Debski and Associates acting as a Debit Collection Agency failed to validate their claim for the account which they were attempting to collect a debt, XXXX XXXX Account : XXXX their Case No : XXXX, as required by the Fair Debt Collection Practices Act Section 809 [ 15 USC 1692g ]. The debt has been disputed thus Debski and Associates were required by the FDCPA to cease collections until the debt collector obtained verification of the debt and said verification is mailed to the consumer. Validation was never provided. Debski failed to cease collections and filed suit in small claims court violating Federal Law. The only document provided to the consumer was through an attachment to the suit, filed in small claims court, Complaint - Breach of Contract referred to in the complaint as " the Agreement ''. " the Agreement '' fails to meet the litmus test for validation. " the Agreement '' consist of pages XXXX thru XXXX of a PDF that can be downloaded by anyone at the url XXXX the matter XXXX v. XXXX, XXXX XXXX XXXX ( Ind.App. XX/XX/XXXX ) : According to this case, the debt collector must, at the very least, provide a full payment history and an explanation of how any additional fees were calculated. In the matter XXXX vs. XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX Cir. XX/XX/XXXX ) : " It is unfair to consumers under the FDCPA to hide the true character of the debt, thereby impairing their ability to knowledgeably assess the validity of the debt. " Although these cases differ in nature they confirm at a very minimum an itemized accounting of how the total amount of debt was calculated including fees and interest should be included in a debt validation. Additional debt validation should include account statements from the original creditor, payment history with the original creditor or a copy of the original signed contract between the original creditor and debtor. Debski and Associates having provided the consumer only a PDF that they refer to as " the Agreement '' by means of attachment to the complaint failed to meet Section 809 of the FDCPA [ 15 USC 1692g ] therefore invalidating their suit Complaint - Breach of Contract. In XXXX XXXX, I reviewed my credit report via XXXX after being denied credit to refinance my house. I was advised that I had XXXX civil judgments on my credit report. Both civil judgments occurred in XXXX XXXX, Fl. I pulled the docket numbers ( XXXX and XXXX ) from XXXX XXXX Circuit Court. The defendant in both cases is XXXX XXXX XXXX, XXXX XXXX XXXX, FL with a date of birth of XXXX/XXXX/XXXX, SSN : XXXX. Debski Associates was the plaintiff for XXXX and XXXX was the plaintiff for XXXX. My name is XXXX XXXX XXXX, XXXX/XXXX/XXXX, Last 4 SSN : XXXX. I notified both plaintiffs on XXXX XXXX XXXX that XXXX XXXX collection and derogatory information ( attached documents ) was placed on my credit report erroneously and I wanted it removed expeditiously. Four months later it was removed from all XXXX credit reports after my credit score dropped, my credit agencies closed my accounts or reduced my credit limit. This also affected my security clearance for Department of Defense. In XXXX XXXX, I received a letter from a credit card ( XXXX Bank ) stating that my credit limit was being reduced on credit card due to serious delinquency and collections. I pulled my XXXX credit report and the previous collections ( XXXX and XXXX ) from XXXX XXXX Circuit Court were placed back on my credit report, to include additional delinquent credit card and mortgage accounts. At this time, I have been refused credit as well as the ability to lease a house. My credit score has dropped over XXXX points and once again my security clearance is in jeopardy. I contact the XXXX Credit Agencies and pointed out the disputes on the reports reference to XXXX XXXX XXXX. However, all agreed to look into the disputes but none was able to explain why this issue occurred again. XXXX actually told me to contact XXXX XXXX XXXX and have her fix her credit issues. I attempted to make contact with Debski Associates and XXXX to get this issue resolved ; however, neither company would address the issue and told me to contact the Credit Agencies. I 'm prepared to provide copies of my XXXX and XXXX XXXX credit report, the dockets, and letters to the XXXX plaintiffs.

I recently received many solicitations from attorneys that wanted to help with a lawsuit, I became very curious as to why I was receiving all this mail. I went online to public records and found that a pre-trial conference was scheduled for XX/XX/2019. I never received any information by mail or by phone. I never received any legal documentation regarding this matter. I was very upset to see this under my name in public records with a past due date. On XX/XX/2019 I called the office of XXXX XXXX XXXX XXXX. I asked to speak with Mr. XXXX. The woman that answered my call said he was unavailable. I gave her my name and asked for her name and she just ignored my question. I willingly provided her with my personal information. She informed me that they are representing XXXX XXXX & I owe a balance of {$3600.00}. I informed her that I had XXXX XXXX XXXX accounts in the past years all 4 were closed upon my request all 4 had a XX/XX/XXXX balance. When I told her that this has to be some mistake, I do not owe this money, she became very argumentative. I asked her for her name again, she replied that our discussion was over and hung up. I called back a few more times today, but all I received was a voice message. I left two individual messages, but no one ever returned my call. I can not resolve this issue when this woman is screening phone calls and refuses to give me her name. XXXX XXXX XXXX have not returned my phone call and this unidentified woman behaved like a loan shark, using unprofessional scare tactics. Please help me clear my name and this serious matter. These accounts were purchased by a third- party collections agencies who posed as legal representatives for XXXX XXXX USA . However, XXXX XXXX sold the two credit card debts, as stated on my XXXX XXXX account. I went to court several times about this matter, filed motions to dismiss because the collections agencies were misrepresenting/posing as XXXX XXXX legal counsels, and was fighting the cases. Then the courts were shut down in mid-XXXX XXXX ; with pending court dates. All civil cases are suspended until further notice due to COVID-19. A few days ago ; the collections agencies made new reportings to XXXX about the XXXX & XXXX credit card debt. They changed the last payment date that has/would re-set the statute of limitations of five years. I have filed dispute claims. I am requesting to file a complaint with this agency about the unethical tactics. Sirs, this complaint is in accordance with your decision on XX/XX/XXXX-Court action taken against XXXX XXXX XXXX for selling bad debt ( CC debt ), about their engaging in unfair, deceptive, abusive acts and robo-signed affidavits to get a Judgement against consumers.. The exact scenario happened to me with XXXX.. on XX/XX/XXXX. first correspondence and ending XX/XX/XXXX, final judgment for Plantiff. The debt buyer ( Attorney ) claims he is representing XXXX, when in fact, they have : # 1 - Lack of standing, the Chain of Custody has been broken, Florida law in assignment by the XXXX, XXXX assisted third party debt buyers in deceptively collecting debts. This was a written off account refunded back to XXXX either by insurance or the XXXX & deemed uncollectable. # 2. A robo-signed affidavit to sue me for unverified debts, .Their refusal of providing production, documents & proof of the custodians mire existence were met with denials, as my rights in the matter were unfair & illegal. I had prepared & studied this case before its hearing, and properly presented evidence. All of my suspicions have been proved by your decision and I thank you for invoking consumers rights

On XX/XX/2021 i received a summons from XXXX XXXX XXXX XXXX Debski & Associates PA XXXX XXXX XXXX XXXX Fl XXXX. Docs provided documents. I contacted them about file XXXX and requested a Debt Validation. After contacting them several times and them stating they had 30 days to provide information they finally sent out and insufficient validation of this debt on XXXX XXXX. Docs provided as requested. After I contacted them in regards to why this was not complete and did not have any contract between us. Mr XXXX at that office began to get frustrated and said if I was stating that they stop collecting that he needed to put me on with an attorney. At that point an attorney by the name of MrXXXX XXXX got on the phone and began to raise his voice at me in a threatening manner and interrupting me before I could finish my request for him to stop his attempt to collect. HE continued to ask me sarcasticaly if this was really not my debt as he kept shouting and acting belligerent. The phone call ended when he stated he was done and if there was nothing else he can do for me.

In XX/XX/2017 I filed a complaint with XXXX XXXX, where it was discovered that my own father stole my identity and acquired three credit cards. Two of these cards were with XXXX XXXX. XXXX XXXX removed all references to these debts on my credit reports, and I assumed that XXXX XXXX would turn over the identity theft issue over to the Federal Bureau of Investigation. Now I receive a letter from a law firm known as XXXX XXXX XXXX, XXXX. out of XXXX, Florida. The debt is not valid pertaining to me, and XXXX XXXX knows the facts, they removed the accounts from my credit reports, and it is their responsibility now to pursue charges against my own father. I demand a retraction of this collection attempt, and for XXXX XXXX to purge any reference to my name and social security number immediately. The Consumer Financial Protection Bureau needs to see just how easy it is for law firms operating as collection agencies can ruin a person 's creditworthiness so quickly. I demand the purging of my information from XXXX XXXX and XXXX XXXX XXXX, XXXX. immediately.

I received a " Continuing Writ of Garnishment Against Salary or Wages after Judgment '' on XXXX/XXXX/15 from XXXX XXXX XXXX, XXXX. On XXXX/XXXX/15 I received notice from my employer that my wages would be garnished starting XXXX/XXXX/15!!!!!!!!!!!!!!!!!!!!!!!! Per the notice, I had 20 days to dispute this action ; it was 3 days!!!!!. I had no chance to dispute this before my money is being take from my paycheck. This attorney 's office has NOT provided any documentation proving that I owe XXXX XXXX or that I owe the amount mentioned. This garnishment is causing further financial hardship because I am now unable to pay my rent, electric, water or put gas in my car!!!! I can not afford to hire an attorney to file bankruptcy or fight this harassment. Do I need to quit my job to stop them from stealing my hard earned money. How is this legal or fair?

Received a subpoena case number : XXXX stating the plaintiff as XXXX XXXX, however the document also states that it 's from a debt collector. I contacted XXXX XXXX with my soc sec # and there is nothing in there records since I do not have any type of accounts with them. I pulled my credit history and XXXX reported me delinquent on some unknown balance. ( The amounts were close so I assumed that XXXX sold the debt to XXXX XXXX ). Either case I have never received warnings either from XXXX or XXXX XXXX. How do I go about this? It is obviously illegal since I do not owe XXXX or XXXX XXXX. I got a mail letter by DEBSKI & XXXX stating that I must provide to them for the past 3 years the following : Bank statments/ Income Tax Return/ XXXX Property under my name/ Car under my name/ IRA fund/ XXXX. I do not know the reason why I should provide all of this Important and private documents to this company. DEBSKI & XXXX also ran a Credit Report under my name without my consent. I am a victim of identify theft. I had an account with XXXX XXXX, fraudulent charges occurred on that account. I spoke with XXXX XXXX about the issue and they solved the issue and removed the negative account from my credit and forgave the debt from the fraudulent charge. This firm is persistent with harassing phone calls, letters in collection of a debt that is not owed them.
