At this time I feel it is necessary to file this complaint and advise you of the following. Due to your company violating FCRA ( Title 15 United States Code Section 1681 ), FDCPA ( 5 U.S.C. 1692 -1692p ), and UDAPP this letter will serve as my Notice Of Intent to File Suit. Pursuant to XXXX Code Annotated, Title 22, Ch. 3, Article 1, Sections 10-30 ; Title 22, Ch. 3, Article 3, Sections 110-320 ; Title 15, Ch. 7, Sections 10-30 ; Title 18, Ch. 7, Article 1, Section 20 ; Administrative and Procedural Rules for Magistrate 's Court, Rules 1-19. I will be filing suit in XXXX District XXXX Court in the amount of {$20000.00} that is to include Statutory and Actual damages incurred by myself as a result of increased APR 's as well as out right denial of credit. As we both know companies tend to wait until the suit is filed and wait until the last day before their answer is due to the court to offer settlement. I will advise you once the case is filed I will not even entertain an offer for settlement. I have already spoke with a law firm and advised them of the situation and if an agreement for settlement is not reached between myself and your company 14 calendar days from today he will be retained and take over the case in its entirety. But he will hold no settlement authority due to the disrespect your company displayed when ignoring documentation and request for validation of this fraudulent account.
Your company listed XXXX account with XXXX on my credit. This account was opened fraudulently and I had notified the original creditoras soon as I had seen them listed on my credit. Apparently they must have received the Fraud Affidavit and Dispute after selling it to your company. Never the less your company without mailing any documentation attempted to collect on this debt. FDCPA requires mailed documentation within 5 business days which to this day has still not been done. Now even after mailing the request for Validation of Debt and my letter of dispute for the second time back on XX/XX/XXXX I have still have not received any response or correspondence. Yet, the account is still being listed on my credit as a derogatory account thus violating FCRA and FDCPA.
What I am proposing as an agreeable settlement would be your company immediately updates all three credit bureaus to remove this charge off account as well as any associated inquiries and pays me {$5000.00} payment to settle any and all violations. Payment must be made to myself at the address listed above on or before XX/XX/XXXX. Considering the cost of hiring representation in XXXX plus the cost you would incur for my court cost and attorneys fees I believe that is a fair offer. Once a settlement is agreed to I would be willing to sign a " Release of all claims ''. On XXXX XXXX, XXXX I went to XXXX XXXX XXXX XXXX and I received attention in the XXXX. On XXXX XXXX, XXXX I received a hospital bill stating that I had to pay {$450.00}, which I paid in time. On XXXX XXXX, XXXX over a year later, I received a notice from a company called XXXX XXXX XXXX and they informed me that they are a collection agency that took over the account of the company XXXX XXXX XXXX XXXX XXXX XXXX which was a company charging me {$1500.00} for the doctor 's bills. They were charging me because I did not pay. I called XXXX XXXX XXXX XXXX XXXX XXXX and asked them why they sent me to collections if I did not receive a notice from them for over a year. They told me that they did try to communicate, but they never received a response and I asked them why is it that they say that they tried to reach me when I never received any notification but received a letter from XXXX and they did have my correct address and means to reach me. They advised me that they could not do anything because the account was in collection. I called XXXX XXXX XXXX and made payments arrangement. So far I paid XXXX a total of {$500.00}, with my last payment being made on XXXX XXXX, XXXX. On the first week of XXXX XXXX, I received an online notification from XXXX stating that I had an open account place in collection from another company named Revenue Recovery Corporation from the amount of {$1200.00}, which is a surprised since I paid to XXXX {$500.00}, so the amount should be {$1000.00}. Where the extra {$200.00} came from? I called XXXX to asked them why they sold my account to another collection agency. They answered me that the account was closed by the original creditor and I should call the original creditor which is XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I called XXXX XXXX and they told me they do n't know why XXXX closed my account when I was making payments. I called the other collection agency Revenue Recovery Corporation and ask them when are they planning to inform me about this account on my credit report. To this day XXXX XXXX, XXXX I did not receive any kind of communication from them. Is this tactics legal? Is this the right way to conduct business? I want to complain because the company XXXX XXXX XXXX XXXX XXXX XXXX sent me to collections without notice after a year. I also want to complaint about this new collection agency Revenue Recovery Corporation as they say I owned {$1200.00} which in reality it should be {$1000.00}. Why are they charging me {$200.00} extra? Why did they report me on my credit report when I was paying to the other collection agency?

I am writing about an item being improperly reported on my credit report. The first company is XXXX XXXX XXXX collecting for XXXX.This information is inaccurate because I 've NEVER EVER been to XXXX XXXX XXXX and you MUST be referred by a physician to get imaging. I go to the VA and they 've only sent me to another VA or XXXX. I told the credit reporting agency this fact and after they saw that I go to the VA another item appeared on my credit report from Revenue Recovery Corporation for XXXX XXXX XXXX XXXX. I could have actually gone to an XXXX XXXX but it would have been prior to the dates being reported and hence not eligible to be on my credit report anymore AND IT WAS N'T until I pointed out the falsehoods of the XXXX XXXX XXXX. THE XXXX WOULD NOT SEND ME TO XXXX XXXX XXXX because XXXX do XXXX IN THE HOSPITAL! I was a XXXX AND a XXXX prior to getting my XXXX so I know XXXX. It is my honest assertion that XXXX XXXX XXXX attempted to disguise some expired earlier debt that was removed from my credit report based on FCRA LAW. After I pointed out that fact, the Revenue Recovery Corporation looks to have attempted to " re-age '' an old debt to help substantiate XXXX claim. It does n't ; it shows some type of collusion because if Revenue Recovery Corporation was due to be on my credit report until XXXX it would have been on my credit report in XXXX when I first checked it and IT WAS NOT THERE. In addition if I was delinquent in XXXX then it would have been due to be removed ANYWAY, however, I HAVE NEVER GONE TO XXXX which makes the XXXX claim a straight lie. If I went to the XXXX as is claimed by Revenue Recovery Corporation it would have been off of my credit report due to time and it was off.
It appears that Revenue Recovery Corporation would have had to provide some type of information which allowed XXXX XXXX XXXX to add information to my credit report to a place that I 'd never been. The Revenue Recovery Corporation then took dates from the XXXX XXXX XXXX information in an attempt to " re-age '' a debt that had obviously been removed from my credit report based on FCRA Law.

I called this Revenue Recovery to ask for an itemized statement for a large medical bill I do not remember, I assumed it was a previous collection agency handling one of my other medical bills. They agreed to send it in the mail. I am trying to see if the VA will help me pay for any of the debt since I was n't close enough to a VA facility at the time. I agreed to make payments definitely, and told them it would be in various amounts and frequently throughout the month since I would pay with income from my employment and VA compensation. 2 days later, I have a new collections account on my credit report that just showed up. My credit score drops XXXX points and I find this extremely unfair to do period, especially 2 days after I contact them for verbal agreement. The only statement I have does not have my apartment number on it and that is why I told them I may have not been getting any other letters from their company. I 'm in a better place financially and am now able to pay on all of my debts simultaneously, I go about doing it and end up with this. There has to be some way to undo this. I am calling tomorrow morning and speaking with a supervisor. I have attached what I just found to be the original creditor ( the hospital ) on my credit report under the " Collections Removed '' portion. They are listed there twice. Duplicated, same name and amount of {$640.00} I know nothing about. Why was this there then removed? And who removed this? This is why I asked for the itemized statement, to verify amounts for instances like this.

My father was contacted by a debt collector ( Revenue Recovery Corporation ) by phone last week claiming that I owed money to a hospital for my son in an amount under {$100.00}. My father was mailed a letter and he forwarded it to me. There are several issues : Upon receiving the letter, I had to dig through records from XX/XX/XXXX to find an EOB with the amount. I have an XXXX debit card, so all my payments are tracked. I could not find a transaction with that amount. That means that I was never sent a bill in the past year. I was also never contacted by the hospital or debt collector by phone, e-mail, or mail. The letter also states that " Pursuant to your telephone conversation with our representative, you promised to pay $ XXXX on or before XX/XX/XXXX ... .If we are not in receipt of your payment on or before the due date or have not heard from you why, we will proceed with further collection activity. '' So, the hospital has not billed me, but they sent me to a debt collector. The debt collector never contacted me, but spoke with my father who lives in a different state and the debt collector claims that I agreed to pay a certain amount by a certain date.The letter also only has my name, not the name of my son -- who it is supposedly for. There is also no account number for me to reference ( either for the debt collector or the hospital ). They also have given me 4 days to pay before destroying my excellent credit which has no late payments or public records of any kind.

As I gathered information to give to the STATE 'S ATTORNEY GENERAL. I did a search for REVENUE RECOVERY CORPORATION license. I have found they are in direct violation of TENNESSEE FAIR DEBT COLLECTION PRACTICES ACT 62-20-101. REVENUE RECOVERY CORPORATION does not have a VALID license in the state of TENNESSEE. Their license expired in XX/XX/XXXX, 2016. They can not collect on a debt. TENNESSEE FAIR DEBT COLLECTION PRACTICES ACT 62-20-105 states no person shall commence, conduct or operate any collection service business in this state unless such person holds a valid collection service license issued by the board under this chapter, or prior stat law. TENNESSEE FAIR DEBT COLLECTION PRACTICES ACT 62-20-108 ( a ) ( 1 ) Every collection service shall have, for each location at which it conducts business a location manager who has submitted an application on a form prescribed by the board. TENNESSEE FAIR DEBT COLLECTION PRACTICES ACT 62-20-123 states a willful violation of this chapter, or any rule lawfully promulgated thereunder, is a Class C misdemeanor. First, none of the provided choices for the second question matched my issue, so I chose " Debt was paid '' so I could go to the third question. My issue is with Revenue Recovery Corp collection agency. On XXXX I went to the XXXX, I was seen XXXX and the problem was fixed. My military insurance paid XXXX XXXX all but {$35.00} dollars on my account. Revenue Recovery Corp receives the debt and reports the debt on my credit report broken down into several accounts : {$2.00}, {$1.00}, {$1.00}, {$2.00}, {$2.00}, {$1.00}, {$21.00}. Each XXXX was turned in as an account. This was also done XX/XX/XXXX, my bill was broken down into an amount per x-ray and turned in as separate account, XXXX separate accounts, if my memory serves me right! This was XXXX account broken down and turned in on my credit report as several separate accounts!!!! This has effected my credit score negatively as well as my Life! It appears to have been done purposely to effect my credit report as to force me to pay. This was a single account and it should have been turned into my credit report as such. If it is not illegal, it should be!

I have recently discovered some collections on my credit report that do not belong to me. Someone has used my name and now I am repeatedly being harassed and threatened for bills that do not belong to me. These agencies use XXXX collection attempts and the US Govt. should stop this. These collection agencies are relentless and they continue to call my place of business, my home, my friends and my relatives, all hours of the day or night seven days a week. I was involved in a motor vehicle accident. I went to the emergency room for treatment and gave my insurance details. I had health insurance. Instead of billing the insurance company the hospital sent me the bills. I repeated told them to bill my insurance company. After few months I hired a lawyer. My lawyer called the hospital to bill my insurance company. Despite my and lawyers repeated calls to bill my health insurance the hospital sent it to collection company. I received a letter from a collection agency regarding a medical debt. I sent a letter asking for information on the debt since I had no knowledge. I also asked nothing be reported to credit report until we could verify the debt. I have yet to received ANYTHING from them and it has since been reported to my credit report. I also sent a secured email to them through their website. They stated they could not tell me anything over the SECURE email even though I verified my information through it! They stated they could call me and I advised them they could send me a letter. I have also never received anything from that communication. I feel it is wrong to report something negative to my credit report without allowing me to verify and/or pay the debt once provided with the information.

No attempt was made to contact me either by mail or phone. The collection agency agreed to remove the collections back on XX/XX/2015. Now they have reinserted the same accounts a year later without notifying me within 5 days, according to FCRA standards. Instead of removing the accounts, I 'm continuously getting hassled to pay bills that I did not authorize. My Mother, made financial decisions with my account while I was on life support and I could not fend for myself.
I disputed those charges a year ago and all 14 accounts were removed. Now they have appeared back and Revenue Recovery Corporation says that they were never removed. I 've submitted proof of the removal and they are ignoring the evidence.

I paid this bill about 2 years ago and it is showing on my XXXX file that it is still in collections and my XXXX file is correct showing that I paid it and is off my file. I tried calling revenue recovery to explain the situation, but they said that it is closed and that I would have to call XXXX to clear it with them. These are small XXXX XXXX bills that are owed and I never received any billing statements or knew anything about owing these bills ( they are bills from 2 to 4 years ago ). Received a call from the Revenue Recovery Corporation regarding a past due medical bill in which was in a different name than mine.
