This is my 3rd time submitting a complaint against Rhodes Kelly & Associates. They have once again failed to provide me with adequate validation of the medical debt that was placed with this office. In addition, they have violated HIPAA by sending me a copy of medical correspondence displaying personal information. They claim that there is an agreement in place that allows the obtaining of this information. I was not made aware of this agreement prior to this information being sent to them. The information should have been sent to me directly from the original creditor. I mailed a letter to Rhodes Kelly & Associates on XX/XX/2018 regarding this HIPAA violation ; they are aware that they have 30 days to respond. Please note that 30 days had past and they didn't respond or mark my credit file as disputed. My credit file was updated on XX/XX/2018, indicating a {$28.00} decrease in payment, this is well over 30 days. They are required by federal law to place a " notice of dispute '' on my account within 30 days of my dispute ; Keep in mind they signed for the certified letter on XX/XX/2018. I have retained a copy showing date of receipt, as well as a time-stamped copy of my credit reports showing that you have violated the Fair Credit Reporting Act, Section 623 ( a ) ( 3 ) and/or the Fair Debt Collection Practices Act Section 807 ( 8 ) by not placing the disclosure within the required 30-day period. I am demanding for these collections to be removed from my XXXX credit file immediately or it leaves me no other choice but to proceed with legal action.

I have contacted the original creditor XXXX XXXX and spoke to several reps there. I was informed that Rhodes Kelly was not instructed to report this account to the credit bureau. Therefore it should be removed from my credit report immediately and sent back to XXXX XXXX. My second issue is XXXX XXXX provided an itemized bill to Rhodes Kelly, I did not authorize them to send my information to Rhodes Kelly Associates. This information should've been sent directly to me. There was no need for them to review this information this is PHI and is a HIPPAA violation. If they have some sort of agreement with Rhodes Kelly I was not made aware of it.

I clearly stated to them that I am paying them off so I don't see any collection bills and yet they keep sending it to the collections. Their first attempt to contact me to discuss a debt from a recent medical bill was to contact me at work directly. They did n't initiate by my cell phone or by mail at all. Told me, at work, that I needed to contact them before the original creditor decided to take further action. Totally unacceptable and unprofessional forcing me to respond and negotiate such items at my work place, in front of other employees.

The collection has been reported as pasted due balance. I do not know this company. I have never done any business with this company. This company does not have a contract with my signature.

Received a call from XXXX and she never indicated that she was calling from a Collection agency. Ive been paying on this debt that I wasnt aware of and they proceeded to send the account to the Collection agency??? Why?

On XX/XX/2020 I sent a debt validation letter to Rhodes , Kelly & Associates Inc. They failed to validate the debt by sending a bill back as proof.
