter at her apartment. They left a postcard in her door and today the taped a postcard to her apartment entry main lobby for everyone to see. Not in an envelope and had my name and her apartment # on it. I contacted the Atty General for South Dakota, XXXX XXXX and he instructed me to contact the FTC/complaint file/and to contact you. They are locating my children using XXXX and XXXX and they gather all of my children 's info, their spouse info/ssn # 's/phone # 's/neighbors # 's and cousin 's information including ssn # 's. They were told by my Attorney XXXX XXXX, XXXX SD, that they had to contact him and only him but they do not listen and now have released private information to my family, co-workers, guards at my work and Supervisor. I do not know what they want or are trying to collect. My spouse has XXXX and has medicare. I only work 2 days a week and travel to do that. It uses everything I make to keep coverage of health insurance at work. They were told 2 days ago by my Daughter that they have the wrong address and still posted a postcard with all of my information today in her entryway. At least XXXX people would have seen it today.

This is someone trying to collect a debt that is not going to be paid on nor will I aloud any kind of fraud to happen. This debt collector is collecting a debt that was removed from the credit bureaus due to fraud. They are attempting to now collect on that account that was removed for fraud. I want no contact about this account again. It will not be posted to my credit or I will sue. I already sued another creditor so if you contact me in regards to this I will let my FDCPA attorney know and we will sue you.II want no more harassing phone calls or letters from you. If you try to put this in my credit you will be sued for violating the law. I want nothing to do with you or this fraud account so no more contact at all. It started with the XXXX XXXX card I had them removed from my credit reports due to fraud and abuse. This company I just got a letter from and I got tired of dealing with the first premier card. For my loan, we did a three-way with XXXX and they claimed to not know XXXX. I was approved for a loan. XXXX asked them for information on the account nothing matched up with them or my records. First, they said I owed them XXXX then XXXX then XXXX then XXXX then XXXX Which XXXX was on a three-way line with me and my loan company at that time. They are trying to commit fraud to the point XXXX and XXXX removed them right away. Lied about a balance owed lied about my information. The credit bureau removed them and put a fraud alert on them due to it.Now this company is claiming a totally different thing XXXX when they claimed only XXXX was owed and refused to correct any of their bogus claims. So please stop the harassment.

An account was being reported as charged off and closed by XXXX XXXX XXXX on XX/XX/2020. I received a letter from Rushmore Servicing Center a couple of months later stating that an account had be acquired from XXXX XXXX XXXX by Rushmore Servicing Center the letter stated that they are the current creditor and all communications would be handled by Rushmore Service Center. I sent a letter addressing this matter on XX/XX/2020, I requested to receive the original instrument of validity in its original format and not copies of any billing statements that proves that I entered into a business relationship with Rushmore Servicing Center. I received a corresponding letter from XXXX XXXX XXXX which I found to be a little strange because I sent the letter to Rushmore Servicing CenteXXXX. The letter I received had copies of billing statements and nothing pertaining to my original request. The letter stated that this was considered to be proof of validation but it wasn't at all what I requested. So, I sent another letter on XX/XX/2020 requesting to receive the same information in the previous letter that I sent. The corresponding letter that I received today as of XX/XX/2020 was the same response I received prior to this letter but still no substantial evidence that validates my request. I recently discovered that XXXX XXXX XXXX uses the same information as Rushmore Servicing Center and operates under the same umbrella to continuning using tactics to deceive people into believing that they owe on these so call debts when they actually don't

A man came to my grandmothers residence yesterday and asked for me. He said he had papers to serve me. MY grandmother told him I was working. After getting the call from my grandmother at work about this, I did n't quite understand because I have no debts. out there. Then a couple hours later the man called my cell phone twice. I answered the second time and he just kept asking for me but I did n't admit that I was who I was on the phone so he hung up. I googled the phone number he called from and there is a website that came up that state its XXXX I then XXXX the address listed so I could go there and try to figure out what this paper work being served to me was about. I go to the address and its a XXXX shipping store.. I called the phone number about 4 times before driving there and no answer. XXXX. After going home my grandmother said the man came again to her residence at XXXX at night and asked for me again. She finally told him that he was driving me crazy because I do not have any debt out there but she will take the paper work so I could be informed what this was about. So I drive over there and read the letter and it states that our local hospital here is taking me to court for not paying a {$600.00} bill from XXXX XXXX years ago. I live in South Dakota by the way. This sounds like a complete scam. Because XXXX XXXX years ago I was XXXX XXXX XXXX I did n't have any hospital bills from back then. Everything is just fishy with this.

He stated that he will not argue with me, when I wasnt arguing with him he was very rude, but the way that wasnt his first time calling my CELL PHONE from a business with PRIVATE CALLED. He asked to speak with me but before he knew it was me he just gave me debt information and I asked him why is he calling from a private number and he stated he have no control over the phone number and I asked one more time why not from the company phone. Did not verify information went right into the mini miranda and asked when can I pay in full of {$500.00} from XXXX XXXX credit card. I asked him if I can speak with a manager, he placed me on hold for 2 seconds and stated no manager was available. I mentioned I will be contacting my lawyer. I also mentioned the second day he called private to NOT CALL MY PHONE he said okay and hung up and called me again next day less than 12 hours away. Not to say the debt isnt mines but he violated my privacy. On XX/XX/2019, I was contacted through mail from Rushmore Service Center on a credit card debt asking me to notify them within 30 days after receiving the letter so that I can verify if the debt is mines or not. I mailed them back certified and they received the letter on XX/XX/2019. I asked them to provide any legal evidence that I owe them, to show my contract that I signed with them, provide copied of the debt, proof that they are licensed to pursue the debt and their license number and I also sent a cease and desist letter so they would not call me. They did not provide me with their licence number, they did not provide proof that they are licenced in my state and they did not provide a signed contract that I have with them or the original company. They also typed up a false letter from " XXXX XXXX XXXX '' stating the information provided as validation of debt. XXXX XXXX XXXX sold the account so they will not be communicating with me. Rushmore Service Center did not provide me with a letter that they mailed to me on XX/XX/2019 explaining the " validation ''. They only sent a fake cover letter from XXXX XXXX XXXX and three statements from XXXX XXXX XXXX.

I have been a victim of fraud. Several credit/loan accounts have been opened in my name. The bank account these were maintained through was fraudulently opened through several prepaid debit card accounts and a XXXX XXXX account and XXXX XXXX XXXX. My mail had also been intercepted by the perpetrators for over two years. ANY good that were shipped and bought with ANY of those accounts I DID NOT Receive. Several Payments were made to keep accounts looking good while maxed out so I DID NOT find out about the accounts until much later and the damage had been done. The prepaid bank accounts, XXXX and XXXX accounts that made payments on these alleged accounts was opened and funded fraudulently.

On XX/XX/2021 I received a letter from Rushmore Service Center attempting to collect a debt that I do not owe. I then sent out a cease and desist letter, an affidavit of truth and an invoice with the list of violations this company has. I have never done business with Rushmore Service Center, I did not authroize them to communicate with me and an investigation was never done, because if it was I should have received the documentation to prove it was completed. XXXX XXXX XXXX sent my debt to a collection agency called Rushmore. I had an agreement of pay to delete and was sending all my money there. Rushmore eventually contacted me in 2021 to tell me that XXXX XXXX bought back the debt. They did not inform me of this and even though the account is paid in full they are reporting a charge off actively on my account. XXXX XXXX has not contacted me nor has validated the debt I requested within 30 days. They also removed my access to their banking system and made it hard for me to pay off this debt. Luckily I finally got in touch with someone after trying for a month to make the final payment, even though the debt was satisfied with Rushmore Service Center.

I called XXXX XXXX at XXXX. I made an offer to settle an existing debt I owed. The lady I was speaking incredibly condescending and insinuated that I was morally bankrupt for not offering to pay the full amount. I expressed that I simply was looking to take care of my debt that I owed and would like to speak to a manager. I was then put on hold for 50 minutes. No one jumped back on the call at any point in time to tell me if I was still being connected. Just 45 minutes of hold music. I used a separate phone and called to ask to be connected with their FDCPA compliance department or a Manager. I was told they had no compliance department and no managers were available.

I need my mortgage company ( Rushmore Servicing ) to start reporting my mortgage payments to the credit bureaus. Presently they are not due to a discharge bankruptcy that occurred years ago. I am no longer in a bankruptcy and paying my account. Per the mortgage company, they do not have to report to the credit bureau at all. I tried to explain I need my payments to be reported as this is negatively impacting me from obtaining a home equity line of credit to assist with getting needed repairs done to my home. It is also impacting my credit score. The company flat out refuses to reverse this. Please help me in working with the company to have this issue resolved.

This number ( XXXX ) has repeatedly called and I just received my number today, therefore I have no connection to this company. I called them back and they immediately demanded my name and social security number. I verified my phone number with them and explained that since this is a new number to me I have nothing to do with them. They continued to demand my personal information and became rude and aggressive when I told them to stop calling me. They still refused to say anything other than they were a debt collector trying to collect from me. I do not owe anything to them.

Since I have n't had debt to anyone for over the last twenty or more years I 'm concerned about the frequent calls from Rushmore Service Center # XXXX in XXXX XXXX, SD, a third party collection agency that gives me at least four calls a week. I have no need to answer the phone from them, a quick look on XXXX tells me who they are. The calls from them have been going on for several months now and they need to stop. I suspect they have the wrong number and need to correct their file.

I set up re-occuring payments, the debt collector agreed to the amount I could pay. I previously had payments set up on hold with them, my debt with them increased in amount so I called back and set up a larger amount bi-weekly. The debt collector said they canceled my old payments on hold, Instead they ran XXXX payments thru my checking account. The old amount & the new amount, resulting in double payments being drafted thru my checking account without my consent.

This is my XXXX submission. This is not an issue for the FTC. It is a violation of the FCRA Section 623 ( a ) ( 1 ) ( a ). I settled this debt with Rushmore for my XXXX card. I disputed it with the credit bureaus..they sent the dispute to XXXX XXXX and they simply applied the settlement to the balance and left a balance on my credit file. This is willful negligence of compliance with the Fair Credit Reporting Act. CFPB is an entity that enforces these violations.

Rushmore Service Center continues to attempt to collect a debt they can not prove is mine. I have asked on three separate occasions for the documentation indicating my business relationship with RSC and the contract with my wet signature. Rushmore Services persistently contacted my employer 's office after I asked them repeatedly not too. I asked to be contacted by mail if they wish to discuss a matter with me. After some research on my own they were attempting to collect a debt that was paid off. Not only have they harassed me at my place of employment, but they have a debt that has been paid.

I received a letter from XXXX Center about a debt. It was original XXXX, In Which I did have a card.
