SHORT VERSION : They are attempting to collect on a debt that has been settled on back on XX/XX/XXXX. They have violated a Cease and Desist Letter and have continued collections efforts after being provided proof of the settled account. UCC 3-311 outlined the settlement of the debt. They failed to send back the settlement payment to void the agreement- they did NOT. They have violated the following Federal ans state laws. Section 805 ( c ), 807 ( 8 ), of the Fair Debt Collection Practices Act Section, North Dakota Century Code XXXX and XXXX Fraud & XXXX ( d ) Harassment, Fair Credit Reporting Act Section 623 ( a ) ( 2 ) ( B ), 623 ( a ) ( 3 ) ,623 ( b ) ( 1 ) ( C ), 623 ( b ) ( 1 ) ( A ) ,623 ( b ) ( 1 ) ( E ), knowingly and willfully reporting inaccurate information regarding XXXX has caused Defamation and Financial Injury as outlined in the US Court of Appeals, Ninth Circuit, No. XXXX, XXXX vs. XXXX XXXX. LONG VERSION : 1. The Defendant, for its Answer and Counter Claim against the Plaintiff, states and alleges as follows : 2. The Defendant, XXXX ( hereinafter XXXX ) is a resident of North Dakota. 3. The Plaintiff, XXXX XXXX XXXX XXXX XXXX, ( hereinafter XXXX ), is a Nebraska Corporation, with its principle address is in XXXX, Nebraska XXXX. 4. The Defendant strongly asserts this is a frivolous lawsuit which is wasting the courts time and the Defendants time. 5. The Defendant affirmatively states the account was a CLOSED and SETTLED account on XX/XX/XXXX and does not owe the Plaintiff {$13000.00}. 6. On XX/XX/XXXX, XXXX sent XXXX a Cease and Desist Letter stopping all forms of communication from the Plaintiff and reminding them the account was SETTLED and CLOSED. 7. There is evidence the Plaintiff received the letter on XX/XX/XXXX at XXXX XXXX in XXXX, Nebraska XXXX. ( USPS Tracking Number XXXX ). 8. On XX/XX/XXXX, XXXX sent XXXX 3rd party collector Rodenburg Law Firm, with an address of XXXX XXXX XXXX XXXX # XXXX, XXXX. XXXX XXXX, XXXX, N.D. XXXX, a Cease and Desist Letter stopping all forms of communication from the Plaintiff and reminding them the account was SETTLED and CLOSED. They were provided proof with a copy of the front and back of the cashed check. 9. There is evidence the Plaintiff received the letter onXX/XX/XXXX at XXXX XXXX in XXXX, North Dakota. ( USPS Tracking Number XXXX ). 10. The Plaintiff had three ( 3 ) times in which the agreement was conspicuously brought to their attention. The time the cashed the check on XX/XX/XXXX, the time XXXX received the Cease and Desist Letter on XX/XX/XXXX, and the time Rodenburg Law Firm received their Cease and Desist letter on XX/XX/XXXX. 11. As outlined in Uniform Commercial Code 3-311, the Plaintiff knowingly accepted the payment, and cashed the payment, for the settlement of the account. Had the Plaintiff NOT agreed with the agreement then the Plaintiff should NOT have cashed the check OR since they did cash the payment they had the option to send the money back to the Defendant, which they did NOT. 12. UCC Accord and Satisfaction by use of instrument in section 3-311 ( c ) ( 2 ) states the Plaintiff had the opportunity to send back the payment within 90 days to null and void the agreement as outlined on the check IF there was a non-agreement. 13. The Plaintiff cashed the check on XX/XX/XXXX, they had until XX/XX/XXXX ( 90 days ) to send the payment back to the Defendant to void the agreement which they did not. 14. The Plaintiffs failure to send back the payment and keeping the payment is informed and implied consent to the acceptance of the settlement which was written on the check. 15. Rodenburg Law Firm was informed of the settlement however, ignored it and continues to attempt to collect on a SETTLED Account. 16. Rodenburg Law Firm was provided proof of the settlement with the copy of the check front and back. They are aware of the law UCC 3-311. 17. Rodenburg Law Firm FAILED to advise XXXX to RETURN the cashed check amount to XXXX to void the settlement. 18. The Defendant has several credit reports which shows the Plaintiff failed to report accurate information regarding the account to the credit reporting agencies. 19. The Fair Debt Collection Practices Act ( FDCPA ) and the Fair Credit Reporting Act ( FCRA ) are federal laws outlining what the Plaintiff should and should not have done regarding the Defendants account information. One of which is to provide ACCURATE information to the credit reporting agencies, which they failed to do and is explained as follows : DEFENDANTS COUNTER CLAIM # 1 20. On XX/XX/XXXX, the XXXX 3rd party collector, Rodenburg Law Firm, violated the Cease and Desist letter by sending the Defendant several account statements. 21. This contact with a 3rd party concerning XXXX violates section 805 ( b ) of the Fair Debt Collection Practices Act Section. DEFENDANTS COUNTER CLAIM # 2 23. XXXX & Rodenburg Law Firm are fraudulently attempting to collect on a CLOSED/SETTLED account, Violating North Dakota Century Code XXXX and XXXX Fraud. 24. XXXX & Rodenburg Law Firm were informed by the Defendant that the account had been SETTLED and yet XXXX knowingly and willingly is attempting to collect on the account DEFENDANTS COUNTER CLAIM # 3 26. By XXXX & Rodenburg Law Firm knowingly and willfully attempting to collect on a SETTLED AND CLOSED account and bringing this frivolous lawsuit against the Defendant is Harassment. 27. XXXX & Rodenburg Law Firm has violated North Dakota Century Code 12.XX/XX/XXXX ( d ) Harassment which stated : A person is guilty of an offense if, with intent to frighten or harass another, the person : it goes on to say under section d : d. Communicated a falsehood in writing or by electronic communication and causes mental anguish. DEFENDANTS COUNTER CLAIM # 4 29. XXXX failed to report to the credit reporting agencies the item was being disputed due to inaccurate information being reported. 30. XXXX failed to abide by Fair Credit Reporting Act Section 623 ( a ) ( 2 ) ( B ) by not reporting the item as disputed. DEFENDANTS COUNTER CLAIM # 5 32. XXXX failed to report to the credit reporting agencies the item was being disputed due to inaccurate information being reported. 33. XXXX failed to abide by Fair Credit Reporting Act Section 623 ( a ) ( 3 ) by not reporting the item as disputed. 34. A reminder to the Court for the Plaintiff willful non-compliance, as per FCRA 623 ( a ) ( 3 ) Responsibilities of furnishers of information to consumer reporting agencies [ 15 U.S.C.1681s-2 ]. a. ( 3 ) Duty to provide notice of dispute. If the completeness or accuracy of any information furnished by any person to any consumer reporting agency is disputed to such person by a consumer, the person may not furnish the information to any consumer reporting agency without notice that such information is disputed by the consumer. DEFENDANTS COUNTER CLAIM # 6 36. XXXX failed to report to the credit reporting agencies the item was being disputed due to inaccurate information being reported. 37. XXXX failed to abide by the Fair Debt Collection Practices Act Section 807 ( 8 ) by not reporting the item as disputed. DEFENDANTS COUNTER CLAIM # 7 39. XXXX failed to report to the credit reporting agencies the item was being disputed due to inaccurate information being reported. 40. XXXX failed to abide by the Fair Credit Reporting Act Section 623 ( b ) ( 1 ) ( C ) by not reporting the item as disputed. DEFENDANTS COUNTER CLAIM # 8 42. XXXX failed to conduct an investigation with respect to the disputed information being reported. 43. XXXX failed to abide by the Fair Credit Reporting Act Section 623 ( b ) ( 1 ) ( A ) by not conducting an investigation. DEFENDANTS COUNTER CLAIM # 9 45. XXXX failed to modify the dispute information upon the investigation with respect to the disputed information being reported. 46. XXXX failed to abide by the Fair Credit Reporting Act Section 623 ( b ) ( 1 ) ( E ) by not reporting the modified disputed information to the credit reporting agencies. By XXXX reporting inaccurate information to the credit reporting agencies an account that is CLOSED and SETTLED caused XXXX extreme mental anguish and further caused financial damage by having a lower credit score. 49. By XXXX knowingly and willfully reporting inaccurate information regarding XXXX has caused Defamation and Financial Injury as outlined in the US Court of Appeals, Ninth Circuit, No. XXXX, XXXX vs. XXXX XXXX.

On XX/XX/2021 At approx XXXX A representative ( I think XXXX was her name ) returned my phone call in an attempt to work out a debt I possibly owe. Unfortunately, the boxes I checked prior to being able to voice my complaint here are somewhat inaccurate because there was not an accurate one to click on and it would not let me proceed without clicking something. Here are my complaints. 1. The representative lied to me by telling me they put a lien on my house. ( She was very clear about this and even said the lien on our property would be lifted as soon as the debt is completely satisfied ). I called the courthouse and according them not only is there NOT a lien on my home but unless there was a special circumstance ( like doing work on our home ), they CAN'T put a lien on our house. 2. The representative belittled me making me feel HORRIBLE by telling me this is such a small debt to take care of. 3. I was told they would be unwilling to consider any settlement without proof of the worth of our home. When I asked why she needed this I was told that if I could sell our home or take a loan out on our home that would cover the debt, they would not accept a settlement of any kind since this was such a small debt. ( To me, XXXX is not a small debt. I live paycheck to paycheck. ) I would also like to know what house sells for less than XXXX. It all added up to saying that if I owned a home, they would not settle. 4. She was willing to take payments but not sure if they could accept anything as small as $ XXXXmonth. This payment amount was something talked about .... but after going over finances, I could not see how I could make a sustained payment even close to that amount. She was also unwilling to stop the daily interest which, after going over my debt/income, is more money than I can afford to pay each month! The debt would be getting LARGER even after the small payment I might be able to squeeze out. The bottom line is this. Although much of what was said may " technically '' be legal, .... LYING to me about the lien can not possibly be considered legal ... XXXX And ethically speaking, I have never felt so horrible about not having enough money to pay this. I don't understand how I can pay if the interest alone each month is more than I can afford and they won't settle because I am a homeowner ( I'm not sure how legal that is ). I obviously can't take out a loan on the home to pay them because then I have another loan to pay on ( which I can not afford ). I am only a homeowner of the home we live in. I have no other property I could possibly sell to satisfy this debt. I also received a letter from them some time ago asking me to itemized my belongings in my home. I have bought nothing on the credit cards they are collecting for that would warrant such a thing. Unfortunately, I have misplaced this paper. I am sure all letters sent to me could be pulled from their records though. They are giving me no option to pay, making me feel horrible, and lying about putting a lien on our home. I first contacted the company, Rodenburg Law Firm, on XX/XX/2022, after being receiving a garnishment notice from XXXX on behalf of my employer. I immediately emailed Rodenburg Law Firm a signed and filled out exemption form from the State of Minnesota the same day, XX/XX/XXXX. I called Robenburg Law Firm the same day to confirm their receipt of the email that included the exemption form and they confirmed they received it and will forward it for review. At the time, I was presented with two options. One option was to wait for them to work with the county to confirm the exemption and the second option was to send in proof myself. This was in regards to me proving that I received rent assistance from XXXX Balance Program ( case ID XXXX ), which would make me exempt from my funds being garnished. I went with the first option, as I just sent the same exemption form to Rodenburg back in XX/XX/2022 when they initially tried to garnish my funds. Back in XXXX Rodenburg sent a release to ADP to stop the garnishment with no issue, so I figured the same would apply in XXXX. However, this was not the case, as I contacted Rodenburg on XX/XX/2022, for an update on the release. I was then advised that XXXX XXXX XXXX XXXX in Minnesota in which I received rent assistance in ) said I was no associated with the case ID ( XXXX ). Again, I had received a release using this same case number back in XXXX. I was then told to send in any proof that I received assistance to Rodenburg directly. I sent in all the documentation I could find on XX/XX/2022. I was not the main applicant, but I am on the lease and I am listed as a household member on the application for assistance ( meaning my info was used in the decision making process ). This included the application ( showed the address, case number, and applicant 's name ), the section that showed household members ( my name was listed along with my children and the main applicant ), a copy of the lease ( showing my name and the main applicant 's name ), and an email confirmation showing we were approved for assistance. I followed up with Rodenburg today, XX/XX/2022 and they still refused to acknowledge my exemption. If I'm on the lease and on the application, how am I not a recipient of relief based need? My information was used in the decision making process on if we qualified for assistance. Also, I am everybit as liable for the lease as the primary applicant, meaning if we were evicted it would go on my record. So any payments for that lease are also for me directly. On XX/XX/2022, over {$470.00} was garnished from my check after I already told them I was exempt. I am currently the only working adult in my household and this is causing a great hardship, especially during holiday season.

I have been trying to fix my credit file and during the process I have made several payment arrangements and settlements with various lenders. I am in dire financial hardship, I have had a job loss as well as a bankruptcy and I am also on XXXX XXXX, making all of my wages and earnings exempt from garnishments. However I have managed to pay everything off except for an unknown account in collections which is listed as XXXX XXXX XXXX. This debt collector remains to continually harass me and has recently acquired lawyers to attempt to sue me at Rodenburg Law Firm, specifically XXXX XXXX who has signed all paperwork. I have asked repeatedly for information regarding this account as it may have been included in my bankruptcy or it may have been created in fraud. They have repeatedly threatened me by sating that if I request validation, they will sue me. I have even made 3 attempts in the last year to get this paid by settlement and they do not respond. Recently they sent a " Summons for Judgement '' in which I responded to right away however they failed to file the case in XXXX County even after it has been over a week since they served me. This is just yet another way that this company continues to intimidate me into paying something which they know I have been disputing now for over a year. I also question if this law firm even has a Minnesota Licence to practice in Minnesota. Do they even have any ownership to this debt? All address on this law firm 's website only show a ND address. The alleged credit card " XXXX XXXX XXXX '' also does not appear anywhere on my credit report either. This feels like fraud and looks like fraud and I am confident that it is fraudulent, I have worked with too many collection agencies ( unfortunately ) and they are normally happy to set up pay arrangements or settle accounts -- -This Company only wants to intimidate me and disclose as little as possible, First attachment is confirmation that I have sent letters to this company - who sometimes calls them self Resurgent? -- Letters were sent XX/XX/XXXX - XX/XX/XXXX & XX/XX/XXXX. ( the letter confirmation to XXXX XXXX is not included in this complaint ) 2nd Attachment -- Copy of the letter I sent. This relates to complaint XXXX. After I filed the complaint, I got a letter from XXXX XXXX indicating that the account " was charged off due to delinquency onXX/XX/XXXX. '' The Rodenburg Law Firm falsely represented in court pleadings that it was collecting on behalf of XXXX XXXX XXXX XXXX, when XXXX XXXX has already charged off the debt. The XXXX XXXX Letter went on to say that the " XXXX XXXX Card account ... was ultimately included in the XX/XX/XXXX sale to XXXX XXXX XXXX XXXX ( XXXX ). '' And admitted that " XXXX XXXX no longer owns the rights to this account. '' Question : How can a bank claim a tax write-off one year, and then sell an asset that has already been written off the books the following tax year? That seems like fraudulent tax reporting, if not fraud itself. Is the sale of an unsecured debt legal AFTER the creditor ( in this case, XXXX XXXX XXXX XXXX ) has ALREADY written off the debt for tax purposes? At any rate, XXXX XXXX of the Rodenburg Law Firm ( XXXX, ND ) falsely represented to the court in legal pleadings that she was collecting on behalf of XXXX XXXX XXXX XXXX, when XXXX XXXX XXXX, according to itsXX/XX/XXXXletter, has no involvement in this debt collection whatsoever. That seems like both fraud and attorney misconduct, as well as a false representation in legal pleadings by XXXX XXXX and the Rodenburg Law Firm. When I left a message with the Rodenburg Law Firm about that fact yesterday, no one called me back. And when I tried to call them this morning, they disconnected the call before I could even speak a word ( likely because they saw who it was on their Caller ID ). But the Rodenburg Law Firm is committing fraud on the court and making false representations in pleadings. And, they filed a false response to the CFPB, which violates 18 U.S.C. 1001. I read the company response. They didn't ask me for the last four digits of my social security number ; they demanded the ENTIRE SSN, as well as my date of birth ( neither of which I am required to give under the law, especially to a debt collector on a fishing expedition ). They lied, so don't take their word for it. Rather than rely on their response, subpoena their tapes of telephone calls ; they state that ALL of their calls are being recorded.

I am currently being garnished from a judgement that was unfairly put on me. I was not given the chance to defend/explain myself in court and never received any papers served to myself for the given judgement. I have attempted to contact the Rodenburge Law Firm several times but every time i am met with a voicemail system and no response. I even attempted to send their company an email to which i never received a response to. My current employers have contacted me with the judgement which has tacked on a ridiculous amount of interest to a judgement that unfairly placed upon me. I was not given any notice to appear before court or a chance to even defend myself. Now, years later I am being garnished without warning from Rodenburg Law firm whom I am unable to even contact for comment regarding these allegations. Another thing that really bothers me about this is the chance that these documents might be forged or tampered with. I see that in the top right corner of the garnishment it says : WRITE EXPIRES XXXX XXXX, XXXX ; and at the bottom of judgement it says : Given under my hand this XXXX day of XXXX, XXXX. This paperwork looks smudged and as if it was filled in by someone with their own handwriting, in other parts of it it is not even legible ( bottom middle ). I do n't understand how they can take {$5600.00} out of my pay check when the original judgement was for {$3700.00} and I was never even given a chance to represent myself in court. How is this even possible or legal? Even though I have attempted to contact them several times i cant seem to get any further documentation and/or explanation out of them. I 've been doing research on this Law Firm and have found numerous complaints and unethical treatment of the people who they are taking money from. I am afraid i am not the only one and this horrible treatment of honest hardworking people needs to stop. Under the state that this debt was formed Montana the creditors violated the following laws : Under the Fair Debt Collection Practices Act, a debt collector CAN NOT : Make any misrepresentations of fact, such as how much is owed, or certain actions they may take to force payment ( FDCPA 15 U.S.C. 1692e )

On XXXX/XXXX/16 I received a letter for the exemption I faxed a letter showing that the last time I received assistance was XXXX/XXXX/2016 which was within 6 months from receiving this letter I faxed it back to them on XXXX/XXXX/16 along with a letter that my children receive free lunches. They told me that the exemption was not valid even though it was within 6 months and that the free lunches is benefit for my children. I told them that I was applying for assistance again and then sent them an email that I received on XXXX/XXXX/2016 that I was approved again for assistance. They said the email did not work on XXXX/XXXX/16 I sent them the approval letter that I received that the first payment for assistance was on XXXX/XXXX/16. In the meantime my check has been garnished knowing that I have received assistance and exemption and that I will be receiving assistance in XXXX. They are telling me the garnishment will continue until XXXX/XXXX/16 even thought the exemption states within 6 months and currently receiving which I am just because the first payment for the new year does not start until the end of the month. The collection person also has notes that she talked to me and called me and she never contacted me. In 2 weeks she never returned my calls and I called at least 5 times a day and never talked to her or anyone else but left messaged. Today XXXX they finally let me talk to a supervisor and she told me again the exemption is not valid even thought it starts in the month and is current. She said garnishment will not stop until XXXX. The exemption letter that is sent states currently receiving or within 6 months months. The exemption is currently receiving in the month of XXXX As well as other collection places take the kids getting free lunch as an exemption as well and not sure why they will not as this is assistance for the family based on my income.

I, along with my father who consigned, took out a XXXX student XXXX Loan, disbursed XX/XX/XXXX, reflected an original principal balance of {$11000.00}. in the The student loan account serviced by XXXX XXXX XXXX ( XXXX ) on behalf of the holder, the XXXX XXXX XXXX XXXX XXXX ( XXXX ). My father and I started making payments on the loan on XX/XX/XXXX. Total we paid over {$15000.00}. Last we heard from XXXX XXXX XXXX XXXX XXXX was on XX/XX/XXXX through a court order. As of last week my employer received a wage garnishment from the Rodenburg Law Firm out of XXXX, ND regarding the XXXX student loan. I never received information regarding the court hearing date regarding this debt. A judgement against me was issued on XX/XX/XXXX and my wages are now being garnished which is the first I have heard about the judgement being reissued. My father has previously tried to contact the Rodenburg Law Firm in XX/XX/XXXX for information detailing chain of custody, loan application and monthly history of all amounts paid. This has been asked for before that with no response. He received no response again. Even with the payments made totaling over {$15000.00} the judgement is showing listed for {$27000.00}! With no explanation as to the balance or the DRASTIC difference in value. In XXXX, If you seek the validation from a debt collector, then the debt collector must discontinue all attempts to collect the debt until such time as the debt collector provides verification. We have never received such verification. Also the statue of limitations in XXXX should have a bearing on the debt collection according to XXXX Annotated Code TITLE 30. TRADE AND COMMERCE CHAPTER 3. UNIFORM COMMERCIAL CODE NEGOTIABLE INSTRUMENTS Part 1. Short Title, Form, and Interpretation En. Sec. 3-122, Ch. 264, L. 1963 ; R.C.M. 1947, 87A-3-122 ; amd. Sec. 105, Ch. 410, L. 1991.

I have some very alarming concerns about what these companies are trying to do. I have been receiving collection notices from TWO different companies. Why are TWO different companies trying to collect on the same alleged debt???? I feel very harassed and stressed getting these demands from TWO different companies for the SAME bill!!! The companies are Rodenburg Law Firm in XXXX, ND and XXXX XXXX XXXX in XXXX, VA. One of them sent a Sheriff with a summons to my house and handed a summons to someone else that was there. I do not remember which one I talked to on the phone, but they were very rude and demanding. I felt very harassed and was forced into setting up a payment arrangement that was financially out of reach for me. Even though I did not know what this debt was for, I tried telling them about my financial difficulties due to medical issues but they did not care. After speaking with my niece, who is helping me with my financials after my medical issues, she said we need to know what they are talking about before you send them money. We then sent them BOTH a request for validation letter. They BOTH responded. Portfolio response was with a few old credit card statements and a Hardship request form, which we filed out and returned to them. Rodenburg Law Firm sent a stack of statements and a demand for payment/ threatening court and a settlement offer due immediately. I am also VERY concerned as to why this company, who is saying they are a " law firm '', is sending information in the mail that contains my social security number on it for anyone to see???

A company called XXXX XXXX XXXX in XXXX XXXX, MN took my XXXX/XXXX XXXX in XXXX for services that I never received from them. So I called Rodenburg Law Firm and was forwarded to a voicemail for a XXXX at ext. # XXXX. She called me back, and I asked her to send literature on this account, as I believe I do not owe this debt. I received literature in the mail, and I have called and left countless voicemails. No one answers the phones, and no one returns my calls. I need this taken care of, as I am trying to close on a house, and this is preventing me to do so. There is an active judgement against me, that I do not agree with, and have disputed numerous times. XXXX XXXX XXXX agrees that I do not owe the debt. Yet after it has been sold and sold, I can not get a hold of anyone to remove it, or help me get this taken care of. Hello, A couple years ago I had gotten a letter about a debt from a debt collection company. The debt collection company I have tried countless times to get ahold of. This company is called Rodenberg Lawfirm located in North Dakota. I have tried contacting them via phone number, snail mail, and emails and have not gotten a response. I still have old emails and a copy of the letter I mailed them in XXXX asking for information on the debt. So the very first stimulus check of XXXX dollars I deposited into my bank account on XX/XX/2020. I have proof of bank statements showing that it stayed in my account until XX/XX/XXXX when this debt collection agency law firm " XXXX XXXX '' took that money out of my bank account. A debt collector by the name of rodenburg law firm in North Dakota has threatened to sue me for a credit card that fell into debt because of hardship in which the original creditor knew it was being closed for that reason. This debt collector tried serving me papers at my previous address and their representative harrassed my parents there in the process. I then got in contact with this debt collector erxplaining I am experiencing hardship and explained that the original creditor knew of the hardship. I tried to work with the debt collector in telling them I could only give so money so much each month but they refused my offer. THEY REFUSED MONEY FROM ME. I have two loans that were taken out through XXXX XXXX XXXX. I have several issues with this company. The original amounts of the loans were at XXXX, XXXX it was agreed upon that there was no interest and there now has been interest added. Mid XXXX, I received a call from the local sheriffs dept about debt collection paperwork needed to be served. I received the paperwork, it ended up being court looking documents, signed by an attorney. I submitted a letter back to them as well as to the court that served me the papers. I received a call from the court saying the company hadnt even filed the documents with the courts. The document was fake.
