XXXX XXXX ( NMLS ID XXXX ) from XX/XX/XXXXcontacted me to refinance my loan. He said that we could remove the PMI from the loan and save me on my monthly payments. He was stating stating my new monthly payments would be {$1600.00} and provided me with a Loan Estimate. Leading into the closing, it was never addressed that my monthly payments would be any different. On XX/XX/XXXX, we had our closing schedule. While going through with the closing, I noticed that the new monthly payments had changed to {$1800.00}. I stopped signing the closing papers and called XXXX XXXX. He said he didn't get a chance to look at the documents before the closing and that he didn't have access to his PC as it was being worked on. I did not hear from him until later asking to have a conference call with him and his boss on XX/XX/XXXX at XXXXXX/XX/XXXX They finally called me on XX/XX/XXXX ( they were late ). During the call they were saying that the taxes in the area had risen significantly and this is the reason why. They said they had used the taxes from XXXX to do my estimate. They then continued to try and tell me that my existing mortgage company is not taking enough out in my escrow and that if I did not move forward with XXXX XXXX Mortgage, I would be short by more than {$1000.00} on my taxes for the next tax payment and that when that happened my existing mortgage company would either demand that I pay in full or spread it out in 6 months and that I would be better off moving forward. I asked if we could wait until Monday so that I could talk to my existing mortgage company before scheduling the closing and they said No. If I did not schedule the closing for Monday, it would be too late and that I would have to pay my Mortgage for XXXX and would not get the 2 month break on paying my mortgage like they promised me. So I said to go ahead and book the new closing for Monday, XX/XX/XXXX. I then spoke to my husband about everything and we both agreed this did not feel right and to cancel the entire thing. So I emailed XXXX XXXX on Saturday, XX/XX/XXXX around XXXX XX/XX/XXXXCST and told that we decided not to move forward and to cancel this. I spoke to my existing mortgage company today XXXX XX/XX/XXXX XXXX to discuss my XXXX account. They said they just did an analysis on it last XXXX and they believe they are in line with my estimated taxes for the year. I also noticed that on the Closing Disclosure, the closing costs where {$2000.00} more than what was on the Loan Estimate and this also was not disclosed to me before the closing. If I had moved forward with River City Mortgage, my monthly payments would have risen by {$10.00} more a month, even though I would no longer be paying PMI. I feel that they tried to do a bate and switch on me.

On XX/XX/XXXX we sought out a mortgage on a double wide home on a permanent foundation. We got pre approval from this company but later was told they dont fund mobile homes. So our realtor suggested a new company, River City Mortgage. Based on his suggestion we applied for the mortgage through them. We got the pre approval letter on XXXX along with the i rial disclosures. We submitted every document they requested within one business day. We then had the appraisal submitted on XX/XX/XXXX and it appraised at {$190000.00} which was {$2200.00} under our offer. My realtor called and asked what I wanted to do and I said I would not cover the difference. He told me the seller might walk away and I said thats fine and that if she walks away she walks away because we arent covering the difference. My realtor called me back very quickly and told me that the appraiser is going to fix the report to get it to our offer. I was led to believe that this was a small typo error. After that I was told we are closing before the new year. Then day after day we were delayed all the way up until XX/XX/XXXX when I asked my loan officer what has been taking so long. Thought this process I was told it was because the underwriter needed to review documents we submitted, but on Saturday the XXXX, the loan officer responded with the appraisal. I responded with oh how there was a typo error? He then answered with a long message that stated Well kind of the appraisal came in low because the appraiser incorrectly used the assumed sale price of XXXX when it was XXXX Then the sellers realtor called the appraiser and had her change the value ( illegal move between us ) and then told me about it AFTER Then the realtor increased it and noted it was based off of the sale price increasing ( not a valid reason to increase value ) So, its just been a XXXX show of trying to make sure the appraisal remains usable and complaint without having the underwriter report the act that happened because she can likely tell. So after talking with those close to me I decided to step away from the deal based on the above text. The illegal and unethical acts taken by the seller agent and the appraisal company and anyone involved in the cover up there in. Everyone wanted to steal the {$2200.00}, that the house didnt appraise, for from my fianc and I. Everyone benefited from this collusion except for us. This collusion made us feel cheated, disgusted, and distrusting in everyone involved.

My complaint is specifically about false advertising. An unsolicited offer was mailed to us by River City Mortgage for an APPRAISAL FREE REFI for which they indicated " our home has met the requirements. '' Upon inquiring about the refinance and speaking with the loan official, we were told that the Appraisal Free is NOT provided in our area. Clearly a " bait and switch ''. We did not proceed with the refinance due to this. I have the offer which includes the specific reference number for an APPRAISAL FREE REFI, and indication of New property value estimate of {$310000.00}.
