The first time that I tried to make a payment plan to address my medical debt I was told that I could only pay an agreed upon amount that was more than I could afford to pay and that legal action could still be taken against me even if I was making consistent payments if they were under the amount they wanted me to make. I called the legal department and they stated that this was not true and that I could make an affordable payment. I then made a payment plan with R and R Resource Recovery in which they were supposed to apply a specified amount to a judgement I had with them and then a specified amount to a " non-legal '' account. They were to deduct the payment automatically and apply it accordingly and mailed a written payment agreement. Despite this and making payment, I received correspondence from them stating that I was not paying the " nonlegal '' account and that further action could be taken against me. I contacted them and they stated that they had made an error and were applying the full amount of my payment to the judgement and failed to apply the rest to the " nonlegal '' account causing this. I was assured that this would be fixed. I then received a summons both in the mail and at my home ( which I'm sure I paid extra fees for ). I called R and R Resource Recovery who stated that they must have started this process before I initiated the payment agreement with them and that I didn't need to worry about attending court etc. that it would be taken care of. They then moved forward with getting a judgement for this nonlegal account despite telling me that I did not need to attend court or worry about this letter because of the agreed upon payment plan. I believe that they proceeded with this because the debt was about to be 7 years old and they wanted to be sure to secure the judgement regardless of the written payment agreement. I believe that they abuse their power and they want me to commit to an agreement although they do not and then continue to bully me. I also attempted to settle on this debt and they stated that I would have to settle on every debt I had in their office in order to do that even though they were all with separate entities, which I believe to be untrue since they have filed separate judgments against me. They also contacted my employer prior to even having a judgement in hand giving them the authority to do so. There is a apparent lack of communication within their office and with the attorneys they contract with. When I did try to communicate on these issues and advocate for myself I was told I was " volatile ''. They are also still reporting items on my credit report as an agency that they used to operate under that they state does not exist anymore " The XXXX XXXX XXXX XXXX XXXX ''.

I checked my credit report today and found a collection item reported by XXXX XXXX XXXX XXXX XXXX XXXX XXXX.for a small balance medical debt. I called the phone number provided : XXXX and was greeted by a man named XXXX. He asked me for my SSN # to which I obliged. He immediately said " you owe $ XXXX, what is the card you would like to use? '' to which I responded : " is this call recorded '', XXXX answered, " no ''. I asked XXXX what is the debt for and he advised it was for a medical debt ; however, he did not say who the original creditor was. I provided my credit card number to XXXX and he ran the payment and gave me a confirmation #. I asked XXXX if he was a debt collector to which he replied yes, so I asked him why did he not state the original creditor name, to which he replied that he is not required to. I then asked XXXX for his last name and he replied that he does not want to provide his last name. I told him he is required to provide his full name, and he replied that he will not because his office services " local accounts ''. I proceeded to ask XXXX why he failed to read me my miranda rights as required by the FDCPA to which he angrily and loudly responded : " I 'm transferring you to my supervisor '' and he transferred me to a voicemail for a woman. I left a voicemail. XXXX violated the FDCPA multiple times during our interaction : 1 ) Section 807 - False or misleading representations. XXXX did not disclose that he was a debt collector collecting a debt. This is false representation and deceptive means to collect a debt. 2 ) Section 807 - False or misleading representations. XXXX did not disclose that he is a debt collector, and that his communication was an attempt to collect a debt, and that information obtained would be used for that purpose. 3 ) Section 807 - False or misleading representations. The company is reporting debt to the XXXX major Credit Reporting Agencies ( XXXX, XXXX, and XXXX ) using the business name " Law Office of XXXX XXXX XXXX XXXX '' ; however, the company 's true entity name is " RESOURCE RECOVERY ''. Resource Recovery is not now, and has never been, an attorney or had the capacity to act in a way similar to an attorney. This is False and Misleading representation by definition and unfair collections practice.

A medical debt was reported to my Equifax profile on XX/XX/XXXX for a {$15.00} medical bill that I am unaware of, by an attorney 's office named Law Office of XXXX XXXX XXXX XXXX. When I called the number a man answered stating " RR Resource Recovery ''. The man did not identify himself. He asked me for my name, which I provided, and he immediately stated that I owed {$15.00}. I advised that I did not recall getting a letter with this information. He did not provide his name, nor the original creditor name, nor disclose that he was a debt collector, nor did he state the Mini Miranda disclosure to me. I felt that I was speaking to an attorney due to the credit reporting, so I paid via credit card the {$15.00} balance + a {$5.00} fee which the man stated would be added to a phone payment. He provided a confirmation # of XXXX and the call ended. I was misled by this company into paying a bill that I am unaware of and had the right to dispute, but was not offered that right. 1 ) The collector did not identify himself2 ) The collector did not disclose to me that he was a debt collector3 ) The debt collector did not state the original creditor name despite me telling him that I did not receive an initial notice4 ) The collector stated that my XXXX XXXX credit report was wrong and that XXXX reports are " never right '' 5 ) The collector did not explain why he was charging me a {$5.00} fee for making a phone payment6 ) The company 's entity name is R R RESOURCE RECOVERY, LLC ; however, they have reported debt to my XXXX credit report using the name LAW OFFICE OF XXXX XXXX XXXX XXXX, XXXX - which is an inactive company due to dissolution on XX/XX/XXXX. How can a debt collector report to a credit bureau using the name of a dissolved attorney 's office?

The credit collections agency in question only contacted me once by phone and once by mail well over a year ago, and suddenly, I have a negative credit flag on my credit score. While I 'm sure that I passed a time deadline to make payments on this account to prevent this from happening, the lack of communication from the collector is not only surprising, as I 'm used to being called monthly when I forget to pay a bill, but also irresponsible, as negative flags like this can remain on an account for XXXX years. I recently graduated college and would like to do things such as consolidate my student loans, possibly finance a newer car in the next few years, and get a mortgage to buy a house, but this XXXX item is going to seriously hinder my ability to do any of that. Had R R Resource Recovery contacted me before this account went into the flag zone, I would have begun making payments immediately as I received a substantial promotion and raise with my current job.

R R RESOURCE RECOVERY XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX I have been dealing with this on my credit for over 2 years, they have had my dispute since XXXX i sent out a certified letter and all the payments i paid for my insurance and the false charges and they still continue to give me the run around. The insurance company advised I had full coverage for a lease vehicle and after 3 years of paying i got into an accident and they went back to XXXX and charged me unauthorized. I just would like this XXXX collections off my credit for good! I do not owe auto insurance and the state of NY your insurance laps you can no owe. This insurance agency is fraud and the collections agency will not help.

R R resource company continues to report a debt that does not belong to me on my credit. I have sent numerous letters for them to correct this and refuse. The original creditor will not even respond to my letters. This is a account for a ambulance service that I never used. I never was in a ambulance during that year nor was my children. We have never had a lapse in health care coverage in 15 years as well. During the time the are reporting as well. I have asked for documentation to prove the basis of the debt and I get nothing but a bill from the creditor. If this was a service we would have used it would have been billed to our insurance. But we did not use the service at all so this doesnt apply.

I cancelled my membership at XXXX XXXX. However they kept me as member for 4 more months. They sold my debt to collection company. Neither health club nor collection company did not provide me with any papers verifying my debt, membership status, payments etc. I sent multiple written requests to collection company asking to verify the debt and send me a breakdown but never received a response.
