Complaint Against Lendly for Reporting Negative Information on Credit Report and Failure to Provide Notification of Charge Off Dear Sir/Madam, I am writing to file a formal complaint against Lendly regarding their handling of my debt and their failure to provide necessary communication and documentation. Lendly has reported negative information on my credit report without any notification of the charge off, and despite multiple attempts to contact them regarding the debt, they have failed to respond to any of my concerns. As per my records, I attempted to reach out to Lendly via email on multiple occasions to inquire about payment options and resolve the outstanding debt. These emails were sent on XX/XX/XXXX and XX/XX/XXXX respectively. However, I did not receive any response from Lendly. Furthermore, on XX/XX/XXXX, I sent an email to Lendly informing them that a debt collector, XXXX, had contacted me and harassed me. I explicitly requested to file a complaint and for Lendly to refrain from contacting me again due to the threats. I also requested a payment arrangement, but Lendly did not respond to this email either. Subsequently, a new creditor named XXXX took over my debt without any prior notification from Lendly regarding the charge off. It was only through communication from the new collector, XXXX, via email that I became aware of this transfer. Furthermore, on XX/XX/XXXX, I sent a request to Lendly to verify the debt. Despite my persistent efforts to resolve this matter, Lendly has been completely unresponsive. It is important to note that Lendly did not send me any billing statements via USPS or email prior to charging off the debt, nor have they provided me with a 1099 stating that the debt was charged off. This has led to significant confusion and frustration on my part. I believe that Lendly 's actions are in violation of the Fair Credit Reporting Act ( FCRA ) and the Consumer Financial Protection Bureau ( CFPB ) laws and statutes. Under the FCRA, specifically section 623 ( a ) ( 8 ), it is required that a creditor provides written notice to the consumer before any information regarding charge off is reported on their credit report. Lendly has failed to fulfill this obligation, and as a result, negative information has been reported inaccurately. Additionally, under the FCRA, section 623 ( a ) ( 1 ), a creditor is responsible for providing a statement to the consumer indicating that the debt has been charged off and for sending a 1099 form if the debt is reported to the Internal Revenue Service. Lendly 's failure to provide these notifications is a clear violation of the FCRA. Furthermore, the CFPB has established guidelines to protect consumers from unfair and deceptive practices by financial institutions. Lendly 's lack of response, failure to communicate, and failure to provide necessary notifications constitute a violation of these guidelines. Therefore, I demand that Lendly immediately remove the negative information they have reported on my credit report. I also request that Lendly fulfill their obligations under the FCRA and the CFPB laws and statutes by providing written notice of the charge off, a 1099 form, and communication regarding the outstanding debt. I appreciate your attention to this matter and look forward to a prompt resolution. Enclosed with this letter are copies of all relevant documentation and correspondence for your reference. I get a call from XXXX XXXX to call XXXX XXXX XXXX something about paperwork for me to sign. That never came it was supposed to come between XXXX today. This company dont know XXXX XXXX XXXX but he sure knew them he calls from private number. He gives number to call XXXX XXXX the other number to XXXX XXXX is XXXX ( XXXX ) XXXX. I spoke to XXXX with XXXX today he was rude and antagonistic and aggressive. I hung up on him at first to call original creditor lendly and then got referred to XXXX XXXX they referred me to XXXX. Well I call XXXX back after verifying that. He asks about notices sent to me dont recall anything by mail, and he dont know nothing of this XXXX server no show guy but XXXX sure XXXX them. XXXX demanded immediate payment by debit card and he would send paperwork to stop next step in process what that is they dont know maybe wage garnishment anything really depending on law. With out immediate debit card and signature on some e docs right that second they will consider me not willing to resolve the account ( despite me telling them I was busy and couldnt get them that info right that second ). I think I received something from united maybe but not this XXXX place. XXXX wouldnt send me payment plan paperwork with out debit card up front. They asked who I bank with same bank as when I got the lendly account XXXX snarked back thats surprising. Also according to XXXX if I kept track with my creditor or something like that this wouldnt happen ( after i informed about seeing if it was a scam ). XXXX was upset and loud and XXXX and sounded mad about me hanging up on him earlier to check to see if this was legit he kept being obnoxious repeatedly oh its not a scam we got your info ( ya scammers can get that ). I told them because they didnt want to give much info. Kept demanding immediate payment and signature on XXXX docs after getting my debit card first that maybe I should look at a lawyer or file complaint with ftc he hollered what lawyer I said maybe XXXX look at getting one or filing with ftc he immediately disconnected. My apologies for including XXXX in the matter but they are not listed on that account. If this account was charged-off/ written off I would like to receive a XXXX form from this bank to my home address since that would mean that they had to report to the IRS. This installment loan was being paid bi-weekly direct deposit from my job, Therefore this gave me the understanding that it was an online payday loan. They will not allow clients to make monthly payments like regular installment loans. They make u add their banking account information ( checking account & the amount to pay ) to your Employer payroll so they can receive payment via direct deposit. On XX/XX/XXXX I refinanced a loan with a balance of {$1200.00} and was making bi-weekly payments of {$73.00}. On XX/XX/XXXX was the last {$73.00} payment with a balance of {$1100.00}. On XX/XX/XXXX they transfer out the account with a balance of {$2400.00} ( principal ). For some reason they were still receiving payments of {$3.00} on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and on XX/XX/XXXX they wrote off the account reference code XXXX. I received a letter stating that the balance was {$1400.00} as of XX/XX/XXXX. My original loan was at an annual percentage rate of 98.60 % and I was to make 25 bi-weekly payments for {$1000.00}. I have received XXXX letters from Debt collectors requesting me to pay and I informed them to validate it, since then I have stopped mailing me. They will not place this in comments on my credit report as a dispute because I did not go through the credit bureau to get them to correct their records.

Hi, I have an account with Lendly. Ive been in consistent contact with different agents. The earlier part of XX/XX/2023, which was my last payment, I was told by your agents that Lendly made big changes such the number of days accounts would default, instead of an account defaulting at 65? days, it would 90 days. I was further advised that my account had not quite approached 65 days. I remitted a payment via phone with agent and was told that my account was back in good standing. On XX/XX/2023, I contacted Lendly again to make another payment. At that time, I was advised that my loan had defaulted and sent to a third party collector. I advised the agent that that was not the information I received earlier this month. I was placed on extenddd hold with both agents as to research the matter. They were unable to determine the status of my account, so they promised me that a supervisor would look into the matter. It has been 2 days since hearing from anyone regarding my account. I wish to at least pay half of my debt and since having XXXXXXXX XXXX XXXX XXXX XXXX, I managed to prevent the account from defaulting l, but disappointed by the inaccurate information provided by your agents as it relates to payments, supposedly changes in default terms etc. Can someone please contact me to inform me of my account status as I would like to pay at least half of my remaining loan amount. In XXXX of XXXX, I changed bank accounts and I sent the information to Lendly before my XX/XX/XXXX payments were due. Lendly never completed the request. I called numerous times, before the due date of my first payment to address the issue and no one was able to assist me with the change until XX/XX/XXXX. I emailed the information over AGAIN on that date and the request still was not completed. Upon speaking to a Rep, the Rep stated that the payments were reversed and that they do not know why the XX/XX/XXXX payments were reversed and then wanted me to pay {$190.00} and my current payment that was due, all in one lump. But I did not feel that was fair, due to Lendly not updating the information when I sent my new bank account information in XXXX of XXXX. It was not my fault that the payments were reversed either, after the fact that the new bank account was entered in XXXX XXXXThe Lendly rep at the time stated to me on a RECORDED LINE that interest is not accrued on late payments, but I guess that was not true, because now I have made XXXX payments of my XXXX and they are stating that I have XXXX more payments, because of the mishap in XX/XX/XXXX. The interest is from XXXX till now and it keeps going up, even though Lendly has admitted that the mistake was on their behalf. I stated to them I should not have to pay late fees on a balance that was caused by them not completing their job of entering the updated bank information. It appears intentional, because the balance is caused by Lendly neglect.

I received an offer by mail from Lendly ( XXXX ). I accepted the offer and was approved instantly online. I was provided several different loan options. I made my selection and was then provided with a link to verify my checking account and deposit information. The link did not work correctly. I reached out to their live chat and spent over an hour trying to enter passwords and account information. Finally I was told they had IT issues with the account verification process and were hoping to get it fixed soon. My only other option was to manually upload the documents. I logged out and then logged back in and was not able to access anything. I clicked on the account information link and learned my approved loan was changed to denied. I called them to confirm if this was correct and they said yes I was approved for the loan but they changed the decision. My complaint here is, when a loan company approves someone for a loan, they should not be allowed to cancel the loan after an official approval has been provided. I wasted an hour of my time today on this pathetic company. I understand the difference between a pre-qualified vs a pre-approved loan offer. In this case it was an approved loan with an offer made by the lender which I accepted and they then denied.

I made a payment on XXXX with XXXX XXXX XXXX, who services a loan I received through Lendly with XXXX XXXX Bank as the lender. I contacted both Lendly and XXXX XXXX Bank to cancel this payment which is scheduled for XX/XX/ by calling the number as directed at the time I made the payment. The prompt indicated I had until XXXX XXXX XXXX XXXX today, XX/XX/, to cancel this payment. I made calls at XXXX XXXX and XXXX XXXX XXXXXXXX XXXX, only to be told that there is no record of the payment, and that " it takes a few days to show up in their system ''. Having done everything I could, I was still unable to cancel this payment using the directions provided by XXXX XXXX XXXX and Lendly. This is ethically dubious behavior on the part of Lendly, XXXX XXXX XXXX and XXXX XXXX XXXX. If an individual is able to schedule a payment online, they should be able to cancel said payment. If an individual is told to call into a specific number to cancel a payment, they should be able to do so, not be told that the payment has not shown up in their system and as a result nothing can be done. Now the payment I wanted to cancel, within the parameters set forth by Lendly ; and XXXX XXXX XXXX and XXXX XXXX Bank as agents of Lendly is unable to be cancelled.

Hello, I was in need of additional financial assistance so I took out a personal loan. What I was not aware of is lendly.com is just another predatory lending company. I was given a loan for {$2000.00} but when it is paid off this company is going to receive {$7100.00} with an interest of 184.49 %. It felt initially like I was being helped with this company, but now I am in a debt trap. I've asked to refinance to try to get a lower rate, but was denied that option. A loan company getting everything they loaned you plus almost triple of what they loaned you should be illegal. Lendly Loans also known as XXXX XXXXXXXX XXXX XXXX XXXX ( Account # XXXX ) they have placed incorrect information on my Credit Report. Lendly is charging a much higher interest rate than was I was told during the application over the phone. The entire process was over the phone and when I asked for validation of my loan and comments to see my interest rate it was XXXX %. The Michigan XXXX loan maximum interest rate is 25 %. I send the Michigan XXXX statutory law to Lendly and asked for a reduction to the state maximum and was completely ignored.
