All conversations between myself or my husband with Roach and Murtha PC, were recorded by Roach and Murtha PC.
Between XX/XX/XXXX and XX/XX/XXXX, my husband and I received several phone calls from a representative named XXXX XXXX who worked for a Debt Collection Attorneys Office called Roach and Murtha, P.C. ( He was NOT an attorney-basically a receptionist used to scare and threaten people ) XXXX XXXX called us many times threatening a law suit, lean on our home, garnished wages and also threatened to contact my husbands place of work over a debt that had nothing to do with his job. When we asked him to send over paperwork of this debt, he threatened to not send it directly to us, but to my husbands job Also, when we asked for proof of this debt we were told we were thieves and stole from out homeowners insurance company. ( very unprofessional behavior ) He nor anybody from this law office provided us with any written information about this debt.
We then found out that XXXX contacted my husbands brother who # 1. doesn't live with us or in the state for that matter, and # 2. was not ever on any homeowners policy with my husband or myself. When asked why he contacted my husband brother he had no response.
XXXX continuously told us we needed to pay him exorbitant amount of money or we would be sued. These phone calls were never resolved because we simply wanted more concrete information about the debt, and XXXX refused to to provide us with anything.
The third time that XXXX called/harassed us about this debt, I asked to please talk to his boss because I was tired of XXXX 's rude and unprofessional behavior. He continuously would yell at me and demand money. When I asked to speak to his superior, he told me his boss 's name was Mr.Murtha.
I was never transferred to Mr.Murtha, but i was in fact transferred to a few other people who were all equally as rude and just demanded money from us. Their names were XXXX XXXX and some other guy named XXXX ( who hung up on me when i asked for some kind of proof of this debt ) After researching the Professional Profiles of Roach and Murtha PC, I found out that the last guy named XXXX was infact Mr. Murtha ( he never introduced himself to me as an attorney or that he was Mr. Murtha, just that his name was XXXX ) XXXX cause our family grief, anguish and stress.
This attorneys office, Mr. Murtha and specifically XXXX XXXX go against all rules of the Fair Debt Collection Practices Act ( FDCPA ). They threatened our family and harassed us to no end. They violated many of the Basic FDCPA violations.
I really hope this individual ( XXXX XXXX ) as well as the entire law office is investigated. Just because someone owes money, doest mean they deserved to be harassed daily and threatened.

On or aboutXX/XX/XXXX I contacted the XXXX XXXX XXXX XXXX XXXX XXXX to inquire about receiving assistance in reducing my property taxes and I spoke with XXXX XXXX XXXX XXXX sent me a Docu-sign contract ; however, upon reading the terms of this companies fees I opted not to sign the contract and ended up using the law firm of XXXX XXXX XXXX XXXX XXXX. I continued to receive emails from XXXX XXXX onXX/XX/XXXX and finally onXX/XX/XXXXwere it said that my grievance application had expired. XXXX XXXX XXXX were able to successfully reduce my taxes over the course of the past 3 years and they have been fully compensated for their legal services. This information can be verified on the XXXX County website and i have copies of the court documents as well.
Sometime in early XX/XX/XXXX, I received a phone call from XXXX XXXX XXXX claiming that I had an unpaid debt of approximately {$3000.00}. When I explained to the person on the line that I did not sign a contract with that company, she put me on the line with an apparent supervisor who informed me that it was a mistake. Since then, XXXX XXXX XXXX has used various debt collection agencies like XXXX XXXX XXXX and recently, Roach & Murtha to aggressively pursue debt that I do not owe ( there were a few other companies that called me but refused to provide me with any written documentation. ) On Thursday, XX/XX/XXXX a female came to my house at approximately XXXX claiming to be a process server and served my wife with what appeared to be official court summons. But there was no appearance date or time and I was being directed to contact either the Roach & Murtha law firm or XXXX XXXX XXXX directly within twenty days to settle the judgement. When I searched the NYS court website there was no such case on file. I believe this be harassment and a violation of ethical practices.

After receiving the call by a gentleman named XXXX of Roach & Murtha, PC in NY he stated he was an attorney and that he had frozen my accounts with XXXX bank as I was sued and they had won a default judgment. I mentioned to him impossible as I don`t have an account there and never received any documents to go to court.
A few days goes by he kept calling me and I asked politely to please do not call me and send all information via mail as per law that I would need to check and go to the court and see what happened and why I did not receive anything and was unaware of any debt by the people he represented.
Meanwhile XXXX kept on calling my work speaking to co workers and telling them about my debt and harassing them as well for more information about me. The company I work for offered their attorney to resolve and even after providing him with the information he kept harassing me and my co-workers and now even family members.
As I try to vacate the judgement we find out that this case was already brought in another jurisdiction and the plaintiff had won the case with another attorney and this collector managed to get a second lawsuit in another jurisdiction for the same. Even after speaking with attorney and specifically told him that he was representing me in this matter he still calls and harasses me.
I really need the help as it will cost me my job and he went nuts when I told him he had no case under res judicata and it would be vacated by the attorney. He wont stand losing his commission.

To whom it may concern In XXXX i moved to XXXX from US. Beetween XXXX I live in XXXX. I only came to US for vacation. And i didnt receive any document from collector or Court. Our bank account was frozen on XX/XX/XXXX. ( with my husband ) My husband called the Roch and Murtha company. The company emailed us a paper to release the account. And they never told us that we could defend ourselves. I signed the paper on the XXXX of the month and approved it from the notary. I sent the company by email. Our accounts were released at XX/XX/XXXX and {$6700.00} was withdrawn from my account for debt. On the XXXX of the XXXX, I received letters from the company and my bank separately. It is written in 2 separate letters that I can appeal. These letters were mailed to me on XX/XX/XXXX, when they guaranteed to get the money from me.
The letters also say that if " my income is unemployment benefit '' they can not withdraw money. Even so, they withdrew the money. XX/XX/XXXX I went to the court concerned to vacated a judgment. XX/XX/XXXX was the result, Judge declined. Because my prove is to complicated. I will do clearly with my old passport. As a reason, I wrote that I was not in the US at the time, on the court date, and that my unemployment benefit was confiscated. Despite this, I was rejected.
I complain about this company because they didn't tell me about my defense rights. What can I do legally, please help me.

I received a letter from XXXX XXXX XXXX XXXX @ XXXX. The envelope came to my address with a sticker that had my name on it. In addition the envelope merely had a return add., no company name. I thought that it was an advertisement. Upon opening the letter I truly believed that this was an advertisement, or a scam. The letter had NO creditor listed. They were merely offering me a " Winter Tax Savings ''. I was offered no opportunity to even dispute this alleged debt from the unknown creditor. This is the first and only communication that I have ever rcvd from this office. Additionally, the signature is a photo copy of " XXXX XXXX '' 's signature. The letter also states a current balance of {$340.00}. However, the offer is for " 25 % off of the current balance due and owing ''. How much are they demanding? They also state that the payment must be made in a " lump sum ''. If this is a valid debt, from a valid creditor, they can NOT demand payment in full. Also they have failed to provide their consumer debt collection license.
This Law firm has clearly violated the numerous laws within the FDCPA and furthermore my consumer rights.
I am asking for immediate sanctions to be brought against this firm, and they should be thoroughly investigated.

I received a call from Roach & Murtha on 2 occasions. The 1st call was sometime in XXXX and the second call was on XX/XX/XXXX at XXXX est. The reps name was XXXX. In XXXX I noticed he failed to read the XXXX XXXX and verify my information and just started disclosing my personal info without know who he was talking to. He just assumed it was me. I did not pursue the XXXX violation because I owe the money and I did not mind paying it. On XX/XX/XXXX at XXXX est. XXXX XXXX collector did the exact same violation. He failed to read the XXXX XXXXXXXX, he failed to XXXX who I was and he opened up the conversation saying " XXXX this is XXXX from XXXX and XXXX, when are you going to make the payment. I responded and said I have a 10 day grace I will pay in the next couple of days. '' I ask " Hey XXXX your company does not verify information or disclose the XXXX XXXX '' He responded verbatim " We only XXXX XXXX on the XXXX contact '' which is a violation of the FDCPA. The XXXX XXXX must be read on every attempt to collect a debt. XXXX XXXX failed to disclose on both Contacts. He did not ask for my address last 4 of the social and basically was in violation of the 3rd party disclosure as well. He had no way of know who I was if he failed to verify.

I went too get money from my bank account and seen that the amount I had wasnt there, I notified my bank they said a restraint was put in my account, they gave me the number I notified them, this is the second time they seized my account, I sent in proof that the monies in my account is from pension and unemployment, I sent them my award letter from both pension and unemployment but they still froze my account, spoke too them they claim I never sent any documents too them? I explained too them I have proof that I sent my award letters too them through fax and by mail, I dont owe these people anything! The entire building won the court case against the landlord, we were able too stay until or lease was expire, I never signed any new lease agreement saying I was gon na live there, I moved out before the new landlord took over the building! But yet shes filing judgement against me?

( see attachment for the legal documents ) On XX/XX/XXXX Per the XXXX XXXX, statement I paid the last payment of XXXX On XX/XX/XXXX, I got the legal document stating that the account is paid in Full.
For the last 18 month, XXXX XXXX and XXXX XXXX XXXX report are still report out to all 3 credit company that it is not paid and I will owe the money.

Last week was the first time I've been made aware that someone was trying to Bill me for a debt they are saying I owe. The last time I did business with this company ( XXXX XXXX XXXX XXXX ) was 3 yrs ago. I understand that if I am responsible for a debt I have to pay it, but I need to be sent a bill or some sort of attempt to send an invoice or to call, or email to bring to my attention that someone is attempting to collect a debt from me. On XXXX this company Roach & Martha called my employer and threatened to reveal private information about an alleged debt that is unverified.
