To resolve partner llc RPL XXXX I am writing this letter in response to a notice sent to me from your organization on XXXX XXXX 2011. This letter is not a refusal to pay, instead it is in accordance with the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested. Please note that this letter is NOT a request for VERIFICATION that the account exists, instead, I am seeking VALDIATION that I have a legal obligation to pay you for the account referenced above under the Fair Debt Collection Practices Act. In accordance with the Fair Debt Collection Practices Act, please provide me with the following : An explanation of what the money owed is for. An explanation of how the amount owed was calculated. Copies of any agreements signed obligating you to pay for the debt. Provide copies or other verification of any judgment ( if applicable ). Prove that federal and state statue of limitations applicable to the debt have not expired. Identify who the original creditor of the debt was. Provide verification that the collection agency is licensed to collect in my state. Provide their license numbers and registered agent. In addition, this letter serves to inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau 's ( XXXX, XXXX or XXXX XXXX ) this action might constitute fraud under both Federal and State Laws. When you rent from these apartments, the manager will be your real estate broker. Regarding the BAD MANAGEMENT of these apartments, at an apartment complex build and managed by the same company that is building and managing XXXX It appears as though management lied about the amenities that they offered such being a tanning bed and garages. It appears as though management and or other personnel of the apartments did willfully and intentionally alter our lease contract by extending the end date of the contract by one month without our knowledge and approval. It appears as though management and or other personnel photographed themselves as they vandalized the carpet in the apartment that we rented and vacated at the apartments. After vacating said apartment, we hired an apartment cleaning service to clean said apartment, and we hired a carpet cleaning service to clean said carpet. After management and maintenance personnel from the apartments examined and approved the condition and cleanliness of said apartment, it appears as though management and or other personnel at the apartments photographed themselves as they intentionally forced a finger between the seams of the carpet and ripped the seams apart. The management and or other personnel then blamed me for ripping the carpet seams apart and billed me for the replacement of the entire said carpet in the apartment and violating the end date of said lease. The same may happen to you. During construction you will eat dirt and your car will be covered with dirt. You will constantly head the sound of builders and machinery, and the amenities they promised you will either never be there of be built a year or more later. They are petty and rude and have a relationship with a collection agency that will submit your name and social security number to XXXX and other credit bureaus on management 's request. If you rent there you will be renting from fly by night builders that build apartment complexes sell them and leave town. Watch out for the mold, leaks, thin floors and walls and a manager that is a mean realtor. Fraud is the intentional use of deceit, a trick or some dishonest means to deprive another of his or her or its money, property or a legal right. A party who has lost something due to fraud is entitled to file a lawsuit for damages against the party acting fraudulently, and the damages may include punitive damages as a punishment or public example due to the malicious nature of the fraud. Quite often there are several persons involved in a scheme to commit fraud and each and all may be liable for the total damages. Inherent in fraud is an unjust advantage over another which injures that person or entity. It includes failing to point out a known mistake in a contract. There is a known mistake in a contract that was never pointed out to me by my broker. It also includes failing to not reveal a fact which he or she has a duty to communicate, such as not delivering promised amenities. My broker promised amenities including a tanning bed and garages as originally understood. The amenities of a tanning bed and garages were not delivered to me as promised. Constructive fraud can be proved by a showing of breach of legal duty such as lying about advertising amenities that were not delivered. Constructive fraud can be proved by a showing of breach of legal duty without direct proof of fraud or fraudulent intent. Extrinsic fraud occurs when deceit is employed to keep someone from exercising a right, such as a fair trial, by hiding evidence or misleading the opposing party in a lawsuit.

XXXX XXXX is the XXXX, and XXXX in the State of North Carolina. The XXXX XXXX apartments are located at XXXX XXXX XXXX XXXX, XXXX, NC XXXX, phone : XXXX. Based on my analysis of this situation, I hereby submit this complaint against XXXX XXXX, manager of the XXXX XXXX apartments, and XXXX in the State of North Carolina. Here are my thoughts. It appears as though management and or other personnel of the apartments did willfully and intentionally alter our lease at the apartments without our knowledge and approval. It appears as though management and or other personnel vandalize the carpet in the apartment that we rented and vacated at the apartments. After vacating said apartment, we hired an apartment cleaning service to clean said apartment, and we hired a carpet cleaning service to clean said carpet. After management and maintenance personnel from the apartments examined and approved the condition and cleanliness of said apartment, it appears as though management and or other personnel at the apartments intentionally forced a finger between the seams of the carpet and ripped the seams apart. The management and or other personnel then blamed me for ripping the carpet seams apart and billed me for the replacement of said carpet and violating the end date of said lease. Based on my analysis of this situation, I hereby submit this complaint against Resolve Partners. Here are my thoughts. When I refused to pay the collector for damages by management and or other personnel at the apartments to said carpet and what I think was contract malpractice by management and or other personnel at the apartments, the collector referred me to XXXX XXXX, thereby damaging my credit rating. The collector accepted this account from the apartments with I think possibly no proof of wrong doing by me. The collector accepted this account from the apartments and referred this account to XXXX XXXX with no substantiated proof of wrong doing by me.

I feel that I have not been treated fairly in this matter by XXXX XXXX XXXX, Resolve Partners, and XXXX. Please find attached a copy of the lease that appears to have been altered by management and or other personnel at the apartments. Please note that the collection agency or the creditor will probably refuse to show you the actual lease because the creditor altered the lease and have therefore incriminated themselves. Please note that the creditor has already sent a dossier regarding this case to the NC Department of Justice, and the NC Department of Justice has sent a copy of that dossier to me. If you look at the lease then you will see that the creditor simply changed the end date of the lease from XXXX/XXXX/2014 to XXXX/XXXX/2014 without my knowledge and approval. I applied for an apartment and they used a Credit background agency Ive never heard of, RESOLVE and while inspecting the information I see several issues that are out dated, addresses I never lived at, account that are reported erroneous, I had a Idenity Thief case several Years ago. and I sometimes see issues that the people used to gain some kind of use. 1 ) there are many different name variations, I did not spell my name any different ways other than I use it. Because of this I was denied a Place to live. I have no Rental or Utility Companies default, I am widowed and worked to rebuild my self and I see companies like this looking to create bad reports. My issues are the many errors reported 2 ) XXXX XXXX ( XXXX ) This item was a mail order TV trial which the original was paid.. I did not like the makeup and returned the package..But the company instead resent more, Telling me to keep it then sent a XXXX. I complained and they would not resolve the issue.. Thats why they no longer sell the products via TV, because that was not real according to their Ad. I have challenged it and than no one has ever taken the complaint serious.. also they added more fee. 3 ) I never ordered from XXXX XXXX but yet they keep insisting I did. I leased a home located at XXXX XXXX XXXX, XXXX, NC XXXX. My lease terms were XXXX/XXXX/XXXX through XXXX/XXXX/XXXX. I vacated the unit and returned possession XXXX/XXXX/XXXX. I relocated to XXXX, MO and entered into another lease agreement on XXXX/XXXX/XXXX. I never communicated or received any correspondence from the property owner or property management company until XXXX. I learned that on XXXX/XXXX/XXXX, the property management company, XXXX XXXX and XXXX requested possession of the unit through the XXXX County Courts. XXXX XXXX was award possession on XXXX/XXXX/XXXX. I did n't learn of the request for possession, any debt owed nor was it reported to any of the credit reporting agencies until XXXX XXXX, XXXX. More than 5 years later I received a notification from my credit monitoring service that an entry was added to my credit report stating I owed {$7100.00}. I knew immediately this amount was bogus. On XXXX XXXX, XXXX, I contacted XXXX County Courts for a record of what XXXX submitted as damages ( attached ). XXXX submitted to the courts a balance of {$1400.00} for past due rents and late charges ( which I disagree with ). However, they sold my account to Resolve Partners , Inc. and stated to this company I owed {$7100.00} in rents. They provided Resolve XXXX , Inc. an itemized statement ( attached ) stating I resided in the unit for 5 additional months after they had obtained possession from the courts. This is untrue. As I previously stated, I fulfilled my lease which expired XXXX/XXXX/XXXX and moved out of the unit on XXXX/XXXX/XXXX ( lease attached ). Furthermore, why would a property management company allow a tenant to remain in a unit without paying rent for 5 additional months after they obtained legal possession of the unit from the courts? XXXX fabricated the amount of the debt I owed them to be able to sell it at a higher price to Resolve Partners , Inc. Even if I am liable for the {$1400.00} that XXXX submitted to the courts, I was not credited for the {$950.00} security deposit I paid upon taking possession on XXXX/XXXX/XXXX. This would make my balance {$470.00}, not {$7100.00}. I have requested that Resolve Partners remove this inaccurate information numerous times and yet it still remains on my credit report.

Filed dispute online with all XXXX credit reporting agencies concerning the account from Resolve Partners LLC for {$2200.00} for damages to a house I rented from XXXX in XXXX SC XXXX XXXX to XXXX. I did have to vacate the property before the lease was fulfilled but the house was re-rented immediately. There was no dispute over the rent. The itemized bill they sent to me shows that fact ( see * on attached bill where it shows the amount did not change indicating there was no lapse of tenants ). The dispute is over damages. I caused no such damage as evidenced by a letter of reference written and signed by XXXX in Charge : XXXX XXXX ( see attached letter ). I have a long history of home rental and have never had a problem. There are no other such complaints on my credit files. I have always left the properties I have rented in better condition than I found them. I believe this dispute with XXXX resulted from my physical inability to complete the counter top after the kitchen stove was removed. XXXX recognized that the built-in stove that was there when I rented the house was severely damaged and posed a fire risk. I offered to remove the stove and use my own appliance relieving them, temporarily, of the duty of replacing it for me. I, however, did not agree to leave my stove when I moved. There was no other damage to the house from me. XXXX kept my security deposit which more than covers any perceived damages. Now Resolve Partners LLC is attempting to profit from this dispute by damaging my credit. I have written to them via certified mail and they have not responded except to update and reiterate this bogus debt. I have written XXXX as well who have also not responded. The credit reporting agencies ; all XXXX majors, have also not responded to my disputes. I believe the bill generated by XXXX XXXX XXXX serves as its own evidence that I do not owe this debt. It shows the inflated charges for petty damages, the unreasonable expectation that I finish out their counter top after the stove install, and the retention of my security deposit even though the house was immediately re-rented. Hi I am contacting you because I am dealing with multiple accounts on my report that are showing up due to fraudulent activity. I recently looked at my credit report and noticed multiple accounts on my report that were not opened by me, there are many medical collection accounts which I have never finance any of my medical costs. I am also seeing accounts from banks that Ive never opened an account with or gotten a loan from or even a credit card. I do not know how these items are showing on my report, I believe some one could have my information and is using it to open these accounts. It could also be some one elses accounts showing on my report. I received calls this company called Resolve Partners in XXXX NC I spoke to the male in the office he said so many harsh and unprofessional words to I asked to speck to his manger he said I could If I paid my freaking bill that I owe I tried to explain to him that I do n't owe this and that I applied for XXXX aprtments and I choose the other XXXX he said that I owe this amount and I better pay it. I reached out to my county court house and was told that it was a court hearing that I knew nothing about and that the judge only asked for the possession of the unit back not any money so I called the collection agency back and advised them of what I was told and offered to give them the proof that was given to me they declined and say you better off paying this we are n't going to remove from credit an they will do what they need to do to get this money and continued to call until I asked the attorney at my job to send them a letter and email and he did and they have stopped calling and he also sent them a letter to remove from my credit reports and they have continued to report me to all XXXX credit reports. I have never lived at this apartment complex and never had any utilities in my name there I choose my current apartment location instead and have proof and all my rental payments and utilities listed in my name. This company has given me so much stress and harassment and is ruining my credit. please, please please help me. Thanks in advance

Wednesday, XX/XX/XXXX, On Wednesday XX/XX/2019 a calls came to my job from Resolve Partners , LLC due to alleged negligent account, which resulted in conversation with my superior telling me no personal calls on the production floor. In speaking with several representatives ( XXXX. & XXXX XXXX, Collections supervisor @ XXXX ), I found not only were they combative, After multiple times being placed on hold, It is clear that Resolve Partners , LLC has never been held accountable for the impact of employee error on customers, misleading credit reporting, unethical collecting and deceptive practices. On XX/XX/2022 I sent a email and USPS certified letter to RESOLVE Partners in regards of the inaccurate information being furnished with their organization. I informed RESOLVE Partners in this email and USPS certified letter of each inaccurate account and how it was in-fact inaccurate. I am extremely concerned about privacy practices of this company. I was shopping for a new car and noticed a recent reporting from a collections agency. I disputed the charge in collections because I had already paid it to the property management company in XX/XX/2015 shortly after vacating the property. In response to my dispute, I received a letter informing me it is my debt to be paid and please refer to the lease attached. The lease attached was for an entirely different person at a different property managed by the same company. The letters included the full lease and all certified letters sent to this individual. I contacted the woman to inform her they had made this mistake and warn her to watch her credit report just in case they had done this before. She informed me she has had issues with identify theft and has been trying to dispute this charge for quite some time. I sent her a copy of the letter that was sent to me for her records. The order that the papers were in appears as though someone grabbed from a stack and assumed all of the papers below the letter addressed to me were mine.

I spoke to the manager at the property, XXXX XXXX and asked her to send me a detail copy of the supposedly bill I owed and as of today 's date. I have not received any information. On XX/XX/2018, I submitted an application to lease a house in XXXX XXXX FL. As part of the application, I agreed to a background and credit check. On XX/XX/2018 a credit/background check was conducted as part of the application. The inquiry into my credit history was a " hard '' inquiry vice a " soft '' one. This type of inquiry is not warranted for a just leasing a home. This type of inquiry is normally reserved when one requests credit in the form of a mortgage, credit card, loan. The information obtained, could have easily been done with a soft inquiry. The difference between XXXX and XXXX is now 22 points. Prior to the hard inquiry, they were the same. I called the company to ask why, and even after discussing the difference between hard and soft inquiries, they simply stated " we do hard inquiries '' They need to stop doing this, and immediately restore to my credit rating.

This apartment complex has on my credit report that I owe over 4,000 dollars. When i vacated this premises I was only 2 to 3 months behind with a rent of XXXX. I completed an application to rent a residual property. I sent the application without my SSN due to the SSN guidelines.
