This formal complaint is being made against XXXX XXXX ( XXXX ) and Rickart Collection Systems , Inc. ( Rickart ) On or about XX/XX/XXXX, I went to my beach house located in XXXX to find out that the electricity was cut off. It took some time, but I was finally about to speak with a customer service representative who informed me that the last payment on the XXXX account was in XX/XX/XXXX. This information was a shock to me, however, I was told that I could pay {$380.00} at that time to activate the electricity. During the discussion with the customer service representative, the billing address and phone number were outdated and I provided current information. I also explained to the representative that something was wrong since I had been getting the bills. The representative was not able to help me further. Even after providing my current information to XXXX, I did not receive any further direct communications from XXXX until a collection notice dated XX/XX/XXXX from Rickart seeking to collect {$1100.00} on behalf XXXX was received. I responded to the notice from Rickart and tried to explain what had happened. Rickart did not have access to the XXXX account information and assistance was limited. However, my concern was with my current bureau information which is pristine. Therefore, I paid the amount and asked that I get copies of the XXXX statements going back to XX/XX/XXXX. To date, I have not received any copies of the XXXX statements. The weather in the East coast has been below average temperatures and I have been concerned about the status of whether there was electric power to my XXXX home. I called XXXX on XX/XX/XXXX to discuss the current status. Again, it was very difficult to get information because XXXX did not have my social security associated with any account. Since I had not received a bill from XXXX since XX/XX/XXXX, I did not have a statement and I did not know the account number. My bill payment service truncates the account number, so again, I did not have the account number. After some time and trying my husbands social security number ( although he has been XXXX for 14 years ), the representative shared some information. The facts confirmed by the representative on XX/XX/XXXX over the phone : The representative that took payment onXX/XX/XXXXXX/XX/XXXX, did not follow procedure and did not set up another account for me. The representative that took payment on XX/XX/XXXX did not advise me that the account was in collection. The representative that took payment onXX/XX/XXXXXX/XX/XXXX did not update the account with current information social security number, address and contact phone number. The representative on the XX/XX/XXXX call confirmed that the XX/XX/XXXX and XX/XX/XXXX bills were going to my current address XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX. The representative on the XX/XX/XXXX call confirmed that XXXX updated its system in XX/XX/XXXX which impacted my account and causing it to revert back to an old address. The representative on the XX/XX/XXXX call said that she could not provide copies of my statements. My complaint is that the account went into collection due to XXXX system change and that system issue is likely to impact other accounts. I have established a strong credit history and an examination of my payment record with XXXX will support my strong payment history with XXXX. When I receive a bill, I ensure payment is made on a timely basis. I request that XXXX and Rickart provide an accounting to show that the total amount collected and paid by me : {$380.00} + XXXX = {$1400.00} does not include any late fees, penalties, collection fees or other fees or charges. Any amounts other than for actual electricity used should be refunded with interest. XXXX and Rickart should also ensure that my credit history is not impacted by the error made by XXXX. I had arrived home at approximately XXXX on XX/XX/XXXX and grabbed the mail. There was notification from Rickart Collection Systems , Inc. stating that they were a debt collector from my account with XXXX and must notify them within 30 days of receipt of this notification if I dispute this debt. I called up my representative XXXX that night at approximately XXXX. I inquired about the debt and she stated that this was a debt that was from XX/XX/XXXX to XX/XX/XXXX in the amount of {$1100.00} for services from XXXX at XXXX XXXX XXXX XXXX. I have not resided in that home since XXXX. I had filed Bankruptcy and was discharged of all debt in XX/XX/XXXX from this residency. XXXX XXXX XXXX is a duplex that I purchased and is under one parcel. I find it funny that now at the end of the 7 years this resurfaces and that XXXX is again trying to collect on old past debt, debt that was included in the bankruptcy and now appears that they have created a story to get me attention to make contact with them to discuss and collect on past debts. I stated that someone has taken my identity and put service in my name but for only a 3 month period? XXXX advised me not to call the police to make a report until after I call XXXX. She stated to put the dispute in writing. I hung up with her and then called XXXX and spoke to a representative. He had stated that the bill is from past accounts in addition to this new account that was created on XX/XX/XXXX through to XX/XX/XXXX which was put in my name. Again I have not lived at this address for many many years. He stated that there is old account balances and when someone comes up for service with the name it attaches that debt to the new account in hopes of collection or termination of services when payment is not made, which has happened in this case. The only problem is, is that its not me, I do not even have XXXX as my electric provider close to 7 years now. Also, they sold off any past debt to collection agencies so why are multiple people trying to collect the same monies? This is very wrong and I feel that they are in hopes of trying to scare me into paying money not due or to falsely create a new collection inquiry on my credit report.

THE COMPANY, RICKART COLLECTIONS SYSTEMS, INC, PURCHASED A DEBT FROM ANOTHER COMPANY AND I HAD NO INVOLVEMENT WITH THE TRANSACTION. ACCORDING TO 15 USC 3002 ( 1 ). I AM AN NATURAL PERSON WHICH MEANS MY NAME IN ALL CAPS IS NOT ME. MY NAME IS XXXX XXXX . 15 USC 1692 ( A ) ( 1 ) The term Bureau means the Bureau of Consumer Financial Protection. XXXX, XXXX and XXXX are assumed to be credit bureaus and there is only one Bureau and that is the Consumer Financial Protection Bureau. On XX/XX/1933, Congress enacted HJR-192 to suspend the gold standard and to abrogate the gold clause. This resolution declared that Wheras the holding or dealing in the gold affect the public interest, and are therefore subject to proper regulation and restriction ; and whereas the existing emergency has disclosed that provisions of obligations which purport to give the obligee a right to require payment in gold or a particular kind of coin or currency... Are inconsistent with the declared policy of congress in the payment of debts. I moved out of my old apartment on XX/XX/2022 and I requested XXXX stop service to my apartment on that date. I submitted a stop service request on XX/XX/2022. XXXX confirmed this stop service request on XX/XX/2022. I continued to be charged through autopay until XX/XX/2022, which totaled to {$81.00}. I attempted to contact XXXX on multiple occasions about this issue. On XX/XX/2022, I called XXXX to discuss the issue and was told that it would be resolved. It was not so I called again on XX/XX/2022. This time i was given an email i needed to send my new lease to in order to prove I had moved. I sent my lease to this email on XX/XX/2022 and didnt receive a response. I continued to be charged, but had turned off autopay. The bill would show up as late. I followed up on XX/XX/2022 and was told again to send proof of moving and of my stop service request. I did both. XXXX did not respond and continued to charge me. I followed up on XX/XX/2022 and did not receive a response. Despite all of this, XXXX continued charging me and eventually sent the remaining debt to a collection agency. I have been receiving mail from Rickart Collection Systems , Inc. since XX/XX/2022 stating that i owe them {$34.00} as the remainder of my XXXX bill. XXXX actually owes me {$81.00}, as i have not lived in the apartment for almost a year and provided ample proof of this, including my original stop service request which was submitted well before i moved out. The most recent mail i received from Rickart Collection Systems , Inc was on XX/XX/2022. I still have not received any responses from XXXX.

As of XX/XX/XXXX, I was a victim of identity theft. These fraudsters used my identity to purchase goods and services, opened credit accounts, bank accounts, and other items not approved me. As a result of this, I closed all of these accounts and froze my credit so that no attempts to open more accounts under my name could successfully go through. On XXXX, XX/XX/XXXX, I received a notification through XXXX about a XXXX point drop on my credit score as result of a debt owed to XXXX XXXX Upon further review, I contacted XXXX and they informed me that there was a debt collection under my name in the amount of {$1100.00} for the following address : XXXX XXXX XXXX XXXX XXXX XXXX, MD XXXX. This debt owed stems from an account that was opened in XX/XX/XXXX. I have never lived at this address nor have I opened a XXXX account. My current address is XXXX XXXX XXXX, XXXX, MD XXXX and I have lived here for 26 years. This debt is now with RICKART COLL SYSTEMS. Original creditor : XXXX XXXX XXXX. XXXX instructed me to file a police report and an FTC report to get this matter resolved and removed from my credit report. Rickart Collection System placed this debt of {$5100.00} on my credit report on XX/XX/2016. I have never opened an account with this company, nor XXXX XXXX. I have been applying for apartments for me and my soon to be born first child and by this appearing on my credit report I have been constantly denied. Someone must have used my name and created an account of their own because I have never had an account with this company, because this is the first time I have been on my own seeking for a place to stay.

I paid my final bill with this utility company after the end of my lease. Months later I receive a bill in the amount of {$21.00}. Once I received the forwarded bill to my XXXX XXXX , I mailed it in and the check was returned " cashed '' by the same utility company ( XXXX ). I then received a letter from Rickart Collection Systems requesting payment. I have attached both the collection notice and the proof of the cashed check.

I was mailed a letter on XX/XX/XXXX regarding a debt that was due. I contacted XXXX from the company on XX/XX/XXXX and told her that the debt was paid. She required me to provide proof. I explained that the initial debt holder who contracted with RCS should provide that as I made full payment of the initial amount owned to the initial creditor in XX/XX/XXXX.
