Be advised this is not a refusal to pay, but a notice that your claim is disputed and validation is requested. Under the Fair Debt collection Practices Act ( FDCPA ), I have the right to request validation of the debt you say I owe you. Complaint Summary : I received a letter from the US Department of the Treasury dated XX/XX/XXXX ( Federal Offset Letter ) I called The US Department of Education, and was told that I had to contact XXXX XXXX XXXX. XXXX XXXX XXXX has almost 200 complaints registered with The Consumer Financial Protection Bureau, as well as countless complaints listed with the XXXX and other internet searches. They were also fired for inappropriate dealings pertaining to student loans, and recently reinstated. I made several calls, and left several messages. I then called Student Aid and was directed to RMS, Recovery Management Services Inc. RMS has 135 complaints registered with The Consumer Financial Protection Bureau, as well as countless complaints listed with the XXXX and other internet searches. They told me not to contact XXXX XXXX XXXX, only deal with them. I spoke with a woman ( XXXX, no last name given ), and she said I owed them over {$25000.00}. I DONT She was rude, confrontational, and insisted that I sign up to pay {$5.00} per month to start the repayment process. There are many many complaints on the internet ( including The Consumer Financial Protection Bureau ), of how RMS forced consumers into this program, then got hold of personal information, changed the plan, harassed, and used their personal information inappropriately. First of all, I DO NOT OWE THIS DEBT Second of all, I would not sign up to pay {$5.00} per month to pay a {$25000.00} debt that I DONT OWE. I asked for documentation, and she said it would only delay the process and that I had to sign up to pay {$5.00} per month. I refused on many occasions. I asked for all documentation pertaining to my account. Finally she agreed to send all documentation. I received it this week. ( Federal Offset RMS Documents ). They sent copies of 2 pages. The pages are from 2 totally different documents? The font, and print dont even match ( not even close ). She told me that I had defaulted consolidation loans on which I had never made a payment. I got information from Student Aid on loans that were supposedly in default. The information is NOT ACCURATE. ( Federal Offset MyStudentData Download ) One of the loans listed was a Perkins loan directly with XXXX University. The loan was listed as defaulted. I contacted XXXX University, who sent a document confirming that the debt had been paid in full. That loan is now listed as Paid in Full. I also found a box of bank statements from XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. ( they were with old tax returns that I had no idea I had. These were the only ones I found ). In these statements were cancelled checks paid to XXXX XXXX XXXX XXXX XXXX for these loans. ( Federal Offset Cancelled Checks Summary, Federal Offset Cancelled Checks1, Federal Offset Cancelled Checks2 ). In XX/XX/XXXX, banks stopped returning cancelled checks, I do not have any statements beyond these ( with the exception of recent online accounts ). The cancelled checks for the Perkins Loan with XXXX University totalled {$1900.00}. The cancelled checks for the XXXX XXXX XXXX XXXX XXXX loan totalled {$3900.00}. There were absolutely additional payments made, but these are the only statements that I happened to find. ( I dont keep documents for 30 years, I dont know anyone who does? ). I tried to contact XXXX XXXX XXXX XXXX XXXX, but they are apparently no longer in business. ( the IRS confirmed this. ) I believe part of this stems from my fathers death ( 10 years ago ). On my birth certificate Im XXXX XXXX XXXX On my drivers license Im XXXX XXXX XXXX ( XXXX wasnt available on my license at the time I received it ) On my social security card Im XXXX XXXX. When my father passed away, XXXX XXXX declared me DEAD. Apparently, when you die, any credit you have open is, at minimum, tripled, and written off. ( XXXX XXXX more than tripled it, and sold it to at least 5 collection agencies before writing it off ). I didnt realize what had happened until I tried to buy a car ( 2 months after his death ). I was told that they would love to sell me the car, but I was deceased. When I got my credit report, every balance I had was at minimum tripled and written off. I had to go to The Social Security Administration to prove I was still alive, and in fact, it was my father who had passed away. It took years to pay, and cancel cards. My credit score went down over 250 points. Example : I had a XXXX card that I owed approximately {$100.00} My report said almost {$400.00}, deceased. ( I called, told them I was alive, they said I owed them {$100.00} ) I paid {$100.00} and cancelled the card. Nearly the same numbers with a XXXX card. XXXX XXXX was listed with at least 5 collection agencies at more than 4 times the amount owed. Approximately 5 years ago I received a letter from the IRS stating that XXXX XXXX had forgiven the debt I owed them ( over {$5000.00} ), and I had to pay tax on the debt ( over {$1000.00} ), as it was now considered income. Every time I have to buy a new car ( mine had XXXX miles ), that requires a credit report. This same kind of thing happens. Its a Total Nightmare. I DO NOT OWE THIS DEBT.

Weds XXXX XXXX, I received a notice in the mail from University XXXX ( XXXX ) in conjunction with Recovery Management Services , Inc ( RMS ) claiming I owed {$150.00} in citations from XXXX and a threat to suspend vehicle registration. At this point, the issue is almost comical to me if it were n't for the sheer abysmal failure of XXXX 's Parking and Transportation Services to do any due diligence or record maintenance over the last three years. The issue had been addressed in XXXX, and I, XXXX XXXX XXXX, have not owned the vehicle since XXXX/XXXX/XXXX. Here is the sequence of events as I understand them in my research : XXXX XXXX XXXX receives a Lease End Notice XXXX/XXXX/XXXX from XXXX XXXX XXXX is turned in by XXXX XXXX XXXX to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, XXXX on XXXX/XXXX/XXXX According to XXXX and XXXX Bank car was sold to college aged student on XXXX XXXX, XXXX According to the XXXX DMV record search title was processed and transferred to new party on XXXX/XXXX/XXXX ( Title XXXX was processed on XXXX/XXXX/XXXX ) City of XXXX XXXX tries to bill XXXX XXXX XXXX for Ticket XXXX on XXXX/XXXX/XXXX XXXX, XXXX, and the City of XXXX XXXX ( spoke with XXXX XXXX/XXXX/XXXX ) validate that XXXX XXXX XXXX is not the owner of the vehicle during the violation period and indemnifies him from any further action University XXXX XXXX XXXX Falsely files a first notice of citation payment due with XXXX XXXX XXXX, Account Number : XXXX Citation Numbers : XXXX, XXXX, XXXX and Contracts RMS to service the collection of this False Debt ( RMS was not mentioned in the e-mail, or in the letter from XXXX, i.e. XXXX sold this to a collection agency prior to any due date mentioned in the original form letter ) XXXX XXXX XXXX calls XXXX at XXXX and speaks with representative who can not help as she does not have access to records. XXXX/XXXX/XXXX E-mails are exchanged between both Parties and issue is 'claimed ' to be resolved, XXXX sends letter and claims the issue is closed XX/XX/XXXX-XX/XX/XXXX XX/XX/XXXX XXXX XXXX XXXX receives letter from RMS claiming the same amount is owed XX/XX/XXXX Immediately call and get a hold of the customer service rep, states issue is closed and refuses to provide any proof, initially refuses to allow transfer to manager, transferred to manager who also refuses to provide any documentation and admits to not having any policy in place to do so, nor are they able to due to third party outsourcing. Manager is XXXX XXXX at XXXX. This is my 2nd encounter with XXXX and my first with RMS. The unprofessionalism and complete disregard for customer service or ability to speak intelligently as to any reason not to provide documents at RMS gives the impression of deception and fraud. XXXX for their shady and non-disclosure of involving RMS is completely absurd and should have been addressed previously and disclosed to me. I have no faith that this issue will be resolved and fear harm to my good reputation and credit. I have fully documented this transaction and will provide any and all required to the CFPB. I considered this matter closed with XXXX until further action was taken by RMS.

RMS-Recovery Management Services did not purchase this debt from XXXX XXXX University . RMS-Recovery Management Services provided the consumer with an itemized statement of charges, per the consumers request, on XX/XX/2022. I have attached the itemized statement of charges as well. During a review of my credit report, I noticed a debt and a corresponding name to that debt that do not belong to my identity. The debt was related to a federal student loan and the name corresponding to that debt was one not belonging to my identity. After further review, I disputed that debt and name with each credit bureau as neither belongs to my identity. To this day, the referenced derogatory account has remained on my credit profile and is affecting my scores tremendously. I know that this debt is not an enforceable debt in the amount stated and does not belong to my identity. An unknown party without my permission or knowledge used my personal identification data to execute documents to obtain this loan. As I did not apply for this loan personally, I never intended to receive a student loan to pay for my education. An attempt to use mine and others personal identification data to obtain this loan was done illegally, with incorrect and false data. The date of the first contact by the collection agency was XXXX of XXXX. The total balance they presented to me was {$5200.00}. At that time I contacted the agency explaining the debt was not mine and does not belong to my identity. They responded in XXXX with documents and steps I needed to take in order to prove that fact. I followed their steps within the same month, only to be contacted saying what I did was incorrect and would not be accepted. In XXXX after not hearing from the agency, I sent another letter explaining the debt was not mine in conjunction with a letter from the FTC and an Identity Theft Report to have the debt collection stopped and it removed from my consumer report. Between XXXX and XXXX, they started to send correspondence to my work saying that they were going to garnish my wages in order to pay off the debt. They did not stop reporting the debt or stop collections activity against me but sent another form in XXXX that I needed to fill out to prove the debt does not belong to my identity. I complied and returned the form within the week. Again they responded needing MORE supporting documents by XX/XX/XXXX. The documents the requested were documents I sent them previously and this would now be the fourth time. I sent the documents in order to comply and put the matter to rest. However, after returning the documents I have not been able to get ahold of the agency and they have not communicated any results back to me. I have sent follow up letters to all parties involved but I have not received any responses. One thing the collection agency does a good job of is leaving the full name of who the debt belongs to on their documents. They leave out a key part of the name that proves immediately the name and debt does not belong to my identity.

My name is Name, a federally protected consumer, and I am making this complaint against Recovery Management Services, for committing identity theft. I have never given Recovery Management Services, any permission to use any of my identifying information to commit mail fraud by contacting me about an alleged debt they claim I owe. I am aware that in accordance with Article 9, the assignment of a defaulted note is illegal. Both the assignee and the assigned are both liable for violations under 15 U.S. Code 1692e I have not validated any alleged debt with ( COMPANY ) and my failure to dispute the validity of these alleged debts shall not be construed as an admission of liability. As of XX/XX/2022, I have not received any documentary evidence, such as a trilateral contract, giving Recovery Management Services any right to collect on this alleged debt. I have never received any documentation requesting validation from Recovery Management Services, before they committed multiple violations under the FCRA and the FDCPA by furnishing this alleged debt to my consumer report, including but not limited to 15 U.S. Code 1692d ( 4 ) which the FTC defines as debt parking. If Recovery Management Services, can not provide me with proof such as a tracking number that they attempted to lawfully validate this alleged debt with me, the consumer, prior to furnishing it on my consumer report, this has been a fraudulently furnished account with forethought and malice as an attempt to bring harm to me and my financial reputation. I am legally refusing to pay this debt pursuant to 15 U.S. Code 1692c ( c ). I am demanding a cease and desist of all illegal activity, any communication and collection activity, of this and any alleged debts until Recovery Management Services , can provide me with sufficient documentary evidence that I have any legal obligation to pay them. If this documentary evidence can not be produced and Recovery Management Services, continues its collection efforts, I will file for litigation for actual damages caused and Recovery Management Services, will be held criminally liable for aggravated identity theft pursuant to 18 USC 1028A, extortion, theft by deception, securities fraud, and mail fraud. RMS DID NOT contact me about collecting a debt. RMS NEVER contacted me at any point in time to identify THEIR COMPANY as a company and to confirm if this debt is mine via phone call/voicemail, email, or mail nor have you sent me a debt contract in the mail. I found out about this debt by an alert of a negative impact on my CREDIT REPORT. How can RMS report a debt on my credit report without contacting me to verify that the debt is MINE AND VALID. When enrolling in the school I was notified how much I would need to take out in terms of federal student aid, and was also told I had to take some private loans from the school because the federal aid would not cover my education. I was not sure why I had to pay while I was going to school, as I assumed loans were to be payed after you finished school, but they required payments from me monthly while I was attending, which did not help me financial situation. I took out over {$25000.00} in federal student aid which I am currently repaying. I quit going to school at the beginning of the semester because of unforeseen financial hardship and soon began to receive calls and letters from the school stating I had a balance with them. I was unaware of this balance as when I logged into my account on the schools webpage, it stated my balance was {$0.00}, yet I kept receiving phone calls and letters stating I need to pay over {$2500.00} to which I had no idea about, or where it came from. When I finally spoke with the school they stated I needed to pay up. I told them I could not repay it all at once, and could only make a payment of about {$400.00} at the time, to which they did not seem to like, but I did so anyways. I had some trouble making payments from time to time so they sent me over to a collection agency to which I set up a payment plan with. While making my payments on time, I kept receiving calls and letters from them stating I needed to contact them asap. When I finally had the time to do so they would not respond. I attempted to call the phone number provided on the letter I received to only receive an empty dial tone like it was not in service. I also attempted to email them and still no response. I am now getting this reflected as negative points on my credit history and I do not know what to do about it. I can not contact the company, nor can I pay them. And I still do not know what this loan amount is for. I have been reading about scams this school has done in the past, and do not know if these are legitimate statements made but it worries me they are preying on me and trying to take money from me I do not owe them.

I called Recovery Management Services at XXXX on XXXX at to inquire about my defaulted loan. My loan had been on hold due to XXXX XXXX 's exemption promise. It was taken out of hold, and I did not know. It was sent to collections. I got a call from Recovery Management Services in late XXXX. I called today to get my loan out of default, so I can apply for federal student aid for XXXX XXXX I told her I need to apply to XXXX XXXX and I told her that at the beginning of the call. She used this precarious position to hang necessary information over my head, such as how to pay off the loan presently, what my login information to do so might be, and what my options to pay were. I called the company in order to resolve the issue as soon as possible. I expect decent treatment. This was not he case. The operator told me that my payment was bounced back from my bank, so I could not pay with a payment plan anymore. She said credit card payments were available. She said " we will call you '' unlimitedly and as frequently as they want, to collect the debt. I took this as a threat. The balance is {$750.00}. I was taken aback, and told her I did not want to argue, just to know my options. She told me there was no payment plan available, and reiterated that it was because my ACH bounced back, so I asked if I could pay another way. She said the balance needed to be paid in full, and could be done online. She began to change the information, saying I could make multiple payments though the month of XXXX. I brought my dad on the phone, feeling suspicious about her inconsistent information. I told her he was there. She then said, I had until the end of XXXX to pay the loan, not that it was due now, as she said before. In XX/XX/XXXX, I was contacted by Recovery Management Service on a debt they said originated from XXXX University Online which I had previously attended starting in XXXX to pursue a XXXX XXXX degree. All of my payments were from Student loans and this handled through FAFSA.When I withdrew from XXXX in XXXX or so due to personal commitments they had done some creative accounting by charging for classes I had not taken, then sending back all of my student loans and grants from the current and previous Semester. This in short showed I had a debt to the school for {$9900.00}. This had happened once before with them when I dropped out in XXXX they sent my federal funds back and claimed then a balance of {$10000.00}, Some months later when I was contacted by the school I agreed to re-enroll after they corrected the accounting error in which XXXX admitted they made a mistake and re submitted for federal student funds and I had a small balance of {$630.00} for a dropped class. This time I did not re enroll as I found the communication and service very lacking and decided to look elsewhere, when I did the same thing happened and now RMS is saying I owe this debt. But in XXXX XXXX and its parent company were closed down to misuse of Student Loans, they essentially sent back students funding but instead kept the money for personal expenses. I have tried to no avail to sort this out with RMS but it is difficult now that XXXX has been shut down essentially because the Federal Government would not send anymore student aid to them and they filed for Bankruptcy closing all campuses. OK, I get this letter from a collection agency for {$630.00} for a college in Arizona ... This debt was previously sold to two different debt collection agencies- XXXXXXXX XXXX XXXX and Recovery Management Services . Per my previous complaint with the CFPB, this debt was legally guaranteed from XXXXXXXX XXXX XXXXXXXX to be deleted from my credit infinitely under the circumstances of obscene harassment and threatening me illegally. This debt was then collected by another agency ( RMS ) who has persistently harassed me and I have filed a complaint in XXXX of 2022 for that. I was enrolled at XXXX XXXX University in XXXX but I was not eligible for financial aid. I withdrew from the classes before the financial aid deadline because I would not be able to afford to pay the tuition out of pocket. I did not partake in the classes after that date. It is very ironic and stressful that I am being asked to pay for a service that I did not want to use because I could not afford it. I have been contacted by Recovery Management Services on the dates of XXXX, and XXXX. I made it known during the first phone call on XXXX that they are not to call me, and that I can not take calls as I work from XXXX to XXXX, however, the same individual proceeded to contact me again on XXXX. I forgot the name of the agent, however upon speaking to her several times trying to explain to her that I could not afford any of the options she was giving me. She told me that I had to figure it out ( somewhere along the lines of that ) and then hung up on me. I called back and told her that I no longer wanted to speak with her via voicemail because no one answered. However she kept calling me to the point that I needed to block her number. I have attempted to resolve this issue previously with this company Recovery Management System ( RMS ). On XX/XX/2001, the balance stood at {$7000.00}, but XXXX XXXX agreed to settle the debt for XXXX XXXX XXXX loan for {$4000.00}. Called my employer asking for me passing himself as a sprint customer that need to speak to me. When a manager picked up the phone and asked the caller who was asking for me the caller responded im a customer. i requested the contract between RMS And i but yet i received my tuition bill which should be private due to it having my personal information on it. it also came back verified even when i asked them to conduct a proper investigation which was never conducted nor provided to me as requested. On XX/XX/2017 I got a call from Recovery Management from a masked number which was XXXX informing me or legal counsel to call XXXX with a case number of XXXX. Persons name was XXXX XXXX and when the Manager came on he demanded XXXX dollars on my debit card to hold my settlement amount of {$700.00} from a old XXXX debt. He threatened me with court action without letting me talk and hung up. I told them I settle for the {$700.00} but did n't have any money. I even said I 'll pay the {$50.00} to hold my settlement but as a one time payment not as a recurring payment. The manager said NO and said " we 'll see you in court '' and promptly hung up without letting me talk. I received a call from RMS Recovery Management Services on Thursday XXXX XXXX. The female who called said I had to pay at least {$50.00} a month on the account. I had previously advised them that I could only pay {$20.00} a month. She refused to re-set up direct withdrawl monthly unless it was {$50.00} a month and would not help any further. I tried to set up the automatic monthly payments online, Again, it would only allow me to do so with a monthly payment of {$50.00} a month. Sounds like to me that she gets a commision if {$50.00} a month is paid, not {$20.00}. The reason it went to collections from XXXX XXXX was that, I could not afford the {$50.00} a month. If I could, then it would not have gone to collections. It was supposed to be taken care of by a student loan but I dropped classes and did not realize that would happen.

I was made aware of an account in collections with Recovery Management Serv on behalf of XXXX University in the amount of {$3400.00}. RMS has contacted me about 2 student loan debts from XXXX XXXX XXXX XXXX. One in the amount of {$6000.00} and the other around {$5000.00} ( estimating amounts ). I have attempted to call them to dispute and wrote a letter stating DO NOT contact me further about this debt as I was in a BNK CH XXXX in XX/XX/XXXX-XX/XX/XXXX and this debt was paid in full. I continue to get notifications from the collectors each year about this loan whereby once I contact them and let them know I was in BNK and the law states do not contact me they cease and decease. RMS continues to try unlawful tactics to collect on this erroneous debt. My BNK was successfully paid off and all creditors should have received notification from the US Federal Court in Texas. This debt collector has obtained my private, personal information illegally. I have tried to fix this problem with the XXXX XXXX XXXX but the collection agency stopped responding. I then contacted XXXX XXXX and they stated the debt collection agency was adding the debt. When I went back to the debt collection agency, they continued to deny adding the collection fee. They specifically stated on a recorded phone conversation that they did not add the fees and XXXX XXXX added the fees. After speaking with XXXX several times, they stated this is false. I filed for bankruptcy 3-4 years ago, which I was recently discharged from. However, during that time they tried to contact me. I paid XXXX per month and the debt was fully paid off. I received threatening phone calls two months after my last payment telling me that I owed another XXXX.
